The DEA Is Not Having a Banner Year The chief of the agency stepped down in April under a cloud of scandal. The acting administrator since then has courted ridicule for saying pot is “probably not” as dangerous as heroin, and more recently he provoked 100,000 petition-signers and seven members of Congress to call for his head after he called medical marijuana “a joke.” This fall, the administration earned a scathing rebuke from a federal judge over its creative interpretation of a law intended to keep it from harassing medical marijuana providers. Then, the Brookings Institution issued a strongly-worded report outlining the administration’s role in “stifling medical research” into medical uses of pot. Then a group of 12 House members led by Ted Lieu of California wrote to House leadership to push for a provision in the upcoming spending bill that would strip half of the funds away from the DEA’s Cannabis Eradication Program, and put that money toward programs that “play a far more useful role in promoting the safety and economic prosperity of the American people” … domestic violence prevention and overall spending reduction efforts.

Each year the DEA spends about $18 million in efforts with state and local authorities to pull up marijuana plants being grown indoors and outdoors. The program has been plagued by scandal and controversy in recent years. In the mid-2000s it became clear that the overwhelming majority of “marijuana” plants netted by the program were actually “ditchweed,” or the wild, non-cultivated, non-psychoactive cousin of the marijuana that people smoke. More recently, overzealous marijuana eradicators have launched heavily-armed raids on okra plants, and warned the Utah legislature of the threat posed by rabbits who had “cultivated a taste for the marijuana.” Last year the DEA spent an average of roughly $4.20 for each marijuana plant it successfully uprooted. In some states, the cost to taxpayers approached $60 per uprooted plant.

MINNESOTA EXPANDS MEDICAL MARIJUANA USE TO PAIN PATIENTS After months of deliberation, Minnesota health officials announced that residents with chronic and intractable pain will be allowed to use medical marijuana starting in August 2016. Minnesota, which approved medical marijuana in 2014 but with extremely tight restrictions and currently only has 760 registered patients, could see a significant expansion of the state’s enrollment with this decision. Pot in leaf form is still banned; only two manufacturers make and sell marijuana pills, oils and vapors, which can be purchased at one of the state’s eight dispensaries. Ed Ehlinger, Department of Health Commissioner, said these tight restrictions, as well as stories from people suffering from constant pain, ultimately outweighed the medical community’s concerns that there was not enough evidence to use medical marijuana to treat pain. Ehlinger said in a statement that it was a “tough choice.” However, Ehlinger said, “given the strong medical focus of Minnesota’s medical cannabis program and the compelling testimony of hundreds of Minnesotans, it became clear that the right and compassionate choice was to add intractable pain to the program’s list of qualifying conditions.” Minnesota will be the 19th of the 24 states where medical marijuana is legal to extend the drug to people with intractable pain — defined in state law as pain that can’t otherwise be treated or cured. Dozens of those would-be patients had urged for it to be approved, eyeing medical marijuana as a possible relief from never-ending headaches or constant pain from back surgeries or car accidents.

MASSACHUSETTS LIKELY TO VOTE ON WEED IN 2016 It is almost inevitable that Massachusetts will be forced to answer to the issue of marijuana legalization within the next year. In December, the Campaign to Regulate Marijuana Like Alcohol, a group working to establish a statewide cannabis industry similar to what is currently underway out West, submitted more than 100,000 signatures to the Secretary of the Commonwealth in hopes of qualifying the necessary 65,000 to get their initiative in front of the legislative brass. If all goes according to plan, organizers could receive approval from the state later this month. “This is direct democracy in action,” campaign manager Will Luzier said in a statement. “People can see that our current prohibition policy isn’t working, and they’re taking action to replace it with a more sensible system. Based on the level of support and enthusiasm we saw during the petition drive, voters are ready to end prohibition and start treating marijuana more like how our state treats alcohol.” The proposal under consideration would allow residents at least 21-years-of-age to purchase marijuana from retail shops in the same way they do beer. Not unlike the drink, legal cannabis would be slapped with a special tax of 3.75 percent in addition to the states 6.25 percent sales tax. Once the initiative is approved by the state, it will go before the Massachusetts Legislature to see if local lawmakers are interested in picking up the issue during the next session. If they reject it, which is expected, supporters for the campaign will need to collect an additional 11,000 signatures to get the question in front of voters in November.

Marijuana Breathalyzer Test Coming Soon A new invention may soon make it easier for police who pull over risky drivers to test them for marijuana impairment on the spot, in addition to the usual alcohol breath test. A marijuana breathalyzer will begin clinical trials early next year, the Oakland, California-based Hound Labs Inc. announced early in December. “The idea is that law enforcement will have one device out on the road to test for both THC [a marijuana component] and alcohol,” said Hound Labs CEO and founder Dr. Mike Lynn, an emergency room physician at Highland Hospital, in Oakland. Typically, measuring the level of tetrahydrocannabinol (THC) — the psychoactive component in cannabis that gives users a “high” — is done using urine, blood, or saliva tests. The results can show if marijuana has been used in recent days or weeks, but they are not a very accurate way to measure real-time impairment. Hound Labs has been collaborating with scientists at UC Berkeley to develop the technology.

“The UC Berkeley scientists are a really good group, including the chair of bioengineering and the associate dean of the college of chemistry. It’s a complicated scientific challenge,” Lynn said. The handheld device will be tested for roadside use by law enforcement agencies in the San Francisco Bay Area and then Lynn hopes it will eventually be used across the country.

U.S. MARIJUANA GROWERS ARE USING UP $6 BILLION A YEAR IN JUICE As more states legalize cannabis in the United States, pot cultivation is sucking up an ever-growing amount of energy from the grid. Since most of the legal marijuana is grown indoors, the pot industry burns through large quantities of electricity used to power lamps, ventilation systems, and air conditioning. A square foot of planting requires some 200 watts of electricity, about the same as a data center, according to a report in the Columbia Journal of Environmental Law. The paper notes that marijuana plantations soak up at least 1 percent of the country’s electricity at a cost of $6 billion a year. The U.S. marijuana business has exploded in the wake of state efforts to legalize

the drug. Sales increased 74 percent in 2014 to $2.7 billion, according to ArcView Group, which conducts research on the cannabis industry. If all states legalized marijuana, the amount the industry spends on electricity could go up to $11 billion. That’s putting enough pressure on electric utilities that regulators discussed the issue at their annual meeting on Nov. 11, in a session titled “The Straight Dope on Energy & the Marijuana Industry.”

Marijuana Laws Could Loosen Nationwide While doctors can prescribe patients medical marijuana in 23 states, they legally cannot study how it affects their illnesses. But that could soon be changing. Federal policy classifies marijuana — medical and recreational — as a Schedule I drug. That label means the Drug Enforcement Administration (DEA) treats weed as equal to heroin, ecstasy and LSD. Paradoxically, drugs like cocaine and meth fall into lower,

looser categories which do allow clinical research. But the movement to federally reclassify marijuana as a Schedule II drug, like cocaine, is picking up steam. 2016 Democratic frontrunner Hillary Clinton broke news by publicly backing a federal reclassification, knocking marijuana down from Schedule I to Schedule II. It was the cautious candidate’s first time lending her voice to the cause. With medical marijuana laws spreading, Clinton says reclassification is now a necessity, explaining, “Researchers at universities, at the National Institutes of Health, could start researching what’s the best way to use it, how much dose does somebody need, how does it interact with other medications.” Other Democrats in the 2016 race are already comfortable in the marijuana overhaul camp. A handful of regulating entities overlap when it comes to drug classification jurisdiction, including: President, U.S. Senate, House of Representatives, Centers for Disease Control, Federal Drug Administration and Department of Justice. In response to Clinton’s recent shift on reclassification, White House Press Secretary Josh Earnest tempered public expectations for imminent change, telling media, “Our policy when it comes to marijuana hasn’t changed and I’m not aware of any policy process that’s underway to change it right now.”

THC vs. CBD:

What Is the Difference Between Tetrahydrocannabinol and Cannabidiol? In this issue, you will see a lot more of the holistic-attributed CBD oil and other products being showcased in BLAZED 420. WITHOUT A DOUBT, the creation of cannabis prohibition is one of the darkest and longest examples of American corruption at its worst. Every arrest, every imprisonment, every drug deal gone south, every kid getting sick on “spice,” every SWAT team assault, every job lost to a piss test and every cop thrusting his nose in your business to sniff for probable cause extends the injustice of the original corrupt act of making cannabis illegal. Since the 1960s, America’s prohibition of cannabis has pushed the entire world into a state of reefer madness. So far, more than 20 million Americans have had their lives destroyed by arrest and prosecution for a plant that some speculate has been a part of human existence since the dawn of man.

Somewhere in our country, an American is arrested for marijuana use every 37 seconds (according to the American Civil Liberties Union, or ACLU). Each year, here in Arizona, more than 16,000 people are arrested for cannabis charges. This year between federal and state law enforcement costs, Americans will spend more than $37 billion dollars funding our country’s war against its own citizens. Only now, hope is on the horizon that the horrors of prohibition will end at last — after decades of legal and electoral battles. Arizona currently has some of the strictest marijuana laws in the nation; but is also widely regarded as one of the top states likely to vote on ending prohibition next election. As the 2016 election cycle heats up, many people in Arizona are attracted to the ballot measure campaigns to legalize cannabis, or marijuana, for adult use, reversing the nearly 80-year prohibition against cannabis in America. So the question comes up: Why is there a prohibition against cannabis in the first place?

When Shouts of Joy Were Frowned Upon First thing to keep in mind is that it was not always so. American Cannabis Prohibition is a comparatively short period in the otherwise uninterrupted relationship between the plant and mankind that goes back all the way back to the dawn of civilization. Throughout recorded history, cannabis had been a staple in human agriculture. With the earliest written records of cannabis use going back nearly 5,000 years, Carl Sagan, the famous astronomer and unabashed cannabis enthusiast, even speculated that early man’s relationship with cannabis led to the development of agriculture and thus civilization itself. While that may be never be determined, written records document Chinese use of cannabis for medicines date back to 2700BC and there is evidence that the Chinese developed hemp rope making technologies as far back as 8,000 years ago. Hemp paper, hemp fabric, hemp fuel oil and hemp for food soon followed. Hemp rope and fabric, known as canvas, was so common the U.S. government claims that “up until

the 1850s, almost all the ships sailing the western seas were rigged with hemp rope and sails.” Though most of cannabis’ multiple uses were widely accepted and the plant became a key crop for many agricultural economies, the plant’s medicinal properties proved to be a bit more controversial. As its cultivation spread westward, Chinese, Indian Ayurvedic and Middle Eastern cultures all embraced cannabis as medicine, but also all took note of its psychoactive properties. Ancient Indian legend tells that the cannabis plant grew from the nectar of the gods and it could heighten courage, enjoyment and sexual desire. Chinese and Indian Hashish preparations go back thousands of years and were typically eaten, though the Scythians of ancient Eurasia created “vapor baths,” tents filled with smoke that caused celebrants to “shout of joy.” In cultures where shouts of joy were frowned upon, cannabis use was soon restricted on religious principles. In 1378, Islamic leaders attempted to restrict its use by the general public, though they allowed for religious groups to continue using it as a sacrament. The modern word “hashish” itself comes from tales of a secret society of religious assassins who used the drug as a motivator so they could experience the pleasures of heaven before risking their lives on deadly assignments. Hashish is also why the legendary “whirling dervishes” whirled. Despite, or perhaps because of its psychoactive and other medicinal effects, over the millennia, cannabis as a crop spread worldwide and grew as a medicine to be part of the “pharmacopeia,” or list of products considered “medicine” of most medical traditions, including the U.S. starting in 1850. As a cash crop, cannabis, or hemp had already been part of American culture since day one. The first laws in the English colonies required farmers to grow cannabis or hemp.

An American Tradition There are numerous legends and myths regarding early American leaders and cannabis, but experts tend to agree that in addition to their penchant for growing it, recreational

cannabis use was popular among our Founding Fathers: Washington, Jefferson, Monroe and Madison all wrote of their affection for what Washington called “blossom hemp.” Washington also journaled of being impressed by Polish Hashish and Jefferson bragged of smuggling forbidden highpotency cannabis indica seeds in from China for his gardens at Monticello. He also wrote one of his drafts of the Declaration of Independence on hemp paper. Celebrated libertine Ben Franklin, who enjoyed all the chemical pleasures of the era including cocaine and nitrous oxide, built America’s first hemp paper factory. And the list goes on. While a General, President Andrew Jackson would brag about toking up with his soldiers in his letters home. After their experiences south of the border, numerous veterans from the Mexican-American War adopted cannabis smoking including future presidents, Franklin Pierce and Zachary Taylor. Meanwhile, widely grown for paper, fiber and fuel, hemp flourished as a staple crop grown across America during the 1800s. Two All-American icons Levi Strauss’ blue jeans and later, Converse Chuck Taylor Model All Star tennis shoes were originally made from hemp fabric. In addition, cannabis extracts were used in numerous early medications, known as patent medicines, by many brands we still recognize including Bayer, Parke-Davis and Pfizer. It was the public outcry about the undependability of these patent medicines in general that led to the earliest American laws restricting cannabis use. Several patent medicines of the time would become the forerunners of modern prescription drugs, but many were little more than placebos and some were even deadly. The earliest laws restricting cannabis use were filed in New York in 1860, a mere 10 years after cannabis had been accepted in the U.S. pharmacopeia. By 1905, 29 states regulated cannabis as medication, though most, like New York, simply required a doctor’s prescription for access. But controlling medical access to drugs derived from cannabis was not the only rationale behind the trend towards prohibition. As a “recreational drug,” cannabis in the form of smokable hashish had gained a foothold in US society during the 1800s as well. Hashish houses similar to opium dens proliferated in the latter half of the century. In the early 28

20th century, with the apparent success of the Temperance Movement’s efforts to prohibit alcohol, efforts intensified limit public access to all “habit-forming drugs.” Making matters worse, with racism rampant in early 20th century America, prohibitionists had an ideal propaganda tool to turn the country against cannabis. During this same era, racist arguments were used in South Africa and Jamaica to justify cannabis prohibition. In Canada targeting the Asian population was the justification for their cannabis prohibition starting in the 1920s. Meanwhile as Mexican immigrants moved north escaping the country’s bloody revolutions, some brought their cannabis culture with them. Soon, however, Mexican “marijuanos” became targets of racial attacks in the same ways that African-Americans and Asian-Americans were harassed as cocaine and heroin were made illegal. Because cannabis had also become popular in southern black communities, in particular New Orleans, “reefer” or “juke” (as in jukebox, based on the original word “jute”— a name for hemp fiber used in rope) became associated with both minority communities. One newspaper’s editorial even read: “Marihuana influences Negroes to look at white people in the eye, step on white men’s shadows and look at a white woman twice.” Troublesome as they were, these social conditions by themselves were not the primary driving forces behind the ultimate call for American cannabis prohibition. The actual cause of our 80 year prohibition is another unpleasant American tradition, almost as bad as racism, known as “crony capitalism.” Though capitalism in itself is often a good thing, a “crony capitalist” is a corrupt businessman who uses his connections to corrupt government officials to help his business. In this case, the business was newspaper tycoon William Randolph Hearst and the corrupt politician was Harry Anslinger. Six Reasons Why Exercise Is Better on Weed By Anthony Franciosi

The words “marijuana” and “exercise” may not go together upon first glance, but they actually go hand in hand. The marriage of the two is something you may have not considered, but if you’re looking to get ripped--you really should. Listen up. Did you know that weed is actually the best thing you can do for your workout routine? Sure, we know pot has the power to relieve pain and stress, but did you know it can also improve focus, increase metabolism, and make you BETTER at your favorite sports? Let’s look at the facts. Some of the most incredible athletes

are actually pot smokers. Don’t believe me? I mean, this may sound crazy, but think about it. Remember Michael Phelps? He has 22 Olympic medals and, as we all know, he’s a big fan of the reefer. Okay, so he got in trouble and whatever, but seriously: If Phelps can smoke weed and be that great at swimming, wouldn’t you think it might play some part in his athletic achievement? If that’s not reason enough to introduce pot into your fitness regime, I’m really not sure what is.


But, in case you do need a little more convincing, here are six concrete reasons why exercise is better on weed:

Weed raises your metabolism Let’s start with the basics so we can get the ball rolling on an explanation as to why you should be ROLLING a fatty before hitting the gym. Marijuana can help speed up your metabolism so you can actually get a fat-burning boost before hitting the elliptical. According to a study recorded in Men’s Journal: “The compounds THCV and cannabidiol found in marijuana may help raise metabolism, speed fat loss, and lower cholesterol.” So, if you’re looking for a little something extra pre-workout, smoke a little weed. This might seem counterintuitive but, nope, it really does help. Pot smokers are just thinner. As Wellspring notes: “American Journal of Medicine researchers have discovered that pot smokers actually have 16% higher levels of fasting insulin in their bodies than those who abstain from marijuana. In addition, the study indicated that cannabis users have 17% lower insulin resistance levels as well as significantly smaller average waist circumferences than their non-smoking counterparts.” Controlled insulin levels are key to energy and weightloss. Pot is good for insulin levels which means pot is good for your body.

Weed reduces anxiety and gets you revved up to workout

Strangely enough, weed is actually the key ingredient in pumping you up for a workout. After smoking, we feel more heightened and ready to take on the gym by storm. As Stanford Medical School professor Keith Humphreys told Outside Magazine, “We have cannabinoid receptors throughout our brains, and when the THC hits those receptors, it triggers a system that reduces anxiety. That you would feel more aggressive is a natural reaction to the drug.” So, while you might think that weed would chill you out and force you to complacently melt into the couch, forging the gym completely, it actually can help you get ready for your routine. It reduces anxiety and pumps you up! Who knew?!

Weed can make you better at sports Marijuana can literally make you better at the games you love to play. While participating in activities DRUNK might impair your judgment and compromise your performance, smoking weed will actually IMPROVE your skills. In an interview with Men’s Journal, well-known triathlete Clifford Drusinsky, a Colorado gym owner who actually holds sessions where everyone gets high, said: “Marijuana relaxes me and allows me to go into a controlled, meditational place. When I get high, I train smarter and focus on form.” Since you’re relaxed after smoking, you’re automatically more aware of the tasks at hand, which of course is crucial to sports aptitude. According to Business Insider, Outside Magazine correspondent Gordy Megroz said weed actually made him better at skiing. He said that once he got high, he felt really pumped up and was ready to take on all of the slopes. So, there you have it, smoking weed improves sports and science says so. Take that, mom and dad!

Weed helps your muscles recover You know what seriously blows about a super hardcore workout? Being super sore the next couple of days after. Luckily, the answer is even simpler than eating a ton of protein and having a trusty spotter: get high AF. According to Megroz, smoking weed actually helped his muscles recover more quickly than going at it alone. He reported that when he did squats while high, he wouldn’t get as sore. Smoking weed means the end of the muscle pain after workouts. Wouldn’t that make you just want to workout more? Hell yeah.

Weed does the same thing as exercise STONERS, REJOICE! Here’s another zinger. Weed actually has a similar effect on your body that the gym has. LOL forever, amiright?! According to Wellspring, marijuana can activate the same areas of the body that exercise can: “As a group of lipids, fats, and cell receptors that THC bind to when smoking weed, the endocannabinoid system plays a prominent role in the neurological system for maintaining homeostasis for overall human health. In short, the endocannabinoid system is responsible for easing our pain, controlling our appetite, relieving our stress, influencing our mood, and even regulating our memory.” So, think about combining the exercise AND pot! It’s like a recipe for happiness, wellness, and delight.

Weed keeps you in the zone On top all the aforementioned, magical things weed can do to help improve your fitness strategy, it can also help you stay ultra-focused during your routine. As Wellspring points out: “Many long-distance runners admit to using vaporizers or edibles before participating in a marathon, because the cannabis enables them to remove the monotony and stay in a steady rhythmic zone for keeping at a competitive running speed.” So if you’re looking to stay in the zone and improve your longevity like so many top performers (cough, Michael Phelps, cough) just light up!

ARIZONA DUI LAWS Arizona is one of the harshest states in the nation when it comes to DUI charges, especially when it comes to Marijuana DUI By Attorney Brian Douglas Sloan Law OfďŹ ces of Brian D. Sloan // The Arizona DUI Team


ARIZONA IS A STRICT LIABILITY STATE: if you have active THC in your system, while driving, that is a DUI. Other states, such as Colorado, introduced a threshold limit, similar to alcohol, where a person who drives with a certain amount of active THC in their system is punished. Despite a Citizen Initiative that permitted Medical Marijuana possession and use, Arizona remains quite harsh on Marijuana DUI cases, even when the person had permission to use Medical Marijuana under the Arizona Medical Marijuana Act (AMMA). However, on November 20, 2015, the Arizona Supreme Court ruled that in a Marijuana DUI case — where the person had a valid Medical Marijuana Card at the time of the traffic stop — the fact that they had a Medical Marijuana Card can be used as an Affirmative Defense in a DUI case, in some circumstances. This clarifies prior cases where judges were interpreting the law so that a Defendant’s Medical Marijuana Card could not be introduced at trial as evidence of innocence. In the recent case of Dobson v McClennen, the Arizona Supreme Court held that the Arizona Medical Marijuana Act does not provide immunity to a cardholder from prosecution of a DUI while simply having active THC in their system, but does afford an Affirmative Defense if the cardholder can show that the Marijuana or its active metabolite, was in a concentration insufficient to cause impairment. The Arizona Supreme Court also stated the burden falls on the AMMA patient to show that they did not have Marijuana concentrations sufficient to cause impairment, stating that patients “generally know or should know if they are impaired and can control [a vehicle] when they drive.” The few sentences devoted to this aspect of that case amounts to the potential of a DUI suspect saving hundreds, if not thousands of dollars at trial, because it basically tells the trial courts that the Defendant need not bring in a scientist or a doctor to testify as to the impairing qualities of Marijuana, based on the amount of active THC or the active metabolite of THC in their system, but allows the Defendant, themselves, to testify that they did not feel impaired. Active Marijuana shows up in a person’s system as Tetrahydrocannabinol (THC). That then metabolizes into hydroxy-THC, which is an active metabolite. That then metabolizes into carboxy-THC, which is an inactive metabolite. Active THC can stay in a persons system for about one or two days after last ingesting Marijuana. Hydroxy-THC can stay in a person’s system for up to about a day. And carboxyTHC can stay in a person’s system for around 30 to 45 days. Fortunately, the Arizona Supreme Court decided several years ago that having only the inactive Marijuana metabolite in one’s system while Driving or being in Actual Physical Control of a vehicle is not a DUI. The Arizona Supreme Court held that the Legislature did not intend to punish those persons who solely had carboxy-THC in their system while

driving, regardless as to whether the Marijuana was used legally or illegally. Unfortunately, for those who were convicted of DUI in the decades leading up to that decision, who simply had carboxy-THC in their system while driving, a Court of Appeals ruling came out stating that the holding of the Arizona Supreme Court concerning carboxy-THC not amounting to a DUI is not retroactively applicable. That means that those who were previously convicted of a DUI, simply for having the inactive Marijuana metabolite in their system while driving, which the Arizona Supreme Court determined was ‘never intended by the Legislature’ to fall under Arizona DUI laws, cannot now go back and attempt to have their conviction overturned. As of the writing of this article, that issue is being appealed to the Arizona Supreme Court.

How Marijuana DUI Charges Are Brought Up In Arizona, there are two ways in which a DUI charge can be brought against someone who has Marijuana in their system. Under Count 1, the prosecutor will attempt to prove Beyond a Reasonable Doubt that a person was Driving or in Actual Physical Control of a vehicle, while impaired to the slightest degree by a drug, and/or medication, and/or alcohol. Under Count 2, the prosecutor will attempt to prove Beyond a Reasonable Doubt that the person was Driving or in Actual Physical Control of a vehicle, while having a drug, or its active metabolite in their system. Unfortunately, the recent Arizona Supreme Court case only considered the issue of the Arizona Medical Marijuana Act in relation to Count 2 — Driving or being in Actual Physical Control with active Marijuana or its active metabolite in a person’s system. The Supreme Court did not consider the AMMA in relation to Count 1 — Driving or Being in Actual Physical Control while impaired to the slightest degree by the use of the drug. While the Supreme Court determined that the AMMA is not a complete defense to DUI charges, nor is it immunity to DUI charges, it did open a door to helping those charged with Marijuana DUI while having a valid Medical Marijuana Card. The Supreme Court held that, at least as far as Count 2 goes, the prosecutor still must prove Beyond a Reasonable Doubt that the Defendant was Driving or in Actual Physical Control while having active THC in the their system, but the Defense Lawyer can attempt to prove as an “Affirmative Defense” that despite that the Defendant was driving, with active THC in their system, the Defendant had a valid Medical Marijuana Card AND that the amount of Marijuana or its active metabolite in the Defendant’s system was in insufficient quantities to cause impairment. This is an issue for the jury to decide, and the jury decides whether the Defense Counsel has proved the Affirmative Defense by a


Preponderance of the Evidence, which is a lesser standard of proof than Beyond a Reasonable Doubt.

Confusing Laws Ultimately, what this means is that Defense Counsel should be able to introduce that their client had a Medical Marijuana Card at trial, so the jury can hear that their client had a Medical Marijuana Card, which is something that many judges prevented before this ruling came down from the Arizona Supreme Court. There are a few reasons why this has become such a confusing issue in Arizona. Since the law that allowed for Medical Marijuana was a Citizen Initiative, it seems that the people who wrote the initiative either did not take into consideration how Medical Marijuana laws would impact DUI cases, or specifically left that vague in order to encourage more people to vote for it. Case law concerning the AMMA and DUI came to the conclusion that had the AMMA intended to be a defense or immunity to a DUI case, it would have been very easy for the initiative to write that into the law. Very simply, the AMMA law could have stated, ‘Use of Marijuana under this act (law) provides complete immunity to Marijuana DUI charges.’ Likely the people who wrote up the Citizen Initiative thought that a statement like that would scare people away for voting in favor of Medical Marijuana. There were some provisions in the Medical Marijuana Act that seems favorable to the argument that Medical Marijuana provides immunity or is a defense to a DUI. These provisions included statements, “A registered qualifying patient … is not subject to arrest, prosecution or penalty in any manner, or denial of any right or privilege, including any civil penalty or disciplinary action by a court … [f]or the registered qualifying patient’s medical use of marijuana pursuant to this chapter …,” and “This chapter does not authorize any person to engage in, and does not prevent the imposition of any civil, criminal or other penalties for engaging in, the following conduct: Operating, navigating or being in actual physical control of any motor vehicle, aircraft or motorboat while under the influence of marijuana, except that a registered qualifying patient shall not be considered to be under the influence of marijuana solely because of the presence of metabolites or components of marijuana that appear in insufficient concentration to cause impairment.” These statements in the AMMA were specifically addressed by the Supreme Court, and held to not grant immunity in a DUI case, nor is it a defense in a DUI case, but may be considered an Affirmative Defense where the presence of Marijuana or its active metabolite is in insufficient concentration to cause impairment. Accordingly, there is a statutory defense for DUI, when the person is Driving or in Actual Physical Control of a vehicle, while having a drug in their system, when they are prescribed that drug, and taking that drug as prescribed. However, the Courts have held that Marijuana use under the AMMA is not “prescribed,” as it is still an illegal substance under Federal guidelines, and a doctor cannot prescribe something that is an illegal substance.

Rather, the Courts have taken the position that Marijuana under the AMMA is “recommended,” not “prescribed,” therefore the statutory defense under Arizona law does not apply. This was again confirmed in the recent Supreme Court ruling, where it was specifically held, “Medical Marijuana used pursuant to ‘written certificates’ under the AMMA is not ‘prescribed.’ ” Adding “[The Prescription Drug Affirmative Defense] applies to drugs prescribed by a different class of licensed “medical providers” than those who may issue medical marijuana certifications.” Despite this beneficial ruling at the Arizona Supreme Court, my advice to those who smoke Marijuana remains unchanged: If you have smoked Marijuana, legally or illegally, within the past two days, do not get anywhere near the driver’s seat of a vehicle. STRAIN THEORY Nurse Courtney takes a closer look at the holistic impact of strains on well-being DEFINITION: strain theory: noun (pl. theories) a supposition or a system of ideas intended to explain something, especially one based on general principles independent of the thing to be explained: i.e. Darwin’s theory of evolution. What’s up with the names? CBD, THC, Sativa, Indica, Marijuana, Hemp, Pot, Weed, Kush, Charlotte’s WEB, Blue Dream, Sour Diesel. What does it all mean? With three distinct varieties of cannabis and more than 700 different strains identified and more being produced each day, medical cannabis users face a mind-blowing number of choices in choosing the best medicine while populations around the world struggle to comprehend the difference between medical and recreational cannabis verses industrial hemp and legal CBD. While CBD and THC represent only two of the 75 or more cannabinoids already identified, they are the most newsworthy and controversial due to little Charlotte Figi, a then five year old stricken with uncontrollable seizures. Introduced to the world via Dr. Sanjay Gupta and CNN, audiences worldwide quickly learned about the benefits of CBD. A supposedly non psychoactive cannabinoid, CBD oil has gained acceptability. The popularization of CBD by the Stanley Brothers, set in motion waves of legislation demonizing THC while promoting the breeders interest with multiple states adopting CBD only “Charlotte’s Web” laws. While the benefits of legalization of any form of cannabis may seem promising, ultimately the popularization of CBD has done more to confuse the public than provide answers. Even long time cannabis users are stumped trying to explain the difference between CBD and THC, legal CBD verses illegal CBD; Hemp oil found in grocery stores verses the popularized Rick Simpson cannabis oil. Even more concerning, newcomers to the world of medical cannabis enter dispensaries and are greeted by a massive variety of strain choice and methods of delivery well beyond the scope of the CBD verses THC conversation. Additionally, many new patients have just been diagnosed with a frightening life threatening or life debilitating conditions and after the recommendation is made, find their way into dispensaries staffed by well-meaning bud tenders with little, if any, medical or nursing background. While many testing labs, dispensaries, books and websites are dedicated to describing the effects of the different strains to help patients, many of these reviews are not based on science or direct experience with a condition, but on conjecture and supposition.

Whipped Sweet Potatoes & Cannabis INGREDIENTS:

° 2 pounds sweet potatoes, peeled, cooked and mashed ° ½ cup firmly packed light brown sugar ° ¼ cup evaporated low-fat milk ° 1/3 cup Cannabis butter, softened ° ¼ teaspoon ground nutmeg ° ¼ teaspoon ground cinnamon ° ¼ teaspoon ground ginger ° 2 tablespoons fresh lemon juice ° 1 egg ° 1 teaspoon vanilla extract ° salt and pepper to taste DIRECTIONS: 1. Preheat oven to 350 degrees. Grease a casserole dish (9”x13”) in preparation. 2. Combine all ingredients in a large mixing bowl. With a mixer, beat until smooth. 3. Transfer potato mix to casserole dish. Bake uncovered for 45 minutes or until top begins to brown.

Chocolate Chip Cookie Dough Bites INGREDIENTS:

° 3 tbsp Coconut Cannabis Oil ° ½ cup natural crunchy peanut butter ° ½ cup ripe banana, mashed till smooth ° ¾ cup unbleached AP flour or white whole-wheat flour ° 2 tbsp coconut sugar* ° ¼ tsp cinnamon ° 1 ½ tsp organic vanilla extract ° 2 tbsp vanilla soymilk or almond milk ° ¼ cup mini DF chocolate chips (such as Enjoy Life) ° Toothpicks or other cocktail pick

DIRECTIONS: 1. In a medium bowl, add the coconut Cannabis Oil, peanut butter, mashed banana, coconut sugar, cinnamon and vanilla. Use a wooden spoon to fully combine. 2. Stir and incorporate the flour in by ¼ cup at a time until the mixture thickens up. Add the nondairy milk until moistened into a smooth cookie dough consistency. Stir in the chocolate chips. Enjoy as is or check out the next step for another serving option. 3. Line a baking sheet or glass baking dish with parchment paper. Roll the cookie dough into small balls, about 1 tbsp each. Place onto lined sheet or dish and place a toothpick into the center of each. Freeze for at least 2 hours or overnight for best results. Once frozen, dip into melted chocolate and chopped nuts for extra flavor. Store in an airtight container in the freezer for up to 2 weeks.


Chocolate Peanut “Budder” Balls INGREDIENTS:

° 1 ½ cups peanut butter ° 1 1/3 cups crushed graham crackers ° 1 cup Cannabis Butter ° 2 cups powdered sugar ° 1 tsp vanilla essence ° 12 oz chocolate chips DIRECTIONS: 1. In a large bowl, add the peanut butter, graham crackers, Cannabis Butter, powdered sugar, and vanilla essence. Mix well. 2. Roll into balls and lay on a tray lined with baking paper. 3. Freeze your balls in the freezer until hard. Approximately 3 hours. 4. In double boiler, melt and stir the chocolate chips until a smooth consistency (add a tablespoon of butter if needed to make it smoother). 5. Remove you balls from the freezer and impale them with toothpicks. 6. Dip your balls into the melted chocolate. 7.Leave to set on a tray lined with baking paper. 8.Enjoy your delicious chocolate-nutty balls!

Pumpkin-Spiced Canna-Pancakes INGREDIENTS:

° 1 cup vanilla soymilk ° 1 tbsp lemon juice ° ¼ cup coconut Cannabis Oil ° 2 tbsp agave nectar ° 2-3 very ripe bananas (the more ripe and black/spotty they are, the tastier these will be!) ° 1 tsp vanilla extract ° 1 cup white whole-wheat flour ° ½ cup all purpose flour ° 1 tsp baking powder ° 1 tsp baking soda ° 1 tsp pumpkin pie spice ° ¼ tsp cinnamon ° ½ tsp salt ° ½ cup walnut pieces, optional (if using, sprinkle on top of pancake while in skillet cooking) ° ½ tbsp earth balance butter

vanilla extract, and soy milk mixture. Whisk together until combined. Set aside. 4. Place a large skillet over medium heat. (While prepping). 5. Slowly add the dry ingredients into the wet ingredients, stirring until just combined. Make sure there are no dry ingredient lumps in that batter! 6. Once skillet is heated, lightly butter and test a baby-sized pancake to check for correct heat level. The pancake should begin bubbling and cooking through on the sides without burning on the bottom. 7. Once your heat level is solid, drop the batter into the skillet (about ¼ cup each) and cook for about 5 minutes on each side, or until browned and cooked through. Hold in a warm oven until ready to eat. Top with agave nectar or maple syrup and enjoy!

DIRECTIONS: 1. Add soymilk and lemon juice into a small bowl and whisk together until combined. Let sit 5 minutes. 2. Meanwhile in a medium bowl add the flours, baking powder, baking soda, spices and salt. Whisk together to fully combine. Set aside. 3. GLASSBLOWER EXTRAORDINAIRE One on One with Ken Kulow of Chameleon Glass

Many of us take for granted the art of glassblowing when we sit down at the dinner table and our glasses are filled with ice water — mostly because glassware today is mass produced in factories in China. Closer inspection of those glasses, however, reveals an age-old technique perfected through the skills of ancient craftsmen and handed down from one generation to the next. Glassblowing dates back to the earliest days of the Roman Empire, and the Romans helped elevate it to the art form that it is today. In the modern era, glassblowing was revitalized by Harvey Littleton and Dominick Labino. In 1962, they began heating glass in small furnaces that could fit inside of an artist’s studio. There are still glassblowing artisans located throughout the United States. We’re fortunate in Arizona to have one such artist: glassblower Ken Kulow of Chameleon Glass in Phoenix. Blazed sat down and chatted with Kulow about glass and grass.

BLAZED: How long have you been blowing glass? KULOW: Fifteen years. Previously I made incandescent and florescent light bulbs for GE, which is where I fell in love with the medium glass. BLAZED: What got you interested in glass blowing? KULOW: Watching the masters (Chihuly and Milon Townsend) after touring the Corning factory in N.Y. state. BLAZED: What made you transition to blowing smoking products? KULOW: Bills. Pipes could earn you real money while fuzing, beadwork, etc. causes you to remain in the starving artist category. BLAZED: How often do you smoke? KULOW: Daily. Pretty much every four hours or so. BLAZED: Are you stoned right now? KULOW: Just had lunch with my parents so YES! THE OG’S HOW-TO GUIDE: PLANTS / PART I This is the first in a three-part series on reading your plants and correcting abuse, deficiencies and other common problems

Find out how to recognize some of the most common marijuana plant abuse disorders, marijuana deficiencies and other common problems by detecting these signs early and adjusting your garden methods accordingly. Following these steps will greatly improve the overall success of your garden, resulting in the production of high-quality flowers. HEAT STRESS Look closely, and you’ll see the brown leaf edges that are indicative of heat stress. This damage looks a lot like nutrient burn, except it occurs only at the tops of the plants closest to the lamps. There’s only one cure for this: get the heat away from the plants, either by moving the lamps or moving the plants. NUTRIENT SOLUTION BURN These symptoms are seen when the EC/ppm concentration of nutrient solution is too high in the root zone. Even expert gardeners see this problem when pushing their plants too hard. Yellowing of the tips in the new growth or “clawing” is the beginning of nutrient burn. This indicates that the plants have all the nutrients they need. Reduce the concentration of the nutrient solution by a small amount. The high level of nutrients accumulates in the leaves and causes them to dry out and burn. If this happens in your garden, you must flush with clear, clean water immediately to allow the roots to recover, and prevent further damage. OVER WATERING/UNDER WATERING There are many different grow mediums to use, whether it’s soil, DWC, Rockwool, etc. Therefore, there

are different ways to water plants. The soil needs to dry slightly, while cocoa, Rockwool or DWC can be fed several times a day. It depends on what medium the grower prefers. The procedure is still the same in each of these subculture environments. Allow the roots to dry out a little before the next feeding. This allows oxygen to saturate the root zone. Damage to an overwatered plant will show signs of stunted growth. If the plant looks weak and its leaves can’t hold themselves up, check the moisture levels of the soil for dryness (under-watering). • Soil 2-4 days before next watering • Coco Coir up to 6x daily or 2-3 days between waterings • Rockwool daily flood and drain, 3-4x • DWC can top feed up to 6x in a 24-hour period pH CONTROL 5.5-6.5 Too high or too low a pH can lock up nutrients in the form of non-dissolvable salts and compounds, some of which are toxic to the plants. What then happens is the grower tries to supplement the plant’s diet by adding more fertilizers, throwing off the pH even more and locking up more nutrients. This type of problem is seen more often in soil mixes, where inconsistent mixing of the medium’s components leads to “hot” spots. If you’re using soil, its best to allow a natural PH to occur in the 6.0-6.5 range. This will allow for optimal nutrient uptake (ONU) to occur. If you’re growing in a hydroponic medium, your pH should be adjusted to a 5.8-6.2 range. For ONU to occur. checking pH of your runoff after every feeding will help you to adjust the pH in the future.

SHUTTER SPEED Blazed Magazine Talks Shop with Local Photographer Ryan Guzzetta I must admit, I’ve had somewhat of a man crush on risqué photographer Ryan Guzzetta since he took the first photo of me in the nude. I get a tingly feeling in my body when he snaps a picture, like a teenager climbing the rope during gym class. Ryan is such a stud muffin, I let him touch my underarm during this interview. BLAZED: How long have you been doing photography? GUZZETTA: I’ve been shooting for just more than 10 years. BLAZED: Who’s been your biggest influence in your life? GUZZETTA: My dad. He taught me that to be successful, you have to be able to maintain the same level of effort through the good and the bad. Almost every person that we consider successful in today’s society — and I’m not referring to reality TV people here, but self-made people, that got to where they are through hard work … not blind luck — has gone through his or her share of obstacles and challenges. They persevered, they worked harder and they pushed through. Our failures define who we are as people, not our successes. BLAZED: What’s your favorite style of photography? GUZZETTA: I like to shoot a combination of fashion and glamour. My preference is to shoot with a very vibrant color scheme, utilizing fun dramatic makeup and wardrobe. When I get the chance to shoot something just for me, I like to shoot things that make people think. Putting two subjects in the same frame that don’t have anything to do with one another is so much fun. If I can get people to look at one of these photo and say, “WTF?,” then I have done my job. BLAZED: If you could be anywhere in the world shooting photos, where would you choose? GUZZETTA: There are a handful of places, but one of the places I really want to shoot is in a New Orleans cemetery. The tombstones, crypts and architecture are so cool. There is just something amazing about the feel that you get shooting in a place with such a mixture of energies. BLAZED: Who is your favorite photographer? GUZZETTA: David LaChapelle. His use of color and fun/ controversial themes was what helped me break out of the standard picture format and look at photo shoots in a whole new light.

BLAZED: What has been you most memorable moment in your life? GUZZETTA: The birth of my children. I have two amazing boys, and there is something about creating an actual human being that is just not comparable to anything else in the world. Seeing them for the first time when they are born is an incredible rollercoaster of feelings and emotions. BLAZED: If you could meet anyone dead or alive who would that person be? GUZZETTA: Mahatma Ghandi. Here was a guy that didn’t seem to let ANYTHING bother him. He was always at peace, he had a great sense of humor, and an amazing sense of self. BLAZED: What did you learn from him? GUZZETTA: One of the biggest struggles I have … and I think a lot of artistic people struggle with this … is just being happy with your work. Not worrying about how others perceive it. Social media has changed the artistic landscape so much. It has given a voice to the entire world. Now a small, local photographer will get the same type of attention and criticism that only a world renowned photographer would’ve gotten ten years ago. The difference is that the famous photographer gets paid enough to handle that, and has had time to adjust and learn how to deflect a bit. The starting photographer could be crushed by this initial weight and never try again. BLAZED: How do you put your models at ease when shooting in hot situations or odd positions? GUZZETTA: From the start, I try to meet all of my models at a coffee shop, or some public place ahead of our shoot. It is really important to establish some sort of rapport before asking them to take their clothes off (laughs). That intro conversation saves a lot of warm-up time on the day of the shoot. When you are shooting, the key is to just be a real person. Avoid terms like “hot” and “sexy” until you can work them in on a more humorous level. Do NOT hit on your models. Your models are trusting you as a photographer to take beautiful pictures of them, they are not here for a social call. Your focus should always be on making him or her feel comfortable. Provide a robe or a towel for them to cover up with when walking to and from the dressing room, don’t follow them into the changing area and stand there like a creep. Just because you recently saw them practically naked, there is a difference between the set and the changing area. Give them their privacy. Make sure that you provide them with an area that is theirs for the duration of the shoot. Everyone needs privacy; models on a shoot can sometimes feel very vulnerable. It is important for them to know that they have an area of refuge to relax in.

BLAZED: What is your opinion on the legalization of marijuana for recreational use? GUZZETTA: Personally, I think that the reasoning behind making marijuana illegal in the first place had nothing to do with public health and everything to do with the greed of the tobacco companies. I have seen first-hand, the good that marijuana can do for people, and I find it very frustrating that it has been denied for so long due to misinformation or backwards religious views. I am happy to see that the country as a whole is starting to see the truth about marijuana. BLAZED: Tell us something that no one knows about you? GUZZETTA: I am a hardcore binge TV watcher. I watched the entire series Breaking Bad in a weekend. I hate commercials, and waiting between seasons. My preference is to wait until the show is over and then watch the whole thing start to finish. Exceptions were Sons of Anarchy, Walking Dead and Game of Thrones … just couldn’t wait to get started on those.
