Dear Colleagues, Dear Friends, At our next committee meeting, we will have an exchange of views on the new framework of technical measures (Rapporteur: Gabriel Mato) and on the multiannual management plan for the North Sea (Rapporteure: Ulrike Rodust). As part of these parallel discussions, we must strive to coordinate these two frameworks. An important issue are the joint regionalised technical measures defined in the annexes of Gabriel Mato's report with the specific technical measures defined in each management plan. Is it necessary to rely solely on the general framework or establish a specific framework within each management plan? As such, Article 8 of the Baltic Sea Management Plan establishes a clear framework directly in the plan to achieve its objectives. The Commission's proposal for the North Sea does not repeat such a provision and proposes a smaller approach. There is also the question of the role of the European Commission in the process of regionalisation. I consider that the Commission should be able to develop technical measures on its own initiative in the absence of joint recommendations from the Member States. Regionalisation is an excellent instrument, but it is not sufficient and it should not lead to a restriction of the Commission's and the legislator's flexibility. EUROPEAN PARLIAMENT MEPs ask the Commission “to look into the possibility of establishing, as soon as possible, an instrument specifically dedicated to supporting fisheries in the outermost regions, along the lines of the POSEI scheme for agriculture”.

EU’s farthest-flung fisheries need funding, say MEPs (27/04/2017) Young fishermen and fish farmers in the EU’s outermost regions need financial help and incentives, including money for new boats, said Parliament on Thursday.

Programmes of Options Specifically Relating to Remoteness and Insularity (POSEI), governed by POSEI Regulation No 228/2013, include specific measures for agriculture in the outermost regions, such as production and import subsidies.

The non-legislative resolution was passed by 428 votes to 64, with 118 abstentions. An amendment to allow EU and national funding to renew the OR fleet was passed by 358 votes to 240, with 16 abstentions.

Atlantic tuna: ICCAT recommendations to be transposed to EU law

Commenting on the resolution and the amendment, rapporteur Ulrike Rodust (S&D, DE) said "I have tried to work out the best proposals for a possible solution. And I deplore the fact that the amendment has raised hopes which in my opinion cannot be fulfilled. This result does not correspond to the coherence of the Common Fisheries Policy and the European Maritime Fisheries Fund, respectively, and I doubt that it will pass legal scrutiny. Emphasis should be put on the aim of the Common Fisheries Policy to reach sustainable stocks and fisheries". EU and national funding to renew fleet The renewal funding amendment calls on the Commission to “allow the funding (at EU or national level) of the ORs’ artisanal and traditional fishing vessels which land all their catches in ports in the ORs and contribute to local sustainable development, so as to increase human safety, comply with European hygiene standards, fight illegal, unreported and unregulated fishing and achieve greater environmental efficiency”. MEPs nonetheless stipulated that “this fishing fleet renewal must remain within the limits of authorised capacity ceilings, must be restricted to the replacement of an old vessel by a new one, and must allow sustainable fishing and reaching the Maximum Sustainable Yield (MSY) objective”.

(25/04/2017) The proposal to transpose the International Commission for the Conservation of Atlantic Tunas (ICCAT) recommendations to EU law was approved by Fisheries committee on Tuesday. MEPs ask to apply the new law also to third country vessels operating in EU waters and add a special provision for swordfish and tuna quotas and small-scale fishing. The objective of the proposal is to transpose into EU law the conservation, control and enforcement measures adopted by the International Commission for the Conservation of Atlantic Tunas (ICCAT) in the Atlantic Ocean and adjacent seas. The aim of the proposal is to transpose 28 ICCAT recommendations. The new regulation would apply to Union fishing vessels which operate in the ICCAT Convention Area and, in the case of transshipments, also outside the ICCAT Convention area if they transship species caught in that area. It would also apply to third country vessels which are inspected in member states ports and which carry ICCAT species or fish products originating from such species. MEPs ask to extend the scope of the regulation by applying it to “third country fishing vessels and vessels engaged in recreational fisheries which operate in Union waters”.

European Commission adopts action plan to improve in Estonian fisheries control system

The European Commission has adopted an action plan setting out how Estonia can overcome identified shortcomings in its fisheries control system, following an audit programme on data management and control system in Estonian in 2015 and 2016.

On 11 May 2017 the Agriculture and Fisheries Council agreed its position on a proposal for new rules on the conservation of fishery resources and the protection of marine ecosystems, often referred to as "technical measures".

This closely follows the plans recently adopted for Germany and Belgium. The measures and timeline of implementation were agreed together with the Estonian authorities, in line with the procedure set out in Regulation (EC) No 1224/2009 on fisheries control.

The Council's position builds on a Commission proposal that aims at modernising the existing rules on how and where fishermen may fish. These cover the taking and landing of fisheries resources, the specifications and operation of fishing gear, and measures to mitigate their impact on sensitive species or areas.

Under the action plan, Estonia will work to improve data management; principally ensuring that catch data are comprehensively collected within the required time limits, validated, crosschecked, exchanged with other countries and applied to ensure effective monitoring and reporting of quota uptake. In addition, Estonia will improve the coordination between the relevant authorities involved in the control of marketing standards and traceability, and ensure that an effective risk-based analysis is applied to ensure inspections are targeted effectively.

"Until now European fishermen have had to respect more than 30 different regulations", said Roderick Galdes, Maltese Parliamentary Secretary for Agriculture, Fisheries, and Animal rights, "an overly difficult and burdensome legislative framework. We want to make their life easier, guarantee legal certainty and focus on innovation. Better and clearer rules will help protect our seas and the sustainability of our fishery resources. And most of all, the Council position empowers the fishing community by giving it more direct say in the decision-making process".

Action plans are an effective way to enforce the Common Fisheries Policy in a spirit of cooperation and dialogue. With their clear timeframes, benchmarks and reporting deadlines, they allow the Commission to follow up on the implementation and the progress made, and have been shown to obtain good results; as proven, for example, by the closed action plan with Latvia and the ongoing plan with Finland. They help to ensure that Member States have set up appropriate administrative and technical structures and systems to ensure monitoring, control and enforcement of the Common Fisheries Policy rules and thereby contribute to the sustainability of fisheries.

The Council's position on technical measures further improves the coherence of the Commission proposal with existing EU law and enhances two key elements: simplification and regionalisation. In particular the text streamlines the procedure for regional cooperation and strengthens the role of member states' joint recommendations, in line with the reformed Common Fisheries Policy (CFP). The Council general approach also strikes a balance between the current rules allowing for lawful fisheries' practices, which may be maintained in order to guarantee business continuity, and the need to provide for viable and innovative solutions in the future.

The 1s t round of negotiation on a new Protocol took place in March 2017. The 2nd round is s chedulled for 8-11 May 2017. Both s ides aim to conclude negotiations before the end of May, and thus have enough time for legis lataive procedures to allow the new Protocol to provis onally enter into force (before 23 November 2017). A new Protocol entered in force on 1 January 2016. November 2016 JCM focus ed on the s etting of fis hing opportunities and April 2017 JCM will focus on s ectoral s upport.

New protocol was s igned and entered into provis ional application on 23/12/2014. Las t Joint Committee meeting took place on 11-13 May 2016.

This would be a new agreement. A firs t technical meeting took place in Dar-Es -Salaam 4-6 July 2016. Tanzania did not officially inform COM (partially due to a complex ins titutional s etting) and information available point to various directions but there s eems to be an interes t in dis cus s ing an SFPA with the EU. Date of firs t round pending confirmation. This will be a new Agreement. A technical meeting took place 20-21 January 2015. Confirmation of interes t by Kenya on 21/03/2016, but date to s tart negotiation not agreed upon yet. The Agreement and the Protocol are in force s ince 14 October 2016. 1s t Joint committee meeting took place on 28-30 November 2016.
