New dawn for Gosford Council In a move which is seen as a break from the past, Gosford Council has elected a Mayor and Deputy Mayor with no local government experience and who will oversee the appointment of a new General Manager (who, it is said, will not come from within the organisation). At its first meeting on the 24th September, Independent Councillor Lawrie McKinna was elected Mayor and Liberal Bob Ward, Deputy Mayor. The vote was 6 to 3 in favour of both the Mayor and Deputy Mayor with Councillor Doyle abstaining. Following the vote the new Mayor said that he wanted to see a united council working together for the good of Gosford City. “I want people to be proud to say they live in Gosford. It’s why I stood for Council in the first place, to make a positive difference.” The former Mariners football coach may be inexperienced in local government but many see him as a straight shooter whose coaching background has taught him how to get the best out of people. While Clr Ward may be inexperienced as a councillor, he has a basic understanding of local government as he was involved in drafting the Coalition’s local government policy prior to its election. He told CCBR that he is very concerned with the level to which the Gosford CBD has descended and is totally committed to the rejuvenation of the CBD in particular and the generation of jobs. Following the Local Government Elections, the Liberal Party saw its numbers in the Council Chamber confirmed at four for the second term in a row. Add to that
Gosford City Mayor, Lawrie McKinna and Deputy Mayor, Bob Ward
two Independents, who appear to be more aligned with the Liberals, and you have the six with a controlling say in how Council will be governed. Advertising for a new General Manager is already underway but it is unlikely that an appointment will be made prior to the end of the year.

RDA Chairman speaks at CEDA Last month Central Coast Regional Development Australia Chairman, David Abrahams, was invited to present at a CEDA (Committee for Economic Development of Australia) luncheon in Sydney, the topic of discussion being “The NBN, Sectoral Transformations and Productivity Benefits”. Joining Mr Abrahams to discuss issues relating to the NBN were: Harrison Young, Chairman NBN Co, Andrew Stevens, Managing Director IBM Australia and New Zealand, Dermot Roche, General Manager – Customer Relationship Management Medibank Healthcare Solutions and David Kennedy Practice Leader – Asia Pacific Research Group Ovum. When asked about his inclusion on such an illustrious panel, Mr Abrahams said “To be speaking in such esteemed company is a huge honour not just for me, but also for the Central Coast. Big business is clearly behind the NBN rollout and is interested in the impact this has on regions such as the Central Coast.” Mr Abrahams discussed how regions were contributing to the national economy with a particular focus on the Central Coast highlighting the achievements related to the NBN rollout and those who have made it possible here on the Coast.

CEDA has been influential in articulating and advising on some of Australia’s biggest challenges of which, it can be argued, the NBN definitely is one. CEDA quote that 75% of the nation’s businesses believe a national broadband infrastructure will increase their ability to engage in the digital economy; Mr Abrahams wholeheartedly agrees. “The rollout of the NBN on the Central Coast is critical, it has the potential to dramatically change the way we do business and how we are perceived as a leader in business, commercial services and tourism” commented Mr Abrahams.

Once in a lifetime opportunity for Gosford Nothing stays the same in politics forever – thank goodness! And so it was with last month’s Local Government Elections – in Wyong and Gosford. In Wyong voters really turned things around by kicking the Greens out and replacing them with Save Tuggerah Lakes Party which has scored two councillors. Former Mayor, Bob Graham and councillor since 1991 and Mayor and Deputy Mayor increased his vote. With the Referendum for an elected mayor getting almost two-thirds support it will be an interesting election next time around – if there is one. In Gosford the Liberals, for the second time, have got four councillors in, two, Jeff Strickson and Chris Burke, from the previous council and new blood Bob Ward and Deanna Bocking. And they are off to a good start. Both the Mayor and Deputy Mayor have come in with no baggage to colour their thought processes. Add to this that they, and the rest of the Council will be appointing a new General Manager and you would have to think that we have won the lottery. (With two State Liberal Members and four confirmed in Council and two who while independent can be expected to favour the Libs one might expect that Gosford at least may see some strong political support to change the malaise into which it has descended - time will tell!).
The election of former Central Coast Mariners Coach now Business Development Manager, Lawrie McKinna and his number two, Gabbie Bowles, is a welcome breath of fresh air at Gosford Council. Being independent and passionate about the Central Coast Clr McKinna will be the honest broker when it comes to making sound decisions for the common good of the people. We need a salesman for Gosford and the Central Coast and I think this guy is it. Certainly he is in a position to do just that as well as clean up some of those in Council who are still committed to a zero population non-policy. He will be ably backed by Deputy Mayor Bob Ward who is equally passionate about getting Gosford moving. Of course the first job for the new Council and the Mayor will be the appointment of a brand new General Manager, someone with similar ability to Wyong’s General Manager, Michael Whittaker. Gosford Council has an endemic culture that must be changed. He or she will need to be strong, determined and above all a very capable change manager. During the campaign some ugly messages targeting some of the previous councillors got out concerning Gosford Council’s investments in CDOs and the millions that have unquestionably been lost. So, a word of advice to the new councillors. Do what all companies do when they
have a loss or even see it coming. Write it off! Draw a line and move on. Don’t deny it, its there and its water under the bridge. The recent Court Decision in respect to CDO losses says it all. CCBR had its say on the issue when it first came to light and we made our point. Of course one thing the new council should ensure is that the organisation has a sound investment policy. Meanwhile it is now eighteen months since the O’Farrell Government came to power. While accepting that they inherited a virtually bankrupt and dysfunctional state with featherbedding endemic throughout the entire public service, the Central Coast has big issues that cannot be allowed to drift along. The Landing at Gosford is now looking like it is a dead duck. The Government simply isn’t interested, least of all the Minister for Planning and Infrastructure. Sure the Gosford Primary School will be relocated opening up the space for redevelopment but that is all. But that is a long way off. Lend Lease overplayed their hand and at the same time the Central Coast Regional Development Corporation has been neutered by a Minister who has no interest in our region. Right now it may appear that the Central Coast is Liberaland but the clock is ticking and Continued on page 22

Awards scholarship delivered with flowers The generosity of Boydita Flowers Delivered and guests attending the Central Coast Business Excellence Awards delivered $3,500.00 towards a Bachelor of Science, Marine Science Scholarship at the Central Coast Campus University of Newcastle. An initiative of organisers Kerry Ruffels and Edgar Adams the scholarship became a reality when Lyn and David Ross from Boydita Flowers Delivered agreed to donate the table centre-pieces, featuring some gorgeous Boydita quality roses which were sold off on the night to raise funds for the Scholarship. On hand to receive the cheque was Central Coast Campus Director and ProVice Chancellor Stephen Crump. “This major provides students with knowledge of Australia’s unique marine ecosystems and their biodiversity, an up-to-date analysis of the current issues and challenges facing Australia’s marine ecosystems and species, skills in field and laboratory techniques, and understanding of the management initiatives that have been developed. Telework the talk of Coast An extremely engaging Telework forum was held on 20th September at Regional Development Australia’s Central Coast branch as part of the popular ‘Focus on the Coast’ series. ‘Focus on the Coast’ brings relevant issues to the community for discussion and debate, everyone is welcome to attend. The most recent event focused on The Central Coast’s Teleworking project, which has been spearheaded by Innov8 Central, who has created a specific Central Coast Teleworking Committee. The Central Coast Telework Committee is chaired by Graham Baker of Innov8 Central together with Kevin Bryan and Frank Zammut. Their extended committee is pulling out no stops to promote telework in the region, ready for National Telework Week which is to be held during the week of November 12th.
A number of initiatives to promote teleworking on the Central Coast have already commenced, including engaging with the commuting public through community consultation at public transport venues in addition to a large scale media push for support from the community for the Teleworking initiative. The ultimate aim of the Central Coast Telework Committee is to have two teleworking hubs established on the Central Coast for people who may already be teleworking but need a space closer to home to work and for those who may be interested in teleworking who can present the idea to their employer – complete with a suitable workspace. Kevin Bryan from Central Coast Telework Committee said, “The response to date has been astounding, as word is getting out, more and more of the commuting public are supporting this brilliant initiative”.
As expected the Telework or “work anywhere” movement is fast becoming the most potent in our region’s digital transformation. The evening drew approximately fifty attendees and featured talks from Nick Bowditch from Facebook, Barbara Lepani from the Department of Broadband Communications and Digital Economy, Kevin Bryan from Central Coast Telecommuting Committee / Ourimbah TAFE and Dianne Alchin, a local teleworker with an insightful perspective and story. Children’s magazine celebrates 10 years Children’s magazine, Kidz on the Coast celebrates its 10th birthday this month and Debra Elliott and Simone Evans are proud of this highly successful Central Coast publication. Kidz On The Coast is a well established and loved free Central Coast family magazine that is published bi-monthly and is distributed throughout the entire Central Coast reaching families from Lake Munmorah in the north to the Peninsula in the south. Reducing power costs the main game With power costs in NSW now escalating out of control, business owners everywhere should be totally focussed on taking charge of this high cost business expense. In an attempt to reduce his power costs, Lake Haven Pizza Hut Franchisee, Gavin Kruck, engaged DNA Energy Solutions. The objective was to look for a product with emerging technology in a commercial kitchen environment to be installed on their two electrical distribution switchboards supplying appliances and equipment. As a commercial kitchen in the fast food industry, the Pizza Hut restaurant at Lake Haven searched for an effective solution to reduce the high energy consumption of

TAFE student wins NSW Apprentice of the Year Hunter TAFE student William Peters, has been awarded NSW Apprentice of Year at the NSW Training Awards. Mr Peters received this prestigious award in front of 700 guests at the Sydney Convention and Exhibition Centre, Darling Harbor. After two years studying a Bachelor of Construction Management at Newcastle University, Mr Peters decided he needed more practical experience and began a Certificate III in Carpentry at the Ourimbah Campus of Hunter TAFE. As an apprentice in his father’s company, Toukley based RWP Building Pty Ltd, Mr Peters said that he recognised the importance of hands-on experience. “I didn’t want to be one of those

Here are some questions to ask about any potential venue:
Location • Is the venue easily accessible to those attending? • Is the location quiet and close to accommodation if required?
Size • Is the seating capacity suitable? • Are the meeting rooms large enough to provide a comfortable experience for those attending? • Are the meeting rooms well laid out? Do they allow for good views of the speaker without any obstructions? • Does the venue allow attendees to move around without bottlenecks and delays?
Facilities • Does the venue have a variety of rooms if required? An auditorium if necessary? Small rooms for break out meetings? • Do they offer a projector, electronic whiteboard, stationery, wi-fi internet access, photocopying/fax service and can they provide laptops or PC if required?
• Does the venue have enough parking spaces? • Is there a restaurant or bar for postmeeting networking and entertainment? • Can the venue also provide accommodation if required?
Cost • Can they offer any discounts? • Can the price be negotiated? • Are there hidden costs? • When is payment required? • What is their cancellation policy? Will you receive a full or partial refund? At the end of the day you want to get the most out of your meeting and the venue you choose has to add rather than detract from the experience of those attending. So take the time to choose carefully.

Avoca Picture Theatre redevelopment a hot issue again Charter Hall buys Bay Village

Norman and Beth Hunter, proprietors of the Avoca Beach Picture Theatre have lodged a Development Application for the redevelopment of their land that comprises the theatre and adjacent vacant land totalling 1,811 sqm at 69 Avoca Drive, Avoca Beach. The project is for construction of four 60 to 110 seat auditoriums, an upstairs gallery and cafe and 5 residential units with access to Vine Street and with underground parking. The development complies with the current site specific LEP approved in 2007.

As part of the DA the Hunters are offering to donate land to provide a footpath along Vine Street and donate $300,000 to Council for the refurbishment of the adjacent Hunter Park which was donated by the family in 1974. The DA was lodged in late August and put on display on 5th September for two weeks. A group of Avoca activists were given an extension of time for objections until 5th October. Architect for the project is Robert Fullar from Artichoke Design Studio Avoca.
Property fund manager and investor, Charter Hall Group, has acquired the subregional shopping centre, Stockland Bay Village, now known as Bateau Bay Square for around $164 million. It is part of a number of centres being off-loaded by Stockland. The Centre was opened in 1985 and bought by Stockland in 2000 and was expanded and refurbished in 2005 and 2006. In 2009 the Centre was valued by Stockland at $187 million. The Centre is on a prime 90,000 sqm site with a GLA (Gross Lettable Area) of 29,174 sqm. According to Shopping Centre News the Moving Average Turnover (MAT) for 2008/2009 was $197.50 million or $7,353 psqm, with Average Spend per visit of $49.93. The property is anchored by Woolworths, Coles, Kmart and Aldi, 3 mini-majors and over 80 specialty stores. The Centre is managed by Charter Hall with all staff being retained. Garry Morrison remains Centre Manager and Kristy Cameron Marketing Manager.

Informal Votes An interesting fact surrounding the voting was the high Informal vote both in Wyong and Gosford. In Wyong the Informal vote was 12,189 or 17%, almost double the number at the previous election. In Gosford the Informal vote was 10,859 or 14%, also double the number of at the previous election.

Pagliaro & Ors [2012] NSWSC 1068, neys - Suites 2/3Bergin held that information of the Justice rance Road,revenue ERINAraised by employees in the stockbroking industry was confidential information capable of contractual protection.
Background A group of employees were "poached" from Wilson HTM Investment Group Limited (Wilson) by Ord Minnett Limited (Ord). Wilson alleged the employees had breached the terms of their employment contracts with Wilson which restrained them from disclosing confidential information.
Wilson claimed one of the employees, Mr Pagliari, had told Ord what revenues employees at Wilson had earned during 1 July 2011 to May 2012. This information was then used to draft financial offers to employees planning to leave Wilson. Wilson claimed this information was confidential and Ord had caused the employees to breach their contracts.
Decision Justice Bergin held that revenue was confidential information as it was "information" relating to Wilsons "business affairs" which was protected under the employment contract. Ord argued the restraint was unreasonable and void on the basis that if employee's were restrained from revealing their revenue then; • It would reduce the employee's ability to seek other employment; • It was anti-competitive; and • It did not protect a legitimate commercial interest. Justice Bergin held the restraint was reasonable but stated it was not enough to show there was a breach in this case. Wilson also had to show that Ord had intended to induce
a breach of contract and was aware their conduct would induce a breach of contract. Ord submitted that they had not induced the employees to breach their contracts; rather the employees already wanted to leave employment with Wilson and approached Ord seeking employment with them. Her Honour concluded Ord had induced the employees to breach their contractual obligations and that Ord knew the employees had contractual obligations not to harm Wilson's business and disclose confidential information. As the employees were looking to leave Wilson and find other employment her Honour concluded they would have given 1 month's notice to Wilson and awarded $176,416 damages. Wilson was also granted an injunction restraining Ord from using, publishing or otherwise dealing with any of the employee revenue information in the future. The decision is an arguable expansion in what confidential information the courts will protect and demonstrates that employees and prospective employers need to be careful when negotiating new employment.

An elderly lady was invited to an old friend’s home for dinner one evening. She was impressed by the way her lady friend preceded every request to her husband with endearing terms such as: Honey, My Love, Darling, Sweetheart, etc. The couple had been married almost 70 years and, clearly, they were still very much in love. While the husband was in the living room, her lady friend leaned over to her hostess to say, ‘I think it’s wonderful that, after all these years, you still call your husband all those loving names.’ The elderly lady hung her head, ‘I have to tell you the truth,’ she said, ‘his name slipped my mind about 10 years ago, and I’m scared to death to ask the cranky old bugger what his name is. (Contributed by Sandra Walsh) Father Norton woke up Sunday morning to an exceptionally beautiful and sunny early spring day so decided he just had to play golf. So he told the associate pastor he was feeling sick and persuaded him to say Mass for him that day. As soon as the associate pastor left the room, Father Norton headed out-of-town to a golf course 40 miles away. This way he knew he wouldn’t accidentally meet anyone he knew from his parish. Setting up on the first tee, he was alone. After all, it was Sunday morning and everyone else was in church. About this time, Saint Peter leaned over to the Lord while looking down from the heavens and exclaimed, “You’re not going to let him get away with this,
