Niles gets ethics ruling
On Tuesday, April 25, 2023, Cook County Circuit Court Judge Araceli De La Cruz provided declaratory judgment that the April 2021 resident-initiated referendum attempting to change the Village of Niles Board of Ethics from a government-appointed body to a voter-elected body was unconstitutional and against Illinois state law. As a result, the Village of Niles Ethics Board members will not be elected by the public, the recent consolidated election results for these positions will not be released by the Cook County Clerk, and the Village of Niles Board of Ethics members will continue to be appointed by the Village Board of Trustees.
“It is good for the Niles community that we finally have a definitive answer to this matter. It has been a long and trying road for all involved, from the candidates who worked diligently to declare
and run their candidacy, to the Village staff who have tirelessly worked to keep moving forward in the face of conflicting directives and laws,” said Mayor George D. Alpogianis. “We appreciate the important work of the independent, upstanding residents who serve on the Board of Ethics.”
The April 2021 referendum appeared on the ballot following previous litigation that focused on procedures for placing referenda on a ballot, but not the constitutionality of the referendum itself. This new April 2023 ruling came after a resident filed a lawsuit regarding the constitutionality of the referendum.

Southern Illinois judge blocks assault weapons ban
A federal judge in East St. Louis issued an order Friday blocking enforcement of Illinois’ ban on assault weapons and high-capacity magazines until a lawsuit challenging the law is resolved.
Judge Stephen P. McGlynn, of the Southern District of Illinois, said the law known as the Protect Illinois Communities Act, or PICA, is likely to be found unconstitutional when the case goes to trial and the plaintiffs in the consolidated cases will suffer harms without a preliminary injunction to block its enforcement.
In a 29-page opinion, McGlynn acknowledged that the law was passed in the wake of a mass shooting at an
Independence Day parade in Highland Park last year. But he said the “senseless crimes of a relative few” cannot be used to justify abridging the constitutional rights of law-abiding citizens.
Citing a U.S. Supreme Court case that was decided less than two weeks before the Highland Park shooting, New York State Rifle and Pistol Association v. Bruen, he said the Constitution guarantees an individual right to keep and bear arms for self-defense.
“More specifically, can PICA be harmonized with the Second Amendment of the United States Constitution and with Bruen?” McGlynn asked rhetorically in the opinion.
“That is the issue before this Court. The simple answer at this stage in the proceedings is ‘likely no.’”
McGlynn’s decision came less than a week after another federal judge, Lindsay Jenkins, of the Northern District of Illinois, reached an opposite conclusion and denied a motion to halt enforcement of the law. Plaintiffs in that case have indicated they intend to appeal to the Seventh Circuit Court of Appeals.
The law prohibits the manufacture, sale, and possession of more than 190 different types of firearms as well as many types of grips, stocks and attachments. It also bans largecapacity magazines like the ones used by the accused Highland Park shooter that enabled him to fire off more than 70 shots in just a few minutes.
Based on other recent U.S. Supreme Court cases, McGlynn said the
state needed to show that the items being banned are not in “common use” and that they are the types of firearms that have been regulated historically.
The state argued that the law is consistent with historical tradition because neither assault weapons nor large-capacity magazines were in common use when the Second and 14th Amendments were ratified. But McGlynn said that argument was “bordering on the frivolous” because the Supreme Court has said the Second Amendment extends even to firearms that did not exist when the Constitution was drafted.
He also noted that Friday’s ruling was not a final resolution of the case, but he said the state has other means available to address the issue of gun
violence.
“There is a wide array of civil and criminal laws that permit the commitment and prosecution of those who use or may use firearms to commit crimes,” he wrote. “Law enforcement and prosecutors should take their obligations to enforce these laws seriously. Families and the public at large should report concerning behavior. Judges should exercise their prudent judgment in committing individuals that pose a threat to the public and imposing sentences that punish, not just lightly inconvenience, those guilty of firearm-related crimes.”
Attorney General Kwame Raoul, whose office defended the statute, did not immediately comment on the decision.

Raymond W. “Ray’ Knapp, age 83, a resident of Plainfield, IL since 1978, formerly of Forest Park, IL, passed away on Thursday, April 27, 2023, at Edward Hospital in Naperville, IL. He was born on September 6, 1939, in Chicago, IL.
Beloved husband of 36 years to the late Rita Marie Knapp (nee McNamara), whom he married March 25, 1975 and who preceded him in death on April 19, 2011, loving father of the late Victor (Sonia) Kelly of Plainfield, IL, Joseph (Kathleen) Discianno of Morris, IL and Christine (Andrew) Gatt of St. Joseph, MI, adored grandfather of Anne (Gavin) McCrindle and Kathryn (Mark) Houlihan; Kariann Fenoglio, Willie Ray and Jolene Huff; Genevieve, Sebastian and Theodora Gatt, cherished great-grandfather of Peyton and Travis Houlihan; Aila and Calleigh McCrindle, devoted son of the late John and Mary (nee Bohm) Knapp, dear brother of Kenneth (the late Marie) Knapp, the late Donald (the late Katherine) Knapp and the late Marion (James) Venetucci, brother-in-law of the late Regina (the late George) Coburn, fond uncle, great-uncle and friend of many. Ray grew up on Chicago’s West Side and married and started his family in Forest Park. During his youth, Ray enjoyed spending time on his family’s farms in Wisconsin. Ray moved to Plainfield in 1978 and was employed for 42 years with Electro-Motive Division / GM in LaGrange, IL.
Ray enjoyed many years with his family and friends at his summer lake home on Lake Camelot in Rome, WI and, especially, spending time with his grandchildren. He will be remembered as a “2nd dad” by many of his children’s friends and was known as “Grandpa Ray” to many.
Visitation will be held on Thursday, May 4, 2023, 4:00-8:00 PM at Overman-Jones Funeral Home & Cremation Services, 15219 S. Route 59, Plainfield.
