CBABC ADVOCACY UPDATE

HISTORIC NEW INDIGENOUS HUMAN RIGHTS LEGISLATION

In its 2017 platform paper, An Agenda for Justice, CBABC called on the provincial government to recognize Indigenous justice systems in a manner consistent with treaty and constitutional obligations, as well as the United Nations Declaration on the Rights of Indigenous Peoples (“UNDRIP”). The UN Declaration is an international set of standards to protect the rights of Indigenous peoples. It outlines rights in all areas of life — such as human rights, education and health. The Truth and Reconciliation Commission called for UNDRIP to be used as a framework for moving toward true and lasting reconciliation.

In November 2019, the BC government unanimously passed Bill 41, the Declaration on the Rights of Indigenous Peoples Act. Bill 41 mandates the government to harmonize its policies with the UN Declaration. British Columbia becomes the first jurisdiction in Canada to adopt and implement UNDRIP; all current laws will be harmonized with UNDRIP principles, and all future laws will be drafted in consultation and cooperation with the Indigenous peoples throughout the province.
