TERMS AND CONDITIONS Bidding: Each animal offered for sale will be sold to the highest bidder. Each bid shall constitute an offer to purchase, and the final bid shall constitute a binding contract between buyer and seller. The auctioneer will settle any disputes as to bids, and his decision on such matters shall be final. Terms: Terms of the sale are cash or bankable check (U.S. funds), unless prior arrangements have been made. All settlements are to be made with the clerks of the sale immediately following the conclusion of the sale. Announcements: Any changes from printed information of any kind will be announced from the auction block and such announcements shall take precedence. Registration Certificates: A certificate of registration and transfer will be furnished for each animal at no cost to the buyer. Identification: Seller offers each animal with a readable tattoo corresponding to registration. Buyer agrees to check tattoos for accuracy. Handling and Risks: Each animal will be purchaser’s risk as soon as sold. Rights and Obligations: In the event of default in any part of the Terms and Conditions covering the sale by either the buyer or seller, it shall be the responsibility of the buyer or the seller to instigate any action necessary to bring about a fair settlement of any claims arising from this sale and to be responsible for any and all costs involved therein. The sale management assumes no responsibility, legal or otherwise, for the failure of either seller or buyer to fulfill their obligations. Risk: All persons attending the Western National Show and sale do so at their own risk. Neither the sale manager, board members of the Western States Hereford Association or any person involved with the management of the show and sale assumes any liability, legal or otherwise, for any injury or damages. Delivery: Sale management will assist in making delivery arrangements of the sale animals to the new purchaser’s destination at the least possible cost. Delivery will not exceed $400 — per lot to a central location within the continental United States if arrangements are made by the sale manager. All such deliveries will be at the buyer’s risk. Livestock Mortality Insurance: Insurance will be available from StarNet Insurance, James F. Bessler Agency, James Bessler and Robert Schacher Agents. Health and Guarantees: 1. All bulls will be tested for Brucellosis, Trichamoniasis and appropriate health papers will be available for immediate shipment. All females are officially Brucellosis vaccinated. Cattle selling to any area that requires additional testing will have to complete tests prior to shipment. 2. All bulls born prior to Dec. 1, 2014 have passed a semen evaluation by an accredited veterinarian. These results will accompany the bull’s health papers. Bulls born on or after Dec. 1, 2014 will be sold with a breeding guarantee. 3. All females selling safe in calf will have been tested within 30 days by an accredited veterinarian, and a statement of proof will accompany the health papers. 4. All cattle selling are guaranteed IE and PI/BVD free.

• The Colyer Family wanted to make sure the 50th Nugget Sale was special and they have delivered with this package. The buyer will have the opportunity to pick from the entire 2016 spring heifer calf crop. Just think of the potential from the herd that has produced four Denver Champion Females with Notice Me, C Ms Moler 6214, Chanel and Eye Candy and also 76 National Champions at major shows throughout the U.S. It has also produced donor females and herd sires serving in major herds nationwide. • The buyer will have two ownership options: Option 1, 1/2 interest, buyer will own ½ of the heifer and share ½ the cost of showing and flushing. Colyer Herefords will either send you half of the eggs produced from agreed on flushes or you can alternate flushes. Option 2: Colyer Herefords Retains Two Flushes. If this option is chosen, the buyer will own 100% of the heifer and Colyer Herefords reserves the right to two future flushes. • As the Nugget reaches a 50 Year Anniversary, our ranch has also reached a great milestone. It has been 100 years since my great-grandfather began to register Hereford cattle in 1915! Today, our cow herd still grazes the native mountain summer range and winters in the same valley which the Daniels family called home. My father’s operation has been known as Rex Daniels and Sons, still continuing as Dad has a few cows that are “his.” As my children got older, we chose to go by DTK Land and Cattle, “Dan and Teresa and the Kids.” As part of our commitment to this legacy, we again changed our name to Daniels Hereford Ranch a few years ago.
