Excellence Awards a huge success The 2012 Central Coast Business Excellence Awards Gala Evening held at Mingara Club on Saturday 18th August has been hailed a huge success. The Mingara Showroom auditorium was close to capacity with just over 320 of the Central Coast’s leading business people attending. The prestigious event was attended by local MPs led by The Hon. Chris Hartcher, Minister for Energy and Resources, Minister for the Central Coast and State Member for Terrigal along with Federal Member for Robertson, Deborah O’Neill, State Member for Gosford and Gosford Councillor, Chris Holstein and Member for Wyong, Darren Webber. Mayor of Wyong Bob Graham represented Wyong Council which was a Gold Sponsor of the Awards while Gosford Council, also a Gold Sponsor, was represented by Deputy Mayor Craig Doyle and Councillors Jim Macfadyen and Chris Burke. Minister Hartcher also presented the winner of the Excellence in Service Award Sponsored by NSW Trade & Investment. Apart from the 17 Award Winners the highlight of the evening was entertainment organised by one of Australia’s leading musicians, songwriter and record producer Rod McCormack. Rod McCormack and his wife Gina Jefferys both reside and run their business on the Central Coast and both performed on the evening along with two of their star students, Makaylie Foodey and Hannah Smith. The evening wound up with dancing to the music of Soultraders. Theme of the evening was the search for Gold as it coincided with the conclusion of the London Olympics and start of the London Paralympics. Mingara’s Showroom was dressed in gold and black with surrounding storywalls depicting the search for gold and which were produced by Display Power especially for the evening. In keeping with the evening’s focus on excellence Mingara’s Head Chef, Robert Bartos personally designed the exclusive menu while Mingara’s staff provided excellent service. Super Clinic to anchor Riverside Park project Last month’s announcement by the Federal Government that it would provide $7 million for a GP Super Clinic to be located in the Riverside Park Tower at West Gosford has resulted in commencement of construction of the project. Earlier, the Gibbens Group, who will develop the 4-storey commercial building, had secured international mining supply company FLSmidth as a leading tenant leasing 1,580 sqm. The Wyoming based Reliance Medical were granted the contract to establish the Southern Central Coast GP Super Clinic at West Gosford providing a wide range of medical services including fourteen full-time GP’s, emergency medical treatment, after hours medical services and allied health services. The company has purchased and leased a total area of 1,815 sqm of ground and first floor space plus a 300 sqm ground floor pharmacy. FLSmidth will relocate their Australian Head Office from the premises they currently occupy in Comserve Close, West Gosford to Riverside Park. The Danish based company also has facilities in Coomera, Perth and Melbourne and recently acquired the Brisbane mineral processing equipment maker Ludowici Ltd. MM_Treehouse_SeptCCBR.qxd

Worldwide, FLSmidth employs over 12,000 people and has a presence in some fifty countries Gibbens Group General Manager, Matthew Gibbens said that the Tower project would lead the Central Coast in quality, style and energy efficiency. The 6,300 sqm (approx.) building will comprise an open atrium style foyer, 6:29 PM

licensed restaurant, two lifts and abundance of external and basement car parking. The building has been designed for optimum light and energy efficiency and will have a 4.5 star NABER rating – the only building in the region to be so rated. Areas in the building for sale or lease start at 44 sqm.

Business excellence our future It is with some degree of pride that we report on the highly successful 2012 Central Coast Business Excellence Awards at Mingara Club last month. This year’s event built on the Inaugural awards last year and again highlighted the fact that the Central Coast can acknowledge those businesses that strive to be the best at what they do. The world we now live in is very much different to the world of the last thirty odd years where, to a large extent almost anyone who wanted to have a go would be successful. We are now back to a low growth environment where only those who run a ‘tight ship’ will survive and prosper and I believe this situation will persist for a long time to come. So it will be those businesses that embrace sound management practices, are highly innovative, understand that their employees are their most valuable assets, see their customers as their lifeblood as well as accepting that good solid long term growth will give them the success they are searching for. Our congratulations therefore to those winners of the 2012 Central Coast Business Excellence Awards who have shown that they understand, and have in place, these principles. It is these businesses who, we as a region can be very proud of as they are the ones that will anchor our future. In keeping with our focus on excellence the awards evening was a gala event with the

theme digging for and refining the ultimate – GOLD, remembering that the London Olympic Games had just ended and the Paralympics were about to begin. And in keeping with the event Mingara’s Head Chef, Robert Bartos, created a menu specially for us. It was also an event to highlight some of our local up and coming artists as well as being entertained by two of the Australia’s leading musicians, Rod McCormack and Gina Jeffreys. Of course, none of this would have been possible without our sponsors who underpin the financial viability of events like these. All of this year’s sponsors came back from last year and supported the 2012 Awards. So thanks to our sponsors who have played such a valuable part in staging the Awards and also to Kerry Ruffels who managed the whole event. A partner with us in Adams Business Events he again showed what running a prestigious event is all about. The positive comments we have received following the event is evidence that Central Coast business people appreciate what we are trying to do. So its game on for next 2013! This month’s Cover Story is about a major commercial development at West Gosford that is being undertaken by the Gibbens Group. This development is part of a redevelopment of their West Gosford site that has

already seen the first commercial building completed a two years ago and more recently a Dan Murphy’s liquor outlet. And while the new commercial development is under construction a Masters Hardware superstore is about to start as well. The Gibbens Family is better known for making springs of every description for all sorts of applications from cars to beds to pacemakers and which are exported all over the world. They relocated to West Gosford from Sydney almost fifty years ago. They have been very successful at what they do because of their ability to be drive and be ahead in spring (the modern term is ‘energy storage’) technology. So it is fitting that this story coincides with our Central Coast Business Excellence Awards. While the business is now moving onto the fourth generation of Gibbens’ it is a powerful message that the success of this local family has translated into major investment here on the Coast. In our August edition we reported that Gibbens will be relocating their spring manufacturing facility to the former Albany factory at Lisarow which the family rececntly purchased. Edgar Adams Editor

Coast a winner as well for Business of the Year Taking out the Business of the Year Award at the 2012 Central Coast Business Excellence Awards was a big win for West Gosford based Independent Portable Buildings but it was also a win for the Central Coast as this company only relocated from Western Sydney two years ago. Independent Portable Buildings took out the Excellence in Manufacturing Award as well as the Excellence in Small Business Award. A family owned and operated business Independent Portable Buildings manufactures portable or modular buildings. Major clients include; Thiess Constructions, Multiplex, ABB Australia, Dept Immigration, Thiess Mining, John Holland Constructions, Roach Mining and Australian Energy. It was in 2010 that we made the life changing decision to move the company from Mulgrave near Windsor to the Central Coast. Initially opening in Tuggerah, then expanding their

Big win for micro business with big growth plans Close Financial Group won the Excellence in Micro (Home-Based) Award sponsored by Apex Insurance Brokers. Close Financial Group provides clients with professional bookkeeping services offering onsite and offsite service. Their primary activities are management accounting, bookkeeping, payroll services, software and training. The business was established as an “on the side business” in 2007 by Tim Close while working full time and completing his full time university studies. Within two years the business had grown into a full time business.

Within the next 12 months Close Financial Group will move from being a home-based business to an office space in the Wyong/Tuggerah area. Part of their 5-year plan is to build the business to twelve full time bookkeepers, an administration manager and a general manager. ING Direct took out the Employer of Choice Award at the 2012 Central Coast Business Excellence Awards. The Employer of Choice award recognises the organisations which put in place strategies and initiatives to create stimulating and supportive workplace environments for their employees, having a positive impact on both employees and the organisation as a whole. Head of Contact Centres, Paul Claassens at ING Direct and a support team from the company was on hand to receive the award from Gold Sponsor, Leigh French Central Coast Manager of Complete Staff Solutions. The Category was well contested with four finalists vying for contention. ING Direct opened a Contact Centre in Tuggerah Business Park in July 2002 and in that time have grown their workforce, all drawn from within the Central Coast, from ten staff to 150 and in recent

Last year, at the 2011 Inaugural Central Coast Business Excellence Awards, Tuggerah based E-Bisprint took out the Excellence in E-Business Award. This year they have followed up by taking out the Excellence in Innovation Award sponsored by the University of Newcastle’s Central Coast Campus. This Award recognises a business which has made significant contribution to their industry through the introduction or improvement of an idea, method, technology, process or application with entrants demonstrating a deep understanding of their customer and market needs and has a culture of innovation including vision, leadership, supportive and open to new ideas and a commercial imperative to innovate E-Bisprint has achieved outstanding success in the development of a suite of customised e-commerce products which form part of their proprietary software “Streamline Online”. In recent months

Future business leader on a well earned holiday Naomi Taylor, has been awarded the 2012 Future Business Leaders Award. At 23 years of age Ms Taylor, who was on holidays overseas when the announcement was made is Maitre de at Indigo Eats Treats + Bar, a 300-seat a la carte style family dining facility at Mingara. It was recently named Best Casual Dining Venue at the 2012 Clubs NSW Awards for Excellence. This award recognises the positive contribution made to business by young business people and professionals aged 18 to 30 years. It recognises young business people who demonstrate outstanding entrepreneurial spirit, strategic business direction and innovative ideas. Winners of this award become Finalists in the State Business Awards. Ms Taylor has a diploma in Hospitality

Management and is undertaking further studies. In her nomination she says, “Developing the talent pipeline in Indigo will enable me to further develop my leadership skills by doing some placement in other areas of Mingara including our events department. This diversification for event leadership will provide new skills and options for future career pathways.” She also commented, “We are fortunate to have a strong culture at Mingara, this is something that has been developed for many years and part of my role is to develop the culture within my team. What Workers Comp changes mean to you

In June the NSW parliament passed laws to open the workers’ compensation market to new insurers and reduce benefits. Commenting on the government’s initiative General Manager of DMA Insurance Brokers, Gary Hayward said, “The changes to the NSW Worker’s Compensation Scheme will reduce the upwards pressure on employer contributions to the scheme, which will in its own way, reduce the cost of employment to small to medium business owners on the Central Coast.” Here is a summary of the main changes: • Benefits will start reducing at week 13, rather than week 26

• Payments after 130 weeks will only be made to people who are totally incapacitated or who are partially incapacitated and have returned to work for at least 15 hours per week • Payments will stop after 5 years for people with less than 20% “whole person impairment” and lump sum criteria have been tightened • Assessment of work capacity has been increased and there will be a time limit on medical payments • Weekly payments will be based on preinjury average weekly earnings rather than the current weekly wage at the time of injury • There is now restricted access for compensation following heart attacks and strokes and for diseases unless work was the main contributing factor • Relatives will no longer get compensation for nervous shock • There will be new compliance measures on return to work, with a new offence for employers who fail to provide suitable duties If you have any questions about these changes or your policy, please contact your DMA insurance broker by on 1300 856 657.

Mayor and Roads Minister meet to discuss issues Wyong Shire Mayor Bob Graham and State Member for Wyong, Darren Webber, have met with NSW Roads Minister, The Hon. Duncan Gay to discuss a number of issues relating to road infrastructure in the Shire. High on Council’s agenda were discussions involving the Pacific Highway upgrade through Wyong, the Central Coast Highway upgrade through Long Jetty and the Warnervale Town Centre Sparks Road intersection. The Mayor also raised the issue of vegetation maintenance on State Roads within the Shire, and the ownership of the Pacific Highway from Tuggerah to Ourimbah. Commenting on the meeting Mayor Graham said, “Certainly, he was very receptive to our concerns and took away our submission promising to have a really close look at it. I would like to think that in the not too distant future, the State Government can move onto actioning work rather than budgeting for more plans.” Council’s submission to the Minister identified the need for a part interchange with the F3 Freeway at Alison road. Goodgear wins Workcover NSW contract West Gosford based uniform specialists, Goodgear, have announced that they are the successful tenderer for the supply of corporate wardrobe to Workcover NSW with the contract applying to all locations throughout the State. The contract follows Goodgear’s success over the past three years in winning tenders to supply Gosford and Wyong Councils with corporate wardrobes and work wear which in the past were typically awarded to large national suppliers such as Pacific Brands. Mt White Mechanical Services wins NRMA road service contract. In a similar vein, the team at Mt White Mechanical Services were happily and successfully providing road service patrols to the NRMA up and down the F3 from their base at Somersby for almost 20 years when a Request for Proposal was received from the NRMA. There was a real possibility the process could have resulted in them having their contract terminated or provide an opportunity to significantly increase the

However the recent case of CFMEU v Pilbara Iron Company (Services) Pty Ltd (No 3) [2012] FCA 697 highlights the possibility of reinstating employees subjected to adverse action. Darren Lamberth (‘the Second Applicant’), who was a member of the CFMEU (‘the First Applicant’), was

employed by Pilbara (‘the Respondent’) under a fixed term contract of 12 months, but unlike most others in his position, was not offered permanent employment. The Respondent was also found to have marked down his performance review from a “pass” in the draft assessment to a “fail” in the final assessment, and rejected his nomination as a Health and Safety Representative. The Federal Court rejected the Respondent’s argument that the failure to extend the Second Applicant’s contract was because of issues relating to his attitude, communication and behaviour. The court instead agreed with the Applicants’ claim that the actions amounted to adverse action, actuated because of the Second Applicant’s union membership, industrial activism and complaints and inquiries about workplace practices - reasons which are prohibited by ss340 and 346 of the Fair Work Act. In reaching this decision, the Court applied an important earlier decision (currently before the High Court)1, which held

that in determining whether actions taken by an employer were unlawful required a determination of the actual reasons as to why the action was taken, rather than the reasons asserted by the employer. The Respondent was ordered to offer permanent employment to the Second Applicant, after the Court found that there was no evidence which suggested that re-employment was impracticable. At the time of writing this article, the Court has yet to decide whether a penalty will be imposed on the Respondent. What does this mean for employers? Employers who are found to have taken adverse action face severe consequences, including significant penalties and even reinstatement of the employee. It is therefore our view that employers exercise extreme caution to ensure that disciplinary actions are not linked to unlawful reasons, including union membership or complaints made by the employee. We strongly recommend obtaining profession advice prior to exercising any disciplinary actions.

Umina Village Masterplan a good start The Peninsula Chamber of Commerce has today said that the Umina Village Masterplan is off to a good start following the successful information sessions at Ocean Beach Surf Club this afternoon. "We realize its early days yet, but the options presented to land owners and business people at today's briefing were a good start to the public consultation process which will now run for 28 days", said Peninsula Chamber President Matthew Wales. "On show were the proposed traffic options for the Umina retail centre and various proposals for the future civic space around the Bullion Street car park". "We need to remember that this is a long term plan for the next 20 years although the Chamber has been firm in its view that there must not be any reduction in the current car parking spaces in the town and West Street traffic flow needs to be maintained", said Mr Wales. "Umina is very successful at the moment so we don't want big changes over a short period that will disrupt the successful balance between business and community". "Council's consultants have taken the key Chamber issues on board which we were pleased to see reflected in the draft plans", he said. "The proposals for the civic space around the Bullion Street car park will receive a lot of scrutiny. The Chamber will be looking September 2012

to ensure that parking and accessibility to West Street are not compromised by the possible future construction of a mix of civic/retail and multi-level car parking in Bullion Street". "Whilst we appreciate that Council is planning for the future, the proposals need to be realistic and adaptable to the changing needs of the business community", said Matthew Wales. "We are encouraged by Council's proposals to improve key

intersections so that customers can enter and exit the town more easily including the possibility of a new roundabout at Wellington Street and Trafalgar Avenue". "The Chamber will be providing detail comment during the exhibition period and encourages both businesses and residents to have there say. The more input provided the better so that Council fully understands the needs of the community", Mr Wales concluded

“We understand the Roads and Maritime Service (RMS) recently carried out a survey of the Wyong Township to identify the volume of traffic likely to use a Freeway interchange if one was constructed at Alison Road,” Mayor Graham said. “We have asked the RMS to consider the need for this freeway interchange before they finalise the layout for the Wyong Road and Pacific Highway intersection.” “I know plans have been prepared by the RMS that involves extensive works at Long Jetty,” Mayor Graham said. “However, action is required

now to reduce traffic congestion and make it more attractive as the main route to The Entrance. “We would like to see an interim measure of two lanes in each direction, particularly between Toowoon Bay Road and Pacific Street. “I believe, if this work was carried out, it would accelerate development and tourism in The Entrance area.” Council also asked Minister Gay to ensure the execution and timely construction of works at the Sparks Road intersection, to allow for the construction of the access road to enable Woolworths to start their development. F U N NY BU SI N ESS Two guys, one old, one young, are pushing their trolleys around a Woolworths Supermarket when they collide. The old guy says to the young guy, “Sorry about that. I’m looking for my wife, and I guess I wasn’t paying attention to where I was going.” The young guy says, “That’s OK, it’s a coincidence. I’m looking for my wife, too... I can’t find her and I’m getting a little desperate.” The old guy says, “Well, maybe I can help you find her... what does she look like?” The young guy says, “Well, she is 27 years old, tall, with red hair, blue eyes, and long legs, and is wearing short shorts. What does your wife look like?’ To which the old guy says, “Doesn’t matter, --- let’s look for yours.” Tom had this problem of getting up late in the morning and was always late for work. His boss was mad at him and threatened to fire him if he didn’t do something about it. So Tom went to his doctor who gave him a pill and told him to take it before he went to bed. Tom slept well and in fact beat the alarm in the morning by almost two hours. He had a leisurely breakfast and drove cheerfully to work. “Boss”, he said, “ The pill actually worked!” “That’s all fine” said the boss,” But where were you yesterday?” Murphy applied for an engineering position at an Irish firm based in Dublin. An American applied for the same job and both applicants having the same qualifications were asked to take a test by the Department manager. Upon completion of the test both men only missed one of the questions. The manager went

to Murphy and said. Manager: “Thank you for your interest, but we’ve decided to give the American the job” Murphy: “And why would you be doing that? We both got nine questions correct. This being Ireland and me being Irish I should get the job!” Manager: “We have made our decisions not on the correct answers, but on the question you missed.” Murphy: “And just how would one incorrect answer be better than the other?” Manager: “Simple, the American put down on question #5, “I don’t know.” You put down “Neither do I.” Did you hear about the banker who was recently arrested for embezzling $100,000 to pay for his daughter’s college education?

As the policeman, who also had a daughter in college, was leading him away in handcuffs, he said to the banker, “I have just one question for you. Where were you going to get the rest of the money?” An accountant is having a hard time sleeping and goes to see his doctor. “Doctor, I just can’t get to sleep at night.” “Have you tried counting sheep?” “That’s the problem - I make a mistake and then spend three hours trying to find it.”
