Jones sworn in as judge BY HOWARD ARCENEAUX Special to the Advocate

CLINTON — Twentieth Judicial District Court Judge George “Hal” Ware Jr. officially handed his gavel to Kathryn E. “Betsy” Jones, who was sworn in as the new judge Friday in the recently renovated courthouse. After administering the oath of office to Jones, East Feliciana Clerk of Court David Dart announced, “Ladies and gentlemen, it is my privilege to introduce Betsy Jones, judge of the 20th Judicial District.” Jones thanked the audience, saying the yearlong campaign leading up to her Nov. 4 election was a humbling experience, and she vowed to work tirelessly in her new position. She defeated fellow Democrat Sydney Picou Walker by 13 votes, 6,299 to 6,286, and she praised Walker, who was at the ceremony, for the high level of ethics during the campaign. She then thanked her husband, family and close friends for helping during the campaign and made a promise. “I’m going to continue to strive to make the best place to live in the world even better for

all of us,” Jones said. The 20th Judicial District covers East and West Feliciana parishes, and Ware, who has served as Division A judge for 18 years, during brief remarks, advised Jones to “keep your sense of humor and don’t make common sense a stranger.” Ware was generous with his “thank-you’s” and included the many staff members and courthouse employees he worked with over the years. Judge William Carmichael, who presides over Division B, recognized Ware’s nearly 40 years of service as a public defender, district attorney and judge. “No one could be easier to work with,” Carmichael said. “Hal, from all the people in this district and all the people who you treated fairly, thank you.” Ware said he plans on “doing as little as possible” and will work in his machine shop and continue to teach machine shop classes at the Louisiana State Penitentiary at Angola. He said he will pursue hobbies such as building radio-controlled airplanes, target shooting and skeet shooting. Jones’ first day will be Jan. 1.

Power tools, twoby-fours bracketed together in odd shapes and plywood lie about a makeshift work area as daughter and father work side by side constructing a gift for the little ones in their family. Stephanie Ferguson and her father, Glen Ferguson, are making a kid-powered “squaris wheel” — dubbed by its original designer because of its square wheel. The pint-sized version of a Ferris wheel is braced to be as sturdy as possible. Each time the square wheel goes around, each passenger gives the wheel a backward push with his or her feet. The bucket seats pivot and have a safety bar across the front, just like a Ferris wheel, keeping small riders safe. Stephanie Ferguson said she first approached her dad about the idea after seeing a photo of the vintage ride on a social media site. She searched the Internet until she found the plans for building the wheel and secured her dad’s help with the project. “I wasn’t too concerned that we wouldn’t be able to do it, because he is great at fixing and building things,” Stephanie Ferguson said. She said the two projects are the latest examples of how engaged the PTL is with the school on a regular basis. The president is Stephanie Ferguson. “We have an all-new board this year, and they help do anything we need them to do,� Cochran said. “They provide us with manpower and money.� Other projects the Bains PTL has helped with include

ice cream socials, nacho days after the students complete state-required testing, and fund-raisers, including book fairs and the box-top program. They also provide teacher appreciation programs, and each year, they give Christmas gifts to faculty and school employees. “They put in hours the staff can’t and help with everything like filing papers and making copies — things the teachers don’t have time to do,� Cochran said. “They are also very big in getting parent participation. They are like our cheerleaders, and they’re good at spreading the word. I couldn’t do a lot that I do without them. They support us financially, and they help with anything and everything. We’re lucky to have them.�

Continued from page 1G were outdated. “That’s when we knew the design and plans were probably really, really old,� Stephanie Ferguson said. “So, we sort of winged it.� As if constructing one square Ferris wheel wouldn’t be difficult enough, they realized that with two households of Ferguson children, they’d have to build two square Ferris wheels. “We figured if we could successfully build the one, we’d be able to pull off making another one much easier and faster,� Glen Ferguson said. “I got this idea in my head, and I was determined to see it through, but honestly, I have never built anything before this, never used a power tool before,� said Stephanie Ferguson. The five young children in Stephanie’s and Glen’s lives — her great-nieces and nephews and his great-grandchildren — have no idea what their elders have been doing. The Ferguson children will be surprised with the squaris wheels on Christmas Day. The children — Micah , 4, Baleigh, 2, and Jude, 1 — are Michael and Sharon Ferguson’s, while Aralynn, 4, and Avynn, 2, are the children of Joseph and Marcia Ferguson. According to Stephanie, the mini-carnival rides are large enough for eight small children

to ride. Two children can fit into one of the bucket seats, which are fastened with bolts for safety and painted in vintage green, red and yellow colors. The Fergusons have worked on the project every spare second when Stephanie Ferguson hasn’t been working at her day job as an accountant. Because she lives near her parents in Ethel, getting to the work area has been easy enough. Her quest to create the ultimate Christmas gift for the children turned into something greater, a chance to bond with her father over the Christmas spirit of giving. “I feel a great sense of accomplishment in working with my dad on this project. He is a master of all types of things and can do practically anything,� Stephanie Ferguson said. She said that in the past her dad handed down his knowledge to her four brothers — Glen Jr., Mike, Steve and Jeff — but now he has passed some of his wisdom to her. She said she hopes the memories of building the squaris wheels will return when she needs to complete a project on her own. Stephanie Ferguson admits children can be unpredictable at times, so she’s been unsure of their reaction to the odd gift. “I just hope we can see the magic of Christmas in their eyes when they see what we built for them and they’ll know how much we love them,� she said. “After all, Christmas is for kids.�

The students learned new sports skills and improved individual sport performance. Participants also learned about individual and team sports and built friendships. St. Helena Parish School System’s Chief of Innovation Donna Reno said it has been more than 10 years since Special Olympics has been in St. Helena Parish and was excited for the students to have the opportunity again. “We plan to compete in the regional games this spring where our athletes will compete with other athletes from surrounding parishes. In the near future, we will incorporate the inclusive Unified Games where students with and without disabilities will train and compete together,� Reno said. “Special Olympics will only get bigger and better in St. Helena Parish and we are ready for all of our athletes to show off their abilities and bring home some ribbons.� “We were very excited for our students who participated, and very proud of the administrators and teachers who helped facilitate the event,� Superintendent Kelli Joseph said. “We strive to include all of our students and provide them with opportunities to be successful in and out of the classroom.� Special Olympics Louisiana provides year-round sports training and athletic competition in a variety of Olympictype sports for all children and adults with intellectual disabilities, giving them continuing opportunities to develop physical fitness, dem-

Advocate staff report What do you get when you bring together adult education students, parents of Early Head Start and Head Start children of the West Feliciana Family Services Center for a nutrition program? You get a nutrition series filled with lessons, activities, games, tastings and food demonstrations, said Layne Langley, LSU Agricultural Center nutrition agent, who conducts the program. For the past three months, the adult education class at the Family Services Center in St. Francisville has been learning about the MyPlate nutrition guide and the five food groups, as well as why it’s important to make half of the food on their plates servings of fruits and vegetables, Langley said. MyPlate is the nutrition guide published by the U.S. Department of Agriculture. A food circle or pie chart depicting a place setting with a plate and glass divided into five food groups replaces the USDA’s previous pyramid food diagrams. Program participants were taught the benefits of switching to skim or 1 percent milk. “To extend the lessons, the students and parents participated in hands-on food demonstrations, made quesadillas, a fruit cobbler called Rise and Shine and a snack known as honey milk balls,� Langley said. The LSU AgCenter nutrition program met again Dec. 12 at Bains Lower Elementary. Displays bring out holiday spirit downtown Advocate staff report Several of Jackson’s historical buildings have received a holiday make-over. Charter Street Studio, the Gumbo Kitchen and the Pipes McKowen Building have been transformed, the buildings’ windows decorated with intricate window displays and twinkling lights. Three East Feliciana residents — Connie Hoffman McMillin, of Jackson; P.H. Price, of Clinton; and Faye Hoffman Talbot, of Jackson — added the holiday accoutrements to the buildings on Charter Street. Talbot said the Gumbo Kitchen has been decorated with holidaythemed china figurines while Charter Street Studio has been trussed up with Christmas village scenes and has a 3-foot tall nativity scene in its attic, which can be seen from the street. “In the Pipes McKowen Building, the windows seem to magically come to life with vintage toys, teddy bears and dolls,” Talbot said.

Talbot and McMillin, sisters, and Price, a friend, said they took it upon themselves to decorate the windows. The sisters belong to the Jackson Assembly, which owns the buildings. Talbot gives credit to Jackson resident and artist Donna Kilbourne, who decorated the windows of Pipes McKowen last year. “We decorated Charter Street Studio last year and decided to expand to the Gumbo Kitchen this Christmas. When we heard Donna couldn’t decorate the Pipes McKowen building again, we decorated those, too,” Talbot said. Talbot said the Gumbo Kitchen and Pipes McKowen buildings are empty, except during the Jackson Assembly Antique and Art show in March, so the friends thought “it would be a fun thing to do.” The three are Baton Rouge natives who relocated to East Feliciana, Talbot said. “We all love the area and wanted to share our Christmas cheer,” Talbot said.

Getting caught up in the chaos of Christmas makes it easy to lose sight of what’s really important: family, friends and others around us. When we ask the question “how are you?” of others, are we really expecting them to answer us truthfully? Are we truly prepared for them to tell us how they are, what they’ve been doing or what their issues are? Or has the question become so perfunctory, we’re not expecting anyone to really answer us at all except to say, “I’m fine, I’m good, and you?” with both parties going about their merry ways. Recently, while grocery shopping, this happened to me. I asked this question of someone I barely know but who had taken the time to approach me to extend pleasantries. “Hey, how are you, how’s it going?” I asked, unsure of what to say. “Not so good. It really hasn’t been a good year for my family. We lost a loved one, and it’s been really difficult,” they replied. I was completely unprepared, jolted out of my little reverie, because I never expected this person to truly tell me how they were. I did ask the question after all, but what was I expecting? If I wasn’t prepared for the answer, then why ask the question? My theory is that we’ve become preoccupied with self, so busy with our lives, we’ve grown oblivious of others and what’s going on with them. It’s not that we don’t care; we do. Maybe we’ve just become so

Editor’s note: Jazz Ferguson will be featured in an upcoming sports column in The Advocate Extra. When Ryan Reed and Jazz Ferguson left for Shreveport by bus last week to play in the Louisiana High School Coaches Association EastWest All-Star game, the two West Feliciana Saints were beginning the final chapter of a long and remarkable story as football teammates. “We’ve been playing together since pee-wee football, 11 or 12 years ago,” Reed said. “He came to school here in sixth grade, and we hit it off immediately. We both played football and baseball, the same positions, and we just began working together and became friends. He’s someone I grew up with, and we’ve been teammates for a long time.” That familiarity was evident as their team enjoyed a remarkable football season this fall. Reed was quarterback for the Saints, and Ferguson was his No. 1 target at wide receiver. They also played in the defensive backfield together. The Saints earned a fifth seed and had a remarkable run in the Class 3A playoffs, losing to eventual champion and top-seeded Livonia 23-15 in the semifinals. They concluded the season with an 11-3 record. With the final snap of last Saturday’s game at Independence Stadium, Reed’s and Ferguson’s football careers

likely will diverge down different paths beginning next year. Ferguson, 6-foot-5 and 205 pounds, has committed to play for LSU next fall. He’s currently on the Saints basketball team, and he’ll play baseball in the spring. Reed is a versatile athlete as well. He’s been a standout as a quarterback and defensive back. The 6-foot-1, 180-pounder has received offers from Northwestern State to play “wildcat” quarterback, defensive back and kick returner and to play defensive back at Nicholls State. He’s also had strong interest from Southeastern Louisiana, Louisiana Tech and Southern Miss. More schools will certainly recruit him after the all-star contest. “I’ll decide in January which five schools I’m going to visit; then I’ll make my final decision after that,” said Reed, who plans to study civil engineering in college. He also plays sweeper, a defensive position, for the West Feliciana soccer team. He’s the starting shortstop and a top-of-the-lineup hitter for the Saints baseball team who throws right and bats

left. This spring, he’ll also be a sprinter on the track team, running the 100 and 200 dashes and the 4x100 and 4x200 relay teams. Last year, in a first-round playoff game against Marksville, Reed broke his leg, but the injury didn’t slow him down for long. He missed soccer season and didn’t run track, but he played every game in baseball. He still has a couple of screws and a rod in his leg, but that hasn’t slowed him down. “I’m actually faster now than I was before I broke my leg,” said Reed, who estimates he’s picked up a tenth or two tenths of a second in the 40yard dash. Reed said he and Ferguson will play baseball together, and they’ve talked about the possibility of playing college football on the same team. “I’d consider it, but when I get an offer and I make a commitment, I’m not going to decommit, I’m going to stick with it,” Reed said. Instead, they might find themselves on opposite teams in the future, and Reed would know what to expect. “Everything’s competitive with Jazz,” Reed said with a laugh. “We go at it. We even play games with apps on our cellphones, competing against each other. I’d know what to expect.”

The squad performed with the National Cheerleaders Association and the National Dance Alliance. They made the trip after winning the Game Time Top Team Award at summer camp. Silliman representative Katy Hayes said it was the second year the school was invited to the event. The Silliman cheerleaders joined more than 830 performers from 41 states at Disney’s Coronado Springs Resort at Walt Disney World on Dec. 3-8 to perform in the Disney Parks Frozen Christmas Celebration, a “Frozen” twist on the 31st annual telecast airing at 9 a.m. Thursday on ABC. This year’s Christmas special, hosted by Louisiana native Robin Roberts, of ABC’s “Good Morning America,” is inspired by the blockbuster movie “Frozen,” about uniting family and loved ones, Hayes said. Roberts will telecast from Disney World in Florida with support from Tim Tebow, GMA contributor and ESPN/ SEC network analyst. “This was a great experience for the Silliman cheerleaders,” Hayes said. “They are grateful to everyone who supported them in making this dream come true.”

REQUEST FOR RELEASE OF FUNDS On or about January 13, 2015 the Village of Wilson will submit a request to the Louisiana Division of Administration for the release of FY 2014 Public Facilities Improvements funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as FY2014 Water Improvements for the purpose of the construction of a new water well for the Village of Wilson. This project will be to design and construct a new 300 gpm potable water well and 8-inch water line connecting the well to the existing system. The existing well is older and running at 60% capacity. If it should fail, the Village does not have a back-up water supply. Construction of the new well will provide the Village with a reliable water source to serve the current residents and account for future growth. The new well will be located at the intersection of Hwy. 68 (Grant Street) and Poplar Street. The water line will be in existing ROW. It will be directionally drilled down Poplar Street and tied in at Virginia Street. The well will service the corporate limits of the Village as well as additional customers outside the limits. All residents in the Target Area will benefit from this project as the Village will have an acceptable water well meeting the EPA’s Standards and Guidelines. Available ground water shall be pumped and disinfected before use by the public. The grant funding amount is $698,500.00. Total project cost is approximately $819,600.00. FINDING OF NO SIGNIFICANT IMPACT The Village of Wilson has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Village of Wilson Office, 6528 Sycamore Street, Wilson, LA and may be examined or copied weekdays 8:30 A.M. to 4:00 P.M. Mayor Bellue reminded everyone that we have applied for 2 new units through Pennington and advised that we wait until December when those grants are awarded before any decisions are made. This matter was tabled. Christmas with a Cop was discussed. Chief Nevels will be talking to his volunteers to try to set that up. There was some discussion about the body cameras that we have been using on a trial basis for the last couple of weeks. A motion was made by Ald. Jelks and seconded by Ald. Duncan to purchase 3 of the cameras. 2. Fire Report – Fire Chief Jimmy Garig gave the monthly report, expressing his gratitude that the tax renewal had passed. There were several classes held in Oct. Chief Garig said that when the hydrant work is completed, there will be 38 hydrants in town. There will be water shuttle practice and a fire safety class for children held at the fire station on 11/29. 3. Gas Report – Jimmy Garig gave the monthly activity report. 4. Maintenance Report – Mayor Bellue reported that the police jury has cut around the oxidation pond, on Pine Street and on Honeysuckle Street with the side cutter. She is still working on quotes for the tank inspection that she expects to get done in the Spring 5. Article II, Planning Districts, Section 21, Table C, Parish of The West Feliciana Planning and Zoning Ordinance is hereby amended to reflect below as follows: Allowable uses for the Planned Unit Development District (PUD) shall include all designated uses specified for Neighborhood Commercial Districts (C-1), General Commercial Districts (C-2), Professional Districts (P-1), and all Residential Districts (R-A, R-1, R-2, R-3, R-4, T-R, A-R, M-R). The risk of interruption was not acceptable to our State customers and would greatly impact our residential customers. For these reasons, the Finance Committee recommends approval the blending agreement as presented and authorize Board President Kevin Beauchamp to sign the necessary document. APPROVAL OF AGENDA ITEMS FOR CONSIDERATION AND ACTION Mr. Percy offered a motion to amend the agenda to waive executive privilege with the exception of the executive session meeting earlier today as it pertains to the Lambert Lawsuit. This amendment to the agenda requires a unanimous vote. Seconded by Mr. Young. Upon a roll call vote, Young, Percy and Howle voted in favor of the motion. Kean, Wilson and Williams dissented. Mr. Lambert abstained. Motion failed. Mr. Kean asked that item 10.C.x. be removed from the agenda. Upon a motion of Mr. Percy, seconded by Mr. Wilson, the Council unanimously approved the agenda with the exception of item 8.E. which was added after the 144 hour deadline. Upon a motion of Mr. Percy, seconded by Mr. Lambert, the Council approved agenda item 8.E. 7. APPROVAL OF PARISH COUNCIL MINUTES Mr. Lambert offered a motion to approve the minutes from the special meeting of August 27th and the regular meeting of August 18th, 2014 as written. Seconded by Mr. Percy. Discussion ensued on the status of the minutes of the June 23rd special meeting and the minutes of the July 21st regular meeting. Ms. Williams made a substitute motion to approve the minutes with the addition of the four (4) comments or statements in the minutes of the August 27th special meeting. Discussion ensued prior to the vote referencing a state law of the requirements for inclusion in the minutes. Upon a roll call vote, Wilson, Williams, Young and Howle voted in favor of the motion. Casting the only dissenting vote was Percy. Lambert and Kean abstained. Motion carried. 8. PUBLIC HEARING At 5:47 p.m., Mr. Percy offered a motion to enter into public hearing. Seconded by Mr. Young. There were no objections. Motion carried.

The Chair read aloud the following ordinances: Ordinance No. 2014 September 15 – 1 establishing the Office of the Assistant Secretary; Ordinance No. 2014 September 15 – 2 for oil and gas well registration and Ordinance No. 2014 September 15 – 3 for settlement of pending litigation entitled “(Lambert Gravel Company, Inc., et al v. Parish of West Feliciana, et al)�. The Council posed questions to the staff regarding the oil and gas well registration ordinance and public comments were made at length on Ordinance No. 2014 September 15 – 3. [A summary of the ordinances named above were previously published in the August 13th, August 27th and September 3rd, 2014 editions of the Official Journal, the St. Francisville Democrat, respectively.] 8.D. – 8.E. The Chair read aloud and introduced an ordinance to set new water hook-up and user rates and the ordinance on the Independence Sewer. The ADA recommended an amended to the ordinance to set new water hook-up and user rates by adding, “or any part thereof� under Usage for both Residential and Commercial to read, “$3.50 per 1,000 gallons or any part thereof over minimum.� [A summary of the ordinances were published in the September 24th, 2014 edition of the Official Journal, the St. Francisville Democrat.] At 6:36 p.m. Mr. Percy offered a motion to end the public hearing and return to regular session. TAKE ACTION DEEMED NECESSARY Action noted above. NEW BUSINESS 9.A. OFFICIAL JOURNAL Dan Shea, President/COO of The Advocate and Fred Kalmbach, Managing Editor representing Capital City Press (Morning Advocate) gave a brief presentation on the future of the St. Francisville Democrat going forward and its desire to maintain community relations. 9.B. PLANNING & ZONING COMMISSION 9.B.i. Public Hearing At 6:54 p.m., Mr. Percy offered a motion to enter into public hearing. Seconded by Mr. Kean. There were no objections. Motion carried. Planning Administrator, Jim Ferguson was in attendance and presented the

Ms. Howle stated that she attended the P&Z meeting and there was talk about the roads and that it meets parish standards for subdivisions. She continued then asked what is the width of the street for Catalpa Plantation to which the Administrator responded 16 ft. She then referenced the Subdivision Regulation as being 20 ft. Mr. Young stated that there have been subdivisions with four and five lots that were told they had to put in adequate roadway and were turned down because they couldn’t do the roads [meet the road requirement]. He mentioned another instance where there was issue with school buses and private roads. Developer, Greg Ferris explained that this is a 9 Lot Subdivision with a turnaround at the end and the road will never be extended so with the amount of traffic they feel that 16 ft is sufficient. He also concurred with the Administrator’s recommendation and asked the Council for approval. He concluded by referencing the Comprehensive Plan in support of his request to allow 16 ft rather than 20 ft. Mary Godke, Planning and Zoning Chair, stated that is my [her] understanding that we [the Planning and Zoning Commission] don’t have the ability to grant a variance. That goes to the Board of Adjustment. We can grant what’s in our ordinances which is 20 ft and much discussion was had on that but asked the ADA for guidance. She believes that we [P&Z] cannot vary from the ordinance. She concluded by asking the developer to go before the Board of Adjustment and ask for a variance or comply with the 20 ft. The ADA concurred with Ms. Godke by responding that “she is right.� Mr. Ferguson’s final recommendation to Council is to approve the proposed 9 Lot Subdivision requiring the 20 ft. as stated in the current ordinance and that the Development goes before the Board of Adjustment for a possible variance.

The ADA asked the Chair to read aloud the recommendation from P&Z which did not specifically stipulate anything on roads. At 7:10 p.m. Mr. Percy offered a motion to end the public hearing and return to regular session. Seconded by Mr. Young. There were no objections. Motion carried. Mr. Percy made a motion to accept the recommendation of Planning and Zoning for Catalpa Plantation. Mr. Kean made a substitute motion to accept P&Z’s recommendation subject to the public standards on roads of 20ft. Seconded by Mr. Wilson. Discussion ensued and Mr. Kean was made aware of a possible conflict of interest. Ms. Williams then made the substitute motion. Seconded by Mr. Wilson. Upon a roll call vote, Percy, Young, Lambert, Wilson, Williams and Howle voted in favor of the motion. Kean abstained. Motion carried 6-0-1. 9.C. 2014 – 2015 BUDGET REVISION NO. 1 The Council deferred action on this item to the Finance Committee for a recommendation. Mr. Percy resigned from the Lambert Lawsuit Committee effective immediately. For the record, Mr. Lambert then informed the Chair that he will step down as a member of the Finance Committee. 9.D. INSURANCE COVERAGE The ADA explained that about fifteen years ago the then-Police Jury adopted a uniform set of insurance requirements for anyone who contracts with the Police Jury which includes

Wilcox d/b/a Wilcox Chevron, LLC. OLD BUSINESS 10.A. BOARD/COMMISSION APPOINTMENT Mr. Lambert made a motion to reappoint Mr. Shane P. Landry to the Board of Adjustment. Seconded by Mr. Percy. Ms. Williams entered a substitute motion to appoint Mr. Charles Griffin. Seconded by Mr. Kean. Upon a roll call vote, casting votes in favor of the substitute motion were Williams and Kean. Casting dissenting votes were Percy, Young, Lambert, Wilson and Howle. Upon a roll call vote in favor of Mr. Shane P. Landry, the Council unanimously reappointed him to serve a two year term according to the Home Rule Charter. Mr. Young nominated Mr. Jessie Van Gilmore to serve as his appointment to the Planning & Zoning Commission. Mr. Wilson entered a motion accepting Mr. Young’s nomination. Seconded by Ms. Williams. Discussion ensued upon whether a resume was required according to the Home Rule Charter. One applicant provided a letter only and the other applicant provided both the letter and resume. The ADA also interjected regarding the actions of the Council. Mr. Wilson offered a substitute motion to defer the appointment until a later date. Seconded by Mr. Kean. Further discussion ensued. LAMBERT GRAVEL COMPANY, INC. AND THE SUCCESSION OF PAUL A. LAMBERT, SR. V. PARISH OF WEST FELICIANA, SUIT NO. 21774 20TH JDC, PARISH OF WEST FELICIANA, STATE OF LOUISIANA i. – iii. Ms. Williams along with persons making public comments discussed these items at length pertaining to the named subject matter. No action was taken by the Council. iv. Ms. Williams asked Mr. Charles Griffin to speak. He [Charles Griffin] stated if you want to be clear to the public and transparent you need to go back and change the zoning of that area as it was on the original map that was approved by the original Planning and Zoning. And that was there was only a sliver on the riverfront that was C-3. Everything else was R-A. And if there was something there that was not conforming then it was a NonConforming use grandfathered in. But that whole area was not zoned in by the Planning and Zoning. Somebody went in there and changed it and they didn’t follow the process. So once y’all get the ownership of that property straight then they can go forward and do what you are supposed to do, follow the rules and have the public hearings and so forth to ‌ somebody just drawing it in is a problem because when you talk about why businesses don’t come here, it wasn’t because of the original zoning map it’s because people can go in there and do things like that and it depended on who they are and who they know. And it’s the same thing y’all said about the roads, it’s not the fact that

I [Ms. Williams] have gone on record as saying to all of y’all the person that was ended up being our mediator was an attorney that I worked for, I [Ms. Williams] was his legal assistant. And I said I don’t think we should use him and that’s very expensive I [Ms. Williams] don’t think we should be doing the mediation. From what I [Ms. Williams] could understand, everyone thought the mediation was not necessary and a waste of time. We were ready to go to court and we postponed it all for some reason to go through all the settlement negotiations. Fooling with the settlement has been very expensive. Now the attorney’s have contacted me because I [Ms. Williams] have to give my deposition and they had to go through all my information. But when we were initially on this, we worked closely … Mr. Hashagen and the Council with our attorney. We had all the information gathered. And that was the only place the attorneys had to get the information from. So if we would let the attorney who is willing to do it for $20,000 or on a pro-bono matter, we would not be having this huge expense. We have a set amount that he said he would charge us. Twenty thousand or if we just simply could not afford it he would do it on a pro-bono basis.

PUBLIC NOTICE The following ordinance was offered for adoption by Larry Beauchamp and seconded by Dennis Aucoin: ORDINANCE An ordinance providing for the levy within the Parish of East Feliciana, State of Louisiana, (i) effective January 1, 2015, of a three-fourths of one percent (3/4%) sales and use tax, (ii) effective January 1, 2015, of a one-fourth on one percent (1/4%) sales and use tax and (iii) effective January 1, 2015, of a one percent (1%) sales and use tax upon the sale at retail, the use, the lease or rental, the consumption, and the storage for use or consumption, of tangible personal property and upon the sale of services in said Parish, levying and providing for the assessment, collection, payment and dedication of the proceeds of such taxes and the purpose for which the proceeds of the taxes may be expended, such taxes having been authorized at a special election held in the Parish on December 6, 2014. WHEREAS, under the provisions of Article VI, Section 29 of the Constitution of the State of Louisiana of 1974, and other constitutional and statutory authority and an election held on December 6, 2014, the Parish of East Feliciana, State of Louisiana (the “Parish”), acting through the Police Jury of the Parish of East Feliciana, State of Louisiana, as its governing authority (the “Governing Authority”), is authorized to levy and collect within the Parish (i) from and after January 1, 2015, a three-fourths of one percent (3/4%) sales and use tax (the “3/4% Tax”), (ii) from and after January 1, 2015, a one-fourth of one percent (1/4%) sales and use tax (the “1/4% Tax”) and (iii) from and after January 1, 2015, a one percent (1%) (the “1% Tax”) (said taxes being collectively referred to as the “Taxes”) each for a period of ten (10) years, upon the sale at retail, the use, the lease or rental, the consumption, and the storage for use or consumption, of tangible personal property and upon the sale of services as defined in applicable statutory authority, pursuant to the following propositions which were approved at said election held on December 6, 2014: PROPOSITION NO. 1 (3/4% SALES TAX RENEWAL) Shall the Parish of East Feliciana, State of Louisiana (the “Parish”), under Article VI, Section 29 of the 1974 Louisiana Constitution and other constitutional and statutory authority, be authorized to levy and collect a tax of 3/4% (the “Tax”) upon the sale at retail, the use, the lease or rental, the consumption, and the storage for use or consumption, of tangible personal property and on sales of services in the Parish (an estimated $862,500 reasonably expected at this time to be collected from the levy of the Tax for an entire year), for ten (10) years, commencing January 1, 2015, with the proceeds thereof (after costs of collection and administration) to be used to provide, maintain, operate, construct, acquire and/or improve solid waste disposal facilities and services and to contribute to the maintenance of the reserve equal to one year’s operating expenses for solid waste purposes as determined by the prior year’s Parish’s Solid Waste Fund financial statement and any proceeds in excess of the above purposes to be used as follows: (i) 50% to the Parish’s General Fund and (ii) 50% to the Parish’s Road and Bridge Fund for any and all road and bridge purposes, including equipment therefor? PROPOSITION NO. 2 (1/4% SALES TAX RENEWAL) Shall the Parish of East Feliciana, State of Louisiana (the “Parish”), under Article VI, Section 29 of the 1974 Louisiana Constitution and other constitutional and statutory authority, be authorized to levy and collect a tax of 1/4% (the “Tax”) upon the sale at retail, the use, the lease or rental, the consumption, and the storage for use or consumption, of tangible personal property and on sales of services in the Parish (an estimated $287,500 reasonably expected at this time to be collected from the levy of the Tax for an entire year), for ten (10) years, commencing January 1, 2015, with the proceeds thereof (after costs of collection and administration) to be used to provide, maintain, operate, construct, acquire and/or improve solid waste disposal facilities and services and to contribute to the maintenance of the reserve equal to one year’s operating expenses for solid waste purposes as determined by the prior year’s Parish’s Solid Waste Fund financial statement and any proceeds in excess of the above purposes to be used as follows: (i) 50% to the Parish’s General Fund and (ii) 50% to the Parish’s Road and Bridge Fund for any and all road and bridge purposes, including equipment therefor? Mr. Wilson acknowledged opposition to establishing fees to connect solely to the Independence Sewer System which does not include other systems in the parish and suggested action be postponed. 11.F. 2014 – 2015 BUDGET REVISION NO. 1 – LAMBERT LAWSUIT LEGAL FEES The Chair, Ms. Howle moved up this item prior to setting the date and time of the public hearing and removed ii. and iii. that is a part of the ordinance. She stated that the Finance Committee did meet and recommended that $200,000.00 be taken from the General Fund to cover expenses associated with the Lambert Lawsuit. In response to Parish President Couhig, Ms. Williams stated that we [the Council] have an attorney that I don’t think you [Mr. Couhig] could dismiss, maybe you [Mr. Couhig] can. We did not dismiss our attorney. He was the attorney we had of record. He is our attorney of record. He has offered to take this thing through to the Court of Appeal for $20,000 and if we could not afford it, he has offered to do it on a pro-bono basis. I [Ms. Williams] think Phelps and Dunbar is a magnificent firm, but it puts four, five, six attorney’s that we cannot afford. We cannot afford them. We know that we cannot afford them. The mediation was going to cost us a whole lot of money. We are having to pay an attorney $350 an hour, a $400 set-up fee, we could not afford that. In addition to that the mediation we had to have our attorneys spend a great deal of time gathering all this other information they had to provide, plus show up for the mediation for a

9. EXECUTIVE SESSION At 7:04 p.m., Mr. Kean offered a motion to enter into executive session not to exceed forty minutes. Seconded by Mr. Percy. There was no objection. Motion carried. At 7:36 p.m., the Council returned to the meeting place. Mr. Wilson offered a motion to exit the executive session and return to regular session. Seconded by Mr. Percy. There was no objection. Motion carried. The Parish President disclosed that the settlement that was negotiated with the Lambert’s, that agreement which was the basis for a settlement is not going forward. Furthermore, the mediation that we were ordered into by the Judge has failed. Where we are today is we are heading towards a lawsuit and towards a trial. During the mediation, we can up with an idea that I [Couhig] think is the basis for resolving every major problem relating to the current legal circumstance. I [Couhig] have proposed that the Parish begin the process of building a port by acquiring some property along River Road next to Tembec [d/b/a KPAQ]. There are a couple of different options. And we [the Parish] have proposed to the Lambert’s that our last and final offer as a settlement of this matter will be resolved by an exchange of their right, title and interest to the riverfront for the land we [the Parish]

NEW BUSINESS 10.A. PLANNING & ZONING COMMISSION Upon a motion of Mr. Percy, seconded by Mr. Kean, the Council entered a public hearing. I do not recall ever particularly observing the questioned entry. I could speculate but I do not know its provenance (how, when, what authority). Neither do I know who posted it to the map. Mr. Babers ended his previously submitted letter to the Council and stated that in all fairness to Charles, he has sent me [Mr. Babers] a letter and apologized for any … he has caused me [Mr. Babers]. And thanked the Council for allowing him to respond. Mr. Charles Griffin then read into the record his response letter which read as follows:

SECTION 12. Penalty for False or Fraudulent Return. Penalty as provided by La. R.S. 47:337.72 shall be fifty percent (50%) of the Taxes found to be due.

NOW, THEREFORE, BE IT ORDAINED by the Police Jury of the Parish of East Feliciana, State of Louisiana, acting as the governing authority of the Parish of East Feliciana, State of Louisiana, thereof, that: SECTION 1. Imposition. Pursuant to the authority of a special election held in the Parish of East Feliciana, State of Louisiana, on December 6, 2014, the Taxes are hereby levied upon the sale at retail, the use, the lease or rental, the consumption, and the storage for use or consumption, of tangible personal property, and upon the lease or rental of tangible personal property and on the sales of services in the Parish of East Feliciana, State of Louisiana, as defined by law. The Uniform Local Sales Tax Code, as enacted by Act 73 of the 2003 Regular Session of the Louisiana Legislature and as it may be amended, shall apply in the assessment, collection, administration and enforcement of the Taxes, the provisions of which are hereby incorporated by reference. The levy and collection of the Taxes will be a continuation of the similar sales and use taxes previously authorized to be levied by the Parish. SECTION 2. Rate of 3/4% Tax. The 3/4% Tax is levied at the rate of three-fourths of one percent (3/4%) of the sales price of each item or article of tangible personal property when sold at retail in the Parish, the 3/4% Tax to be computed on gross sales for the purpose of remitting the amount of tax due to the Parish, and to include each and every retail sale. The 3/4% Tax is levied at the rate of three-fourths of one percent (3/4%) of the cost price of each item or article of tangible personal property when the same is not sold but is used, consumed, distributed, or stored for use or consumption in the Parish, provided there shall be no duplication of the 3/4% Tax. The 3/4% Tax is levied at the rate of three-fourths of one percent (3/4%) of the gross proceeds derived from the lease or rental of tangible personal property, as defined by law, where the lease or rental of such property is an established business, or part of an established business, or the same is incidental or germane to the said business, or of the monthly lease or rental price paid by lessee or rentee, or contracted or agreed to be paid by lessee or rentee to the owner of the tangible personal property. The 3/4% Tax is levied at the rate of three-fourths of one percent (3/4%) of the amount paid or charged for taxable services, as defined by law, performed in the Parish. SECTION 3. Rate of 1/4% Tax. The 3/4% Tax shall be effective on January 1, 2015. The 1/4% Tax shall be effective on January 1, 2015. The 1% Tax shall be effective on January 1, 2015 SECTION 6. Term. The Taxes shall remain in effect for ten (10) years (the 3/4% Tax: January 1, 2015 through December 31, 2024; the 1/4% Tax: January 1, 2015 through December 31, 2024; the 1% Tax: January 1, 2015 through December 31, 2024). SECTION 7. Purposes. The proceeds of the 3/4% Tax shall be used for the purposes set forth in the proposition approved by the voters in the special election held in the Parish on December 6, 2014, authorizing the 3/4% Tax, the proceeds of the 1/4% Tax shall be used for the purposes set forth in the proposition approved by the voters in the special election held in the Parish on December 6, 2014, authorizing the 1/4% Tax and the proceeds of the 1% Tax shall be used for the purposes set forth in the proposition approved by the voters in the special election held in the Parish on December 6, 2014, authorizing the 1% Tax, which propositions are set forth in the preamble hereto. SECTION 8. Vendor’s Compensation. For the purpose of compensating the dealer in accounting for and remitting the Taxes levied by this ordinance, each dealer shall be allowed two percent (2%) of the amount of Taxes due and accounted for and remitted to the Parish’s collector in the form of a deduction in submitting its report and paying the amount due by the dealer, provided the amount due was not delinquent at the time of payment, and provided the amount of any credit claimed for taxes already paid to a wholesaler shall not be deducted in computing the commission allowed the dealer hereunder.

SECTION 9. Exclusions and Exemptions. The Governing Authority adopts none of the optional exclusions or exemptions allowed by State sales and use tax law, nor does this Governing Authority adopt any exclusions or exemptions authorized by legislation enacted under Article VI, Section 29 (D)(1) of the Constitution of the State of Louisiana of 1974, that are not allowed as an exclusion or exemption from State sales and use tax. Included within the base of each Tax is every transaction, whether sales, use, lease or rental, consumption, storage or service, with no exclusions or exemptions except for those mandated upon political subdivisions by the Constitution or statutes of the State of Louisiana, including the Act. SECTION 10. Interest. The interest on unpaid Taxes provided for by La. R.S. 47:337.69 shall be at the rate of one and one-fourth percent (1-¼%) per month. SECTION 11. Delinquency Penalty. The delinquency penalty, as provided by La. R.S. 47:337.70, shall be five percent (5%) per month on the unpaid

SECTION 13. Negligence Penalty. The penalty provided by La. R.S. 47:337.73 shall be five percent (5%) of the Taxes or deficiency found to be due, or ten dollars ($10.00), whichever is greater. SECTION 14. Penalty for Insufficient Funds Check. The penalty provided in La. R.S. 47:337.74 shall be an amount equal to the greater of one percent (1%) of the check or twenty dollars ($20.00). SECTION 15. Attorney Fees. The collector is authorized to employ private counsel to assist in the collection of any taxes, penalties or interest due under this ordinance, or to represent him in any proceeding under this ordinance. If any taxes, penalties or interest due under this ordinance are referred to an attorney at law for collection, an additional charge of attorney fees, in the amount of ten per centum (10%) of the taxes, penalties and interest due, shall be paid by the tax debtor. SECTION 16. Penalty for Costs Incurred. As provided by R.S. 47:337.75, and under the circumstances set forth therein, a penalty shall be added to the amount of Taxes due in an amount as itemized by the Collector to compensate for all costs incurred in making an examination of books, records or documents, or an audit thereof, or in the holding of hearings or the subpoenaing and compensating of witnesses. SECTION 17. Distraint Penalty. The penalty as provided by R.S. 47:337.76 in cases where the distraint procedure is used in the collection of the Taxes shall be ten dollars ($10.00). SECTION 18. Limits on Interest, Penalty and Attorney Fees. Should the interest, penalties or attorney fees herein, or the combined interest, penalties and attorney fees be declared to be in excess of limits provided by other law, including relevant jurisprudence, then the maximum interest, penalties and attorney fees allowed by such other law shall apply. SECTION 19. Collector. The Taxes levied by this ordinance is authorized to be collected by a “Collector” which term shall mean the East Feliciana Parish School Board. SECTION 20. Powers of Collector. The Collector is hereby authorized, empowered and directed to carry into effect the provisions of this ordinance, to appoint deputies, assistants or agents to assist it in the performance of its duties, and in pursuance thereof to make and enforce such rules as it may deem necessary. SECTION 21. Agreement to Collect Taxes on Vehicles. With regard to the collection of the Taxes on any motor vehicle, automobile, truck, truck-trailer, trailer, semi-trailer, motor bus, home trailer, or any other vehicle subject to the vehicle registration license Taxes, this Governing Authority, acting through the President of the Governing Authority and on behalf of the Parish, is authorized to enter into an agreement or agreements with the Vehicle Commissioner, Department of Public Safety and Corrections, for the collection of the Taxes on such vehicles, as provided by R.S.47:303(B). SECTION 22. Revenues of Taxes. All taxes, revenues, funds, assessments, moneys, penalties, fees or other income which may be collected or come into the possession of the Collector under any provision or provisions of this ordinance relating to the Taxes shall be promptly deposited by the Collector for the respective accounts of the Parish in the special funds heretofore established and maintained for the deposit of such proceeds, which fund shall be a separate bank account established and maintained with the regularly designated fiscal agent of the Parish , provided, however, any amount which is paid under protest or which is subject to litigation may be transferred to a separate account established by the Collector with said fiscal agent pending the final determination of the protest or litigation. In compliance with the said special election of December 6, 2014, authorizing the Taxes, after all reasonable and necessary costs and expenses of collecting and administration of the Taxes has been paid as provided for above, the remaining balances in the respective special funds shall be available for appropriation and expenditures by the Governing Authority solely for the purposes designated in the applicable propositions authorizing the levy of the respective Taxes. SECTION 23. Severability. If any or more of the provisions of this ordinance shall for any reason be held to be illegal or invalid, such illegality or invalidity shall not affect any other provision of this ordinance, but this ordinance shall be construed and enforced as if such illegal or invalid provisions had not been contained herein. Any constitutional or statutory provision enacted after the date of this ordinance which validates or makes legal any provision of this ordinance which would not otherwise be valid or legal, shall be deemed to apply to this ordinance. SECTION 24. Effective Date. This ordinance shall be in full force and effect immediately upon its adoption, being an ordinance affecting the public peace, health and safety. SECTION 25. Publication and Recordation. This ordinance shall be published in one issue of the official journal of this Governing Authority as soon as is reasonably possible. A certified copy of this ordinance shall be recorded in the mortgage records of the Parish of East Feliciana, State of Louisiana. PARISH OF WEST FELICIANA RESOLUTION INITIAL ANNUAL CERTIFICATION OF COMPLIANCE WITH STATE OF LOUISIANA OFF SYSTEM BRIDGE REPLACEMENT PROGRAM WHEREAS the Code of Federal Regulations as enacted by the United States Congress mandates that all structures defined as bridges located on all public roads shall be inspected, rated for safe load capacity and posted in accordance with the National Bridge Inspection Standards and that an inventory of these bridges be maintained by each State; and WHEREAS the responsibility to inspect, rate and load post those bridges under the authority of West Feliciana Parish in accordance with those standards is delegated by the Louisiana Department of Transportation and Development to West Feliciana Parish. The following resolution was offered by Major Coleman and seconded by Warren McCray, Jr.: RESOLUTION A resolution providing for canvassing the returns and declaring the result of the special election held in the Parish of St. Helena, State of Louisiana, on Saturday, December 6, 2014, to authorize the rededication of a sales and use tax therein.

SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the Parish of St. Helena, State of Louisiana, on SATURDAY, DECEMBER 6, 2014, to authorize the rededication of a sales and use tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election. SECTION 2. Procès Verbal. A Procès Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of St. Helena, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority. SECTION 3. Promulgation of Election Result. The result of said election shall be promulgated by publication in the manner provided by law.
