Get Permission! This time of year Fish and Wildlife officers receive numerous reports from frustrated landowners regarding hunters accessing their property without permission. Many times fields, crops and windbreaks are damaged due to the inconsiderate nature of those who are trespassing on others’ properties. A lack of a “No Trespassing” sign does not mean that land can be automatically accessed. Since amendments to the Petty Trespass Act in 2004, landowners no longer have an obligation to post ”No Trespassing” signs on their property; therefore, anyone wishing to use privately owned land must first seek permission from the landowner or a representative appointed by the landowner. Hunting is a privilege, which could quickly be lost resulting in the seizure of the animal harvested and significant fines. Driver crashes through door September 26

Unknown person(s) trespassed onto a property near Miquelon Lake, gaining access to a shed by driving through the door to break the dead bolt. Camrose RCMP are currently investigating.

Be advised of a new phone scam: someone calls stating they are from the Royal Administration and that a son or daughter was involved in a fatal collision. They ask for money to begin preparing funeral arrangements.

Wild Rose Co-op Hunters must get landowner permission By Lori Larsen

Trespassing on others property essentially means being there without permission and is not only against the law, but shows a lack of respect for the rights of the landowner. Since amendments to the Petty Trespass Act in 2004 landowners no longer have an obligation to post No Trespassing signs on their property, therefore anyone wishing to use privately owned land must first seek permission from the landowner or a representative appointed by the landowner. Trespassing applies to all privately owned or public (leased) land whether that be in the city or the county. With hunting season now upon us county residents may once again find

themselves dealing with hunters using their land. Camrose Fish and Wildlife Enforcement Branch district officer Lorne Rinkel advises hunters to be diligent about knowing exactly where they are hunting and ensuring they always get permission to gain access to private or public (leased) lands. “From the hunters perspective, it doesn’t matter if it is not posted, or fenced or under cultivation, they have to go get permission from the private landowners, period.” While not required by law, Rinkel suggested that having a written copy of permission with you while accessing private and public (leased) land will save the time it takes for FWEB officers to investigate

whether permission has been granted. In most instances of trespassing, charges are being laid as the result of a complaint from a landowner, and hunters need to be fully aware of the consequences of trespassing on private or public (leased) land. “If charged under the Petty Trespass Act hunters need to be aware that any animal they have harvested becomes illegal and it will be seized. We will take the animal,” noted Rinkel. As well the hunter will receive a $287 fine. Under the Wildlife Act anyone convicted with trespassing on occupied land, will automatically receive a one year hunting licence suspension, a fine and loss of the harvested animal. According to Section 38 of the Wildlife Act occupied land is defined as (a)privately owned lands under cultivation or enclosed by a fence of any kind and not exceeding one section in area on which the owner or occupant actually resides, and (b)any other privately owned land that is within 1.6 km (1 mile) of the section referred to in clause (a) and that is owned or leased by the same owner or occupant. “You must contact the lease holder to get permission to be on the land.” As well, occupied lands do not need to be posted with No Trespassing signs. Rinkel recommended all hunters carry land ownership maps available from the MD that contain landowner contact information, or download one of the APPS now available that show all the landowner designations and in many cases phone numbers. “Lease holders are required by law to advertise phone numbers,” said Rinkel. “And there is a government website (aep. alberta.ca under the Recreation and Public Use header)with information about accessing lease land including landowners and contact information.” On a final note, Rinkel advised landowners that guides and outfitters are required by law under the Wildlife Act to tell private landowners they are a guide or outfitter and they are conducting a business and charging a fee to clients. “They have to be very clear about that so landowners understand it is a commercial outfit and that they have paying clients. Misrepresentation by commercial operations is something we spend a lot of time dealing with.” Hunting is a privilege granted to residents that in many cases affords them an opportunity to provide sustenance but is also a regulated way to control the population of wildlife, that may otherwise become a nuisance by sheer number alone. But those privileges can be lost by making poor decisions. “Do your research before you go out hunting and always get permission before hunting on any private or public (leased) land.”

The Battle River Community Foundation awarded a grant to the Town of Hardisty to assist with purchase of a blood pressure monitor for the town owned Hardisty Medical Clinic. The grant is from income from the Doreen and Irving Bell Fund and the Annie and Dick Drever Fund, both created to support projects in the Hardisty community. The Battle River Community Foundation exists to support projects and facilities, such as this, in East Central Alberta which benefit the local communities and have a positive impact on the future. Grants from the Battle River Community Foundation are primarily made possible through the generosity of individual donors and organizations that have created endowment funds. The principal of these endowment funds are kept intact and the income is made available annually to support local projects and organizations. Damage, theft in rural areas on the rise A complaint was received by the Camrose RCMP of a theft from motor vehicle in Bawlf in the early hours of the morning. Two vehicles were damaged as a result. The complainant observed two males wearing black hoodies, driving a white Ford truck in the back alley. The same suspects may be responsible for a break and enter in Daysland. Report any and all suspicious activity to police at the time of the incident. The lock was cut on an equipment trailer in Bawlf, a truck was also broken into and damaged. This occurred in the early morning hours. Police responded to a residential alarm in Bittern Lake around 10:30 a.m. It was determined to be a break and enter, with access gained to the shop. This is currently under investigation. Police received a report of a stolen vehicle. The blue 2006 Ford F350 was parked on a street in New Norway. This occurred between 1 and 7:30 a.m. A grey Dodge Caravan was observed driving slowly around New Norway around 11:30 p.m. the night before, with an incorrect licence plate attached. The van may be associated with the theft, this is still under investigation. Access was gained to a Ford Escape parked in New Norway. The lock was jimmied and the vehicle was rummaged through. This occurred between the dates of Sept. 27 and Oct. 2. A white 2004 Toyota Camry was stolen from a residence near Range Road 194 and Twp 480. The theft occurred throughout the night. A Ford Super Duty truck with the ignition punched out was found abandoned in a field approach along Highway 834 mid-afternoon. It was determined that the truck was stolen from Camrose sometime overnight or early morning. A break and enter occurred overnight in Bawlf. A vehicle lock was punched out and the garage door opener was missing along with tools and fishing gear. September 28

Numerous tools were stolen from the back of a parked truck sometime throughout the day. Tools included air tools, ratchet sets and various hand tools. If you have any information regarding any of the above mentioned incidents, contact your local RCMP.

KEEPING TRACK IN A CHANGING MARKETPLACE AFREA has been busy keeping up with developments in the electricity sector and advocating on behalf of our member REAs. Listed below with a summary description, are a few of the items we have been working on and information about the regulatory bodies we interact with when we represent you. 1. The Market Surveillance Administrator is reviewing the Regulated Rate Option at Alberta Energy’s request. On June 1, 2017, the Regulated Rate Option was capped at $0.068/ kWh through passage of Bill 16 in the Legislative Assembly. The AFREA continues to provide feedback on this change and is working closely with the MSA. 2. FortisAlberta Inc. has applied for an order from the Alberta Utilities Commission to: a) confirm its service areas on land annexed by municipalities, and b) compel REAs to turn over wires, substations, and their corresponding members. AUC Proceeding 22164 is ongoing. It directly involves three REAs that are AFREA members. The AFREA is representing its members and one additional REA in disputing this application. We have engaged legal counsel and technical consulting expertise to assist us. 3. The Alberta Utilities Commission (AUC) is tasked with investigating distribution-connected generation. Proceeding 22534 involves how renewable (solar, wind, hydro) and alternative energy sources could be expanded in Alberta to produce electricity close to power users. The AFREA is participating as a key stakeholder in this proceeding, at the request of the AUC. 4. In June 2017, the AUC approved changes to Rule 024: Rules Respecting Micro-Generation. The AFREA has represented our members’ interests in this Consultation. The Rule changes were effective July 4, 2017. After 75 years in the business, the environment has likely never been more complex than it is now. Even in these far-reaching scenarios, we have not mentioned all the agencies involved in running Alberta’s electricity industry. While we ask for member input into these cases, we recognize it’s a zoo – not just technical detail, but of too many acronyms and players to keep track of. But it is possible. Here’s a list of “who’s who” to detangle it for you. Thank you to our member REAs for representing their members and the unique nature of their REA when providing input. KEY ELECTRICITY PLAYERS IN ALBERTA Alberta Utilities Commission (AUC): Our principal regulator – the AUC operates with many of the same powers as a court of law. Alberta Electric System Operator (AESO): The AESO operates the provincial power grid 24/7 by dispatching the power sold by generators.
