Fouts seeks appeal after federal lawsuit is dismissed BY GENA JOHNSON gjohnson@candgnews.com

WARREN — Lawyers for Warren Mayor Jim Fouts vow to appeal a ruling by a federal judge who dismissed a lawsuit alleging the mayor’s civil rights were violated when he was removed from the ballot of this year’s primary election. Fouts filed the four-count complaint on Aug. 2 against the Warren City Council, the Warren Election Commission, Warren City Clerk Sonja Buffa and Macomb County Clerk Anthony Forlini. On Sept. 5, U.S. District Court Judge George Caram Steeh granted motions to dismiss filed by the defendants. The case was dismissed in its entirety without a hearing,

making moot Fouts’ request for an expedited review of his case. Count I of the complaint alleged Fouts’ First Amendment rights were violated when he was taken off the 2023 primary ballot. Fouts sought a remedy of a special election for the office of mayor only, with him on the ballot with the other mayoral candidates. According to what was requested, absentee votes that came in before the special election would have been decertified and residents would have had to revote for the candidate of their choice. “The court finds that there is no fundamental right to run for office, and Warren has a rational basis for imposing term limits for the office of mayor,” Steeh wrote in his opinion and order. Warren celebrates Ukrainian Independence Day WARREN — Ukrainians gathered in Warren to celebrate Ukraine’s independence in a joyous yet solemn ceremony Aug 24, to commemorate freedom and pay homage to fallen heroes. The day marked the 32nd anniversary of Ukrainian independence from Russia. The event was held at the Ukrainian and Ukrainian-American Veterans Memorial and was supported by many in the community. Oksana Hryhorchuk Gudz, president of the Ukrainian National Women’s League of America, often referred to as UNWLA, gave the keynote address. “Today should be a great joy and celebration. It was on

this day in 1991 that Ukraine proclaimed its independence (and) was internationally recognized as a sovereign, independent nation,” said Gudz. Part of the joyous celebration were proclamations from Gov. Gretchen Whitmer, state Sen. WARREN — In February 1973, a group of Ukrainian women with the desire to help others gathered for their first meeting. With founder Lydia Kolodchin at the helm, they formed the Ukrainian National Women’s League of America Branch 53, which is part of the Ukrainian National Women’s League of America based in New York City. Kolodchin died last year at age 96, but her legacy and that of Branch 53 continues. Currently, there are 21 active members in the charitable and cultural organization. Branch 53 will celebrate its 50-year “Golden Jubilee” at 1:30 p.m. Oct. 8 at the Ukrainian Cultural Center, 26601 Ryan Road. The event, open to the public, will include a luncheon and a fashion show featuring clothing made by Maryana Priymak, who designs clothing from her studio in Lviv, Ukraine. Priymak uses the hand-looming cloth technique to make men’s, women’s and children’s clothing, purses, wallets, belts and shawls. She will not be at the luncheon, but is sending the clothing, which will be available for purchase. The Golden Jubilee gives the members a chance to celebrate the group’s history and share Ukrainian culture with others. Golden Jubilee tickets are $65 each and must be purchased by Sept. 27. A portion of the proceeds will benefit the UNWLA humanitarian and scholarship funds. Over the years, Branch 53 members have held countless fundraisers, Easter raffles and other events that have raised money to provide scholarships, medical care, food, financial assistance and care packages to local residents and people living

WARREN — On Aug. 29, the heroic efforts of Warren police officer Brenden Fraser resulted in a toddler regaining the ability to breathe on his own. Fraser was on traffic enforcement duty in the area of 12 Mile and Schoenherr roads at around 6 p.m. when he saw a Chevy Camaro speeding westbound on 12 Mile traveling at an estimated 75-80 mph, according to police. When Fraser caught up with the vehicle, he noticed the driver was waving his hands in an apparent attempt to flag him down. According to police, the driver frantically told Fraser his nephew was not breathing, and the child was observed to be in obvious distress. Fraser reportedly took charge immediately and performed back blows to clear the child’s airway. The child regurgitated a liquid and started to breathe on his own, police said. “Officer Fraser was able to calm down the child’s family members, who were understandably frantic over the situation,” said Warren Police Commissioner William Dwyer. Other officers arrived on the scene and rushed the child to Brenden Fraser Ascension Macomb-Oakland Hospital at 12 Mile and Hoover Road, just a mile away. The child was released from the hospital two days later and was back at home with his family. “Officer Fraser’s actions on this traffic stop are nothing short of heroic. This incident shows that police work and traffic stops are not always about writing tickets or making arrests. In this case, what started off as a traffic stop for speeding resulted in Officer Fraser saving a child’s life,” Dwyer said. “Officer Fraser’s supervisors have already nominated him for a lifesaving award from the Department which is beyond well-deserved.”

In Lansing, she missed 107 votes, including a bill to give disabled veterans a tax credit. When she did show up, she voted for a bill that would deny all Michigan taxpayers an income tax cut and instead would send hundreds of millions of our tax dollars to battery companies with employees in China connected to the Chinese Communist Party.

On city council, she took no action on allocating $14 million in federal funding to fix our parks, but did vote to file lawsuits to sue the city, costing Warren taxpayers well over $1 million. Also has not supported building the Towne Center.

STEM Saturday focuses on wind power

Checkmate: Chess is Michigan’s favorite board game

STATEWIDE — A new study has revealed that chess is Michigan’s favorite board game. The online game website World of Card Games analyzed the number of Google searches for 605 board games to determine which one is Michigan’s favorite. When conducting the study, each game’s name was combined with various terms, including board game, how to play and rules to determine the interest in each game. According to the study, chess topped the list for Michigan’s favorite board game, with an average of 12,732 monthly searches. Checkers was second with 5,850 average monthly searches, while Monopoly was third with 3,960 average monthly searches. Clue was fourth with an average of 2,444 average monthly searches. With 2,178 average monthly searches, Mancala was fifth. “Chess is a cultural touchstone, with terms such as checkmate being a staple of the English language. It has been studied for centuries, and skill at the game is considered shorthand for a person’s intelligence. It has even seen a new wave of popularity in recent years as more people learn of its intricacies. It is fitting then that chess is Michigan’s most popular board game,” a World of Card Games spokesperson said in a prepared statement. “It will be interesting to see if chess continues to grow in popularity in the coming years and how that might impact how people play the game online and offline, both professionally and at the amateur level.”

SOUTHEASTERN MICHIGAN — The Southeast Michigan Council of Governments recently announced approximately $2 million in funding awards for walking and biking projects in southeastern Michigan. SEMCOG has awarded $2,073,728 in Transportation Alternatives Program (TAP) funding for three projects for fiscal year 2025. This fall, SEMCOG will consider additional projects for 2025-2027. TAP projects are transportation-related improvements to roadways, local streets and corridors. They primarily address mobility options through new or enhanced bicycle and pedestrian infrastructure. This includes pathways, bike lanes, sidewalks and pedestrian crossings. The projects are designed to improve the existing transportation system, while providing safe new options to help people connect to transit, regional trails and core service destinations. TAP can also fund green infrastructure projects that mitigate environmental concerns from the road network. SEMCOG’s Regional Review Committee is currently considering additional projects for future fiscal years. The next application deadlines are Oct. 11 of this year and Feb. 21, 2024. MACOMB COUNTY — Since opening up the Center Line High School Academies in 2016, school officials have partnered with several local businesses to better prepare students for the workforce. These relationships provide more resources, give educators the chance to bring in professionals to meet with students about employment options, and allow for job shadowing opportunities and other projects. On Aug. 29, the educators took it one step further when they conducted on-site visits with three local entities: Ascension Macomb-Oakland Hospital in Warren, Invio Automation in New Baltimore, and the Macomb County Administration Building in Mount Clemens.

The goal was to give staff members a more in-depth look at the qualifications and certifications employers are looking for, learn new terminology and make new connections with professionals. Through their lesson planning, the teachers will bring what they learned back into the classroom during the school year. Teachers will be able to reference specific careers, technology and skills. Center Line Public Schools Superintendent Joseph Haynes said the hope is to have the students take field trips to the three places of business as well. Center Line High School offers two different academies: Industry, Technology and Innovation; and Health and Human Services. There is also a Freshman Academy designed to provide a transitional environment from middle school to high school. See VISITS on page 9A

The four ITI pathways are engineering technology; innovative art and design; business, commerce and entrepreneurship; and digital design and communication. The four HHS pathways are health and wellness; first responders; law and justice; and public service. The district also established a graduate profile linking collaboration, communication, critical thinking and leadership to prepare students for college, trade school and the workforce. “The market is so demanding now, and this will help our kids,” Haynes said. As per their visits, according to staff members, a willingness to learn, good communication skills and resilience are among the many qualifications businesses look for when hiring employees. Health and Human Services Academy instructor Laura Phy-Daly was among the teachers who went to Ascension. During the visit, hospital staff talked about the careers available to students who are part of the Center Line High School academy model. The staff covered nursing, nutrition and food services, housekeeping, information technology, security, mental health services and other options that students can pursue. Center Line High School Assistant Principal John Grob visited the Macomb County Administration Building with the school’s Freshman Academy teachers. In ninth grade, students pick their academy for 10th, 11th, and 12th grade. “In summary, our discussion revolved around the importance of bridging the gap between educational outcomes, as defined by our Academies and Graduate Profile,

while incorporating the evolving needs of employers,” Grob said via email. “This marked the initial step of a broader initiative aimed at linking our educators with industry partners. Our Freshman Academy teachers will take this knowledge back to their classrooms, enhancing the relevance of their curriculum.” During the visit, the freshmen group engaged in discussions that covered a wide range of topics linked to various facets of employability. “One of the primary focal points of our conversation was establishing a strong connection between the skills outlined in the Center Line Public Schools Graduate Profile and their practical application in diverse work environments,” Grob said. “We delved into the core competencies and attributes highlighted in our Graduate Profile, aligning them with the demands and expectations of future employers. They’ve also been known to help widows in need, support summer camps for orphans and lend a hand to injured soldiers undergoing rehabilitation. “The big emphasis now is to help those people impacted by the war,” said Ola Movchan Novak, of Warren, who has been a Branch 53 member for 50 years and is the Golden Jubilee chairperson. “There are millions of people that had to leave their homes in the east. During the winter, the water supply was damaged and compromised, and now there are more medical needs. We feel good to be able to help the community.” When the Golden Jubilee Committee met Sept. 7, the members reflected on Branch 53’s traditions, describing the Ukrainian people as “friendly, generous, musical, artistic.” Many still have family in Ukraine. Two Branch 53 members were born in Ukraine, while several were born in Germany where their families lived in displacement camps after World War II. Some members were born in the U.S. Through a sponsor, Helen Palmer, born in Germany, came to Cleveland as a young girl with her parents and brother. “My dad had $12 in his pocket,” Palmer remembered. The family toughed it out to start a new life in America. “Ukrainians are survivors. We have survived all these years. People have tried to dominate us for a very long time. We survived,” said Palmer, of Rochester Hills. “Our parents and our grandparents want us to remember the history. We remember the love of country. We remember the country. It means a lot to us. It’s in our hearts.” The group’s social/welfare chairperson, Janet Tymczenko-Zuy-

us, a Warren resident who was born in Germany, came to the U.S. on a Navy ship at age 10. “I remember when I was young, my dad would show me a picture of the Statue of Liberty. When you see that, you’re in heaven,” he often told her. “To him, America was heaven.” So when her family left Europe — her father stayed behind for three years — Tymczenko-Zuyus’ eyes teared up when the ship approached the Statue of Liberty in New York harbor. “I was crying because my dad wasn’t with us,” she said, although she adjusted “very well” to American life and eventually reunited with her dad. Many of the Branch 53 members have visited Ukraine. Vice President Martha Jovanovic, of Sterling Heights, toured parts of the country with her mom and brother in the early 1970s, which she said was the Ukrainian Soviet Socialist Republic at the time. Recording Secretary Luba LePage and President Sophie Koshiw — both original members of Branch 53 — also traveled to Ukraine prior to the recent war. They still carry the memories of those trips with them. “It was fantastic,” said LePage, of Clinton Township, who visited Lviv, Kiev and the Black Sea. “I went to the village where my mother is from.” “I stayed in the villages on my family’s property. I was also in Lviv,” said Koshiw, of Bloomfield Hills. “Going through the villages, it’s very nice.” All the members are looking forward to the Golden Jubilee next month. “We are excited about it because we have been planning it for so long,” LePage said. PONTIAC — Fasten your seat belts — it’s time for the third annual American Speed Festival. The event will race into town from Sept. 28 through Oct. 1 at the M1 Concourse, located at 1 Concourse Drive, which is situated at the northwest corner of Woodward Avenue and South Boulevard. “The American Speed Festival offers more than just static displays; it provides an engaging and captivating experience for people of all ages,” an American Speed Festival press release states. “Attendees can fully immerse themselves in the event, hearing the thunderous roar of a NASCAR as it enters the pit lane, catching the scent of burning rubber around the track, and witnessing the thrilling spectacle of time attacks. It’s an interactive event that truly brings the excitement to life.” The M1 Concourse is a playground for any car buff. The 87-acre property features a 1.5-mile road course, an events center, and indoor and outdoor spaces that overlook the racetrack. Also built on-site are private car condominiums that feature living rooms, kitchenettes and personal garages, which will open for a fee on late Friday afternoon. The four-day American Speed Festival is a chance for car owners and spectators to mingle in an automotive setting. There will be race car drivers and sports car owners onsite. Everything from vintage Indy cars to

historic stock vehicles to classic cars will spin their wheels. Some of the cars were built for speed, while others became popular because of their unique style. “It will be a mix of early classic cars, Packards from the 1930s, cars from the ’50s, ’60s, Oldsmobiles, Buicks,” M1 Concourse CEO Timothy McGrane said. Festival officials have set up the event so onlookers “can get up close and personal and talk to the drivers,” McGrane added. In addition, the American Speed Festival will celebrate three significant automotive anniversaries: 100 years of Americans at Le Mans, 70 years of Corvette, and 50 years of International Race of Champions (IROC) Series. The “vroom vroom” fun begins on Thursday with the “speed ring” circuit laps for competitors from noon to 5 p.m., followed by the Motor Grille driver reception from 6-9 p.m. The speed ring is a rare opportunity to see race cars from every era perform on the Concourse track. The momentum continues on Friday with on-track activities featuring various classifications of supercars, endurance race cars, vintage Indy race cars and Le Mans race cars. Corvette fans will want to stay for the Corvette parade laps at 12:50 p.m., along with the Reeves Callaway tribute, set for 12:25 p.m. Callaway founded Callaway Cars and was well known in the Corvette community. “He passed away suddenly earlier this year,” McGrane said. “We’ll have six of his See FESTIVAL on page 15A

But if he had to pick his favorite model, he said it would be “the 1959 Aston Martin DBR1.” McGrane, who grew up in Kent, England, in the southeastern part of the country,

remembers the look of the luxury sports car, which gained fame for the James Bond movies. “It was sort of a brand I was fond of when I was a young boy,” McGrane said. “I grew up very close to a racetrack. Both the national anthem of Ukraine and an emotional people’s anthem sung in wartime were performed in the Ukrainian language. Nearly all in attendance knew the words and sang along. The people’s anthem made many teary-eyed. “It’s a beautiful song,” said Marie Zarycky, as her voice rattled and as she said she was fighting back tears. “This has become an anthem for the people because it is full of hope. It is not a formal anthem.” There was a refrain that was repeated with fervor by those gathered at the event. According to a rough English translation provided by Zarycky, who is from Ukraine and is a native speaker of the language, they sang, “Hey, the red berries of viburnum in the ravine will welcome our freedom fighters.” As they sang, many waved the Ukrainian flag, which represents blue skies and yellow grain which is a natural resource and trade commodity of the country, according to Zarycky. Olena Danylyuk served as the master of ceremonies and is also the president of the Ukrainian American Civic Committee of Metropolitan Detroit. The ceremony started with the presentation of the colors from Commander Matt Wroblewski from the Ukrainian American Veterans Post 101. U.S. Air Force Tech. Sgt. Gudz added that there is still a fight. “At this independence celebration, our hearts are heavy because of the injuries, loss of life, and destruction taking place in Ukraine today. With Russia’s attack on Ukraine, Ukraine again became the target of aggression and is experiencing the horrors of war, aimed not only at the military, but women, children and civilian population,” said Gudz. “We grieve together with the widows and orphans whose lives have been changed forever. What we have seen on the news makes it hard for us to fathom that such evil and cruelty can exist in our world.” Zarycky said there were two messages from the event. “To keep on fighting and ask our (United States) government representatives to prevail on our (Ukraine) government to give serious weapons so President (Volodymyr) Zelenskyy can win,” Zarycky said. METRO DETROIT — Back downtown for its second post-pandemic event, the North American International Auto Show is mostly what industry watchers have come to expect from the annual automotive gathering. General Motors Co., Ford Motor Co. and Stellantis take up the majority of Huntington Place’s floor space. Toyota Motor Corp. is the only non-Detroit manufacturer with a significant presence, while Volkswagen of America Inc., American Honda Motor Co. and Kia America, Inc. have smaller exhibits. Electric vehicles are given a considerable amount of attention on the show floor with GM, Ford and Stellantis showing off their electric truck, SUV and crossover offerings. But for those looking to go beyond looking at exhibits and sitting in static cars, look no further than the four different ride-along experiences. Electric enthusiasts can take a ride on the Powering Michigan EV Experience, where seven brands — BMW of North America LLC, Cadillac, Chevrolet, Ford, GMC, Tesla and Volkswagen — give a rapid ride through a twisting course at the back of the exhibition hall. EVs of all sizes are available for rides ranging from the Chevrolet Bolt EUV compact to the titanic GMC Hummer EV. The Powering Michigan EV Experience provides a smooth-ifintense ride through the hall, but those looking for a more rugged ride-along are in an abundance of luck. Ford, Jeep and Ram all provide terrain-filled experiences to put their off-road vehicles to the test. Ram’s Truck Territory course puts its 1500, 2500 and 3500 trucks through an industrial-themed route with inclines, banked corners and rough terrain. Camp Jeep has a similar experience where Wranglers and Grand Cherokees test their off-road capabilities on a trailthemed course. “A lot of times, people ask questions about Jeep and if owners really do go off-road,” said Stellantis spokesperson Rick Deneau. “Some do and some don’t, but if you don’t, maybe you don’t know about the capability of the vehicle. This (Camp Jeep) is really awe-inspiring, going up the steepest and highest hills, going through the different areas with the wheel articulation. You might not experience that if you’re not an off-roader.” Ford’s Built Wild experience puts the Ranger Raptor and Bronco Badlands through much of the similar paces, including a 38-degree climb and descent as well as other hazards like inclines and uneven terrain. The judge wrote, “Term limits are part of a state ‘to prescribe qualifications for its officeholders’ rather than a ‘regulatory procedure relating to the election process.’” Count II alleged a violation of Fifth Amendment rights without due process of the law. Fouts’ lawyers argued that Warren residents voted to extend the term limits of the mayor from three terms to five terms or 20 years in 2016. They contended retroactivity was not on the ballot or in the proposed amendment in 2020 when voters passed term limits of three four-year terms or 12 years for all city of Warren elected officials. “Plaintiff ’s due process argument is that counting his terms served prior to the 2020 amendment to determine him ineligible to run for mayor, denies plaintiff a vested property interest without due process of law,” Steeh wrote in his ruling. “However, because there is no property vested in being a candidate for political office, the court grants defendants’ motion to dismiss the claim.” Count III alleged Fouts’ 14th Amendment rights were violated by denying equal application of the law. “Because plaintiff cannot show that the term limits are applied to him differently than they are applied to others who are similarly situated, he fails to state a claim for which relief can be granted,” Steeh wrote. The judge also wrote that Fouts was not entitled to a declaratory judgment sought in Count IV because “Plaintiff fails to demonstrate an ‘actual injury traceable to the defendant(s) (that is) likely to be redressed by a favorable judicial decision.’” Steeh’s decision was rendered without a hearing and oral arguments. “That is certainly atypical. I think everybody was probably surprised by this court’s choice to not have a hearing,” said attorney William Savage, who represents Fouts. “In discussion, in chambers it was expressed that there was a very strong likelihood that a hearing would be had and only a slight possibility that one would not be had.”

What’s next?

In the past several months, Fouts has been affected by lawsuits that have not ruled in his favor. In a press release issued by his lawyers, the mayor asked that questions regarding the federal case be directed to his legal counsel. “He is disappointed, just like he was disappointed in the Michigan Court of Appeals ruling, where he certainly felt it was an incorrect interpretation of the law,” said

Savage. Fouts’ legal team will seek an appeal and an expedited review, according to Savage. “It leaves him (Fouts) with an appeal to the Sixth Circuit Court of Appeals in Cincinnati, Ohio,” said Savage. “And it’s an appeal of right, which is not like an appeal to the Michigan Supreme Court where you are asking, ‘Would you hear this case?’ It will be heard. What the Sixth Circuit will do is yet unknown.” The case being heard does not necessarily mean there will be a hearing and oral arguments. Nor does it mean the outcome will be any different. “I never give my clients odds,” said Savage. “I think there is a reasonable chance and a good chance and certainly based on the law at issue, I think there is a significant chance the (U.S.) District Court’s ruling will be modified in some way by the Court of Appeals.” Warren City Council Secretary Mindy Moore, who was a defendant in this case, said she is pleased with the judge’s ruling. “We thought that would happen,” Moore said. “We feel that this was a totally frivolous attempt for the mayor to try to stay relevant and in the news.” Moore also commented about Fouts’ appeal. “It is a waste of taxpayer money. He (Fouts) is apparently spending his own money to bring the lawsuit, but we had to defend it and that cost the city money,” Moore said. “It’s just ridiculous we’ve had to go through those motions and the other defendants had to have attorneys.” Moore could not say how much the City Council has spent on legal fees to defend the case. “We’ve not gotten a bill yet,” said Moore. “If he (Fouts) is going to file an appeal, then we’re going to have to defend that, and appellate law practices are very expensive. This is once again going to cost us money and time.” Moore added, “His (Fouts) time is up. There are other people who are serious about running for office and he is just creating conflict and chaos and confusion with some of the voters. WORKING THROUGH THEIR GOLDEN YEARS ‘WHEN I’M WITH YOU, I’M YOUR AGE,’ SAYS WORKING CENTENARIAN BY CHARITY MEIER cmeier@candgnews.com

METRO DETROIT — The majority of people look forward to retirement somewhere around the age of 65. However, for some, retirement is simply a boring separation from a career they love, and thus they choose to forgo it. “(Working) wants you to stay alive,” said Dick McLauglin, of Macomb Township. “You have that feeling of, ‘Oh, I’ve done enough. I can sleep in this morning.’ But you get up, you know, and get going, and that’s what I like.” At the ripe young age of 100, McLaughlin works an average 20 hours a week over five days as a funeral director and pre arrangement counselor at Wm Sullivan & Son Funeral Directors in Royal Oak, where he has worked since 1953. McLaughlin said he retired for two weeks in 1988 but was so bored that he jumped at the chance to return to his job after the owner asked him to return. “You burn your duff off sitting at the house,” said McLaughlin. “I stood out there on my deck and said to my wife, ‘I wonder

what I can do. I can’t play golf every day,’ and honest to God, John (Sullivan) called me the next day and says, ‘Dick, you want to come back to work?’ I says, ‘Yeah,’” McLaughlin recalled with a chuckle. He said he loves his job as it allows him the opportunity to take care of people in their hour of need. “Just taking care of people when they are in so much trouble mentally, usually, and just taking care of them … it just catches you when you did something satisfactory. You want to stay,” said McLaughlin. “You’re helping people get through a bad time, you know, and it’s just really a good thing.” According to McLaughlin, his job also helps him retain a youthful mentality, and he enjoys the company of “young” people. He said he is only as old as the person he is with. “When I’m with you, I’m your age. When I’m with her, I’m her age. I don’t get any older than what you are, you know,” said McLaughlin. “And there’s a lot of young people working here.” “Love what you’re doing,” McLaughlin said he would advise others. “If you love what you’re doing and helping people, it’s a big See WORKING on page 24A

And they always remember you.” Mclaughlin attributes his longevity to “the Good Lord.” He said he has survived World War II, when he served in the U.S. Army for three years as a court reporter from 1943-1945 in Japan and the South Pacific. He left with the rank of corporal. He said he has also survived cancer, a heart attack, and a stroke. McLaughlin said his family thinks he has worked enough. However, he said he completely disagrees. He said he doesn’t know what he’d do without his job. He says having a job allows seniors such as himself to stay busy and keep out of trouble. Mike Lope, the co-owner of Wm Sullivan & Son Funeral Directors, describes McLaughlin as “unbelievable.” Lope said McLaughlin has worked with every funeral director and owner of Sullivan & Son — including his great-grandfather, who founded the business in 1906 — and is well known in the industry. “It starts with his character,” said Lope. “He has always put families first. So, in this line of work you have to be good with the rest of the staff, but he’d always put the families and the community first. When you have that person, you don’t want to lose them. Around the building, it’s his sense of humor, embracing the rest of the staff sort of like family. … He’s just a special guy. He always has been. He’s been a mentor to all the younger people. He’s always been good at what he does from the funeral director side, but also management and making sure that the staff under-

stands what they’re doing. It’s always good to have him around, and we’ll keep him around as long as he wants to be here.” According to Lope, McLaughlin has always said that without the job, he doesn’t know if he’d still be alive. Lope said he believes that having the job keeps McLaughlin alive and keeps him going as it gives him something to do. “It’s kept him really sharp. Coming in to work and putting a suit on and being with individuals out in the community on funerals, meeting with them for their needs. And he’s just sort of like a perfect example of the fact that you don’t have to stop working. You can keep working and do it on your terms,” said Lope. Mclaughlin is not the only one working well into his golden years. James Huntley Sr., 80, of Roseville, continues to work as a machine repairman at Avon Machining in Shelby Township, even after suffering a heart attack on the job in November. “I just love working. I love the people I work with, work for. They treat me fine. … I just love coming to work,” Huntley said. “I was home for them 10 weeks. I could tell you every car and what time of day that was coming up and down the street, because I couldn’t do nothing. It was crazy. I can’t shovel snow. I can’t cut grass. I can’t cut branches down. I can’t do anything. So, in 79 years I have been working with these hands. Still got all 10 fingers. But I can’t stop working.” Huntley recalled that his doctor had wanted him to retire after the heart attack, but Huntley told him no. They compromised on 24 hours a week, but after working four weeks at part-time hours, he insisted that his doctor let him return to full-time duties, and

Claiming his fourth-place finish was a “fraud” against the people of Warren, Kabacinski wrote in his complaint, “(This) Constitutes a criminal fraud that has been perpetuated upon the good and decent people in the 5th Council District for the city of Warren by having ineligible and unqualified candidates voted upon the primary election ballot.” From the online background checks Kabacinski claimed he conducted, he said neither Newnan nor Tringali were eligible to run due to their alleged lack of Warren residency. Jackson, according to Kabacinski, was ineligible because he is a current member of the Warren Crime Commission. Both Newnan and Tringali maintained they are longtime Warren residents. Jackson said he would have resigned from the Crime Commission if elected to the City Council, according to the requirements of the city charter. According to the court, Kabacinski had a hearing scheduled before the Warren Elec-

tion Commission that was canceled by a tribunal on May 26. “Kabacinski did not attach a final decision or order to his complaint,” said the judge in his opinion and order. Appearing in court by video, Kabacinski represented himself. According to the judge, the laws Kabacinski cited to support his case were not applicable. This included housing law cases and laws governing actions seeking superintending control. “Eddie had served me a case, but he had not notified me in any way, shape or form of when the hearing was, which is a procedural no-no in suing people,” said Newnan. “My lawyers and I were the only ones actually present (in the courtroom).” The court listened to the Kabacinski case but found little legal merit. “Kabacinski does not seek such relief; rather, he appears to be a candidate for reelection dissatisfied with the Aug. 9, 2023, primary election results,” said Biernat. “Kabacinski is attempting to use a legal forum to address political grievances, and his complaint is therefore dismissed based on lack of compliance with the procedural and substantive rules under MCR (Michigan Court Rule) 3.302,” Biernat ruled. Senior fair coming to Lorenzo Center

MACOMB COUNTY — The 32nd annual Macomb County Senior Fun Festival will be held at the Lorenzo Cultural Center at Macomb Community College on Friday, Sept. 9, from 9 a.m. to noon. Emceed by Macomb County Executive Mark Hackel, the free event will feature vendors, giveaways, live entertainment, a photo booth and refreshments. “We look forward to the Senior Fun Fest every year,” Hackel said in a statement. “This event illustrates our county’s commitment to engaging and caring for seniors. County pulls lake ‘muck’ for testing

MACOMB COUNTY — A second round of samples of the algae formerly known as lyngbya have been pulled from Lake St. Clair for lab testing. Samples of Microseira wollei are being sent from Harrison Township to a U.S. Army Corps of Engineers research facility in Mississippi to undergo testing as part of a two-year study of the mysterious algae. These recent samples will be tested against samples taken

from the early summer. “This muck is found in areas of the shoreline where the water flow is stagnant,” Macomb County Public Works Commissioner Candice Miller said in a statement. “There are a number of boat wells along Lake St. Clair where this stuff is just packed in, or you

see it in different areas right along the shore where there are layers of it.” Studying Microseira wollei will help officials understand the causes of the algae, what threats it poses to life around the water and what steps can be taken for effective management.

he now works 40 hours a week. Huntley’s advice to workers is to find a career they enjoy. According to Melissa Brown, of Avon Machining, the company offers phased retirement. Phased retirement allows retirement-age employees the opportunity to create a schedule that they want to adhere to. She said this enables the employees to work while technically retired, allowing them to earn extra money while mentoring younger employees. However, she said those who partake in the program don’t typically work 40 hours a week. Brown described Huntely as the hardest working person at the company. “Oh my gosh, he never ever stops moving from the time he gets here,” she said. “He is always working. He is always finding something to do.” “Jimmy outworks anybody in this place. Anybody,” said John Binkowski, a machinist who works on Huntely’s team. “He outworks our 20-year-olds,” added Brown. “Except me. He busts my tail, let me tell you. And I love it, cause the days go by fast, but he doesn’t stop. He’s a go-getter, and he loves this job. He’s ornery, funny and very hard working,” said Binkowski. Both Huntley and McLaughlin still drive themselves to and from work, which for both men is an approximately 45-minute commute. They both joked that they continued to work because they are/were married, as they spoke of their wives with found regard. According to Lope, it is quite common in the funeral industry to hire seniors for positions such as funeral assistant. In fact, he said, they actually solicit seniors for the positions, because of their experience and connections in the community, and willingness to be flexible with schedules. He said the assistants usually work 10 to 20 hours per week. Lope said that it has proved to be beneficial for both the seniors and the funeral home because of the flexibility offered and needed by the positions. “We do get some seniors coming to work with us because of the flexibility, the hours,” said Lope. “We’re very flexible as far as when people want to be here and how much time they want to spend here. … It is something that I think has worked out well. It is one of those things that people say is mutually beneficial.” He said that between the two Sullivan & Son locations, in Royal Oak and Utica,

they currently have close to a dozen employees over the age of 65, and while a few — including his father, his uncle and McLaughlin — are actually funeral directors, many have come into the industry as a second career. Often, the seniors are retired firefighters, police officers, nurses, pastors, etc. Lope said they often find their senior employees through their community connections with schools, churches and events. He said that, generally, someone will simply tell them they are interested in some extra work, and they don’t typically have to advertise for the positions. According to Lope, funeral assistants are critical to their organization, doing things such as helping to direct people to where they need to go, and assisting families during visitations and other tasks during funeral services, such as bringing flowers or caskets into the parlor, church or cemetery. “We always look for folks that are good in the community and understand what we’re doing and trying to do,” said Lope. “Most of them are, I would guess, late 60s to mid 70s. So, somewhere between 65 and 80, but still super useful in the fact that they’re all very sharp communicators and able to do what they need to do. … Over the years they’ve been a group of people we look to hire. They’ve been very helpful. … They become very polished and very understanding of what families need and what their expectations are and what funeral service is all about. It’s been a great fit for us. … It’s really kind of a cool gig for a lot of the seniors that work with us.” Binkowski summed up some of the admiration: “Just that they’re that age and they’re still sharp, when I forgot my keys coming in.”
