TECHNICAL ASSISTANCE: DEVELOPMENT OF PROCUREMENT PROCEDURES FOR PURCHASES OVER $50,000 AND OF MODEL REQUEST FOR PROPOSALS AND CONTRACTS FOR REAL ESTATE DEVELOPMENT PROJECTS The Fideicomiso de la Tierra del Caño Martín Peña (Fideicomiso), is a private, nonprofit community land trust that owns and manages over 200 acres of land, through collective land tenure, for the benefit of the residents that live within the Caño Martin Peña Special Planning District (District) and in accordance with the District’s Comprehensive Development and Land Use Plan. It regularizes land tenure for approximately 1,500 families, preventing gentrification as an unintended consequence of the tidal channel’s ecosystem restoration while guaranteeing security of tenure and access to affordable housing. In 2018, the Fideicomiso won the Communities Thrive Challenge, sponsored by the Chan Zuckerberg Initiative and The Rockefeller Foundation. As part of the award, the Fideicomiso request proposals from qualified and experienced attorneys or law firms to provide technical assistance to the Fideicomiso in the following two areas: (a) Development of procurement procedures for purchases of over $50,000. (b) Development of model request for proposals and contracts that the Fideicomiso and its subsidiary, Desarrollos Martin Peña, Inc. (DPM), can use to select the appropriate development team and engage in partnerships that will enable real estate development projects. Attorney or law firm must have capability to operate in Puerto Rico and provide a professional liability insurance policy. Procurement procedures The Fideicomiso has adopted procurement procedures for professional services and for the purchase of goods, works, and services valued under $50,000. The Fideicomiso needs to establish procurement procedures that are within its administrative capabilities and compliant with federal government regulations, within cover the purchase of goods, works, and services valued over $50,000. Such procedures must be available for the Fideicomiso to carry out the upcoming procurement of services related to the rehabilitation of a building. Housing and mixed-use development The Fideicomiso owns several lots that are available for development, as per the District Plan. Although the land cannot be sold, the Fideicomiso can engage in long term leases, grant surface rights, among other property management tools to enable such development. Its priority is to provide and maintain affordable housing within the District, and specifically, to provide housing alternatives targeting the families that are undergoing a relocation process in compliance with the Uniform Relocation Act. Such acquisitions and relocations are led by the Corporación del Proyecto ENLACE del Caño Martin Peña, a public corporation created under Law 489 of September 23, 2004, as amended, tasked with implementing the District Plan. During the upcoming years, the Fideicomiso seeks to build 450 housing units for homeowners and approximately 200 for renters.
