Air quality: the latest pressing issue for government action The BVRLA has been consulting with policymakers at HM Treasury to ensure members’ businesses are not adversely impacted by its soon-to-be-published Air Quality Strategy. As BVRLA News went to press, the Department for Environment, Food & Rural Affairs had not produced the final text of the strategy, but it is believed to contain initiatives aimed at reducing NOx emissions, especially from diesel vehicles. Prime Minister Theresa May has said: “In relation to the issue of diesel cars, obviously we will be producing a new air quality plan. But I’m very conscious of the fact that past governments have encouraged people to buy diesel cars and we need to take that into account when we’re looking at what we do in the future.” Treasury officials have privately indicated they are considering tax increases on diesel vehicles. Exact measures will be confirmed following discussions with stakeholders, including the BVRLA and its members. However, the 3% diesel surcharge is unlikely to
be removed, and increasing the tax differential on fuel duty is also being considered. The Air Quality Strategy is also expected to include recommendations on Clean Air Zones. Mayor of London Sadiq Khan has already announced plans for an Ultra-Low Emission Zone from April 2019, which would see pre-Euro 4 petrol vehicles and pre-Euro 6 diesel vehicles pay a daily fee to drive into central London. MPs from several Parliamentary Select Committees have also launched a new joint inquiry into the government’s air quality plans. They will consider the health and environmental impacts of air pollution, with a particular focus on vehicle emissions. The BVRLA will make a formal submission to the inquiry, and invites members to send their views, particularly regarding incentives to encourage lower-emission motoring. The BVRLA and interested members have also formed a working party on the World Lightduty Testing Procedure, together with the SMMT, the Low Carbon Vehicle Partnership and ACFO. u

The association has sent its ‘main contact’ at each member company a version of the logo appropriate to their membership type. Balance to be struck on access to vehicle data The SMMT’s recently published position paper makes interesting reading for our industry. It talks about vehicle manufacturers’ attitudes to connected vehicles and data, and touches on autonomous vehicles, cyber security, connectivity, infrastructure and the future regulatory environment. The BVRLA has a slightly different position to the vehicle manufacturers. You already know that connected vehicles have the potential to reduce costs, emissions and the number of road accidents. The business value lies not only with the connectivity itself, but the enormous volumes of data that it provides – be it data about driving style, vehicle health, usage patterns or location. You can already obtain this information from telematics devices, but, in the era of the connected vehicle, every car, van and lorry will have its own embedded telematics device. This opens up a host
of opportunities for BVRLA members to develop new fleet and driver-focused business models. Unsurprisingly, an argument is brewing over access to vehicle data, with vehicle manufacturers on one side and a coalition of vehicle owners, repairers and insurers on the other. We believe there is a balance to be struck – creating a level playing field while ensuring vehicle manufacturers’ concerns are addressed. There’s more about this on page 5. To help members get up to speed with this technology and its legal implications, we will be running a workshop with KPMG in May, and we’re preparing a seminar on the General Data Protection Regulations. The issues are sure to be addressed at our fourth annual Fleet Technology Congress in July as well. Thank you in advance for supporting us in this work. u

Spring Budget keeps fuel duty frozen but ignores green options Chancellor of the Exchequer Philip Hammond delivered his first Spring Budget to the House of Commons in March. It included a freeze on fuel duty and a pledge to explore the tax treatment of diesel vehicles, but ignored the BVRLA’s calls for a more environmentally effective approach to Company Car Tax and Vehicle Excise Duty (VED). After the Budget, HM Treasury published the Finance Bill. This confirmed changes to VED and tax on salary sacrifice that have since come into effect (on 1 and 6 April respectively). The BVRLA welcomed the Chancellor’s decision to freeze fuel duty for the eighth year in succession, as well as the news that both the VED rates for hauliers and the HGV Road User Levy will remain frozen for another year. A call for evidence will be launched over the summer on plans to update the current HGV Road User Levy, with a greater incentivisation of efficient routes and less-polluting vehicles. However, BVRLA Chief Executive Gerry Keaney said: “Mr Hammond’s first and last Spring Budget was the perfect opportunity to create a fairer, simpler tax system that incentivises the uptake of ultra low emission vehicles. We are
now left with Company Car Tax and VED regimes that do little to support the government’s green agenda or tackle the growing air quality crisis. “At the moment, a 20% taxpayer choosing between a pure electric BMW i3 and a hybrid Mitsubishi Outlander – both of which have similar P11D values and sit in the same tax band – will pay the same company car tax over the next three years. The current regime provides no incentive to choose a pure electric vehicle until 2020. The BVRLA’s call for the government to bring the introduction of the new 2% rate forward from 2020 to 2017 would incentivise drivers to choose cleaner cars now.” In response, the government has said it will aim to address how the tax system could be made fairer and more coherent concerning benefits in kind, with a further consultation planned over the summer. u

BVRLA urges DfT to test vans sooner The BVRLA has submitted a detailed response to the Department for Transport’s consultation on the future of the MOT, urging the government to reconsider the frequency of tests for light commercial vehicles. The BVRLA supported the government’s proposal to extend the period for the 4
first MOT for new cars from three to four years, but opposed the same extension for class 7 vans (those weighing 3,0003,500kg). The association recommended that the date of the first MOT test for such vehicles should be cut to one year after first registration, in order to address any potential safety considerations.
The BVRLA also opposed a proposal to add the cost of van enforcement to MOT charges rather than general taxation. It called for transparency in how those revenues are spent, if they are introduced. The BVRLA has since met with the Department for Transport to discuss the proposals, and will continue to engage with it after the consultation period. u March/April 2017 |

Differences emerge on connected cars and vehicle data access Vehicle manufacturers have staked a claim to be the ‘gatekeepers’ of all connected vehicle data. The position is set out in a recent paper from the SMMT endorsing a new technical platform for supplying vehiclegenerated data. The manufacturers’ representative trade body claims the system can send data securely, safely and in a non-discriminatory manner. Referred to as the ‘Extended Vehicle’, it sees data relayed to a server maintained by the manufacturer. Data can then be transferred to a third-party or shared with a neutral system that consolidates data feeds from a number of manufacturers. The SMMT paper also refers to fleet sector requirements and obligations: › Personal data should only ever be
used or shared with the express and prior consent of the vehicle user, not the registered keeper.
› The primary user of a connected
vehicle (who registers for a connected service or agrees to terms and conditions) must be at the heart of any data consent process.
› Vehicle manufacturers DO NOT
have an obligation to provide vehicle data to registered keepers. Where data
is shared, it will be subject to a ‘B2B agreement’. › It is neither feasible nor reasonable for
vehicle makers to test and approve all third-party devices and services.
The BVRLA is concerned that the Extended Vehicle platform would prevent fleets and vehicle owners from installing or using third-party apps or interfaces, such as telematics hardware. It believes the system would also give vehicle manufacturers preferential access to data and stifle innovation. Through Leaseurope, the BVRLA is working with the Coalition for Interoperable Data Access, which includes trade associations representing the insurance sector, motorists, independent repairers and garage equipment manufacturers. London faces a mobility challenge, says Keaney The BVRLA has urged policymakers to produce a vision for the way they want car clubs, car rental and other types of mobility service to work in London. This was one of the key messages delivered at a recent London Mobility Forum held at London’s City Hall. The event – organised by the BVRLA, DriveNow, BMW, Zipcar and the IPPR think tank – was attended by more than 150 policymakers and representatives from the transport and environmental communities. The BVRLA hosted a panel session on the car club sector and contributed to a report published by the IPPR (Crossroads – Choosing a future for London’s transport in the Digital Age). Speaking at the event, BVRLA Chief Executive Gerry Keaney said: “World cities that compete with London for talent are racing to incorporate new technologies and attitudes to transport. When it comes to car clubs, London is in danger of being left behind. “BVRLA members want to work in partnership with London authorities to fulfil this potential. The decisions made by the Mayor and TfL in this term will decide whether London becomes an exemplar for intelligent, sustainable transport, or a graveyard for innovative mobility services.” The BVRLA and a group of car club and car rental members have already met with the authors of the London Mayor’s Transport Strategy, in a bid to ensure that the sector is properly represented. Annual Dinner celebrates 50th anniversary in style At a glittering Annual Dinner to mark its 50th anniversary year, the BVRLA recognised the contributions of outstanding performers in the vehicle rental and leasing industry. Awards were presented to several worthy winners at the March event, with Christopher Hume of Arnold Clark Car & Van Rental picking up the Certificate for Rental Operator Skills and Jonathan Ellis of Volkswagen Financial Services being named Fleet Consultant of the Year.
The event took place at the London Hilton on Park Lane in March and saw more than 900 guests enjoy a wonderful evening of food and drink. Entertainment was provided by acclaimed standup comedian Marcus Brigstocke and corporate imposter Graham Davies.
Three more names were also added to the BVRLA’s Industry Heroes roll of honour: Ashley D’Alanno of Licensed Carriage Hire, Janine Lemon of LeasePlan UK and Jennifer Thomas of ALD Automotive.
Guests at the event raised £10,491 for automotive industry charity Ben. Such was the success of the event that next year’s Annual Dinner has already been booked at the same venue for 1 March 2018.

Fleet User Group will drive DVLA improvements The first meeting of the Driver & Vehicle Licensing Agency’s Fleet User Group took place on 30 March, with attendees from the BVRLA and three other trade associations.
Notifications (SORNs) and bulk Vehicle Excise Duty (VED) refunds. The next steps are for the DVLA to produce a list of key areas for development and for the group to contribute a priority rating to these, along with a cost benefit analysis. BVRLA members will be able to attend future meetings. u

Fair Wear & Tear: clear message will aid rentals Last year, a working party made up of BVRLA members and ACFO representatives met to discuss the reasons customers complain at the end of lease – this was a precursor to the review of the BVRLA’s fair wear and tear standards for LCVs and minibuses. The new guidelines will be published later this year. The working party said that end of lease charges are one of the reasons businesses don’t lease or rent vehicles. Either they have had their ‘fingers burnt’ in the past or they fear being charged with unscheduled costs at the end of the lease period. They suggested that BVRLA members do more to explain to customers how return standards can be satisfied. Some members allow their customers to repair or replace damaged items, other members will repair/replace on customers’ behalf and apply a matrix 8
to calculate the damage charge. Other BVRLA members operate a profit share based on the residual value calculation. Whatever policy the BVRLA member adopts, customers must be fully informed about what to expect. The working party suggested members support fleet customers more during the rental or lease, including collaborating about looking after the vehicle in-life. Best practice is to put Fair Wear & Tear booklets in vehicles and/or give customers access to an online version. u
Road traffic offences: let’s change the law The BVRLA is formulating a campaign to improve road traffic offence legislation for rental and leasing companies. Current laws are complex and vary according to the offence, or whether the notice is issued by a private parking company or local authority. The association believes consistency is needed and will be calling on the government to bring in a single legislative act allowing rental and leasing companies to transfer liability for all offences and notices. The BVRLA will also be calling for a review of the evidence that rental and leasing companies are required to supply. It is keen to see electronic transfer of liability become the norm for all authorities and private parking companies, and to end the need to send hire or lease agreements. u

Quarterly Leasing Survey shows strong surge in van numbers The BVRLA’s latest Quarterly Leasing Survey has found that members’ business car and van leasing fleet (business contract hire and finance lease cars and vans) grew by 6.6% year-on-year in the fourth quarter of 2016. This comprised 3.6% growth in the number of cars, and a 16.2% increase in the number of vans.
car ownership schemes, hire purchase and salary sacrifice. In Q4 2016, the business fleet leasing sector represented almost 70% of the BVRLA car fleet, compared with 75% in Q4 2015. The proportion of diesel cars in the total fleet continued to decline, and stood at 76% in Q4 2016, compared to 80% a year earlier. The diesel proportion of cars newly registered also fell, from 74% in Q4 2015 to 68% in Q4 2016. The long-term growth in demand for plug-in hybrids continued, representing 4.5% of the total BVRLA fleet and 5.6% of new deliveries.
When it comes to the total car leasing fleet (including personal contract hire, hire purchase, contract purchase, personal contract purchase, employee car ownership schemes and salary sacrifice products), members responding to the survey reported that this expanded much faster than the business car fleet, at 12% year-on-year.
The survey also found that the average lease car added to a member’s fleet in 2016 emitted just 110.8g/km CO2 – more than 7% less than the average new car registered in 2016. u
Of note is that personal contract hire contributed 49% of this growth, and business fleet leasing (contract hire and finance lease) another 25%. The remainder of the growth came from personal contract purchase, employee

Euro 6 rentals rise as hybrid registrations fall Findings from the latest BVRLA Rental Operator Survey have shown that the number of Euro 6 compliant vehicles on members’ fleets is increasing. Some 89% of rental cars were Euro 6 compliant in 2016, up from 22% in 2015. One in five vans is Euro 6 compliant – up from 18% in 2016. These changes are to be expected, as all new cars registered from 1 September | March/April 2017
2015 and all new vans registered from 1 September 2016 had to be Euro 6 compliant. Rental cars are replaced every eight months, on average, and rental vans every 19 months. Euro 5 11%

The survey also found that the number of hybrid vehicles on the rental fleet fell in 2016. This is primarily due to manufacturers increasing the prices of their hybrid vehicles, and the realigned Plug-in Car Grant effectively reducing the fiscal incentive available from the government. u
Brokers’ fleet size up 26% The BVRLA’s Leasing Broker Survey for the second half of 2016 shows sustained year on year growth. Data submitted by seven funders indicate that there are 261,653 vehicles in BVRLA members’ fleets – up 53,647 on 2015 (a 26% rise). There were 110,813 new contracts in 2016, compared with 93,500 in 2015, making a year on year increase of around 17,000 vehicles. u To participate in future surveys, contact Research & Insight Manager Phil Garthside. Are your vehicles off to France? Then get your stickers ready In preparation for the fastapproaching holiday season, the BVRLA is urging members to ensure that customers are informed about the requirements for travelling abroad in a hire or lease vehicle. This year, customers visiting France will not only require a VE103 certificate (see right), but must also display a ‘Crit’Air’ sticker if they take vehicles into Paris, Lyon or Grenoble. These cities have new low emission zones, so drivers need a sticker showing the Euro emissions standard of their vehicle. Failure to display one will result in a fine of between €68 and €135.
The responsibility for obtaining the sticker is that of the driver, although BVRLA members may wish to arrange this for their customers. Crit’Air stickers cost €3.70, plus postage, and can be purchased online at www.certificat-air. gouv.fr in advance of travel. According to the website, delivery takes up to 30 days, although the BVRLA is pushing for stickers to be available at ports and service stations. The BVRLA recommends that rental members obtain the stickers for a selection of vehicle types. The stickers don’t have an expiration date, so can be kept in vehicles until disposal. u
Webinars for convenient customer service training April sees the launch of the BVRLA’s latest training initiative: the Customer Service Webinar Programme, designed by Grosvenor Training Services. Karen Morton, a Learning and Development Specialist at Grosvenor, designed the programme specifically for daily rental members of the BVRLA, (particularly small to medium-sized operators). The aim of the programme is to provide manageable training for organisations that don’t have the time or budget to invest in outsourced training. Sending staff away for training can be a costly investment. With this in mind, the webinar approach allows for staff to be trained at their place of work through a series of four sessions on customer service skills. 10
Don’t forget the VE103! Vehicle on Hire Certificates are required for all vehicles travelling in Europe. The VE103 is the only legally acceptable alternative for the V5C vehicle registration document, providing the hirer with proof of the vehicle owner’s permission to take the vehicle out of the country. The BVRLA provides a bespoke VE103 service – the VE103B – that includes document management, scanning and retrieval to meet annual DVLA audit standards. The goal is for members to have access to online learning materials addressing their funder, Financial Conduct Authority and BVRLA Code of Conduct competency requirements. The courses will be certificated, providing key evidence of training. The system will also allow funders to host bespoke training for members. The service, to be launched this Summer, will be available for an annual subscription fee. u
