Walia loses lawsuit Judge says city was not negligent in its dealings over a pub and liquor store BY ANDREW FLEMING REPORTER afleming@royalcityrecord.com

Acivil lawsuit brought against the City of New Westminster citing gross negligence and misrepresentation has been dismissed by the Supreme Court of British Columbia. Nirmal Walia, the president of P.S.D. Enterprises Ltd. and the former owner of the Windsor Hotel on Columbia Street, launched the lawsuit against the city. He claimed that Tim Whitehead, the city’s former director of development services, assured him that if he sold the Windsor Hotel property to a developer, the city would undertake any necessary rezoning to enable him to relocate his private liquor store to a new location on 12th Street. Walia sold the property to Ballenas Project Management, who then demolished the building to build the new Downtown Interurban condominium tower, for $2 million but never received approval from the city to relocate his liquor store. He later lost both his provincial pub and liquor store licences and was seeking up to $2 million in damages. In a ruling released on April 8, Judge Miriam Gropper said: “P.S.D. has not satisfied me that ◗Lawsuit Page 8

Seizing on the federal election campaign, the B.C. Nurses’ Union held a rally outside Royal Columbian Hospital Monday afternoon to demand an end to “hallway health care.” “There’s 54 patients admitted that have no beds to go to, and that is outrageous,” said Janice Buchanan, union vice-president, gesturing to the hospital. “We’re going to be out there to hold our politicians accountable.” Helen Roberts, a New Westminster resident and pediatric care nurse at Royal Columbian, said she sees that kind of overcrowding daily.

“If you go on any of the wards, there’s anywhere between three to five beds in the hallways. The hospital has gone off and bought privacy screens by the dozen to create these beds,” she said. Roberts said treating patients in hallways is unsafe for both the patients and hospital staff trying to treat them. She said her daughter-in-law was recently a patient at Royal Columbian and was forced to use a hallway bed for hours without access to a bathroom. Roberts said Royal Columbian’s beds are often taken up by seniors who could be treated at home, but home-care services don’t have the funding or staffing to be effective. She said an expansion of Royal Columbian would also go a long way to

Roberts said concerns over overcrowding shouldn’t be limited to the hospital staff and patients who have been forced to deal with it, as everyone has a stake in health care. “With the election coming up, it should be on the forefront for everybody because it concerns everybody. Our health care is really going downhill,” she said. New Westminster-Coquitlam New Democrat Fin Donnelly was the only local candidate to appear at the rally. Green Party candidate Rebecca Helps was working at the time, according to the union. Liberal candidate Ken Lee didn’t respond to the union’s invitation, and Conservative candidate Diana Dilworth’s campaign told the

An expansion to the Queensborough Community Centre will try to make the building more welcoming. The $6.2-million expansion to the community centre will include child-care and early childhood development spaces, expanded weight room facilities, library services, police office space, dedicated youth and senior spaces and additional multipurpose rooms. Jennifer Marshall, an architect with Urban Arts Architecture, said the plan is to retain the existing community centre and build additions on two sides of the existing building. The expansion will also include an atrium space and will see the existing fitness space moved to a new area upstairs and used as the new home of a library/reading room area. “The theme has been about making connections, making community,” she said. Marshall said the expansion is really building on the strengths of the existing community centre and trying to create a “pavilion in the park” rather than a street front building. It’s an argument that should have happened on Feb. 8, but the future of Hume Park Elementary may be back on the table. On Monday morning, when the New Westminster school district posted the agenda for its April 12 meeting (which was held after Record deadlines), one item stood out. Trustee Brent Atkinson moved forward a motion with the subject: Hume Park/Richard McBride consolidation. Hume Park has been earmarked for closure or consolidation in the past because of dwindling enrolment numbers. In that one-paragraph motion, Atkinson is requesting staff undertake a review related the possible consolidation of Hume Park and Richard McBride “in a manner that is consistent with board policy.”

When reached by The Record on Monday afternoon, the longtime school trustee was adamant in his argument. “If we have a program in the district, and it doesn’t matter what program it is, that isn’t educationally advantageous or fiscally responsible, we have to look at it,” said Atkinson, who said his latest numbers are that of the 26 students at Hume Park, eight are currently in Grade 5 and thus graduating to middle school in September. Add in the fact the district is anticipating less than eight new kindergarten students entering the school in September, and Atkinson wants to at least revisit the issue of operating a school with less than 25 students. “Currently, we have one grade with one student and another with three students,” said Atkinson. “Educationally, it doesn’t make a lot of sense to me, and I don’t think it’s fiscally responsible.”

As well, the sled-dog investigation, which the SPCA led, is estimated to cost at least $200,000. Clark also said the government will start providing annual funding to the SPCA. To be sure, there will certainly be protests or cries for help from other animal rescue organizations that are

hurting from a lack of funds. And there will be continuing pressure from animal rights groups about changing the rules around how farm animals are treated in B.C. And, finally, veterinarians have mixed feelings about a new rule that would force them to report suspected cases of animal abuse. But Clark’s pledges are a big step forward from what the previous government did, and these changes will make a difference.

Where do the Greens belong? IN THE HOUSE KEITH BALDREY

T

he kerfuffle over Green Party leader Elizabeth May’s exclusion from the federal leaders’ debate is a reminder there may be a controversy over the makeup of the next B.C. leaders’ debate. May lost a court challenge of the decision by the television media consortium – made up of national networks such as Global, CBC, CTV, RadioCanada and TVA – to not invite her to participate in either of the English or French language debate. May’s loss in court may have negative implications for B.C. Green Party leader Jane Sterk’s chances for being included in the next B.C. debate (I stress the word “may” because no decision will be made by the B.C. television consortium for some time yet). The Greens have had their leader in the provincial debate since the 2001 election. Former Green leader Adrianne Carr was given a place because, at the time, the NDP was in freefall in the polls and the spread between the NDP and the Greens had narrowed so much it was hard to argue that excluding the upstart

Greens while including the fading NDP was somehow fair. Indeed, while Carr’s party didn’t elect an MLA in the election, it did pull in more than 12 per cent of the popular vote – more than half of what the NDP received that year. With that impressive showing, Carr was invited back to the 2005 vote. But the Green vote shrunk to just 9.2 per cent in that contest. Nevertheless, Carr’s successor as Green leader – Sterk – was invited to the 2009 debate. But the Green vote declined for the second straight election – down to just 8.2 per cent. So, a question naturally arises: should the Green leader be part of the next televised debate of B.C. political leaders? As someone who has some degree of input into the decision by B.C. television stations about the debate structure (I’ve helped negotiate the last three election debates with the parties involved in each one), I think it’s a fair question. The NDP has long complained about including the Greens in the debate. The party feels the Greens “steal” more votes from the NDP than from the B.C. Liberals and so has the most to lose from the publicity a debate appearance brings a political party. As well, a number of environmentalists have become increasingly frustrated with the Green party’s inability to connect

School board’s criticism ironic Dear Editor

Re: Good report card doesn’t impress trustees, The Record, April 2. In reference to the latest publication of the Fraser Institute’s Report Card, The Record quotes New Westminster school board chair Michael Ewen as saying “I think their methodology is flawed and they’re politically motivated.” The irony of this statement, delivered mere days after the school board itself sent out a very methodologically flawed survey that was quite obviously politically motivated, astounds me. Don’t get me wrong, I am no fan of the Fraser Institute. But I am a fan of sound science, integrity, and transparency. And, quite frankly, the school board, with its survey that includes asking elementary school children if they would like two weeks for spring break instead of one, doesn’t exactly get a gold star in any of

those categories. What possible reason, other than political motivation to artificially inflate the numbers showing support, could one give for including the opinions of children on this topic? Can they fully understand the ramifications of such a change including the financial and academic costs? I think not. My advice to the school board: Criticize the Fraser Institute all you want, but make sure your own backyard is in order first. Kim Deighton, by e-mail

Fact: The “train accident” that happened years ago is in fact not directly on the new park property but on a neighbouring plot. Anyone with the energy Mr. Bell has in the drive to defame by ruthless public attacks should at least have correct facts and have the decency and respect to diplomatically put their efforts towards who or what actually caused this – the train. Stop the defamation and demoralizing the character of our city by malicious, public, alarmist, sensationalized letters. Get the facts. You would get further by targeting the correct place. We all know what happened, Mr. Bell, and somehow you exaggerate and twist the facts, and publicly direct blame to the wrong place. I am proud of our city and its valuable history, as are most residents who invested their livelihoods here. You do know “history,” Mr. Bell. Be thankful we are not in the past. Harper’s arsenal of evasion Dear Editor:

Political polling continues to show the Conservatives in the lead, which is understandably applauded by the CEOs who’ve

been promised more tax cuts, and by industrialists who know Stephen Harper will not let environmental concerns interfere with exploiting natural resources and polluting our air and water. But why in the world are so many “ordinary” Canadians supporting the Tories when the major Harper commandments go against what other polls show are the needs and wishes of the people? Surely we know by now that the old claim that fattening big business means more jobs and prosperity for all is a ridiculous myth. Feeding a horse all the oats it can eat, it has been said, may indeed result in some undigested grain on the ground to feed the sparrows, but is that all we want? The Harperites are set to spend $30 billion or more on new warplanes, assuring us that shiny new machines will guarantee protection against all the baddies out there that also have shiny new machines. But I wonder why all the nations that already have great fleets of these things are clearly paranoid? And wouldn’t we rather spend our money in healing the sick and preventing disease? I think the only notable talent of Mr. Harper is his command of political tricks and schemes that apparently influence the thinking of many Canadians. He has a fine arsenal of evasion, coverup and economic threat to counter his moves that make us an international laughingstock in climate change, apes U.S. foreign policy and rubbishes the natural world we need for survival. Do we need this election? Of course we do. And we need it far more than we need any more of the hollow, Sam Slick cleverness of the arrogant Stephen Harper. Tony Eberts, New Westminster

with the voters and wonder whether it’s more effective to shape stronger environmental values in the other parties rather than support the Greens. Despite three debate appearances, the Greens have yet to elect anyone and in fact haven’t even come close to winning a seat. However, the Greens argue that electing an MP or MLA should not be the sole criterion for determining which party leader gets on the debate. There is some validity to this argument. Our first-past-the-post electoral system favours large established parties and makes it difficult for newer, smaller parties to win seats. At the national level,

the Green party received almost one million votes in the 2008 election but won no seats. Should those near-million voters have no representation in the debate? At the provincial level, the Greens won almost 135,000 votes in 2009. Is that enough to get on the stage at the debate? May has complained that the network consortium established the rules on an arbitrary basis. That may be true, but any rule that anyone else comes up with would be of an arbitrary nature as well. Perhaps there should be more than one criterion to establish which party leader is allowed in such debates. Such things as seat representation, portion of

popular vote, a large number of candidates in the field, and significant polling results (from a series of polls over time) could be used as criteria, with leaders qualifying for inclusion if their parties meet a set combination of those factors. But there is no sure thing when it comes to leaders’ televised debates. Neither Sterk nor, for that matter, newly installed B.C. Conservative Party leader John Cummins, is guaranteed a spot in next provincial debate, even though they will vociferously argue for one. New Westminster Secondary School Grade 12 student Todd MacMurchy received a Dr. M. Wosk scholarship for Youth Environmental Leadership at the Pacific Parklands Foundation annual general meeting held on March 31. MacMurchy was one of six people who shared a total of $2,250 as part of the foundation’s 2010 awards program. “Todd was selected to receive this award as a result of his volunteer commitment and leadership skills,” states a press release from the foundation. “He has been involved with the Catching the Spirit program as a peer leader for only one year, but volunteered an incredible 147 hours to the program, contributing to both the overnight and daytime programs.”

Todd, who plans to attend BCIT after graduation, has also volunteered at Walk for Smiles and was part of a group of Catching the Spirit youth who created and delivered a workshop on biodiversity at Metro Vancouver’s annual Parksfest. The awards were established by the Wosk family to encourage youth leadership in environmental areas. According to a statement from Wosk, “With one good leader, there is the potential of attracting a thousand or more participants. Without that one good leader, thousands of people may never get involved.” The Pacific Parklands Foundation is a non-profit charitable organization dedicated to the preservation and enhancement of Metro Vancouver’s regional parks. There are 21 such parks in and around the Lower Mainland, covering more than 10,000 square hectares.

The contest, which runs in April, includes prizes such as dinners at local restaurants and other New West experiences. “We are looking for simple things people can do every day, like wearing a button that encourages people to say hi,” said John Stark, the city’s senior social planner. Judges representing the city, local community groups and the business community will select winning entries in three categories – community groups, youth and adults. Entries will be judged on their creativity, effectiveness and ease of implementation. “We are looking for fun, clever ideas that get people talking and make it easier to meet people,” said Coun. On Thursday, April 14, from 2:45 to 7:30 p.m. in the Herbert Spencer Elementarygym,theNewWestminster chapter of Canadian Parents for French is hosting its sixth annual Marché Français Marketplace. “With the recent closings of Vancouver’s most renowned multi language book store, Sophia’s Books, and the largest source of music, games, CDs and DVDs, French bestsellers, it is even harder to find local French resources,” Heidi Clarkson, local parent and chair of the New

Westminster chapter of Canadian Parents for French, said in a press release. “But we have sourced out several amazing businesses, such as Kidsbooks, French Usborne Books, Savoir Books, Word Nerd Language and Education Ltd. and L’École des Loisirs, offering quality book subscriptions from France, who are bringing tons of French books and other various stock for all ages.” The event will also feature artists displaying photography from France, garden jewels and locally made French greeting cards. The local Van Dop Art Gallery is also showcasing work from some French-Canadian artists. Clarkson said there will also be some surprises, including accordion folk dance music from France and

The New Westminster Historical Society will be taking a peek into the life of Canada’s first prime minister at its next meeting. The meeting is being held on Wednesday, April 20 at 7:30 p.m. in the New Westminster Public Library auditorium. The historical

society is welcoming Terry Julian to the meeting. Local author Terry Julian has written a wonderful book on the story of Sir John A. Macdonald, first prime minister of Canada – a figure powerfully linked to the formation and early development of this country. The book, An Ordinary Miracle: John A Macdonald, chronicles his life including a visit to the Royal City. This biography, published in 2010, notes “much that is generally unknown in John A Macdonald’s heroic life is revealed and shows an energetic and visionary person in whom every Canadian should be knowledgeable.” Julian has written a number of books, with one on New Westminster’s loss of the capital city status, A Capital Controversy, being a favourite local history publication. The program is free and everyone is welcome. There is no need to preregister.

If you have paper that needs to be shredded, bring it on by,” Bailey said. “They will have a truck on site. They will take your paper and shred it immediately.” The charitable society requests that people bringing large amounts of paper to the shredathon bring it in a recyclable box. “Last year we raised about $4,000,” Bailey said. “We are hoping to raise more than that this year.” Tax receipts are available for donations of $25 and over. Cash and cheques are accepted. Bailey notes that it can be costly to have paper shredded professionally so the event is a good opportunity to save money and help a good cause. A local independent church has found both a new home and a possible new sideline. Five Stones Church first began offering services at Douglas College six years ago after a pastor named Rich Kao moved here with his family from Minnesota. It has since relocated to an old warehouse at 612 Columbia St. that will soon be pulling double duty as an art gallery. “It’s a Victorian warehouse, and we’ve renovated it and upgraded it,” said Kao. “Through a series of circumstances, we had some people from the arts council come into our facilities. They just said, you know what, this would make for a really neat satellite art gallery.” It wasn’t all that long ago that the only visitors the seemingly forgotten building probably saw were pigeons, spiders or rats, but the beautifully renovated site, affectionately known as “612” for its street address, is poised to become a bit of a hot-

spot for church goers and art lovers alike. “You could take two steps out of Starbucks and literally walk right past the front door, but once you get inside the church facility, it’s been totally remodelled, and it has this kind of historic feel. We’ve got this very unique building to serve the spiritual needs of the city, but as well we have a vision to be a community church and to build up the whole feeling within New Westminster, so the connection with the arts council is a really fun deal for us.” The new arrangement happened by chance after the Downtown Business Improvement Association invited a group of Quayside residents on a tour of Columbia Street. “From that tour, all we heard from people who went on that tour was, ‘Holy hell, did you hear about the Five Stones Church? Because everyone who was at Royal City Musical Theatre’s premiere weekend of The Will Rogers Follies undoubtedly went home singing (and maybe even dancing). For those who haven’t yet seen it, Royal City Musical Theatre has once again come up with a winner. I caught the show in preview on Friday evening and, like the rest of the audience, was engaged from the first moment. All it took was the entrance of Matt Palmer in the title role – with his winning smile, his down-home drawl and his engaging manner – and we were already predisposed to have a good ol’ time. Next year’s Burnaby Winter Club AAA bantam just couldn’t wait for 2012 to get it done. The winter club Bruins, with six first-year players in its lineup, upset the Manitoba champion Winnipeg Hawks 3-2 in overtime en route to a third Western Canada bantam hockey championship in Winnipeg on Sunday. Second-year forward Victor Dombrovskiy scored the game-winner with his first goal of the Western championships six minutes into overtime. “I knew when I picked this team, I thought this team was pretty special,” said John Batchelor, who earned his third Western title as head coach of the winter club. “They had the character, they had the attitude and they didn’t disappoint.” Winnipeg held a 2-1 lead heading into the third period after Burnaby’s Justin Szeto had opened the scoring in the first minute of play in the goldmedal final. First team all-star Matthew Barzal tied the game midway through the final frame on assists by Dombrovskiy and Szeto. Barzal was also named the top forward in the tournament. Dombrovskiy and winter club goalie Nicholas McBride were also named to the all-tournament first team. The Western banner was the third in 10 seasons

Burnaby South Secondary’s Melvin Arciaga won the boys’ 50-kilogram wrestling title at the Canadian national cadet championships in Windsor, Ont. Saturday. Arciaga, fighting out of the Raw wrestling academy in Vancouver, defeated Matthew Dignan of Abbotsford 7-2 in the championship final match. Arciaga, this year’s provincial high school champion, won five straight matches, including two bouts by pins, to earn the gold

medal at the nationals. Schoolmate Andrew Warren won a bronze medal in the cadet boys’ 66kg division. Warren lost his opening bout on a technical decision to eventual national champ Caleb Rutner of WWC. Warren then won his next five matches to take third place with a 16-10 decision over Ben Christopher of NCWC. He also won two of his backdoor matches by pins. Burnaby Central heavyweight Amar Dhesi won gold in the cadet boys’ 100kg weight class. Dhesi beat four other oppo-

nents in a round-robin wrestleoff. Dhesi blanked three of his opponents, winning all three by technical decision. His bout with Ron Liena of Black Bear was stopped because of injury. Another Central grappler, Saheel Khan, was a runner-up in the national juvenile championships, winning a silver medal at 100kg. Khan lost 2-0 to gold-medal winner Aaron Misner of the Jr. Marauders club in the juvenile men’s final in Windsor on Friday. Khan defeated Lewis Biamonte of Edmonton 2-1 in the semifinal

and Stewart Kyle of Team Impact 4-1 in the quarter-finals. St. Thomas More Collegiate’s Clarisse Dos Santos placed in the top six at the cadet girls’ nationals. Dos Santos lost to eventual bronze medallist Eugenia Gokhman by a fall in her opening bout. She then split her three remaining matches in the repercharge, losing two by falls although leading on points in both matches. Adib Jaber and Azra Iviziku of Burnaby South were both one win away from placing in their respective divisions at the nationals.

The South Burnaby girls, with three returning players from last season’s provincial championship squad, were a perfect 14-0 in league play and swept the opposition in the playoffs. Head coach to give clinic

Shasta medals at provincial gym champs in Langley Benjamin Blais and Liam Doherty showed the future of the Shasta Trampoline Club at last week’s provincials. Ben won both the novice 11 to 14 boys’ trampoline and double-mini tramp at the B.C. Gymnastics championships in Langley. Liam finished runner-up to Ben in the double-mini and third on the trampoline. Jordan Wilmshurst won the 15-and-over novice boys’ tramp and placed runner-up in the doublemini. Shasta teammate Tyler Edwards also medalled behind Wilmshurst, finishing second on trampoline and third on DMT. Matthew Bloudov, Clayton Moench and Connor Doherty also placed well in the novice division. Connor Doherty finished runner-up in the men’s open double-mini competition. Duncan Blais followed suit, winning the men’s A

trampoline, while also finishing second on doublemini. Andrew Rae placed first and second on the men’s B tramp and DMT, respectively. Kirill Yurtsev placed in the top six on both disciplines. Declan McLean was third in the men’s C DMT. Olivia Bortolazzo was also a double winner, placing first in senior women’s double-mini and first in the open women’s trampoline. Anita Cirillo won the senior women’s tramp, while younger sister Carolina took top spot in the 15-and-over novice girls’ tramp. Shannon Comeault won a bronze in the open women’s trampoline. Caitlin Harrigan won the women’s C doublemini division. Amanda Wright finished in third place in the women’s C trampoline. Clare Hardjowasito was fifth on both trampoline and double-mini. He’s No. 1: Burnaby’s Ryan Nugent-Hopkins was named NHL Central Scouting’s top draft-eligible prospect in the final rankings, which came out on Monday. He was rated third overall in the mid-year rankings.

He could go first in NHL draft Burnaby product Ryan NugentHopkins was made the top-rated drafteligible North American prospect by NHL Central Scouting on Monday. The North Burnaby product, who will celebrate his 18th birthday this week, was moved up from third overall among domestic skaters in the midterm rankings in January. Nugent-Hopkins finished his second season with the Red Deer Rebels of the Western Hockey League third in overall

scoring with 31 goals and 106 points. He finished the regular season winning the WHL player of the month in March, piling up 11 goals and 19 points in his final eight games for the Rebels. Nugent-Hopkins was the WHL’s rookie of the year last season. Also among the top 100 domestic skaters was Luke Lockhart of Burnaby. The Seattle Thunderbirds captain was listed 68th by Central Scouting in the year-end rankings.

Former NBA Seattle Supersonics head coach Tom Newell will be coming to Douglas College to give a two-day basketball clinic in May. Newell, who also had NBA coaching stops in Dallas and New Jersey will take part in a coaching clinic and players camp on May 7 and 8 at the Douglas College campus in New Westminster. Newell has also coached in Greece, Russia, Ireland, Belgium, Korea, Venezuela, Spain, China and the Philippines. He currently is an instructor in FIBA’s Olympic development program. The coaching clinic will be held from 9 a.m. to noon, followed by a player’s camp from 1 to 4 p.m. on both days. The player’s camp is open to both boys and girls aged 11 to 17.
