The Residence Nil Rate Band and Inheritance Tax Planning Strategies For many, the main residence is the most valuable asset in the estate. The introduction of the Residence Nil Rate Band (RNRB) from April 2017 will allow properties worth up to £1,000,000 (for married couples and civil partners, £500,000 for individuals) to be passed to direct descendants on death without an Inheritance Tax (IHT) charge. However, in some circumstances it might be preferable to redistribute assets during one’s lifetime, so here we look at one common financial planning scenario – downsizing and gifting the surplus sale proceeds. The Finance Bill 2016 contains draft legislation designed to compensate those who have downsized to a smaller property prior to death. To qualify for a ‘downsizing addition’, assets of equivalent value to any ‘lost’ RNRB must be passed to direct descendants on death. This is straightforward if the surplus is kept then passed on at the time of death. If, however, the surplus is gifted during the individual’s lifetime there are two important considerations: ▪

The gift will be subject to inheritance tax if the donor dies within seven years

On death, it is only possible to benefit from the downsizing addition if there are other assets in the estate to the value of the lost RNRB that can be Inherited.

It is always worth seeking advice on the consequences of any planning with the family home. In this scenario, if death occurs within seven years and there are no further assets to take advantage of the downsizing addition, more IHT may be payable than if the lifetime gift had not been made. Care home fees - are you prepared? As the population ages, the possibility of needing residential care at some point increases. With care home costs averaging £30,000 a year, this means that as well as ensuring you have a decent pension pot, it is vital to consider how you would fund residential care, should the need arise. What does the law say about care home fees? The law relating to care home funding changed in April 2015 with the implementation of the first phase of the Care Act 2014. The position now is that those with capital in excess of £23,250 will usually be expected to meet the full cost of accommodation and personal care in a residential home.

Can I defer fees until after my death? A local authority (LA) is obliged to offer a 'deferred payment agreement' (DPA) allowing the cost of an individual's care to be deferred until after their death, in the form of a charge against their property, where an individual has non-property wealth of less than £23,250 (but more than £14,250) and their home is not disregarded when assessing capital. LAs have the discretion to offer DPAs more widely should they consider them appropriate. What if I give away my house? Many individuals choose to divest themselves of capital in later life in the hope of passing on assets to children in a tax efficient way. This may include transferring their home to their children or putting assets into trust.

It is also important to remember that the level of care provided to those unable to self-fund may be very basic. This on its own should be enough to make individuals think twice before unnecessarily divesting themselves of capital.

Was the avoidance of care charges a significant motivation? At the time of the disposal, did the individual have a reasonable expectation that they would need care and support from the LA (for example, were they fit and healthy)? Did the individual have a reasonable expectation that they would be assessed as having to contribute towards the cost of those care needs?

Having established deprivation of assets, if the individual in care will not accept a DPA, the LA will be able to issue proceedings in the County Court which may eventually lead to a sale of the property.

The Care Act 2014 promised a cap on care fees of £72,000. This cap is now due to be introduced in April 2020. However, this is not as generous as it sounds as it relates only to the care component of the fees and not the accommodation or living costs.

You have heard the saying ‘Eat, drink and be merry’, but life is so much more than the food we eat or the clothes we wear. We have hopes, dreams and aspirations. Some of us have actually managed to discover our ‘true purpose’ and find immense satisfaction in it. But in order to achieve this, one must have time and space to reflect, recharge, and (where necessary) refocus.

When designing a garden or landscape, I always give careful consideration to the relationship between the outdoor space and the building that occupies it. Where this is a private residence, it is absolutely vital that there is also a personal connection with the owner. Everything must blend so perfectly, such that there is no longer a clear distinction of disparate elements but it becomes a single entity.

I spent more than 20 years living in the Far East, steeped in a culture of busyness. One day, I had the opportunity to dream. I left my decade-long legal career and pursued something I had always loved and in fact had been doing all my life.

The concept of wholeness is well understood in the context of an orchestra or a fourpart choir. One body, made of many individuals working in concert together towards a common purpose. In my opinion though, the best example of wholeness is in marriage where 1 + 1 = … 1. There is unity and harmony on many different levels.

It is not clear what the decision will be on 23rd June, but of course by the time you are reading this, the opinion polls might indicate a

Ask yourself if your saving objectives have changed? Is there a possibility you may need access to capital sooner than you previously intended. Is it better to take risk off the table if your need for capital is now within the short term.

Long term – your investment values may be reduced from last year, but a decrease in value on paper, only becomes a loss if you crystallise it. If you are saving for the longer term (5 - 10 years as a minimum), then the value now is somewhat academic. Research from Woodford Investment Management (2015) shows that since 1965, investors who invested in shares for 10 years have a 99.4% chance of a positive return. So hold your nerve.

When markets are volatile, saving monthly is often better. If you have a lump sum to invest, then drip feed it into the markets. If the markets fall, then not all of your investment has been exposed to the

fall and you now have an opportunity to invest the remainder at a lower unit or share price. Re-evaluate your investment risk profile – are you still comfortable with the degree of risk you are taking. If you are uncomfortable then seek advice on what options you have to reduce risk. Diversify your portfolio. The less diverse your investments, the higher the degree of risk you are potentially taking. There are many different assets you can invest in, company shares of all different sizes, geography, sectors, bonds of many different levels of risk, government gilts, property, gold etc. Relying on a single asset class could be risky and don’t think just because it is a household name you are invested in, means it “can’t be that risky”.

Have you noticed some people in the local community are looking fitter and healthier than ever? The reason may be put down to their participation in the Exercise Referral Scheme at the local leisure centre. It is a scheme run in partnership with Bristol City Council and the NHS to offer reduced price supervised physical activity sessions for those people with health conditions. Local resident and recent participant Stephen says “I have been so impressed with the scheme and its effect on my health that I have now become a member of the leisure centre in order to continue my progress. Before beginning the programme my muscles were very weak but now my muscle performance and coordinated movement has improved significantly. It is my hope that others with the same needs will take the same opportunity�. Whether you would like to shift a few pounds, improve your mobility or stamina or if you have a longer lasting condition such as high blood pressure, diabetes or a joint problem you are eligible to join. It could not be simpler. All you need to do is download a referral form at the link below then see your GP and they can refer you on to the programme. Your body will thank you for it!
