Beginning October 2007, a new federal law known as the Military Lending Act limits the way some kinds of credit can be offered and priced for military personnel and their Families. The new law affects a limited number of financial products, including payday loans, vehicle title loans, and refund anticipation loans. The Act limits the APR on certain loan products to 36 percent all-in, which means all fees associated with the product are included in the APR calculation. The Act includes a new “military APR” that not only includes interest fees, but also includes any one-time fees or annual account fees. Active Duty personnel, Activated Reservists, Spouses and dependent children, and individuals relying on service members for a majority of their financial support are “covered borrowers” under the Act. All covered borrowers should closely review the terms of any loan product. Contact a Financial Counselor at Army Community Service if you have questions about the Military Lending Act.
