Task 1 A. Based upon the specific health and social care problem identified in your chosen organisation formulate a Research Proposal, outlining the specific objectives that need to be addresses in the Research Proposal form. Research Proposal Research Title: Legislation and Its Impact on the Service Users in the Hospital Research Question: How the legislations impact the service users in the hospital? Do legislations promote the rights of the service users of health and social care? Introduction:
The Health and Social care sector is spread widely and it is gaining importance with the changing environment. There are many policies, procedures and legislations in the health and social care which have its impact on the service users too. (Government, 2008) As a health and senior social care consultant, this research is conducted to know that how the legislations impact the service users in the hospitals. Legislations refer to the laws which aims at regulating the hospitals or any other organisation so that the rights of the service users can be protected and their benefits can be maximized. (excellence, 2015) Legislations guides the workers in the hospitals, the service providers that how they should treat the patients and other service users so that they feel empowered and protected. There are certain legislations made in the health and social care sector to provide the guidance to work which are The Human Rights Act, (1988), Care standards Act (2000), Data Protection Act, etc. (Commission c. Q., 2015) The Human Rights Act, (1988) fights for the rights, equality and dignity of the service users and the service users get the right to complain if they are not satisfied with nay service provided in the hospital. Care standards Act (2000) aims at empowering the service users by providing the guidance to the doctors, patients, care workers, etc. The activities here are undertaken to empower the service users. (Commission C. Q., 2015) The Data Protection Act aims at maintaining the privacy and security of the data of the service users. Certain principles are also followed so that the Data Protection Act is not breached. All the data of the service users are used for the required purposes and not for unnecessary purposes, the data is accessed by the authorized person only and not everyone. (Commission c. Q., 2015) Legislations protect the Health and Social care service users and their interests. If proper legislations are followed, the service users will get proper respect, proper attention will be given to each service user, service users will feel respected and dignified, there will be a sound communication between the service providers and service users and the loopholes can be minimized then. A positive environment will be established in the hospital and the patients will feel secure. (Commision, 2015) Aim: The main aim of the research is to discuss the legislations in the Health Social Care sector which have a great impact on the service users in the hospital and also how the legislations promote and maximize the rights of the service users in the hospital.
