A former ICBC driving examiner has been awarded more than $2 2 million for a driver’s test that went terribly wrong in Burnaby six years ago
Heather Boal, a fouryear ICBC examiner, was conducting a road test on Parker Street on March 10, 2016, when the driver taking the test oversteered while turning left onto Madison Avenue, sending the car toward a vehicle stopped at a stop sign, according a B C Supreme Court ruling last month.
“Ms Boal testified that in response, she instinctively yelled stop, pressed as hard as she could on the passenger side brake pedal, turned in her seat, and reached across and grabbed the steering wheel with her right hand,” stated the Nov 29 ruling “She said she pulled the wheel hard to the right She was able to alter theToyota’s course
away from the driver’s door of the other vehicle The front driver’s side corner of theToyota collided with the back wheel well of the other vehicle.”
After the accident, Boal directed the driver to return to ICBC by the safest route
Back at the office, Boal took an Advil and started to complete a form to report the accident but found it difficult to gather her thoughts.
Her father picked her up from work early and drove her home
Six years after the accident, Boal testified she still suffers from “excruciating migraine headaches,” depression and pain in her neck, shoulder and shoulder blade, according to the ruling.
She attempted a graduated return-to-work program at ICBC but was unable to increase her hours beyond two fourhour shifts a week, and ICBC terminated the program four months in, the
ruling said.
Before the accident, Boal had been social and active, according witnesses, but her injuries left her “a shadow of her former dynamic, outgoing self,” unable to perform most household duties, including child care
Boal sued the driver, Maria Parilla, and the driving instructor who owned theToyota, Jezer
Eriko Lagman, for $2 9 million for pain and suffering, loss of past income, loss of future income and the cost of her future care, including money for cannabis and Botox treatments for her headaches, homemaking support, fitness passes and Pilates sessions
The defendants said Boal should get $936,169.53 minus up to
15 per cent for her own part in the crash
They admitted they were liable but said Boal should have intervened sooner when she realized Parilla was oversteering onto Madison or should have stopped the road test earlier, since Parilla had actually already failed 20 minutes in, when she oversteered into an oncoming lane of traffic.
But B C Supreme Court Justice LisaWarren rejected that claim, saying Parilla and Lagman hadn’t proven Boal’s conduct “fell below the standard of care ”
“The only evidence at all relevant to the standard of care expected of a driving examiner was that of Ms Boal,”Warren said. “She testified that her conduct throughout
Ms Parilla’s road test was consistent with ICBC policy In particular, she explained that terminating the test and driving Mr Lagman’s vehicle back to the office, herself, would have been inconsistent with ICBC policy.”
In the end,Warren awarded Boal $2 24 million and court costs
“The evidence overwhelmingly demonstrates that the injuries she sustained in the accident have limited her functional capacity and that the limitations are likely permanent,”Warren said.
A man trying to take back a guilty plea he made four years ago for an online gambling company fraud in Burnaby almost a decade ago has taken 11 months to get his application together and he’s not there yet

Mann allegedly convinced a Port Coquitlam man to invest in Mann is alleged to have claimed the investment would generate “significant returns” in six months, according to the BC Securities Commission (BCSC), which investigated the company.
“Rather than invest the
money as promised, it is alleged Mann misappropriated the bulk of the invested funds,” stated a BCSC news release after the charges were approved in April 2018
Eighteen court dates have been scheduled in Mann’s case since he announced his plans to withdraw his guilty plea
“He’s been in the process for some time now of getting legal advice on that,” said Mann’s defence lawyer, Chandra Corriveau, who represented him at an appearanceWednesday.
Corriveau requested and was granted another adjournment to Jan. 10.
Neal raised concerns
about how long it has taken for Mann to actually make the application to withdraw his guilty plea, and he said Mann’s next court appearance should be in-person
“Having him attend personally is the only idea I have to push this matter forward,” Neal said.

A Burnaby massage therapist has been charged with sexual assault and banned from providing any personal or professional therapeutic services to women while he is out on bail
Gudbjartur Bodhi Haraldsson, who goes by Bodhi, was arrested on Nov. 25 and charged with sexual assault, according to a Surrey RCMP news release
The charge is related to
an alleged sexual assault on a female client during treatment at a clinic in the 13700 block 96th Avenue in Surrey on Nov 14, according to police
Surrey RCMP released a photo of Haraldsson on Thursday in order to “further the ongoing investigation,” the release said

Cabinet shuffle is good start for Eby
Putting together a provincial cabinet is a challenging endeavour for any premier, and no doubt new B C Premier David Eby had to make some interesting calls in determining which members of his team would make the inner circle
However, he seems to have pulled off some notable “firsts” in his first crack at cabinet making
For the first time, B C has a South Asian woman in the important post of attorney general Niki Sharma received the only standing ovation from the audience at last week’s swearing-in ceremony at Government House, an indication of the importance attached to this historic appointment
In fact, Sharma is one of 15 female cabinet ministers That is the most ever, and for the first time there are more women in cabinet than men (also, of 25 deputy ministers, 15 are women)
Another first: MLAs from the Fraser Valley are at a BC NDP cabinet table. Agriculture Minister Pam Alexis represents Abbotsford-Mission and there are two ministers of state from Langley (Andrew Mercier) and Chilliwack (Dan Coulter)
The NDP made historic breakthroughs in all three cities in the 2020 election (the party had never won a seat in a general election in them before), and the path to victory in the next election may very well run through all
three communities
A cabinet appointment generally tends to heighten the profile of an MLA, so Alexis, Mercier and Coulter should all benefit from the added attention
While it is not a first, the appointment of Katrine Conroy as finance minister marks the first time since Paul Ramsey held the portfolio in the NDP government in the 1990s that the portfolio has not been held by an MLA from Metro Vancouver or the capital region (Ramsey was from Prince George).
At the ceremony, Eby said Conroy will bring a rural voice into a cabinet dominated by urban voices That is no doubt needed, given that Metro Vancouver has 16 ministers (plus the premier)
while Vancouver Island has six
Conroy and Sharma’s appointments also reflect Eby’s view that not only should there be gender equity in cabinet but that it should also apply to the biggest and key ministries. He views four ministries to be the most important: finance and attorney general (both portfolios now held by women) and health and public safety (held by Adrian Dix and Mike Farnworth, respectively)
Also, of the eight largest ministries when it comes to budget size, six are now overseen by women.
All in all, not a bad start by the new premier.

It is important to be inclusive and advocate for the humane principles of natural justice and equity
1) Does the B.C. government have a right to go and amend the Strata Property Act so that it benefits one class of citizens (investors/landlords) but not another (strata owners) without consultation?
2) If the government does have the right to amend, why is it only benefiting the investor/ landlord in the most obscene way? The investor/landlord is living off the strata owners who volunteer countless hours to keep the strata maintenance costs low, sacrifice their quality of life and family time
The investor/landlord is not only benefiting from the capital appreciation of his property, and able to write off expenses for tax purposes, but paying the same monthly fees and
assessment fees (for not doing anything) as the concerned owners/volunteers who spend countless hours without being compensated
3) Is the government going to bring in legislation for strata owners to charge an additional 50 per cent on top of the investor/ landlord’s monthly fees and strata fees (which the investor/landlord can write off on their taxes anyways as business expenses) to compensate for all the free volunteer work and most of all sacrificing their quality and family life to keep the costs down so we can continue to afford a home? Why should the investor/ landlord get extra monetary and tax benefits for paying the same amount of fees?
Hopefully, the decision makers will re-evaluate the above points and then answer the following: Is it fair? Is it right? Who gets hurt? Who has to pay for the consequences?

Kang, who was the minister of advanced education and skills training under former premier John Horgan, was assigned to municipal affairs in the shuffle, announced Dec 7 Whiteside has been moved from education to mental health and addictions

Innovative surgical technique saves young woman at VGH
It’s just a toothache or at least that’s what Joyce thought at the time The pain would come and go so she wasn’t overly concerned, but Joyce mentioned it to her dentist who thought it was an infection and she was eventually referred to an oral surgeon What she learned next turned her world upside-down “I had a tumour in my jaw that was growing so aggressively it was ‘eating’ my left jawbone,” says Joyce “The bone had become so thin that I had to go on a puree diet immediately just to avoid further damage I was terrified ”
Joyce was suffering from a rare bone tumour called an ameloblastoma The tumour needed to be removed or it would soon leave Joyce unable to eat or speak Without proper care, it could become fatal
“The more I read about the surgery, the more worried I became, because apparently after the surgery, you might need to rehabilitate your jaw ” says Joyce “As in learn how to talk and learn how to chew and learn how to smile again That scared me because I was just like, ‘What?’ I’m not going to be able to do something that’s very basic
anymore?”
This is when Joyce came to meet Dr Eitan Prisman, head and neck surgeon at VGH, who walked her through exactly what needed to be done and to help put her fears to rest

“This tumour was on the jaw which would mean it would grow so large it would prevent her possibly from speaking, eating, and it could deform her face,” explains Dr Prisman “It’s not a tumour you can live with by any means ”
Dr Prisman had to do a “full section” removal due to the location of the tumour This means he had to remove the entire area of jawbone and replace it
“The complexity with the jawbone is how much we use it every day,” he says “There’s constant motion and pressure You can’t just throw a titanium plate in because the bone will not fuse properly and then you’re dealing with a whole other problem ”
Instead, Dr Prisman needed more bone, which he harvested from Joyce’s scapula
Using CT scans and modelling of
Joyce’s bone structure, Dr Prisman utilized simulation software he and his team designed It ran hundreds of virtual surgeries on Joyce before landing on the most optimal one for Dr Prisman to perform
This pre-surgical preparation is key for improving outcomes, as it reduces the amount of time a patient is in surgery by hours This reduces inflammation, soreness, chance of infection, and increases the likelihood of surgical success “Joyce’s surgery went textbook,” says Dr Prisman “She had zero complications ”
Today, Joyce is happily moving forward in her life She has a burgeoning business in calligraphy for weddings and events and is even looking to get married herself in the near-future
“I’m so grateful for Dr Prisman,” Joyce says “He saved my life ”

Emergency support has run out for families displaced by a Burnaby apartment fire earlier this month, so they are turning to crowdsourcing to get through the holidays
Fire broke out in a firstfloor suite at Evergreen Place at 6920 Gilley Ave at about 7:45 p m on Dec 3, according to the Burnaby Fire Department
The suite was totally destroyed, and adjacent units also sustained smoke and fire damage, the fire department said
To make matters worse, the fire exposed asbestos in the building’s walls
“There was heavy smoke damage and when officials had to bust down
one of the walls in a neighbouring unit, they found asbestos inside the walls,” states a GoFundMe page set up by Stacey Humphrey, a sister of one of the tenants, Samantha Humphrey, and her fiancé Jordan “Due to that discovery, the tenants in that wing of the complex are now unable to return home.They have been instructed to remove their personal belongings that are salvageable and now they have to find a new place to rent ”
GoFundMe campaigns have also been launched for a mother of three who has lived in the building for 12 years and a oneincome family of four with a special needs son
Branko, a building manager who did not want his
last name published, confirmed asbestos had been found in the building
“Restoration needs to be done completely, so it’s going to take a while,” he said.
He said the renovations are expected to take
three months, and tenants would have the option of moving back in after they’re complete.
“That would be optional for them,” he said
An insurance adjuster who spoke to the NOW said eight units on the
main floor are currently involved
“We’re still in the very preliminary stages of trying to deal with it,” she said. “They have to take down all the walls to figure out the exact extent of the damage ”
The City of Burnaby emergency support services team, which administers the provincial program, provided emergency support to eight families, but that support has now run out.
“The intent of the program is to support the immediate and most necessary needs of those individuals that have been displaced by an emergency or an evacuation,” said Charmaigne Pflugrath, the city’s emergency management coordinator.
Once the 72 hours of emergency support expires, extensions can be granted on a cases-by-case basis, but those requests have to be approved by Emergency Management B C , according to Pflugrath
Before the emergency help expires, however, the city does its best to connect displaced residents with other social services groups in the city, she said
“We try to engage those community partners to provide whatever support they can,” she said “We make every effort to encourage the evacuated individuals to be self-sufficient, so that they can go to friends and family and get the social supports as well as the emotional support that they might need ”

HAMBURGER SOUP
1Tbsp oil
1 large onion, diced finely 680 g (1½ lbs) lean ground beef
1 796 ml (28 oz) can diced tomatoes, undrained (no salt added if preferred)
2 900 ml cartons beef broth (low sodium if pre-
ferred) 1 284 ml can condensed tomato soup
large carrots, chopped finely
ribs celery, sliced thinly
tsp dried thyme leaves

Heat oil in frying pan over medium low heat Add onions and sauté until soft but not browned Remove to a large pot or Dutch oven
Add beef to frying pan, brown over medium high heat (may need to do in two batches) and drain off fat Add cooked beef to pot with onions Combine remaining ingredients in pot and bring to a boil Reduce heat, cover and simmer, for two hours or until barley is tender

Who doesn’t love warm chewy cookies baked fresh out of the oven? Pair it with some milk and Netflix, you can have Christmas in bed everyday
This Christmas cookie recipe is from the kitchen of Pavan Bharaj, the 13-year-old Burnaby actor who voices the main character in the hit Netflix cartoon Deepa and Anoop Bharaj said she was looking for easy recipes that she could make with her siblings as a fun activity a few Christmases ago, during COVID-19.
“I found this one online and I knew that my little brother and sister would enjoy putting their thumbprints in the cookies,” she said “We made some with strawberry jam and some with Nutella Now, it has become a
family tradition that we make these cookies every year I hope you and your family enjoy them too!”
The best part? It can be easily baked even by kitchen newbies
THUMBPRINT CHRISTMAS COOKIES
What you need: 2 cups all-purpose flour
tsp baking powder
tsp salt 1 cup unsalted butter, softened
cup white sugar ½ cup light brown sugar, packed 1 large egg 1 tsp vanilla 1 cup jam
Preparation steps:
Preheat the oven to 350 F.
Line three baking sheets with parchment paper
and set them aside.
In a medium bowl stir together flour, baking powder and salt
Set aside.
In a large bowl, beat butter, white sugar and
brown sugar together on high speed until light and fluffy This usually takes about two minutes
Beat in the egg and vanilla extract until well mixed
Pour dry ingredients into the wet ingredients and beat just until well mixed
Drop rounded cookies, 1 5 tablespoon in size and two inches apart, onto the
parchment paper lined baking sheets.
Using the back of a teaspoon, dusted in flour to prevent sticking, press back the teaspoon about half way down into each cookie to create an indent for the jam.
Using a small spoon, fill each indent with jam of your choice.
Bake for 13 to 15 minutes or until the bottom edges look slightly browned.
Remove from the oven and let cool for about 10 minutes before removing and placing them on a wire rack to cool completely

Mix well. Add all other ingredients and mix well Remove lumps Add water if batter is not thin. Phase 2 of the Concord Metrotown development sparked debate in its return to Burnaby city council over its unit sizes and number of parking spaces
With four residential towers planned between 40 and 60 storeys tall and one commercial tower, the development at 4750 Kingsway would bring about 2,186 housing units onto the market, with a mix of market strata units, market rentals and non -market rentals
It also includes 58 non -market rental studio units between 323 and 346 square feet.The minimum size for rental units in Burnaby is 322 93 sq ft
The non-market units would be rented at 20 per cent below the Canada Mortgage and Housing Corp. (CMHC) median (the median for Metrotown is $1,385)
At the Dec 5 council meeting, Mayor Mike Hurley said he didn’t think the 323-square foot non -market rental studio units were livable.
“I don’t believe that our housing needs study shows that these are the types of units that we need,” Hurley said at council
“I’m really concerned, not with the buildings at all, it’s the mix of the affordable units in the buildings.”
Burnaby Citizens Association (BCA) Coun Alison Gu suggested transitioning some of the strata or market rental units to non-market units or be rented at the CMHC median
She expressed concern with the number of parking spaces included, at 2,889 total spaces for residential and commercial use, as she said the Metrotown area is “probably the most well-served by transit area” in Burnaby.
“If we keep building for cars, what is going to happen is people are going to think that it’s easier to drive and continue to drive,” Gu said.

Burnaby city council granted its park department an increase to its playground renewal budget for a program staff said would “put the ‘wow’ factor back into the city’s playgrounds.”
The program includes increasing the budget per playground replacement, replacing a fourth playground per year and adding a funding stream to create specialty playgrounds
Playgrounds have become ‘less inviting’
Burnaby currently replaces three playgrounds per year, meaning a typical playground gets replaced every 28 years – though a structure’s lifecycle is only
about 15 years
This has led to “maintenance issues” and “patch repairs to extend (playground) life well beyond the target replacement periods,” according to a city staff report
At least half of Burnaby’s playgrounds are more than 15 years old, and most of those do not include accessible features.
Each playground redevelopment currently has a budget of $185,000, a number that has remained the same over the past decade, according to the report.
Meanwhile, purchasing power has declined by 60 per cent since 2016 –“along with the level of public satisfaction,” said the report

tures have since become “smaller and less inviting.”
The budgets don’t include features like water fountains, shade canopies, benches, or enhanced rubber surfacing that could make playgrounds more accessible.
BUDGET INCREASE
City staff asked council to increase the budget per playground replacement from $185,000 to $300,000 (a 62 per cent increase) and replace four playgrounds per year instead of three
Staff also want to add more “exciting playground attractions,” like those with nature play and adventure features such as ziplines, 10-metre tall “tree house” towers, spiral slides, and rope walkways, to recog-
nize older children who don’t want to be bored with a “too safe” playground
The recommended program has an added funding stream for the creation of “enhanced” and “destination” playgrounds over a three-year cycle
Enhanced playgrounds cost about $750,000 for play areas that support schools, daycares and dense neighbourhoods with more wear and tear.
Destination playgrounds for major parks, intended to attract children from around the city and beyond, are budgeted at $3 5 million The money for those destination parks comes from development cost charges levied on building developers, according to staff.

Beatrice passed away peacefully at the age of 99 She was born in Vancouver and lived most of her life in Burnaby Bea graduated from the University of Toronto as an Occupational Therapist, participating in the Second World War effort as a lieutenant in the Canadian Army. After her service, she worked locally as an OT. Bea was a committed life member of the Beta Sigma Phi Lamda Master Chapter and a dedicated philanthropist and volunteer. During her pastime, she was a talented crafter, knitter, gardener, and world traveller. She was also well known as everyone’s "Auntie Bea."
Bea was predeceased by her husband, Sheldon Hunter; brother Donald M. Carpenter; and niece Corinne Fraser. She is survived by her brother Charles; sisters in law Patti and Cicely; niece Lea Carpenter (Tim Turner); nephews Andrew Carpenter, Kevin Carpenter (Jae Ahn) and Robert (Bob) Carpenter (Michelle); and her many grand nephews and grand nieces, and cousin Beth Coleman.
A graveside memorial, followed by a reception, will be held on Wednesday, December 21, 2022, at 1:00 pm at Ocean View Cemetery & Funeral Home, 4000 Imperial St., Burnaby. The family would like to thank the staff of Amica West Vancouver and My Home Rehab for their professional and affectionate care of Bea over the years.
