(LDF) announced Sherrilyn Ifill will become its next President and Director-Counsel in January 2013. LDF has fought to expand political participation, forestall injustice in the criminal justice system, broaden the avenues of educational opportunity, defend economic freedoms and further the nomination and appointment of fair-minded and diverse judges through impact litigation and advocacy for over seventy years. Ms. Ifill is a long-time member of the LDF family. Early in her career, she served as assistant counsel in LDF’s New York office where she litigated voting rights cases, including the landmark Voting Rights Act case Houston Lawyers’ Association vs. Attorney General of Texas. In 1993, Ms. Ifill joined the faculty of the University Maryland

School of Law where she continued to litigate and consult on a broad and diverse range of civil rights cases while grooming the next generation of civil rights lawyers. A critically acclaimed author, her book “On the Courthouse Lawn: Confronting the Legacy of Lynching in the 21st Century,� reflects her lifelong engagement in and analysis of issues of race and American public life. National President of NPHC, National Urban League CEO Gives Support to Motivating Students for Academic & Career Success The Motivating Students for Academic & Career Success Program has been put on a fast track to begin incorporating its chapters outside of Louisiana and to have it completed by spring 2014. The organization which began back in 2009 has received the national attention and support from some very influential individuals both far and near who have all stated that they support the goals and objectives of the organization and they support the leadership of Montrell McCaleb as the organization’s First National President and CEO. Delta Sigma Theta Sorority, Inc., National President Cynthia M.A Butler-McIntyre who also serves as a member of the Motivating Students for Academic & Career Success Board of Trustees was the first NPHC President to come out in support of the organization and she is main reason McCaleb and his organization has had the success it has had in the communities in which the organization serves and the NPHC Community as well. Vouchers Face Days in Courts BY JOHN MAGINNIS AND JEREMY ALFORD The most significant legislation ever signed by Gov. Bobby Jindal faces two big days in court when his administration answers challenges to his school voucher law before state and federal judges during the week following Thanksgiving. 43 school boards in a trial set for Nov. 28 in state district court are testing the law, providing private-school tuition to more than 5,000 public school students. Before then, the state’s lawyers have to tell a federal judge on Nov. 26 why the law does not interfere with a desegregation order for Tangipahoa Parish schools. The Tangipahoa Parish School Board argues that it is unable to comply with the federal desegregation order, including new school construction, because of the diversion of local tax funds to the voucher program. The diversion of local funds is also the basis for the school boards’ constitutional challenge in the state case. The Jindal administration counters

that the law is constructed so that no local funds go to vouchers. Instead, an amount equivalent to the state and local portion is deducted from payments to local school districts for each voucher student. U.S. District Judge Ivan Lemelle will conduct the first hearing. After that, Jimmy Faircloth, who is representing the state along with state Department of Education lawyers, hopes Lemelle will wait to rule on the matter until after the case in state court is decided. “If we are right that these are not local funds, there is no federal case,� said Faircloth. “If they (the school boards) are correct, then maybe there are federal issues.� Bob Hammonds, attorney for the school boards, did not return a call for comment. Faircloth does not expect a long state trial. “It is really an issue of law,� he said. If the state loses in district court, it can appeal directly to the state Supreme Court. If the state prevails, the Supreme Court has the discretion to accept writs or to have the appeal go first to the Court of Appeal.

BY JULIANNE MALVEAUX NNPA Columnist When I think of Thanksgiving Day, I think of family, gathered around a table that groans with turkey and dressing, green beans and candied yams, mac and cheese or whipped potatoes, and lots of other goodies. I look forward to seeing folks I haven’t seen in a while, savor the food and fellowship, bring in the late evening over coffee and pie. Nobody is rushing out to go shopping – most people save that for the Friday after Thanksgiving, often called, Black Friday, because many stores find themselves in the black after the profligate shopping that day. There have been tragedies associated with Black Friday. A few years back, a Walmart employee was trampled to death by a crowd way too eager to get to the consumer goods. There have also been altercations, bruises, and cuts as customers have vied for some of the scarce goods available or for crazy deals (often only for the first 200 people). Lines often snake around stores as people wait for a chance for a bargain. Now Walmart has upped the ante. Last year, they opened at 10 p.m. and this year they will open at 8 p.m. on Thanksgiving Day. Just

Federal Highway Administration Rebuked for Inadequate Safety Standards for Signalized Intersections Every day millions of U.S. drivers risk serious accidents caused by traffic signals with yellow-light timings that are set too short. That is why the National Motorists Association (NMA) has sent an urgent appeal to Federal Highway Administration (FHWA) head Victor Mendez to change current federal guidelines by mandating acceptable yellowlight durations. In a letter dated Nov. 15, the NMA cited specific safety benefits of setting proper traffic signal cycles. “Short yellow lights force many responsible motorists to make split-second decisions that can lead to unwarranted traffic tickets, or worse, intersection collisions,� said NMA President Gary Biller. “The current federal guidelines on yellow-light durations consist of inadequate

recommendations, not proven engineering requirements.� The NMA letter highlighted a study that determined a onesecond increase in the yellow-light interval reduced intersection collisions by 40 percent. The letter also pointed to an example of a major U.S. city that is deficient in its yellow-light intervals by one second because of inadequate guidelines by the FHWA. In addition, red-light camera operators use this national standards deficiency to set yellowlight times that frequently don’t give drivers enough time to stop as the traffic light turns from yellow to red. “Cities and for-profit camera companies maximize revenue by setting yellow-light times that are too short,� Biller said. “It is a violation of the public trust, and See FEDERAL, on page 7

when folks settle down from their meal and start swapping lies, someone is going to have to get up and rush to work so they can serve those consumers who want to shop on Thanksgiving Day. Many of those who will work do so out of desperation. Many Walmart employees don’t have a full 40-hour shift; some find their hours adjusted each week. Thanksgiving work will augment scarce incomes. Just this week, I talked with a couple whose joint income at Walmart is $26,000 a year, partly because neither has a full week’s schedule. There are those who ask, “Well, why do they work there?� as if there are easy alternatives. But Walmart is one of our nation’s largest employers, and they often set the tone for similar stores such as Best Buy, Sears and others. With Walmart opening at 8 p.m. on Thanksgiving, their competitors will follow because they don’t want to lose momentum to Walmart. This is why some Walmart employees are protesting the way that Walmart treats its employees. They want to inform the public of illegal actions that Walmart has taken against its employees, and have initiated a series of protests, including strikes, rallies, an online campaign, and other actions. Their orga-

nization, Making Change at Walmart, says that Walmart can help revive our economy if they will simply offer workers full-week schedules and fair pay. Barbara Ehrenreich captured the ways that people are forced to work at a store very much like Walmart in her book, Nickeled and Dimed. She wrote about the workers who were forced to work “off the clock,� after they had punched out, or before they punched in. She wrote about the low pay. And she wrote about those supervisors who had made a deal with the devil – implementing unfair policies for their own survival. When Walmart employees speak out there is retaliation. They are fired, or their hours are cut back. They very swiftly get the message that speaking out will be punished. Too many silently seethe at unfair policies; too dependent on the little pay they get to raise their voices. This is why the Making Change at Walmart campaign is so important. It challenges the notion that economic growth is dependent on the exploitation of workers, and suggests, instead, that paying people a living wage is a way to grow a stable and secure workforce. Walmart is not the only company that prefers to pay

its workers on a part-time basis. Many fast-food operations do the same thing, varying hours each week so that workers have no way of knowing when they will work. This means they have difficulty arranging for childcare with these variable hours. Of course, that this does not concern their employers. They are more interested in their bottom line, profits. Many who are aware of the labor exploitation at Walmart say that their prices and deals are unbeatable, and with their money tight they have no choice but to seek the best bargains they can find. Yet the price of the great deals is exploitation of another worker. The action to inform Walmart customers about Walmart’s unfair pay and illegal actions allows people who shop on Thanksgiving Day and on other days to make informed decisions about their shopping. One of the ways consumers can make a statement is to stay home on Thanksgiving Day, enjoying family, giving thanks, and postponing shopping. Falling off the Fiscal Cliff

Will we jump from the cliff? Congress and the president will determine whether we fall, jump, or back away from the cliff. While I trust they will get together and make the right decision, I think we should be prepared for the worst case scenario. How do we prepare? First of all, learn what the fiscal cliff and its implications are for your personal economy. Too often we put ourselves in a position of having to react to things that have taken place while we were sleep, literally and figuratively. We had better stay awake on this one, folks. In general, the fiscal cliff refers to $7 trillion in tax increases and spending cuts that will take place on January 1, 2013. For most of us, on a personal level, it means that we can say, Adios, Sayonara, Cheerio, Ciao, and Goodbye to that increase in take home pay, called the Obama payroll-tax holiday, we have been enjoying for the past year or so. Most workers would see a 2 percent tax increase instead because the “holiday�

was at the expense of the Social Security tax. The broader impact on the economy would be dire as well. The Congressional Budget Office (CBO) estimates it would cut gross domestic product (GDP) by four percentage points in 2013, sending the economy into a recession. It also predicts unemployment would rise to 9 percent with a loss of 2 million jobs. Neither individual workers nor the economy as a whole can absorb that kind of hit. With a little less than two months to prepare, you probably should be doing what the big corporations have been doing for a while now: Holding on to your cash. They have also been converting their financial instruments to cash. Have you checked out the stock market for the past few days? If the big boys and girls are scared of falling off the fiscal cliff, what should our position be? We have heard for the past three years or so that big companies have trillions in cash sitting on the sidelines waiting to see what will happen with

the economy. They want to be fairly certain of the long term strategies being put forth by the government. They are refusing to spend or invest or lend that money until they feel comfortable. We are complaining about it but that will not get them to release their money back into the marketplace. We complain; they retain. Our position should mimic theirs. We should not plan to sleep out all night and get up at 3 a.m. to stand in line on the Friday after Thanksgiving (and this year starting at 9 p.m. on Thanksgiving Day) to spend money we don’t have, to buy something we really don’t need, to impress someone who really doesn’t care. We should not use the upcoming “holiday� season to be an excuse for frivolous purchases, and a way to satisfy our instant gratification mindset. We should put off buying all the stuff we usually buy during this time of the year, until we are in better position to do so. Offers of credit cards, layaway plans, rent-a-couch or a Big Screen TV, and other schemes to

get money out of your pocket will intensify over the next few days. Watch out! You may get into that debt now and regret it later, especially if Congress and the president do not solve the fiscal cliff issue. On January 31, 2013, you will find yourself with more month than money if you are not careful. While I sincerely do not believe the boys and girls in Washington will allow us to fall, jump, or be pushed off the fiscal cliff, I do believe that whatever they decide and agree upon will hurt those at the bottom tier of the economy. Whether it’s a regressive gasoline tax, the elimination of tax deductions such as home mortgage, medical, and contributions, or whether they choose to put an end to cost of living increases for social security recipients, folks at the bottom will be negatively impacted the most. No, it’s not fair. No, it’s not the right thing to do. No, it’s not moral. But, after all, it is always about the money, and you See CLIFF, on page 7

What’s an awesome thing I can say about “Married to Commitment,� the bestseller in the making that I produced with my friend and prayer partner Brigitte “Bre� Eaton? This book is so powerful that every pastor should have a copy of it in his study. Every church should be using this book to help with its marriage and singles ministries. Rooted in the Bible, “Married to Commitment� shares wisdom by the volumes on how to build and maintain healthy, godly relationships. The book ministers to married couples, singles and divorcees alike. There are enough nuggets of wisdom in this dynamic book from which all who read it can glean. “Married to Commitment� also serves to help those caught up in abusive marriages or relationships discern whether the church they attend is equipped to minister to them or whether they should look elsewhere for help — such as another, more grounded church headed by fearless, Christ-centered, leadership. What I mean is there are countless numbers of people who are in marriages who turn to their pastors or church leadership for help when they have major marital problems. But those particular pastors are not filled with (or led by) the Holy Spirit, thus aren’t equipped to help them deal with their problems. At such churches, or under such leadership, a “leader� in the church is still allowed to minister to the congregation even though his (or her) spouse has gone to that (senior) pastor with a legitimate concern about that leader’s character. C’mon, y’all. I’m talking about the married deacon who has a girlfriend on the side, yet he still holds a leadership position, when he should actually be sitting in the pews (and developing a repentant heart). I’m talking about the church songstress who never has time to

cater to her husband at home. I think y’all get the point now. In so many churches, people cry out to their pastors (or church leadership) for help, for guidance. And all they can get, at best, is: “Just continue to pray. The Lord will work it out for you� or “Trust God� or “God can change him (or her).� Let me make this clear: I’m not saying this is the norm at every church. There are some great churches out there, and some awesome pastors who operate in divine wisdom, understanding and discernment, and they bear the fruit of the Spirit. So, to those pastors, I offer up great applause. But, again, to the pastors (or church leadership) who are quick to tell people who cry out to them for help to just pray (but then you don’t have in place a system of helping them beyond just prayer), you’re taking the weasel way out of dealing with what needs to be dealt with. Sure, people should be prayerful. At the same time, there are many instances where prayer, alone, won’t cut it. Some folk need to be dealt with. Some issues need to be met head on. “Married to Commitment� deals with this very real subject. In the book, we share with our readers how to identify the right pastor, the right church, where they can get the help — the ministry — they need. And if you’re divorced or single and you’d like to know how to avoid the mistakes of the past (as they relate to relationships), understand: Successful, new marriages or relationships are birthed from honest, self-evaluations concerning what went wrong in previous ones.

LSU Mid City Clinic Dedicates Live Oak in Recognition of World AIDS Day BATON ROUGE – The LSU Mid City Clinic will dedicate a live oak in recognition of World AIDS Day, on the clinic campus, at 1401 N. Foster Drive, in Baton Rouge, La., on Friday, November 30, in a ceremony beginning at 10 a.m. Large, sturdy and mature, the tree symbolizes the enduring dedication of LSU Health in the fight against AIDS. Its location, beside a bus stop and at the highly trafficked intersection of N. Foster Drive and Gus Young Avenue, will be a constant reminder of this fight and of the need for HIV testing as a critical part of the fight. The ceremony will be part of the clinic’s World AIDS Day Health Fair, from 10 a.m. to 2 p.m. The fair’s theme, “Zero Takes a Community,� refers to zero new HIV infections, zero discrimination for those with HIV/AIDS and zero AIDS-related deaths. “For the community to reach zero, people must know their HIV status,� said Dr. Tatiana Saavedra, with LSU Health. “If they have fallen out of HIV care, they can best meet their healthcare needs by returning to care and staying in care.� More than 30 community and government agencies, healthcare providers and local businesses are participating in the event. Metropolitan Baton Rouge ranked first in the nation for estimated AIDS case rates for the largest metropolitan areas in 2010, according to the Louisiana Department of Health and Hospitals Office of Public Health “STD/HIV Program – HIV/ AIDS Surveillance Quarterly Report� of June 30, 2012. LSU Health is the largest provider of HIV/AIDS healthcare in metro Baton Rouge,

known as the Baton Rouge Transitional Grant area. It includes the parishes of Ascension, East Baton Rouge, East Feliciana, Iberville, Livingston, Pointe Coupee, St. Helena, West Baton Rouge and West Feliciana. The LSU Health Baton Rouge HIV/AIDS active patient census is about 1,450 and growing and ranges from newborns to senior citizens. LSU is also pursuing several hundred patients in metro Baton Rouge who should resume their healthcare. The Health Care Services Division of LSU Health is one of the largest public healthcare

delivery systems in the country. Steelers Bring Plaxico Burress Back Home, Sign Brian Hoyer as QB Insurance Apparently, you can go home again. Receiver Plaxico Burress, the Pittsburgh Steelers’ first-round draft pick in 2000, has re-signed with the team he hasn’t suited up for since the end of the 2004 season. Burress, who caught 261 passes for 4,164 yards and 22 touchdowns for the Steelers, was brought in for a workout on Monday after injuries to Jerricho Cotchery and Antonio Brown left the team’s receiver corps very thin. Per the Pittsburgh PostGazette, Burress was signed after a Tuesday morning workout at the team’s facility. The Steelers also worked out former Penn State receiver Derrick Williams, but the threeman team of head coach Mike Tomlin, offensive coordinator Todd Haley and general manager Kevin Colbert decided that Plax should come back. “We’re looking at these guys with the potential to sign at least one at each position,� Tomlin said during his most recent news conference. “The men we will acquire will fortify our depth to win this football game.� Burress signed with the New York Giants before the 2005 season, missing out on two Steelers Super Bowl championships in the process. However, he caught the game-winning touchdown from Eli Manning in the Giants’

upset win over the New England Patriots in Super Bowl XLII. [Fantasy: Pickups of the Week] Soon after that, things started to unravel for Burress. In November of 2008, he accidentally shot

himself in the leg with a gun he was illegally carrying in a New York City nightclub. In August of 2009, he agreed to a plea deal that would put him behind bars for almost two years. Released in June of 2011, Burress signed a contract with the New York Jets

after turning down a two-year offer from the Steelers that would have given him less guaranteed money. He caught 45 passes for 612 yards and eight touchdowns for the Jets in 2011, but he did not return to the team and has not played anywhere through the 2012 season. To bolster their equally thin quarterback rotation, the Steelers also signed former New England Patriots undrafted free-agent quarterback Brian Hoyer, who threw 27 completions in 43 attempts for 286 yards, one touchdown, and one interception in three seasons for Bill Belichick’s team. He lost a training camp battle to Ryan Mallett in the 2012 preseason. The Steelers also gave former Philadelphia Eagles quarterback Mike Kafka a tryout. NEW ORLEANS– For the first time the 2012 Rickey Smiley HBCU Tailgate Tour will be landing in at the Bayou Classic in New Orleans. Rickey Smiley is set to be a part of the Bayou Classic Fan Fest being held pregame on Saturday, November 24, 10 am – 1:30 pm. Smiley, who is best known for his comedic work as host of BET’s ComicView, as well as appearances on HBO’s Comedy Jam and Snaps, will be a new addition to the 39th Annual Bayou Classic in an effort to make the game and events more fan and family friendly. Smiley will be signing autographs and addressing the crowd at Fan Fest all in anticipation of his new radio show coming to New Orleans in January. “We are excited to have Rickey Smiley join The Bayou Classic this year and we look forward to his appearance at Fan Fest,� said Dottie Belletto, President of New Orleans Convention Company, Inc., the management firm of The 39th Annual Bayou Classic. “In addition to the numerous other adjustments we’ve made this year, such as reduced ticket prices and our newlyreleased website, Rickey Smiley will be a tremendous addition to our weeklong series of events.� The Bayou Classic features one of America’s greatest college sports rivalries, bringing the fans and alumni of Southern University and Grambling State University to New Orleans for a celebration of football, family and the traditions and pageantry surrounding Historically Black Colleges and Universities.
