Terms and Conditions ‘Bugaboo Cameleon Competition’ From 1pm (AEST) 3 December, 2018 until 5pm (AEST) on Dec 10, 2018 (“Contest Period”), Bugaboo Australia Pty Limited (“Bugaboo”) will organise the “Why you love your Bugaboo Cameleon Competition” (“the Competition”). Here’s what you should do. Log on to the Bugaboo Australia Facebook page and post your answer/comment in 50 words or less under the competition post to the following question: Tag a friend and in 50 words or less tell us why you love your Bugaboo Cameleon? Terms and Conditions 1. These Terms and Conditions apply to the Competition. By entering the Competition, you become a participant (“Participant”). Participants expressly agree to be bound by these Terms and Conditions. However, the Competition shall be void where prohibited by law. 2. The Competition is organized by Bugaboo Australia Pty Limited, suite 2, level 2, 156 Edgecliff Road, Woollahra, NSW 2025. ABN 151 298 28 280, as part of a promotional campaign for the the Bugaboo Cameleon®. 3. The Competition is hosted on the Australian Facebook page of Bugaboo. Participants need to Log on to the Bugaboo Australian Facebook page and place their answer/comment (in 50 words or less )under the competition post to the following question: Tag a friend and in 50 words or less tell us why you love your bugaboo cameleon. 20 winners will be chosen and the winner will be displayed on the Australian Facebook page of Bugaboo and may also be featured on Bugaboo social media channels (Facebook, Twitter, Instagram, Youtube, Flickr, etc.). 4. Bugaboo will moderate the Competition and reserves the right not to accept or publish any winner from the Competition that does not comply with these Terms and Conditions. 5. There is no purchase requirement to enter the Competition other than the usual Internet connection charges payable to the participant’s service provider and/or Telephone Company. Qualifying Participants 6. The competition is open to legal Australian residents in all eligible states/territories who fulfil the entry requirements and are 18 years of age or older. 7. Employees of Bugaboo, including their relatives, agents, suppliers (including prize suppliers) and contractors (and the immediate families of directors, officers, management, employees, suppliers and contractors) of the Promoter and of its related bodies corporate, and of the agencies and companies associated with this Promotion, including the terms and conditions providers Trade Promotions and Lotteries Pty Ltd are not eligible to take part in the Competition. Immediate family means any of the following: spouse, ex-spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. 8. Bugaboo reserves the right to verify the eligibility of all Participants. 9. By entering the Competition, the Participant hereby warrants that all personal details submitted by him/her are true, current and complete and that the e-mail address and phone number he/she submits are accurate and valid. 10. By entering the Competition, the Participant also hereby warrants that they will observe a polite attitude and will not post on any of the Bugaboo social network pages (Facebook,
Twitter, Instagram) any comments that would be insulting, offending or content which would be contrary to the law. Any such comments will immediately be deleted. 11. Bugaboo, in its absolute discretion, reserves the right to disqualify any participant if it has reasonable grounds to believe the participant has breached any of these Terms and Conditions, has cheated or does not meet any of the conditions set out in these Terms and Conditions. Or any applicable laws or any other regulation, guideline or community standard. The Competition – entry and prize 12. The Competition begins at Submissions received after this time and date will not be taken into account. 13. Limit of one entry per person. 14. In total 30 winners will be chosen. 15. The Competition is a game of skill and chance plays no part in determining the identity of the winner. All valid entries received during the Contest Period will be judged individually on their merit and a winner is chosen based on the skill, creativity, and originality of their submission. They also must own, or have owned a bugaboo cameleon. 16. Entries must not have been published previously and/or have been used to win prizes in any other competitions. The judges reserve the right to disqualify any entrant submitting an entry which, in the opinion of the judges, includes objectionable content. The judges’ decision is final and no correspondence will be entered into. 17. A jury composed of Bugaboo personnel will select the winner of the Competition. 18. The winner of the Competition will be announced on the Bugaboo Australian Facebook page within 1 day of the competition closing date 19. Bugaboo will notify the winners by facebook messanger using the information given in their competition entry and no later than [10.12.2018]. 20. The winner of the Competition will win a Prize (“the Prize”). The Prize consists of one Bugaboo cameleon3 plus under seat basket. 21. For the avoidance of doubt, no other costs will be assumed by Bugaboo. Nor will Bugaboo be responsible for any tax implication that may arise from winning the Prize. Participants are responsible for any and all expenses that they incur in entering the competition and they will not be reimbursed regardless of whether or not they win the competition. 22. Bugaboo accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise including those entries not received by Bugaboo for any reason. Bugaboo is not liable for any consequences of user error including (without limitation) costs incurred. No correspondence will be entered into. 23. If the Prize is declined or unclaimed by the winner, or if a winner cannot be contacted from the details provided within twenty four hours of notification, a replacement winner may be selected by the jury at Bugaboo ’s discretion from the other selected entries. The new winner will be notified by Bugaboo. The original winner will then be forfeited. 24. Bugaboo takes no responsibility where it is unable to contact prize winners who have not provided correct or complete contact details. If an entrant’s contact details change during the Contest period, it is the entrant's responsibility to notify Bugaboo. A request to modify any entry information should be directed to collaborations.au@bugaboo.com. 25. The Prize is non-transferable and there is no cash alternative. The Prize is awarded at the entire discretion of Bugaboo and no prize will be awarded as a result of improper actions by or on behalf of any participant. In the event that Bugaboo is unable to supply the Prize (or a part of it), Bugaboo reserves the right to supply an alternative Prize of similar monetary value.
Liability 26. By taking part in the Competition, the Participant accepts that unforeseen technical problems linked to the use of computer networks may arise, including problems when connecting to the Internet. Bugaboo cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any participant entering the Competition. Bugaboo is not responsible for any problems or technical malfunction of any telephone network or lines, computer Wi-Fi systems, servers, or providers, platforms and/or platform operators, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to Participant’s or any other person’s computer or other mobile device related to or resulting from participation in the Competition. 27. Bugaboo gives no warranty or guarantee in relation to the Competition and Prize and accepts no responsibility or liability for elements of the Prize being amended by Bugaboo. 28. To the fullest extent permissible by law, Bugaboo excludes liability for all loss, damage or claim arising as a result of the Participant’s entry into the Competition or use of the Prize. 29. Bugaboo will not be liable for any damage in transit to or delay in transit of prizes.
Data protection and publicity 30. Bugaboo reserves the right and the Participant expressly agrees that Bugaboo may use the name of the winner and/or their entry content. Use may include the Internet, such as the website of Bugaboo, its social network pages including Facebook, Twitter, Instagram, Flickr, You Tube etc. and all Photograph, publicity, magazines, catalogues or the likes. 31. By participating in this Competition, the Participant will only be providing information to Bugaboo. Bugaboo will store participant’s entry details in connection with this Competition solely for the purpose of competition administration, unless participants have given permission for additional use.
Cancellation 32. Bugaboo reserves the right in its sole discretion to cancel the Competition and/or to amend the Terms and Conditions or change the Prize at any time and without prior notice. The last amendment was made on 3.12.2018 33. In the event of any dispute regarding the Terms and Conditions, conduct, results and all other matters relating to the Competition, the decision of Bugaboo shall be final and no correspondence or discussion shall be entered into. 34. If at any time one or more of the provisions of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out without affecting the remaining provisions. 35. The Competition and these Terms and Conditions of entry will be governed by the law of the State or Territory in which the Bugaboo ordinarily resides. Entrants accept the non-exclusive jurisdiction of courts and tribunals of that State or Territory in connection with disputes concerning the Competition.
