1. Introduction This guide is intended for all staff members who are about to leave the Organization. It provides general information on practical matters which commonly arise when service comes to an end for whatever reason (reaching the retirement age, etc.), and on some of the formalities that have to be completed. You are welcome to contact the Human Resources Department and the Social Affairs Service for any additional information. NB : This guide provides general information. For detailed information on the provisions pertaining to all individual cases the official texts must be consulted (e.g. the Staff Rules and Regulations, the Rules and Regulations of the Pension Fund, the Rules of the Health Insurance Scheme, the Administrative and Operational Circulars, individual employment contracts and national laws). Only the official texts shall be deemed valid to determine the rights and obligations of persons preparing to leave the Organization.

2. Administrative Matters 2.1 Termination Sheet You will receive an e-mail entitled “Departure Formalities" inviting you to read your personalised termination letter as well as a termination sheet in the EDH system. The termination payments mentioned below are subject to the completion of all these formalities. Particular attention must be paid to the section concerning Swiss cartes de lĂŠgitimation and French cartes spĂŠciales held by you and members of your family: -

these cards must be valid until the last day of your contract

they must be handed in to the HR Department's Cards Service so that they can be

returned to the Host State authorities on whose behalf they were issued. -3-


CERN access cards and car stickers must be returned to the Registration Service. 2.2 Termination payments Settlement of the termination payments listed below is subject to the completion of all the formalities listed in the "Termination Sheet". The final remuneration payment is due on the date on which the contract expires. The reinstallation grant, if applicable (R A 10.02), is paid following the termination of the contract only if the conditions laid down in Article R V 1.33 of the Staff Regulations are met. Depending on your personal circumstances, you may be eligible for other contract termination indemnities or grants if the conditions laid down in Annex R A 11 of the Staff Regulations are met. These indemnities and grants are paid at the beginning of the month following that in which your contract expires. 2.3 Pension Fund If you are a member of the Pension Fund, you should contact the Fund’s Benefits Service as soon as possible to find out the arrangements for the payment of your pension, transfer value or any other benefits to which you may be entitled. The rules governing these payments are set out in the Rules and Regulations of the CERN Pension Fund. 2.4 Health insurance -If you have no pension entitlement: You may opt to remain a member of the CERN Health Insurance Scheme (CHIS) for a period of 12 months after your contract has ended or for the period during which you are in receipt of unemployment insurance benefits, provided that you fulfil the conditions set out in Chapter III of the CHIS Rules. You must apply to the UNIQA -4-


Office within 30 calendar days of the end of your contract, where you will be informed of the monthly premium payable. A decision to opt out of the CHIS cover is irrevocable. -If you are a beneficiary of a deferred pension: You may remain a member of the CHIS for an indefinite period provided that you submit your application to the UNIQA Office within 30 calendar days of expiry of your contract. UNIQA will inform you of the monthly premium payable. The cancellation of optional membership of the CHIS is irrevocable, i.e. you will not be able to rejoin the CHIS once you become a beneficiary of the Pension Fund. -If you become a beneficiary of the Pension Fund: You can remain a member of the CHIS for an indefinite period. You must apply to the Pension Fund to retain your CHIS membership within 30 calendar days of expiry of your contract. The premium payable will be deducted from your pension. If you decide to remain a member of the CHIS and continue to reside in Switzerland, you must apply to the cantonal health insurance service of your place of residence (details in the “Useful addresses� section) to obtain individual exemption from the compulsory health insurance specified by the Swiss Federal Health Insurance Law (LAMal). The decision to opt out of the CHIS cover is irrevocable. - If you decide not to opt for CHIS membership and: - If you continue to reside in Switzerland in gainful employment, as a job seeker as a student or as a pensioner, you must take out basic LAMal health insurance cover with a recognised Swiss health insurance provider within three months of your departure. Health insurance provider are under all circumstances obliged to provide persons required to obtain health insurance under the Health Insurance Law. If you would like your health insurance provider to cover the benefits that are not covered by the basic health insurance such as dental and optical costs or the free -5-


choice of private hospitals, you will need to obtain complementary health insurance cover. Complementary insurance is not compulsory and the health insurance provider is not under any obligation to insure you. NEW: CHIS members can now benefit from a collaborative agreement which was concluded between UNIQA and the health insurance provider SWICA. Under this agreement, CHIS members move from the CERN health insurance scheme to complementary health insurance without a break in cover. For further information contact UNIQA. Also see: CHIS BULL' N°38-June 2014 p8; - If you continue to reside in France, you are not automatically covered by the health and maternity insurance provided under the French social security system. - If you are in gainful employment, a student, a registered job seeker receiving unemployment benefit from the French State, a beneficiary of the French state pension scheme or if you have maintained a link to the general French social security scheme during your employment at CERN by opting for membership of the Caisse des Français de l’Etranger, you are covered for in-kind benefits under the French national health insurance scheme. - If you have no cover of any kind under a compulsory health insurance scheme and you have no entitlement as an "ayant-droit"*, you can obtain health and maternity insurance cover by subscribing to the Couverture Maladie Universelle de Base. You may or may not be liable for a specific contribution, depending on your income. * A spouse, common-law spouse or a partner with a civil partnership (PACS) without gainful employment and effectively and permanently dependent on a person covered by the French national health insurance scheme. 2.5 Unemployment insurance If you have worked at CERN for an uninterrupted period of at least six months, are involuntarily unemployed, are registered as a job seeker with the competent services, you are entitled to benefits under the CERN unemployment insurance scheme (Staff Rules and Regulations - S IV 2.01 and R IV 2.01 Administrative Circular No. 4 ). For further information on your entitlement to these benefits, you can consult your Human Resources Adviser. The amount of the unemployment benefit varies between 70% and 80% of the basic salary depending on your family circumstances (the maximum salary used to calculate the benefit is 10'500 CHF per month as at 01.10.2008). Unemployment benefit is payable for a maximum of 60 weeks, during which family benefits are also payable. On request, CERN will reimburse your health insurance contribution. For further details, please refer to Administrative Circular No. 4 and contact the service concerned prior to your departure from CERN. Tel 022 767 89 63, e-mail : HRUnemployment@cern.ch). 2.6 Medical examination on termination of contract Upon the termination of your appointment, 4 weeks before last day of work, you are obligatorily required to undergo an examination by a medical practitioner designated by the Organisation (Staff Rules and Regulations - Art. 2.7 Travel and removal expenses Article R V 1.09 of the Staff Regulations defines entitlement to the reimbursement of travel expenses on termination of contract. It is your responsibility to claim for these expenses from your departmental secretariat. Article R V 1.20 of the Staff Regulations and Administrative Circular No. 30 define the conditions for reimbursement of removal expenses. The Installation Service of GS Department will advise you of the arrangements to be made prior to removal of your furniture and personal effects. 3. Personal matters 3.1 Links with CERN Subscriptions Subscription to the CERN Bulletin: You are entitled to continue your subscription to the electronic version of the Bulletin, which will allow you to receive the weekly updates that do not appear in the paper version. To do so, go to the Bulletin website and click on "Sign up!" Subscription to the CERN Courier: If you wish to receive the CERN Courier through the post, please complete the electronic form at the following web address: http://cerncourier.com/cws/sign-up Using CERN's computing facilities Two months before a user's contract with CERN terminates, the user and his/her supervisor are notified via mail of the accounts owned by the user and the E-Groups -8-


the user is member of. The user can contact the responsible of the E-Groups he is member of in case he wishes to be still member of them after his departure. In this case, he/she has to provide his/her responsible with his/her external address. Before leaving CERN the user should provide a non-CERN external email address in order to ensure proper communication after the end of the contract ( cern.ch/account > My Accounts -> Provide or update an external email address) After two months following the expiration of the contract of a user, the Primary and Secondary accounts are automatically disabled and all static E-Groups memberships are deleted. A new External account is automatically created, provided the user has defined an external address in the CERN account tool. The user can transfer his/her Service account(s) to another person in advance. Otherwise, they are automatically transferred to the supervisor. At this time the new lightweight external account is created and the external email address will be used. User will get an email notification. After six months following the expiration of the affiliation, Primary and Secondary accounts are deleted. During these grace period of 6 months, the accounts can be recovered/activated if the user gets a new contract (e.g. affiliation renewal).

E-mail routing after end of contract: s The routing of messages sent to the “Primary Account� defined in Account System portal (Most of the time: Firstname.Lastname@cern.ch) to the external address will be stopped 6 months after the expiration of the affiliation. (Change in the e-mail policy October 2012 - CERN Bulletin 2012 41-42 ). Please note that current CERN retirees are not affected for now (for CERN retirees, mails sent to the "Primary address" defined in the Account System portal -9-


Firstname.Lastname@cern.ch will be routed to the external address as long as the external account exists). If you need more help or have questions, please contact Service-Desk@cern.ch or phone +41 22 767 7777 3.2 Pensioners Access to CERN The Termination Sheet includes a visit to the Registration Service, where future pensioners may request a new card allowing them access to the CERN sites, thus enabling them to use the services or facilities available to all members of the personnel, such as banks, restaurants, post offices, travel agency, Staff Association, Pension Fund, Health Insurance, Interfon, etc. This card, which will be issued as soon as they start to receive their pension, remains valid for the duration of their membership of the Pension Fund. They may also obtain a CERN sticker for their car. If the Director-General invites a former member of the personnel to continue certain (unpaid) activities, the latter is under the Directory-General’s authority but is not subject to the Staff Rules and Regulations, nor entitled to any privileges or immunities. CERN-ESO pensioners association The aims of CERN-ESO pensioners association, which is part of the Staff Association, are to maintain links with former members of the personnel and to defend their collective interests. The membership fee is 30 CHF from 2014 and includes affiliation to the Staff Association. Membership application form must be filled.

3.3 Cars The Installation Service of GS Department will also provide you with information on the formalities to be completed. If you live in Switzerland - If you are continuing to live in Switzerland: If you have purchased or imported your car tax-free (electronic form 15.52), you must contact the Direction des Douanes de Genève, Tel. 022 747 72 81, at the end of your contract to settle any customs duty. You may then take the steps described below by applying to the competent Service des Automobiles (list of contact details at the end of this brochure). If your vehicle is on Swiss number plates, you have three months from the date of the termination of your contract to go to the relevant Service des Automobiles with your new Swiss residence permit and the vehicle registration document in order to have the necessary adjustments made to the latter. If your car is on CD number plates, you have three months from the date of the termination of your contract to go to the relevant Service des Automobiles with your new Swiss residence permit, an insurance certificate and the vehicle registration document in order to obtain ordinary number plates. - If you are leaving Switzerland: Contact the Service des Automobiles in order to Inform them of your new address. If you have purchased or imported your car tax-free (electronic form 15.52), you must hand this document to the official at the customs post through which you leave Switzerland in your vehicle. You then have three months in which to return the Swiss number plates by mail to the Service des Automobiles or to the Swiss Embassy or Consulate in your new country of residence. -11-


Note:Third-party insurance cover taken out in Switzerland will not be suspended until your number plates are returned. If you live in France - If you are continuing to live in France: If your vehicle is registered under the old French System (1234 AB 01) and if you are moving to another department, you should start the formalities to change the grey card and the registration of your vehicle during the month following the expiry date of your contract by applying to the prefecture or sub-prefecture of your place of residence. If your vehicle is on green plates (K or CD), you must go to the French customs office on the "Bureau de Douane de Ferney-Voltaire"* prior to the end of your contract to: - settle any duty (VAT or customs duty) - return the original document entitled “Demande d’immatriculation d’un véhicule dans la série …” (Formulaire 2) - return the set of green plates. You must obtain a new registration certificate (certificat d’immatriculation) from the prefecture or sub-prefecture (forms and information available at town halls). If you hold a foreign driving licence, you should check with the prefecture whether it is recognised in France and how to exchange it if it needs to be renewed. - If you are leaving France: If your vehicle has ordinary number plates and you are moving to another member state of the European Union, there are no formalities to complete with the French authorities. If you are moving to a country which is not a member of the European Union, you must make an exportation declaration at the customs service on leaving a European Union country.

If your vehicle is on green plates (K or CD), you must return the original document entitled “Demande d’immatriculation d’un véhicule dans la série …” (Formulaire 2) together with the set of green plates, to the French customs office at the "Bureau de Douane de Ferney-Voltaire"*. Through this customs office and the sub-prefecture in Gex you must obtain French plates, please contact the French customs for details of the procedure to be followed. *Bureau de Douane de Ferney-Voltaire, Tel: 09.70.27.31.81 3.4 Termination of Leases If you change your place of residence on termination of your contract and are living in rented accommodation, you must give notice to terminate your lease according to the conditions of your lease contract. Check carefully the prescribed periods of notice and the expiry date of the lease. Early termination is possible but requires the lessor’s consent. Discuss the arrangements for giving up the apartment with the lessor and set a date for the departure inspection (inventory in the case of furnished accommodation) and for handing back the keys. You will then be able to request the return of the guarantee deposit that you paid when you signed the lease. If you live in Switzerland Persons holding a "carte de légitimation" may invoke the diplomatic clause which, in the Canton of Geneva, is included in the tenancy agreement. In the Canton of Vaud, the tenant must expressly request the diplomatic clause to be included in his tenancy rental agreement. This clause is advantageous for the tenant in that it releases him more rapidly from the obligations associated with termination of his lease. - your local water company - your tax office (Service des Imp么ts des Particuliers) 3.6 Insurance Policies As soon as you know the date of your departure, you should contact your insurance companies to find out whether your policy can be continued in the country to which you are going, or else the conditions applying to its cancellation (notice period, reimbursement of premiums, etc.). 3.7 Bank Accounts In Switzerland From Swiss banks and authorities there is no problem in maintaining a bank account in Switzerland after you have left the country. However, you can no longer claim for a refund of the withholding tax levied on interest from such accounts as you were entitled to as a member of the personnel if you were resident in Switzerland. In addition, maintaining an account in Switzerland may make you liable for certain costs and may have consequences with regard to the authorities of your new country of residence. Make sure that you find out beforehand. Pensioners must maintain a bank account in Geneva as pensions can be paid only in Swiss francs. In France If you wish to maintain an account in France, establish prior contact with your bank to determine the new terms, examine any costs and establish any consequences with respect to the authorities of your new country of residence. Do not forget to cancel your standing orders if you are leaving France or Switzerland and are not maintaining an account there. -15-


3.8 Taxes Taxation of salaries and emoluments paid by CERN In the year following your departure from CERN, you may still have to include on your income tax declaration form any salary and emoluments received in the previous year from CERN for the months up to the end of your contract. Particularly in the Host States, you may be required to attach a certificate of internal taxation. We therefore invite you to consult the document describing departure procedures which includes details of “How to obtain your certificate of internal taxation� and to register your private email address before your departure. In any event, you must comply with national tax legislation. Further information When you leave CERN, your tax position is likely to change. Your income and your assets may become subject to tax in the CERN Host States and/or another country. We recommend that you assess the implications of your departure from CERN on your tax position before you cease working. General sources of information are, for example, international banks which frequently post country-specific tax information on their websites, as well as the government agencies dealing with tax and pension matters in the countries concerned. The national authorities often have international sections which deal specifically with cross-border cases or cases involving foreign nationals. -16-


You may also contact representatives of the country concerned in France and in Switzerland (e.g. mission or consulate) to obtain details of contacts in that country. You may also contact the CERN-ESO Pensioners Association which provides information on tax in France and in the Cantons of Geneva and Vaud. The CERNESO Pensioners Association regularly holds information sessions at CERN where you can obtain advice. 3.9 Social security In Switzerland The Swiss social security system covers the following four areas: 1) Pension provision for old age, survivors and disability (known as the three-tier ("pilier") system): 1st tier: AVS/AI basic state pension scheme, membership of which is compulsory, 2nd tier: LPP occupational provident scheme, membership of which is compulsory for those in gainful employment, 3rd tier: Optional individual insurance (savings schemes, insurance). If you continue to reside in Switzerland after your contract terminates, whether in gainful employment or as a pensioner, you will be required to contribute to the AVS/AI/APG state pension scheme until you reach the legal retirement age, irrespective of your nationality. The AVS/AI/APG contributions of persons not in gainful employment are calculated on the basis of their income and assets. The AVS/AI/APG contributions of persons in gainful employment are deducted from their salary or income. Gainfully employed persons are subject to the compulsory deduction of contributions to the LPP occupational provident scheme. -17-


Once you reach the legal retirement age, you should apply for an AVS pension. The AVS indemnity fund (Caisse Cantonale de Compensation AVS) of the canton where you were last an AVS member will provide you with any additional information you may require. 2) Unemployment insurance (LACI) Persons gainfully employed in Switzerland must be insured against unemployment. Contributions are automatically deducted from their salary. 3) Illness and accident insurance cover Residents in Switzerland (both the employed and pensioners) are required to join the basic health insurance under the Health Insurance Law through a recognised health insurance provider. Members of the CERN Pension Fund who decide to continue membership of the CERN Health Insurance Scheme may request the cantonal health insurance service of their place of residence to exempt them from the Swiss compulsory basic health insurance (See Section 4 of this brochure). Residents in Switzerland may take out voluntary complementary health insurance. Persons not in gainful employment must be insured against accidents in the framework of the Swiss compulsory basic health insurance. Those in gainful employment must be insured under the LAA accident insurance scheme by their employer. 4) Family allowances The family allowances paid to persons in gainful employment are almost exclusively financed by the employers. N.B. Pensioners who decide to continue to reside in Switzerland may obtain additional information from the Social Affairs Service. -18-


In France The French social security system comprises several schemes, including the general scheme which covers the majority of private sector and other categories of employees (students, beneficiaries of certain types of benefit, etc.), special schemes covering employees from other sectors (agricultural scheme, the schemes for non-agricultural self-employed persons), the unemployment insurance scheme and complementary pension schemes. Individuals may supplement these different schemes by private insurance policies (complementary health insurance, etc.) if they so wish. The general social security scheme provides cover for the following insurance risks: -illness, maternity, disability, death -industrial and occupational accidents and illnesses -old age and widowhood -family support obligations. Employees must start paying social contributions equal to a certain percentage of their salary as soon as they take up employment. These contributions, which are compulsory, are automatically deducted from their salary. They entitle the employee and his dependents to membership of the social security system and to benefits under the general scheme, provided that the specific conditions applicable to the benefit in question are met. If, before joining CERN, you worked in a country of the European Union, the European Economic Area or a country having signed a social security agreement with France, you can ask the primary health insurance fund (Caisse Primaire d'Assurance Maladie) of your place of residence to examine your case with a view to determining whether you can claim entitlement to French health insurance based on periods of insurance in another State.

Pensioners who reside in France after their contract terminates do not automatically become members of the French social security system and are not obliged to contribute to it. Pensioners who are recipients of a retirement pension under the French social security scheme can request to become members of the French health insurance scheme. If their medical expenses are reimbursed by the French health insurance scheme, they are subject to the deduction of CSG (Contribution Sociale Généralisée) and CRDS (Contribution pour le Remboursement de la Dette Sociale) contributions from their CERN pension. N.B. Since 1 January 2010, periods of membership of the CERN Pension Fund can, under certain conditions, be used in the calculation of the pension paid by certain French basic pension scheme. Country of residence

If you are leaving Switzerland or France at the end of your contract, please inform the competent French or Swiss authorities, i.e. the Office cantonal de la population in the case of Geneva, the "Contrôle de l’Habitant" in the case of Vaud and the town hall of your place of residence in the case of France (the addresses are provided at the end of this brochure). You are also advised to contact your local consulate to check whether you need to complete any formalities prior to changing country of residence.

In general, if you intend to reside in a country of which you are not a national when your contract terminates, you should find out as soon as possible about the formalities you will need to complete to obtain a residence permit (and a work permit, if applicable) from the authorities of the country concerned. The choice of country of residence is a very important decision for future pensioners. In particular, if you decide to leave Switzerland, the procedures for returning to live there again at a later date may be complicated. In Switzerland If you are a pensioner, the Social Affairs Service can inform you of the procedure you need to follow to obtain an unlimited residence permit (C permit). An application for this permit must be submitted about six weeks before your contract expires. Information to the attention of staff retiring in the Canton of Geneva Due to a delay in processing applications for the residence permit (B) and the settlement (C), it is strongly recommended that staff retiring in the canton of Geneva request a “délai de courtoisie” prior to the end of their duties. This will enable them to keep their carte de legitimation for a further 3 months after the end of their contract, and, where applicable, their diplomatic plates. It must be noted, however, that fuel cards must still be returned on the last day of service. The staff concerned should make this request by filling in this form “délai de courtoisie” when they are completing their departure formalities and hand this to the Cards Office in the HR Department who will then forward the request to the Swiss Permanent Mission in Geneva.` In all other cases, the bilateral agreement on the free movement of persons between Switzerland and the European Union (EU), which entered into force on 1st June 2002 and whose regulations were also adopted by the EFTA countries as well as Cyprus -21-


and Malta since June 2007, simplifies the conditions for entry, residence and the taking-up of gainful employment applicable to the nationals of the States concerned. However, for the 8 new EU Member States (Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Slovak Republic and Slovenia), special conditions may apply until 31 May 2014. At present, Switzerland will apply restrictions on the free movement agreement to citizens of Bulgaria and Romania until 31st May 2019. Nationals of the EU/EFTA looking for employment do not need a residence permit for the first three months they only have to present themselves at the "Contr么le des habitants" of their Local Authority. If your job seeking takes longer, you must apply for a permit to look for a job for a further three months.
