Government backs Gosford redevelopment It’s taken two years but perhaps the Lend Lease proposal for the redevelopment of the Gosford Waterfront was far too ambitious for the community to embrace. However, with committed local members knowing that the community wants to see a renewed Gosford, both the Minister for the Central Coast and Member for Terrigal Chris Hartcher and Member for Gosford, Chris Holstein have been working to get a positive outcome – and “we are at last getting good traction” says John Taylor, Chairman of the Central Coast Regional Development Corporation (CCRDC). “I am very confident we will see cranes on the site mid next year” says Mr Taylor. Following some objections against the Lend Lease proposal in 2011 the (CCRDC), which has responsibility for the redevelopment of Gosford, reviewed the objections and earlier this year submitted a revised proposal to the Minister for Planning over the State Significant Site taking those objections into account. This revised submission contains no commitments about the designs or specifications of what potential new buildings could look like. If the DCP amendment is approved, issues such as building location, shape and form will be on public exhibition and available for comment

during the relevant development application process. This revised submission, named “The Waterfront – Renewing Our City” returns to the principles of the Our City, Our Destiny Masterplan that resulted from the Gosford Challenge undertaken by Gosford Council in 2009. It was the most comprehensive community consultation process ever undertaken by Council in relation to the future of the City. So much so that it gave the previ-

ous Government the confidence to establish the CCRDC and give it responsibility for developing all state government owned land in the region which included the waterfront at Gosford. As the Gosford waterfront is a State Significant Site (SSS), consent authority rests with the NSW Minister for Planning and Infrastructure. Commenting on the current status of the Submission, Mr John Taylor said, “we were pleasantly surprised by the level of

supportive comments lodged during the public exhibition of our revised submission. While the Department of Planning is yet to complete their professional analysis of the submissions we are confident that all issues raised that are relevant to our application can be satisfactorily addressed.” “We are planning to lodge a DA for the first commercial building by October this year on the expectation that by then we will have successfully addressed all issues and achieved approval.” “This timetable would allow building commencement by mid 2014 and occupation in the first quarter of 2016,” he said. Mr Taylor praised the work of the local State Members. “Chris Holstein has been particularly helpful in arranging access to the numerous departmental officers we have needed to talk to. Recently Minister Hartcher arranged for the CCRDC to make representation to Ministers Pearce (Finance) and Stoner (Regional Development) in relation to obtaining a government agency relocation to occupy a substantial proportion of the building we propose to complete in 2016”. “Whilst no commitment has yet been made, the positive support of Minister Hartcher and the response by the relevant

Ministers reinforces the confidence I have been publically making,” said Mr Taylor. Asked whether the Minister for Planning, the ultimate authority, would support the redevelopment of the waterfront Mr Taylor said, “the NSW government and all Ministers now understand the need to support what we are doing and get Gosford happening and improve the region’s economy. We previously had not received the level of support we are now experiencing.” “Minister Hazzard, is responsible for ensuring the planning approval process

is transparent and carried out with integrity and appropriate governance. We understand his position and are very comfortable with the support he provides within the bounds allowed by his regulatory responsibility,” said Mr Taylor. Asked if we will see, in the future, the other stages initially proposed reactivated Mr Taylor said the previous Lend Lease option is no longer in consideration. “The CCRDC has no plans to initiate any other waterfront development than that within the boundaries of the Continued on page 23

Innovation the key to the region’s economic future The Federal Government cops a lot of flack for the way it is running the country and deservedly so in many cases – particularly in industrial relations, where the unions are running the show and climate change where we are trying to out-bid the Europeans to change the world, and not forgetting spending like there is no tomorrow! But, like every government they do get some things right. The NBN is an investment in our future and will go down as one of their greatest legacies and the Central Coast is a big winner on this one thanks to the work of our local Federal Members. Another is their Enterprise Connect initiative which is a partnership between government and industry which is doing a great job. Part of this is the Innovative Regions Centre which works closely with regional industry organisations, local governments, businesses, regional universities, and communities in important regions across Australia. The Centre takes an innovative approach to helping expand markets, boost local economies and create new jobs. The Central Coast is one of only eleven Innovative Regions in Australia with a dedicated Innovations Facilitator, Graham Baker, working on the Coast to support and encourage an innovative approach to what we do.

He is supported by a handful of committed people led by Dr Anton Kriz, a Senior Lecturer at the University of Newcastle’s Newcastle Business School. A Central Coast resident he specialises in doing business with China and is passionate about innovation and how small business can make a difference to our economy by being agile and innovative. The Feds picked the Coast to be an Innovative Region because innovation had been identified in the 2009 Regional Economic Development and Employment Strategy (REDES) as a significant driver of economic and employment growth. Backed by the previous state government and launched by Premier Keneally in 2010, it is the one Report, out of all those that have been carried out over the years, that had any real substance and to their credit the present government is committed to it. The work of Graham Baker and Anton Kriz has given rise to a loose knit group of supporters who operate under the banner innov8central and it is this group that have organised the third Central Coast Innovation Summit (see pages 7 and 8) to be held on 13th June. Our region has a huge number of innovative people, and business people at that, who are making a difference to our economy. They fly under the radar so

they don’t get the accolades they deserve but they are an important and growing segment of our economy. With the National Broadband coming along we will see many of these businesses expand and new ones pop up. Good news for Gosford this month with the State Government committing to the Gosford Waterfront redeveloped, starting with the Gosford Primary School. The CCRDC went right back to the original Masterplan for Gosford, which had widespread community support, revising that which was proposed by Lend Lease and which scared the pants off some of the locals. The CCRDC is now preparing a DA for the school site which Chairman John Taylor says will be lodged with Gosford Council in October this year. He wants to see construction start by mid 2014. A big ask but he is the man to do it. A hell of a lot of effort has gone into getting this far particularly on the part Continued on page 25

Coast takes lead in Innovation Innov8Central, the organisation set up three years ago to implement the Central Coast Innovation Plan, has reported back to stakeholders on the results of its work so far and it makes for positive reading. Innovation in the Central Coast of NSW – Exploring the quality of our thinking is the work of Chairman, Dr Anton Kriz and researcher Caroline Veldhuizen. It builds on the goal of the Innovation Plan, the aim of which is to ‘contribute to understanding and building a regional community and to put in place programmes to improve the quality of life for residents and improving the quality of regional businesses’. The Central Coast is one of only eleven Innovative Regions in Australia under the Federal Government’s Enterprise Connect initiative and is proving to be an Innovative Region. The Report highlights the Programmes that have been undertaken and details their success: • The Innovative Champions Programme Educating regional business and stakeholder representatives to be more innovative. So far thirty participants have

taken part in this Programme delivered by the University of Newcastle. • The Cluster Programme Contributing to the development of Clusters within the region, in particular; Manufacturing (which has seen the establishment of Central Coast Manufacturing Connect), Teleworking, Music, Social Enterprise and Creative Industries. The establishment of a Food Cluster is currently being considered. • The Monitoring Programme A programme of qualitative and quantitative research which has included a region-wide telephone survey of businesses and qualitative case study interviews. • The Gazelle Programme This programme has not yet commenced but will be aiming at supporting high growth regional businesses. The Report identifies the need to develop Knowledge Dynamics which are: relationships that exist or should exist between a business and its customers and suppliers, • relationships between business and knowledge providers, such as research, technology and industry organisations, • relationships between business and

policy makers and regional leadership via local councils, and • relationships between business and social enterprises and the community. The Report’s objective is to ‘Improve the innovation eco-system’ of the region. That is identifying and improving the elements that enable innovation to grow and develop. These are: Knowledge dynamics, Firm characteristics, Cluster and network characteristics, Culture and governance (leadership) and Regional socio-economic and cultural settings and their relationship with business. Futurist James Moody to address 2013 Innovation Summit Catching the Next Wave of innovation

The third Central Coast Innovation Summit will be held on the 13th June 2013 and will be the highlight of Central Coast Innovation Week. This year’s Summit will feature internationally renowned Futurist and thinker in innovation and sustainability, Dr James Bradfield Moody. The Summit will host nationally renowned speakers from the Carbon Climate Institute, Carbon Arts and the University of Newcastle. The Summit will also showcase local organisations that have adopted Sixth Wave Thinking in their business practices. On the back of two highly successful summits in the past two years this year’s summit will explore new business ideas and models that capitalise on the next wave of innovation.

The theme of the summit is “Catching the Next Wave of innovation: A resource efficient Digitally Connected Community”. The Summit takes its theme from the book “The Sixth Wave “by James Bradfield Moody and Bianca Nogrady. THE SIXTH WAVE is a popular business book built around extensive research with predictions and a roadmap to the future and explores how to succeed in a resource-limited world. The summit will explore the opportunity of coupling sustainability with digital technology to create a resource efficient digitally connected community. The key being for business is to work out how to take advantage of such opportunities. The Summit will also be the platform for Innov8Central to report on its progress over the past twelve months on the Central Coast Innovation Plan. Researcher, Caroline Veldhuizen who has been monitoring the plan’s implementation will present results from her investigations including a major Central Coast business innovation survey. The results have identified major issues for the region and will help guide our innovation strategy going forward.

Dr Anton Kriz, Chair of the Innovation Strategy will assess where we are as a community and where we need to go given this new level of data and evidence. He says, “Businesses need better information in what is a rapidly changing environment and so this type of information is critical. The role of innovation is now a central tenet of national and regional policy and one can expect some important implications in the lead up to the next Federal election. The aim of this year’s Summit is to provide exciting and informative speakers with plenty of food-for-thought for those looking to understand and take advantage of this new Sixth Wave of innovation. Finding ways to become more efficient and at the same time more effective is the key to business going forward. Grabbing hold of smart technologies and using these to your advantage is a key. Wallarah 2 Coal Project EIS on public exhibition Wallarah 2 Coal Project’s Environmental Impact Statement (EIS) has been released for public exhibition providing members of the community with the opportunity to find out more about the proposed underground mining operation northwest of Wyong. Project Manager of Wallarah 2 Coal Project, Kenny Barry, said that the public exhibition of the EIS is an important step forward in the planning and approval process and will provide an opportunity to address any stakeholder concerns. “The team at Wallarah 2 views community feedback as a highly valuable resource and we respect that every member of the public has the right to know what’s going on in their local region,” explained Kenny. The public exhibition phase will provide an opportunity to address all public concerns satisfactorily and field any feedback or input put forward by the community and other stakeholders. During this phase, members of the public will be able to ask questions, raise any issues and receive definitive answers regarding the Project. Mr Barry said “we also see it as a chance to address any misconceptions that may be circulating in regards to our proposal.” Throughout the public exhibition of the EIS, Wallarah 2 Coal Project will be

holding a series of community consultation sessions in May and June 2013. “We encourage interested parties to come along to our consultation sessions to voice any feedback and find out more about the Project and how it seeks to benefit the Central Coast commu-

nity, while protecting the region’s water resources,” said Kenny. “It’s important for the community to become aware of the benefits that will be provided through the Project, both in terms of job creation and boosts to the local, regional and NSW economies,” he added.

From jams to schnapps From barman to businessman, Gavin Yates is quickly making a name for himself in Australia through introducing innovations to the bar industry. His desire to manufacture quality beverages and help the bar industry deliver service more efficiently, all started out with making breakfast jams. After recognising the demands from the alcohol market, he set out to create his own unique range of products to appeal to consumers and bartenders alike, while taking on the larger international brands. Mr Yates started out making breakfast jams with his father in 1992 which grew into Dural Park Jams, Blue Mountains Honey and Granny Kookaburra Jams and Sauces. Business Awards scholarship to Marine Science student The 2013 Central Coast Business Excellence Scholarship in Marine Science has been awarded to Carol Martin who is in her final year of a Bachelor of Science (Honours) degree with a Marine Science major at the Central Coast Campus. The scholarship was made possible by the fundraising held at the annual Central Coast Business Excellence Awards dinner in August 2012. “We congratulate Carol on receiving this Scholarship and we are equally delighted that we could assist a Central Coast student in their quest to gain greater knowledge in their chosen field,� Central Coast Business Excellence Awards (CCBEA) Director, Kerry Ruffels, said.

Vale Ashley Reid 1947 - 2013 Ashley Reid grew up at Picnic Point at The Entrance and completed his schooling at Gosford High School. On leaving school, Ashley got a job as an apprentice carpenter but soon realised that was not for him and so he left for Sydney where he worked for a short time. On returning to the Central Coast, Ashley approached Regal Motors owner, Malcolm Brooks, for a job selling motor cars, setting him on a career that would make him one of the most respected motor car dealers in Australia. Ashley left Regal Motors to satisfy his thirst for travel in 1976, and spent two years travelling the world. In 1978, he married Cherie Howarth and a few years later they would establish their first business together, Kam’s Car Centre in Gosford, while at the same time starting a family. Once established and successful, they sold this business and subsequently opened Ashley Reid Motor Mart at North Gosford, selling that business in 1983. Ashley’s next venture was to buy McLean’s Caravans business at Tuggerah, a business that, as the name suggests, retailed new and used caravans and relocatable homes. In spite of the opinion of others that it could not be achieved, Ashley successfully introduced the concept of caravans and motor vehicles being sold side by side and introduced Daihatsu, his first new car franchise shortly after purchasing the business. At the time, there were no permanent relocatable homes permitted to be permanently housed at caravan parks. Ashley saw an opportunity for relocatable homes to be introduced as permanent fixtures in caravan parks (thereby providing an affordable housing option for retirees) and was instrumental in effecting change in the ordinances governing them. After selling the business at Tuggerah, Ashley returned to Gosford, relocating his staff to the old Gosford Motors site temporarily, calling it Westside Motors. Ashley’s next move, and the one that would establish him as a significant player in the new car business on the Central Coast, was to buy Roberts Auto Centre, owned by Richard Roberts and his family. It was 1986 and Roberts Motors (in Mann Street, Gosford) was a multidealership business, holding franchises for Mazda, Subaru, Volkswagon, Audi and Mercedes-Benz and a staff of around 30 . A few years later Ashley and Cherie bought the property and proceeded to build a stand-alone Mercedes-Benz dealership on the corner of Mann and Lindsay Streets. At the time it was regarded as the

most modern and sophisticated showroom outside a capital city. As the years unfolded, the Reids would build stand-alone showrooms for each of the franchises they owned, all within the one precinct. Ashley’s vision was that each showroom would be of the highest standard and equal to any. In 1996 he gained the Nissan franchise and built a new showroom across the road from Mercedes-Benz to house it. With this suite of franchises Ashley had the new and used car market covered on the Central Coast and viewed the multidealership business model as one that covered the whole market spectrum. By selling a range of cars from more affordable vehicles such as Daewoo to luxury vehicles such as Mercedes-Benz (including commercial vehicles), Ashley was able to ride out the cyclical nature of the motor industry more easily. Ashley Reid’s focus was not solely Gosford and he saw the Central Coast growing rapidly, particularly in Wyong, and in 1998, he established a Mazda and used car dealership in the centre of town. Ashley would later build a Nissan showroom and service department on the same site. In 1999, Ashley again sought improvement in the calibre of his dealership, building a new Mercedes-Benz service centre, which housed technicians for MercedesBenz, Subaru and Nissan. The cherry on the new development’s cake was Ashley’s “Silver Arrow” fine dine restaurant. In 2003, it was time for Ashley and Cherie to move on. With Ashley’s vision and management, he left Central Coast Motor Group as one of the Central Coast’s most successful businesses and the largest multi-franchise dealership on the Central Coast. After leaving the motor industry, Ashlely undertook various property developments in and around the Central Coast, Branxton and Gloucester regions. Every step of the way he was supported by his wife Cherie who worked in the business along side of him. Ashley’s daughter, Karina, noted “Cherie and Ash were the perfect match when it came to the business. One complimented the other”. “Every day Ashley walked right through every showroom, talking and listening to staff and customers,” said Mrs Reid. “He took a personal interest in every one of the 140 people who were working for him until his retirement. Ashley did all he could to

support and keep good staff which, in the end, he believed contributed to his success.” Many have said that he wasn’t a salesman, people bought off him because they believed in him and trusted him. Ashley was passionate about the region in which he lived his entire life and always instilled in the people around him the importance of supporting local business. Where Ashley could buy something on the Central Coast, he would. The story of Ashley Reid is one of a man of vision and of being a step ahead. Ashley saw and seized opportunities before they were apparent to most. Former Mayor of Gosford, Tony Sansom said, “Ashley was a highly respected businessman who succeeded in anything he put his mind to. He was good-natured, easy-going and generous, supporting several causes over the years including the Salvation Army. Ashley was always the true gentleman and was definitely one of those people who made the world a brighter place. He was a great champion for the Central Coast region through his strong investment in many projects including Central Coast Motor Group. He touched the lives of so many people and he’ll certainly be missed by all who knew him.” Ashley died on the 21st of April 2013, after a short illness. Ashley is survived by his wife Cherie, daughter Karina and son Danny.

Bunnings Warehouse West Gosford breaks ground Work has started on construction of a new Bunnings Warehouse at 5 Yallambee Avenue, West Gosford. The Pluim Group has been appointed builder of the 17,000 sqm project that is expected to be completed in late 2014. To mark the start of construction a ground breaking ceremony was held in late May with Mayor of Gosford City, Councillor Lawrie McKinna, Bunnings NSW Regional Development Manager, Andrew O’Neill, Council’s General Manager Paul Anderson and Pluim Group’s Managing Director, Scott Allen. Mr O’Neill said that the company would invest more than $40 million in the development of Bunnings Warehouse West Gosford on the over four hectare site. Bunnings bought the site in December 2009 paying $9.9 million with the intention of building a new larger warehouse but hit snags with their Development Application which was finally approved in May this year. “Gosford City Council is extremely supportive of this development, with Paul Anderson and myself meeting

proactive and supportive making investing in Gosford City an easy and attractive option,” Clr, McKinna said. Bunnings Warehouse West Gosford will include a main warehouse, indoor timber trade sales area and outdoor nursery, as well as a café and kids playground and parking for more than 500 cars. The new Warehouse will provide local residents with the widest range of home improvement and outdoor living products. As part of the development, the intersection of Yallambee Avenue and Central Coast Highway will be upgraded. The new expanded warehouse will employ around 200 people. Scape wins Ettalong foreshore tender Gosford Council has awarded a contract for construction of the Ettalong Foreshore Redevelopment to Terrigal construction company, Scape Constructions Pty Ltd. The contract, worth around four million dollars is for: 1. C onstruction of a new sandstone seawall, cycleway/ footpath, playground, park furniture, realignment of car park, stormwater infrastructure and landscaping at the reserve area between Beach Street to the Lemon Grove netball court entry. 2. C onstruction of a beach facilities building (café/kiosk/public toilets) at the end of Beach Street. 3. Beach nourishment (i.e. sand will be dredged from the centre shoal and pumped onto the beach. The beach will then be restored to a 15 metre wide beach). The construction period is thirty weeks and the work is scheduled to commence late May 2013. Council received five tenders for the work, two from Central Coast contractors, including Scape and three from outside the region. The tenders were assessed against the criteria as set out in the tender documents, which included tender price, finanJune 2013

cial details, insurances, contract program, Work Health & Safety, environmental management, sub contractors, referees and previous experience. The tender assessment indicated that Scape Constructions Pty Ltd ranked highly against all the stated criteria and is considered the best value to Council. Commenting on the winning the contract Scape Managing Director, Andrew Smith said, “We are very pleased to have been awarded this project. Over the last five years Scape has focused on civic projects which incorporate a combination of our key strengths which are civil construction, building and construction and landscaping. We believe this project will provide Ettalong with a much needed leisure area for the local community to enjoy”. Scape has also recently been awarded the contract for the Captain Cook Lookout Improvement at Copacabana which involves the demolition and removal of the old lookout and construction of a new, suspended steel, viewing platform. They are presently completing the Terrigal CBD & Hylton Moore Stormwater Harvesting Schemes, and works at Kincumber and Lisarow.

July completion for toyshop rebuild Gosford builders, North Constructions, is planning on completing their part of the contract for the rebuilding of a 3-unit retail complex on Karalta Road, Erina that was destroyed by fire in June last year by July. North’s were awarded the contract to rebuild the 2,500 sqm complex by the property owners’ insurance brokers and commenced construction in March. The $2.5 million project comprises 2 retail tenancies of approximately 500 sqm each plus a 1,500 sqm tenancy which was occupied by Casey’s Toyworld. The property is managed by Elite Strata Management.

One of the southern Central Coast’s most popular tourist businesses has been bought by Andrea and David Caterer from Morgan in South Australia. Formerly owners of the Daly Waters Pub and managed a restaurant in Mission Beach, as well as running the catering section of the hotel in Morgan, SA, the new owners are well experienced in catering and food service. The previous owners were surprised at the wide response to the website advertising. The sale was negotiated by Geoff Trebble of Southern Cross Business Brokers, West Gosford who said the business sold within two weeks of the listing at full price.

Express Lube has opened its third auto service centre on Karalta Road, Erina. This is the third centre for Express Lube since opening their first in 2009 at West Gosford and then at Tuggerah in 2011. types of employment? The short answer eys - Suites 2/3 is nothing – and something. There are nce Road, ERINA still the same categories, but ‘casual’ employment is increasingly taking on the features of permanent employment. So, here is a quick summary of the current state of play.

Permanent Employee As the Supreme Court of NSW said recently: “Life employment is not unknown, but will not be the proper meaning to be given to a term of a contract unless there is the clearest intention. What then is the clearest intention? The Supreme Court of Victoria recently considered the claim of the plaintiff that: “…he was told, when interviewed … After the completion of the five year period ‘then you had a job for life’. Putting to one side the meaning that could be attributed to the critical phrase, the remark relied upon by the plaintiff seems to me to be no more than a colloquial exposition of a virtue of service in

the railways as popularly - whether or not accurately - understood in those times…” If not for life, then employment contracts are terminable on notice or for serious misconduct. For most employees, the unfair dismissal provisions impact on that principle.

Fixed Term It is – as it is. The term is determined by the notice period expressed in the agreement. Employment agreements for a specified period do not enjoy the protection of the unfair dismissal provisions of the Fair Work Act. However, it is important to note that for the purposes of unfair dismissal rules, agreements that are terminable by the employer and employee prior to end of the term are not considered to be for a specified period and, therefore, the unfair dismissal protection applies. The courts have also held that the expiration of a contracted term does not amount to termination at the initiative of the employer.

However, many casual employees enjoy the benefit of protection from unfair dismissal where they have worked on a regular and systematic basis for more than 12 months (if less than 15 employees) or 6 months (if 15 or over employees). Reducing a casual employee’s hours is always an option (although some issue of adverse action can arise), but termination of a casual employee can open the way for an unfair dismissal claim. Thus for most casuals, the term of their employment is similar to a permanent employee, once the minimum employment period (6 or 12 months) has passed. Moore J in Reed v Blue Line Cruises (1996) Fed Ct describes it thus: “A characteristic of engagement on a casual basis … is the employer can elect to offer employment on a particular day or days and when offered, the employee can elect to work. Another characteristic is that there is no certainty about the period over which employment of this type will be offered.”

the Wallarah coal project. CCBR believes it’s time to come out and say what has to be said in respect to this project. In 1995 the NSW Government granted an Exploration Licence to a joint venture to explore areas east and west of the F3 around Wyong. Over one hundred million dollars has been spent on exploration and the EIS now on exhibition is considered to be the most detailed and exhaustive of any. This is a deep deep underground mine that will not affect the water supplies on the Coast or in the Valleys.

The pollies have played political football with the project in recent years, which is all about votes. The value of the Wallarah coal project to the regional economy will be very valuable and it will create a lot of well paid jobs for a long time. The community has to get behind this project and not allow a handful of activists to distort the facts. Edgar Adams Editor
