The ERA: A Bit of History The Constitution does not guarantee equal rights without regard to a person’s sex. The only right that the Constitution speciﬁcally afﬁrms to be equal for women and men is the right to vote (19th Amendment).

What is the Equal Rights Amendment?

Section 1. Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex. Section 2. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article. Section 3. This amendment shall take effect two years after the date of ratification. 1840 ~ Women begin to fight for the vote. They were called suffragettes in England and suffragists everywhere else. At this time, women were property of their fathers, then husbands. They could not own property, could not sign contracts, could not vote, file lawsuits nor have their own money. 1868 ~ The 14th Amendment and, in 1878, the 15th Amendment grant citizenship and suffrage to African-Americans but not women. The word “male” is added to the Constitution but not the word “female.” A suffrage amendment to the Constitution is presented to Congress but repeatedly fails to pass. 1875 ~ The Supreme Court rules against women’s right to vote. 1916 ~ Alice Paul forms the National Women’s Party and attempts to introduce equal rights legislation while Margaret Sanger fights to legalize birth control, founding Planned Parenthood in the early 1920s. 1920 ~ The 19th Amendment women’s right to vote is ratified. 1923 ~ The Equal Rights Amendment is introduced into Congress that year and every year after but never passes. 1972 ~ Title IX, federal civil rights statute prohibiting sex discrimination in education is passed. The Equal Rights Amendment is approved by the Senate and sent to the states for ratification. 1971 ~ The Equal Rights Amendment is approved by the House of Representatives.

1994 ~ Beginning in 1994, ERA advocates have been pursuing two different routes to ratification: the traditional process described in Article V of the Constitution (passage by a two-thirds majority in both the Senate and the House of Representatives, followed by ratification by three-quarters of the states), and the innovative “threestate strategy” (ratification in three more of the 15 state legislatures that did not ratify the ERA in 1972-82, based on legal analysis that when three more states vote yes, this process could withstand legal challenge and accomplish ratification of the ERA). 2010 ~ Supreme Court Justice Antonin Scalia says he does not believe that the Constitution protects against sex discrimination. 2017 ~ On January 21, 2017, women are marching in Washington D.C., all over the United States and dozens of other countries for many causes from women’s economic equality, religious freedom, ethnic and sexual diversity, agency over our own bodies, and reproductive decisions to clean water, the environment, and a myriad of social justice issues.
