Important new legislation that appeared in this short fall session included an amended Personal Information Protection Act. This statute comes into force January 1, 2004, and will have wide application to and impact for Alberta businesses and other “organizations”. The consolidated Family Law Act was also passed, although it will not come into force until proclamation. Bill 56, the Alberta Court of Justice Act, which would create a sort of merged Family Law Court, died on the new paper. It is expected to re-appear in Spring, 2004.

Summary: Petty Trespass Act – Increase of maximum fine from $100.00 to $2000.00 for first offence and up to $5,000.00 for repeat offence. Requirement to give notice to trespasser that entry is prohibited. Removal of restriction on prosecution under the Act. Removal of exception to trespass based on reasonable expectation of right to do so. Trespass to Premises Act – Maximum fines increased. Removal of restriction on prosecution under the Act. Young Offenders Act – Renamed the Youth Justice Act. “Young person” and “child” are redefined. “Alternative measures” now known as “extra-judicial sanctions”. Youth Court now known as Youth Justice Court. Dispositions now known as “youth sentences”. Fines increased from $500.00 to $1000.00. Sentences may now include any combination of community service, probation and fines. Clarification on the conditions imposed under a probation order. Changes to the coming into force of a probation order. Failure of a parent to receive a copy of a probation order does not affect the validity of a probation order. Progress report may be submitted orally or in writing. Public morals no longer a consideration for determining whether to exclude a person from proceedings. Court may admit into evidence any statement or waiver by a young person despite irregularities. Proceedings which are commenced but not completed must be dealt with as if the offence occurred after the coming into force of this Act. Consequential amendments to several statutes as a result of the renaming of the Act.

Summary: Requirement to commence or continue activities in accordance with a code of practice. The code of practice governs many aspects of liability under the Act. Several terms are redefined. Power of director to re-designate activities as activities in respect of which an approval is required. Regulation making power respecting re-designation of activities requiring approval to activities requiring registration. Requirement to provide security and carry insurance in respect of inactivity which is subject to a code of practice. Reports to the director regarding the release of a substance into the environment. Such reports may now be made by electronic means. Environmental protection orders may be issued for release of substances in respect of a substance released regardless of when it was released. Discretion to refuse issuing a reclamation certificate where application is incomplete or inaccurate. Generally expands powers of inspectors. Inspectors now responsible for environmental protection orders after reclamation certificates have been issue. Regulation making power to set a date regarding issuing environmental protection orders has been broadened.

credits and removal and storage of specified gasses. Mandatory reporting requirements respecting the release of a specified gas. The Minister may make agreements regarding intra-jurisdictional co-operation. Creation of proprietary interests in a “sink” which is defined as a component of the environment which removes or captures specified gasses and includes a geological formation or constructed facility that is used to store specified gasses. Establishment of the Climate Change and Emissions Management Fund for the purpose of conservation, reduction of specified gas emissions and other related programs and measures. Failure to comply with the Act or Regulations may result in an administrative penalty payable to the Government. Liability of directors and officers for contravention of the Act. Vicarious liability of corporation for its employees. Prohibition on disclosure of certain prescribed information. Lieutenant Governor in Council granted a broad range of Regulation making powers to administer the Act and specifically can make Regulations respecting agreements, levels of specified gasses, record keeping standards, disclosure of information, defining terms as well as many other areas set forth in section 18(1). Restrictions and requirements for setting or increasing tuition fees, borrowing, investing, acquiring and/or using land as well as various other aspects of postsecondary learning. Summary: New sub-clause added to the definition of permanent establishment. Where a corporation or partnership does not have taxable income, the Alberta Allocation Factor shall, for certain purposes, be determined as if the income were $1.00 for the year. New definition of the amount taxable in Alberta. New formulas for calculating royalty tax deduction. Rules for calculation of tax payable by a corporation that has a taxation year in 2003. New formulas for calculating specified partnership income. Deductions for tax payable by a Canadian-controlled private corporation with a taxation year ending after March 31, 2003. Repeal of the Appeal Committee and associated rights to object or appeal a determination or an assessment. Specified sections of the Federal Act apply for the purpose of determining a taxation year of an Insurance Company. In force:

Municipal Government Amendment Act, 2003 Bill 46 Amends:

Summary: Definition of tobacco products broadened to include tobacco sticks. Tax rate on cigars are lowered. Minister may require a person who collects taxes to deposit amounts collected into an account at a financial institution specified by the Minister. Creation of duties and liabilities for “responsible representatives” such as trustees and receivers who deal with the property or business of tax collectors. Liability for non arm’s length transferees where tax collector is insolvent or becomes insolvent. Extended liability for directors where a corporation has failed to remit tax collected. Lieutenant Governor in Council may now make regulations regarding licensing of persons who produce tear tape.

Summary: Changes to definitions of several defined terms. Power of Minister to cancel or suspend recreational licenses where offenses committed in another jurisdiction. Minister may issue authorizations. Expanded scope of trafficking in wildlife. License holders may only remove traps which they believe have been set unlawfully and must report the removal to a wildlife officer. Prohibitions on training dogs for the purposes of hunting wildlife. Power of wildlife officers and guardians to order removal of attractants and to search for and inspect attractants. Certain sections of the Criminal Code apply to warrants issued under the Wildlife Act. Wildlife officers/ guardians and certain Crown employees are provided with immunity for contravening provisions of the Wildlife Act, provided they are carrying out specified duties. Increased fines and imprisonment for offences. Increased fines and imprisonment for corporations, repeat offenders and for hunting of a grizzly bear. The Legislative Review Committee is a joint committee of the Law Society of Alberta and the Canadian Bar Association Alberta. It has subcommittees in both Edmonton and Calgary and has filled a role in the legislative review process in Alberta for over 30 years. The Committee reviews all bills introduced in the Alberta Legislature and provides comments and assistance to both Government and the Bar on drafting and operative aspects of legislation and amending legislation. The Committee is often called upon confidentially to give legal practitioners’ input on draft legislation and regulations. It played significant roles in the shaping of the Personal Property Security Act, the Civil Enforcement Act, the Builders’ Lien Act and other Alberta statutes. Its chairperson sits as a member of various stakeholder committees consulted by Government, including the Registry Liaison Committee, which have helped shape statute law. The Committee draws upon practitioners with a wide range of practical experience, some of whom have served for many years. It also, through its Legislative Liaison Officer, facilitates input by CBA sections, the Law Society, and business and community groups on the policy of legislation. At the end of each legislative session the Committee publishes and circulates to Bench and Bar a short summary of all legislation passed during the session. E.M.
