ell, half the year has gone by already. It sure seems like a fast year for me. Business is slow but work seems harder than ever. It seems this year I have to work a lot harder to make the same money I made a few years ago. Well I hope this will all change next year with the Military buildup and construction projects that are planned. I believe we really need this buildup and construction and I believe we will solve our environmental problems and quality of living issues and end up in a much better economic and living conditions than we are right now. I know there will be some hassles and troubles, but we have had many of those over the last 35 years I have lived here and we have faced them and solved them. I think sometimes we focus too much on the negative impacts and problems and forget to remember the positive and good things that will also come our way and happen. I recently went to the states and Philippines and see how tough things are in those countries and how hard it is to get a job there. I keep getting letters for friends trying to come back to Guam from Vegas or Florida or California where they went 10-15 years ago to get jobs. Things here are rough but much better than in the states or other countries and I believe one of the main reasons is the Military spending and proposed buildup. A lot of money has already been spent and lot more is to come and this will help us get thru this world wide economic crisis. I honestly believe we will look back in 5 years and see how lucky we got. These thoughts are my own and not necessarily the belief or supported by the Guam Association of Realtors.

Transaction Recovery Stalls Amid Build-Up Confusion

A

fter three consecutive quarters of strong growth in sales volume, Guam's real estate market stalled during the first quarter of 2010. The most recent quarter reflected $63.7 million in activity, down 28 percent from the prior quarter, but up 76 percent compared to the global financial crisis-impacted first quarter of 2009. The stalled recovery is partially attributable to the on-going confusion and mixed signals from Japan regarding the military build-up. In the residential sector, the 135 single family units sold last quarter involves the second slowest quarterly activity in six years, and down by 17 percent compared with the prior quarter. However, based on historical trends, Captain Real Estate projects 20 percent growth for next quarter, or a more stabilized level of 162 units sold. Although transaction activity has declined, prices have remained relatively firm with the median house price of $221,000 reflecting the third highest average on record. The highend market reflected additional positive results with seven houses sold at prices above $500,000. A combination of more units sold and fewer units for sale reduced the high-end market inventory to 1.2 years, still relatively high, but the lowest high-end inventory statistic in years. Condominium unit sales activity also reflected mixed results with 48 units sold during the first quarter of 2010, approximating units sold last quarter, but up 19 percent from a year earlier. This sector recorded its fourth consecutive quarter of growth since the market bottomed in Q1 09. The 6 CasaGuam June 2010

condominium median price of $135,500 is effectively unchanged compared with the first quarters of 2006 and 2009. The high end condominium sector reflected additional positive momentum as 5 units sold at prices above $400,000. The commercial sector of Guam's real estate market remains extremely slow with only three recorded sales during the past quarter reflecting $2.3 million in aggregate transaction activity including zero sales of multi-family residential properties. This sector is dominated by a wait and see mindset with most investors optimistic regarding future market conditions. Land sales during the quarter were positively impacted by the massive

GWA connection fees that developers and owner-occupants rushed to beat. The negative impacts of these fees, which significantly increase the cost of homeownership, are likely to impact future statistics. Along with the dearth in commercial sales, commercial real estate lending plummeted in Q1 10. In a rare example of prevailing forces in this sector, First Commercial Bank earned 1st place with a $2.35 million deal with Six D Enterprises. 2nd place went to Bank Pacific with a $1.6 million deal and Bank of Guam recorded a $1.5 million mortgage. Other lenders with $1.0+ million real estate loans closed in the first quarter include First Hawaiian Bank, Coast

360, Community First, and ANZ. Overall real estate market conditions are improving and our projection of 25 percent growth in sales for 2010 remains unchanged; however, potentially massive infusions of foreign investment could impact final figures. Increased government fees and an end to the first time homebuyer tax credit are expected to negatively impact the residential sector although the recovery in the high-end sector is expected to continue along with demand growth from the first wave of military build-up related personnel. The commercial sector will likely remain soft until economic growth spurs increases in rent and occupancy levels.

Feature hroughout the world people have awakened to the importance of the system of free enterprise‚— a system of private individuals working in the freedom of the market place in competition with each other, creating wealth and employment for society and providing the basis for stability. The private sector must find solutions for society’s needs. Proposals to encourage and enable more Guamanians to work, prosper, save, invest and realize their ambitions can only come from an organization that is free from bureaucracy and where every member has a say. The Guam Chamber is such an organization. Below are some pieces of information found on the chamber’s Web site which details the benefits of investing in Guam.

The Guam Visa Waiver Program was developed to enable Guam to draft its own requirements for admitting visitors from foreign countries. Residents of 15 different participating nations are allowed to travel to Guam as tourists or to conduct business up to a maximum stay of 14 days without having to obtain a visa. Countries currently in the Guam Visa Waiver Program include: Australia, Brunei, Burma, Indonesia, Japan, Korea, Malaysia, Nauru, New Zealand, Papua New Guinea, Singapore, Solomon Islands, United Kingdom, Hong Kong, Vanuatu and Western Samoa.

Taxation

The Guam Economic Development Authority (GEDA) has a variety of tax incentives to encourage new investment to Guam. GEDA grants Qualifying Certificates to investors based on investment commitment and ability to generate new employment, replace imports, reduce consumer prices, or create vital new facilities. Qualified firms may receive:

The 23rd Guam Legislature is currently reviewing a bill (Bill No. 602) proposing tax incentives for developers of additional hotels, tourist facilities, and affordable housing units. The measure would allow gross receipts tax exemption for construction of these types of facilities and tax rebates of up to 50% not to exceed 5 years, plus rebates up to 25% not to exceed the next consecutive 5 years. Income tax rebates on certain gains of up to 50% are also provided for.

• 75% tax rebate on corporate income tax for up to 20 years; • Abatement on real property income taxes up to 10 years; • 75% rebate on corporate dividend tax up to 5 years; •s Abatement on gross receipts tax on petroleum and alcoholic beverages made in Guam up to 10 years.

Tourism Development

Insurance Industry Incentives Guam Public Law No.23-109 was introduced to broaden our economic base by capitalizing on Guam’s unique geographic location to become a financial/insurance capital of the Pacific. The measure authorizes the issuance of Qualifying Certificates for Guam insurers and clarifies the tax treatment of captive insurers. Companies locating their Pacific headquarters in Guam will be able to operate aggressively both outside of and within Guam without paying taxes on anything locally, while having an advantage of being located in a modern American community with some of the world’s finest communication tools, access to American courts and to the American and health systems and yet remain free of local taxes on their worldwide income.

Foreign Sales Corporations The Deficit Reduction Act of 1984 provided to U.S. manufacturers, architects and engineers, selling in foreign markets an opportunity to minimize the U.S. income tax on the profits of such sales. The law designated Guam, amongst certain other locations, a site for the establishment of Foreign Sales Corporations (FSCs) to facilitate the tax savings. The Government of Guam has provided local legislation in support of the Federal Act. GovGuam annual fees of $400 for a regular FSC (sales under $5 million per annum) and $1,000 for a large FSC (sales above $5 million per annum) are amongst the very lowest in the world. Professional legal and accounting support is also available at reasonable rates. Over 300 U.S. manufacturers have already established their FSC on Guam. Cost savings await other U.S. companies who see fit to establish their FSC within the Territory of Guam. 12 CasaGuam June 2010

Trade Incentives Headnote 3(A)—The General Headnote 3(a) program of the Tariff Schedules of the U.S. allows duty-free entry into the U.S. Customs Territory for those items manufactured or assembled in Guam that meet certain requirements that enable Guam to be considered the “country of origin”. Reduced Tariff Rate—Another trade incentive program allows products manufactured on Guam to be imported by participating nations at a reduced tariff rate. Guam is the beneficiary of the following countries: Japan, Australia and the European Common Market nations. Requirements of each participant vary and interested exporters should contact the appropriate trade office of the particular country of destination. eal estate in Guam presents a unique opportunity. With the onset of the military build-up, many investors have turned their eye to Guam as the next big real estate investment haven. Up until 2007, the world experienced a steady increase of its financial markets. However, from 2007~2009, the world then experienced a drastic turn in both the real estate and financial markets. With the advent of year 2010, the global real estate and financial market is still recovering from the almost 2 year long recession. Any business student attending any university will attest to learning what is called the Marketing Mix, or most often referred to as the 4 P’s of Marketing. The 4 P’s of Marketing are, Product, Price, Place and Promotion. As a recent MBA graduate from the University of Guam and a doctoral in finance student from Walden University, I can attest to the effectiveness of utilizing the 4 P’s of marketing to sell a product, which is real estate. The use of the 4 P’s of marketing apply to real estate in that real estate like any other product is a product that is sellable and is desirable. The 4 P’s of real estate can clearly be defined as: • PRODUCT: What is the product? In this case, the product could be land, a house for sale or rent or a condo for sale or rent. The product needs to be clearly defined, i.e., what is the square footage, year built, bedroom & bathroom size, etc. • PRICE: What is the property worth? Every owner would like to believe that their real estate is worth more than what it is worth. An article written in the Marianas Business Journal by Captain Real Estate Group (May 10-23, 2010), dictates that the median price for a home is now $221,000.00; this article essentially lays the median price for what a house should sell for in Guam. I currently have a house for sale in Iron Wood Estates, Dededo, priced at $188.000.00 which is competitively priced well below the median price. From a rental point of view there are some landlords who believe their 2 bedroom apartment in Inarajan is worth $1900.00, but in actuality it is not competitively priced to meet market standard. It is the job of the Realtor® to educate most landlords or seller and guide them to competitively price their real estate to sell by utilizing a Comparative Market Analysis (CMA).

• PLACE: Location! Location! Location. This could not be truer. I live in Santa Rita, and so my daily commute could be as long as 45 minutes or as short as 20 minutes. The closer the home is to a desired place the pricier the product. In this case, a home in Tamuning will probably cost more than a home in Inarajan, given the location. • PROMOTION: ADVERTISING!! The most important part of selling or renting out your home/ condo/apartment/ land. Advertising of any product is imperative for the sale of any product. The Casa Guam magazine allows its reader the ability to understand and see what is going on in Guam’s real estate market, as well as help its reader to become a more educated buyer or seller in Guam’s already tough real estate market. By identifying the product, competitively pricing the product, understanding the location of the product, and most importantly promoting the product, the use of the marketing mix coupled with an educated Realtor® will ensure the successful sale of YOUR home/condo/apartment or land!

Casa Guam magazine is an excellent media for our industry — the full color photos, the glossy text really catch your eye and pique your curiosity. The process of buying real estate is as much an emotional as well as financial decision. I think the ads can really generate interest within readers who are in the market to invest in real estate.

“I

was in the right place at the right time to start a career in this industry," said Diane Lee, associate broker for The Real Estate Professionals. She had just returned to Guam in 1998 after attending Rutgers University and living in the east coast. At the time, Guam's real estate industry was booming, and said she was about to represent buyers and sellers and even segued into investing. "I can’t imagine myself in any other profession but in real estate, it still fascinates me!" Lee didn't get as far as she did without any hard work, however. She completely immersed herself in the industry, serving as as the vice president of the Guam Association of Realtors in 2005, became a Certified Resident Specialist, was named Realtor of the Year in 2006, and currently serves as a director for the Guam Association of Realtors, a post she's held since 2008. Lee also served as a past chairperson for Community Affairs, a member of the Professional Standards, Grievance, Multiple Listing and Education Committees. "Rare is the real estate transaction that doesn’t have a few hiccups along the way until close of escrow," said Lee. "After 20 years in the business and so many transactions, there is always something new to learn." She added that more often than not, she is a problem solver. "For example, some buyers may be short on funds for closing costs, so I have to structure the offer to come up with a creative way to make the deal viable to both parties. When this type of transaction gets to the closing table it’s a win-win situation and this is when I feel like I earned the right to pat myself on the back," she said. Lee said real estate professionals need to be prepared to work hard. "Contrary to what may be public perception, it’s a service oriented industry and you don’t make a lot of money overnight. It’s a competitive industry that is easy to get into but in order to be sustainable in this business you have to build a customer or client base by earning their trust and confidence," she said. Aside from dealing with banks, appraisers, surveyors, engineers, contractors, Realtors have to know the business well enough and continue to educate themselves in as many aspects of the business as possible. "I’m glad that continuing education is a requirement for keeping your real estate license because the industry is continually evolving. As professionals, especially Realtors™, we must hold ourselves to higher standards." Lee lives by the Golden Rule in life and in work — do unto others as you would have them do unto you. "It is a far-reaching concept. It encourages one to live by an ethic of reciprocity, to have compassion and respect for one another. It is a profound ideal to espouse." Upon looking back at her career, she said she would like to thank her customers. "It’s a privilege when someone lists their property for sale or asks me to represent them when they are buying a property. It means that I’ve earned their trust and confidence and not something that one should take lightly. Real estate is a “big ticket” item and probably the most expensive thing an average person will buy or sell in their lifetime. For this reason, it’s a 24-hour, seven-days-a-week job." In the next few years, Lee anticipated the military buildup and how it will affect he real estate industry. "I believe it will be in a positive way and there will be opportunity for buyers, sellers, landlords, investors and real estate agents alike." When she isn't working, she likes to play tennis, do pilates, travel and spend time with her husband and three children.

hances are, in the mind of a potential buyer, your home is not the unique gem that you might think see it as. It can be hard to understand that, but most homes have a pretty basic structure that might change from home to home but does not vary greatly overall. If you are aiming at creating that elusive buzz word, curb appeal, understanding that and playing up the strengths you do have can help you tremendously. Curb appeal can help you cut through a lot of the hassle of selling your home buy motivating buyers to want your property before even setting foot inside the real estate. With a surplus of interested buyers, you can skip the process of even hiring a real estate agent and simply sell it to one of the interested parties that has demonstrated interest in your property. So while curb appeal is an ever-changing characteristic, there are some basic things you can do to help your home show better and look better to everyone that drives by. These can be simple things like adding shutters around windows that might look out on to your porch and can be as complex as adding new products to the front of the home like a refurbished garage door or better looking porch railing.

Windows Windows make up a lot of the expense of a home, but are sometimes neglected when it comes to dressing up your property for potential sale. Adding things like shutters to the exterior of your property or repainting trim on each window can make your home look words different. Paint especially is an inexpensive input for your property, so putting in a little manual labor can make a big difference in your curb appeal.

Landscaping Landscaping is perhaps the aspect of a home that most people think of when they hear the term curb appeal. If your front lawn has gone with mowing and is chock full of weeds, you 22 CasaGuam June 2010

can guarantee that a buyer will have a slightly negative feeling about your home before ever setting foot in your real estate. You can combine the landscaping and window aspects of your home by making sure that your bushes and other items are trimmed away from window beds. These may look like they were planted with good intentions when your home was built a few decades ago, but letting light into your property and showing off the amount of windows will ultimately do more to increase your curb appeal.

Walkways Your driveway and other walkways that lead to your home serve as a visual line that grabs the buyer's eye and directs it toward your home. If a walkway or garage is full of holds and has not been cared for, this travel of the eye will only hurt the curb appeal of your property. Take advantage of the way a buyer will look at

your home and pay extra attention to the walkways and driveway. If you have some nice landscaping elements around a path to your home that might wind its way to your front door, you will have almost instant curb appeal and will set your home apart from the other 50 properties a buyer might be shown that day. Common sense is the biggest asset when it comes to developing curb appeal. If something on the exterior of your home is broken or dirty, fix or clean it. If you drive by and wince at a particular eye sore in the front yard, remove it. Put yourself in a buyer's shoes and ask yourself what you would want to see when you drive up to your new home and what you wouldn't. Quick Fixes For Leaking Pipes t's a nightmare that most homeowners hope they only have to dream about and never experience - a pipe suddenly there's a water leak. First, turn off the water supply to the leaking pipe. This may be at the fixture supply valve in front of the leak or at the main water supply valve itself. Shutting off the water will stop the water flow and give you time to think. If the plumber can't get there for a couple of days or you don't have time to fix it yourself, you actually do have a number of options to do a quick fix until the pipe can be properly repaired. First, figure out where the leak is actually coming from. Is it a pinhole or has a pipe split? If it's a run of copper, here are some quick fixes - depending on what you have available.

Permanent Repairs Such fixes take a little more time and some planning, but once you're finished, you've got a permanent repair for your leaky pipe. • Install a pipe clamp specifically designed to fix leaking pipes. These clamps have a rubber gasket attached permanently inside the clamp, which itself is designed to fit around the leaky pipe. Simply place the clamp over the hole and tighten the integral screws, holding it in place and making a permanent seal. Pipe clamps are available at home stores. • Another alternative is to use flexible/braided metal tube with compression couples on each end to provide a permanent fix. A significant advantage of this repair is it will allow you to not only fix a small pinhole leak, but it can be used to fix a longer split pipe. Because the repair tubes are flexible and will bend, they can even be used to repair a leak in a pipe elbow. The metal tubes are available in number of lengths so you should be able to fix your pipe wherever it's holed. • To install the braided metal tube, you're going to have to cut out the damaged section of pipe, so be sure to drain all the water out of your pipes. Next, center the repair coupling against the damaged section of pipe and mark the water pipe one-inch in from each end of the coupling. Cut out the damaged pipe at the marks, slide the compression couplings onto each end of the water pipe, and attach the repair coupling. Tighten the compression fittings and turn the water back on to check for leaks. 24 CasaGuam June 2010

Temporary Repairs Remember, none of these are permanent fixes, but they will allow you to turn the water back on until you can get the pipe fixed more permanently. • Stick a pencil point into the hole and break it off, then wrap the pipe with electrician's tape. Smear some plumber's epoxy repair putty over the tape to make sure it doesn't leak. Let it set for half an hour and turn the water back on. • Wrap a piece of rubber (like an old inner tube) around the pipe over the hole, and then use a C clamp and small blocks of wood to clamp the rubber wrap tightly in place. If you have them, hose clamps around the rubber covering the hole could also be used to keep water from leaking. • Don't have any old rubber that can act as a repair? Cut a piece of garden hose long enough to cover the hole in the pipe plus two or three inches on each side. Slice the garden hose lengthwise and position it over the hole in the pipe. Once again, use hose clamps to keep it in place and stop water from leaking. Any and all of the above quick fixes will get you back in business quickly if you ever need to deal with a leaky pipe. Anyone living in a home with copper pipes can be thankful that leaky pipes happen very seldom. In older homes where galvanized pipes were used for plumbing, leaking pipes will unfortunately be much more common. Since galvanized pipes rust from the inside out, you can't tell what kind of condition they are in by looking at them. However, when one starts leaking, it's logical to expect that others won't be far behind. Laying in a good supply of pipe clamps might be a prudent investment.

NAR on Appraisal According to the National Association of Realtors®, state-licensed and certified appraisers represent about 40,000 of its members. NAR supports the importance of appraisal process as follows… • State certified or licensed appraisers prepare full appraisal reports that provide critical information to home buyers and sellers. • An appraisal is an important part of the home buying process because it assures the lender of the property’s worth. • An appraisal is also a valuable tool for sellers, who can obtain an appraisal before listing a property to help determine a listing price, particularly if the property is unusual. • Determining an accurate property value is more difficult in today’s market. You need an expert to handle this. • Online estimates aren’t as credible as professional appraisal. • Some loans require that comparisons be limited to home sales in the past 90-120 days. In many cases, the only available comparisons may be distressed sales – homes that are sold in foreclosure or short sales. Therefore, loans should include appraisals that use comparable sales that closed within the past 12 months as required in the Fannie Mae Guidance for Lenders and Appraisers. • Buyers, sellers and Realtors® can ask appraisers to consider additional data and correct errors. They may discuss the unique conditions of a home and its neighborhoods with appraisers. • NAR supports a borrower’s right to know how a property valuation is determined.
