Short description Providers must provide key contact information of clients when requested for the purposes of conducing consumer surveys for home and community-based services. In addition, a resident experience survey for assisted living facility residents and families will be developed.
Summary The commissioner may now request contact information of clients and associated key representatives for purposes of conducting consumer surveys for home and communitybased services. Providers are now required to furnish contact information available to the provider and to provide notice to clients and associated key representatives that their contact information has been provided to the commissioner.
Also, the commissioner is required to develop and administer a resident experience survey for assisted living facility residents and a family survey for families of assisted living facility residents. Money appropriated to the commissioner to administer the resident experience survey and family survey is available in either fiscal year of the biennium in which it is appropriated.
Implications Care Providers of Minnesota has not identified any implications and will watch for any that may arise.

Sec. 24. Minnesota Statutes 2020, section 256B.439, is amended by adding a subdivision to read:
Subd. 3c. Contact information for consumer surveys for home and communitybased services. For purposes of conducting the consumer surveys under subdivision 3a, the commissioner may request contact information of clients and associated key representatives. Providers must furnish the contact information available to the provider and must provide notice to clients and associated key representatives that their contact information has been provided to the commissioner. EFFECTIVE DATE. This section is effective the day following final enactment.
Sec. 25. Minnesota Statutes 2020, section 256B.439, is amended by adding a subdivision to read:

The commissioner shall develop and administer a resident experience survey for assisted living facility residents and a family survey for families of assisted living facility residents.
