THE CURIOUS TOUR PLANNER Number 8 of a Series “The Curious Tour Planner” is a question and answer column that provides simple answers to simple questions involving bus and group tours. It is patterned after a very successful similar column in our sister publication, NATIONAL BUS TRADER, that has run for about 20 years with more than 200 installments. We will accept reasonably simple technical or operating historical questions on bus and group tours and their operations by letter, fax, e-mail or telephone. Unless otherwise indicated, the simpler questions will be answered by our editor, Larry Plachno, who has owned buses and planned tours for more than 50 years. If our staff is unable to answer them, we will call upon our panel of experts. Names and addresses should be submitted with your questions, but we will withhold names from publication on request. We reserve the right to modify questions to make them more useful to our readers. Q. What is the story behind the proposed increased insurance coverage for commercial motorcoach operators that could impact bus and group tours? –– Several Readers A. The Federal Motor Carrier Safety Administration (FMCSA) has proposed raising the minimum insurance on motorcoach operators. This would throw thousands of people out of work, put many bus operators out of business and substantially increase the cost of operating bus and group tours. It all started with an “advanced notice of proposed rulemaking” from the FMCSA in November of 2014. They suggested that the current $5 million minimum insurance requirement was too low by today’s standards. They quoted some figures to justify their position including the increase in medical costs these days. The FMCSA proposed at least doubling the minimum insurance requirement to $10 million and possibly raising it to as high as $25 million. We were told that more than 1,900 bus operators, truck operators, groups and individuals submitted comments and opin30 • Bus Tours Magazine / July, 2015

Expectedly, the national associations and most of the motorcoach operators have been against the increase since it would substantially increase costs and drive many companies out of business. It would also have a negative impact on “going green” and on safety since the increased costs would drive more people back into private automobiles. Greyhound Lines said that it supports at least doubling the current insurance requirement to provide adequate protection. On the other hand, Lancer Insurance Company, the largest insurer of buses and motorcoaches, pointed out that the current $5 million minimum has been adequate since very few claims exceed this amount. Their submission to the FMCSA included the following: “Lancer Insurance Company is the oldest, largest and most respected insurer of buses and motorcoaches in the United States. Since we issued our first policy in 1985, we have professionally managed over 70,000 claims for the bus and motorcoach industry including nearly 24,000 occurrences involving a wide range of bodily injuries. Of this total, after applying appropriate factors for loss cost inflation, approximately one-tenth of one percent of the liability occurrences we managed would have exceeded $5 million in damages. “We belive, therefore, the current mandatory liability insurance limit for bus and motorcoach operators ($5 million) is more than adequate. “We further believe the additional insurance premium costs resulting from any significant increase in the mandatory liability insurance limit will force numerous small- and medium-sized bus and motorcoach operators out of business and ultimately result in less competition, higher prices for the traveling public and a significant loss of jobs. “The traveling public is best served by a continued emphasis on compliance oversight and swift enforcement by the Federal Government, with the goal always being to take bad bus and motorcoach operators off the road and acknowledge the safety commitment of good operators.”

As we go to press, the industry has had some initial success in Congress in blocking the increased insurance requirement but the battle is far from over. Feel free to check with your national associations to see what you can do to help. Q. It is true that tourism from Asia is increasing in the Western states? How can I get part of this business? –– California Tour Planner A. While Asians touring the Western states is not new, there has been a recent increase in Chinese tourism. This is due at least in part to a recent extension in visa terms late last year. Business people and tourists can now apply for a 10-year visa and even students can get a fiveyear visa. The number of Chinese tourists is expected to increase substantially in the next few years. One source suggests that by the end of the decade, China will represent the third-largest group of inbound tourists, following Canada and Mexico. Much of this is a result of an increasing Chinese middle class that would like to travel. It was suggested that the Chinese spend as much as $6,000 on a trip to the United States. However, getting part of this business may not be easy. Because of the difference in language, customs and interests, most of the tour planners and operators that have been successful in this area have special staff with the knowledge and language skills for working with the Chinese and Asian tourists. Lodging properties, restaurants, casinos and attractions seeking to draw Chinese tourists are advised to have people on their staff who can speak their language and know their customs and interests. The National Tour Association has been working with tour operators as well as hotels and other tour suppliers to provide the needed information.
