As a historian Ibn Khaldûn is widely known as true founder of modern sociology,
history of civilization. In this thesis questions like: “How and why societies form a
government, a state and constitute a law system in the light of Ibn Khaldûn’s vision?”
will try to be answered. For this purpose, firstly asabiyye term will be explained and
then the forming process of state will be explained as with evolution process from
nomadic society to urban society. Then Ibn Khaldûn’s political and judicial ideas will be explained with their connections. After that the law system which was in use in Ibn Khaldûn’s era will be analyzed and its position in ‘state and society affairs’ will be tried to determine.
