Judge Halts Lowe's Project

A circuit judge has stopped the construction of a new $22 million Lowe's in Virginia because of a land dispute.

A judge claims that Lowe's violat- ed state law by trying to move an easement without getting permission from neighbors at its building site in Virginia Beach.

The owner and renter of the nearby property are suing Lowe's, seeking a temporary restraining order and permanent injunction.

The controversy is about a 50-ft. dirt road leading from a lot behind the Lowe's site, through the Lowe's property and on to the main street in front of the properties.

A lawyer for the renter said it is impossible for Lowe's to build around the easement. "It runs right through the front door of the building. In order to build their building, Lowe's has to solve the problem of the easement," he said.

According to the Virginian-Pilot, Lowe's petitioned the Virginia Beach Circuit Court in 2000 for permission to move the easement without the neighbors' approval.

The paper also contends that Lowe's recorded a deed that purported to move the easement without the neighbor's knowledge.

"They went about it in a sneaky fashion." said a lawver for the owner's family. "It really looks like the big guys trying to bully the little guys."

Lowe's says it is evaluating its legal options.

"Lowe's does want to be a good neighbor and a good corporate citizen, and that's what we've been trying to

do all along," said Lowe's son Chris Ahearn.

The judge's restraining continue until a hearing is permanent injunction.

Doors Swing Open In Fort Worth

Fort Worth Lumber Co.. Fort Worth. Tx., has returned to its roots by opening an on-site door shop and millwork showroom using the name the company was founded as more than 60 years ago.

Fort Worth Sash & Door features a new 55,000-sq. ft. warehouse, including 11,000 sq. ft. of door manufacturing space. "We realized that if we wanted to control the quality of the doors we sell, we should manufacture them ourselves," said Emily Fiesler.

A new 4,500-sq. ft. building is split between office space and a showroom to showcase columns, windows, doors, sidelites, stair parts and trim for custom builders.

Fort Worth Sash & Door will be headed by general manager Mike Pontremole and operations manager Celso Duran, with outside salesmen Jeff Eddy, Forrest Kirkpatrick and stair parts specialist Michael Lynch, and inside sales personnel Pete Howell and Lee Ann Venable.

The new facility opened in early September, but held an official grand opening October 2.
