A great action picture, signed by Alain Prost, depicting the famous crash between him and Senna during the Japanese Grand Prix at Suzuka in 1989, an event which turned out to be a pivotal moment in F1 history. Ayrton got away and won the race but was disqualified and Alain took the championship. 1965 Ford Cortina GT Mk.I Historic Rally Car

Not only does this car have good genes, being as it’s a genuine 2-door Mk.I Cortina GT with a matching numbers engine, but it also has new MSA historic rally papers and a successful rallying history to boot.

In the cockpit are two brand new Sparco seats and belts, a full navigator’s dashboard, a fire suppression kit, a full cage and perspex windows within the aluminium doors. The boot lid is also aluminium to save a bit more weight. Offered ‘rally ready’ with a fresh MOT, what’ s not to like about this cracking little Red Rally Rocket.

This dynamic mid-sixties saloon is powered by an unburstable precrossflow GT engine fed by twin 40 Weber carburettors, mated to the correct 2000E gearbox as was fitted to the original Cortina GT road cars. It has a Gartrac Atlas axle with a 5.1 LSD differential, a front strut brace, full sump and gearbox guards, Minilite style wheels and is shod with Dunlop forest tyres.

The Porsche 911 Carrera RSR was introduced in 1973 with a 2.8 litre engine and was a development of the highly acclaimed RS Sport Lightweight, a homologated road car aimed at drivers who planned to use the car for occasional motor sport. The RSR, on the other hand made no attempt at being daily transportation, and was aimed specifically at racing teams who wanted an ‘off the shelf’ racer to compete at the highest level including FIA Group 4 long distance endurance racing and Le Mans. Only 49 of the 2.8 litre engined cars were produced as factory built customer racing cars, making them some of the rarest Porsches ever made.

who had raced RSRs in period for Porsche Cars GB, it won the Tour Espania in 2006, and later went on to win the Tour Britannia in 2008 and again in 2010.More recently the car has been refreshed by Mike Bainbridge who rebuilt the engine in 2012, and receipts are included for all these works including an engine spec sheet and a list of parts used. At the time of the engine rebuild he also rebuilt the gearbox fitting new Guard Transmission components, a complete new gear cluster, new crown wheel and pinion and a new Guard limited slip differential, and again invoices for these parts are included in the cars paperwork.

The Porsche you see today was originally a factory supplied LHD, 1975, 2.7MFi Carrera. It was later used as the perfect basis to build a Porsche to FIA RSR specification in 1996. This rebuild was carried out at great expense and with exceptional detail by HS Racing in Switzerland. The engine was originally built by Heini Schneebit using high butterfly injection, twin coils and all the usual RSR type mods used by Porsche to produce around 300bhp. Bilstein suspension was fitted on all corners and the car is fitted with 930 Turbo large front brakes. Well known in competition, and a competitive car in the hands of well known Porsche racer Nick Faure,

Currently set up more for circuit racing than road rallies, the car has seen minimal usage since its mechanical refresh and as such is presented in very good condition all round. Accompanying the car is an old set of FIA/HTP papers as well as period German literature from the time of the car’s import, along with invoices for much of the work undertaken on this fabulous Porsche.

Born on 16th January 1952 in Lombardy, Italy, Piercarlo Ghinzani is one of the most successful Italian racing drivers of the 1980’s era. Cutting his teeth in single seaters he was the Italian and European Formula 3 championship winner before launching a Formula One career which lasted from 1981 until 1989.

He went on to drive in 77 Formula One Grand Prix, mostly for the smaller Italian team, Osella, but also for Toleman, Ligier and Zakspeed. He also drove successfully in Group C as a works driver for Lancia supporting fellow Italian teammates Michele Alboreto and Riccardo Patrese. He kept, and fully maintained most of the cars that he drove in period, which Silverstone Auctions are now extremely proud to offer for sale for the very first time. These include his 2 Championship Winning March Formula 3 cars, 2 of his Osella F1 cars and also his Toleman F1. The restoration process and rebuild are pictured in the history file and the car is offered race ready. The fuel cell is out of date and a temporary 20 litre aluminium tank is currently installed, although a proper rubber bag tank can be supplied. Registration: Not Specified Chassis Number: 055 Engine Number: Not Specified Year of Manufacture: 1996 Estimate (ÂŁ): 12,000 - 15,000 In 1996 the International Formula 3000 Championship became a one-make series and Lola was awarded the contract by the FIA to build the Lola T96/50 chassis for all teams competing in the championship. This is one such race car, albeit now offered as a static display car less engine and electrical wiring. Expertly preserved, this car is chassis#055 and boasts excellent coachwork, paintwork and interior. This is the car that Team Ghinzani used in the 1999 F3000 Series with Paolo Ruberti, and in the 2000 and 2001 Euro Formula 3000 seasons with Gabriele Varano and Alex MĂźller. Interested parties should note that it would be possible to install a 3000cc, 8 cylinder Zytek engine and race this car.

The rapid and highly competitive Graeme Dodd is a very well known and highly respected Gentleman historic racer of note. The apple never falls far from the tree and his son James is now also setting the pace, particularly in the current HSCC Super Touring series, where 1980’s and 90’s Touring Car legend, John Cleland, recently commented that James is now as quick and committed as any of the current generation - high praise indeed! This 1998 ex-Works Nissan Touring Car has been professionally maintained and run for the Dodd family. It benefits from a 2015 engine rebuild by the renowned Dick Langford and has run both very competitively and reliably this season without incident. All the usual Super Touring specification, including a flat shift sequential gearbox, high tech electronics and state of the art brakes,

Priced to sell today, these cars were built in an era where the build cost regularly ran to seven figures. The spares included are a set of wheels and gear ratios. However, a comprehensive spares package can be be acquired post sale including; A bag tank, doors, all body panels, all four corner suspension components, front splitter with built in undertray, driveshafts and a further 8 wheels. We are pleased to offer this fabulous Lotus Eleven Series I, known by its original chassis number #384 and importantly retaining its original chassis plate. From a private collection of actively raced historic Lotus car, this car has been well maintained and used in his care and is one of the more desirable Series 1 models - the Le Mans Sports Racer. The car is currently in full race trim and fitted with a ‘top of the shop’ Glyn Peacock Coventry Climax FWB 1490cc with all of the best available parts assembled on to a “New” FWB block. This gave a remarkable 124 bhp on the rolling road which equates to around 145-150hp at the flywheel. This engine has done less than 1 hours work, finishing well to the front at a recent televised Silverstone VSCC 40-minute Spring Start race. The passenger seat is present, but not currently fitted and spare front & rear wheels are included in the sale.

From enthralling battles with much larger competition in period, to latter day giant killing performances in Historic Touring cars, the Mini Cooper represented an opportunity to compete at high levels for privateers with cars not far removed from the works entrants, enhanced by a plethora of emerging tuning companies and race/rally parts. Driven by names such as Hopkirk, ‘Whizzo’ Williams and ‘Smokin’ John Rhodes, the Mini Cooper firmly cemented its place in motorsport folklore.

Offered here is an FIA appendix K, Morris Mini Cooper S built from a bare shell by Dale Racing for the 2013 season. The shell had a new floor, inner and outer wings, and scuttle and was fitted with a welded in T45 roll cage by Custom Cages. Suspension set up included new strengthened subframes, Swiftune Koni shocks and all the latest suspension set-up tweaks. The car is fitted with the correct period rose petal alloy wheels shod with new Dunlop CR65s. Inside a new Corbeau seat is fitted together with a Willans harness, a work’s dashboard and Stack instrumentation. Potential buyers should satisfy themselves as to the

Under the bonnet is a full-race Swiftune 1293cc engine and gearbox with zero hours since the last rebuild. After World War II, the Morgan Car Company had re-introduced their 4/4 model fitted with a 1267 cc Standard engine. This continued in production until 1950 when it was replaced by the larger Plus 4 announced at the 1950 Earls Court Motor Show. This particular vehicle was built by the Morgan factory as a standard roadgoing car and originally dispatched to a Mr Thomas Haddon in Newcastle on the 2nd June 1954. It was actively campaigned in competition in period. Acquired then, by well known Morgan main agent and racer John Macdonald and developed as a replacement for his ex Lawrence / Shepard Barron +4 , ‘PGP 123’ (widely known as ‘Choc Ices’). It was returned to the Morgan works and fitted with a super-light aluminium body and completely rebuilt to 1959 supersports specification using a very special all steel full race engine with twin 45 Webers, close-ratio gearbox, new 4.1 GKN differential, integral aluminium short and long racing fuel tanks, aluminium floors, sump, rocker cover, Alfin rear brake drums, original Lawrencetune manifold and rare chronometric rev counter with a telltale.

1954 Morgan Plus 4 Works-built Lightweight

including a lightweight ‘E’ type, a Tojiero Buick V8 and assorted single seaters, including Roddy McPherson’s Cooper Bristol GP car. It also came second to Ben Cussons Jaguar ‘C’Type at Oulton Park. The current owner has had the engine completely rebuilt, fitted new wheels, clutch and a hardtop so that it can compete as a GT as well as a sports car. At the GTS Equipe race at Donnington Park, it was on the grid with the aforementioned ‘Choc Ices’ which it managed to lap! Finished in attractive ‘Connaught Green’ originally painted by John Macdonald (a colour Charles Morgan found so attractive it was latterly adopted as a Morgan colourway) this car comes complete with a comprehensive history file, and full HTP FIA papers (issued in June 2009) and ready to qualify again ‘as is.’ This is an important, rare and highly desirable sports car, recently serviced and ready to continue its competition career, eligible for all National and International events and with such a realistic guide price, surely an historic racing car worthy of closer inspection...

In November 1958, the Cooper Car Company launched the T49 MkI as the successor to the successful ‘Bobtail’. Featuring the coventry Climax two litre engine, all aluminium bodywork and a notorious short wheel base, it was regarded as amazingly low and light for the period and was very successful straight away on track, notably in the capable hands of Sir Stirling Moss. Here we have one of just 7 cars built by Turner Sports Cars between 1950 and 1954, one being an F2 car and the others sports cars. This example is chassis number 006 and was built in 1952 and first road registered in 1953. It was originally purchased by Wilfred McDougall of Wolverhampton, who raced it at a number of different circuits and hill climbs around the UK during the mid 1950s, including Silverstone, Brands Hatch, Mallory Park, Oulton Park, Shelsley Walsh, Castle Combe and Charterhall in Scotland. Turner 006’s full race history is still to be fully researched but race programmes in the history file for this early period of the car’s life include: Charterhall International in August 1953, Castle Combe in April 1954, Brands Hatch BRSCC and International in May 1955 and August 1954 respectively and Silverstone in August 1954. Although no evidence at this stage has been found linking 006 to Goodwood, it is interesting to note that two of its sister cars (Chassis 003/JDA 555 and Chassis 004/MAB 121) did race at Goodwood in period. An extensive history file and photo album documents a great deal of 006’s history in what has been a fascinating life for this rare British sports racing car.

Founded in 1977 by Sir Frank Williams and Sir Patrick Head, Williams Grand Prix Engineering Ltd. are a successful Formula One motor racing team and constructor. Winners of nine Formula One constructors championships and seven drivers championships their track record speaks for itself. Between 1995 and 1999 Williams designed, built and ran the works Renault Laguna entries in the British Touring Car Championship. Things started well, with the team taking the manufacturer’s championship in their first year 1995, although 1997 was their best season by far, when they took 15 out of the 24 races and both the drivers and manufacturer’s championships. Those were heady days when most of the cars on the grid cost over £1m to build and budgets of £3-5m to run each car for a season were not uncommon. Of all the manufacturer built cars in this period - it was the Williams Renault that was the most highly regarded.

This car, chassis no.99/04, was the last ever chassis built and was prepared for ex F1 driver, Jean-Christophe Bouillon, to race alongside multiple champion, Jason Plato for the 1999 season. Nescafe were the main sponsors, and the cars were both distinctive and quick. Jason Plato secured an outright win for them during the ‘99 season, but ultimately Renault had decided to switch their focus back to Formula One and consequently pulled out at the end of the year. Helped by the success of his Motor Sport and Performance Car accessory business (run with his brother Derek), Gordon Spice became an established racing driver from the late 60s, through the 70s and 80s in saloons and Group C. A veteran of 14 Le Mans races and 4 FIA C2 World Championship titles, he raced over 70 different cars during his long career. From 1986 onwards he designed and built a range of Group C Spice Engineering cars that enjoyed unrivalled success internationally in endurance events, World Sportscar Racing and latterly IMSA GT. When our vendor purchased this Capri he was naturally curious about its history and his research lead to the understanding that this may have been the ‘Autocar’ Capri, chassis CC10. A letter on file confirms that Gordon Spice has inspected the car, and after a phone call to Dave Cook of CC Racing confirming some key identifying marks, our vendor is confident that this is their 1979 car, CC10, and the car now proudly displays a stamped chassis plate to this effect.

For the privateer in the mid 1970s who wanted to go sports car racing, and in particular compete successfully at the famed 24 Hours of Le Mans, there was really only one viable option, the Porsche RSR. Introduced in 1973, the RSR was a factory built racing car based on the 911 chassis. These were not converted road cars, but rather purpose built competition models, designed and built from the ground up for serious racing use. In 1974, the factory made significant changes to the car including a new 3.0 litre engine, wider wheels with centre lock hubs and improved aerodynamics. The result was a car that would dominate the GT category and challenge for overall wins around the world for years to come. The Ferrari 360 Challenge is a race focused development of the hugely popular Ferrari 360 Modena road car. The 360 Challenge was a significantly modified, non-road legal car, originally conceived with Ferrari’s popular racing series the ‘Ferrari Challenge’ in mind. When the car was first introduced, Ferrari claimed that the 360 Challenge boasted a quicker acceleration time of 3.9s from 0-62mph along with substantially better cornering ability over the standard road car unsurprisingly as a result of its enhanced racing suspension and brakes. Purchased by our vendor in 2012 from GT Cup regular, Mick Dwane, this car had been campaigned in the Ferrari Challenge in 2003 and 2004 and Mick had raced it in 2010 and 2011 in the Pirelli Ferrari Open as well. The condition of this car appealed to our vendor as it had never sustained any accident damage, chassis damage or corrosion. At the time of his purchase in 2012, the engine had been rebuilt by Graypaul Ferrari Nottingham and the power had been increased by fitting a Stradale inlet tract and uprating the exhaust. Named after its founder Vincenzo “Enzo” Osella, the team began life by racing Abarth sports cars in local and national races in the mid 1960s in Italy. Though relatively successful (Osella eventually took over the factory Abarth sports car program), Osella expanded into single seater racing in 1974 to further develop his business. The team would rise to Formula Two in 1975, achieving some success with its own car (the Osella FA2); François Migault scored one point. They also competed in sports car racing producing some of the most competitive and prettiest two litre cars ever produced.

The process took nearly two years and the first outing at Brands Hatch (2011 HSCC MARTINI) when running a very respectable 4th, fuel pressure problems halted any further progress. In 2013 two races were entered at Donington producing a win and the chance of another while leading till loose bodywork prevented a double. In 2014 four races were entered in the HSCC MARTINI and it won all four. The very highly respected Ian Flux proclaimed this Osella was the best 2.0 litre sports car he had ever driven!

The Osella PA3 BMW M12 offered here was purchased by Colin Pool, who was responsible for nearly all the Osellas in the country, from Francesco Molina of Pescaro in the early nineties. Like many Osellas of the period, it was used initially for hill climbing but did compete in the 1976 Monza 4hrs finishing 11th overall. Chassis PA029 resided with him until 2011 when it was purchased by our vendor who set about a comprehensive rebuild. It was decided to commission a new tub which was built by Martin Slater of Lyncar and a new replacement engine was purchased from Wassermann. Every other component was either

With the Lotus 14 of 1959 - better known as the Elite - Colin Chapman demonstrated that his skills as a racing car designer and constructor could just as easily be applied to production road cars. The classically shaped body was extremely aerodynamic thanks to the pen of Frank Costin and was one of the leading factors in the Elite being incredibly successful on, as well as off the track! The Elite was a class winner across the globe in International Motor races, notably at Le Mans where it won its class 5 times! This particular car, chassis 1947 was delivered in 1962 as a Series 2 Super 95 car. The Super 95 was a car that enjoyed more power from an engine that had a higher level of tune, with raised compression and a fiercer camshaft with 5 bearings. Very little is known about the early history of the car however, it is likely that it was a car supplied for fast road use. By the 80s, however, with historic racing becoming more fashionable the car was converted into full racing specification. The car has been raced extensively across Europe ever since and has become well known in the historic paddock as one of the most

Elva, whose name is derived from the French phrase “elle va” (she goes) was founded in 1955 by Frank Nichols in Bexhill, Surrey. Nichols always took the approach that it was better to sell racing cars than race them himself. However, it was the Mk 7, introduced in 1962, that enjoyed success on both sides of the pond. Porsche supplied engines to Elva, a rare instance of the German firm supplying another manufacturer, and a Porsche-engined Mk7 took a debut win in the 1963 Road Atlanta race, one of the most important on the American calendar. In Europe Herbert Muller drove a Mk 7 to 2nd place in the European Hill Climb Championship whilst Tony Lanfranchi regularly beat the Lotus 23s and Brabham BT8s en route to the 1964 Autosport Championship. The Elva Mk 7 was the best under 2 litre sports car of its day but despite this, it is believed that only 29 were produced over a 2 year period. This car, chassis 023 was originally supplied through Carl Haas to Jim Rahal, part of the Rahal racing dynasty. Driven in SCCA and club events by his father, the car has been described by ex F1 driver and Indy legend Bobby as the car that ignited his passion for motor racing.

The car remained in North America until the mid-eighties when it was brought back to Europe by Roger Fountain who set about a long rebuild. It wasn’t until the early 2000s however, that the car was regularly seen in historic racing. Following a period at renowned Simon Hadfield Motorsport with Rupert Clevely and Rob Hartley driving, it ended up with prolific historic racer Roger Wills. Wills, along with regular co-driver Joe Twyman, drove the car across Europe regularly winning their class in Masters, HSCC and CHE Endurance races. Since then it has been used by the current owner for the same purpose and has enjoyed ‘no expense spared’ preparation with WDK Motorsport. March Engineering was established in 1969 with four founding members, Robin Herd, Max Mosley, Alan Rees and Graham Coaker who all oversaw different elements of the business. With the exception of Formula One it went on to be more successful in more classes than any other manufacturer. Offered here is a 1978 March 783 Formula 3, Unipart Team car that was driven by future World Champion Nigel Mansell. The complete history line shows it was converted to Formula Atlantic specification in 1979/80 before being passed on to Tony Hudson in 1981. The car was subsequently owned by Tony O’Neil (1982), Mick Waller (1984), John Vines (Toyota F3 Championship, ‘86 & ‘87), Martin Cocks (from 1988) and finally acquired by Richard Dutton (of Fortec fame) in 2012 and competed in the 2014 Historic Monaco event.

Offered here is an Audi A4 Super Touring car built in 1995, although not raced until the following year, when it was campaigned in the ‘96 ADAC Super Touren Wagen Cup by respected German team ABT Sportsline, and piloted by Danish racer Kris Nissen. Chassis number ST05 was then raced in the 1997 FIA Cental European Zone Super Touring Championship in the hands of Josef Venc with some success. For a brief period between 1998 -1999 the car is believed to have been used in Sweden, before being picked up in 2002 by Tyssline Racing to run in the Swedish SLC Championship. 2003/4 saw a change of ownership when chassis #ST05 was purchased by the Spanish racing team, B9 Racing to prepare and race in the Spanish Hillclimb Championship for a number of seasons.

Riley & Scott Mk III. Chassis WSC 95-03 The Riley & Scott Mark III was a Sports Prototype initially designed by Bob and Bill Riley and Mark Scott of Riley & Scott Cars Inc. to compete in the WSC category of the IMSA GT Championship for the ‘94 season. However, it was to be 1995 before the first Mark III was completed. This Mk III, chassis number 95-03 was presumably the third car produced and was originally delivered to, and run by Payne Racing in mid 1995. In its first season, the car was entered into 6 IMSA races with a best result of 4th at Mosport, but went on to complete the entire 1996 season with a solid 5th position at the Daytona 24 hours and achieved its best result of 2nd in Texas. The Italian team “Target 24” later bought the car, running it again at the Daytona 24 in 1997. Following engine problems, the decision was made to change from the original Oldsmobile V8, to a Chevrolet. After competing in one final race in the States that year, the vehicle was shipped back to Europe for the 1998 ISRS Championship, where it raced for most of the season, plus an outing at the Vallelunga Gold Cup, and achieved a creditable 3rd at the Le Mans Bugatti Circuit.

1995 Riley & Scott MKIII Sports Prototype Chassis WSC 95-03

Registration: N/A Chassis Number: WSC 03 Engine Number: Not Specified Year of Manufacture: 1995 Estimate (£): 60,000 - 70,000 95-03 was then rented to the Conrero Team, unfortunately going on to suffer some reliability issues. It was returned to run with Target 24 again, proving to be more reliable for a few outings. Robin Smith then acquired the car in 2002, but a number of mechanical issues dictated that the power units were shipped to Hertel in the US. Once they had dealt with the engine’s gremlins, the car was once again reliable but, regrettably, it wasn’t to be raced regularly as the new owners now had other commitments. Following an extensive rebuild in 2003, the car has been carefully kept in the owners unit, where it has been moved around to keep everything free, the engine regularly run-up and the transmission taken through several heat cycles. The car comes complete with 3 sets of spare rims and several sets of gear ratios, however, a large spares package, including a spare engine, is available with this car by separate negotiation.

Buying Guide The golden rule for anyone hoping to buy at auction is to thoroughly inspect the lot you are interested in before bidding, as no warranty or guarantee is given with anything that is sold. For this reason the auction centre is open for viewing prior to each Auction (please check times). All bids are final and irrevocable. Bidder Registration You can bid at auction either in person by attending the sale, by telephone, by leaving a commission bid or live online. To meet current legislative requirements, you will need to provide proof of identification in the form of a passport or drivers licence and a recent utility bill as proof of address. The auctioneer will aim to sell approximately 90 lots of automobilia and lifestyle per hour and 20 vehicles per hour. The following Terms (“Terms”) together with such other terms, conditions and notices as may be set out in any relevant catalogue apply to all sales by Silverstone Auctions Limited (“SAL”) at auction or within 14 days after the auction.

No alteration to the Terms will be binding unless accepted by SAL in writing. The Terms are subject to amendment by SAL provided it is reasonable for it do so by the posting of notices or by oral announcement made by the Auctioneer prior to or during the sale. Nothing in the Terms shall affect the statutory rights of a consumer.

Additional information applicable to the Auction may be set out in the Catalogue for the Sale, in an insert in the Catalogue and/or in a notice displayed at the Auctions and you should read them as well. Announcements affecting the Auction may also be given out orally before and during the Auction without prior written notice. You should be alert to this possibility of changes especially if bidding by telephone and ask in advance of bidding if there have been any.

SAL acts solely for and in the interests of the Seller. SAL’s job is to sell the Lot at the highest price obtainable at the Auction to a Buyer. SAL does not act for Buyers in this role and does not give advice to Buyers. When SAL or its employees makes statements about a Lot or it is doing that on behalf of the Seller of the Lot. Buyers who are themselves not expert in the Lots are strongly advised to seek and obtain independent advice on the Lots and their value before bidding for them.

In these Terms: 1.1 “Auction” means the auction sale in respect of which a Lot is consigned for sale. 1.2 “Auctioneer” means the representative of SAL conducting the Auction. 1.3 “Automobilia” means any memorabilia including but not limited to trophies, badges, programmes, models, prints and other collectables. ‘Lifestyle’ means any goods including but not limited to leather goods, watches and fine wines. 1.4 “Buyer” means the only person whose bid is accepted by SAL to conclude the contract for the purchase of a Lot. 1.5 “Buyer’s Premium” means the amount payable by the Buyer to SAL equal to 12.5%+VAT of the Hammer Price on Motor Vehicles and 17.5%+VAT of the Hammer Price for Automobilia and Lifestyle goods. 1.6 “Catalogue” means the catalogue relating to the relevant Auction includes any advertisement,

brochure, estimate, price list or other publication or webpage relating to one or more Lots. “Contract” means the agreement to be completed by the Seller relating to the proposed sale of each separate Lot at the Auction. “Entry Fee” means the sum payable by the Seller for each item entered into the Auction. “Expenses” in relation to the sale of any Lot means SAL’s charges and expenses payable by the Seller in addition to the Seller’s Commission including insurance, storage, illustrations, auction Entry Fee, cleaning costs, photography costs, catalogue costs, special advertising, packing and freight of that Lot and any VAT thereon. “Hammer Price” means the price in pounds sterling at which a Lot is knocked down by the Auctioneer to the Buyer. “Lot” means any item(s) consigned to SAL with the view to its or their sale at Auction. “Motor Vehicle” means any car or motorbike included or proposed to be included in a sale of motor vehicles. “Purchase Price” means the Hammer Price together with the Buyer’s Premium and any additional charges due plus VAT. “Reserve” means the minimum Hammer Price agreed between SAL and the Seller at which a Lot may be sold. “Sale Proceeds” means the net amount due to the Seller being the Hammer Price less the Seller’s Commission and VAT, Expenses and any other amount due to SAL from the Seller. “Seller” means the person who offers the Lot for sale, whether as agent or principal. “Seller’s Commission” shall have the meaning given in clause 10. “VAT” means Value Added Tax applicable at the prevailing rate from time to time. “Working Day” means any day (other than a Saturday and Sunday) at which clearing banks in the city of London are open for the transaction of normal sterling banking business. Agent SAL sells as agent for the Seller (except where SAL is selling as principal, which SAL will disclose in the Catalogue or otherwise in the Auction). The Contract for the sale of a Lot is between the Seller and the Buyer. SAL shall not be liable for any act or default by the Seller (except where selling as principal) or the Buyer. Discretion

SAL has the right at its sole discretion to refuse any bid, to divide any Lot, to combine two or more Lots, to withdraw any Lot and, in the case of dispute, to put any Lot up for Auction again. If SAL is notified about the Seller’s alleged breach of any of the Terms before it has remitted the Sale Proceeds to the Seller, it may at its sole discretion withhold payment until that dispute is resolved. SAL may, however, deduct any sums that are due to it from the sum held. Loss or injury SAL shall be under no liability for any injury, damage or loss sustained by any person while on SAL’s premises (including any premises where a sale may be conducted or where a Lot, or part of a Lot, may be on view from time to time) except for death or personal injury, damage or loss caused by the negligence of or other breach of duty by SAL, its employees or agents in the ordinary course of their duties to SAL. Lots The Catalogue contains details about each Lot. The description printed in the Catalogue is given on behalf of the Seller, and may contain SAL’s opinion about the Lot, but in any event is not a contractual representation or warranty by SAL. Photographs, Illustrations and diagrams contained in the Catalogue are for identification purposes only. They may not show the true condition and colour, (which may be inaccurately reproduced) of the Lot. Lots are available for inspection prior to the Sale and it is for any potential bidder to satisfy themselves as to each and every aspect of a Lot, including its authorship, condition, provenance, history, background, authenticity, style, period, age, suitability, quality, roadworthiness (if relevant), origin, value and estimated selling price (including the Hammer Price). Each Lot is sold by its respective Seller to the Buyer. Lots are sold to the Buyer on an “as is” basis, with all faults and imperfections. The actual condition of a Lot may not be as good as that appears by its outward appearance. In particular, parts may have replaced or renewed and Lots may not be authentic or of satisfactory quality; the inside of a Lot may not be visible and may not be original or may be damaged, as for example where it is covered by upholstery or material. Given the age of many Lots they may have been damaged and/or repaired and you should not assume that a Lot is in good condition. Any person who physically interferes with, scratches or damages the Lot in any way (at, before or after the Auction) will be held liable for the loss so caused.

The Seller is responsible for delivering the Lot in a presentable and saleable condition. If additional cleaning is required it will be charged for by SAL to the Seller as an Expense. If a Lot is not sold at Auction, SAL will for the next 14 days be entitled exclusively to negotiate a sale of the Lot on terms agreed with the Seller and as Seller’s agent, and if successful will be entitled to charge the Seller’s Commission and Expenses. The Seller gives SAL the full and absolute right to photograph and illustrate any Lot placed in its hand for sale, and to use such photographs and illustrations as are provided by the Seller at any time at its absolute discretion (whether or not in connection with the Auction), with indemnity against copyright infringement. The copyright in all written matter and illustrations relating to Lots shall remain at all times the absolute property of SAL, and any person wishing to use such materials, or any part of them, may only do so with the prior written consent of SAL.

Alterations and Estimates Estimates and descriptions may be amended at SAL’s discretion from time to time by notice given orally or in writing before or during an Auction. 6.2 The Lot is available for inspection and any potential bidder must form their own opinion in relation to it. You are strongly advised to examine any Lot or have it examined by a specialist or engineer on your behalf before the Auction. 6.3 SAL gives no warranty or representation as to the anticipated or likely selling price of any Lot. Any estimate given, whether written or oral and whether or not printed in any Catalogue, as to the estimated selling price of any Lot is a statement of opinion only and may be subject to revision from time to time at SAL’s sole discretion and should not be relied upon as an indication of the actual selling price. 6.4 SAL shall not be liable to the Seller for any error or misstatement in or omission from the description of any lot in any Catalogue where SAL has: 6.4.1 been provided with such description by the Seller or any person on his behalf; or 6.4.2 provided the Seller with a copy of such description prior to publication of the Catalogue and neither the Seller nor any person on his behalf has notified SAL in writing within 7 days of any error or misstatement in or omission from the description. 6.5 SAL has no duty to the Seller or the Buyer to investigate the accuracy of the description of any Lot provided by or on behalf of the Seller.

7. 7.1

Warranty by the Seller The Seller warrants to the Buyer and to SAL that: 7.1.1 The Seller is the owner of the Lot or is properly authorised to sell the Lot by the owner, and is able to sell the Lot with full title guarantee free from all encumbrances and third party claims and in particular that there is no outstanding finance affecting the Lot. If the car is subject to finance the amount outstanding must be confirmed prior to consignment and sale. 7.1.2 The description of the Lot in the Catalogue is to the best of the Seller’s knowledge accurate and not misleading. The Seller has notified (or will before the Auction notify) SAL in writing of any material alterations to the Lot of which the Seller is aware and of any concerns expressed by third parties in relation to the authenticity, provenance, origin, age, condition or quality of the Lot and has provided SAL with all such information in the Seller’s possession or control. 7.1.3 If the Lot is a road going Motor Vehicle, it may lawfully be used on the public road and complies with all statutory provisions and that there is in force a test certificate required by law in relation to such use; OR ALTERNATIVELY the Seller has notified SAL in writing that the Motor Vehicle may not lawfully be used on the public road. 7.1.4 The Seller shall compensate SAL and the Buyer in full for all losses, expenses and other costs which are caused by the Seller’s breach of any obligation of the Seller under the Terms. 7.1.5 Where the vehicle is not registered in the UK, the seller shall be responsible for completing the NOVA application within 14 days or the car arriving in the UK and before the vehicle arrives at the auction for sale.

8. Vehicle Registration Numbers 8.1 If the Seller wishes to sell the Motor Vehicle but to retain the right to the registration number of the Motor Vehicle it is the Seller’s Responsibility to notify SAL in writing. 8.2 It shall be the Seller’s responsibility to take all necessary steps to ensure that the current vehicle registration number is retained and that a new number is allocated prior to the Motor Vehicle being sold at the Auction. 9. Bidding and Reserves 9.1 Admission to the Auction requires the purchase of a

Catalogue which must be presented at the entrance to the Auction. SAL do not accept bids from any person who has not completed and submitted a registration form. Proof of identification will be required in the form of a passport or driver’s licence, together with a recent utility bill showing your current address, before the registration process can be completed. The Auctioneer will commence and advance the bidding at levels and in increments he considers appropriate and is entitled to place a bid or series of bids on behalf of the Seller, up to the Reserve on the Lot. The Seller may place a Reserve on any Lot when he consigns it to the Auction, and once placed it may not be changed without the written consent of SAL. All Lots will be sold without Reserve unless a Reserve has been agreed by SAL in writing. Where a Reserve has been agreed, only SAL at its absolute discretion may bid on behalf of the Seller. If no Reserve has been placed on a Lot, SAL shall in no way be held liable should the Lot be purchased for a price below any lowest estimated selling price of the Lot given in any Catalogue. SAL may sell a Lot below the Reserve agreed with the Seller, provided that SAL accounts to the Seller for the same Sale Proceeds as the Seller would have received had the Lot been sold at that Reserve.

10. Commission and Expenses 10.1 SAL shall be entitled to deduct from the Hammer Price and retain an amount equal to 5% of the Hammer Price for vehicles and 10% for automobilia and lifestyle goods or such other sum agreed by SAL in writing (“Seller’s Commission”) plus VAT together with Expenses and any other sums due from the Seller to SAL. 10.2 The Seller acknowledges SAL’s right to retain the Buyer’s Premium payable by the Buyer. 11. Insurance 11.1 Only on payment of the Purchase Price in cleared funds shall title in the Lot pass from the Seller to the Buyer. However, the risk in the Lot passes to the Buyer on the fall of the hammer. It is therefore, the responsibility of the Seller to insure the Lot before the hammer falls and the responsibility of the Buyer to insure the Lot after the hammer falls. 11.2 SAL will not be responsible for any damage to or the loss or destruction of a Lot unless caused by the negligence of or other breach of duty by SAL, its employees or agents in the ordinary course of their

Payment of Sale Proceeds Subject to SAL’s right of retention under Clause 3.2 and other provisions of this Clause 12, SAL shall pay the Sale Proceeds to the Seller not later than 14 Working Days after the Auction provided that the Purchase Price has been received in full by SAL. Unless an alternative method of payment has been agreed by SAL in writing, payment shall be made by telegraphic transfer. In the event of an unsettled hire purchase, finance agreement or any other charge or lien affecting the Lot SAL reserves the right to settle the amount due of such charges not exceeding the Sale Proceeds and if the Sale Proceeds are less than the charges outstanding the Seller will be responsible for the settlement of the balance forthwith. 12.2 If the Purchase Price has not been received in full by SAL within the time specified in clause 12.1 SAL will pay the Sale Proceeds to the Seller within seven Working Days from when the Purchase Price is received in cleared funds from the Buyer. 12.3 In respect of road registered Motor Vehicles, SAL reserves the right not to remit the Sale Proceeds to the Seller unless the Seller has deposited with SAL the registration document of the Motor Vehicle, and any other documents relating to the Motor Vehicle in the Seller’s possession or control which he agreed with SAL to supply. 12.4 If the Buyer fails to pay the Purchase Price within 28 days of the Auction, SAL will notify the Seller who may instruct SAL as to the appropriate course of action. SAL may endeavour to assist the Seller but SAL shall be under no obligation to do so, and shall not be under any obligation to institute proceedings in its own name. 12.5 In the absence of any written instructions from the Seller to SAL within 7 days of SAL having notified the Seller under clause 12.4 SAL shall be entitled to take any of the actions set out in clause 19.: 12.6 Any monies recovered by and paid to SAL in

consequences of SAL taking one or more of the steps referred to in clause 19 shall be applied to the payment of: 12.6.1 legal or other costs incurred by SAL in connection with such steps;. 12.6.2 Expenses; 12.6.3 the Buyer’s Premium and the Seller’s Commission on the sale of the Lot; 12.6.4 any balance remaining shall be paid to SAL to the Seller (or, if appropriate, the Buyer). If there shall be a shortfall any such shortfall shall be made good by the Seller to SAL on demand. If within 7 days after receipt of the notice referred to in clause 12.5 the Seller informs SAL that he wishes re-delivery of the Lot, he shall be entitled to do so but only upon prior payment of all Expenses and all legal and other costs reasonably incurred by SAL so as to keep SAL fully recompensed.

13. Withdrawal Fees 13.1 The Seller may not withdraw the Lot from the Auction. If SAL is unable to sell the Lot at the Auction due to action or interference by the Seller, the Seller shall be liable to pay SAL 15% of the estimated value of the Lot plus VAT thereon together with Expenses. The estimated value shall be the mid value estimated in the Catalogue. Removal and Storage The Seller shall arrange for the removal of any unsold Lot by 2pm the next working day following the Auction or by such other time as agreed by SAL. 14.2 Failure to remove any unsold Lot pursuant to clause 14.1 above will entitle SAL to charge the Seller a removal charge, storage fees, insurance and other expenses and any costs incurred at the following rates: Motor Vehicle: Removal - £195 plus VAT Storage - £10 per day plus VAT Automobilia: Removal – £25 plus VAT Storage – £10 per day plus VAT

Payment Once a lot is sold, the Purchase Price shall become immediately payable to SAL. Full payment for all Lots must be made to SAL by 5:00pm the next Working Day. Payment can only be accepted in GBP. For security reasons, payments by Debit or Credit card (VISA/Mastercard) will only be accepted where the cardholder is present. Credit Card Payments are subject to a 1.76% surcharge. Business debit and credit cards are subject to a 2% charge. There is a floor cash limit of £5000. Immediately after a Lot is sold the risk shall pass to the Buyer notwithstanding that possession will not be given and title will not pass to the Buyer before payment of the Purchase Price and SAL will not be responsible for any damage to or the loss or destruction of the Lot or any injury, loss or damage caused by the Lot unless caused by the negligence of or other breach of duty by SAL, its employees or agents in the ordinary course of their duties to SAL. The Buyer will compensate SAL in full in respect of all claims and proceedings brought against SAL in respect of any loss or damage to the Lot or injury, loss or damage caused by it not arising from the negligence of other breach of duty by SAL its employees or agents in the ordinary course of their duties to SAL.

duties to SAL and the Seller shall compensate SAL in full in respect of all other claims and proceedings brought against SAL in respect of any loss or damage to or destruction of the Lot. SAL will not be liable for any injury, loss or damage caused by any Lot or by the Seller’s negligence of SAL, its employees or agents in the ordinary course of their duties to SAL. The Seller shall compensate SAL in full in respect of all claims and proceedings brought against SAL in respect of injury, loss or damage caused by any Lot or by the Seller’s negligence or breach of any obligation under the Terms.

Responsibility for Purchased Lots The Buyer will be responsible for loss or damage to a Lot purchased by him from the fall of the hammer. Neither SAL nor its employees or agents shall be responsible for any loss or damage unless caused by the negligence of SAL, its employees or agents in the ordinary course of their duties to SAL while the Lot is in SAL’s custody or under its control. The Buyer shall be responsible for all removals, insurance, storage and other charges on any Lot from the fall of the hammer (in accordance with Clause 11). DVLA will be notified of the change of keeper within 5 working days following receipt of payment, using the details from invoice, unless otherwise stated. Non-payment or Failure to Collect If the Purchase Price is not paid in full, SAL as the agent of the Seller, shall in its absolute discretion and without prejudice to any other rights it may have, be entitled to exercise one or more of the following remedies:19.1.1 to remove, store (either at SAL’s premises or elsewhere) and insure the Lot at the expense of the Buyer; 19.1.2 to charge interest at a daily rate equal to 4% pa over Barclays Bank’s Base Rate on so much of the total amount due as remains unpaid after the date of and time referred to in clause 17.2; 19.1.3 to retain that or any Lot sold to the same Buyer at the same or any other auction of SAL and to release it only after payment of the total amount due; 19.1.4 to apply any money due or to become due to the defaulting Buyer in or towards settlement of the total amount due and to exercise a charge or lien on any property of the Buyer which is in SAL’s possession for any purpose. 19.1.5 take such steps as SAL shall at its absolute discretion consider necessary to collect the monies due from the Buyer, and to agree terms for the payment of the Purchase Price; 19.1.6 to rescind the sale and refund any monies to the Buyer, or to rescind the sale to the Buyer and to purchase the Lot itself. If it does so, property in the Lot shall pass to SAL on its election and SAL shall remit the Purchase Price to the Seller within 14 Working Days of its election less the

Seller’s Commission, Expenses and sums due to SAL which would have been payable had the contract not been rescinded; 19.1.7 to appoint a solicitor and/or other agent to pursue any of the courses of action referred to in this clause 19, and the Seller hereby authorises SAL to take any of the courses referred to in this clause, including the issue and prosecution of proceedings on the Seller’s behalf, and to settle claims and/or proceedings made by or against the Buyer on such terms as the Seller shall instruct, or in the absence of instruction s on such terms as SAL shall at its absolute discretion think fit. If the Buyer fails to make payment within 14 days after the date and time referred to in clause 17.2, SAL shall at its absolute discretion and without prejudice to any other rights it may have, be entitled to re-sell the Lot or cause it to be resold by public auction or private sale, and, if this results in a lower price being obtained, the defaulting Buyer shall then pay to SAL any deficiency, together with re-sale costs and any costs incurred in connection with the Buyer’s failure to make payment and any surplus shall belong to the Seller. If the Lot is not taken away on the date and time referred to in clause 17.2, whether or not the Purchase Price has been paid, SAL shall remove, store (either at SAL’s premises or elsewhere) and insure the Lot at the expense of the Buyer and only release the Lot after payment of the total amount due.

Any shall be deemed to have been received:22.1.1 if hand-delivered, at the time of delivery; 22.1.2 if sent by mail, two days after the date of posting. In proving service by delivery:22.2.1 by hand, it shall be necessary only to produce a receipt for the notice signed by or on behalf of the addressee; 22.2.2 by post, it shall be necessary only to prove that the notice was contained in a pre-paid envelope which was duly addressed and posted first class. Data Protection All information provided to SAL will be treated confidentially and shall not be passed to third parties, except where necessary to complete a sale transaction. SAL reserves the right to pass on information when required by legislation, government authorities or the courts. SAL shall also have the right to use any personal information to notify you of further auctions and future events, unless you notify us that you do not consent to receive notifications of future events.

Liability of SAL and the Seller Buyers are solely responsible for ensuring that Motor Vehicles are safe for use, roadworthy (if a road going car) and comply with all relevant laws and regulations in force in all relevant jurisdictions and for ensuring that any necessary test certificates are in force It is the responsibility of the Buyer to carry out such inspection as he thinks necessary. In bidding for any Lot, the Buyer acknowledges that he does not rely on any representation made to him by SAL, its employees or agents.

Governing Law Any transactions to which the Terms apply shall be governed by English Law and the Courts of England shall have exclusive jurisdiction to settle all disputes arising in connection with all aspects of all matters or transactions to which these Terms relate or apply.
