Tax Incentive Extended and Expanded!

s part of the National Stimulus plan, an up to $8,000 tax credit was put in place this past year for qualifying first time homebuyers in the mainland U.S. and in Guam. While this was set to expire by November 30th, 2009, the U.S. Congress has extended and Expanded this credit. Congress has passed new legislation that now: • Extends the First-Time Home Buyer Tax Credit of up to $8,000 to first-time home buyers until April 30, 2010. • Expands the credit to Current homeowners who are eligible for a $6,500 tax credit, provided they have lived in the home they are selling, or have sold, as principal residence for five consecutive years in the past eight years. • Income limits for eligible home buyers are expanded to $125,000 for single buyers and $225,000 for couples. (The purchase price of the home cannot exceed $800,000.)
Special Benefits for Military buyers! Additional provisions provide for special benefits on the law for Armed services members: • Armed services members, as well as intelligence service and foreign service personnel, who are on active duty and out of the U.S. for 90 days during any part of 2009, get an additional year to buy their homes, to May 1, 20ll. • Another benefit is a waiver on the time of occupancy of the home purchased with the tax credit. Homebuyers who purchase their home using the tax credit must use that home as a principal residence for a period of no fewer
than three years, or must forfeit the entire credit. Military, intelligence and foreign service members do not have to repay the credit if they have to sell their home after fewer than three years occupancy due to official business. The Guam Association of REALTORS® acting in conjunction with REALTORS® across the nation with the National Association of REALTORS® worked diligently to help encourage Congress to get these provisions passed. Guam delegate Madeleine Bordallo was extremely supportive of these provisions, and Guam REALTOR®, Liz Duenas, of RE/MAX Diamond Realty headed the Guam RPAC committee and was able to push Guam Association of REALTORS® to the highest level of percentage support of all the National REALTOR® organizations at over 300% of goal, for this cause which will benefit the housing market and the homebuyers on Guam and the U.S. If you have not already, I encourage you to look into the housing market now and consider taking advantage of this tax credit and the low interest rates. D
uring the first half of 2009, especially considering the temporarily disrupted market conditions, there were a remarkable number of notable transactions. The first quarter, for the first time on record, reflected zero transactions priced above $1.0 million. The highest priced deal of the quarter closed in March, when Manu Melwani sold the leased fee interest in a former Royal Palm Tumon land site to Becco Guam, Inc. at a recorded price of $950,000, slightly less than the reported March 2008 price of $1.0 million. Also, a high end Tamuning house sold at $850,000 and another house sold at $550,000 during the first quarter. After that, all sales reflected prices below $500,000. Now that’s quiet. During the second quarter, the market recovery was evident as the increase in notable sales included 10 transactions closed at prices above $500,000. These sales included a $3.1 million industrial property acquired by Jerry Kramer’s Pacific International Inc. In May 2009, Triple J Enterprises sold the MKI Air Conditioning commercial property in Tamuning (behind McDonald’s) to Victorino and Conchita Reyes at a recorded price of $925,000. meter, approximately the same price it sold at in November 2007. The highlight of the quarter involved the sale of a Talo Verde cliff line land sale from Pacific Rainbow to Mr. Marchal at a recorded price of $800,000 or $521 per square meter. Lastly notable, a Tumon land sale reflected $236 per square meter, down by nearly 15% from its prior 2007 sale. The good news in Guam’s real estate market also includes the return of high-end housing sales, which shrank to a nano-market during the first quarter. Clearly the fear and uncertainty caused by global economic and credit market fallout is on the decline as 21 houses sold at prices above $350,000 and 5 houses sold at prices above $500,000 during the second quarter. The second quarter also reflected four condominium transactions at prices above $325,000 which is good news for sellers. But with the commencement of the U.S. military’s largest construction project since World War II now less than one year away, why would anyone want to sell? Guam’s first experience with $1 billion per year in construction alone is already fixed for FY2010. We expect further increases in median prices for housing because an increasing number of sales will reflect new and higher priced product.
The bad news for Guam’s real estate market is that activity, although increasing, remains weak. Our downward revised expectations (again) for overall 2009 sales volume reflects $225 million, down 42 percent from 2008 (which was down by 55 percent from 2007). Strong growth from the first quarter was expected because that period was weaker than the height of our local “depression” during 2002 and 2003. The bad news also includes generally weaker overall economic conditions with significant job losses reflected in the tourism sector. The ugly news for Guam’s real estate market involves a lack of foreign investment. Historically,
Guam’s market has significantly increased only when foreign investment is flowing into real estate acquisitions and development. Korean investment has shifted from acquisition into construction which is positive, but we need foreign capital injections to push real estate to the next level. The lack of foreign investment creates what may be the last good buying opportunity for many years. We expect strong market conditions to coincide with massive military construction projects between 2010 and 2015. The next 12 months may involve the last great Guam real estate investment opportunity during our lifetimes.

lmost every media outlet has been preaching that for Guam, it’s the time to buy real estate. With the impending military buildup and interest rates at a low, this is definitely true. However, before you go on a buying frenzy, there are several factors to consider and it’s important to work with a real estate agent that will help you work through these steps. So how do you choose an agent to work with? First of all, it is important for buyers to know the difference between a Realtor and a real estate agent. A Realtor is acknowledged by the Guam Association of Realtors and abides by a set of ethical standards in addition to getting a real estate license. Eddie Styers, a financial expert and business owner, said that as someone who has bought more than 10 houses over a period of 30 years, the most important thing that makes a good Realtor is someone who will return phone calls and e-mails in a timely manner. “You may laugh,” he said, “But there is nothing more aggravating than making a call about a house and not hearing back for three or four days. ... I am not talking about an immediate call but one within an eight- or 24-hour period would be nice.” In addition, a good Realtor should be in good standing with the Guam Association of Realtors and should have advance knowledge in tax benefits, variable values and should have proven experience, not to mention above average communication skills. Trinitas Sarmiento, associate broker at BHI Realty said that good Realtors are approachable and knowledgeable. “Most first-time homebuyers want someone they can talk to, someone that can help them with what they want, not what the Realtor wants to sell.” Most people don’t know much about real estate when they buy their first house. Many homeowners will be shocked at how much they never knew about homebuying before delving into the process. If you aren’t careful, you can get into a lot of financial trouble. (continued from previous page) Toni Johnson, associate broker at Century 21 Realty Management Co. said that before looking around at properties, it’s important to check out various lenders and learn about the financing packages. “Figure out what you qualify for and what your bottom line costs are,” Johnson said. “Always bear in mind the ability to resell when you are purchasing.” Though it isn’t the responsibility of a Realtor to make sure you know what you’re doing before buying a house, try to find someone who will give you a lot of information about homebuying — the good and the bad — and not just what you want to hear. Vicki Anderson Estes of Today’s Realty said her definition of a good real estate agent is someone who will listen and pay attention to what a client really needs. And it’s important to understand that each client is different. “Communicate with me on my level, not yours,” said Styers. As the buyer, you need to know that your Realtor is listening to what you want and showing you properties that meet your needs and work for you rather than what’s in his or her best interest. “There is nothing as frustrating as going out with a Realtor who shows you all their listings first and talks them up as great deals, even when they are not what you want at all. Another experience is a Realtor that takes you to their house that has been remodeled so they can get a feel for what you want. If you cannot figure out what I want by our discussions and the houses I bring to your attention, something is wrong,” Styers said. All in all, look for someone who gives you common courtesy and respect. While a Realtor definitely knows more about real estate and it’s in your best interest to heed their advice, he or she is profiting from your business and they owe you a certain amount of respect. Indu Shankar, Realtor at Coral Sea Realty said that the number one message she’d like to give her customers is that it’s always better to work with a professional for any service you choose. “If you intend to buy, sell or lease real estate on Guam, always work with a knowledgeable Realtor, who will guide you and look out for your best interest.” So now that you have an idea about what makes a good Realtor, where do you find him or her? The first step is to ask around. Ask people who have bought or sold a house recently and inquire about their experiences with their agents. Ask lots of questions. A good Realtor will be organized and help you remember what you can’t remember as the process gets more complicated. There is no exact science to finding “The One” but it’s not a decision to be taken lightly. Find someone you’re comfortable with and if you feel you’ve made the wrong choice, feel free to walk away. 14 CasaGuam December 09

was barely 24 years old and a family friend approached me and asked me if I had my own home. I was like, “Nope, I’m just renting right now—owning a home is just a dream for me. I just work, pay bills and chill.“ The gentleman replied, your dream has just come true. So, I wondered how could this 20 something guy, staying with a room-mate paying $350.00 a month in rent and making a little more than minimum wage be able to buy his own home? No way! He replied… Yes way! So we sat down and he asked me about my income, what my monthly payments were (such as car payments, personal loans, stuff like that) and then he ran some numbers and said, “well you can probably get a loan for somewhere around $45,000”. At the time all I had was just $100.00 in savings. So he figured out how I could get my own place, with my own keys for no money down and move-in within a few weeks. The place was something I could afford and more importantly it was mine. I could paint the walls whatever color I wanted; I could change the floors, the light fixtures, just about anything. It was the ideal place at the time and it set me on a journey that I’ve never ventured from. As I continued along, my needs changed and I ended up buying places that fit my ever-changing requirements. No, my first home did not exactly match my dream. It was not the two story home, with 4 bedrooms, 3 baths, a hot tub and a five minute walk to the beach. But, it was a great first step towards reaching my home ownership goals. By the way, if that gentleman had never approached me many years ago I would probably still be renting today. While you ponder this article, ask yourself this... will you realize your dream? Or help someone else realize theirs! Consider yourself approached. Make that call today and let’s get to work on buying your first home

icki Anderson Estes admitted that when she graduated with a music degree, she had no idea that she would eventually become a REALTOR®. “Like some people who major in English or psychology, I basically wanted to get an education and hoped it would help me later when I chose a career path,” she said. Estes said she got married right after graduating from college. Her husband was in the military and this is what eventually led them to settle in Guam in 1987. Prior to going into real estate, Estes was the marketing director for a local business magazine, which helped her build relationships in the community. “Anthony [Godwin] approached me and encouraged me to get my license, so I looked into it. But it wasn’t until about a year later that I went into it full time,” she said. Though some real estate agents often go through a learning curve, it was a smooth shift for Estes, having a background in advertising and knowing key players in the business industry. “My marketing background made the transition relatively easy for me,” she said. But she added that the biggest challenge was having to learn the intricacies of real estate. As she honed her craft, she developed a knack for customizing her service according to the needs of her clients. During her 10 years of experience, she said the most memorable

moments are the ones when she helps someone who is really in need. “These are people who would never think they could own their own home. If I find a way to make that happen for them, then it makes me happy.” She added that the best part is when they’re closing on a deal, because it’s when it hits that she has helped people make home ownership a reality for them. On the commercial end, she said she also finds it rewarding when someone she helped acquire real estate does well in business. “It’s nice to see them succeed,” she said. As a Realtor, Estes said her personal goal is to simplify the process of buying and selling real estate and to satisfy everyone’s needs to the best of her ability. “My extensive experience and proven track record are factors you can count on when working with me,” she said. In her opinion, a good Realtor is someone who really listens to what the customers want and need. For those looking to find a good Realtor, she said personal referrals from friends are probably the best way to go. “These are the people who have first hand experience of what it’s like to work with a particular agent,” she said. Estes added that everyone’s needs are different, so it’s up to the buyer to go with someone they feel comfortable with. “Interview your prospective agents, and really look for someone you trust.”

Outdoor Chirstmas Lighting Safety Tips By Dave Donovan

ecorating your home for the holidays is always a fun and exciting time, but it's no time to get lazy. Hundreds of homes each year are damaged by faulty electrical wiring at the holidays. Whether the cause is overloaded circuits or a bad extension cord, you have to make sure you're as safe as possible and using the best quality equipment you can find. Here are a few simple ways you can ensure that your outdoor Christmas lighting is as safe as possible. • Avoid using the larger seven-volt light bulbs. Sure, they are bigger and brighter, but they also burn much hotter than mini Christmas lights. One of the most common causes of holiday-time house fires results from these bulbs being too close to gutters filled with dried out leaves. • Make sure that the strings of lights you are using outside have built-in fuses on the lines. Sometimes, these fuses are located in the actual plug. 24 CasaGuam December 09
• Make sure to use Christmas lights that are designated for outdoor use only. If you use indoor-rated lights, they may not be able to withstand the weather conditions which will cause them to break down much faster. • You should only use Christmas lights and electric equipment that has been tested and verified by a reliable testing laboratory. Two reputable laboratories are UL and ETL. Any equipment or lights that have been tested safe will have one of their logos on the packaging. If it doesn't have it, don't use it! • If you have a string of lights with a blown bulb, be sure to replace it with a bulb of the exact same wattage. • Never tap into your home's feeder line to power your outdoor Christmas lights or hang decorations on the line. • Avoid using nails, tacks or metal staples to secure your outdoor Christmas lights. Use insulated hooks instead, and be sure your lights are strung tightly to avoid damage from the wind.
• Use only outdoor rated extension cords. Plus, avoid connecting more than three strings of lights to a single extension cord. • All plugs should be plugged into a GFCI protected outlet when used outside. • When it comes time to take your Christmas decorations and lights, never remove the strings of lights by pulling on the wires. This causes the wires to break free from the sockets and the bulbs to break. Decorating for Christmas doesn't seem so easy anymore, does it? Well, in truth, these tips don’t take that long to perform and imagine having to deal with a fire on Christmas Eve. Keep a Cut Christmas Tree Fresh By Steve Nix, About.com Guide

ome people believe Christmas just isn't Christmas without a real Christmas tree. Here is an easy guide that will help you preserve that perfect tree whether you purchase it from a neighborhood lot or a Christmas tree farm. These steps should help you keep a Christmas tree fresh through the holiday
Here's How: 1. Refresh the tree by making a straight cut, taking one inch off the butt and immediately place in water. This will improve water uptake. 2. Place the tree in a stand that can hold at least 1 gallon of water. You should expect the tree to take up additional water. Water the new tree until water uptake stops. 3. Always keep the base of a tree in water. If the base dries out, resin will form over the cut end and the tree will not be able to absorb water and will dry out quickly. You don't need anything other than regular tap water - drying out deters future water uptake and will need a new cut. Commercially prepared mixes like aspirin, sugar and other additives introduce into the water are not necessary. Research has shown that plain water will keep a tree fresh. 4. Check for worn Christmas tree light electrical cords and always unplug at night. Use UL approved electrical decorations and cords. Using miniature lights produce less heat and reduce the drying effect on the tree or any chance of fire. 5. Take down the tree before it dries out. Many fresh cut trees if properly cared for (using the first five steps) should last at least five weeks before drying out. Some species keep their moisture longer that others.
Tips: 1. Cutting a refresh cookie off the tree base is important only when trees have been cut for over 4 hours. 2. For easier watering, buy a funnel and a 3 to 4 foot tube. Slip the tube over the funnel outlet, extend tubing down into the tree stand and water without bending over or disturbing the tree skirt. Hide this system in an out-of-theway part of the tree.season.

REALTOR® Leadership Under the Law By Peggy Araullo Llagas Surely members understand their fiduciary duty to their clients, but understanding the fiduciary duty to the association when they assume a leadership role; perhaps not. Here’s a simple overview: 1. What kind of legal duties do elected association officers and directors have? Members elected or appointed to service as association officers and directors owe fiduciary duties to the association by law. In addition to attending to the affairs of the association as they would their own businesses, elected or appointed leaders are required to make a genuine and diligent effort to carry out their designated responsibilities with the intention of advancing the association’s interests. 2. What kind of fiduciary duties are there? There are both general and specific fiduciary duties. General fiduciary duties include the responsibility to act at all times in good faith and in the best interests of the association. Specific fiduciary duties include care, loyalty, and obedience: The duty of care involves discharging one’s responsibilities in a reasonably attentive and diligent fashion. For example, it requires directors to prepare for, attend, and pay attention during directors’ meetings. A director who is distracted by his or her BlackBerry or otherwise attending to real estate business during meetings may not be adequately satisfying his or her fiduciary duty of care. The duty of loyalty requires always acting in the best interests of the association, rather than in the interests of oneself or another person or entity. For example, if a proposal before the association’s board of directors is good for the association and its members generally, but not helpful to a director’s business, the duty of loyalty requires that the director support the proposal. The duty of loyalty also includes avoiding and declaring conflicts of interest and abiding by the “Corporate Opportunities” doctrine. This doctrine requires that if a member learns of a business or personal opportunity in his or her capacity as association leader, the member may pursue it only after the association has elected not to do so. The duty of obedience requires leaders to abide by the bylaws, policies, and other governing documents of the association, 32 CasaGuam December 09
and to support decisions of the association’s board of directors. For example, even if an association director votes against an issue before the board of directors, once that decision is made, the director must support it. A director who “badmouths” or otherwise undermines the board’s decisions is probably violating his fiduciary duty of obedience and loyalty. Other specific duties include the duty to disclose relevant information, protect as confidential other information, and to safeguard and preserve the association’s assets by ensuring that proper procedures and controls are adopted and followed. 3. How should leaders handle conflicts of interest? As fiduciaries, association leaders are obligated to avoid or resolve conflicts of interest. Typical conflicts involve transactions between the association and entities in which the leader has an interest. For example, listing the association’s building for sale with the association president’s real estate firm could be a conflict of interest if the terms or conditions are more favorable to the president’s listing firm than another listing firm might be expected to offer. Resolution of such a conflict may require that it be approved by the association’s board, but that the president—the party enjoying the benefits of the transaction— not vote or otherwise participate in approving the transaction. Another type of conflict can occur when a leader awards benefits to certain members or groups of members. The key to resolving conflicts is to identify them, preferably as early as possible, and to resolve them so that an association leader does not participate in an action that may afford him or her unique benefits (or appear to do so) at the expense of the association.
