As we journey into 2012, the year of the Dragon, the Guam Association of REALTORS® Leadership team is committed to serve our members and community through cooperation, professionalism and integrity.
Our installation of officers and Inaugural ball is scheduled for the 2nd week in February. Our theme for the event is "Hollywood" where our REALTORS® STARS shine and walk the red carpet. Our Board of Directors and Committee Chairpersons and Vice Chairpersons set the tone for the year by scheduling our Activities and Events for our membership and the community. Our leadership team is comprised of elected and volunteer members. Our dynamic and energetic Executive Officer, Peggy Llagas is responsible to the Board of Directors for the effective conduct of association affairs. We thank our 2011 President, Anthony Godwin, for his contribution and accomplishments during his term. During the year I have scheduled to meet with each REALTORS® office to provide updated information from the National Association of REALTORS® and spur the "grass roots" movement in our membership to take active roles in "My REALTORS® Party." The National Association of Realtors over the years have made a difference through "My REALTORS® Party" by lobbying in congress regarding issues that affect Realtors as well as individual homeowners rights. The high number of foreclosures nationwide is alarming. The rate of foreclosures on Guam is very low and hopefully will remain as such. Our Real Estate Market - As REALTORS®, we are often asked How is the Real Estate Market? Our response is normally which market are you referring to - buying, selling or renting. Guam's real estate market is currently stable, however our inventory of rental units are on the high side. Owners are now resorting to reducing their rental rates in order to lease their units quickly. Brand new or newly renovated units are the first to rent in any condo complex or neighborhood. Spending some monies to upgrade your properties to make it more appealing in a competitive market is a must. Know your competition - how many units are available in the same neighborhood, what are their asking prices, and how does your unit show in comparison to the others. Overall YTD Sales Volume Up 10% From 2010 Guam Median Housing Price Plummets; Median Single Family House Price Down 25% From Prior Quarter; Foreign Investment Rebounds; Second Quarter Sales Volume Up 42 Percent To $91.6 Million
ctivity Update – Mixed signals once again dominate Guam’s real estate market as foreign investment has rebounded, but economic realities and uncertainty over the military build-up negatively impacted market activity during the 3rd quarter of 2011. The rebound in foreign investment was highlighted by two major transactions that boosted overall quarterly sales volume to $91.6 million, an increase of 42 percent from the prior quarter. The closing of the Sherwood Hotel and the sale of an 11 acre beachfront site along Tumon Bay highlighted transaction activity and impacted 3rd quarter sales volume by over $30 million. Year to date 2011 real estate sales activity reflects $257.9 million, up by almost 10 percent compared with the same period in 2010. The third quarter reflected a rebound in high priced sales with nine transactions closing at prices above $1.0 million. The high end single family market also rebounded with 17 properties selling at prices above $400,000. However, it wasn’t all positive news during the third quarter as the median prices of Guam houses and condominiums plummeted. Although the single family housing category reflected a relatively healthy 146 unit sales, the median price dropped by 25 percent, the sharpest drop since the 26 percent decline reflected during the global financial crisis impacted 1st quarter of 2009. The median home price on Guam remains strongly correlated to the product mix ratio, or the relationship between the number of new vs. older homes sold. When the ratio of new houses is high, the median price tends to increase, because new houses typically sell for higher prices than older homes. If the new home sales product mix ratio continues to decline, the median price level is likely to decline further. Guam median housing prices first exceeded $200,000 in mid 2007, and peaked at $268,000 during the 2nd quarter of 2011 due to the atypical ratio of new home sales. Total single family home sales in 2011 are projected to reflect 575 units, down sharply from over 700 units sold annually between 2006 and 2008, but far higher than the record low 380 units sold in 2000. Guam median house prices increased dramatically from less than $110,000 in early 2003 to $170,000 by late 2006 as product sold transitioned from low priced foreclosure sales to new construction. The annual median home price ranged from approximately $195,000 to $220,000 between 2007 and 2010, but increased sharply during the first half of 2011 due to the significantly higher ratio of new home sales, many located with Guam’s largest subdivision, Paradise Estates. Guam’s condominium sector also reflected a sharp decline in median price during the third quarter of 2011 as sellers remain reluctant to reduce asking prices and sales volume has shifted to lower priced units. The 36 condominium units sold and $119,500 median price reflected during this past quarter were nearly identical to the second quarter of 2000, nearly 10 years ago, indicating that future increases are imminent in this notoriously volatile sector of Guam’s real estate market. During the 3rd quarter, only three condominium sales closed at prices above $400,000 with the vast majority of sales closing at prices below $200,000.

Notable Transactions – Third quarter 2011 sales volume included two industrial property sales at prices over $1.0 million, including the $2.1 million sale of the 21,600 square foot Proline warehouse complex in Harmon Industrial Park. Multifamily apartment sales during the quarter included the $2.5 million sale of the 66 unit Granada Apartments Complex at Oka, Tamuning. Commercial property sales during the third quarter included two grocery store related properties at prices from $800,000 to $2.5 million. In addition to the $17.6 million Tumon beachfront sale, the nearly 250 land sales closed during the quarter included three deals priced above $1.0 million and two sales reflecting unit rate prices over $200 per square meter. Land sales at Guam’s premier gated residential communities have stalled with no lot sales recorded at Talo Verde or The Laguna at Pago Bay Resort during 2011. Guam’s premier residential subdivision, Talo Verde, continued through its foreclosure related sales activity with Department of Land Management records reflecting seven Talo Verde Acquisition LLC house sales during the third quarter at indicated prices of $540,000 to $600,000 with buyers including Guam Pinnacle Corporation, Manu Melwani, Tamio Clark, Felix P. Camacho and Louie Yanza.

Closing Out You’ve decided to buy a house. Now what? By Faye Varias The Offer to Purchase While there is no perfect plan to get a seller to accept an offer, it’s always important to move fast when you find a house fitted to your needs. One rule of thumb is to offer a price that is eight to 10 percent below the asking price. There is room to negotiate, but remember to stay under what you’ve determined you can afford. Making the Deposit A “good faith” deposit is often required to show the commitment by the buyer to the seller, usually one percent of the home’s purchase price. Your REALTOR® or seller’s lawyer may hold the deposit in trust until your deal is closed. If you decide not to close after your offer is accepted, this deposit may be nonrefundable. However if the seller doesn’t accept your offer, the deposit will be returned. If the sale proceeds, your deposit is usually applied to the down payment. Contingencies These are certain requirements specified in a contract that need to be met before the buyer is required to close. Typical among them: the buyer's securing of financing and an acceptable house inspection. Generally speaking, an inspection contingency covers a 10-to-14-day period from the acceptance of the contract, and financing contingencies run for 30 days. But in a seller's market, buyers may be asked to fulfill their contingency requirements in shorter time frames. Home inspection In a home inspection, a professional conducts a thorough examination of a property to assess its structural and mechanical condition. The idea here is that a trained home inspector will be able to catch potential problems that a buyer might not detect. The Contract This follows the acceptance of an offer by the seller, and it is a legal and binding obligation, on the part of the buyer, to purchase the property if any contingencies are met. It outlines the details of the transaction,
including: a description of the property, the selling price, the date of closing, the possession date and any applicable contingencies.
Settlement Sheet Also called a "closing statement" or a "settlement statement," this is a document that the Department of Housing and Urban Development (HUD) requires to account for all financial aspects surrounding the sale and purchase of a home. It provides an enumerated list of the funds that were paid at closing. Items on the statement include real estate commissions and initial escrow amounts (money or securities deposited with a neutral third party – the escrow agent – to be delivered upon fulfillment of certain conditions). The Real Estate Settlement Procedures Act requires that a copy of the settlement sheet be distributed to both parties at least one day prior to settlement. Closing Documentation Before you can close on a house, some paperwork such as a title search to make sure the title is clear, title insurance to protect the buyer and the lender from an oversight regarding a claim on some aspect of the property and an application for homeowner's insurance (necessary for securing a mortgage). Closing Costs The total amount of closing costs varies, but may include: a loan origination fee, an appraisal fee, the cost of a credit report, a lender's inspection fee, the cost of title insurance, a mortgage broker fee, taxes and a fee for document preparation. Your lender is required to give you prior notice of fees associated with your loan. Final Arrangements Before the deal is closed and you take possession, you must make some practical arrangements regarding utility service and first mortgage payment. Settlement Settlement describes the payment of the balance of the purchase price the buyer owes on the property, and the transfer of the title. It takes place on the possession date specified in the agreement.

BE A GREASEBUSTER AND HELP KEEP OUR ISLAND GREEN & CLEAN By GRESCO e all know we’re not supposed to pour used cooking oil, bacon fat, or other grease products down the drain, but we do it anyway. And GRESCO knows it happens anyway because we are often called to open kitchen drains when they get clogged, and remove globs and globs of solidified cooking grease. We recently replaced some kitchen pipes for a remodeling project and peered through a section of drainpipe after it was removed. A layer of solidified oils and fats had reduced the width of the pipe to only 3/4 of an inch. It was only a matter of time before a small piece of food lodged itself in the grease and caused a clog! Even if you run lots of hot water and soap down the drain while pouring the oil, it’s still going to collect on the pipe walls and turn into a sludge that is hard to remove from your pipesoften requiring high-pressure water jetting. But if we’re not supposed to pour greasy and oily substances down our drains, then what do we do with them? Here’s what you can do: Keep a sealable container like a peanut butter jar or pickle jar (either glass or plastic if you’re afraid glass will break) near your sink, and after the oil has cooled enough (especially if you’re using a plastic bottleyou don’t want to melt the plastic), carefully pour

the grease into the jar. When the jar is full you can throw it in the garbage if it’s small, or drop it off at any one of GRESCO’s locations.* You can also use the grease in a compost heap if you have one, or take it to our local landfill. Contact Guam Waterworks Authority or Guam EPA for more information on how to properly dispose of used cooking oil and grease. During the Great Depression, families would often re-use their cooking oil several times before discarding it; and during WWII, families used to save their bacon fat in jars and donate them to the war effortwhere factories would use the fat to create glycerin for explosives. Today, you can still use your cooking oil more than once if it was lightly used and you strain it through a fine mesh strainer or cheesecloth. GRESCO has developed a recycling program and drop-off points for used cooking oil to be safely disposed of and recycled as fuel. Each household is allowed to drop off up to five gallons of used cooking oil per month; free of large food particles (bones, solid fat particles, etc) and other debris such as paper, plastics, and Styrofoam, at any of our several locations throughout the island. Be a GREASEBUSTER and help keep our island green and clean.

Dual Agency How it Works

y definition Dual Agency or Limited Agency, in Real Estate related terms, occurs when the same Brokerage is in position to represent both the Seller and the Buyer in a sales or lease transaction for the same property. Here are two random examples of how this can actually happen: 1. A Real Estate Broker/Agent are contacted directly by a prospective Buyer or Tenant interested one or any of one of their listed properties. The Broker is put in a position to represent both Buyer and Seller if it relates to a property they already have listed. 2. Two different Agents from the same Brokerage are in a position to represent Buyer and Seller for the same property or even another that is already listed by the same Broker. The Seller can also be the Owner or Landlord of a subject property and the Buyer can also be an Investor or the Ten-

ant of the same. All are considered to be clients and or customers of the Real Estate Broker. Dual Agency requires a unique approach than the most ordinary form of representation called Exclusive Agency. In an Exclusive Agency the Broker represents the best interest of one party exclusively, Buyer or Seller, acting as their advocate and negotiating price and terms most favorable for their respective client/customer. In Dual Agency the Broker is put in a position to represent both Buyer and Seller now becoming a facilitator or intermediary, not an advocate. The Dual Agent would then be limited in providing any information which would give one party an unfair advantage over the other in the negotiation process. Dual Agency demands disclosure and mutual consent. This is extremely important because a conflict of interest can easily arise as a result. In the U. S. laws vary from state to state and interpret Dual Agency differently so it is very important to check local laws to get a reasonable understanding of how
these rules may apply to you. For instance “oral” disclosure is an acceptable practice in some places, but in others “written” disclosure is absolutely mandatory. Members of the Guam Association of REALTORS® are required to disclose Dual Agency and must receive written consent before proceeding with the transaction. There is a form called “Consent to Dual Agency” which has to be signed by the Seller, Buyer and Broker when Dual Agency occurs. This holds the REALTOR® accountable to a higher standard than the average licensed agent. GAR Members are trade professionals, sworn to abide by the NAR Code of Ethics and totally obligated to exercise a fiduciary responsibility including, but not limited to, open disclosure, due diligence, accountability, loyalty, integrity and obedience. There are some advantages and disadvantages to having Dual Agency as opposed to Exclusive Agency so I highly recommend you consult with your local Guam Association of REALTOR® Member so that you can get all the facts first. The Home Buying Process: Step by Step

uying a home can be a very intimidating process, especially if you've never done it before. So the first thing you should do before you start is to figure out whether owning a home is right for you. If you're in a region where housing is at a real premium or is very expensive (such as New York or California), it may be better for you to continue renting. Take into account that if you do buy a home, there are extra responsibilities and costs that go along with it — such as lawn care, snow removal, home maintenance and repairs, etc. Ok, then. You've decided that renting is no longer for you and you want to move into your own home. Where do you begin?
Step 1: Check Your Credit Report and Score Before getting any kind of loan, you should always check your credit. According to the law, you're allowed to receive one free copy of your credit report per year. You can do this by visiting Annualcreditreport.com. Don't forget to check your report for errors.
Step 2: Figure out How Much You Can Afford
pre-approvals. Pre-qualifications are only a guess based on what you tell the lender and are no guarantee. A pre-approval will give you a better idea of how big a loan you qualify for. The lender will actually pull your credit and get more information about you. Quicken Loans offers a Mortgage 1st approval before you start home shopping. With an actual approval, you're ready to make an offer, and the sale will go much quicker. Besides, your offer will look more appealing than other buyers' since your financing is guaranteed.
Step 4: Look for the Right Home Make a list of the things you need to have in the house you buy. Ask yourself how many bedrooms and bathrooms you'll need, how big you want the kitchen to be, if there's an adequate number of closets and cabinet space and if the yard is big enough for your kids and/or pets to play in. Once you've made a list of your must-have's, don't forget to think about the kind of neighborhood you want, types of schools in the area, the length of your commute to and from work and the convenience of local shopping. Take into account your safety concerns as well as how good the rate of home appreciation is in the area.
You can calculate how much you can afford by starting online. Quicken Loans Home Affordability Calculator can help you calculate an affordable monthly mortgage payment. Don't forget to factor in money you'll need for a down payment, closing costs, fees (such as for an attorney, appraisal, inspection, etc.) and the costs of remodeling or furniture. Remember that you don't always have to put down 20 percent as your parents once did. There are loans available with little to no down payment.

To find a real estate agent, it's best to shop around. Get recommendations from your friends and family and check with the Better Business Bureau. Talk to at least three or four real estate agents. Now that you've found the home you want, you have to make an offer. Most sellers price their homes a bit high, expecting that there will be some haggling involved. A decent place to start is about five percent below the asking price. You can also get a list from your real estate agent to find out how much comparable homes have sold for.
There are many different types of mortgage programs out there, but as a first-time home buyer, you should be aware of the three basics: adjustable rate, fixed rate and interest-only. Adjustable rate mortgages (ARMs) are shortterm mortgages that offer an interest rate that is fixed for a short period of time, usually between one to seven years. After that, the interest rate can adjust
every year up or down, depending on the market. These are good for people who don't plan on living in their home very long and/or are looking for a lower interest rate and payment. Fixed-rate mortgages are more traditional and offer a fixed interest rate (and thus a fixed monthly payment) for a longer period of time, usually 15 or 30 years, though they're available in 20 or 25 year terms. These are good for people who like a predictable payment and plan on living in their home for a good long time. Both fixed- and adjustable rate mortgages can have an interest-only payment. What this means is that for a certain amount of time during the loan term, you're allowed to pay only enough to cover the interest portion of your payment. You can still pay principal when you wish, but don't have to if your budget is tight. There is a myth that with interestonly mortgages, you don't build equity. This is not necessarily true, since you can build equity through home appreciation. The benefit to interest-only mortgages is that you increase your cash flow by not paying principal. Landscaping Choices For New Home Design

ou may have always heard the old adage that "first impressions" are the ones that count most - and this is all too true when it comes to curb appeal and your home. If you are designing a new home, or revamping your existing home (perhaps to put it on the market), then you must add some curb appeal in order to make your home a stand out in the neighborhood. Landscaping choices can go a long way towards adding curb appeal - which means that lawn maintenance and lawn care has taken on a whole new importance.

Go For a Healthy Lawn Just like a bright smile is a sign of health, a beautiful, healthy, green lawn that is lush and full, yet manicured, is a sign of a well-kept home. Whip your lawn into shape by using fertilizer, weed eliminator, and good techniques with edging to add maximum curb appeal.
Choose Contrasting Plants The plants around your lawn can make or break the appearance of the lawn, and give it an inviting look. Choose plants that contrast with the mulch you are using for maximum visual impact; as an example, if your plants are dark and rich, then choose light mulch and dark mulch for light colored plants. Curb Appeal Tip: Choose Plants by Foliage, Not Flowers While flowers are beautiful and can add some nice curb appeal, they don't last very long. To get the most for your money, choose plants and landscaping that have beautiful, dark foliage instead.
Don't Go Over the Top Keep your landscaping simple and clean, don't overdo it. One of the obvious disadvantages to "too much" landscaping is that it is harder to maintain properly. Likewise, it creates visual clutter that may detract from your home. You want your home and your property to be inviting, but too much landscaping can actually be intimidating - especially if you're trying to sell your house. Who wants to trim two acres of hedge? That might be an exaggeration, but never do more landscaping than you are comfortable with maintaining regularly.`
Keep it Manicured When we want to make a good impression, we make sure our appearances are manicured. The same is true for your lawn. Mow it, trim it, edge it, and clip it - including your lawn, trees and plants - to get the most curb appeal.
Other Exterior Concerns Besides your landscaping, there are other concerns for the outside of your property that you should take into consideration when it comes to adding curb appeal. Obviously, you want a great walk way to the front exterior. Make sure the walk way is uncluttered and laid out well. The driveway to the home should be in excellent shape (no "pot" holes or cracks). The exterior lighting should be clean and in good working order as well. Increasing Curb Appeal I saw an ad for a book entitled 197 Ways to Have More Curb Appeal. I don’t know all of them, and I don’t want to. Here are the 15 or 20 ways I think will give you the most bang for your buck and make the most difference to the appearance of your home. They are in no particular order of importance. It’s up to you to decide what you think is appropriate for your home, and what will do the most to enhance curb appeal. Here they are:
Install Outdoor Lighting

Enhance Your Entry Even with a small budget, there are ways to draw attention to your front door. Molding acts like a picture frame when applied around a doorway.
Add Shutters Or Accent Trim Shutters and trim add a layer of beauty to your home's exterior. Shutters also control light and ventilation, and provide additional security. Exterior shutters can be made of wood, aluminum, vinyl, composite, or fiberglass.
Landscape lighting makes a huge impact on your home's appearance, while also providing safety and security. Fixtures can add accent lighting to trees or the house or can illuminate a walking path. If you aren't able to use lights that require wiring, install solar fixtures (but understand that their light levels are not as bright or as reliable).

Renew Paint, Siding, And Trim
House numbers, the entry door lockset, a wall-mounted mailbox, and an overhead light fixture are all elements that can add style and interest to your home's exterior. These elements add the most curb appeal when they function collectively. Oiled-bronze finishes suit traditional homes, while brushed nickel suits more contemporary ones.
An exterior facelift (new paint, siding, or trim details) automatically transforms the look of a home. Any obvious defects, such as cracked or rotting material, can downgrade your curb appeal and diminish the value of your house.
If your home has an older gutter system, odds are it's also suffering from peeling paint, rust spots, or other problems that can convey a sense of neglect. Replace old systems. Copper systems, while pricier, convey a look of quality.
Apply Stone Veneer
Get garden beds into shape by pruning, pulling weeds, planting flowers, and adding new mulch. If your border is old or tired-looking, try upgrading to stone or a decorative cast-concrete edging system.
Stone is a great option for dressing up exterior features such as concrete foundations, column footings, and other masonry details. Natural and manufactured stone can be costly options for large areas, but both are affordable and well suited for use as accents.

Symmetry is not only pleasing to the eye, it's also the simplest to arrange. Symmetrical compositions of light fixtures and front-door accents create welcoming entries. When a door is flanked by two sidelights, or two planters, it makes a difference.
If your driveway is cracked or stained or has vegetation sprouting from it, you can upgrade it without doing a complete redo. First repair the cracks and stains (and kill the weeds), then dress it up by staining the concrete.
Dress Up The Front Door
Arbors, garden gates, and short sections of decorative fence panels will enhance your curb appeal. These can be found in easy-to-build kits or prefab sections you simply connect together. For best results, paint or stain these items with colors already on your house.
Renew Planter Beds
Your front door is the focal point of your home’s curb appeal. Make a statement by giving your front door a blast of color or by installing a custom wood door. Clean any dirty spots around the knob, and polish the door hardware. Your entry should also reflect the interior, so choose a wreath that reflects your personal style.
Upgrade Your Mailbox Mailboxes should complement the home and express the homeowner's personality. Dress up posted boxes by staining or painting the wooden post to match the house's trim and woodwork.
Create An Instant Garden Container gardens add a welcoming feel and colorful appeal to any home exterior—quickly and affordably. You can buy ready-made containers from garden centers or create your own with your favorite plants. For most landscapes, a staggered, asymmetrical arrangement works best.
Add Outdoor Art Give your yard a little spunk by adding weather-resistant artwork. Choose pieces that complement your home's exterior elements. Birdbaths, metal cutouts, sculptures, and wind chimes are good choices for outdoor art. Water sculptures (fountains) not only function as yard art, but the burbling sounds soothe and make hot days feel cooler. Place fountains on level ground in optimum hearing and sight vantage points. Build A Walkway Well-designed walkways make your home feel warm and inviting. For a dramatic improvement to a straight concrete path, replace it with a contoured one made of stone or brick. For a less costly upgrade, apply a colored concrete resurface to the old walkway, then edge with brick or stone borders.
Upgrade Railings Porch and stoop railings can deteriorate quickly if not treated properly. If your railings are past their prime, look for good quality components to replace the existing material. Make sure the color, scale, design, details, and material are compatible with the home.

What If REALTORS® Didn’t Lead? (Part 1) What would the real estate industry look like without the leadership of REALTOR® associations and volunteers?
W
It may be hard for real estate practitioners today to imagine, but there was a time—long before state licensing—when the practice of real estate wasn’t even recognized as a profession. Only through the work of hundreds of REALTORS®, who fought for years, was the profession established and standards and license requirements created. Perhaps not surprisingly, professionalism was one of the national association’s first major advocacy campaigns. Since then, REALTORS® have championed private property rights, tax incentives for home ownership, secure and affordable home loan products, environmentally responsible building practices, and hundreds of other issues affecting both real estate practitioners and property owners nationwide. Today, however, there is a real possibility that the industry will face a back slide of some of its achievements. For instance, there is talk that Congress may do away with real estate tax deductions and reduce housing loan limits to trim the federal deficit.
In a virtual town hall meeting he hosted this spring to introduce the national association’s new sweeping political advocacy and community leadership initiative, 2011 NATIONAL ASSOCIATION OF REALTORS® President Ron Phipps cautioned, “The privileges we’ve had, our parents had, and our grandparents had since World War II are being eroded, and our children face having [those privileges] denied to them.” NAR’s political advocacy project, called the My REALTOR® Party Initiative, is a call to action for associations and members to become more politically active. This rallying cry is not only to encourage members to defend established benefits, but to become modern advocates for the new issues relevant to their business and home ownership. -National Association of REALTORS®The Guam Association of REALTORS® shall remain your leading advocate for promoting and protecting homeownership on Guam.
