haron Fairley was appointed as the new chief administrator of the Independent Police Review Authority (IPRA) in December 2015 in the wake of the botched handling of the Laquan McDonald case by the Chicago Police Department, the State’s Attorney’s Office, the Mayor’s Office and IPRA.
IPRA itself was created – or at least given a new name after previously having been the Office of Professional Standards (OPS) – in 2007 after the botched handling of the Anthony Abbatte case by the Chicago Police Department, the State’s Attorney’s Office, the Mayor’s Office and IPRA’s predecessor OPS. Anthony Abbatte was the Chicago police officer whose brutal drunken pummeling of a female bartender was caught on tape, like Laquan McDonald, and viewed around the world. Abbatte was found guilty of felony battery and eventually fired. The bartender sued the Chicago police department for mishandling the investigation and a federal jury agreed with her in 2012, when it found the department guilty of a cover up of the crime and of honoring a code of silence in which officers turn a blind eye towards or try to cover up the misdeeds of other officers. After that federal verdict, Mayor Emanuel’s office issued a statement saying that then Supt. Garry McCarthy would not “approve of or participate in a code of silence” and if that there was indeed such a thing, that “McCarthy and his team will deal with that.” The Abbatte debacle in February 2007 led to the resignation of then Police Supt. Phil Cline in April 2007. That summer, the City Council voted to abolish OPS – with the approval of Mayor Richard Daley – and form IPRA. OPS had long been connected with the police department; IPRA was meant to be a separate entity that would investigate cases of misconduct “independent” of the police. IPRA was headed initially by Illana Rosenzweig, an attorney who monitored the Los Angeles Sheriff’s Office at L.A.’s Office of Independent Review. She resigned as head of IPRA in 2013 after her husband accepted a job in Singapore, and was replaced by a former Drug Enforcement Administration agent named Scott Ando.

Not A Pretty Picture
Her initial evaluation of IPRA after taking over? “Well, there was a lot going on there that was pretty messed up, to be honest with you,” Fairley bluntly began. “The place was really run without a lot of checks and balances. It was run just kinda by seat of the pants. There wasn’t a lot of deep, strategic thinking about planning and procedures and policies and organizational stuff that you need when you’re running a complex organization that does complex work like that. “It was shocking. Everyday I was going, ‘Oh my God, why wouldn’t they have done this or that?’ The bad news is that there’s a lot that needs to be fixed. The good news is that it’s just not that complicated as to how to fix it.” Fairly called the immediate first fixes basic block-andtackle structural things – “good management principles that needed to be put in place that weren’t there,” she said. “Specific policies were not in place so that things should run consistently the same way all the time. Rules and procedures that have to be followed to make sure everybody is doing things the same way and the right way all the time – that was a problem.” Fairley has updated the agency’s policies and procedures related to its response to officer-involved shooting incidents. Additional personnel will allow IPRA to more effectively conduct a canvas of the neighborhood for witnesses or additional evidence such as video footage. She also identified an Ethics Officer internally to be available to any IPRA employee who may feel that what
they are being asked to do during the course of their work is unethical or improper. Fairley has implemented a laundry list of quality control measures, performance evaluations, etc. in her first 100 days. She notes that they did exist before she arrived, “but I felt that they were terrible, so I redid them,” she said. “The performance evaluations in particular. I wanted the performance evaluations to reflect the values that I think are important – timeliness, independence, integrity and all that is reflected in the program we have put in place. “We wanted to make each investigator personally accountable for the timeliness of their work. That is a piece that wasn’t there that I think was important to put in.” Having said that, Fairley notes that the people who work at IPRA are “really very demonstrably committed to the mission of accountability.” www.chicagodefender.com
FRONT PAGE JUMP IPRA has about 97 people when fully staffed and are down by eight or 10 people at the moment, Fairley said. There are about 65 people on the investigative staff, half of whom are Black, around 11 percent Hispanic, and most of the rest White. IPRA’s basic work deal is to take in all the complaints against Chicago police department officers, and it gets thousands of complaints a year, according to Fairley. IPRA then investigates the ones that fall within its jurisdiction and passes back the complaints that don’t to the Internal Affairs Department to be investigated. One of the reasons so many of the complaints have previously gone unsubstantiated, Fairley said, was that “the process (investigators) were told to follow resulted in that bias.” She said the agency looked at things very narrowly in misconduct charges and used the Laquan McDonald case as an example. The investigators “looked at the shooting, but did they pay enough attention to all the reports?” Fairley said. “What I find is that by and large, they would have an allegation, but there was no systemic approach towards looking at an incident holistically. “Now, we’re not only going to look at the shooting as to whether the shooting officer did the right thing, but look at all of his conduct from when he showed up, to when the shooting occurred, to the evidence that was collected afterward. “I’m going to look beyond just the guy who fired his gun.
“That’s inappropriate. That’s the whole point about these things. You are going to have these two competing narratives and you do have to weigh the evidence to see if you can find a way to support one versus the other. “Going forward, I’m training them on the right ways to evaluate these cases and giving them the correct tools to use and putting the policies and procedures in place to broaden the scope of what they’re analyzing. You’re going to see more in the way of good oversight.”
I’m going to look at all the other witness officers, look at whether what they did was appropriate when they showed up. Were their reports accurate? Was there any indication that they’ve been doing a coverup? “I’m going to look at when the 911 call came in to dispatch. I’m looking at the whole system and I don’t think that was done systematically before. You had people that were only looking at one little piece of the puzzle, so that’s why they’re not sustaining these cases.” Another problem, Fairley noted, was that the way IPRA analyzed cases was not the way she talks about doing it going forward. “If you didn’t have an independent witness to corroborate one narrative over another, they would just go, well, we can’t sustain that case; I’m out,” Fairley said.
and then especially at the end, when it’s most important – on the analysis where the agency arrives at its conclusion about whether the police officer committed misconduct or not.” Fairley is also commissioning an outside law firm to audit past officer-involved shooting closed cases to assess the quality of the agency’s investigative process and the accuracy of the findings and outcomes, “so they can be fixed going forward,” Fairley says. “No matter what happens to IPRA, that learning is going to be important to whatever body undertakes civilian oversight of the Chicago police department. We’re going to have to follow some policies and procedures, so this analysis is going to be valuable for that.”
Stronger Attorney Oversight
Fairley’s very first move was adding that oversight, even before putting in what she considered the rudimentary quality control measures. First, she installed more legal oversight of the investigative process by building out IPRA’s legal team. She hired a supervising lawyer and replaced the general counsel who resigned in December. “I felt strongly that the goal should be to have attorneys assigned from start to finish on the important cases because the legal landscape that these investigations take place in is really complicated,” Fairley explained. “It involves collective bargaining agreements, federal criminal law, state criminal law, municipal codes, all the CPD directives – and the way those things interact can be confusing and non-intuitive. “So rather than having investigators trying to figure this out by themselves, I want to have a lawyer assigned to work with them, to set the investigator’s strategy from the start, to work with them to identify legal issues throughout,

After the uproar following the 2007 barroom assault of a female bartender by Chicago policeman Anthony Abbate, who was subsequently convicted of felony battery and fired, Mayor Richard Daley replaced the Office of Professional Standards with the Independent Police Review Authority (IPRA). The court-ordered release of the video showing the brutal police killing of Laquan McDonald sparked citywide outrage and demonstrations that were broadcast nationwide. Subsequently, Mayor Rahm Emanuel fired Police Superintendent Garry McCarthy and Scott Ando, then head of IPRA, and appointed Attorney Sharon Fairley to the job. Attorney Fairley’s specific assignment from the mayor was to clean up the agency and allow it to re-gain the trust of the community. Chicago’s citizens as a whole and Black citizens in particular have little or no trust in the ability of IPRA to produce justice in the hundreds of cases of police shootings, killings, and use of excessive force of Blacks. Thus, the first thing that Attorney Fairley did after her appointment was to turn over the Laquan McDonald case to outside lawyers for investigation.
Reporting requirements are clearly spelled out, including annual audits of activities and reports to the public on all investigations.

“This ensures that the process to file police misconduct complaints is simple, widely accessible and safe, and requires a process through which community members can provide real time feedback to the Monitor investigative process,” states her Summary and Analysis. When asked about the probability of its passage in City Council, Hairston said, “I have the support of the Black Caucus and I am working to gain the support of all of the other caucuses in the council. Keep in mind that this is a citywide issue that effects the citizens all over the city.” As for the question of who could possibly head up such an agency, Hairston stated, “Ms. Fairley is well qualified, she is smart and we want to do the right thing. Therefore, I think that she would make a good pick for this job. “Remember that she graduated from the University of Chicago Law School and was a student of Professor Craig Futterman, who assisted me in constructing this ordinance, along with Professor Shelia Bedi from the Northwestern University Law School.

Aside from the poor record of non-sustained complaints, the biggest knock on IPRA has been why the investigations take so long – two years and longer. Fairley’s simple answer is: “Because it’s crazy. I’m telling you. Like I said, there are structural reasons that these things went that way.” One of the big culprits is a policy reason, she said, whereby an administrator would table an administrative investigation in favor of a criminal investigation. “In other words,” Fairley explained, “they would just put the brakes on the disciplinary aspect of the investigation if the State’s Attorney’s Office was still looking at the case. So cases just went untouched for months at a time by IPRA because they hadn’t gotten a declination from the State’s Attorney’s Office. “No one was picking up the phone going, ‘Hey Anita (Alvarez), like what’s going on with that case? Are you going to finish it soon, or what?’ That kind of communication wasn’t happening and they had this hard and fast rule.” Fairley says they don’t have that hard and fast rule anymore and that IPRA also has a more ongoing dialogue with the State’s Attorney’s Office. “We’re having monthly meetings about the cases that we share, so that we can’t have what happened with Laquan McDonald – where IPRA was going, ‘Well the ball was in her court,’ and Anita was going, ‘Well IPRA screwed up because they dragged on blah blah blah.’ I don’t want that to happen anymore.” To that end, Fairley said she is so optimistic about having a “much more collaborative and cooperative type of interaction between the two agencies” once the new State’s Attorney, most likely Kim Foxx, takes office. She feels similarly about new police superintendent Eddie Johnson. I think he’s great!” Fairley said. “I have nothing but good things to say about him and I really look forward to working with him. “I had a very productive, collaborative relationship with First Deputy John Escalante, so I’m glad to see him still in a position of leadership. I found him to be a very thoughtful man and open to feedback. I’m very optimistic about being able to work with the both of them. “But I will say that I won’t be doing my job if my relationship with the police department is always just hunky-dory. It’s not going to be like that all the time, but it has to be collaborative and cooperative and there are things that I think we can all work on together.” www.chicagodefender.com
Her take on the Fraternal Order of Police is not as rosy, however. “The FOP is a big thorn in my side,” she conceded. “They don’t like even the concept of civilian oversight, but I don’t really care. We’re going to do everything that we can to put the pressure on them. “The reality is that the Department of Justice investigation is not going to stand for some of the gobblety-gook that is in their contract agreements right now. So FOP can get dragged kicking and screaming to the table about it, but at the end of the day, there is some stuff in those contracts that is just plain stupid and is going to have to go.
“There are talented, committed people here who deserve the chance to show what they can do under new leadership.”
“And still, I could work with the FOP if they weren’t being so bullheaded,” she adds. “There are things we agree on – like the need for additional training. I know that’s an important value to them as it is to me. So why wouldn’t we collaborate on that? That could be very productive.”
T raining And Experience
Fairley was born in Washington D.C. and grew up in Silver Springs, Maryland, raised by two civil servants both in education. Her dad was a teacher at first, then got into administration at the federal level. He was part of the team for the U.S. Dept. of Health, Education and Welfare that went into the South to desegregate schools in the 1960s. Her mom was first a teacher and then a principal in Montgomery County, Maryland. Fairley graduated from Princeton in New Jersey, then got her MBA from the Wharton School in Pennsylvania
before moving to New York for a 20year business career in marketing. She moved to Chicago 12 years ago to attend law school at the University of Chicago, fell in love with criminal law, interned at the U.S. Attorney’s Office, worked briefly for Lisa Madigan’s office in criminal appeals, and then was a federal prosecutor for eight years. Last winter, Fairley got an offer she couldn’t refuse from the Inspector General to come over to a new position that he was creating as First Deputy and General Counsel, and that was how she began working for the city. She was only there for a few months before getting a call from the mayor’s office asking if she would consider taking the job as the Chief Administrator of IPRA. During her time in Chicago, Fairley married Ariel Capital founder John Rogers. They separated in 2008 and divorced in February of 2015. She says she’s pretty sure she met Rahm Emanuel even before he became mayor, through her relationship with John Rogers. “But I don’t know him well,” Fairley said of Emanuel. “You can probably count on both hands the number of times I’ve seen him in the 12 years that I’ve been here before my appointment to IPRA.” Even now, she says that she’s only met with Rahm once since taking the IPRA job, though she does talk with his office about basic realities such as budget issues. “But I don’t feel the pressure that I think a lot of people assume that I’m getting just because he appointed me,” she offered. “It was a shocker when the initial job invitation came,” Fairley recalled. “My initial reaction was, ‘Oh, hell no,’ because I knew IPRA was messed up and I was worried that it was just a recipe for failure. “I didn’t know if anybody could do the job. I had zero political experience. I’m a federal prosecutor. All I cared about was making cases, figuring out who did the crime and then trying to prosecute them.” Fairley said that once she got over the fear of failure, she thought that maybe she could be the one to do the job. “I have a really fairly unique combination of legal skills and managerial skills of 28 years, and I knew that the job needed both,” she said. After 100 days with IPRA, Fairley concedes, “There’s still a lot of struggle to get people aligned and focused on the right things and trained to do the right things, but we’re working towards that, and I hope the bigger, more problematic things aren’t going on anymore. “The piece that I think was really missing before is that IPRA is actually supposed to make policy recommendations to the police department and I can’t find any record of that having
been done under the prior administration. “That I think is the biggest opportunity going forward in terms of IPRA’s ability to make change and be a positive influence in the landscape of police accountability for the city. “We take in all the complaints about police officers and we conduct the most serious of the investigations of misconduct, so we have this wealth of institutional knowledge about what’s going on out there in the world where the police officer is – what they’re doing well, what they’re not doing well. “We’ve been sitting on this information, but in the future, we can mine it and use it to drive policy to create change with the department.”
Even after only 100 days, Fairley thinks that if her regime is given a chance, people will see a very, very different IPRA come about. “I know that based on its history, people think IPRA is terrible and that they’re going to make a complaint and it’s going to go into a big black hole and nothing’s going to happen,” said Fairley, who intends to form an IPRA Community Council to provide feedback to the agency. “But there are talented, committed people here who deserve the chance to show what they can do under new leadership – when they’re given the right tools and the right policies and procedures to follow so that they can do the work in the way that it’s supposed to be done.”

Defender Staff Writer On October 28, 2015, the Chicago Defender published a story on tenants rights and landlord retaliation. The story was about Tenant X, who lived at 6650 South University Avenue in Woodlawn and rented from the 6650 SUA LLC, which was managed by Ebko Inc.
“The complaints in our database have been in regards to repair issues,” Truss-Miller said. “This could include extermination and addressing normal wear and tear.”
Tenant X, who paid their rent on time and sometimes in advance, had noticed a rodent problem that began to grow over time. They reached out to the management company on several occasions to correct the problem, with the last notice to management occurring weeks before it was time to renew their lease in mid-summer 2015. A representative from management had agreed to renew the lease, according to Tenant X, and to exterminate the unit, according to documents provided to the Chicago Defender. However, when it came time to sign the new agreement, Tenant X was caught off-guard when management decided not to renew their lease. Without a renewed lease, Tenant X was forced to move in less than 35 days. Feeling as though they had been retaliated against, Tenant X hired an attorney who filed suit against the former landlord under the CRLTO, Section 5-12-150. This section of the Landlord Tenant Ordinance prohibits landlords from retaliating against tenants who request that the landlord perform due diligence and make repairs or address issues according to the terms of their lease or the CRTLO. Tenant X’s attorney, Aaron Rifkind, of Rifkind Patrick LLC, initially filed suit on August 24, 2015. The case has been going through pre-trial motions, but on Friday April 8, Judge Murphy-Gorman ruled against the Defendant’s Motion to Dismiss and ordered both sides to come to a settlement before going to trial. What was significant about Judge Murphy-Gorman’s ruling was the inclusion of an adjacent parking lot to the property as part of Tenant X’s lease. Under the

He said his attorney advised him that there was a likelihood that could happen. Coleman said, “Why are we going to DuPage County? But we don’t control the system and had nothing to say about where they were going to hold (a trial).” He said that in conversations with both white Republican and Democrat friends, they all said that suburban residents would be more empathetic to law enforcement. In his opinion, he felt his son would just be another Black person gone.
Defender Senior Staff Writer Philip Coleman was taken into police custody on December 12, 2012 when Chicago police were called to his family’s West Pullman home after the 38-year-old, University of Chicago political science graduate tried to attack his mother. His erratic behavior led to his arrest and videotape shows that while in custody, six police officers entered Philip Coleman’s jail cell and repeatedly tasered, choked and dragged him until he was unconscious. At a hospital, Coleman died from the injuries he endured from the abuse, but no charges were filed against the officers involved in the jail cell incident. Two weeks ago, an announcement was made that Coleman’s family and the city agreed on a monetary settlement over Philip’s death. Philip’s father Percy Coleman sat with the Chicago Defender recently for an exclusive interview to discuss the decision behind the settlement and how the family will move forward in preserving his son’s legacy as a community advocate.
Pattern Of Misconduct
The City of Chicago has had numerous lawsuits filed against it in police misconduct cases – some of the biggest settlements have stemmed from the torture and abuse cases of former Chicago police commander Jon Burge and his team, including $34.3 million in 2013. The city has paid over $59.2 million since 2014 in settlement awards to victims of violence at the hands of police officers. In the case of fallen victim Rekia Boyd, who was shot and killed by Chicago police officer Dante Servin in 2012, the officer was cleared of all charges when a judge determined that Servin should maybe have been charged with first-degree murder instead of involuntary manslaughter. Similar cases like Ms. Boyd’s have come under public protest as police officers are protected by the union contract set forth by the Fraternal Order of Police. The backlog of cases has continued to sit dormant for victims whose families have tried to get justice for their loved one’s murder. The fuel to this fire was sparked when a Cook County Circuit Court judge last November ordered the City of Chicago to release the police dashcam of 17-year-old Laquan McDonald being shot 16 times execution-style by Chicago police officer Jason Van Dyke. Many questions were raised as Chicago residents shared their outrage and the country was once again faced with the reality of racism and modern day lynching taking place in urban cities across www.chicagodefender.com

Keeping His Legacy Alive
The Coleman family is determined to keep Philip’s legacy alive by establishing the Coleman Oliver Foundation. HOSPICE, a program that his son Philip led, included other educators and ministers traveling to Africa a few years ago. Earning his degree in Political Science and later his MBA in Public Health from U of C, he built an extended network of friends beyond the United States. The foundation is determined to continue Philip’s mission in helping others and building independent empowerment within the African-American community. One of the goals of the organization is to encourage one million people to join by signing up for a yearly paid membership. “That is what he was trying to put together,” Percy Coleman said. “The ability to get one million concerned residents worried about the South and West Sides of Chicago. “We can create our own jobs and instead of people like the Governor and Madigan fighting over which

Not missing a beat, Coleman answered, “The first step is a paid, elective, civilian oversight commission for the CPD. That would scare half of them out of the county if they knew the safeguards that the union contract had put in place for them would no longer be of any value. “If there’s an outside group who’s got the experience, the knowledge and the skills to investigate, you don’t need IPRA. All of that stuff that’s under one person’s control is now gone. “Once that’s gone, you’ll have other police officers standing up and speaking up if they know they have a true ‘whistle blower’ if we can do our own investigations and do them in a timely and professional manner.” Coleman added, “We should stop allowing folks – Black and White – to tell us what’s best for us if we don’t have input into the process. Why aren’t we involved in your decision-making? Why don’t you advocate for a paid, elected and civilian oversight commission for the Chicago Police Department?” With the newly formed Coleman-Oliver Foundation, the family, along with close advisors, faith leaders, legislators and Black media partners, are working to host a citywide day of workshops, lectures and panel discussions in mid-June. The family feels this is one form of healing from their tragic loss, but they are also adamant that the problem of police misconduct is much bigger than the loss of a child. “I think that if Black lives matter, all of these folks that have died in Chicago could not have died in vain. This just can’t be something in and out of the news in three or four days and we go back to business as usual. We cannot continue to accept the illusion of the conclusion,” Coleman said.

After graduating from Curie High School on the Southwest Side, she attended the Fashion Institute of Technology in New York, whose notable alumni include Calvin Klein, Carolina Herrera, and Michael Kors. Dunn pursued fashion merchandising as her major and entered into an internship at Rocawear under the watchful eye of owners Damon Dash and Jay-Z. After graduation, Dominique never looked back as she eventually worked for the company as the national merchandising director. Dunn says, “During that time, I traveled extensively and basically lived out of a suitcase. It required a lot of eating on the run. So as I traveled, though I was not sick, I did notice that something was missing.” Dominique began reading about her health and discovered that her overall well being was directly related to her diet. “I was interested in functioning at my optimum health,” she says. Detox Tea There are several brands of detox tea on the market that you can drink at any time during the day. Just make sure that you observe and follow the directions. Learning to love what I have, when it comes to material objects and food ingredients has helped me adjust to many inconveniences, including being a devoted Gulf shrimp lover living far away from the coast in Chicago. I learned to love tender Gulf Coast shrimp from our family celebrations in Mobile and New Orleans, and the pink, sweet crustaceans will always be my first choice. In Chicago, I keep a pound of best-quality frozen shrimp from Argentina in the freezer for my shrimp emergencies. And yes, when you’re as much of a shrimp lover as I, shrimp emergencies pop up more quickly than you think.

1 tablespoon sweet paprika 1/2 teaspoon each: garlic powder, onion powder, ground thyme, ground cumin, salt 1/4 teaspoon each: ground oregano, celery seed Freshly ground pepper, to taste 2 tablespoon Dijon-style mustard 2 teaspoons balsamic vinegar 1 pound uncooked large shrimp, peeled deveined, thawed if frozen 1 avocado, cut into wedges for serving, optional
Heat oven to 450 degrees. Combine the paprika, garlic powder, onion powder, thyme, cumin salt, oregano, celery seed and ground pepper in a small bowl; set aside. Whisk the mustard and vinegar together in a large bowl; add the shrimp. Using your hands, toss to coat the shrimp with the mustard mixture. Add the seasonings; continue tossing. Transfer the shrimp to a foil covered pan that has been coated with olive oil. Roast shrimp, turning as needed with tongs, until pink and cooked through, about ten minutes.
Transfer to appetizer plates lined with avocado wedges, if using. Serve with prepared spicy sauces. Makes four servings. NNPA National News Managing Editor In an effort to provide student journalists with a unique experience working in the Black Press, the National Newspaper Publishers Association (NNPA), teamed with Chevrolet and the School of Communications at Howard University to launch an innovative journalism fellowship program.
She said that the experience will open the doors to new pathways of opportunity for student journalists and communicators in a 24-7 digital environment and that the stories that the students will report on from Washington, D.C. to Atlanta, to Chicago, to Detroit “will provide insight into the lived experiences of the people in those communities working, living, and acting to make their lives better.”
The program titled, “Discover The Unexpected” (DTU), will feature internships at four NNPA member publications for eight Howard University students. The journalism fellows that are selected for the program will receive stipends and also have access to a 2016 Chevrolet Malibu to commute between their local newsrooms and their assignments. The Michigan Chronicle, the Chicago Defender, The Washington Informer, The Atlanta Voice, were selected as participating publications for the first round of internships and legendary hiphop pioneer MC Lyte will serve as the national spokesperson for the program. MC Lyte said that she entered into the music business not only to have a voice, but also to inspire people to be unique and to stand up for what they believed in. The hip-hop icon, who is known for her storytelling prowess, said that she wanted the journalism students to have the opportunity to tell stories that mattered and that have the capacity to change lives.
