Chapter 1: Introductory Provisions

CHAPTER ONE: Introductory Provisions A) Applicability. 1. This ordinance shall apply to all incorporated land within the City of Charlestown. B) Purpose. The purpose of this ordinance is to guide development within Charlestown. 1. The regulations established for the administration of a Zoning Ordinance under IC-36-7-4 are covered by all Chapters of this ordinance. C) Intent. The intent of this ordinance is to promote the public health, safety, morals and general welfare and more specifically to: 1. Accomplish the purposed of IC 36-7-4; and further such other purposes are stated hereinafter within specific provisions of this ordinance; 2. Guide the orderly, responsible, and sustainable development and redevelopment in accordance with the City of Charlestown Comprehensive Plan and all of its components; 3. Define the powers and duties of administrative officers and bodies as provided herein, and to establish procedures for the implementation and enforcements of this ordinance; 4. Prevent the pollution of air, water, and soil; 5. Protect the character and stability of residential, institutional, business, industrial, and natural areas; 6. Encourage compatibility between different land uses and to protect the scale and character of existing development from the encroachment of incompatible uses; 7. Facilitate the adequate provision of transportation, water, sewage, schools, parks, and other public facilities; and 8. Establish corrective and punitive recourse for violations or noncompliance regarding the provisions of this ordinance. D) Repeal. All other prior ordinances or parts of prior ordinances in conflict with the provisions of this ordinance are hereby repealed upon its passage. E) Effective Date. This ordinance shall be in full force and effect from and after its passage, approval and any publications required by law. F) Sections Adopted Separately. The sections, paragraphs, sentences, clauses, phrases and words of this ordinance are separable, and if any word, phrase, clause, sentence, paragraph, provision or section of this ordinance shall be declared unconstitutional, invalid or unenforceable by the valid judgement or decree of a court of competent jurisdiction, such unconstitutionality, invalidity or unenforceability shall be affect any of the remaining words, phrases, clauses, sentences, paragraphs, provisions, and sections of this ordinance.
