You may be concerned that increasingly, solicitors’ practices are becoming ‘law firms’ with a solicitor meeting the client, taking on a matter and then supervising paralegals and legal executives to carry out the work. Corfield Solicitors does not operate in this way; we simply offer three fully qualified solicitors, personally dealing with your matter from start to finish. Deciding to leave his city centre firm, Jonathan Corfield established his own practice in Sneyd Park in 2009 where he and his wife have lived for many years and raised their family. Charles Corfield joined the practice later that year after graduating from Bristol University with a Masters in Law and both were later joined by Stuart Corfield when he also qualified as a solicitor. Our fees are set in order to make a living rather than a fortune. No ‘extra costs’ are added for home visits. No additional ‘out of hours’ charges are made.

THE EDITOR'S SMALL PIECE

By Joanna Murray-Smith

Hello there and welcome to the March magazine. I trust this finds you all warm and well.

Horfield Theatre Company at

The Alma Tavern and Theatre

It's a late Thursday afternoon as I type this, just getting dark - and the trees I look out onto are beginning to flex and bend in the strengthening wind. Tomorrow morning Storm Eunice is due to arrive with all the frightening force that Mother Nature can muster. Combined with a very high tide and a full moon the propsects for some meteorological fireworks are high, so I only hope that everyone manages to batten down the hatches, stays safe and, by the time you read this, you have found your fence panels.

I'm hoping that the office, which is in a 1970's loft extension built to a design that Prince Charles would have (rightly) hated, survives the incoming low pressure as I am due to have it redecorated in early March. The first overhaul for 15 years, and 10% Discount for NHS staff first new carpet for 25 years, is an event requiring careful thought, especially in terms of colour schemes. To "ease" the decision I invested in a box of about 500 Peter Wyatt 2020 rev 1.indd 1 18/05/2020 All types of plastering: colour swatches, like the sample cards you get at the DIY centre. And yet I keep coming back to a white ceiling, magnolia walls (aka Clifton qualified and experienced plasterer. Senior Snippets Getting ready for Spring

Many people, especially seniors, tend to slow down and stay indoors more during the winter, so when spring finally makes its appearance, it may be difficult to get out of some of those winter habits. Spring is the perfect time to enjoy the outdoors and start a more active lifestyle. Keep Active - As people age, it is essential that they stay active mentally, physically and socially. It is important to stay active and fit by doing something you enjoy. Finding a hobby or revisiting activities that you once enjoyed will help to maintain your strength, flexibility and balance as well as promote good cardiovascular health. Physical activities will help you maintain a healthy weight, make sleeping easier, control illnesses and reduce stress. Eat Healthy - Eating a healthy diet is one of the most important things seniors can do have a healthy, active spring. Winter often makes it difficult to eat the fresh fruits and vegetables that your body craves, but now that spring has finally arrived, it’s time to change your eating habits. The combination of physical activity and eating a nutritious diet can help prevent or reduce the risk of a wide range of illnesses, such as high blood pressure and heart disease as well as reduce the symptoms of osteoarthritis. Preventative Care - This is the perfect time of the year to schedule all of your routine checkups, including dental, vision and hearing. Spring Cleaning - spring cleaning is a great way to ensure you stay healthy and fit this spring. Enlist the help of family, friends or your CAREGiver to help you remove items that may be a fall risk, such as throw rugs or loose carpeting. It’s also the perfect time to clean out the refrigerator and cupbpards, get rid of expired foods and restock with fresh, healthy foods. Opening the windows and letting the fresh spring air circulate through your home will not only help your home smell fresh, but it will help to relieve stress. If you would like to speak to someone at Home Instead, please do get in touch. Similarly if you have any ideas for a future topic, please call 0117 435 0063 or email john.moore@homeinstead.co.uk - we’d love to hear from you! 10

21st CENTURY MYSTERIES Streaming… most of us do it but what do we actually know about it? Let’s dig into the good, the bad and the downright perplexing of this modern phenomenon…

platforms like Netflix will always be on there. Contracts may not be renewed and shows may suddenly disappear. Similarly, with music, your favourite artist may not always be available to stream – this recently happened when Neil Young and Joni Mitchell removed their songs from Spotify and is something that doesn’t happen if you own the physical product.

What Is Streaming? Streaming is a way of s e n d i n g / receiving data over a network. Streaming allows you to play content such as television shows, podcasts, movies, music and video games without the need to download large files. Sent as a continuous flow of data, you’re able to start watching (streaming) a film the moment your device receives the corresponding data, with the rest of the data transmitted in real time.

You also need to have fast and reliable internet connection with sufficient bandwidth in order to prevent slow play and buffering (that annoying interruption in play when data is loading). A dodgy connection can lead to a significant drop in audio and visual quality that may have you reaching for your Blu-ray discs/vinyl records We’ve Head That Streaming Is Bad For Musicians, Is This True? That depends on how you look at things. Streaming platforms such as Spotify and Apple Music offer new musicians a way to get their songs heard without requiring the backing of a label. Uploading songs is relatively simple, far more so than having to produce, market and sell a physical product, and it’s easy to stream them too.

Smooth streaming relies on a strong internet /4G/5G connection. If you have that, and a subscription to the relevant platforms, a vast catalogue of visual and audio treats awaits. How Does Streaming Work?

However, the bigger issue is how little money is distributed to songwriters via these platforms, making it almost impossible for most musicians to make a living through streaming music. For example, Forbes recently reported that for 1 million plays of a song, artists receive roughly the following: Amazon Music $5,000; Apple Music $5,000-$5,500; Google Play $12,000; Pandora $1,400; Spotify $3,000-$6,000; YouTube $1,700.

Streaming works by breaking down content into small pieces of data and then transferring them to your computer or mobile. Once your device receives this data, both audio and visual, its able to interpret what it has received and can begin playing your chosen song, game or the latest episode of your favourite show.

What Is Live Streaming?

As we mentioned, you don’t need a large amount of computer space when streaming as you are not downloading content onto your device. However, companies like Netflix, Disney+ or Amazon Video that provide the content will need vast servers or online (cloud) storage for housing everything that can be streamed.

As well as streaming pre-existing content, you can also stream live video and audio content such as talks or gigs as it is being created. This can be done through social media sites such as Instagram Live, Facebook Live and LinkedIn Live. The world’s most popular live streaming platform is Twitch, with 15 million daily users using it to stream live content. And what do most people watch on Twitch you might ask? The answer is that they mainly watch other people playing videogames – welcome to 2022!

What Are the Downsides of Streaming? Most providers charge a monthly subscription fee in order to be able to stream their content, but that doesn’t mean that shows currently on

Are you protecting your cash from inflation? As you will no doubt be aware, inflation is at its highest rate for 30 years, having risen to 5.4% in the 12 months to December. At the time of writing the average bank account interest rate is 0.06%!

Investments have always provided better growth potential than savings in the long-term. In addition, utilising key tax shelters such as ISAs and pensions is a simple and effective way to further protect investment returns – and mitigate the impact of inflation.

This news is extremely unwelcome as inflation has the potential to significantly devalue your cash in real terms over time. Effectively, your purchasing power is ravaged as you live through retirement. Perhaps you have spent your whole working life saving up a nest egg for you and your loved ones. You may have only recently come into ‘cash’ after inheriting money, downsizing or selling a house or business.

Remember, this year’s ISA allowance has to be used by 5th April or it is gone forever. From 6th April a new ISA allowance is available. ‘ISA Season’ is often a great time to review, and potentially switch, existing under-performing cash ISAs and also make new tax efficient ISA contributions.

The issue is that even if interest rates rise this year, the rates offered for saving accounts are likely to be significantly below the rate of inflation.

We are happy to offer a complimentary investment review so you can be sure you are doing everything you can to protect your cash assets, whether from inflation or any other external factors.

Therefore reviewing your assets this year will be key to protecting your wealth from inflation. At times of high inflation and low interest rates, it simply isn’t ideal to hold on to too much cash.

To book your financial planning review with Chartered independent financial adviser Richard Higgs, by calling 0117 3636 212 or emailing office@haroldstephens.co.uk. Harold Stephens provides friendly financial advice in the local community on a face-to-face basis in a welcoming location at 50 High Street, Westbury on Trym, BS9 3DZ. The firm specialises in advising later life clients on their investments and pensions, long-term care, inheritance tax and estate planning. 15

AROUND THE WORLD IN EIGHTY DISHES - JAMAICA From Central Africa last month we head west, northwest, to the Caribbean Sea and the island of Jamaica, to try out two of their most common and popular dishes. The motivation to do this was the receipt of a lovely box of tropical foodstuffs from Kathryn at Irie Box, a new little Bristolian business she has established to bring the flavours of the Caribbean into our kitchens.

a pea in sight. In Jamaica kidney beans are, apparently, called peas - even though other beans are called beans. It is usually cooked as an accompaniment - going well with the ackee and saltfish - but can also be the main dish itself - healthy, filling, tasty and easy to cook. I loved it. I hope, you do to.

We ordered the "Ackee and Saltfish Recipe Box" which gave us everything we needed to put together what is regarded by many as Jamaica's national dish. Both the main ingredients were new to me, and the nutty flavour of the ackee (actually a savoury fruit) and the dry saltfish (usually cod or pollock preserved in salt) combined beautifully with the other supplied ingredients to produce a really colourful, tasty, easy to cook dish.

Ingredients - serves 2 to 3 people depending on the size of their hunger.

However I'm not going to give you the ackee and saltfish recipe - it comes with the recipe box, and if you fancy giving it a go please support Kathryn and her great new venture by buying online from www.iriebox.co.uk What you do get from me though is the recipe for another traditional Jamaican staple - Rice and Peas. I hope I am not alone in simply thinking "rice and peas" is , well, just rice - and peas. There is more to it than that - the key thing being there isn't

Jamaican Rice and Peas

• • • • • •

1 x 400g tin of kidney beans, rinsed and drained 1 x 400g tin of coconut milk ("light" is fine) 4 spring onions, finely sliced long grain rice, enough when uncooked to fill 2 medium wine glasses 1/2 tsp of fresh thyme, removed from the stalk 1/2 tsp ground allspice (also known as pimenta seeds - If you can't get allspice use 1/4 tsp of ground cinnamon and 2-3 cloves) 1 x Scotch Bonnet chilli (optional) - do not chop 1 medium wineglass of cold water salt and pepper 1 tsp oil

Method 1.

2.

In a medium saucepan heat the oil to a moderate temperature then add in the spring onions. Gently fry the onions for 2-3 minutes. Remove from the heat. Add in the thyme, kidney beans,

coconut milk, allspice and water, and season well with salt and pepper. Also add in the Scotch Bonnet chilli if you want your rice and peas to have an extra kick - it is best to leave it whole to keep a lid on the heat! Over a medium heat bring the ingredients to the boil, then reduce the temperature and simmer gently for 5 minutes. In the meantime rinse the long grain rice well in a sieve, to remove as much of the starch as is possible. Now add the rice into the coconut milk, beans and spice mixture, stir well, return to the heat and bring to a boil. Reduce the heat, stir again, cover the pan and leave to simmer gently for 10 minutes. Remove the lid, stir the rice and, only if necessary, add a little more water. Continue to simmer uncovered for a further 5 minutes until the rice is tender

Website continue to attract a lot of press and concern. So what are they and are they dangerous? Simple tracking cookies are essentially harmless and rather useful - without them much valuable website functionality couldn’t work - but many people feel that cookies actually invade their privacy. And you should be aware of the growing use of third-party cookies to track your online activity.

So, they are generally NOT security threat - but you may feel them an invasion of privacy. You can easily instruct your web browser, in its settings menu, to disable all cookies - Trouble is, you’ll find most websites with any functionality won’t operate well - or at all.

Although some people think cookies are malware, they aren’t. Browser cookies, tracking cookies or simply just cookies are all tiny text files that are saved to your PC while you’re surfing the web. Innocently, cookies are used to personalize your browsing experience by tracking and storing your activities. They allow you to store log-in passwords, they enable websites to remember your past purchases and preferences etc.

My general advice is a halfway house - limit “Third Party” cookies, which are more of a privacy - and potentially security - threat. Third-party cookies are cookies that are set by a website other than the one you are currently on. For example, a website might have a Facebook “like” button on their site. That like button will set a cookie that can be read by Facebook. Most web browsers like Edge, Firefox and Chrome allow this - usually by going to the Options or Settings menu, and looking under the “ Privacy” tab (different browsers menus will vary slightly). Ultimately it’s personal choice whether you disable, limit or happily live with them. Russell Isaac can be contacted on 0774 775 3764 or via www.ithomehelp.biz

Give your roses a good feed after pruning (this applies to all shrubs after pruning). My preferred feed is organic seaweed fertiliser or chicken pellets. Hard-prune summer-flowering shrubs such as buddleia, caryopteris, hardy fuchsia, lavatera, leycesteria and perovskia. You can also prune rosemary and lavender but just lightly as it will not re-grow from the old wood. Coppicing (hard pruning to the ground) willow and dogwood (cornus spp.) will produce new colourful stems for next winter. Coppice or pollard eucalyptus, catalpa and paulownia to keep them a manageable size and provide attractive foliage. Renovate overgrown honeysuckle or jasmine and prune summer-flowering clematis to shoots about 1ft from the ground, even if new fat buds are sprouting on old stems. Lawns will also need some attention. Scarify with a spring tine rake to remove moss and thatch, spike with a fork (to improve drainage) and top dress with 3 parts sand mixed with 4 parts loam. Brush the top dressing in with a soft brush, and if re-seeding is necessary then either mix the seed with the top dressing or sow afterwards. Remove one or two inches of compost from containers with permanent planting and top- dress with fresh compost, and feed them. Deadhead daffodils as they fade, but allow the foliage to die down naturally, allowing the nutrients to be drawn back

down into the bulb Split and divide congested clumps of snowdrops to spread around the garden and to encourage better flowering. You can also buy bulbs 'in the green’ such as snowdrops and winter aconites which establish more quickly. 10. Herbaceous perennials are starting to emerge, so protect new growth from slugs and snails. Please don’t use metaldehyde based slug pellets because these are disastrous for the birds, hedgehogs and other wildlife 11. Plant asparagus crowns, Jerusalem artichokes, garlic, onion sets, shallots and strawberry plants. 12. If you haven’t cut back your ornamental grasses, leaving the seed heads for the birds, do so this month, to allow for fresh new growth 9.

HISTORY NOTES NO. 168 - JULIAN LEA-JONES Bristol's little seen saint I wonder how many are aware of local sculptor Steve Joyce’s 1985 statue of St Odelia? His splendid statue of the saint stands amidst a quiet space for visitors in an inner courtyard of our Lower Maudlin Street Eye Hospital. Unless visitors follow the statue’s gaze, they may not even notice the model bird suspended high above, and even then, they may not appreciate its significance.

years old her adopted parents placed her in a convent at Besancon. During her subsequent baptism her sight was miraculously restored when her eyes were touched by the officiating Bishop and he reportedly said to her, “Now you will see the Kingdom of Heaven”. After a number of setbacks, she became reconciled with her birth bfamily. Her father was so impressed by her piety, and presumed divine protection from murderous attempts on her life, that he offered her his Rhineland castle at Hohenburg, later renamed as Odilienburg, as a convent, where she was installed as Abbess. Renowned for miracle cures and visions, she went on to found a second convent at Niedermunster. After her death her shrine became a place of pilgrimage for those with eye diseases. Her popularity resulted in her canonisation and henceforward she was recognised as the Patron Saint of The Blind, and of the Alsace region. However, it wasn’t until 1807 that Pope Pius VII made her sainthood official with her own feast day. But what was the significance of the bird? According to legend, when Odelia was trying to escape her father’s clutches, a mountain opened forming a cave to give her a hiding place. Later when it was safe the rocks again opened releasing, her at which point she spied a bird.

As with most saints’ lives, dates and legends vary. Odelia, (or Odilia), is reported to have been the daughter of Lord Adalric of Alsace and was born in the eighth or ninth century. According to the Wordsworth’s Dictionary of Saints she was born blind and her father considered her handicap brought disgrace to the family and wanted her killed. Fortunately, her mother saved her but only at the personal expense of giving the baby to be raised by a peasant family who were not told of the baby’s noble background. Thus, Odelia survived, and when she was twelve

Other accounts say that the bird was the first creature she saw when her vision was restored. Whichever version is correct no one knows. As with many legends the passing of time has resulted in a proliferation of different versions of the story of Saint Odelia. However all versions agree on one point, Odelia is recognised as the patron saint of all eye problems, with her feast day recognised by the Orthodox Church as the 13th of December. Saint Odelia is only one of Steve Joyce’s many artworks, but probably the least noticed. In contrast his most noticed and visited Bristol statue must be the pensive figure of John Cabot seated on a ship’s timber on the quayside by the Arnolfini gallery. Steve trained as an artist and sculptor and worked for a while

HISTORY NOTES NO. 168 - JULIAN LEA-JONES as an Industrial Archaeologist which perhaps explains the realism he has brought to his artworks. To understand how these commissions came about, we must go back to the 1980s when the city of Bristol Town Arts group were looking for a way to commemorate the restoration of Welsh Back from the World War II bomb damage. Steve’s very evocative and graphic design for an Iron plaque marking the site of the quayside crater soon led to more commissions.

The first and probably his most famous was the seated statue of John Cabot. His next opportunity came when Architects of the Alec French Partnership were renovating for the City Council the Brunel House office building in St Georges Road by College Place (In history note 162 I explained that it was once the Great Western Hotel for GWR passengers about to embark on Brunel’s ships to America). At the Park Street side of Brunel House is a deep amphitheatre shaped space, once the site of a 19th century horse bazaar, (conveniently near the former carriage manufactory to the other side of Brunel House). Steve’s commission was for an artwork commemorating the site’s history. The happy outcome was they agreed to fund his choice of two life sized statues, that of a horse trader in working clothes leading a work horse. Interestingly, in the days when goods traffic was by horse and cart, extra horses, known as

trace horses, were stabled at the bottom of Bristol’s hills to help get wagons and omnibuses, in this case, up Park Street. However, the statue of the horse looks so careworn it is doubtful if it could have pulled it on the level, let alone up Park Street. The amphitheatre is now just a restful, albeit drafty, green space. I was told by an actor that they had used the space for a performance of a Midsummer’s Night’s Dream, and it was the coldest midsummer they had ever spent. Which reminded me of Mark Twain who is reputed to have said, “The coldest winter he ever spent was a summer in [foggy] San Francisco.” I started this month’s note by telling about Steve Joyce’s statue of St Odelia, but with Bristol’s reputation for being a city of churches, (and pubs!), it would be an interesting exercise to see how many other saints you can name as being commemorated in Bristol – a magazine quiz perhaps? (noted - Ed.) Lastly as a possible tie breaker, the next time you are walking around the Corn Street and St Nicholas market area, see if you can find the sign for St Pancras. Andy may give the surprising answer in next month’s magazine. © Julian Lea-Jones, FRAeS, 2022 If you are interested in reading any of Julian's previous history articles that have featured in the magazines they can be accessed by visiting the BS9 and BS6+8 website - www. bcmagazines.co.uk There you will find issues of the magazines going back to 2013.

The Highway Code has received a refresh, with a new set of rules that came into force at the end of January. As well as some 49 existing laws having been updated, new rules will be introduced.

New rule for drivers and motorcyclists at junctions

The changes are extensive and further information is available on the website link located at the bottom of this article. However, the key areas are summarised below.

Safe passing distances

Hierarchy of road users Previously The Highway Code stated all road users should be considerate towards each other, applying this principle to pedestrians and drivers equally. It meant that equal responsibility was originally placed on all road users for assuring the safety of others. The new hierarchy places responsibility on road users who could do greatest harm to others, and it is with them that the greatest obligation to protect the most vulnerable on the road now lies. Top of the hierarchy are lorry drivers, cars, vans buses and motorcycles. But it should be noted that cyclists, horse riders and horse-drawn carriage drivers have a greater responsibility to reduce the danger posed to pedestrians. Pedestrian priorities at junctions Prior to the rule change, road users would have given way to pedestrians who have started to cross the road into which they are turning. Under the new rules priority must be given to pedestrians who are waiting to cross the road, which means that if you are about to turn into a road and a pedestrian is waiting to cross, you should give way.

The new rule states that when turning into or out of a junction, drivers should not cut across the path of any other road user, including cyclists, horse riders or horse-drawn vehicles, if doing so would cause the other road-user to slow down, stop or swerve. An amendment to existing Rule 163 sets out safe passing distances for drivers when overtaking cyclists, motorcyclists, horse riders and those in horse-drawn carriages. Drivers must give at least a 1.5 metre space when overtaking a cyclist at speeds of up to 30mph. More space should be allowed when overtaking at speeds of more than 30mph. Rule 72 establishes the right for cyclists to ride in the centre of their lane, to ensure that they remain visible. When passing a pedestrian who is walking in the road, drivers should allow at least two metres of space and maintain a low speed. Rule 213 has also changed and now states that on narrow sections of roads, horse riders may ride in the centre of the lane and drivers should allow them to do so for their own safety, to ensure they can see and be seen. Drivers should pass a horse at least 2 metres distance and at a slow speed. In all cases, drivers will now have to wait behind a motorcyclist, cyclist, horse rider, horsedrawn vehicle or pedestrian and not overtake if it is unsafe or not possible to meet these clearances. Extra care should be taken in poor weather, including high winds.

THE STORY OF ANDREW KELLER

Bristol has a new blue plaque, at 41 Westbury Road, BS9 3AU, and I’ll bet none of you have heard of Andrew Keller, the person it is dedicated to. You should though, because many aspects of your daily life have been made possible by his work. From medical equipment to components of the tech you use every day, and even your clothes, developments and improvements were made because of his discoveries. But there is another side to his story too, an incredible side which reads like the pages of a novel, because Andrew (born András) was a Holocaust survivor. He was born in 1925 in Budapest to a secular Hungarian Jewish family. During WWII, aged 19, he was conscripted into a brutal labour battalion, where he was forced to mend airfields damaged by Allied bombing. He was starved, beaten and expected to work until he died, in days, weeks or, if he was lucky, months. When the Allied planes flew over the prisoners quickly learned that the guards would run into the woods - so they would fan the flames of their fires to attract the planes’ attention. They hoped, even if they were shot for it, the runways would be bombed, the war would be over quicker and maybe their families would survive. When Allied advances meant the Germans had to retreat, he was taken on one of the

infamous Nazi death marches. In a brief moment when there was no guard visible, he jumped out of the column and was not spotted. He later learned that only two people from his group survived. He was nearly discovered when the German front passed over his hiding place, but his luck held and he finally emerged when he heard the voices of Russian liberators. The Russian soldiers took him to a displaced persons’ camp where former prisoners and prisoners of war were all held together. The day to day running of the camp was left to the German prisoners, who made life very difficult for a young Jewish man. He noticed that truckloads of prisoners were being taken away and, guessing (correctly) that they were being taken to fill the labour shortage in Russia, he escaped again. This time he crawled under three rolls of barbed wire on a moonless night and ran into the dark. He spent three weeks trying to get back home to Hungary, travelling on false Red Cross papers. When he finally got home he found his mother and young cousin still alive, but his father, uncle and aunt had disappeared and were never seen again. Later he discovered his father had died in Buchenwald Concentration Camp, three weeks before it was liberated i n April 1945. Even back in Budapest with his family he could not relax as, here too, men and boys were being indiscriminately snatched from the streets to ship back to help with the war effort in Russia. He had three terrifyingly narrow escapes where he was caught but managed to get free again. At the same time he was able to start University and, after some initial difficulties because of his false papers, enrolled into an accelerated programme in Chemistry, achieving his BSc in 1947. His abilities were evident even then as he started a Phd which he completed in two years. He had submitted, but not yet defended it, when he was warned by his English teacher in Budapest, a British industrialist thought to be an intelligence officer, that there was a warrant out for his arrest and that he should not go home. He immediately got on a train

THE STORY OF ANDREW KELLER and left for England where this same teacher had arranged an interview for Andrew at ICI. That night the Iron Curtain came down and, had he tried to leave even a day later, he would have been trapped. Perhaps he was part of the brain drain, where promising scientists were encouraged to leave the Soviet sphere of influence during the Cold War. He got the post at ICI, allowing him to stay in England. (In an interesting twist to the story, another candidate for the post was a young scientist called Margaret Roberts, who later married Dennis Thatcher and went into politics). Andrew came to Bristol in 1955 to take up a post at Bristol University where he worked until his death in 1999. He never spoke about his early life, being entirely focused on science, and this extraordinary part of his life remained unknown to most people until the unveiling of the Blue Plaque last August revealed it. As a scientist he had an impressive record, being awarded many prestigious honours , became a Fellow of The Royal Society in 1972, an elected member of the Academia Europaea

in 1994 and an elected External Member of the Hungarian Academy of Sciences in 1998. There is even a prize named after him now, The Andrew Keller Award for Best European Paperin ‘Polymer’ Journal. AK-01.png

So, next time you have an injection, pick up your phone or type on your keyboard, think of Andrew Keller, the man who made this possible. A man who experienced more trauma than any human being should hold, and turned it, here in Bristol, into a determination to make his life count.

VIEW FROM THE LORD MAYOR’S PARLOUR The start of the New Year has been a relatively quiet time in the Lord Mayor’s diary, as I’m told it usually is. There has been a bit of a focus in the last month on celebrating special events for particular communities within the city.

As I write we are also in the swing of celebrating the start of the lunar year of the Tiger. I attended a celebration at Bristol Museum which brought together groups from across East Asia where lunar new year is celebrated with community groups from around Bristol. We were treated to a display of dances, including a traditional dragon dance, put together by community groups from across Bristol. The new year celebrations continue throughout February with several events still to come as I write.

On the 26th January I hosted a flag-raising ceremony and reception at City Hall to mark Indian Republic Day, the anniversary of the Indian Constitution coming into effect in 1950 which created the modern Indian state.

The slowdown in formal events has left me with more time to focus on the more practical tasks that come with being Lord Mayor. Part of the role is to chair Council meetings, and on the 15th February I will be chairing the Council’s annual budget setting meeting. This is usually a marathon session which runs for six hours or more, and this year looks like being no exception. As Lord Mayor I can steer clear of the politics and focus on the process of running the meeting, which makes a nice change. The only slight downside is that the meeting will be on my birthday, which isn’t exactly how I had hoped to celebrate!

We hold many of these kind of ceremonies to mark different national days. They are usually relatively low-key events and pass unnoticed by many. It is always a real pleasure though to meet and learn about the different communities that make up our City, and I think it is important to recognise these special occasions as part of our combined history. Being able to do that as Lord Mayor is a sign of how we are all a part of Bristol’s story, whatever our backgrounds.

I have also been focussing a lot on my role as Chair of the Downs Committee. It is a fascinating job which historically falls to the Lord Mayor due to a law dating back to 1861. We are working on reviewing how the committee works and what we are trying to achieve, and hopefully you will see a public engagement coming out on that very soon. I’m moving now into the final few months of my year as Lord Mayor, with the handover to my successor due on the 24th May. In the mean time I’m looking forward to meeting many more people at more events, so if you have an event coming up and would like me to attend, please just get in touch at lordmayor@bristol.gov.uk. Steve Smith, Lord Mayor of Bristol 36

Remote Witnessing of Wills Extended When the first lockdown began in March 2020 the execution of Wills became problematic. Fears about mortality in the light of the Leila Goodarzi pandemic meant that large numbers of people decided it was time to put their affairs in order, in case they succumbed to coronavirus. At the same time, actually meeting anyone, outside of your immediate family, was not possible, and so the question of how to sign a Will validly became pressing. Section 9 of the Wills Act 1837 provides that, in order to be validly executed a Will must be signed by the testator “in the presence of two or more witnesses present at the same time”. Given that a Will should not be witnessed by anyone who is a beneficiary under it, close family members were out and Private Client lawyers turned to old case law, in particular the 1781 case of Casson v Dade in an attempt to find ways around the problem. In Casson v Dade it was found that a Will was valid when the testator, sitting in her carriage outside her solicitor’s office, could have seen

40

the witnesses adding their signatures to her will inside. This led to people signing Wills through windows and on car bonnets, as so long as they had a clear line of sight of the two witnesses on the other side of the glass the Will would be valid. Signing Wills Virtually As the nation learned to use Zoom so the Government moved quickly to bring in an amendment to the Wills Act 1837 and allow Wills to be signed virtually. The amendment, which was retrospective to the beginning of the pandemic and was scheduled to expire in January this year, has now been extended until at least January 2024 What this means is that while a Will must still be signed in the presence of at least two witnesses, the testator and the witnesses do not have to be physically present in the same room and a “virtual” meeting via Zoom or Teams would enable a Will to be validly executed. The Ministry of Justice has indicated that remote witnessing via video technology should be a last resort, and physical witnessing should be used in preference where it is safe to do so. In addition virtual witnessing is recognised only if the quality of the

sound and video is sufficient to see and hear what is happening. Many practitioners are very cautious about remote witnessing, with recent research by the Law Society finding that only 14 per cent of legal professionals who had drafted Wills since the amendment was made had used videoconferencing to witness Wills. However, in certain cases, for example where someone is extremely clinically vulnerable, the ability to execute a Will in this way is welcome. However it is vital to

ensure that safeguards are observed, for example recording the meeting, to ensure that there is no question of fraud, or undue influence, and when the Will is sent to the witnesses for signing registered post should be used.

MUSIC - PRESENT, PAST AND PODCAST - DUNCAN HASKELL Album Of The Month Raised by Hailey Whitters If you only listen to modern country radio you’d come away with the impression that the genre solely consists of handsome young men singing songs about driving around in their car/truck with the top down and their feet up (is that even possible?). Thankfully, away from the whisky-stained airwaves, there’s plenty of great music still being made, as Hailey Whitters’ new record proves. One way that Whitters’ doesn’t deviate from the Nashville norm is the number of co-writers that she’s willing to work with. Familiar names such as Brandy Clark, Lori McKenna, Hillary Lindsey and Bobby Pinson all lend a hand. Thankfully, rather than homogenising her sound, the long list of cohorts seem to have sharpened her focus. What we have on Raised is a collection of songs paying homage to her childhood home of Shueyville, Iowa and the wider Midwest. Bookended by a pair of classical compositions that whisk you away to the banks of the Mississippi, the album nicely balances poignant ballads with toe-tapping anthems. A loving upbringing looms large over Big Family, a fiddle-led party of a song. That familial feeling permeates the album, not least on The Grassman - a sweet dedication to her sodgrowing grandfather who was often confused with the local dope dealer. Other highlights include the empowering Plain Jane, “I ain’t afraid to wear my floors / it’s so last year to cover them all,” and the nostalgiaimbued ode to first crushes and lasting friendships Boys Back Home. Raised on the music of Alan Jackson, The Chicks and John Mellencamps, Whitters deserves to be held in the same regard as her idols. Now this is the music the radio stations should be playing Next Step Crazy Ex-Girlfriend by Miranda Lambert

US reality show Nashville Star, Lambert seamlessly made the crossover to the country mainstream with the release of her major-label debut Kerosene in 2005. Two years later came Kerosene, an album which remains the highlight of the Texan’s long and distinguished career. The persona Lambert embodies throughout Crazy Ex-Girlfriend is that of a hell-raising popcountry outlaw. Opening track Gunpowder & Lead sets the dangerous tone and tells the tale of a victim of abuse who won’t take it any more, “His fist is big, but my gun's bigger / He'll find out when I pull the trigger.” It’s hard-hitting stuff that finds Lambert looking for her next fling on Guilty In Here before leaving a trail of broken hearts in her wake on Down. There are heartfelt moments too. More Like Her finds Lambert in quiet contemplative mood, reflecting “She's beautiful in her simple little way / She don't have too much to say when she gets mad” as she showcases her versatility as both a songwriter and a storyteller. You don’t have to be a country music fan to love these songs, but you do need to recognise a genuine badass when you hear one. Podcast of the Month How to Build a Sustainable Music Career and Collect All Revenue Streams Not one for the casual listener this month but some practical information for anyone wanting to negotiate the music industry in 2022. Based on her book of the same name, entertainment industry entrepreneur Emily White guides you through the different elements needed to establish a career in music. Topics covered include creating marketing material, landing a sync placement, deciding on a live strategy and designing your merch. Interviews with Justin Vernon, Imogen Heap and others only add to the value of this insightful series. Duncan Haskell

BRUCE FELLOWS’ BOOK RECOMMENDATIONS Letters of Note is what its title says, fascinating letters from a wide range of the notable and the less notable, brought together by Shaun Usher. The Queen sends a recipe for scones to President Eisenhower; Elvis asks President Nixon for special agent’s powers; a morse code message from, guess who, says, ‘we are sinking’. John Steinbeck says the girl his son’s met will always be welcome at their home, Ronald Reagan, a divorced man, gives his son advice for a happy marriage. Surprising, informative, entertaining, often very funny, and usually in the correspondent’s own hand, the letters are a joy and make compelling reading. Two young Irish friends; Alice, rich from the sales of her novel and Eileen, a poorly paid editor at a literary magazine, have similar anxieties and doubts in Sally Rooney’s captivating and intriguing novel, Beautiful World, Where Are You. How should they live? Who should they be with? The standard worries of the young perhaps but with the added extras of our contemporary world. Alice takes up with Felix, who slaves away in a warehouse, Eileen gets back with Simon, the friend of her childhood. Will they all stick? A simple tale, really, but so elegantly and cleverly told that you can’t put it down. How have the past couple of years been? Home schooling. Are they having too much screen time? Got to get some work done, though. Does the wall behind you send the right message on zoom? Who can we meet up with at the moment? No parties, obviously. Theroux the Keyhole, diaries by Louis Theroux, gives us the entertaining and often hilarious lowdown on how he and his have managed during the pandemic. No chance to make documentaries, he has to find other ways to make a living; podcasts, writing a diary? Life lived in the bosom of the family he concludes is hard; but good. Gritty, violent, near the knuckle, Twelve Days of Winter, by Stuart Macbride takes us on a tour of the dark underbelly of Scottish life. Twelve stories over twelve days tell of the fattest cat burglar in town; what goes on in the mortuary; an angry chef’s confrontation with a malevolent restaurant critic; an undertaker; a Santa and an Elf and several more: Christmas themes often but with very little ‘Ho, ho, ho.’ Nevertheless, they’re great stories, told with brio, with endings that you don’t see coming and often interlinked, so that characters, at least the ones who survive their stories, pop up again in another. August 1942 and the people of Malta are starving. Churchill decides the island’s loss would be one disaster too many and dispatches a fleet to raise the siege. Max Hastings tells the story in Operation Pedestal, his detailed and totally gripping history of the five days the Royal Navy and the Merchant Marine spent fighting their way across the Mediterranean. Great courage was displayed, as well as some cowardice; there was grit and determination aplenty and of course final success: a handful of the ships arrived, one tanker lashed to two destroyers. A terrific read to make you marvel at the things done back then.

REAR LANE – DO WE HAVE A RIGHT TO USE THIS?

right of way whether it is on foot and/or with vehicles. Sometimes there may be conditions on the time of day that the right can be used and who will be responsible for the maintenance and repair of it.

Laura Wilkinson of AMD Solicitors provides an insight into use of rear accessways and lanes.

b) Even if there have been no express rights of way granted it is possible that a private right of way can be established though evidence of long use. This is called a right “by prescription”. Provided it can be shown that it has been used for over 20 years without permission from a third party or in secret and that no payment has been made for the use of it, then a right of way can be established.

In many parts of Bristol there are lanes or access paths to the rear of properties used either to gain access to garages or as a pedestrian right of way for the removal of rubbish. As a property owner it is important to understand whether you have a right to use a rear accessway. A right of way may exist in one of the following ways:1.

A public right of way

This is a general right which can be enjoyed by the public over an adopted highway or path which is maintained by the Local Authority. A Local Search undertaken at the time of your purchase should show whether the accessway is adopted by the Local Authority. 2.

A private right of way

This can be established either by:a) An express agreement contained in historic deeds giving the owner of the property a right of way. The deed should specify the exact route, any restrictions on the extent of the width or height of the

Your local award winning law firm

Repairing a private right of way Often no one party can be identified as responsible for the maintenance and repair of an accessway. In this instance the usual practice is for the owners of adjoining properties to join together informally to contribute towards any repairs or, alternatively, each individual property owner will maintain the part adjoining their property. Buyers should therefore be aware that private lanes may therefore not be maintained and repaired to the highest standard. AMD Solicitors have teams of experienced conveyancers with a wealth of experience in all aspects of buying and selling properties. We take pride in our commitment to excellence in providing a high quality professional conveyancing service for our clients. We can assist you with buying and selling leasehold or freehold properties and flats and houses of all types.
