As president of the Guam Association of REALTORS®, I have had the privilege of meeting with our members and having many conversations with Arnold Jose • President them about our real estate industry and their business. I know you’ve been reading negative stories about the housing market nationwide and even Guam has recently been experiencing a slowdown, but don’t let that dampen your enthusiasm for helping folks achieve the American Dream. Those who have been in the business long enough recognize that our business is cyclical. To those weathering their first slowdown, here’s my advice: Real estate is a long term- investment. The boom created a misconception that real estate is a high yield, short term investment. It’s not. And we can all help drive that message home to consumers. There’s no such thing as a bad market. Regardless of where we are a in a cycle, there are always plenty of people ready to buy and sell. Today, buyers have more choices and favorable interest rates. With your help, they can put together a good deal. Bad news should be put in perspective. The unprecedented tumult in the financial markets is a time of adjustment and the market will and must heal itself. This may be the best time for opportunities to acquire real estate than any other time in history. Moreover, last month’s passage by the House of Representatives of the Veterans Construction and Extension Act of 2008 would benefit veterans across America who are homeowners as well as those who aspire to homeownership, according to the National Association of Realtors®. The House passed H.R. 6832 in a bipartisan effort. “As leading advocates for housing issues,

Realtors® have a long history of supporting veterans and the causes that matter to them, such as affordable housing. “Our 1.2 million members appreciate the leadership of Reps. Bob Filner, DCalif., and Steve Buyer, R-Ind., in helping pass this legislation, which will go a long way in helping veterans buy and keep their homes.” Three provisions in the legislation are critical to help veterans during the current housing turmoil. H.R. 6832 would help more veterans who are homeowners refinance their loans into safer, more affordable loans backed by the U.S. Department of Veterans Affairs (VA loans). This would benefit veterans who have fallen victim to risky subprime loans that will be unaffordable when their adjustable interest rate resets. In addition, the legislation would make VA loan limit increases permanent, helping veterans who live in high-cost areas. The bill would also extend the VA’s authority to offer adjustable-rate mortgages to veterans. That measure would make homeownership more attainable for military families and personnel who often have to move more frequently than their civilian counterparts. It is important to stop and recognize America’s brave military personnel, both active and retired. Today’s action by the House of Representatives is one way of showing our ongoing appreciation to all of those who have put their life on the line so that all Americans can continue to enjoy the freedoms our country provides, including the dream of homeownership. “We look forward to Senate action to finalize this bill, helping ensure that every veteran who can afford to own a home and wants to do so will have the opportunity and that everyone who responsibly owns a home is able to keep it.” This action by the House of representatives will certainly have a positive impact on Guam’s real estate industry as we all prepare for the population boom that is just around the corner.

MARKET REPORT October 2008 Bullet Points derived from 2nd Qtr. 2008 data from W. Nicholas Captain of the Captain Real Estate Group of Companies. 2008 Market slowdown exacerbated by series of local government actions that have resulted in a reduction in the potential profits associated with real estate investment and development. Wide gap between buyer and seller expectations is a significant factor in 2008 market slowdown.

Commercial property sales led decline with annualized sales down over 70% over the first half of 2008. 2nd Quarter 2008 residential sales is second strongest quarter in over a decade + median home price $199,100. 2nd Quarter 2008 apartment building sales activity declined over 60% mainly due to “limited supply of quality product”. 2nd Quarter 2008 condominium sales slowest in over two years + median condo price $130,000 (includes a $1.6M Tumon beachfront property)

You may just be of the species “Buildus YourOwnus.” This means that you have specific ideas of what you want and customizing is the only way to get where you want to go. You are a very brave and unique species indeed as choosing to build a home instead of buying an existing home is an enormous commitment in time and resources. The payoff; however, can be extremely satifying!

Dream Your Plan & Plan Your Dream It is possible that you’ve been working on the plan or design of your home for a very long time without even knowing it. You may have a distinct affinity for Spanish style, a preference for two-stories or a desire to have a master bedroom suite—Jacuzzi tub included. All these bits and pieces are the start of what will eventually be “home”. To get the dream on the path to reality it takes focusing on a plan. As the eventual home owner, you need to decide on three basic things: Where, what, and how much. Where will you be building this home? Hence, you will need some land. What size, design, and floor plan do you envision? Finally, how much is your budget? Many on Guam are fortunate enough to get family property to build upon. No free property? This is a good time to contact a Realtor® who can help you find the piece of land that suits your needs and wants. Other “where” considerations might be, current infrastructure, quality of neighborhood, school districts, etc. Once you’ve secured the site, the next aspect of the plan is “what” are you going to build. Do you want a singlefamily home or a duplex so that you can rent out a unit to cover a portion of the mortgage? Have you scoured the internet or magazines for home plans? Simultaneously, you should be working on the “How Much“ portion of the plan. In previous articles, we’ve discussed pre-qualifying at a lending institution. Much of the same process will occur when getting a loan to build a home, except for the initial loan phase being a “construction loan” which is basically an interim loan that precedes the traditional mortgage loan. Just as if you were purchasing a home, when building a home you must still know how much you can qualify for which in turn will determine what kind of house you can build. 10 CasaGuam ◆ October 2008

Talo Verde Estates Valencia Series C Architect - Yay or Nay? Once financing has been addressed, the road forks into a couple of options. On the one hand, you can take all of your ideas, magazine cut-outs and sketches on napkins to an architect. On the other hand, you can go directly to a contractor who may have a draftsman on staff or an affiliation with an architect. The benefits of going to an architect are numerous; however, finding the right architect for your project may be challenging. John Setiadi of Setiadi Architects says, “It is important that you hire a duly registered Architect that understands your requirements and your personal taste. Hiring the wrong house designer, no matter how cheap, will be costly in the long run.” Many

people forego the services of an architect simply because they are afraid of the cost. “The cost for hiring an Architect is a small fraction to the cost of the construction, furnishing and other related expenses, to create your very personal ‘dream home’,” adds Setiadi. An architect’s fees are generally based on scope of work so it is difficult to give a cookie-cutter cost. Setiadi says that a homeowner should ,“review the Architect’s work before hiring him or her. A good Architect has his/her apparent style; and it is important that you like his/her previous work. Hire an Architect that you are comfortable to communicate with; and [you] are able to understand each other.” www.CasaGuam.com


Feature Executive secretary for the Guam Contactor’s Licensing Board, Tommy Morrison, recommends that every consumer address the following before selecting a contractor: Verify Contractor’s License. Obtain copies of his/her license. Call the Contractors License Board to make sure his/her license is in good standing. Also don’t take on good faith that the license won’t expire during your said project so confirm expiration dates to. Check the term of contractor’s liability insurance. Experience. How many years have they been in the business? [Which also raises the question of financial stability and ability to stand behind a warranty]. References. Look at your initial mode of contact. If they do or don’t come by way of reference from associates, friends, or from those already in the business. Still do your part. Become clear on the issues of cleanliness, professionalism and regard for the project overall from inception to beyond completion? Do their projects come in on budget and on time. * Obtain at total of at least three references in any case. Obtain and check references with names, addresses, and phone numbers. Also, ask the contractor for jobs in progress where you can make a site inspection. Cost. While the low bidder is favorable to many, and is usually most often chosen, consider what you may be paying for in trade for the lesser price; if at all. Is quality of materials possibly being sacrificed?

The benefit is a well-designed house for the lifetime of its existence. No awkward beams, no light switches at the far-end of a room requiring you to walk in the dark to flip it on, no doors opening into doors. These are many common mistakes that occur in homes on Guam that lack proper planning. Of course if this is cost prohibitive, you can go straight to the general contractor who may have a draftsman on staff or an affiliation with an architect. You should still be able to come up with a reasonable layout and elevation. It means you as the homeowner must be diligent about details which may be missed with this process. www.CasaGuam.com

Do Your Homework

Get at least three written, detailed estimates. If there are large differences in price, get an explanation.

Choosing a contractor may be one of the most critical aspects of the project. In this magazine, we have published a listing of all licensed contractors which now number in the several hundreds. You will have to do some homework. Fortunately, there are resources out there. Both the Guam Contractors Licensing Board and the Guam Contractor’s Association are helpful resources to ensure you find a reliable contractor. The Guam Contractors Licensing Board (CLB) is a government entity created to protects consumers by licensing and regulating Guam’s construction industry. The CLB works to assure quality of and fair construction practices exist to protect all consumers of Guam.

This might all seem like time consuming, tedious work, but it is the only way to avoid crisis situations that the CLB deals with when people haven’t done their homework on the front end and are seeking help when their contractor hasn’t filled their obligation, leaving the homeowner high and dry in some cases. The Guam Contractors Association is a nonprofit organization whose members “subscribe to a code of ethics and are held to a higher standard of work ethic and quality of craftsmanship.” According to GCA executive director James Martinez, “This is beneficial to consumers in selecting a contractor knowing that our contractor members are held to October 2008 ◆ CasaGuam 11


Feature these higher standards. Consumers can come into our office for an updated listing of all our members. We also offer consumers a guide on how to select a contractor.” The CLB and GCA are often mistaken for one another. Martinez says that consumers often call the GCA office to file complaints which are refered to the CLB. “Both organizations want to ensure that the consumer is protected from fraudulent acts Tommy Morrison Executive Secretary, and inferior workmanship,” Guam Contrators LIcense Board explains Martinez. You as the consumer should know that there are resources and recourse available.

Break Ground Your contractor will deal with government permits, soil testing, topographical surveys of your property, among other things just prior to breaking ground. If all goes well, you will soon see a nice, smooth clearing and chalk lines that show you where your walls will go. (Be aware that, in chalk form, your house will look tiny—even if it is 2,000 sq. ft. Just an optical illusion). Once actual construction starts you should be prepared for a rollercoaster ride as things never go exactly as planned. Changes will be made. Outlets will be moved. Walls may even be broken. You just never really know for sure until the process unfolds. Unless you’ve gone with a contractor that offers turnkey construction, which means that you are not obligated to disburse funds until construction is completed, your bank will be disbursing funds to your contractor at different stages of construction. Since construction

loans are often based on high interest rates, timing is going to be crucial and often nerve-wracking. There will be a push and pull between you as the homeowner and the contractor in terms of deadlines, changes, and disbursements from the bank which require you to sign off on completed work.

Timing is Everything In today’s construction market, timing has become more critical than ever. In terms of the actual construction, Guam’s weather can wreak havoc on timelines. Will the pouring of the roof be delayed by a week or two because of rain? If a typhoon is coming, all debris will have to be cleaned up, scaffolding taken down and interest on that construction loan will not wait until the storm passes. Ideally, you want the bulk of your construction to take place during the dry season. Also, with the real estate market conditions, it is often difficult to tell when contractors who do single unit, residential homes will be readily available. A mere six months ago, it was almost impossible to find a contractor because many were busy with bigger projects such as developments or commercial construction. Today, it may be easier to find a contractor because a brief lull in the marketplace and the moratorium on central-Guam construction.

Catch 22 In the final weeks of construction, when the finishing work is being completed and anticipation on both the your part and the contractors part build, is where some significant stress may occur. Home owners are often critical about finishing as it deals with the aesthetics of the home. You may want walls smoothed, light fixtures straightened, tile repositioned, grout color changed, among a host of other details that need fixing.

The CLB urges consumers to follow these tips before selecting a contractor: • Hire only licensed contractors and ask to see the license • Verify the contractor’s license by going online at www.clb.guam.gov or calling the CLB Office at 649-2211 • Check if the contractor is in “Good Standing” with the CLB • Get three bids, check references, and get a written contract • Do not pay cash, and do not let the payments get ahead of the work The contractor may ever so subtly, or blatantly, want you to signoff on completion so that final disbursements will be made from the bank. You will be in a rush to get out of that construction loan because you will now be paying big interest on the full amount of the loan. The contractor will be in a rush to get his crew to a new job site. You will be in a rush to get your occupancy permit and move in to your new, beautiful home. Take a deep breath and know that this will all pass. You have endured and will soon have keys in hand.

oday, more and more Guam homebuyers are starting their home search on the internet. Guam homebuyers are not alone in this trend as over 77% of homebuyers nationwide begin their home search online according to the National Association of REALTORS®. Over the past several years the ‘on-line’ experience has been enhanced to bring more property information to the buyers and sellers of real estate. Five years ago or so, the first real estate websites allowed visitors to view and search the inventory of all real estate companies that were members of the Multiple Listing Service (MLS). The visitor could perform searches but there was no method to save or retrieve the information later. Times have indeed changed and technology has caught up with the buyer’s desire to save and retrieve their searches. Recently Today’s Realty launched a FREE new service on their ever popular website, www.guamhome.com, that allows visitors to create a personal webpage called a portal. This portal allows you to save your favorite properties, save ‘what if’ properties and even ‘reject’ properties that didn’t make the list. The Hawaii-Guam Connection

f you’ve seen a Horizon Properties ad, you’ll know that Maria Miller is the “Hawaii-Guam Connection”. Miller has been a part of the dynamic real estate industry in Hawaii for 30 years prior to bringing her experience right here to Guam less than two years ago. One might think it was the booming market conditions that led Miller west; however, she had a more divine inspiration. “After visiting Guam on the insistence of a friend, my Principal Broker in Hawaii, Eric M. Watanabe, thought it would be good for us to check out Guam. He contacted the only CCIM designee he found in Guam, Chris Felix, and we started selling investment properties in Guam,” explains Miller. “We saw the need to maybe open an office here to help take care of the rentals investment properties we were selling. I was approached about it moving to Guam and was praying about the decision when I decided to just come, spend a month here, take the real estate course and see what happened. Four of us ended up coming. Besides myself, my partner Jocelyn Marquez, Eric’s daughter, Ashley Watanabe, and my daughter Carmen Miller. We came, spent a month, studied hard, took the course, fell in love with Guam—the food, its people, the sunsets—and failed the real estate exam! But God had other plans and we are all back here!”

Miller admits that there are marked differences in the industry on Guam and in Hawaii. “Hawaii is a very sophisticated market – it is innovative and follows closely behind California. There are other states on the Mainland and real estate boards that ask Hawaii for help and learn from the Honolulu Board. Honolulu was among the first to tackle and solve the ‘agency’ question well over 10 years ago,” says Miller. “All sales and transactions are public information and online. You can find out in seconds who owns what, how much they paid for it, the original mortgage amount and dates of purchase. As well as the history of everyone who owned it from day one and also a ‘footprint’ type floor plan of the improvements complete with dimensions,” she further explains. Miller does say that Hawaii is behind Guam in the use of the convenient electronic lock box system which allows other Realtors access to show a property. “Guam, I find refreshing and challenging. The forms, in my opinion, need revamping and need to be more applicable to this market”, states Miller. “I find the showing of property much easier here,” she adds. “Also, there is much more comradeship here among Realtors. I sincerely enjoy the small community and the friendship everyone has extended to us,” expresses Miller. Another unique distinction that Miller holds is six acronyms after her name!
