ell here it is September already- seems like I just started using 2010 as the date and now I have to start practicing using 2011 in just 4 months! As I mentioned in my last month’s letter we’ve been getting ready for the visit from last year’s National Association of REALTORS® President, Mr. Charles McMillan at the end of August. As I write this article it still hasn’t happened yet but we are very excited and looking forward to this visit. He will be here for 4-days so I will be busy showing our beautiful island off to him and the other visiting dignitaries. Our real estate market remains slow as everyone is still awaiting for the final Federal government notice to proceed on the pending build-up. The official notice is called the ROD (record of decision) which may be signed as soon as this month! Once the ROD happens then the contracts and build up will start. I do expect things not to change much for three to six months and then certain markets like the industrial (warehousing) and executive level residential will start to take off with the rest of the residential market following soon thereafter. It sure seems like it no longer is “if the buildup happens” but rather now they are saying “when the buildup happens”. Some are predicting it will be like the late 80’s again with prices going up almost monthly and everyone working. Remember when the “for rent” section of the paper was less than a column long while the “for work” section was pages long- well look at the paper – it is getting there.

Significant Future Gains Projected Steady Market May Bring 20 Percent Improvement Over 2009

G

uam's real estate market held steady during the second quarter of 2010, which is on pace toward an estimated 20 percent improvement over sales activity in 2009. During the 2nd quarter of 2010, total islandwide real estate sales reflected $66.1 million, up slightly from the prior quarter, but up sharply from the first quarter 2009 low of $36.1 million. "The market has been extremely steady with monthly sales volume of around $20 million. That's the pre-bubble rate of sales activity, so we are expecting sharp gains after the massive military and infrastructure construction projects commence." noted Nick Captain, President of Captain Real Estate Group. "By mainland standards, a steady market is a healthy market. Although the past few years has witnessed an evaporation of Asian-based foreign investment, it will return", stated Captain. Private sector foreign investment is already returning, it's just not the big money from Asia, yet. Investment has been flowing into Guam from Hawaii, Alaska, the mainland and other locations. In the residential sector, single family median pricing has stabilized over the past year in the $210,000 range. Captain Real Estate's projected 20 percent increase in total single family residences sold this past quarter was reasonably accurate with 160 units closed. In the condominium sector, sales activity showed 20 percent growth but the median price dropped below $120,000. Commercial and industrial sales activity through 6 CasaGuam September 2010

Debt Rules The new game in Guam real estate is debt. Cash is not king, because debt rules and lenders reign. As the key to leverage opportunity (and risk), debt is now the critical component of most deals. As liquidity dried up and speculative property prices declined since 2007, properties acquired during the boom suddenly experienced equity squeezes. Now, foreclosure and debt sales activity dominate the major deal landscape. At the 2009 Micronesia Real Estate Investment Conference (MREIC) at Leopalace Resort on Guam, we said that the future market would be characterized by a "take a banker to lunch" mentality. So as 2010 evolves into the Year of Debt, towering statistics are rolling in. Annualized 2010 Guam real estate lending is down by $192 million, or 36 percent from 2009 (see chart). Among other financial industry fallout, Wells Fargo will exit Guam. Notable 2003 MREIC Investor of the Year Mr. Hee Cho stormed back to life this past quarter by acquiring the first mortgages under Talo Verde Estates and Hemlani's Marine Drive land from Nara Bank. The Hemlani land sold at $6.2 million at the peak, went through foreclosure and recently sold via auction credit bid at $3.3 million in July, a decline of nearly 50 percent. The Talo Verde note was paid in full at the recent closing, but the $25 million second mortgage holder Kumho, took a beating.

In Tumon, the buyer of the first mortgage (sold by FHB at a reasonable discount) secured by the Marriott Guam is working hard to salvage that hotel's future. And debt owners may prevail at Guam's latest abandoned (temporarily on hold, shall we say?) project, the four massive towers next to GMH. Debt holders including mostly Korean lenders are further controlling numerous peak 2007 deals including raw land and other abandoned projects. At the same time, off-island lenders are showing optimism in Guam; most notably via a Resona Bank secured nine figure megadeal with the Leopalace Resort owner (no, it's not for sale), closing the largest real estate mortgage in Guam's history.

Notable Deals In an unbeatable combination of debt, equity and connections, Talo Verde Estates luxury residential

project has finally fallen into new hands, sold to a group led by Harry Chang. Talo Verde's projected cost of $35 million compares unfavorably with its $19Âą million sale price. First Hawaiian Bank proved its leadership in lending again with an $11 million note on the deal. Other major deals this past quarter include 13 additional closings at The Laguna, the high-end lot subdivision at Pago Bay, at prices up to $476,000. In the condominium sector, nearly sold out Harvest Residences has been highly successful with a perfect combination of product and price. Michael Jury and partner acquired nine Pacific Gardens condominium units from the Guzman family at an indicated price of just $38,400 per leasehold unit. During the past quarter, only five condominiums sold at prices above $300,000 and just eight houses sold at prices above $400,000.

How to renovate your kitchen without going crazy.

Kitchen remodeling ups the value of your home if you’re planning to resell — but is it worth all the hard work? Unlike any other home remodeling project, kitchen renovation encompasses so many things — from the raw to the sublime, from the picayune to the important — that it can easily overwhelm even the most determined homeowner. On the other hand, a fine kitchen remodel instantly raises the value of your home, provides you with a more effective cooking space, and makes you the envy of all of your friends. So, before beginning this toughbut-rewarding project, ask yourself: 1. What Are My Needs and Desires?: Is your kitchen a disaster zone where you can’t even manage to boil an egg? Or do you just want to freshen the place up with new appliances, countertops, floors, and cabinets? A need might be: I need kitchen cabinets because my current ones are falling apart. A desire might be: I desire a new dishwasher because my current one is ugly and noisy, though it works perfectly well. 2. Is It Worth Putting Myself Through This?: Do you want work crews in your house for extended periods? Do you want to spend money and put yourself through this turmoil? While one of the more expensive home renovation projects, kitchen remodels retain their value well should you decide to sell your house. CasaGuam.com 11

Feature 3. Deep-Down Renovation or Surface-Level?: Be honest. Is this a $85,000 full-scale kitchen remodel or a less ambitious surface-level kitchen renovation? No shame in either choice.

This is the fun part. When you design your kitchen, you get to exercise your creative muscle while your house is still clean and in one piece. For ease of movement, plan your kitchen workflow around the classic kitchen triangle.

Something has to go. Something as small as those nasty laminated counters or as major as that load-bearing wall blocking the view of the living room. Kitchen materials may contain hazardous materials such as lead-based paint and asbestos, both of which require special handling. After that, you need to haul away the waste material and dispose of it. Waste stations may not accept hazardous materials, so you should first check up with them about acceptable waste.

Hire or DIY

Building and Repairing

You should have at least a 200 ampere service panel to power a modern kitchen. If you have less than this, you will need to heavy-up, or increase, your service capacity. This is a job best done by an electrician. Electricians most likely will abandon your old wires in favor of running new wires through the walls to power lighting and appliance circuits. If you are doing the work yourself, you may also find it easier to run new circuits than to deal with a spaghetti mess of old wires. Now the kitchen takes shape and begins to look like a kitchen.

You’re got great ideas. But how do you turn these ideas into reality? You can: • Hire a Contractor: Find a licensed contractor who deals extensively with residential kitchen remodeling. • Do It Yourself: Renovating the kitchen by yourself, you spend no money on labor charges but you may slow down your project as you learn skills necessary to remodeling. • Act as Your Own Contractor: A tempting option. You hire carpenters, electricians, plumbers, and other sub-contractors yourself and save the contractor’s high commission. But this puts a lot of work on your shoulders.

Depending on your new kitchen’s configuration, you may be taking on major construction tasks. Are you adding or replacing windows? Or removing windows to increase cabinet space? How about taking down walls to open up the kitchen to the rest of the house? Even minor kitchen remodeling may need joists strengthened to support heavier appliances or built-ins such as a kitchen island. If you’re doing the work yourself and learning as you go, this will be slow-going. Kitchen plumbing and electrical are not exactly trades you learn overnight. But if you’re using a contractor or hiring subcontractors, your head will spin at how fast experienced plumbers and electricians can do this.

You should apply for permits now. Permits must be obtained from different agencies. Your city or county may administer the electrical, plumbing, and building permits. Your water company may also need to permit any work relating to water supply and drainage. If a contractor is handling the renovation, he will obtain your permits. If you are doing it yourself, start by calling your local city or county permitting agency.

Rough-In the Plumbing

Designing

Your new kitchen may have a kitchen island with a sink or a refrigerator with an automatic ice-maker. Or you may decide to move the main sink to a different spot. In any event, it is almost certain that you will have increased plumbing needs. At this “rough-in” stage, new supply and drainage pipes are added for sinks, dishwashers, and refrigerators.

Flooring Kitchen floor is laid after the heavy work of building and painting to save wear and tear. Flooring Options: • Vinyl is the least expensive flooring choice and can usually be laid in one day. • Tile requires the application of cement backing board and must be adhered with mortar and then grouted. Each step requires drying time. Even with inexpensive tile, this flooring option can be costly because of the labor involved. • Engineered wood feels like solid hardwood (its surface finish is real wood), but it is fairly moisturetolerant. • Laminate flooring is a highly popular choice for kitchens because of its tolerance to moisture. Unlike engineered wood, laminate is scratch and dent resistant. • Solid Hardwood • Hardwood is less popular because water, if not quickly mopped up, can warp it. However, with proper care, it is a viable choice for the kitchen. Installers can lay wood in an average-sized kitchen floor in three days.

Cabinets Cabinet-hanging requires patience. Your local cabinet supplier should have work crews who can hang your cabinets, usually over a period of a day or two. If you are sub-contracting the work, any competent carpenter can do this job. Or you can do it yourself as long as you have an extra set of hands.

Countertops Whether ceramic tile, granite, marble, you must keep in mind basic tile design principles that have been around for 2,000 years. Or, you may choose to use man-made materials such as Silestone, Formica, or Corian. If so, it’s best to have specialized shops fabricate your countertop. Installation looks easier than it is. All counters must be level enough that an egg can rest on them without rolling off. It is impossible to level the countertops if the base cabinets were not installed correctly. Feature Sinks and Fixtures To this point, the plumbing was roughed-in. Now it’s time to set the sinks into the countertops and make final connections. Sink faucets and handles — the fixtures — are put in place and dishwasher hooked up.

Last Items Just when you think you’ve got it all, you’ll always find more items that need to be installed. Remember that the recessed light covers were left off so that the ceiling paint could dry? And the cabinet knobs on back-order just now arrived. HVAC filters were left off so they wouldn’t get clogged with construction dust. And what about all those outlet covers? You thought you were done. As always, a few last things to do.

Touch-Up Painting Inevitably, there will be scars and dings on your walls. So accept the fact that there may be spackling and touch-up painting to do even though the walls have already been painted.

Clean-Up A good contractor employs a housecleaner who specializes in building-related cleaning. If you’re doing it yourself, give yourself a breather and hire a housecleaner to clean your kitchen. erriam-Webster defines etiquette “as the conduct or procedure required by good breeding or prescribed by authority to be observed in social or official life”. AREALTOR®being a working professional is subject to the Realtor® Code of Ethics. Moreover, aREALTOR®should also conduct themselves with a certain level of respect and sophistication for his/her clients/ customers/and colleagues. Real estate in Guam is a highly competitive industry with 400 realtors® and growing, you are sure to have a relative, friend, or acquaintance that is a practicingREALTOR®or is planning on obtaining real estate license. John Doe can become a REALTOR®, however; once he is in the industry, there is a certain level of respect he should oblige to his fellow REALTORS®, whom would expect from their colleagues. Having an understanding for theREALTOR®Code of Ethics is a must. Also, there is a certain level of etiquette that aREALTOR®must maintain towards his/her colleagues. Realtors® are sales driven individuals. Realtors®, especially newer realtors® have to also understand that there are invisible boundaries that must not be crossed, territories which must not be disturbed as well as respect for your competition which is imperative for your success as a realtor®. If one’s boundaries are crossed, or territory is disturbed or there is no respect for your competitor, then one will be working in a hostile environment that will eat you alive. Respect for your fellowREALTOR®is imperative for the real estate industry in Guam. So too is respect and etiquette for your clients and customers. AREALTOR®must understand that buyers and sellers seek a realtors® help for real estate

guidance. With guidance comes fiduciary responsibility to your new client or customer. This is where etiquette is highly admired in a realtor®. Your clients and customers are your lifeline in this industry, without clients and customers, you as aREALTOR®may as well submit your disassociation letter and discontinue real estate in Guam. With Guam being such a small and close knit community, all aREALTOR®needs is one bad review to spoil his/her reputation. Etiquette, like a fine bottle of wine needs much care and attention, one cannot rush etiquette or it will seem rehearsed and half learned. The following is a list of some of what I believe is essential ingredients for properREALTOR®etiquette: I. Respect for the Public • Follow the "Golden Rule" - Do unto others as you would have them do unto you. • Respond promptly to inquiries and requests for information. • Schedule appointments and showings as far in advance as possible. • Call if you are delayed or must cancel an appointment or showing. • If a prospective buyer decides not to view an occupied home, promptly explain the situation to the listing broker or the occupant. • Communicate with all parties in a timely fashion. • Leave your business card if not prohibited by local rules. • Never criticize property in the presence of the occupant. • Inform occupants that you are leaving after showings. • When showing an occupied home, always ring the doorbell or knock - and announce yourself

loudly - before entering. Knock and announce yourself loudly before entering any closed room. Present a professional appearance at all times; dress appropriately and drive a clean car. If occupants are home during showings, ask their permission before using the telephone or bathroom. Encourage the clients of other brokers to direct questions to their agent or representative. Communicate clearly; don't use jargon or slang that may not be readily understood. Be aware of and respect cultural differences. Show courtesy and respect to everyone. Be aware of - and meet - all deadlines. Promise only what you can deliver - and keep your promises. Identify your REALTOR® and your professional status in contacts with the public. Do not tell people what you think - tell them what you know.

II. Respect for Property • Be responsible for everyone you allow to enter listed property. • Never allow buyers to enter listed property unaccompanied. • When showing property, keep all members of the group together. • Never allow unaccompanied access to property without permission. • Enter property only with permission even if you have a lockbox key or combination. • When the occupant is absent, leave the property as you found it (lights, heating, cooling, drapes, etc). If you think something is amiss (e.g. vandalism) contact the listing broker immediately. • Be considerate of the seller's property. Do not

allow anyone to eat, drink, smoke, dispose of trash, use bathing or sleeping facilities, or bring pets. Leave the house as you found it unless instructed otherwise. • Use sidewalks; if weather is bad, take off shoes and boots inside property. III. Respect for Peers • Identify your REALTOR® and professional status in all contacts with other REALTORS®. • Respond to other agents' calls, faxes, and e-mails promptly and courteously. • Be aware that large electronic files with attachments or lengthy faxes may be a burden on recipients. • Notify the listing broker if there appears to be inaccurate information on the listing. • Share important information about a property, including the presence of pets; security systems; and whether sellers will be present during the showing. • Show courtesy, trust and respect to other real estate professionals. • Avoid the inappropriate use of endearments or other derogatory language. • Do not prospect at other REALTORS®' open houses or similar events. • Return keys promptly. • Carefully replace keys in the lockbox after showings. • To be successful in the business, mutual respect is essential. • Real estate is a reputation business. What you do today may affect your reputation - and business - for years to come. An important note that all perspective owners and buyers should seek when looking to employ aREALTOR®is the experience and the knowhow for selling, buying or renting your real estate. Owners, renters and buyers should keep in mind, when looking to employ a realtor®, it will be beneficial to yourself to choose aREALTOR®that is able to present him/herself as an ethical person coupled with proper etiquette.

Just One of the Guys

Tomas Reyes lives a simple life, works hard for his family and gives his customers an honest perspective.

T

hough most people who are in real estate one day hope to have their own firms, Tomas Reyes, Real Estate Agent for Today's Realty, said his dreams are simple – keep his family happy. “Real estate was always a dream for me even at a young age. I got my first taste of real estate while working with the Chamorro Land Trust Commission prior to becoming an agent,” Reyes says. “I helped families lease land for $1 a year for 99 years. Upon attending a local conference, I met Mr. Mark Zhao, an instructor at Westpac Institute of Management (now NEZPAC). Mr. Zhao said he could teach me how to make 'big money' as a real estate agent. I jumped at this opportunity to realize a lifelong dream.” However, his priorities are always for his family. He says his business motto is, “Work to live, not live to work. I believe at times we get too into our jobs that we neglect the true reason why we are working in the first place. I strive to provide for and keep my family happy.” He said that while working in real estate, he learned that the business is about establishing relationships with clients. “It's either you own several real estate properties or you know people that do. Being a shy boy raised in a middle class family down south, I was not surrounded by business men boasting about their real estate portfolios. Instead, I was literally surrounded by my grandpa’s vegetable farm and stray chickens. I had to adapt fast,” he says. He adds that he had to overcome being shy and learn how to build strong, trusting relationships with clients and customers, ensuring returned business and new business referrals. Reyes says it has been a rewarding experience. His most memorable moment was helping a homeless couple secure a lease agreement. “Rather than turn my head, I decided to help them. They had a blank check and a promise that they were receiving a monthly pension. Of course, I did inform the listing agent of the tenants’ situation, but the owner was very motivated to rent.” He says honesty is his policy. “If you do not want to hear the truth, I am not the agent for you.” In the next few years, he hopes to take his family on a trip to New Zealand or Australia and perhaps add a wooden deck to his home. When not working, he enjoys fishing, off-roading and tinkering with home improvement projects.

How to Fix Leaky Three-handle Tub & Shower Faucets

L

eaks are most commonly caused when valves are not closed completely. Over time, this allows water to seep past the valve seat, resulting in “pitting” of the seat. A small channel is formed in the seat and the washer cannot close against the seat properly. Thus, that annoying drip! If the constant dripping coming from the shower faucet or the high water bill from months or years of leaking is making you crazy, it’s time to remove those old washers and valve seats.

• You can now remove the valve stem assembly using a shower valve nut socket. Turn it counterclockwise. (Except in special cases, most valves, screws and bolts are tightened clockwise, an easy reminder is the rhyme “righty - tighty; lefty - loosey”!) Washer • After the valve stem is out, remove the washer from the end of the valve stem by removing the screw holding it in.

You can get all the tools you need at your local home center and if you’re feeling particularly adventurous, you can buy a remodeling kit to replace all the valve parts with new ones. • Before you get started make sure to turn off the main water line. (located by your water meter) • Now, drain off remaining water by opening the faucet. If the water is still flowing, the main line is not turned off. • Remove the center cap of the handle with a small knife or screwdriver. They can be removed by placing the tip of a utility knife under cap and prying up. • With a screwdriver, remove the handle. Wiggle it back and forth until it comes off. • Remove the decorative plate (Escutcheon). If you are unable to remove it by hand, wrap electrical tape around the jaws of a pliers and use it turn the plate until it comes off.

• Now you can reach the valve seat. It is located at the very back of the valve housing, remove the valve seat from the faucet by inserting a seat wrench, (that strange looking “L” shaped tool with the tapered ends), into seat. push the wrench firmly into the seat and turn counterclockwise.

• Take the stem and seat to a home center and buy a new washer and seat of the same size. When one faucet part is old enough to wear out, other parts will soon follow. If you going to fix one part of the faucet, you might want to consider buying a rebuild kit. • Remove any calcium deposits from the metal or plastic parts of the stem. Replace the seat and stem back into faucet, turning clockwise by hand until tight. (Never overtighten, it will cause you no end of grief later on!) • Attach the handle, and turn on the water. If there is chatter, the washer is loose. If water seeps out from around the handle, the stem retaining nut may not be tight enough. Just a quick turn of a wrench will usually cure it. You’ve done it! No more nasty, annoying drip, drip, drip! Congratulations, you’ve just saved some money and learned a new skill. Faucet repairs aren’t that hard if you just take your time and trust your inner plumber!

Curb Appeal

Buyer Beware Don't be Instantly Charmed by Curb Appeal By Ed Kirkland You may have heard the familiar real estate jargon of, "curb appeal". There's so much information out there on how to enhance your curb appeal to attract buyers. But there's probably much less pertinent info on how to truly assess what is "good" curb appeal, from a buyers perspective. As a buyer although curb appeal might draw you in to go view a home, it's important not to get swept away by the pretty picture. Just as you would have the structure of house inspected, you'll also want to assess the landscaping in a similar way. Begin by investigating the general health of the plants on the property. Even if you're not an arborist, there are tell tales signs such as wilting, brown or dry crispy leaves that indicate a plant is suffering. Also look for fungus or mushrooms at the base of trees, which can be a sign of poor tree health. Also with trees, you'll want to look into the placement of the tree limbs. Make sure limbs aren't obstructing power lines or the chimney. If there are such complications, assess how much pruning you'll need to do to repair the problem and whether or not such a prune will drastically effect the health or the look of the tree. Likewise you'll want to ensure that foliage isn't too close to the home's exterior. Such a situation can provide an ideal shelter for rodents and insector delicados to hide from predators, or to slip into the home. Also shrubs can rub up against the house and cause damage to the siding. For all these reasons, plants, trees and shrubs should all be a good distance from the home's exterior. 22 CasaGuam September 2010

It's equally important to look for problems underfoot–for nasty root systems that may not be initially visible. You can sometimes see evidence of this through cracks in the sidewalks or driveway, where roots have cracked through the concrete. A depression in the yard, could be the sign of a leaking sewer line due to root interference. These are all things to keep an eye out for–right from your first walk through. In terms of the elements that make up any home's landscaping, you'll want to assess not only their form and condition, but also their function. What purpose do they serve? Are they merely decorative space filler, or do some aspects provide shade where needed? Is the deck placed in a spot that is advantageous to the sun, or to a

particular view, or does it seem like a project slapped together without much thought? Are there areas that are landscaped for sitting, for gardening or for other particular purposes? As best you can, imagine yourself making use of the different areas outside, and truly decide how much of the designed space, has been designed with function in mind. Assess how the house is situated on the lot. You don't want rainfall to be able to follow a downward slop toward the foundation. This could spell out potential flooding something that is best to

avoid all together. Although a deck is not a living component of the landscaping it's equally important to assess its value and construction. A deck is often one of those DIY projects, so you'll want to ensure it was done right. Make sure it's fastened correctly to the house and is well supported. A good deck should have a railing for people to hang onto and balusters should be no more than 4 inches apart. Again, it's important as a buyer to know the difference between curb appeal and "good" curb appeal.

Brokers: Protect Your Office and Your Agents Below are some recommended safety techniques for real estate brokers from REALTOR® Associations, police and other sources. Implementing some or all of these actions can help you make REALTOR® safety a prime concern for your employees and agents. • Create an office safety plan. Appoint one individual as a safety coordinator to oversee, maintain and enforce the plan. Require everyone in your firm to know and understand the safety policies and procedures. Make it a top priority. • Assign an office safety contact and several alternates. If your office has a full-time receptionist or clerical assistant, this person is an ideal choice. However, encourage your agents to call 9-1-1 in an emergency or if they perceive that they are in danger. • Require salespeople to report their whereabouts to your safety contact, and establish safety call-in procedures. Mandate the use of the buddy system. Create and communicate distress codes, making sure that all employees and agents not only know what they are, but exactly what to do when they hear them. • Don’t forget workplace safety procedures for the office. Use a registration book for all clients and other visitors, and check their information against a photo ID. Establish a secure location to which employees can go in a dangerous situation. Make sure private areas of the office aren’t accessible to strangers. • Ensure that someone is responsible for being aware of your agents’ whereabouts whenever they work offsite. Consider personally visiting or calling the open houses where your practitioners are working.
