just got back from attending some meetings in the states both in California and New York. As I said in some of my earlier articles — I am glad I live in GUAM! Things here are so much better than in the places I visited. In California there are so many foreclosures and bank “short sales” (a short sale is when the bank allows the owner to sell the house below the mortgage amount and agrees to forgive the difference). Most short sales take over nine months and many fall apart during the contract period. One complex I visited has over 25 percent of the units in or near default. It is so bad that some condominiums cannot support their common area fees because so many units are not paying their monthly maintenance fees. In New York the main problem is rental housing rates. Even though the real estate sales have slowed down the rental rates remain very high. I talked to some renters who are paying over $2,500 a month for a small two bedroom unit in a very old building in a tenement complex (very low end rentals). Our taxi driver told me that he rents just a room from a homeowner and pays over $600 a month just for a bedroom and shared bathroom. It’s nice to come back home to real estate market that may be soft, but still surviving and rentals that start around $500 a month. You can still buy condominium units well under $100,000 and houses under $150,000!! They may not be in the best locations or in the best condition but they are livable and rentable. I still think the reason we are not hurting as bad as in the states is because of our proposed military buildup. When I talk about the plans for the build up and the economic impact that will happen over the next seven + years – you should see the envy and excitement that others show me. I agree that this relocation and build up will cause some problems but I am sure we can work them out and come out of this better and stronger than ever!!

Transaction Recovery Stalls Amid Build-Up Confusion

A

fter three consecutive quarters of strong growth in sales volume, Guam's real estate market stalled during the first quarter of 2010. The most recent quarter reflected $63.7 million in activity, down 28 percent from the prior quarter, but up 76 percent compared to the global financial crisis-impacted first quarter of 2009. The stalled recovery is partially attributable to the on-going confusion and mixed signals from Japan regarding the military build-up. In the residential sector, the 135 single family units sold last quarter involves the second slowest quarterly activity in six years, and down by 17 percent compared with the prior quarter. However, based on historical trends, Captain Real Estate projects 20 percent growth for next quarter, or a more stabilized level of 162 units sold. Although transaction activity has declined, prices have remained relatively firm with the median house price of $221,000 reflecting the third highest average on record. The highend market reflected additional positive results with seven houses sold at prices above $500,000. A combination of more units sold and fewer units for sale reduced the high-end market inventory to 1.2 years, still relatively high, but the lowest high-end inventory statistic in years. Condominium unit sales activity also reflected mixed results with 48 units sold during the first quarter of 2010, approximating units sold last quarter, but up 19 percent from a year earlier. This sector recorded its fourth consecutive quarter of growth since the market bottomed in Q1 09. The 6 CasaGuam July 2010

condominium median price of $135,500 is effectively unchanged compared with the first quarters of 2006 and 2009. The high end condominium sector reflected additional positive momentum as 5 units sold at prices above $400,000. The commercial sector of Guam's real estate market remains extremely slow with only three recorded sales during the past quarter reflecting $2.3 million in aggregate transaction activity including zero sales of multi-family residential properties. This sector is dominated by a wait and see mindset with most investors optimistic regarding future market conditions. Land sales during the quarter were positively impacted by the massive

GWA connection fees that developers and owner-occupants rushed to beat. The negative impacts of these fees, which significantly increase the cost of homeownership, are likely to impact future statistics. Along with the dearth in commercial sales, commercial real estate lending plummeted in Q1 10. In a rare example of prevailing forces in this sector, First Commercial Bank earned 1st place with a $2.35 million deal with Six D Enterprises. 2nd place went to Bank Pacific with a $1.6 million deal and Bank of Guam recorded a $1.5 million mortgage. Other lenders with $1.0+ million real estate loans closed in the first quarter include First Hawaiian Bank, Coast

360, Community First, and ANZ. Overall real estate market conditions are improving and our projection of 25 percent growth in sales for 2010 remains unchanged; however, potentially massive infusions of foreign investment could impact final figures. Increased government fees and an end to the first time homebuyer tax credit are expected to negatively impact the residential sector although the recovery in the high-end sector is expected to continue along with demand growth from the first wave of military build-up related personnel. The commercial sector will likely remain soft until economic growth spurs increases in rent and occupancy levels.

rofessional real estate inspectors get to see and hear the right and wrong things people do when buying a home. These five tips will help you choose the right real estate agent the first time to avoid unnecessary stress.

Mistake #1: Not using an agent at all or using the Multiple Listing Service (MLS) as your “agent.” By law, the listing agent is required to keep the seller’s best interest at stake, so it’s important to be mindful of yours. If you choose wisely, you can put a trained real estate professional on your side for free! A true buyer’s agent can help you negotiate a contract, fly through the mountain of paperwork, help you find the right home and help you schedule the needed inspections and appointments necessary when you do find your dream home.

Mistake #2: Relying on the home inspector your agent recommends. While many people are generally honest when it comes to inspections, agents do have a financial stake in seeing the deal go through. Why risk the conflict of interest by solely relying on their choice of inspectors? With a little research, you can find your own home inspector who will have your best interest at stake.

Mistake #3: Putting up “non-refundable” earnest money. This is like giving the sellers a check and saying, “Here, you keep this. Even if we don’t buy your home, you can keep our money.” Some sellers request upward of $20,000 non-refundable earnest money. Don’t do it. Stick with the standard refundable earnest check.

Mistake #4: Falling in love with the home. The one group of consumers that get easily taken advantage of the most are those that “fall in love” with a home. They will accept any terms set by a seller. They will buy the home and tell themselves, “It just needs a little work, I can do that myself,” even though they have never picked up a hammer in their lives. They let their “love” cloud their vision and judgement and end up paying hefty sum.

Mistake #5: Buying more home than what they can afford. There is a rule of thumb that says you should not buy a home that cost you more per month than 20 to 25 percent of your take home pay. Hardly anyone follows that rule of thumb today. Instead, many consumers end up buying homes that take a large part of their monthly income. This leaves little room in their finances for emergencies, furniture, vacations, investing and other expenses. With the relaxed lending requirements, people are buying way more home than what they can realistically afford. If you go down this road, chances are that you’ll grow to hate this home. You should own a home, the home should not own you.

5. Know the difference between rate and points.

Choosing to become a homeowner is a big decision, but an extremely satisfying one if you have all your ducks in a row. If you think you want to buy a home, consider these factors:

For those choosing a mortgage, they often have the choice of paying a part of the interest which is usually paid at closing, at the beginning. This will allow for them to have a lower interest rate. For those staying in a house for a long time (three or more years), the points option is usually best, as it will save you money over time.

1. Only buy if you are going to stay in put for a while. If you think, or know, that you will not be staying in that house for more than a year or two, buying a house is a waste of time. Buying and selling a house costs money, and in the end, you will probably lose money. Buying a house is best for those who will in place for a while, thus giving the houses value to rise.

2. Fix up your credit score. For most people, buying a house requires getting a mortgage. Getting a mortgage requires having a good credit score. Prior to buying a house, review your credit report and be sure that all is correct. If you find any mistakes, have these sorted out before trying to get a mortgage.

3. Even if you cannot put a 20 percent down (which is standard), do not worry. Many lenders, both private and public, have mortgage plans that require a very small down payment (as low as 3 percent of the houses price sometimes).

4. Look for a home in an area with good schools. If you have children, this will be very important for their future. Even if you do not have children, living in area with good schools is important; reason being that it greatly increases the value of the home. This will benefit you when it comes time to sell again.

6. Get pre-approved. Getting pre-approved will make the house searching process much easier. You will know what you can afford and what you can't afford. Pre-approval is not the same as pre-qualification. Being pre-approved has to do with your income, debt, and credit history.

7. Research before making an offer. Look at the trend of sales in the neighborhood before making an offer on a home. If houses in the area selling for 7 percent less than their listing price, you should start off by bidding around 11 percent lower than the listed price. This is just an example. Your agent can give you a better idea of what a reasonable bid is for your situation.

Title Insurance and Escrow, Who Needs It? Bertha Evangelista President, Title Guaranty of Guam

B

uying a home is an exciting experience but it is not one without risk. Compare the transaction to the game of “Hot Potato” with the home being the very expensive potato. You wouldn’t want to drop it—not without insurance! That is why this smart guy named Benjamin Franklin created the concept of title insurance. A title and escrow company protects much more than just small potatoes. It protects one of the largest financial investments you’ll ever make. For first time home buyers, the terms “title insurance” and “escrow” may need some defining. Title insurance protects the purchaser or property owner against a loss that may arise by reason of defect in their ownership or the interest they have in real property for as long as they hold the title to the property. “Escrow” is the holding of money or documents by a neutral third party prior to closing. Title insurance generally falls into two categories: Lender’s Title Insurance and Owner’s Title Insurance. The Lender’s Policy is required by the Lender and the Owner’s Policy is optional. Of course, the best case scenario is for the Buyer to acquire both types of insurance for maximum coverage. Fortunately, title and escrow companies generally discount one or the other if a customer is purchasing both types. Escrow fees vary from company to company. Some use a sliding fee schedule while at least one company just applies a flat fee. The lending institution you are working with on your mortgage loan will supply you with a list of title companies to choose from. A federal law called the Real Estate Settlement Procedures Act (RESPA) entitles the individual homeowner to choose a title

insurance company when purchasing or refinancing residential property. Of course you can just pick one as there are only a few on island. The conscientious Buyer would likely want to do a bit of homework before selecting a company. Ask around and find out who your family and friends recommend. The buyer is responsible for paying for the lender’s policy, the owner’s policy if they opt to receive it, and the escrow fees. It makes sense to do a little shopping around. Fortunately, Guam only has three major title insurance and escrow companies, so there isn’t too much work involved. Find out what kinds of discounts they offer as well as special services that are included in fees as opposed to added on later such as notary fees. Companies may offer lower rates to buyers who qualify for Guam Housing Corporation or rural development loans. Most importantly, you want to feel confident about the work of the title and escrow company you choose. You want to know that the company you select is going to do a thorough job researching the title for the property you are purchasing. What’s the big deal you ask? All property has changed hands at one time or another. Sometimes many such changes have taken place. When you receive the title, you want it to be “free and clear”. If there are encumbrances, the title and escrow company will do its due diligence to find these defects through its research. As you sit in your lending institution trying to decide which company to use for your title and escrow needs, remember that you can be a proactive consumer and make a well-informed choice with just a little bit of homework.

ometime in the late '90s, Duane Pahl decided he was done being a renter and wanted to become a homeowner. Then in 2000, he decided to make it happen. "Renting just wasn't in the cards anymore," he said. Pahl worked with a Realtor to help him buy his first condominium. "The Realtor worked really hard on my behalf," he said. Pahl added that the experience was so awesome that he wanted to give the same emotional success for other people, so he sought out getting licensed in real estate. Before joining the real estate industry, Pahl said his experience has always been in tourism, so he needed to go back to school at the University of Guam to get his license. "I just barely passed," he said with a laugh. But it shows that grades are trumped by passion any day, because Pahl set his mind to becoming a successful Realtor — and he did. He said he enjoys going through the process of helping people become homeowners, because he knows how emotionally satisfying it is. When he got his license in 2004, he started seeking brokers for whom he wanted to work. "When I met Anthony Godwin, I knew the search was over. Today's Realty was my home." While he enjoys his career, Pahl said land transactions continue to be a challenge. "Dealing with land is it's own [feat]. There are so many aspects — level, property markers, flooding issues, financing issues — it's a challenge." He said it's important for buyers and sellers to conduct due diligence so that the transactions works to everyone's benefit. Additionally, Pahl said the affordability of a home is also one to consider when buying. "Your budget should be comfortable. Don't overstretch yourself. Make sure your bills are affordable and stay within your budget." In the next few years, Pahl said his goal is to never stop learning. "In real estate, every day is a challenge and a new lesson." In life, he said he just hopes to keep his wife and kids healthy and happy. Pahl is married to Miyoko and they have two sons. When he's not working, he is an avid sports fan, and plays golf, soccer, beach volleyball and has coached six- to eight-year-olds for the Wings for five years. He said he would like to send a shout out to Today's Realty. "We have an amazing team and I am very thankful for their support."

The Dos and Don'ts of Lawn Care

A

great lawn is part of a great yard in general. So how do you get the lawn you're looking for? Here are a few lawn care dos and don'ts from Southern Lawn Care—a professional lawn service company that serves Hillsborough, Pinellas, and Pasco. Don't put too much fertilizer. Applying fertilizers on your lawn is the first basic step in lawn care but you have to know what type of grass you have and what plant food to use. Horticultural studies show that the nitrogen in fertilizer can burn your lawn, and when temperatures get higher, the likelihood of burning goes up. To prevent damage, go for a slow-release fertilizer with lower nitrogen content. Make sure you follow the directions carefully when applying it to the grass. Do water you lawn on a consistent schedule, preferably before the sun rises in the morning (around 5 a.m.) or late at night. Moisture is best absorbed during these times because the temperature is relatively cooler. If you have just planted a new lawn, you will usually need to water once a day so the seeds can germinate and a good solid root system can form. On average, this can last from two to eight weeks, depending on the type and grass and season. Also, it's best to water deeply that watering too often. Frequent, light watering produces a shallowrooted lawn, and you don't want that. Don't water your lawn before mowing. Horticultural magazines will say that that you should water your lawn a day before mowing to avoid the ugly crowning at the tip of your grass. Watering your lawn a day before they get mowed will give them time to recover and make them look nicer as they start growing again. Mowing should also depend on the type of grass' optimal height. Recommended mowing heights are three inches for tall fescue, two and a half inches for perennial ryegrass, and one inch for bentgrass. Do apply occasional pesticide or herbicide to your lawn. According to the U.S. Environmental Protection Agency, about nine million pounds of 2, 4-D is used on U.S. lawns every year. This

pesticide is the most commonly used pest control solution for residential and commercial use. Grass grows best in a biologically active soil where soil organisms like earthworms recycle plant material so that nutrients are slowly released in the root zone of the grass. Any excess of organisms like ants and worms can cause your grass to die so an occasional application of pesticide—like once every four months, would be good. Do remove excess thatch. A thatch is the partially decomposed grass stems, roots, and leaves found between the green part of a lawn and the surface of the soil. Thatch problems are caused by excessive fertilizing and watering, infrequent mowing, and frequent pesticide use. Surrounding trees and shrubs could also cause thatches, especially if they do not receive enough water. Provide more water to grass that have trees and shrubs nearby.

The landscape design should ensure water drainage back to the ground's water table. Patios and walkways should be sloped so water drains into the lawn bed. REALTORS® Political Action Committee The National Association of Realtors® is the leading advocate for housing issues, and NAR’s Political Action Committee backs congressional candidates who support homeownership and protect private property rights. NAR encourages Realtors® to invest in their industry’s future through RPAC. In fact, more than one in three Realtors® contributed to RPAC last year. In 2008, more than nine out of 10 RPAC-supported candidates for the U.S. House of Representatives and the Senate won their elections. RPAC is the most bipartisan PAC in the country. RPAC’s record of success demonstrates that Realtors® are among the most politically active and engaged citizens in the country. NAR members participate in the political process to ensure that the Realtor® point of view on homeownership and private property rights is heard at all levels of government. However, it must be duly noted that NAR does not get involved in presidential politics. Background RPAC distributed a record $4.3 million in direct contributions to federal candidates in the 2008 election cycle, more than any other PAC. NAR spent a record total of roughly $14.3 million during the 20072008 election cycle and $11.5 million in the 2005-2006 election cycle. Our goal for the 2009-2010 election cycle is to disburse $16 million. RPAC supported 454 candidates for the U.S. House of Representatives and Senate during the 2007-2008 cycle. Of these candidates, 428 won their races, giving RPAC a 94 percent winning record. In the House, 399 of the 421 RPAC-supported candidates won their seats. In the Senate, 28 of the 33 RPAC-supported candidates were elected. In 2008, 419,491 of NAR’s 1.2 million members contributed to RPAC.
