Ken Jolly AM – A scholastic achievement FROM A CLASSROOM magazine in 1920 to the publicly listed global corporation and leading publisher of children’s books it is today, Scholastic Inc is proof that print is as alive and well today as it was before the digital age. Indeed according to Central Coast local and Chairman of Scholastic International, Mr Ken Jolly, less than 3% of Scholastic Inc’s revenue today comes from e-books, which is quite extraordinary considering their Gen Z target market readers were practically born with a smart phone in their hands. Having been with Scholastic for 45 years, it would be fair to say Jolly has seen many changes in the company’s evolution, including the advent of the digital age. But the one thing that remains a constant is the fact that children today yearn to “open a world of possible” just as much as children always have, which is why this phrase remains the company’s hallmark and driver of success to this day. This story explores the evolution of Scholastic Australia (The H J Ashton Company) since 1970 when Jolly first joined the company. Working with an outstanding team of people, many from the Central Coast, Jolly helped steer the company from a small business to become part of Scholastic Inc, an almost 2 Billion US dollar company that is arguably the largest publisher of children’s books in the world and one of our largest local employers. Originally from Melbourne, Jolly started his career in the early 1960’s as a high school English and History teacher. After 5 years of teaching and a 12-month stint with
the Victorian Teachers Union, Jolly was, by sheer chance, offered the role of Teacher Consultant with a tiny yet growing company in Melbourne, The H J Ashton Company, by the Managing Director at the time, Terry Hughes. For someone who never had any intention to apply for the job, life was to go in a very different direction for Jolly than it would have had he returned to teaching as he had planned to do. Jolly essentially launched the H J Ashton brand into the Victorian market as the sole rep in the state. Being an ex-teacher stood him in good stead for success in the role. In fact Jolly credits much of the company’s success in the early days to the fact that the entire sales force had a teaching background, which gave the fledgling company solid educational credibility. Even today, whenever Jolly speaks to a group of educators, he notices an instant feeling of respect when he mentions that he was once a classroom teacher himself. Jolly grew the business as though it were his own, using his garage at home as a storage and packing facility and delivering the books personally. In hindsight Jolly says being so hands-on when the business was in its infancy was key to his leadership growth in the business. “Right from the start I was ambitious enough to want to head the company up one day, so learning from the ground up was very important. In fact I believe all CEOs should have this grass roots level experience. It gives you a real understanding of the workings of the business,” he said.
By Phaedra Pym After spending a year as a rep in Melbourne, Jolly was promoted to Victorian Manager before being promoted again to the role of National Sales Manager in 1972, a role, which required Jolly and his family to move to the NSW Central Coast. In May 1978, Jolly was promoted to General Manager Ashton Scholastic (by now H.J. Ashton had merged with Scholastic Inc and had become Ashton Scholastic in Australia and New Zealand), and just a year later he moved up another rung to Managing Director, a role he held for 8 years. In 1987, Jolly’s career almost took a very different turn when he was headhunted by leading general publishing company MacMillan Publishing to take on a senior publishing role. However Scholastic Inc had other ideas. Reluctant to let Jolly go, Dick Robinson, the Chairman, President and CEO of Scholastic Inc personally offered Jolly the role of Managing Director Australia and New Zealand, which he accepted. “I had put so much of my life into being part of a team that built the company from the ground up that to be able to continue that in such a pivotal role was very exciting,” said Jolly. The decision to move the company to the Central Coast came in the early 1970’s. Fast outgrowing its Brookvale premises, the company decided to purchase land at Somersby. When that land was deemed to become Sydney’s second airport mid development, the search was suddenly on for a new site, which, with the help of Gosford Council, was found at Lisarow; the current Scholastic Australia and New Zealand headquarters.

As a long term Central Coast resident, father and grandfather, Jolly is justifiably proud of the significant contribution Scholastic makes to the local economy. The company today employs around 500 Central Coast locals (made up of around 380 full time equivalent staff ), making it a major player in the local employment stakes. “Our commitment to the local community is all about the employment, the opportunity for jobs for qualified people and a great family friendly workplace culture. We also work with local businesses and buy locally as much as possible. I believe moving to the Central Coast was the best move we could have made,” he said. Another ‘hat’ Jolly wears outside his corporate role is Chairman of Central Coast Grammar School. So it’s no surprise that Jolly takes a keen personal interest in the ongoing development of the region for future generations. “I think there is no reason why any business of any size couldn’t operate on the Central Coast. Firstly we’re not far from Sydney and secondly, we’ve got the resources - especially a ready sup-

ply of labour,” he said. Jolly mentioned some other major business players on the Coast who are kicking goals internationally, not to mention Scholastic, which has published some of Australia’s most notable children’s authors after their manuscripts were first read right here on the Central Coast. Jolly still travels extensively in his role as International Company Chairman and works almost around the clock when overseas. Indeed it’s clear speaking to Jolly that he is as passionate about the business he helped build from the ground up today
as he was 45 years ago. “I’ve been lucky to have been involved in education all of my life and to have worked with an outstanding team, both on the Central Coast and within Scholastic’s international subsidiaries. From humble beginnings we have continued to grow. Most importantly, under the leadership of the current MD, David Peagram, together with a wonderful team, consisting mostly of Central Coast locals, we continue to produce outstanding literature, not only for Australian and New Zealand children, but for children all around the world.”

In the end many business people are simply giving up. Working every Sunday to keep the taxman and bureaucrats happy and finding that at the end of the year they have no one they can rely on to look after the business while they take a break is taking its toll. If you are in a 7-day business and have the added cost of penalty rates that now seem to have become sacred after years of acceptance then there is no future for you. Perhaps one of the essential requirements for all politicians entering parliament should be that they have actually had 20 years experience in the real world. We don’t need party hacks, union delegates, academics or activists running our country. Thank goodness for those business people who are prepared to take on the crap handed out by government and take the risks, mortgage their homes, forego time with their families and grow their businesses. As we go to press these very people will be celebrating their successes at the 2015 Central Coast Business Excellence Awards. Gosford Waterfront set to come alive AFTER A TWO year wait final approval has been given for the development of Marine Cove with ten restaurants on the Gosford Waterfront under the Brian McGowan Bridge. Gosford Council approved the $1.6 million project in early August. An initiative of Tim Gunasinghe from property management and development company Commercialhq the restaurants have been designed by East Gosford architects CKDS Architecture and will accommodate a range of cuisines. Mr Gunasinghe said the ten specialised food outlets will offer a variety of cuisines including: Italian, French tapas, Japanese, pizzas and burgers, seafood, Singaporean, Caribbean/Indian, modern Australian, Spanish tapas and a cafe. Each will accommodate 40 to 50 patrons and have been designed around a modern casual dining experience with interior fitouts boasting a variety of styles, colours and trends adding to the vibrancy of the area. Most will operate under a restaurant or small bar liquor licence so that people can enjoy a drink by the water’s edge while they eat. The concept is for Marina Cove to be a food precinct with the variety of operators creating a thriving urban culture. Commenting on the project Mr Gunasinghe said the concept is about getting back to basics and creating a financial and social development. “One of the most important aspects is affordability,” he said.

Somersby company’s hand in Netball World Championship SOMERSBY SPORTS FLOOR specialists, Shoreline Sports Floors, played a big part in the 2015 Netball World Championships held in Sydney last month supplying the playing surfaces for Netball Australia’s new stadium, Netball Central and refurbishing the All Phones Arena. Owned by Troy and Kylie Marquart, Shoreline specialises in the design, installation and maintenance of top performing sprung timber flooring systems. The Marquart’s originally started in business as Shoreline Carpentry and Joinery and won the contract to install the basketball court flooring in the new Peninsula Leisure Centre at Woy Woy in 2004. It was their first venture into the field of sports floors with timber supplied by Wauchope manufacturer ASF Horner Pty Ltd, the only FIBA Certified Sprung Timber Floor System manufacturer in the Southern Hemisphere. That job resulted in ASF Horner appointing them their exclusive NSW, Queensland and ACT distributor. Since then the Marquart’s have installed and regularly maintained over 200,000 sqm of sports floors. The company has won the contracts for the supply of the sprung timber floor systems for the 2018 Gold Coast Commonwealth Games Infrastructure Builds. Shoreline was selected too for the 12,600 sqm Cararra Sports Centre which will be Australia’s largest single span sports centre and the Coomera Sports Centre with a floor area of 6,000 sqm. The interesting point about Shoreline winning this contract was that they were competing with companies from Europe and the USA and won against three multinationals.

Darkinjung sign 60 year land lease for motorsports complex
Unfair Contracts Bill being watered down sell out to Big Business and bureaucracy

THE DARKINJUNG LOCAL Aboriginal Land Council (LALC) has signed a 60 year land lease for the proposed CASAR motorsports complex at Bushells Ridge in Wyong. Members of Darkinjung LALC voted in favour of the CASAR development in December 2014 which will see two parcels of land along Bushells Ridge Road converted into a motorsports development. CASAR’s vision for the space incorporates a $14 million motoring complex comprising of a 3.5 kilometre tarmac race track, undercover pit garages, driver training facilities, a dual use go-kart track, simulated driving environment and associated amenities.
Darkinjung Chief Executive Officer Sean Gordon said, “This complex is a great step forward for the economic future of the Central Coast and we are pleased to be able to support a project of this nature. “ The proposed development will see a major boost to our local community and will provide increased job opportunities within our region,” he said. “Our members put considerable thought and deliberation into this decision and in light of the cultural and heritage value of the land, it was not taken lightly,” he added. Since 2010 the Independent Contractors Australia has campaigned hard for the unfair contract protections available to consumers to be extended to small business people. The Abbott Coalition promised to do this when in opposition and again repeated the promise on winning government. The Bill is now in Parliament. Yet the Government is opposing it! It’s been sent to a Senate Committee for review. There’s been a simple ‘trick’ inserted into the Bill. The protections against unfair contracts are limited to contracts under $100,000. That means that the people who will miss out on the protections are: 1. most IT contractors and all consultants 2. massive numbers of owner-drivers 3. small retailers trying to bulk buy goods 4. family farmers try to sell bulk products 5. and many more. The Coalition didn’t promise to protect some small business people some of the time! It’s a sell-out to big business and government bureaucracy who oppose small business protections. The government’s stated excuse for doing this is irrational. The ICA says there’s been a simple ‘trick’ inserted into the Bill. The protections against unfair contracts are limCONTINUED ON PAGE 28

East Coast Beverages chase boutique consumer with exotic juices KULNURA FRUIT JUICE company, East Coast Foods and Beverages is about to launch a new and innovative product range of exotic vegetable and fruit juices under a new label, “Jive”. “Jive” is being aimed at the boutique consumer market in a breakaway from the highly competitive fruit juice market. Initially two exotic flavours are being introduced: apple, carrot and ginger with a dash of lemon and kiwi fruit, peach, apple and mango smoothie. Both will be available in two sizes. The move to exotic juices is evidence that innovation in the food industry is continuing to play an important part in growing market share for companies producing established products such as orange juice which is where East Coast Beverages first started. Orange juice is undoubtedly among the most highly competitive of all products on supermarket shelves these days. Even so, East Coast Beverages has recently broken into Woolworths in NSW while still maintaining a long relationship with Coles Supermarkets. The company also produces mineral water taken from springs on their own property and of course continues to be a major citrus grower in the region. Owned by the Lentini Family, East Coast Foods and Beverages is one of the Central Coast’s most enduring food processing and farming businesses. Their story goes back to 1965 when Salvatore Lentini bought a citrus orchard on George Downes Drive at Kulnura and picked and packed fresh fruit which he then sent to Sydney’s Flemington Markets. These were the days when farmers took what agents in the markets paid them. They had no control over their produce whatsoever. It got worse when the Federal Government removed tariffs from orange juice imports and the market was flooded with orange juice concentrate from countries like Brazil. With the bulk of the orange crop going for juice the bottom dropped out of the market. That was the early 1970s. Salvatore decided to squeeze his own oranges and market direct to small retailers. He had three sons; Frank, Mick and Sam. They all worked on the farm with their father. In fact the whole family worked on the farm when necessary. And that was their competitive advantage. Freshly squeezed orange juice and no imported concentrate added. Subsequently, after some water scares in Sydney, demand for bottled spring water took off. The Lentini’s were in the right spot at the right time with their orchard having unlimited spring water. It was just a case of adding to the product range. Sam, the youngest of the three brothers, on leaving school went to university and became an accountant while working on the farm in his spare time. Over time the business has continued to grow and now the Lentini’s source fruit from growers across the Coast. Salvatore’s grandchildren are now in the business ensuring that it will continue to grow and keep up with and ahead of the competition. “Jive”, East Coast Beverages new exotic juice range He told CCBR that the company has a policy of supporting local suppliers and services. “We employ over 30 people on top of the family and source as many services as we can from the Coast,” he said. “We have been accepted by the major supermarkets and other retailers but what we find disappointing is that many of the local restaurants and major hotels prefer to get their juice and water from Sydney suppliers.”

Mingara supporting community groups MINGARA HAS CONTINUED with its support for community groups that share their vision to make a significant contribution to the quality of community life, with a Cheque Presentation evening in late July. Mingara has supported over 100 different community and sporting groups totalling more than $680,000 with additional funds of over $1.2 million spent on community facilities such as the Mingara One Pool and Mingara Athletics Centre. Mingara CEO Paul Barnett said, “the Mingara Cheque Presentation was an opportunity to recognize the hard work of the amazing volunteers and organisations that we have on the Central Coast. Twenty seven organisations shared in the night receiving funds to continue with some amazing projects that will make living on the Central Coast an even better place to be.” Some of the projects funded included a Community Education Van for the Cancer Council so they can visit schools and community events to educate people on ways to reduce the risks of cancer, Funds for a Boys Shed at Bateau Bay Primary School, Literacy Projects for Berkeley Vale Primary School, Water Safety Education sessions for Surf Lifesaving and a brand new car for the Oasis Youth Centre to provide free driving lessons for youth in need. “The Central Coast really is an amazing place to live with so many community minded people and being able to support the great work that they do is one of the best parts of being a community Club,” said Mr Barnett. THE FEDERAL GOVERNMENT’S Standing Committee for Education and Employment was on the Central Coast in late August speaking to local representatives as part of the latest round of hearings into the barriers regarding small business employment. Mrs Karen McNamara MP, Federal Member for Dobell and a member of the Standing Committee for Education and Employment, was able to bring the hearing to Dobell to look into the obstacles to small business job creation and the difficulties that people in regional areas face when looking for work. “When this Inquiry began I immediately spoke about the need for the Committee to hear firsthand from representatives in Dobell about the challenges we face,� Mrs McNamara said. “With these Committee hearings usually held in major capital cities, it is a big coup to have the Members travel to our wonderful region to hear from local representatives.�
With small business being the engine room of our economy, Mrs McNamara worked with local organisations to ensure their ideas and problems were heard and recorded as part of the official submission process. “Small business plays a major role in our economy and we need to make sure they are well represented and supported,� stated Mrs McNamara. It is also important to recognise the factors that may hinder job seekers in the region and what solutions can be put in place to make finding a local job easier for everyone. “This Inquiry is about hearing from the grass roots level what needs to change in regards to job seekers and what difficulties they face,� Mrs McNamara said. “This Committee wants to bring these issues to the forefront and identify tangible and focus ready solutions.� For further information about this Inquiry please visit the Committee’s website at www.aph.gov.au/ SmallBusinessEmployment

E-Bisprint aligns for future growth TUGGERAH BASED E-BISPRINT has announced the appointment of Sean Havard as CEO responsible for managing the E-Bisprint team under its founder and Executive Chairman, Paul Freeman. Mr Havard will head up an expanded leadership team and be supported by a youthful and dynamic executive team with Catherine Gibson taking up the role of National Sales Manager and Peter Miller managing the local and offshore IT development teams. Mr Havard’s work history stretches from a small town in Alaska to the Central Coast of NSW having worked at PriceWaterhouseCoopers (PWC) in both the United States and Australia before leaving PWC as a mid-level manager. After gaining experience in numerous industries and international markets, he joined Apple Computer Australia where he managed the shared services division located in Singapore. He first joined E-Bisprint in 2004 and spent eight years managing the Finance

Owned and operated by David Nagle, James Patheyjonns and Jo Ryder for the past 4 ½ years, this quirky café is renowned for its great coffee and breakfast and dinner menu. The purchaser is Deanne Berry who is looking forward to continuing with the good service the café is renowned for. All staff have been retained. The sale was negotiated by Graham McMullen of Argyle Estates Business Brokers who experienced strong interest throughout the expressions of interest process exceeding his clients expectations as quoted by other business agents. All partners are now wishing to pursue other ventures in the future.

Draft strata bills released MID JUNE SAW the State Government release two reform bills to the NSW strata laws. These reforms are the first major changes since initial strata legislation was introduced in 1961. These changes come following an extensive review which began in 2011 and the release of position papers on reform of strata and community schemes. UDIA NSW welcomes the release of the strata reform bills which seek to make laws more applicable to today’s modern strata living. The most pivotal reform is lowering the threshold requirement to 75 per cent support for the sale or renewal of a strata scheme. These reforms apply only to future strata schemes, not to existing schemes. However, existing strata schemes can vote to opt in. A snapshot of the major changes contained in the bills: > Developers will be required to pay building bonds equaling two per cent of the contract price for the building work > Place a limit on the number of proxy
votes one person can hold. In a strata scheme of 20 lots or fewer the vote will be one, in a scheme with more than 20 lots the vote will be no more than five per cent of the total number of lots in the scheme > Changes to the model by-laws to address common issues, including parking, pets, smoking, and hardwood floors > Allow non-voting tenants to sit on the executive committee where the majority of units are tenanted > Establish a new process of identifying and rectifying building defects > Allow the creation of by-laws to limit the number of adult occupants residing in a lot. No less than two adults per bedroom per lot > Introduce a number of new measures to address maintenance items and building defects > Enable modern forms of communication including electronic records and email updates to be used > Allow owners to carry out minor reno-
vations to their lots without the need for approval > Owners corporations can seek compensation against the developer if unrealistic levies were set > The name of the ‘executive committee’ will be changed to ‘strata committee' In recent years the UDIA NSW has actively encouraged reform of the NSW strata system. While supportive of the reforms, there are a number of concerns regarding the changes contained in the draft bill including the ability for tenants to sit on executive committees and the changes in the provision of defect reports. These reforms will need to be carefully considered prior to implementation and the Institute looks forward to continuing to work with government to progress change to current strata reform. Over the coming weeks the UDIA NSW Strata Committee will prepare a submission on the draft bills. See the draft bill on the NSW Fair Trading
Grants to improve business recycling rates on the Central Coast Parliamentary Secretary for the Central Coast, Scot MacDonald MLC has announced that two NSW Government Bin Trim grants of $293,425 to Energy Conservation and $280,000 to HunterNet to help small-to-medium businesses on the Central Coast improve recycling rates and divert waste from landfill. Bin Trim grant recipients will use their money to fund more than 100 waste assessors to provide advice to businesses on recycling and cost reduction opportunities as part of the NSW

Government’s flagship $465.7 million Waste Less Recycle More initiative. “These Bin Trim grants provide businesses across the Central Coast access to tap into new opportunities to reduce waste to landfill and boost recycling.” Bin Trim assessments provide businesses with an onsite analysis and a tailored Waste Reduction Action Plan, which includes practical and affordable options to increase recycling. These assessments can result in recommenda-
tions to increase recycling such as new signage to educate employees about correct waste disposal and separation practices through to new infrastructure, such as balers or crushers. Businesses that receive a free Bin Trim assessment are eligible to apply for a share of the government’s $9.4 million Bin Trim rebate program to help cover up to 50 per cent of new recycling infrastructure costs. Businesses are eligible to apply for a rebate only if they undergo a Bin Trim assessment.

Brisbane company wins $28 million Wyong Road project intersection upgrade
Chinese Temple plans finally lodged with Council
INFRASTRUCTURE CONSTRUCTION COMPANY BMD Constructions Pty Ltd have been awarded the tender to improve the Wyong Road and Enterprise Drive intersection at Berkeley Vale. Parliamentary Secretary for the Central Coast, Scot MacDonald MLC said BMD Construction Pty Ltd will start work to replace the existing roundabout with traffic lights to improve traffic flow and safety on the major intersection upgrade next month. The work includes building new turning lanes between Enterprise Drive and Wyong Road, from Chittaway Road into Wyong Road and from Wyong Road into Enterprise Drive. “The NSW Government has allocated $28 million for the upgrade of Wyong
A development application for the long talked about Chinese Temple was formally lodged with Wyong Shire Council in late July. The application is for a Buddhist temple and ancillary buildings on a 2.61ha parcel of land at Sparks Road Warnervale, on the proposed Chinese Theme Park site. The $83.5million proposal includes Buddhist ceremonial and meditation halls, a 244 unit and four storey pilgrim lodge, basement car parking area, internal roads, landscaping and associated infrastructure. The development proposes 24 hour per day 7 day per week operation as a place of public worship employing over 150 fulltime staff and with 20 monks residing full time at the lodge. The application will be publicly exhibited within the coming weeks for public comment. This site forms part of the 15.7ha Australia China Theme Park site which is currently under consideration for a planning proposal to allow a range of additional tourist related uses to be considered on the site. The Department of Planning and Environment has issued a gateway determination for the proposal and the applicant is undertaking a range of studies as part of the planning proposal process.

Green light for $5 million mixed use development in Gosford Council has approved a mixed use development worth around $5 million in Gosford’s city centre. The up to seven storey development comprising a 31 room boarding house, 15 residential units, a small retail shop and two levels of car parking will be built on the corner of Beane Street and Watt Street in Gosford. This development will provide addi-
tional housing and housing choice (including affordable housing) on a site with good access to public transport and the city centre area. Since October 2014, over $335 million worth of development has now been approved for Gosford’s city centre area by Council and the Hunter and Central Coast Joint Regional Planning Panel.

International event secures world class naming partner University of Newcastle will be the naming partner of the Central Coast Sevens International Rugby Festival to take plasce on 24th and 25th October at Wyong Rugby League Club. The announcement made by tournament officials and UON representatives at the tournament’s official launch event held in early August, has further established the internationally renowned tournament as one of the world’s leading invitational rugby sevens events and a major asset event for the Central Coast region. The tournament to be known as the UON Central Coast Sevens is regarded as the premier tournament of its kind in Australia outside of the World Series, attracting some of the very best sides in the world, including a number of national teams, who will use the tournament to prepare for upcoming Olympic qualification events the 2015/16 World Series. Tournament Founder Craig Morgan said “this is an extremely exciting announcement and a very important partnership for the Central Coast Sevens, we see a strong alignment with the core values

Mariners apply for NPL Licence The Central Coast Mariners have announced that an application has been lodged to Football NSW that would allow the Mariners to facilitate an elite pathway and enter teams in various ‘Football NSW 2016 National Premier League’ (NPL) competitions. In the event that the Central Coast Mariners were successfully granted a licence to participate in the NPL, the Mariners would commence the management and development of an elite football program for males and females on the Central Coast from the 2016 season.
Within this program we have lodged an application for a Skills Acquisition Program (SAP), which is Football Federation Australia’s official talent player pathway for 9-12 year old boys and girls. The management of an elite pathway by the Central Coast Mariners under the technical remit of the Mariners Technical Director/Head Coach aligns with Football Federation Australia’s holistic strategy that encourages all Hyundai A-League clubs to be more involved with youth development by administering and managing teams within the NPL competitions.
Football NSW is currently reviewing the applications put forward by the Central Coast Mariners. If the Central Coast Mariners are granted an NPL and SAP licence, an announcement will be made – outlining the specifics of a Central Coast Mariners ‘Football NSW 2016 National Premier League’ program. A proposed Central Coast Mariners ‘Football NSW 2016 National Premier League’ program has no impact on the current Central Coast Football Club structure and would only take effect from the 2016 season onwards.

been terminated (other than for issues of misconduct). In the past, this right was limited to award employees or those under various company schemes, but with the introduction of the Fair Work Act in 2010, the payment of redundancy became a universal right in such circumstances. In previous articles, I have discussed when a redundancy arises. It arises where the job the person was doing no longer needs to be done. This usually is because it is either outsourced or staff numbers are cut and the duties involved in that role are shared equally amongst other staff. It may just be that the company ceases to make that line of product or provide that service. A final situation may be that a business unit is sold.
So in such circumstances do all employees get paid redundancy? The answer – like so much in law – is yes and no. Employers are not obliged to pay redundancy in some specific circumstances: • Where they have fourteen or less employees at the time of the termination • Where the company is sold, the employees are taken on and their prior service is recognised by the new employer • Where they are on a fixed term contract that has expired • Where they are casual There is a further exception which is available to the employer to the Fair Work Commission where an employer can argue that they were proactive in finding new roles for the employees and therefore should be excused from paying redundancy. The question is how proactive you have to be? In a recent decision of the full bench of the Federal Court, the Court considered the circumstances of a company that had lost a contract. The contract had gone out to tender again and a new tenderer had been successful. In that case, the employer took some steps to put the employees in contact with the new tenderer and 49 of the staff were successful in finding such a role. However, the new tenderer didn’t recognise prior service with the employer. The question was whether the actions of the employer were significant enough as to allow them to be exempted
from the payment of redundancy. The Court – controversially – found against the company and required them to pay redundancy to their staff (even though they had new roles). Unfortunately, the full bench of the Federal Court didn’t make any effort to set out what sort of steps it would expect the company to take. The Courts seemed to distinguish between merely creating an opportunity and taking steps to actually secure employment with the new company. The full bench assured us that they weren’t setting too high a bar. I am not so sure. The difficulty with their decision is that it further encourages employers to look closely at permanent casual arrangements to avoid such liabilities and in some respects it diminishes the incentive on employers to take any steps at all unless they are certain that they have the full cooperation of the potential new employer – that is not always easy to achieve. NEXT STEPS We would recommend that you do more than just contact the perspective employer. Rather, we suggest you work collaboratively with their HR or management to secure interviews for your staff, that you assist the staff with preparation of CV’s. It may be timely that you organise for some of those interviews to occur on your premises. That’s in addition to making sales, managing staff, developing customer relationships, planning marketing strategies and hopefully making a profit! As a director of a private company and owner of the company itself, you are exposed to a number of risks such as: • breaching directors and officers duties • the company breaching a range of laws and regulations
• employment practice liabilities (e.g. unfair/wrongful dismissal or harassment by other employees) • crime within the business (e.g. employee fraud) • tax audit investigation expenses • statutory liabilities (e.g. workplace/OH&S legislation) which can involve criminal prosecutions. Not only can these risks cause immediate financial ruin, but also exposure to lengthy and costly litigation. Just the cost of defending a claim, let alone any damages and costs awarded against you based on a simple allegation, can be very costly in terms of time and money. CCBR Subscribers look over the new Imperial Centre Gosford CCBR’S SUBSCRIBER COCKTAIL Evening in August at the Imperial Centre Gosford was one of the best attended for some time showing the interest our readers have in the Centre’s renewal. Over 80 CCBR Subscribers along with Imperial Centre tenants and senior executives from the Lederer Group (owners of the property) had the opportunity to look over the Centre as the refurb nears completion. Lederer Group Property Asset Manager gave an overview of the refurbishment and mentioned that the Development Application for the project was approved by Gosford Council in 28 days. “This is the fastest response we have ever had from any council,” he said, complementing the Mayor, Lawrie McKenna and the staff at Council.
Also at our Cocktail Evening was Peter Zhu from LB Group which is building the twin-tower residential and hotel development on the Union Hotel site in Gosford. Mr Zhu gave an enthusiastic talk on the reasons for investing in Gosford along with an overview of the project. Mayor McKenna commented on both projects and highlighted Council’s attitude to new investment which has seen a large number of developments approved over the past eighteen months. The evening was also attended by Member for Robertson, Lucy Wicks MP. Our thanks to Centre Manager, Deborah Warwick, for allowing CCBR to hold this function in the Centre.

FOR THOSE OF my older generation who do not really comprehend why Facebook exists. Presently, I am trying to make friends outside of Facebook while applying the same principles. Therefore, every day I go down the street and tell the passers-by what I have eaten, how I feel, what I have done the night before and what I will do tomorrow night. Then I give them pictures of my family, my dog and me gardening and spending time in my pool. I also listen to their conversations and I tell them I love them. And it works!
