While this issue is at the printers I will be in London at the Tower of London to witness the Jubilee Superbloom, where the moat of the Tower has been planted with vast swathes of wild flowers. Mind you, the Tower have been in touch to say that because the 2022 spring weather has been less than conducive to the early growth of the meadows it is possibe that anyone visiting in June may be more under- than overwhelmed by the display - and so a free return visit later in the summer has been offered. I’m not complaining about a second trip to Londinium. I feel their pain though. I planted sweet peas, grown from seed, in the garden earlier this month - and the slugs scoffed the lot. A second wave of seedlings went in 2 days later - another munch for the molluscs. A third lot have now been planted - and are under close surveillance morning and evening. I will pick home-grown sweet peas this summer. In the meanitme I hope you like the front cover photo, taken on Clifton Hill. Read more about this new wildflower meadow on page 46.

Probate Applications and Delays

backlog of Probate applications. Add to this a change in the Probate application process to an online system which has experienced a number of issues and the timescales for the issuing of a Grant of Probate have increased substantially.

Sophie Haskins of AMD Solicitors discusses the latest news about delays and probate applications.

Where Inheritance Tax needs to be paid, the Probate Registry ask that the Probate application is submitted to them 20 working days after the submission of Inheritance Tax forms to HMRC, which means the overall timescale is further extended. If an application is submitted sooner, this could cause further delay as the Probate Registry may not be able to match up the application with anything received from HMRC.

Often when a loved one passes away, a Grant of Probate is needed to deal with their assets. A Grant of Probate is legal document, which provides Executors appointed under a Will the authority to deal with a person’s estate, collect in assets and distribute them as guided by the Will. Once an Executor has collected in details of assets and labilities, the next step is to apply for the Grant of Probate. This includes the preparation of Inheritance Tax forms, which may need to be sent to HMRC, and a Probate application form which is sent to the Probate Registry who will then issue a Grant of Probate.

We understand that HM Courts and Tribunal Service (HMCTS) have been taking and continue to take steps to reduce delays and get back to their pre-Covid workload by taking on more staff and making improvements to the online system.

Before the Covid-19 pandemic, the average application issue time for a Grant of Probate was around two to three weeks. However, over the past 2 years, Probate Registries have been affected by the pandemic by way of staff shortages and increased numbers of applications, which has resulted in a

AROUND THE WORLD IN EIGHTY DISHES - AFGHANISTAN From June’s stop off in the deep south of the USA we head this month into southern Asia - and the landlocked country of Afghanistan. It seems as if most countries have a popular dish of ”rice with meat” - think risotto, paella, special fried rice, Jollof etc - and Afghanistan is no different. This dish is called Kabuli Pulao, or Afghan Carrot and Sultana Jewelled Rice with Lamb, and despite what you might think from all the seasonings it is a delicious, fragrant non-spicy dish. It’s not difficult to prepare but the various steps take a little, while so not a quick supper.

3 cups of uncooked basmati rice (think small takeaway coffee cup size) 600g diced stewing lamb (about 2cm rough cubes) 3 carrots 50g sultanas 50g pomegranate seeds 1 large onion 4 cloves garlic 6 tbsp sunflower / cooking oil 3 tsp granulated sugar 2 tbsp butter 1 tbsp tomato paste 3 tsp ground cumin 1 tsp ground cardamon (about 10 pods crushed) 1 tsp turmeric 1 tsp ground black pepper 2 tsp salt a pinch of saffron 1 handful chopped pistachios

Method

Soak the saffron in a small glass of warm water. Get your rice going. Rinse the dried rice in cold water and strain. Repeat 3 times to remove excess starch - this will aid you getting fluffy rice. Put the rice into a large saucepan, add 1 tsp of salt and twice the quantity (so 6 cups) of boiling water. Stir once to help the anti-sticking process, bring to the boil and cover. Reduce the heat and simmer gently for 5 minutes - you only want the rice partly cooked. Remove from the heat, strain the rice and rinse it in cold water, then set to one side to cool. More prep. now. Peel and slice the onion and garlic cloves, peel the carrots and slice into fine batons (aka julienne), and rinse the sultanas. In a large pan (a big frying pan is fine) heat half the sunflower oil until it is nice and hot, then add in the diced lamb. Fry gently for about 10 minutes until it is browned nicely on all sides. Remove from the pan, leaving the leftover oil behind, and set aside in a bowl. Now add the onions to the oil in the pan and fry gently for 5 minutes. Add the garlic and fry for a further 5 minutes. Add the tomato paste, together with the turmeric, black pepper, cumin, cardamom and remaining tsp of salt. Mix well in the pan, frying gently for 5 minutes. Add 500ml of boiling water to the spice mixture, mix well and then return the lamb to the pan. Add half the saffron water to the pan as well, stir well, bring to the boil and then reduce to a very gentle simmer. Cover the pan and allow to cook for about an

AROUND THE WORLD IN EIGHTY DISHES - AFGHANISTAN hour / hour and a quarter, checking to stir occasionally and adding a drop more water if necessary to keep the sauce level up. 6. While the meat simmers away it is time to prepare your carrots. In a separate frying pan gently melt the 2 tbsp of butter, increase the heat slightly and add your carrot sticks to the pan. Fry the carrots for 3 minutes, then sprinkle over the sugar, coat the carrots and let them fry / caramelise for a further 5 minutes. Remove the carrots from the pan and set to one side (including half a dozen batons set aside separately to use as a garnish). 7. Now gently fry the sultanas in the residue butter left in the pan for 3 minutes, remove from the pan and set aside - again keeping a few separate for garnishing purposes. 8. Once the meat is cooked remove it from the heat. Carefully separate the lamb from the sauce and set it to one side. You will be left with the sauce in the pan which will have reduced and be nice and thick. At this point add in an extra cupful of boiling water - you want to be sure you have enough sauce for the finished dish. Now you put the sauce through a sieve into a jug, which will allow you to remove the leftover onion and garlic pulp and will also help you spot any rogue bits of cooked lamb left behind. 9. It’s time to assemble the dish - away from the heat. This should be done in a casserole dish or pan that has a lid and that is suitable for use on a hob - a Le Cruesset thingy is perfect. (I suspect you can do this final cooking stage in the oven, replacing the tea-towel with foil - but I haven’t tried it). 10. In the bottom of your pan add the remaining 3tbsp of sunflower oil, and a similar amount of boiling water. Now start layering the dish on top add about a quarter of your cooked rice to the pan, enough to cover the

bottom. Add about a quarter of your sauce onto the rice, then a third of your meat, and a third of your carrots, sultanas and pomegranate seeds. Repeat the layering process twice more - rice, sauce, meat, carrots, sultanas and pomegranate. You should be left with enough rice to create one final layer on top and some remining sauce to drizzle over. Finally create a couple of “vents” in the rice by sticking in the handle end of a wooden spoon (or similar - a clean garden dibber would work!). Once you have done this return thec asserole / pan to the hob, heat until you start to see steam coming from the vent holes, then cover the top of the dish with a clean tea-towel and then the lid. Reduce to a very low heat and let the dish steam very gently for about 35 minutes. Be careful not to set fire to the tea towel! After the 35 minutes are up remove the lid and tea towel and check to make sure the rice is cooked through (it will be!). To serve, drizzle the remaining saffron water over the top of the rice, and garnish with the remaining carrots, sultanas and pomegranate seeds. Sprinkle the crushed pistachios on top and serve straight from the pan.

Around 30% of adults over 65 and 50% of adults over 80, living at home will experience at least one fall each year. The risk increases for patients living with cognitive impairments, dementia and other illnesses. In the event of a fall the first number to dial should still be 111 or 999. Then once cleared with the emergency services that there are no injuries, we would arrange for one of our trained Supervisors to arrive with the equipment, at the client’s home as soon as possible. Our Supervisor will then carry out a full assessment of the client and the environment, and help the client up using the Raizer Chair, if appropriate. We will then stay with them to assess their ongoing needs, before handingover to a family member or neighbour. We are pleased to be able to offer this additional service to our clients and have already seen the benefit and reassurance it provides. Heat awareness advice

Welcome to the latest edition of Senior Snippets: the monthly advisory column with the older members of our community in mind, brought to you by John Moore, Director of Home Instead in North Bristol. With warmer weather on the way, it is important to recognise that older people’s bodies are often unable to adjust to sudden changes in temperature, which makes them more susceptible to heat exhaustion and heat stroke. Doctors have warned that hot nights are particularly dangerous for the elderly as it is more difficult for their bodies to recover from heat stress caused during hot days. With this in mind, here are a few tips on how to stay safe during the warm summer months:

Avoid the hottest times of the day (between 11am – 3pm) – if you do need to venture out make sure you aren’t outside for long periods of time and find shady spots when you can. Keep hydrated – even if you’re not thirsty it’s important to drink plenty of water or fruit juice to replace fluids lost during sweating. Avoid caffeine or alcohol which increase dehydration. Think lightweight – choose clothing which is loose, lightweight, light coloured and breathable, such as a white linen or cotton shirt. Cover up – in addition to wearing cooler clothing it’s also important to remember a hat. No matter whether it’s a cotton baseball cap or a straw boater, headwear will help to keep your face in the shade. Pick the perfect spot – seek out the coolest areas of your home during warmer weather. Keep curtains and blinds closed to prevent sun heating up rooms, especially your bedroom.

BRUCE FELLOWS’ BOOK RECOMMENDATIONS In the early thirties, war hero Maurice Wilson got the idea of climbing Mount Everest solo. Several expeditions had already failed. Wilson decided to travel light. Although he got supplies at Fortnum’s, he dispensed with the champagne and quails stuffed with foie gras previously considered essential. In addition, to speed his conquest of the peak, he would fly there and land on the lower slopes. Ed Caesar tells this tale of barmy pluck in The Moth and the Mountain. In an always riveting book Wilson endears himself to the reader as he staggers on to his inevitable end. How you’ll wish he could avoid it! Julian escapes a high-pressure life in the city to run a bookshop at the seaside. That’s when Edward turns up with an unusual request. His wife is in rapid decline and his daughter has had to deliver a mysterious package to a high up in the Service. Well, we’re back in the land of John le Carre and his posthumous novel Silverview. It’s all very mysterious of course and rather confusing at first but all the better for that. With the usual intriguing and well-drawn characters, we get a fascinating and totally gripping insight into the lives of spies and their families. An excellent novel. Square Haunting is Francesca Wade’s enthralling and often moving account of how five women in the first part of the twentieth century living in Mecklenburgh Square in Bloomsbury fought for an intellectual and independent life. Virginia Woolf was one and her search for ‘a room of one’s own’ was the search of them all: Dorothy L Sayers, of detective story fame; Jane Harrison, classicist; Eileen Power, historian and Hilda Doolittle, the modernist poet known as HD. Wade brings them vividly to life, how they lived, their struggles, their relationships, how they dressed, even the furnishings of their rooms; above all their magnificent successes. It’s inspiring. Bridget and Michelle got to university and have good lives. But is that because of or despite the parents they share? In her intriguing novel My Phantoms, Gwendoline Riley, through her heroine Bridget, gives us the information to make a decision. Her parents separate but her father continues to insist the world revolves around him. Her mother, Hen, becomes the focus of the story, forever seeking to belong, never quite making it. Bridget conducts a sort of double act with Hen, at times sad, at others funny, sometimes cruel, often moving. This is a brilliant portrait of a mother-daughter relationship. Families, eh, who’d have ‘em? Penance for Jerry Kennedy, by George V. Higgins, is a fast-paced, funny novel that entertains from start to finish with sparkling dialogue that leaps from the page. Jerry is a hardworking and honest trial lawyer in Boston, Massachusetts who does his best for every client from small time career burglar to high-powered accountant though he gets constant grief from everyone including his ne’erdo well son and his wife, who goes silent on him over a property deal he isn’t keen on. Add in the taxmen who are trying to track him down and a perfect storm is on the way. This is a great read.

Lifetime Gifts - What You Need to Know About Inheritance Tax, Allowances and Exemptions

Gifts made in your lifetime may be subject to inheritance tax on your death, depending on who the recipient of the gift is and their relationship to you, the value of the gift and when it was made.

Inheritance Tax on Gifts

you have survived the gift by three years. This is known as ‘taper relief’ but it only applies to the tax due on the gift and not the value of the gift itself. Allowances and Exemptions on Gifts In each tax year, you can make gifts up to a certain value that will be free of inheritance tax. The following allowances are available.

Lifetime gifts can include gifts of money, personal goods, properties and shares. If you give away more than £3,000 in one tax year (see below), the gift becomes what is called a Potentially Exempt Transfer (PET). The value of the PET is included in your estate for inheritance tax purposes for the seven years following the date of the gift. Once you have survived for seven years from the date of the gift, the value of the gift falls out of your estate and is therefore not subject to inheritance tax.

Annual Allowance

If you make significant PETs during your lifetime, exceeding the amount of your nil rate band allowance for inheritance tax (currently £325,000), you must consider the following points:

You can give as many gifts of up to £250 in value to as many people as you wish in each tax year, provided you have not used another allowance on the same person. Birthday or Christmas gifts that are paid out of your regular income are exempt from inheritance tax.

Any inheritance tax due as a result of your death on the PET is normally payable by the recipient of the gift unless your Will specifies. Gifts made within three years before your death are taxed at 40%. The tax due reduces by a certain percentage each year once

Each person is entitled to an annual gift allowance of £3,000 (or a maximum of £6,000 if the previous year’s allowance is unused) without there being any implications for inheritance tax. This is a total gift allowance, and it is not an amount per recipient. Up to £3,000 can be given to one person, or the amount can be split between several people. Small Gift Allowance

Gifts for Weddings or Civil Partnerships Lifetime gifts on the occasion of marriage or registration of a civil partnership are exempt from inheritance tax. The allowance that is available will depend on the relationship between the


donor and the recipient of the gift: •

up to £5,000 to a child of the donor

up to £2,500 to a grandchild or great-grandchild of the donor

up to £1,000 to any other person

If you are making gifts to the same person, you can combine the wedding gift allowance with any other allowance (except for the small gift allowance). Gifts Between Spouses/Civil Partners There is no inheritance tax payable on gifts between spouses or civil partners. You can make as many gifts as you like

to your spouse or civil partner during your lifetime, provided they live in the UK on a permanent basis, and the marriage or civil partnership is lawful. Gifts made to charities or political parties are also exempt from inheritance tax.

‘Flicted by Bruce Hornsby Despite, unfairly, being best known for his hit song The Way It Is from 1986, Bruce Hornsby has continued to make captivating and courageous music and is still doing so all these years later. In fact, some of his most interesting work has been as a bluegrass musician, particularly his collaborations with Ricky Skaggs. It therefore shouldn’t come as a surprise that Hornsby has never been particularly worried about keeping his fans happy, instead searching for new ideas without huge concern about who may or may not be listening. Latest album ‘Flicted is a good example of that sonic searching. It’s the final instalment of a trio of albums inspired by the work Hornsby has done with the legendary director Spike Lee. Following on from the equally brilliant Absolute Zero and Non-Secure Connection, it takes music that was composed for various film and television projects, including the Netflix series She’s Gotta Have It, and reimagines them as proper songs. He’s also enlisted collaborators from the ranks of the American indie scene, all stemming from his relationship with Justin Vernon of Bon Iver fame (see below). The record itself is an exhibition of his range, both musically and lyrically. Starting off with the straightforward indie of Sidelines, complete with guest vocals from Vampire Weekend’s Ezra Koenig, what follows is a series of twists and turns. Highlights include the blues and EDM mashing Maybe Now with its delightfully dirgy piano riff, the crazy jam Bucket List, the floaty and floaky Lidar and the funky protest song Had Enough. You get the sense that Hornsby is also challenging himself to come up with the most interesting lyrics possible too. Take the song Tag, which somehow manages to use phrases such as “solipsistic reverie” and “eschatological raps” without sounding pretentious. Instead, as with the songs themselves, it’s the work of a musician continuing to push the boundaries and

HISTORY NOTES NO. 172 - JULIAN LEA-JONES They celebrate the 4th of July - but what if a young Glaswegian, in colonial service in Bermuda and whose career success drew him to the attention of Robert Walpole, hadn’t in his new post recognised a local talent and rewarded his protégé? The rest as they say, is history.

authority over the colonies whilst expanding its reach into North America. Robert Dinwiddie sent a constant stream of communications back to London detailing French encroachment in the Ohio Valley and thus was able to make the English Government fully understand that in order to realise their expansionist goals on the continent, the depredations of the French would have to be contained. In Virginia Dinwiddie saw that a key element of his strategy was the need to protect the colonists and their lands by a force of trained militia, rather than existing untrained but well-meaning volunteers. By November 1753 the French were already overrunning the forts, and Dinwiddie attempted to remedy the Ohio River situation by appointing a very bright 21-year-old Surveyor as his adjutant for the southern district of Virginia. One of this new adjutant’s tasks was to recruit forces to relieve the Ohio River forts. However, the young surveyor was outnumbered and forced on that occasion to capitulate to the French.

This month’s history note relates to America’s independence from Great Britain, and a ‘hinge moment’ that stemmed from a decision made by a Scotsman born in the 17th century and later buried in Clifton. Robert Dinwiddie, was a successful Glasgow merchant who built on his commercial skills when entering the colonial service. One of his early appointments was as the Royal Collector of Customs in Bermuda, where it was said of him, “Although diligent in his duties, his mercantile experience enabled him to become one of the wealthiest men in the colony”. His reputation for probity and diligence brought him to the attention of Sir Robert Walpole, Great Britain’s first Prime Minister, who decided that he was the best person to be sent to the American Colonies as Surveyor-General for the whole of the Southern District of the Americas. Dinwiddie went on to become Governor of the Royal Colony of Virginia. As colonial administrator one of his responsibilities were the forts of the Ohio valley, which had been erected by the colonists to protect themselves against the incursions of the French. His success was in part due to his ability to cultivate friendships with many powerful Virginians, even becoming a partner in the Ohio Company. However, he always was true to his brief to maintain Britain’s

However the situation in which the adjutant found himself, together with the problems he encountered during that expedition, taught him valuable strategic lessons. History shows us that those hard lessons were obviously well learned and turned out to be much to our (GB’s) cost. By the following year the young adjutant had shown such promise that he had already been promoted to a Major, and then under Dinwiddie’s instruction to LieutenantColonel. With the necessary instructions, and a crown passport, he was invested with the authority to present a letter to the Commandant of the French forces. The letter contained a warning that the Ohio lands had already been claimed by the British Crown and any further Frenchled encroachment would not be allowed. His reports and notes which can be seen in the collection at Virginia University stated that: “I was commissioned and appointed 35 51


HISTORY NOTES NO. 172 - JULIAN LEA-JONES by the Honourable Robert Dinwiddie, Esq; Governor, of Virginia, to visit and deliver a letter to the Commandant of the French forces on the Ohio, and set out on the intended Journey the same day: The next, I arrived at Fredericksburg, and engaged Mr. Jacob Vanbraam, to be my French interpreter; and proceeded with him to Alexandria, where we provided Necessaries. From thence we went to Winchester, and got Baggage and Horses and from thence we pursued the new Road to Wills-Creek, where we arrived the 14th of November”. Dinwiddie’s adjutant got back to Williamsburg the following January and submitted his report to him. Pleased with his adjutant’s handling of the matter Dinwiddie, much to the young soldier’s surprise, sent the report to the local printers and arranged for it to be distributed. This must have done a lot for the soldier’s credibility, because as history shows his skill in the affair was undoubtedly noted both by the leaders of the Virginia colony and by those further afield. In the meantime due to the strains of overwork and years of attempting to reconcile the irreconcilable Robert Dinwiddie asked Secretary of State Wiliam Pitt “The Elder” to be relieved of his position. This was granted and in 1759 he returned to England with his family, living first in London, then Bath, and finally at Clifton in Bristol where he died and was interred. A memorial to Dindiddie was installed in St Andrew’s Church Clifton. The church was destroyed in the Blitz of November 1940 and subsequently his memorial, along with the rubble remains of the church, was used to fill in the crypt. A transcript of his memorial reads “In this church are deposited the remains of Robert Dinwiddie Esq. formerly Governor of Virginia, who deceased July 27th 1770 in the 78th years of his age. The annals of that country will testify with what

judgement, activity, and zeal he exerted himself in the public cause when the whole North American continent was involved in a French & Indian War” (My thanks to the late Marguerite Fedden who included a transcript of his memorial in her book, Bristol Vignettes). To explain why Robert Dinwiddie’s actions resulted in a ‘hinge moment’ in world history we must consider his choice of protégé - the young surveyor with whom he had entrusted with the raising of militia and for the building of forts. The young Lieutenant-Colonel, now not so young, had learned his lessons well and as a result was now a General. The year of 1767 saw the Virginia House of Burgesses summarising the colonists’ case, the introductory clause of which was written by the member who referred to “Our Lordly masters in Great Britain”. It was the same member who, on 10th May 1775, was appointed Commander in Chief of the Continental Army, and on 30th April 1789 ws inaugurated as the 1st President of the United States. By now I expect that you have guessed that the person that Robert Dinwiddie gave that all important start to his military career to was George Washington. ` A question for you. If Robert Dinwiddie hadn’t seen the potential in the young George Washington, or hadn’t returned to England and died in Bristol, would someone else with similar capabilities have appeared on history’s stage, or would the British have gone on to win the American War of Independence with the result that America in 2022 would still be part of the British Commonwealth? St Mary Redcliffe Church launches stained glass window competition

Bristolians as it was for people in Jesus’ time. The competition offers us the opportunity to open up this question once again within the context of this window. Rather than the four panels at the base of the window quoting the conclusion of the story (which Edward Colston took as his motto) we will use them to provide the context of the story and allow the window, with its the Victorian artistry, to provoke the contemporary viewer with the same challenge to broaden and expand our understanding of the question “And who is my neighbour?” just as Jesus provoked the lawyer.

St Mary Redcliffe Church is inviting individuals, community groups, organisations and schools both locally and nationally to enter an exciting competition to create new designs for four stained-glass panels for their Good Samaritan window reflecting the theme ‘And who is my neighbour?’. The church, which has been a place of Christian worship for over 800 years, is looking for creative and imaginative designs that will work well across the four small panels of glass that run along the bottom of the North Transept’s central window and will complement the window as a whole.

The competition is open to everyone, including those under 18 years old and the judging panel will consider all types of design. The winning entry will be recreated in stained glass and subject to legal permissions, will replace the plain panels currently installed in the window after the original panels were removed due to their association with the slave trader, Edward Colston. The shortlisted entries will be displayed in an exhibition at St Mary Redcliffe Church and on the church’s website from 20th August to 18th September. Members of the public will be invited to view the designs and make comments before the judging panel make their final design. Comments made by the general public will be considered in the final judging process.

The North Transept window tells the story, commonly known as The Good Samaritan, in which a lawyer tests Jesus by asking him, ‘And who is my neighbour? The story has many messages, but one of them is that the lawyer’s concept of ‘neighbour’ needs to be challenged, broadened and expanded. That lesson is as much a challenge for 21st-century

In the spirit of openness and inclusivity, St Mary Redcliffe decided to run this competition to find new ideas for stained-glass panels that are in recognition of the deep wrongs inflicted on so many in the past. What has become increasingly clear, as we understand more of our history, is that philanthropy built on the back of injustice is immoral and should not be commemorated. The removal of the stained-glass commemorating Colston forms part of an ongoing process of historical evaluation and analysis designed to ensure that the church’s presentation of its past accords with its modern values, vision statement and mission.

The word “pwned” has origins in video game culture and is a derivation of the word “owned”, It’s typically used to imply that someone has been controlled or compromised. It’s a phrase we now apply to email addresses, passwords and mobile numbers that have been data-breached. And it’s worth checking whether you’ve been pwned.

Change your security questions as well. If you’ve used the same password on other accounts or websites, change the passwords and security questions on all of those accounts. Have I Been Pwned? (HIBP) is run by web security experts and allows you to see, for free, if you may have been put at risk because your information was “pwned.” Here’s what to do:

New meadow in Clifton Village bursts into bloom A new meadow is flowering in Clifton Village, on a former grassy slope on Clifton Hill, below the old churchyard of St Andrew’s.

The meadow, and a ‘wildflower lawn’, have been created by local ecological group West Bristol Climate Action, working with the council, who own the land. The aim is to support pollinators, such as bees and butterflies, whose numbers have collapsed in recent years.

Environmentalist Dan Geerah, a volunteer with the group, said, ‘Clifton Hill is a perfect demonstration of how quickly nature can thrive. We hope we can inspire people to follow our example on both council-owned and private land, and help bring nature to Bristol.’ The group ran a public consultation last summer, and 99% of the 300 people who took part were in favour of the transformation. GARDENING TIPS FROM HILARY BARBER 1. Deadhead regularly to keep plants flowering - great for the insects in your garden and great for the plants and for you, because they just keep flowering! 2. Weed regularly to stop weeds going to seed - If it’s hot then leave the weeds to die on the surface of the soil, unless they have already gone to seed, then put them in the green bin immediately because all those seeds will germinate next year! The old saying is 1 year's weed, 7 year’s seed! 3. Check for pests and diseases - use organic methods to get rid of pests where possible. I crush 2 cloves of garlic in boiling water, leave to cool overnight and then put in a spray bottle (sieve out the garlic!) with a teaspoon of cooking oil and a squirt of washing up liquid - great for getting rid of aphids which seem to be running rampant this year. 4. If July and August are hot, water your garden well once or twice a week, rather than little and often. Water directly to the base of the plant as this encourages plants to put down roots in search of water, rather than coming up to the surface. If you have mulched your pots and your beds well, then hopefully the ground will remain damp under the mulch. (And don’t forget saucers under your pots to stop water run off)

Mow your lawns regularly, but raise the height of the mower blades if the weather is hot. Prune the whippy growth of wisteria to about 5/6 buds from the main stems. 12. With heavy rain and humidity, I have found that some plants start smothering others, so do keep an eye on those and trim back accordingly - I have found some gems in my garden this year, sitting under other more ‘busy’ plants and with care, feeding and watering, they have started to flourish!

5. Clear algae, pond weed and debris from your ponds and keep them topped up with fresh rain water, and make sure you have a new bale of barley straw to keep ponds clear. This is so important for pond life and insects.

Inheritance Tax - Traps for the unwary Bereaved families face paying up to £140,000 in avoidable inheritance tax due to bewilderment over the death duty’s “most confusing” rule. Since 2018 homeowners have benefited from extra tax breaks on their main home when passing it on to a direct descendant known as the “main residence nil rate band”, or “family home allowance”. Today this stands at £175,000 and comes on top of the standard £325,000 allowance. Spouses and civil partners can share their allowances. People who sell an expensive property to downsize or to go into care can claim a tax credit known as the “downsizing addition” so they still qualify for the enhanced protections. But many are unaware they qualify. Now, with more people downsizing, living longer and moving into care in later life, an increasing number risk missing out. What’s more is that families who thought they had avoided the duty by making legal, tax-free gifts were told to pay thousands of pounds after being found to be in breach of so-called gift with reservation of benefit laws. The tax rules are meant to stop people from rattling around big houses to make the most of tax breaks on their homes, but it is the families who have to claim the addition and most lay executors have no idea it exists at all.

The rules apply to anyone who has sold their home or downsized to a smaller property since July 2015. How the family home allowance works : • •

Inheritance tax is charged at 40pc of all assets above £325,000. From April 2017 a new, higher threshold including a “family home allowance”, began to be phased in. To be eligible it must be passed to direct descendants. The allowance stands at £175,000. Married couples will be able to pass on estates of up to £1m to direct descendants, including a family home. Estates over £2m lose the relief at a rate of £1 for every £2 over the threshold. People who sell an expensive property to downsize or go into care can claim the ”downsizing addition” so they still qualify for the new threshold, as long as most of the estate is left to direct descendants

As an example, consider a widow who sold her house in 2018 for £400,000 and moved into residential care, but later died in 2020, leaving £650,000 in investments and £350,000 in cash to her family. Her relatives use her and her former husband’s main IHT allowance so the investment portfolio passes tax free. They wrongly believe they cannot claim the family home allowance, as the house was sold previously, and are hit with a £140,000 death tax bill.

Enduring Power of Attorney (EPA) vs Lasting Power of Attorney (LPA) A power of attorney is a document by which one person (the “donor”) gives another person (the “attorney”) the power to act on their behalf and in their name. Lasting Powers of Attorney (LPAs) were introduced in 2007 by the Mental Capacity Act and replaced the old system of enduring powers of attorney (EPAs). Like the EPA, the LPA remains effective after the donor loses mental capacity. However, there are some important differences. For example, an EPA can be used prior to registration but must be registered when the donor becomes or is becoming mentally incapable for it to have an ‘enduring’ effect. Conversely, an LPA cannot be used until it is registered but it can be registered as soon as it is executed. It is not possible to change an existing EPA into an LPA; instead a new separate LPA has to be drawn up and the EPA revoked. Although EPAs remain valid, there are many advantages in switching to LPA(s) which make them more comprehensive and more flexible: • EPA: covers Property and Financial decisions, there is no provision for the donor’s welfare.

LPA: can cover Property and Financial decisions and/or Health and Welfare decisions, including decisions about life-sustaining treatment. EPA: where more than one person has been appointed as attorney, all the named people must agree with the decision for it to be actioned. LPA: up to four attorneys can act ‘jointly and severally’ (together or separately) with your permission. You can also allow them to make certain decisions ‘jointly’ while making other decisions ‘jointly and severally’. Replacing your EPA with an LPA gives you the freedom to review, at any time, who you’d like to act on your behalf should you lose the ability to make decisions through illness or injury.

If you have an EPA, consider reviewing your circumstances to confirm you have the correct provisions in place, ultimately ensuring you are looked after in the ways you want to be should the time come.
