Koala Publishing – Central Coast Business of the Year TAKING OUT THE prestigious Business of the Year and Employer of Choice Awards at this year’s Central Coast Business Excellence Awards, Koala Publishing is a company that proves the greeting card industry is alive and well despite the growing prevalence of online social communication. 100% Australian owned and operated, Koala prides itself on innovation through a solid investment into its number one resource – its people. Evidence that staff and customer relations have always been high on his

This was done to ensure they could continue to serve its loyal customer base and run the business with the level of pride and autonomy that comes with business ownership. When Grieve first entered the greeting card market, he saw an opportunity to outperform the ‘cheap’ card producers by selling cards that matched their retail price of a dollar but created a point of difference by delivering a level of quality not seen in that portion of the market before. So how did Grieve work out a way to produce a ‘high-end quality’ greeting card that retails

for a fraction of the cost while utilising Australian products and services, including local printing? Firstly, Koala delivers high volume sales through a quality product and rapid turnover of custom designed stock on the shelves. So while Koala wasn’t immune to the impact of the GFC, their dollar card range stood them in good stead to weather the storm. Secondly, Grieve established a business-to-business national distribution network that was unique in the industry. Today there are 25 distributors in Australia and four in New Zealand. Each distributor operates as a separate business entity

Newcastle planners decide against Gosford’s future THE HUNTER CENTRAL Coast Joint Regional Planning Panel (JRPP) met on Thursday 17th September to decide on what is seen as Gosford’s future – A three tower development now known as Waterside and chose to totally ignore the community benefits that the project would bring. In the event the Panel, which is weighted with 3 Newcastle planners plus 2 representatives from Gosford Council, chose not to approve the development but defer it to a date unknown. Eighty people in support of the development packed into Gosford Council Chambers with another 40 left outside. There were only a handful of objectors who included Malcolm Brooks and Green activists the Community Environment Network. There were 12 speakers in support. Importantly, and surprisingly, the Panel in considering the application absolutely refused to consider the community benefits that would accrue to Gosford and the whole Central Coast from this development. Three months ago when considering the redevelopment of the Union Hotel site the Panel relied on Clause 4.6 of the Gosford Local Environment Plan 2014 which specifically sets out exceptions under this Clause. It appeared that the Panel had made up its mind not to approve the development and was looking for ways not to reject it but not to defer it. An absolute travesty and the Minister for Planning needs to be made aware of it.

The Waterside development has 3 street frontages – Mann Street, Baker Street and Georgiana Terrace. The project will comprise 500 residential units in 3 Towers: Mann Street Tower 33 floors, Baker Street Tower 31 floors and Georgiana Tower 25 floors. In addition it will comprise an 80-room hotel, 9,300 sqm of commercial, retail and food premises. The old Brisbane Water County Council building will be refurbished for use as a cinema / performance space. A few weeks earlier the same Newcastle panel members approved a development

There will be parking for over 600 vehicles. 47% of the site will be open space with public access and a pedestrian link from Mann Street to Baker Street and the Waterfront. The project is being developed by New Hong Kong Macau Australian Pty Ltd which is owned by Mr Jian Wang who sees a great future for Gosford. Architects for the development are CKDS Architecture from East Gosford for Newcastle CBD that was 300% over the height limits for the city under its LEP.

Another Gosford planning fiasco – but this time it’s not Council IN SCENES REMINISCENT of twelve years ago when Gosford Council voted down the Spurbest development in Gosford last month saw a similar fiasco except that on this occasion Council are the good guys and the Department of Planning’s Hunter/Central Coast Joint Regional Planning Panel are the bad guys. The support for Spurbest was strong but the support for Jian Wang’s Waterside development has been overwhelming. CCBR’s Facebook page recorded a Reach of 25,160 people and 1,027 Likes and Comments. Well over one hundred people gave up a whole afternoon to support the project. The performance of the JRPP has to create a situation where Central Coast people must stand up and tell the Premier, if the Minister won’t listen, that this region is entitled to its own JRPP and we will not be governed out of Newcastle. JRPPs are instruments of the Department of Planning set up by former Planning Minister Brad Hazzard to take projects over $20 million out of the hands of local councils. By appointing three Newcastle members to the Panel and giving them enormous planning powers over the Central Coast region it showed the O’Farrell Government’s total contempt for our region. Until recently there were no major projects for the Hunter/Central Coast JRPP to consider apart from the Union Hotel redevelopment about three months ago. At this

one Panel member was replaced by an alternate member who saw the opportunities for Gosford and voted with the two Gosford representatives thereby getting it approved. It maybe that the developer won the lottery! Meanwhile as we go to press the big announcement that the Federal Government will locate a part of the Tax office and other government agencies in Gosford on the former primary school site, has caused some confusion. Firstly, the names of the developer or builder were not mentioned and secondly, the State Government on whose land it will be built appears to have been left out of the loop. However, CCBR has discovered that a Canberra company has got the building job and the image provided is right out of synch with the Masterplan for this State Significant Site. See story page 17 but a lot more to come on this! Our congratulations to the winners of the 2015 Mercedes-Benz Central Coast Business Excellence Awards. Now into the fifth year and having gained a prominent place in the Central Coast business events calendar, CCBR is proud to have been the founder of these

As usual Awards Director Kerry Ruffels did a great job in organising the event, as he has done right from the start. The important point though about these awards is that they highlight business excellence and achievement in our region. And they send a message outside the region, particularly to government that businesses in this region have the capacity to drive the economic growth into the future. All they need is a little understanding from government and the finance sector. Finally, may I congratulate Carolen Barripp for her initiative in organising the Central Coast Startup Weekend late last month. See story page 12. Construction starts on Pine Tree Apartments Terrigal

Pinnacle gets nod for Gosford development

The Pine Tree Apartments Terrigal construction site IT’S THE FIRST major construction project in Terrigal since the Star of the Sea Apartments over ten years ago and heralds a new era in luxury accommodation in Terrigal as more projects come into the pipeline. Pine Tree Apartments, a $60 million project, is being built by Sydney builders Richard Crookes Constructions for PTL Land Pty Ltd. The development comprises 70 luxury apartments of which 50 have been sold and exchanged. Prices start at $420,000 for a 1-bedroom apartment. A retail hub to be known as Pine Tree Lane will comprise around 800 sqm of indoor and alfresco dining options and is being marketed as culinary ‘hot spot’. Street-front spaces range from 35 – 350 sqm and have been designed specifically

PTL Land Managing Director, Andrew Cochrane, said enquiries for the remaining apartments had picked up since the building activity had commenced on the site. The project is scheduled for completion in early 2017 although the retail spaces will be up and running for Christmas 2016

It wasn’t all bad news at the JRPP meeting in September with the Pinnacle Construction Group’s complying development application being approved. The 6,064 sqm property at 21-23 Mann Street at the rear of the Gosford Telephone Exchange was formerly a Telstra works depot and backs onto Henry Parry Drive providing extensive views of Brisbane Water. The development, designed by East Gosford architects CKDS Architecture, comprises 140 residential units over 16 storeys with three basement car parking levels. Pinnacle Managing Director, Joseph Bechara, told CCBR that they would start marketing the project early next year with plans to commence construction in the second half of 2016.

Their story on Pages 4 and 5 justifies their elevation to the top spot in this prestigious position. CCMC comes of age OVER THE COURSE of the past five years Central Coast Manufacturing Connect (CCMC) has been slowly growing in stature as the manufacturing organisation for the region. In 2010 the organisation was formed through the collaboration of the major regional industry bodies and local manufacturing and engineering organisations. This collaboration has made CCMC more able to effectively support Central Coast manufacturers and facilitate opportunities for the growth and sustainability of local manufacturing. Newcastle Innovation (NI), the commercial arm of the University of Newcastle and Innov8central have been instrumental in helping CCMC develop and grow. NI provided the legal structure for CCMC to operate under as well as back office support while Innov8central provided the event support and general administration. Early this year the advisory board of CCMC decided it was time for the organisation to become its own entity and to be independent. Its growth and strength over the incubation period with NI made this decision easy. As such a not-for-profit organisation called Manufacturing Connect Limited has been formed and officially began trading as at the first of July. On the 21st July at the Gosford Golf Club HunterNet together with Central Coast Manufacturing Connect and Engineers Australia, Central Coast Group hosted a presentation from Lend Lease on the NorthConnex Project. Around 80 people attended. Robert Ioffrida and Travis Butler from Lend Lease gave the presentation on the project covering what is NorthConnex and who is delivering it and provided some insight into the projects design features and timings. The NSW and Federal Governments, Transurban and the M7 Westlink Shareholders (the Project Sponsors) are planning to build, operate and maintain a tolled motorway linking the M1 Pacific Motorway at Wahroonga to the Hills M2 Motorway at West Pennant Hills – called NorthConnex. The proposed nine kilometre tunnel motorway includes interchanges to the north and south to accommodate connections at either end of the project. When complete, it will link Sydney's north to the Orbital network and form part of the National Highway route. The $3 billion project, consisting of a construction budget of $2.65 billion in addition to land and project delivery costs, will be funded through toll charges with a contribution from the NSW and Federal Governments of up to $405 million each. Winner announced, Startup Weekend Central Coast STARTUP WEEKEND CENTRAL Coast hosted its first ever event on Sept 18-20 in the Gosford Smart Working Hub. The 54-hour long event involved a creativityfuelled weekend that provided a platform for participants to develop their technology idea, meet like-minded enthusiasts, build their network, get face time with thought leaders, and learn new skills. 60 aspiring entrepreneurs including students from the UoN and Central Coast Grammar, coders, business people and the unemployed registered to attend the first event for the Central Coast. Fifteen ideas were pitched and Eight teams were formed around

Jessica Gledhill’s team with the Maker to Market concept was judged to have best idea - an online platform connecting makers, manufacturers and distributors to turn great ideas into awesome products. Jessica is the founder of The Creative Workshop, a group of like-minded artists, designers and crafters who are establishing the Central Coast’s first makers space for creatives which will open its door at Imperial Centre for Xmas. Jessica is now on her entrepreneurial journey.

Priority Powder Coating notches up 20 years TUGGERAH BASED PRIORITY Powder Coating celebrates 20 years in business this year with owners Paul and Debbie Hansen taking the opportunity to thank their staff and long term customers at their 20th birthday party last month. The Hansens saw an opportunity for a new supplier in the powder coating market and set off in a 450 sqm factory at Fountaindale with just two employees. Within twelve months staff had increased to seven and they took over the factory next door doubling their workspace. They also installed an additional oven and expanded the dipping tanks giving them added capacity and capabilities for product diversity. With a business philosophy that to be successful the business must operate on a totally professional basis with customer service and quality being uppermost in everyone’s mind the business continued to grow. “We took the attitude that nothing was too much trouble. We are the last stage for most customers so everyone is in a hurry,” said Mrs Hansen. “To be ahead of the competition we have continually developed and improved our processes allowing us to expand our capabilities along the way,” she said. By 2001 it was very clear that they had outgrown their premises, so with a massive leap of faith and encouragement from a developer they embarked on a purpose built factory in the new Tuggerah Business Park. The new factory comprised 3000 sqm of factory space plus office facilities and amenities. This allowed them to install new plant and equipment with longer conveyorised line, a fully automated online spray system for steel products, improved pre-treatment and a licensed waste water treatment system.

By 2007 they were running two shifts and expanded their truck fleet to three while the following year they invested in further upgrades to the spray booth and spray guns improving quality, and the installation of an extraction system optimising powder usage. And then the GFC hit. Like most businesses Priority was heavily affected from 2009 through to 2012 forcing them to downsize but with a determination to survive the crisis. “Our client base remained very stable”, said

Wyong Council appoints CEO

Rob Noble Wyong Council has appointed Mr Rob Noble, an experienced local government CEO, as Acting Chief Executive Officer for 12 months. A Relationship Management Consultant Mr Noble has extensive experience in local government. He was Acting General Manager of the City of Newcastle in 2011 and most recently was the Acting CEO of Liverpool City Council while those Councils recruited for a permanent CEO. Mr Noble was CEO of Caboolture Shire Council, a regional Council in

Queensland, just north of Brisbane for eleven years before it was amalgamated with the City of Redcliffe and Shire of Pine Rivers, in 2008 to form the Moreton Bay Region the third largest Council in Australia. Wyong Council’s Mayor, Doug Eaton OAM, said Mr Noble’s experience managing a water authority, large regional Councils and as a relationship consultant made him the perfect candidate for the job. “He seems like an expert Acting CEO and that is certainly what we need right now,” Mayor Eaton said. “We are heading into some challenging times with the Fit for Future process, being driven by the NSW Government, hanging over our heads and we need a steady hand to guide us through that process while ensuring we keep delivering the essential services our community expect and need. Tax Office comes to Gosford but at what cost

Image of the proposed Commonwealth Agency Building Federal Treasurer, The Hon Scott Morrison and Member for Robertson Lucy Wicks have announced that the Australian Tax Office will be located on the former Gosford Primary School site. The announcement was made during a visit by the Treasurer to Gosford on Friday 25th September. Due to open in 2017, the premises will house 600 staff from Commonwealth agencies with the majority of workers employed

by the Australian Taxation Office (ATO). While no details were released about the lease and sale of the school we do know that The Doma Group from Canberra has won the bid and the image above is what is proposed to be built on the most valuable site on the Central Coast. The State Government via the Central Coast Regional Development Corporation has been tight lipped about the project and continues to maintain a secrecy blanket over the site.

Sydney developer build at Ettalong Beach

A Sydney property developer has bought a vacant site at 220 Memorial Avenue, Ettalong Beach (opposite the Mantra Resort and RSL Club) with a current development approval in place. The 917 sqm corner block with sweeping views across the entrance to Brisbane Water had been owned by property developer Tesrol Pty Ltd since 2003 and then A & V Mamone Holdings Pty Ltd who gained a Part 3A approval from the Department of Planning as a State Significant Site in 2010 and then under-

took physical commencement. Price paid for the property was $7 million plus GST. A 7-storey residential and commercial development is proposed with 45 apartments and street level retail including restaurants. The build cost is estimated at $18 million. The new owner is planning to start construction prior to Christmas 2015 but not until after the Oyster Festival. Helen Hughes from McGrath Ettalong Beach negotiated the sale.

The consortium developing the Element building in Erina has struck a deal with the Big Air Group to provide high speed broadband fixed wireless network. As part of the deal with Big Air transmission towers will be erected on the Platinum Building, Rivers Building and Highpoint which means that all businesses in the Erina Business District will have high speed broadband well before the NBN is connected to Erina. Commenting on the deal, Commercialhq Manager, Tim Gunasinghe who has negotiated the deal with Big Air and who manages all the Brand Group properties and others in Erina, said, “its obvious the Federal Government can’t see the value of the businesses operating in Erina and will not tell us when we can expect the NBN. While the Government prevaricates we are getting on with it.” Big Air representatives will be approaching all businesses in the area in the coming weeks. Gosford Council approves Point Frederick development Gosford Council at its 22 September meeting approved a 20 unit residential development at 3 – 5 Lynn Avenue Point Frederick. The approval takes into account the retention of an existing heritage building known as ‘Cora Lynn’. The application was lodged by C. Maroon owner of the 2 properties. Gosford Council approves North Gosford development for 110 units Gosford Council at its 22 September meeting also approved an application for 110 residential units to be built in 4 buildings in Ormond Street and Range Road, North Gosford. The proposal uses Council’s 30% bonus provisions for height and FSR in the Gosford LEP 2014. Total site area is approximately 4,387 sqm. Key features include 16 x 1-bedroom units, 84 x 2-bedroom units and 10 x 3-bedroom units varying in size from 55 sqm to 114 sqm with 153 off-street car spaces. However, there is confusion around this status. As an employment lawyer, I am often asked whether an employer is able to extend the probation period of an employee who is not performing well – but perhaps not so abysmally as to warrant being terminated. Length of Probation The first point that needs to be made is that probation periods are often mistaken as being for a three month period. This is no longer the case. The Fair Work Act says that for organisations with:

• less than fifteen staff (across a group) the probation period under the legislation is twelve months. So, at any time during that first year, you can terminate that employee without reason being given and without a process of warnings. There are a number of good reasons why you may choose to both give a reason and also have a process of appraisal – but the legislation does not require it. For more than fourteen staff, the probation period is six months. Can it be extended? The short answer is – in normal circumstances – no. Even where an employee has been unwell for much of the probation period and the employer – understandably – asks for their absence not to be included in the probation, the period of probation is fixed. How can I engage a staff member to get a longer period of consideration? One option employers often adopt is to put employees on as casuals. Unfortunately, this is no help if the employee’s engagement is regular and systematic, in these circumstances, they will enjoy the same probation periods and can access unfair dismissal in the same way as a permanent employee.

Senate rescues small business with amendment to Unfair Contracts Bill While the Liberal Party was choosing a new Prime Minister in mid-September the Senate quietly rescued small business people from an outcome being inflicted upon them by the Abbott Government. The Senate amended the Unfair Contracts Bill by lifting the $100,000 contract limit, where the protections were to stop, to $300,000. This means that huge numbers of additional small business people should now have access to the unfair contract protections. Commenting on the Senate’s action Ken Phillips from Independent Contractors Australia said, “We thank the Senate and Senators. Just two weeks earlier the ICA expressed their shock, at the Abbott government on the issue saying the Abbott government was breaking a key small business election promise. In the end the ICA reports that all the Senate Independents and Labor supported the Greens’ amendment to increase the contract limit to $300,000.

“We can also report how sensible and reasonable all the Senators were to deal with. They listened to our reasoning and they stopped bad policy,” said Mr Phillips. “We didn’t get everything we wanted in our submission. We wanted NO contract limit, but the Senators told us that they thought the government might accept the $300,000 limit. But, no surprise, the government announced that it would not budge.” That was yesterday. This is today and a new Turnbull government is in place. “ We now we ask the Turnbull Coalition to honour its 2013 election promise to small business,” said Mr Phillips. The Bill goes back to the House of Representatives and can be changed. “The unfair contract protections must be made available to all small business people not some small business people. That was the election promise. We ask the Turnbull government to honour that commitment,” he said.

There is another exemption under the Fair Work Act for contracts of a specified period. A contract for a specified period cannot have an earlier termination clause. –If you wanted to terminate an employee during the term of this type of the contract, you would have to pay out the balance of the period. That could be expensive. A more useful option is an “outer limit” contract. These contracts are similar to contracts for a specified period, except that they also give employers the capacity to terminate employees earlier. For example, the employer may be a larger organisation that engages people on 12 month contracts with an outer limit provision. This means the employer can terminate the employee sooner. If the employer terminates outside the probation period (i.e. beyond six months) but before the end of that period (ie. 12 months), then (absent serious misconduct) the employer would have to go through the process of warnings. If the contract simply reaches the end date, then there is no termination by the employer and, therefore, no right for unfair dismissal. These contracts can be very useful. Expanding your premises by buying an office, factory or warehouse If your business has outgrown its current premises and rather than rent your next office, factory or warehouse, you may prefer to purchase a commercial property in your business. Depending on the property, renting part of the property out to another business may help support the mortgage repayments. There are certain tax benefits to your business purchasing property, so it’s always best to speak with your accountant prior to doing so. Buying equipment or assets to boost revenue If your business has reached its capacity with the existing equipment or assets, you may need to purchase additional equipment to increase your turnover. Buying a new business, franchise or competitor For those who don’t want to start from scratch, buying an existing business or franchise might be an option to scratch your ‘self-employed’ itch. You may also have an opportunity to grab more market share by buying a competitor.

Loan security Loans can be secured or unsecured by various types of assets, including residential, commercial, rural property or business assets. Alternatively, some loans are unsecured and a director’s guarantee may be the only requirement. Generally the less the assets you provide for security the higher the interest rate will be. Plan your business, plan your financing Business finance can seem daunting and business owners may feel their only option is to talk to their current bank to ask for an overdraft. The world of business finance has grown and options are much more comprehensive. Customer complaints register on its way The State Government is moving ahead with legislation that will give NSW Fair Trading the power to publish information about which businesses have been subject to complaints from consumers. As a result small businesses are being warned to review their approach to handling customer complaints. Minister for innovation and better regulation, Victor Dominello has introduced

the legislation amend the NSW Fair Trading Act in late September. It is now before the Legislative Assembly. If adopted, the amendment to the Act will mean the Fair Trading Commissioner will have the ability to publish its internal data about the complaints it receives from consumers each year, including the identity of the people or businesses that are subject to the most complaints, in a public register.

However, the identity of the people who have made the complaints will not be published. The design of the register is yet to be finalised and consultation has already occurred with consumer and business groups, including the NSW Small Business Commissioner, the Australian Retailers Association and the Business Council of Australia.

Distributor territories vary in size and each distributor is provided all the tools, resources and training they need to be successful at no cost to them. “Everything we do is in support of these distributors because if they don’t do well, we don’t do well,” said Koala Publishing General Manager, Reuben Machin. And last but not least, is the company’s commitment to avoid “putting profits before people”, a mantra introduced from the very beginning by Tony Grieve. Speaking to Machin and Koala’s WHS and Human Resources Manager, Julie-Anne Goodman it’s clear they both have a deep level of respect for Grieve and a strong desire to continue his legacy. Koala’s commitment to maintaining a strong workplace culture is evident from the moment you enter the premises, with messages of encouragement and motivation everywhere you turn. Goodman joined the company in 2011 during a particularly challenging period in the company’s evolution. Undergoing the amalgamation of two business arms into one at the time, redundancies were necessary as part of the consolidation process. Both Machin and Goodman knew they had their work cut out for themselves to restore morale and a sense of security. Since that time they have implemented a number of workplace initiatives including the launch of a Health and Wellbeing Policy earlier this year. Recent workplace surveys provided valuable feedback resulting in the introduction of a number of additional health initiatives; these included mental health leave days, free fortnightly onsite massages, a healthy snacks box, support programs to reduce detrimental health behaviors such as smoking and alcohol, the provision of flexible working hours to assist with the management of emotional distress, family disruptions and time with external health support providers, and the provision of an

onsite gymnasium complete with a personal trainer. “Even offsite staff receive support on how they can live healthy, active lives, said Goodman. “Research tells us that healthy workers are nine times less likely to have a sick day and three times more productive at work,” she added. Koala management also adopt an open door policy and a transparent culture in which all staff are made aware of the sales figures so everyone buys into the business, no matter how it is performing. This culture of trust and transparency promotes accountability and commitment for the good of the company as a whole as each individual understands that if the company performs well, they are all rewarded. “Tony always maintained that it is the culture of a business that ultimately drives its success or failure,” said Machin. Koala’s progressive culture and systems have served the company well, particularly at a time when others have succumbed to market pressures. Machin said that over the last five years the card market has dropped dramatically (around 20% across the board). This has taken a toll on a number of their competitors who have been forced to close their doors. Meanwhile Koala’s distributors and staff of 35 service a solid customer base of 4,000 retailers across Australia and a further 800 in New Zealand. The company also exports cards to countries around the world, including the UK, Canada, Hong Kong, South Africa and the UAE. Justifiably proud of their achievements in winning two awards at the Central Coast Business Excellence Awards, Machin and Goodman said it was particularly wonderful to share the news with the entire team the following Monday. With Beverley Grieve present to accept the awards on the night, the only person missing from the picture was the man himself. Machin said, “Tony often used to say, ‘you can’t control how you come into the world and you can’t control how you’re going to leave it, but you can control everything in between’.”

A WOMAN WALKED up to a little old man rocking in a chair on his porch. “Sir, I couldn’t help but notice how happy you look this morning,” she said. “Tell me, what’s your secret for a long, happy life?” “I smoke three packs of cigarettes a day,” he replied. “I also drink a case of whiskey every week, eat fatty foods, and never exercise.” “That’s amazing!” she exclaimed. “How old are you?” “Twenty-six.” An accountant dies and goes to Heaven. He reaches the pearly gates and is amazed to see a happy crowd all waving banners and chanting his name. After a few minutes St. Peter comes running across and says, “I’m sorry I wasn’t here to greet you personally. God is looking forward to meeting such a remarkable man as yourself.” The accountant is perplexed. “I’ve tried to lead a good life, but I am overwhelmed by your welcome,” he tells St. Peter. “It’s the least we can do for someone as special as you are. Imagine, living to the age of 123 and still looking so young,” says St. Peter. The man looks even more dumbfounded and replies, “123 years old? I don’t know what you mean. I’m only 40.” St. Peter replies, “But that can’t be right we’ve seen your time sheets!” Two neighbours were talking about work, when one said, “Say, why did the foreman fire you?” The other neighbour replied, “Well, you know how a foreman is always standing around and watching others do the work. My foreman got jealous. People started thinking I was the foreman.”
