Defender Contributing Writer Videoed murders by cops are the apex of what happens to African Americans victimized by law enforcement, of course, but what happened to Stanley Stallworth is a far more common and insidious threat to Black men who are regularly pitched into the grinding gears of the criminal justice machine. Since the winter holidays of 2013, Stallworth has lived a Kafkaesque existence – “two years of hell; a nightmare for myself and my family, full of fear and outrage,” as he puts it. After more than 20 years as a prominent civic figure and real estate attorney and one of the few Black partners in the major law firm of Sidley Austin, Stallworth’s life, career and world were hijacked two years ago when Cook County State’s Attorney Anita Alvarez’s Office charged him and an associate with a Thanksgiving Day felony sexual assault on an 18-yearold male. The accuser claimed that he blacked out after consuming less than two drinks at the South Side home of Stallworth and when he awoke, Stallworth and his friend Therrie Miller were performing sex acts on him. Stallworth and Miller were both found not guilty of the charges last week by Cook County Circuit Court Judge Clayton Crane in a three-day bench trial, but that doesn’t erase the damage already done. “The decision does not restore my life to what it was before these charges were brought,” Stallworth said after the trial. “It does not restore what I spent a lifetime building for myself.” He contends that the charges should never have been brought and that it was a false and malicious prosecution by Alvarez’s office. “We should not live in a society where anyone for any reason can walk into a police station and ruin someone’s life,” Stallworth asserts. “And the Cook County prosecutor simply took the word of someone despite overwhelming testimonial and scientific evidence to the contrary.”

Building A Life And Reputation

Stallworth says the ordeal is something he never saw coming because “you try to do the right thing, and you’re looking at someone that did most of it right.” He says he had a mother that would kill you if you didn’t – “B’s were not an option,” Stallworth says. And he had a brilliant sister who graduated with a 99.8 average in high school, “so I had to work hard just to stay in range.” Now 52, Stallworth was born and raised on a farm in the small town of Evergreen, Alabama. His dad was a businessman, high school coach and principal; his mom a school librarian. He graduated from high school as the salutatorian and attended his dad’s alma mater, Alabama A&M University in Huntsville, on an academic scholarship. He was the student body president and graduated summa cum laude with degrees in biology and English and a 3.97 grade point average. Stallworth entered the University of Wisconsin Law School in 1987. His grades were good enough to propel him into the stratosphere of students who could get first year summer jobs, which is rare. He joined Sidley in 1990 and spent his entire career there, sharing a summer class at Sidley with Barack Obama along the way, and negotiating billion-dollar real estate deals while pulling down a high six-figure salary. Stallworth estimates that over the years, Sidley has had maybe 15 Black partners and at the time his

legal ordeal began, he was one of nine Black Sidley partners out of over 700 partners worldwide. Just as important as what Stallworth contributed to Sidley in his real estate practice and as a partner was what he did for the firm’s diversity efforts. He served as firm-wide co-chair of the firm’s Diversity Committee and also served on the firm’s Diversity Task Force and the Recruitment Committee. “I had to meet with Black, white, yellow, orange, lesbian, gay, transgender on Sidley’s behalf everyday, in addition to my practice,” Stallworth says. “I was the primary person to create the firm’s diversity committee. When I got there, there was a task force on minorities’ issues and women’s issues in the Chicago office and they dealt with things on an adhoc basis. “But I decided that diversity could not be a hodge-podge reactive kind of thing – that we needed strategy, long and short-term planning, goals, all of that. So in 2001, I made a hard push for a firmwide diversity committee to be created with firmwide chairs and chairs in each office, because I was flying around the country like a crazy man trying to put out diversity fires. So now they have a diversity committee.” Stallworth also started a program called the Sidley Pre-Law Scholars Initiative to help more Black students get into the field of law, particularly to help

students prepare for the LSAT. That program has been around for 11 years and served about 400 young Black law students. Outside of Sidley, Stallworth sat on the national board of the Thurgood Marshall College Fund for three years with Sidley committing $100,000 a year in scholarships to support his efforts. In addition, he sat on the board of the Chicago Academy for the Arts – Chicago’s version of the performing arts high school in Fame – for 12 years and chaired it for three. Now, all of that is gone. During the course of the two-year trial and the stain on his reputation, Stallworth resigned from the boards, and depending on who you talk to, was forced to retire from Sidley. By the time he finally went to trial, he was an unemployed Black man suffering at the hands of the criminal justice system, like all other Black men do. Stallworth’s friends say the actions of having the charges brought “interrupted a major career, a major public servant, who had done nothing but serve.”

The Botched Case Against Him

Including the three-day trial, Stallworth showed up at Criminal Court on 26th and California 22 times because of delays and continuances on the prosecutor’s part “and it cost me every time,” he says. See Stallworth, Page 07

It has been the cry of the protesters –“Change.” Last month, following the video release of Laquan McDonald’s murder by a Chicago police officer, protesters marched down the city’s Magnificent Mile on Black Friday chanting “16 shots!” while slowing down holiday retail sales on one of the busiest shopping days of the year. Black aldermen called for Chicago Police Supt. Garry McCarthy to be fired. Cook County Board President Toni Preckwinkle urged Chicago Mayor Rahm Emanuel to resign. Some Latino aldermen followed suit, as did newspaper editorial writers, television commentators, columnists and activists from around the country. The protestors asked for the resignations of McCarthy, Cook County State’s Attorney Anita Alvarez, and Emanuel. They got one when Rahm announced McCarthy’s (forced) resignation. Alvarez has continued business as usual and has reportedly said that she will not be bullied by those who intend to intimidate her. Even as Rahm dismissed McCarthy and appointed a task force to recommend new ideas for police accountability, critics said it was too late for City Hall to fix the problems alone. Illinois Attorney General Lisa Madigan asked U.S. Attorney General Loretta Lynch to launch a Justice Department civil rights investigation into the police department’s use of deadly force and the adequacy of its review of such cases. “I write to you with urgency,” Madigan said in her letter to Lynch. “Trust in the Chicago Police Department is broken, especially in communities of color in the City of Chicago.”

investigation” into the Chicago Police Department to determine whether the fatal police shooting of 17-year-old Laquan McDonald was part of a larger, widespread pattern of officers violating civil rights. “The investigation will focus on the department’s use of force,” Lynch said, “particularly if there are racial, ethnic or other disparities in officers’ use of force, and its systems of accountability.” Such deaths, many of them also caught on video, have been the driving force behind the Black Lives Matter movement over the last year and the subsequent protests, demonstrations and national discussion on urban police practices. Unfortunately for many Chicagoans, the story of McDonald’s death represented an all-too-familiar set of circumstances at home: City Hall casts the incident as police self-defense, only for the facts to bear out a much different story later on. And

even though the promise for reform has been made before, the continued abuse of excessive force seems to have continued. Two more videos exposing major incidents involving police using excessive force have surfaced. Ronald Johnson was fatally shot in the back eight days prior to Laquan McDonald’s shooting. Phillip Coleman, a man suffering from mental illness, was mishandled and manhandled while in a jail cell. He ended up dying after being tasered excessively by Chicago police. Those videos have prompted more aggressive outcries from the public. The question is, “When will this stop?”

Rahm’s “Change” Attempting to make hay with his firing of McCarthy, Emanuel also sought to push his agenda forward to reflect “change.” He announced that First Deputy Superintendent John Escalante would serve as acting superinten-

dent during a “thorough” search by the Emanuel-appointed police board, which will recommend candidates for the mayor to interview. “Now is the time for fresh eyes and new leadership to confront the challenges the department, our community, and our city are facing as we go forward,” Emanuel said. “This is not the end of the problem, but it is the beginning to the solution to the problem. There are systematic challenges that will require sustained reforms.” But Chicago’s sordid police history is once again back in the national spotlight. Serving as the backdrop: decades’ worth of police torture and wrongful conviction cases, corruption and ineffectual oversight in shootings and other excessive force actions. Time and again, the department has quickly cleared officers of allegations, only to have civil litigation later reveal video and other evidence that painted a much darker picture of police misconduct.

The task force Emanuel now has appointed to examine the department contains Chicago law enforcement veterans, including some whose time on the force concurred with controversies at the police department. Too many, in fact. It’s a case of the same system continuing even though the head has been removed. They just grow another. The public has lost all faith in a system believed to harbor and foster department officials who when necessary follow the “code of silence,” also known as “code blue,” in the department to protect their own – rogue officers not excluded. The day Emanuel announced McCarthy’s resignation, he was asked why he hadn’t sought sweeping changes in the police department as well, and only sought to address those issues after the release of the video and a week of protests. “I beg to differ with that,” Emanuel responded. “There’s a long history. We have made progress, but our work is not done.”

Holiday Killings Is real change afoot? In the wake of two fatalities at the hands of Chicago police officers over the Christmas holiday weekend, the police department is changing the way it deals with officers who are involved in shootings. Nineteen year-old Quintonio LeGrier was shot and killed after police were called early Saturday morning, the day after Christmas, to respond to a domestic disturbance at his father’s home in West Garfield Park. The dispatcher recording clearly captures Antonio LeGrier, father of Quintonio LeGrier, asking for police help with his son, who was agitated and had threatened him with an aluminum bat. The senior LeGrier had locked himself in his room while his son banged on the door. He then called his downstairs neighbor, Ms. Bettie Jones, to ask her to look out for the police’ arrival. After that the story is unclear. The police report says the younger LeGrier was holding a bat, and he was shot multiple times after police contend he became combative. “He called and said someone was threatening his life,” said Sharon Fairley, Illinois Police Review Authority (IPRA) interim chief administrator. “The other person said his son was beating on the door and had a baseball bat in his hand.” See Police Killings, Page 11

The Black Press

The role of the Black Press has always been one of advocacy with a clear purpose of providing our view of the world. It has never pretended to be objective. And so, as we brave the circumstances that face us daily: the lack of educational resources, employment, career and or entrepreneurial opportunities, access to wealth and optimum health, bonded families, a wholesome spirituality as we stare racism in the face, particularly the destruction of our Black men, let us accept the Black Press as our voice pushing through the jagged glass brier. We cannot afford to ignore the prison system that houses so many and the fact that the others are hunted by men with a license to kill. We have been accused by those outside as not being objective, of being sensational. Seriously, I ask, seriously? And whose agenda, whose objectivity, do you suppose the mainstream newspapers push? We are tired of having to explain ourselves, who we are, why we are, what we do and why we are important, what our significance has been and is. The Black Press traditionally has been one of the Black community’s strongest institutions – employing thousands and giving a voice to our people when we were invisible except to be mistreated, abused and terrorized. Plainly, our words were our weapon. The Black Press was clearly an army of soldiers with pens as swords, to reference filmmaker Stanley Nelson (The Black Press: Soldiers Without Swords). It offered a forum for debate amongst ourselves, enlightening us and allowing us to share and interact with one another across state lines and country borders.

I cannot overstate the importance of Black newspapers. There was family/ home, church and the Black Press. It served as a means of socialization, education and introduction to new ideas. Frankly speaking, the Black Press allowed us to tell our story and to reserve that right. That’s what we do. We tell our story unapologetically. White newspapers perpetuate Black myths and stereotypes, many of which remain embedded in the consciousness of Whites. As we look at this daunting terror of Black lives being taken by White officers of the law who get away with it unpunished, we have got to begin to contemplate what’s really happening from a comprehensive perspective. We must not allow our emotional reaction to blind our vision. The news stories unfold like episodes of a television drama about police killings and the growing protest movements and calls for action. We need them to inspire our commitment to transformation. In order for that to occur, we have to examine the actual facts about the extent of the problem. While the unnecessary loss of a single innocent life is one too many, without facts and data, how can we authentically make the strongest arguments as to the urgency of addressing the problem? Few will be surprised to know that police departments and organizations, particularly the Fraternal Order of Police (FOP), the union that protects the police via contract, have not been as cooperative as they could be in providing data on police killings of citizens that is needed to accurately assess the nature and extent of the problem.

An FOP Deal? As the events have unraveled in Chicago, the head of the Chicago Fraternal Order of Police, Dean Angelo, met with Department of Justice officials in Washington, D.C. as the agency began its civil rights investigation into the Chicago Police Department. The question is, was a deal struck? We think so. Angelo told Chicago Tonight that the meeting was with Vanita Gupta, Assistant Attorney General for the Justice Dept.’s Civil Rights Division, who is heading up the investigation, and Zachary Fardon, the U.S. Attorney for the Northern District of Illinois. Angelo claims the union set the meeting up before U.S. Attorney General Loretta Lynch announced the investigation because he felt the announcement was inevitable. He says the attorneys questioned him on topics like the FOP contract with the city of Chicago and police morale, but said the meeting was mostly personal, off the record and for the purpose of information sharing. He says he wanted to see how the FOP could “help facilitate the moving parts of the investigation.”

What Angelo doesn’t share is the how do you make sure police officers are held accountable if most of their full disciplinary records are no longer available? That is the million-dollar question at the center of what Chicago is currently dealing with. While protesters are shouting for resignations, they may have overlooked the reality that the tail is wagging the dog. As long as the FOP has its grip on an iron clad contract that protects the police officers it doesn’t matter what Mayor, State’s Attorney or Police Superintendent is in office. The U.S. Department of Justice’s investigation into the patterns and practices of the Chicago Police Department is just the tip of the iceberg. There is a legal fight over the destruction of police misconduct records dating back to 1967, the very records that could help the Justice Department review patterns of police misconduct.

“The good news is that most police officers were not abusing people; the vast majority of the officers had very few complaints throughout the bulk of their careers,” Futterman says. “But then there was a small percent who got extraordinary numbers of complaints.”

The Fraternal Order of Police is demanding that the city of Chicago destroy all police misconduct records more than five years old, arguing that keeping them is a breach of its bargaining agreement with the city. The agreement, which is effective from July 1, 2012, to June 30, 2017, says in part: “All disciplinary investigation files, disciplinary history card entries, IPRA (Independent Police Review Authority) and IAD (Internal Affairs Division) disciplinary records, and any other disciplinary record or summary of such records other than records related to Police Board cases, will be destroyed five (5) years after the date of the incident.” If the complaint involves alleged excessive force, it is to be destroyed after seven years, according to the contract. University of Chicago law professor Craig Futterman has been fighting for the release of police misconduct records for more than a decade and recently won the release of a small data set, which includes citizen complaints for things like excessive use of force, illegal searches and unlawful arrests. Futterman made the complaints available to the public in a searchable online database.

• In 14 of the 60 largest cities in the country, all of the people killed by police were African Americans, while Whites were exclusively killed by police in only five of the 60 largest cities. It is worth noting that these five cities had very low percentages of African-American residents. • Police killings rates are not highly or predictably associated with high crime rates as often believed. Some cities with lower crime rates such as Austin, Bakersfield (CA) and Long Beach (CA) have some of the highest police killings rates, while cities with some of the higher crime rates, such as Detroit and Newark have some of the lower police killings rates. • There’s an even sharper racial disparity when it comes to police killing of unarmed citizens, with unarmed African Americans in the 100 largest cities being six times more likely to be fatally shot by police than Whites. • Chicago ranked third in the total number of police killings in 2014, and ranked second for the number of police killings of unarmed citizens for the same year. All of the unarmed Chicago victims were African American or Hispanic, with the largest portion being African American.

Police Killings Facts Here are some highlights of their findings in the 2015 report on police killings from Mappingpolicekillings.org. • Police killings of civilians are definitely overwhelmingly an urban, police-on-Black-citizen phenomenon with one-third of all police killings of civilians taking place in America’s 100 largest cities. While African Americans make up only 20 percent of the population in these cities, 41 percent of the victims of police killings in these cities were Black.

In the State of Illinois, police killing of African Americans happens at a rate of 11.94 per 100,000, while the rate for police killing of all citizens is only 3.96 per 100,000 population. In other words, throughout the state Blacks are killed by police at three times the rate of Whites. • The racial differences in police shootings of African Americans over Whites correlated with the percentage of the population that is Black at the state or city level. It appears that these differences may have more to do with police policies, practices and procedures as well as the relationships with the communities that they serve. At the end of the day, we have to use this information to arm ourselves and reinforce our strength and defense as well as offense. We have to accept the reality. There is a liberating power in us being able to talk about the pathology of White people and its impact upon us without emotional attachment and regret. We have to note that poor and marginally middle-class Whites often react to perceived notions that Blacks are progressing at their expense. The underlying reason for this notion is that they have been deeply socialized into an unconscious belief that their own worth is somehow connected with a sense of less worth of Black people. Blacks have to not be emotional about that reality, but very aware of it in how we assess the safety or the danger we are in. The mutilation of Emmett Till was done as a reaction to the advancement of Blacks. Brown v. Board of Education of Topeka, was a landmark United States Supreme Court case in which the Court declared state laws establishing separate public schools for Black and White students to be unconstitutional. The decision overturned the Plessy v. Ferguson decision of 1896, which allowed state-sponsored segregation, insofar as it applied to public education. It was handed down on May 17, 1954. As a result, de jure racial segregation was ruled a violation of the Equal Protection Clause of the Fourteenth Amendment of the United States Constitution. This ruling paved the way for integration and was a major victory of the Civil Rights Movement. Emmett Till was murdered one year later. That landmark decision was just as important then symbolically as was the election of Barack Obama in this era, and the reaction is reflective in-kind. We need to harness the knowledge we have of our nemesis and be wise and strategic in planning our strategies and actions. For example: The initial strategy of the Chicago Black Friday protest demonstration was a powerful move, but what is the end game? Changing the game is necessary more than changing the players.

Stallworth claims the case was mishandled from the very beginning. “It started with the police,” he says. “Number one, when they came to the door to arrest me a couple days after Thanksgiving, there were like eight of them that just converged to get little old fat me. Some had fatigues, some had the blue jumpsuits they wear. I called my attorney and he came right over because I wasn’t going outside. “The attorney convinced them there was no need for them to take me in at eight or nine that night, whatever time it was, and he would be responsible for getting me there the next morning before 10.” Stallworth believes that the police investigation was entirely lacking. “There is an obvious camera on my front door and no one ever asked to see any film or videos that may have been taken of the young man who accused me coming in and going out. Never in two years did they ask for any of that,” Stallworth says. “To this day, they have never been to my house to see the alleged crime scene, to ask for any sheets or cloths we may have used. Anything. To this day, I never had my rights read to me.” There were obvious discrepancies in paperwork, he adds. “The first document that had the investigator’s name on it had a Patrick Sullivan with a badge number. Then when the investigator is giving his story before the grand jury, it becomes Patricia Sullivan with a different badge number,” Stallworth says. “We looked into that and Patrick Sullivan had been dead 10 years. It was explained away as some secretary incorrectly typing up notes from the district attorney, etc. But Patrick became Patricia, male became female, and badge numbers changed. “That’s more than a typo. Did a Patricia Sullivan actually do an investigation? We still don’t know. We can’t find any evidence. We can’t even find evidence that the grand jury ever met. There are numerous inconsistencies in the documentation.” The accused, Stallworth and Miller, gave DNA samples on Dec. 4, 2013, but the results didn’t come back until 18 months later, earlier this year. Stallworth says that in a rush to judgment, he was charged immediately without DNA results being in, yet the State’s Attorney’s Office took 14 months before charging a police officer caught murdering a Black man on videotape. The DNA results were a huge turning point for his case. According to Stallworth, “The DNA specifically says, ‘These guys’ DNA is not present on or in this young man. But there is male human DNA semen in his mouth and his anus. We don’t know whose it is, but it’s not those two’s.’” Stallworth believes that at that point, and several others along the way, “You would have thought the prosecutors www.chicagodefender.com

would say, ‘Okay, we need to sit down in front of the judge and figure this out.’ You would think at this point, they would try to make amends, but once they dug their teeth into me, there was no turning back. You know the saying that a lie makes you keep telling a lie.” Stallworth believes that the Cook County State’s Attorney’s Office “has created an environment where there is no sense of ‘let’s get to the right decision or let’s get to justice here;’ there’s no sense of cooperation between the prosecutors’ office and the defense bar, whatsoever,” he says. Stallworth notes that there are two charges on his record – the original charge of a criminal sexual assault misdemeanor in December of 2013, and then a felony sexual assault charge in 2014. “The State’s Attorney’s Office had to deliberately make that decision to upgrade that charge to a felony with a different case number,” he says.

“After you go through that kind of injustice, you just cannot not do something. There’s no way.” Now it’s on his record that Stallworth was charged with two sexual assaults within a month’s time and he has to make sure that he expunges them both.

Aftermath

Stallworth says he was always confident that the court would do the right thing on his behalf “because I always knew I was innocent, I believed the facts were strong, and you had a complaining witness who was totally not credible,” he says. It’s been speculated that extortion was the motive behind the accusation since Stallworth at the time obviously was a man of means, and it is said that offers were made to make the charges go away with a financial settlement. But believing in his innocence and the system of law and justice, he refused to take that way out. But now Stallworth also believes that if he was not the average Black man with the resources he had to put out – he paid astronomical legal fees – he may not be standing a free man at all … “and those are resources that you don’t get back just because you’re found not guilty,” he says. After the arrest and charges and during the trial process, he basically moved back home to Alabama and

would fly in for court dates, “because I felt they were after me,” he says. Stallworth estimates he spent $150,000 just traveling for the trial. “And I needed to have a career going since I’m unemployed from Sidley, so I’m doing the same kind of legal practice stuff back home as I did here. Developing property, things like that.” One of the big differences between him now and two years ago, Stallworth says, is, “I think that I am more aware. I’m not going to say paranoid, but I find myself making sure – and I don’t know if in America there’s any such thing as being sure – you do everything right. “Just making sure I use my turn signals, for instance, to change lanes. I find myself feeling like I have to do everything right because there’s a system that doesn’t protect you – even if you are doing right, but certainly if you’re doing wrong. It’s not going to give you any fair shake. “When you know you’re innocent and you have served the legal system, even though you have never been in criminal court, but you’ve been in a professional corporate court, you just think it’s a way it’s not.” Stallworth has very vivid memories of his ordeal – being in lockup with 60 people in an area meant for 30; the gray metal slate beds with no mattresses and pillows; being transported from lockup to court in an overcrowded police van when it’s 19 degrees outside and the van’s not heated; hearing the keys turn after you’ve been locked up for so many hours and hoping someone is finally coming to get you. And of course, he remembers the dry baloney and bread sandwiches that after awhile seem like a feast when you’re locked up – Stallworth even took one home and put it in his freezer as a reminder of his ordeal. “It’s a profound experience at all levels from the charges to being in the cell to how they treat you, the whole deal,” he says. “When the judge gave the not guilty verdict, I couldn’t muster up one tear. I was just sitting there like, ‘This is the most humiliating process for a human to face, especially one who is not guilty, and in many ways, I was treated guilty the entire time. “I could see going home and having a breakdown if everything in your life, except that, were not going well. I had family and friends praying for me, and at least I didn’t have to go worry about eating or providing for kids. But I can see going through that, coupled with a few bad life elements, taking you out. That would take you out.” But Stallworth isn’t going out like that. “I’m not sitting back saying, okay, they found me not guilty and it’s over. I’m fighting back,” he says. “After going through that kind of injustice, I just cannot not do something. There’s no way.”

So Stallworth is looking at legal follow-up to some of the actions that were taken against him. He’s also developing programs based on what he learned. “My platform is going to include trying to help young Black folks stay out of the system and if they do get into the system, help them get out of it through some re-entry programs,” he says. “I am deeply troubled at what is happening at 26th and California, and if this had never happened, I would never have seen it. I did not go to 26th and California one time and a young Black person didn’t ask me if I was a lawyer and to work with them.

“Our daughters aren’t going to have anybody to marry because they’re going to all be in jail. If you stand there and watch the security line, at any given point between 8:30 and 10 a.m., it’s 98 percent Black men. White people must not commit crime in Cook County.” Stallworth’s primary move now that he has been found not guilty is spreading his story. “This was just a clear case of wrong and it needs to be communicated,” he says. “I wanted people to know that this happened, and if it happened to me, it could happen to anybody.”

“The eradication of racial segregation under the law was a victory for our movement, but it had a flaw. We misunderstood integration and desegregation. As a result, we stopped supporting our own institutions and rebuilding our interests on the basis of power. We had more political power with less elected officials.”

The image of the microphone being taken from the Rev. Jesse Jackson during the Black Friday shutdown of Michigan Avenue had the local and national media abuzz. The moment seemed to be a symbolic “taking of the torch” from the civil rights generation by the millennial generation. Mainstream media has portrayed the situation as a struggle between the young and old, but it’s a much more complex situation that must be sorted out as the emerging Black political movement grows with each police murder. The gains of the civil rights generation and eventually the Black Nationalism movement created “an era in which we consciously organized around the question of our collective power,” says Dr. Conrad Worrill, of Northeastern Illinois University. “I was born a Negro, but Generations X and Y were born Black. It was the Black Power Movement that shook up America on the question of our Black collective power. We have historical intergenerational discontinuity. This generation does not know what the previous generation did.” That discontinuity has percolated locally under the surface for years and finally boiled over in front of a national audience during the Black Friday protests on Michigan Avenue. Local community activists who had spent years claiming that civil rights leaders of the

past only show up for the cameras, demanded that they get in line “with the rest of the community, not in front of it!” said Mark Carter, a community activist at ONE Chicago. “We have to be on the same page, not just one person’s personal agenda.” Carter, who established his role as one of Chicago’s leading Gen X community activists working with the ex-offender community, has been a long time detractor of and antagonist for old time civil rights leaders and preachers alike, often loudly voicing his displeasure with them in public settings. But despite long-term grievances with Rev. Jackson, even Carter recognizes that Blacks of different eras and generations must combine forces to combat the epidemic of police murders

of innocent Black people in Chicago.

for our children, who are now out there on the front lines.

Even so, Carter is very clear about the role he feels the civil rights generation must play.

“We must mentor them into leadership side by side with us as their parents,” Carter says, referring to the millennials that have taken to the streets in response to the constant flow of police murders captured on tape.

“Make no mistake about it; the next generation of Black leaders believes their time is now.” “Those that have led the civil rights generation, it is time to move to an advisory role,” Carter says. “It is time that the hip hop generation takes responsibility

These millennials are the children of Gen X, the “hip hop generation” that by and large traded Black activism and nationalism for education and materialism. At the same time, the Gen Xers reaped the benefits of affirmative action programs that attempted to correct the wrongs highlighted by the civil rights and “Black nationalist movement’s work around organizing our collective Black power,” says Worrill.

Resultingly, a majority of the members of Gen X dropped their guards toward racism and focused on participating in a multicultural society. While multiculturalism began as a good thing, it eventually led to the dismantling of the advances of the civil rights and Black nationalist movements. But now the children of Black Gen Xers are back on the front lines, ironically marching for some of the same reasons their grandparents and great grandparents did before them. As the city tries desperately to contain the powder keg being created by the continual murder of innocent Black people, Gen X leaders believe that it is important to take the reigns and work with the millennials to determine the future of the Black community, while always reaching back to the elders for guidance and council. But make no mistake about it; the next generation of Black leaders believes their time is now. “It’s too dangerous of a time for our young adults with limited experience and information to try and lead this alone,” Carter says. “These are our children and so we understand them and their concerns. But we also know that when we were young, we thought we had it all figured out, too.” www.chicagodefender.com

The decision to own a firearm can be one of the toughest decisions anyone will face in a lifetime. However, should you make the choice, here is what you need to know. Based on 430 ILCS 66/0.01, to possess a gun in the home, you need an active FOID card, which you must apply for through the Illinois State Police. It costs $10. Once you obtain a FOID card, you can then apply for a concealed carry license, which permits you to carry a loaded firearm outside of the home. This can cost upwards to $500 for in-state residents. However, there are legal reasons to deny you a concealed carry license if there are issues found in your background. Chicago has a rich history of being one of the lead cities in performing arts and culture, cultivating a long line of talented African-American iconic figures over the decades in various areas of interests.

“Jimilita told us until we figure out what our next move was, we could come and be there at the Harold Washington Cultural Center. Many people said we should’ve moved downtown or closer near there, but M.A.D.D. means ‘Making A Difference Dancing Rhythms,’ so the whole thing has always been about making this art form accessible to young people in the community,” Barrett said. “Growing up, this is the way it was made accessible to me which allowed me to move forth with a career in tap dance. In the same way, I want to keep it accessible within our community.”

During a time referred to as the Black Renaissance period, the South Side of Chicago was the heart and soul of the burgeoning arts scene. The main corridor of activity was in Bronzeville, which was a hub of nightlife venues that included legendary speakeasies, ballrooms and the famous Regal Theatre, where many musical legends launched their careers. In August 2004, the Harold Washington Cultural Center (HWCC) in Bronzeville opened its doors after a 10-year long process of fundraising, construction and controversial challenges. The building sits at the intersection of 47th and King Drive, where the original Regal Theatre was located. Initially under the direction of former Alderman Dorothy Tillman, the 1,000-plus seat venue has received mixed reviews by the community. Over the last 10 years, HWCC has suffered some financial hurdles, limited productions and nearly missed having its doors closed in 2010 due to possible foreclosure. Since the beginning, Executive Director Jimilita Tillman-Hunter has managed the facility and guided it to its original purpose as a performance arts and educational center. The daughter of Alderman Tillman, she isn’t a stranger to adversity and politics and believes the growing pains of running HWCC has been well worth it. There are currently 10 performing arts programs running simultaneously out of HWCC in partnership with established organizations. This is the most programs that the cultural center has housed since its beginning. Tillman-Hunter said, “We were built primarily as an educational training facility, not necessarily an enter-

Cultural Center: Making a Difference, Changing Young Lives tainment center. That was never a part of the plan for the Cultural Center; it’s always been to be where we’re at now. “We’re actually evolving to square one, we’re going back to our original corporate charter and purpose in streamlining what we’re allowing to be done in the building and dictating a better environment that we want to pursue. “As it pertains to the theater and the cultural arts center, overall we understand who we are on the scope of things nationally and internationally. It was just getting our community to believe in who we are and what it is to have a facility on 47th and King Drive where these types of activities

can happen and take place,” Tillman-Hunter explained. “Often times, a lot of organizations lose their funding. When they lose their funding, they lose their place and all of a sudden it breaks down. With us having a brick and mortar operation, we’re able to partner and assist with programming to give people a home and coverage for them to have their kids to participate – not only in their classes, but they also have a place where they can showcase.”

A Bustling Facility On any given day, during after school hours, the building is bustling with students participating in a num-

ber of dance, poetry and acting classes. Some of these programs include: Stick N Move, IONA Calhoun School of Ballet, M.A.D.D Rhythms, Lanita Joseph Cultural Arts Dance, Lady Sol Presents, Ayodele Drum & Dance and Cassandra Bell Acting Studio, along with the Broadway in Bronzeville productions. One of its partnered programs, M.A.D.D. Rhythms, is a Chicago professional tap dance company that has created both a student-based program and an in-demand professional touring group. The company was started nearly 18 years ago by Founder and Executive Director, Brill Barrett. Starting out at South Shore Cultur-

Barrett is mindful of the history of many artists before him and is reminded of this as posters of past events grace the cultural center’s walls. He mentions the legacies of tap dance greats such as Dr. Jeni LaGon and Leon Collins, both Chicago natives. “Being able to tie it into the Great Migration of African-Americans from the South to the North and now when we came to Chicago, the only place we could be in was in this community, the Bronzeville community,” Barrett said. “That became our everything to the point that other people that didn’t want us their community would start coming to here to have a good time. This is where all the culture and arts were. When I talk about the history of tap, no matter where I’m at and who I’m talking to, I talk about the fight of the hoofers of old. Not only to be artists, but fighting to be heard and fighting to be considered human beings. Their circle for the art form is very different than any generation that came afterwards.”

A Production Pipeline With safety being a major concern among parents, having access to programs that HWCC offers has become a sanctuary for both parents and students. Affordable lessons and accessibility is an ongoing challenge and the facility has done a good job building a solid reputation for assisting in this area. continued on next page

the playbill or when people donate money in the envelopes – that’s how we stay open every day. We do not receive funding for operations at all,” Tillman-Hunter said.

White said, “At first, her dad didn’t agree with taking a hip hop dance class, but we discussed that instead of our daughter dancing outside, at least she’ll be doing it with other girls and it’ll be positive. She won’t be in the streets, but she’ll be a part of something special – growing up and knowing who she is as a strong female. I feel like her teacher is very positive.”

“What I noticed about the art based programs in predominately non-Black areas, even in Latino communities is that they’re getting money for what is called ‘audience development’ so that they’re able to reach our population.”

HWCC has become a member of the League of Chicago Theaters, which includes over 432 theaters in the Chicagoland area. Because they have built a solid following of young talent, they have become one of the top “go-to” outlets for professional casting agencies, film and theatre productions. They also work with celebrated companies such as Steppenwolf, Goodman Theatre, and they have a working relationship with Broadway in Chicago. “When the casting calls happen and come down the pipeline, they contact the HWCC,” Tillman-Hunter says. “If they do Broadway in Chicago, or Empire and other productions, they’ll contact us. It’s a good feeling to think that we’re not an agency, but we’re a reliable source for hard working young people.” Tillman-Hunter feels that all of the students’ hard work is paying off in a positive way. “I would say, the evolution of the arts in Chicago as a whole has been beneficial to HWCC because we hand out opportunities to carve out our niche in performing arts – dance, voice, music and theater. We’ll have classes, but also have the capabilities to produce an actual production.” Although she feels the Harold Washington Cultural Center is on the right page after years of keeping the doors open and building the community’s confidence level to support their efforts— she admits there is still an invisible layer of racism. “We operated off of 100 percent earned income. What this means in the theater world is that what you hunt, is what you eat. When we sell tickets to a show, when people buy an ad in www.chicagodefender.com

As the Chicago Teacher’s Union prepares for a possible teacher’s strike, HWCC is also preparing to provide a safe haven for its student participants by working with retired educators in creating an alternative curriculum to keep students on track. “We have educational services on standby to be in the building to help with math, science and test preparation. We will have activities and programs ready along with having our computer labs set up. We’re also partnering up with other agencies, park districts and libraries,” she says. There is no doubt that the power of arts programming has nurtured some of our most brilliant minds within the Black community. As you drive throughout the neighborhoods of Greater Crossing, Englewood, Woodlawn, Bronzeville, Pullman, Chatham – the hub of the Great Migration – the spirits of Gwendolyn Brooks, Nat King Cole, Redd Foxx, Lou Rawls and others are ever present. Ever since Craig Richardson enrolled his 11-year old son at 5 years old into the M.A.D.D. Rhythms dance program, he noticed a positive change in his son. He later enrolled his two 9-year old sons into the dance program. Richardson said, “It helps develop focus. It also helps them to develop drive, determination and skills that translate into better academic performance.” He first heard about the tap dance program through a family friend and it’s been worth the drive and investment for his kids. “My oldest son had an opportunity to dance with M.A.A.D Rhythms on the Steve Harvey Show a couple of years ago. So, there’s been a lot of good things to come out of this program for him,” Richardson said.

Police add that Bettie Jones, 55, the neighbor who lived on the first floor of the building, was accidentally shot. She died from a single gunshot wound to the chest. No specifics as to what actually transpired to cause the police to shoot the 19-year-old seven times are provided. Under new policies outlined by the city, officers involved in shootings will have separation from field duties for 30 days while their fitness for duty is examined. Mayor Rahm Emanuel also called for a review of crisis intervention and de-escalation policies currently in place. Emanuel, who cut short a vacation with his family in Cuba, released a statement saying, “We must take the use of force by our officers extremely seriously, and this new policy provides more time to ensure a thorough examination of an officer’s fitness to police our streets after they have fired a gun.” Rahm’s absence from his city that remains in crisis was not taken lightly by the Black community. He did cut his trip short and returned to Chicago Tuesday afternoon. Because so many questions remain after the police-involved shootings of Black people that left two people dead and one seriously injured over the weekend, people are not seeing the change. “It seems like it’s just rhetoric,” said South Side resident Austin Castleberry. “I’m 52 years old. I know that this sort of thing has been going on all my life. Rahm promised to deliver change when he first ran. So where is it? It appears the cops do what they want because they know they’re protected. Think about it. They know they’re under federal investigation, but they still shot that 19-year-old and the innocent woman. Protected.” Antonio LeGrier, father of the 19-year-old victim, Quintonio LeGrier, a Northern University of Illinois honor student who was experiencing mental health issues, has filed a wrongful death lawsuit against the city, said Basileios Foutris. The Chicago Defender has received news that attorneys for the family of 55-year-old Bettie Jones (who police say was “accidentally struck and tragically killed”) plan to follow suit. Police called Quintonio LeGrier a “combative subject,” but his father’s suit, filed in Cook County Circuit Court, said the young man was unarmed and “never posed a danger of

threat or harm.” It called the shooting “excessive and unreasonable” and said officers “did not do anything to try to provide (Quintonio LeGrier) with medical care.” The suit said authorities have recovered a video of at least part of the incident, although it doesn’t describe what could possibly be learned from it. The Cook County medical examiner’s office ruled the deaths homicides.

They were amongst three Blacks shot by police in Chicago in less than 12 hours. Later that same day, officers responded to an “assault in progress” and shot an armed Black man, according to the Chicago Police Department. What they don’t say is what the family, friends and neighbors who witnessed the shooting say, which is that the police asked Mikel Lumpkin, who had a gun, to lay it down on the ground. Allegedly he did…and then he was shot five times. He was rushed to the hospital in critical condition and had to undergo surgery. Chicago police didn’t say how many officers were involved in the fatal shootings of Quintonio and Ms. Jones, but they said that the officer or officers who responded were on administrative duty for 30 days and that the IPRA would investigate the killings. The shootings prompted Chicago Mayor Rahm Emanuel to order the Independent Police Review Authority to, in addition to investigate, work with the Chicago Police Department to review how officers are trained in responding to mental health crisis calls. “I have asked that they determine the deficiencies in the current training, and determine what steps can be taken immediately to address them,” Emanuel said. “We will continue to ask

tough questions of the police department, of the investigative agencies, and of ourselves, to drive the reforms the people of Chicago deserve and expect.” The families and friends of the deceased victims, Jones and LeGrier, criticized the police response and questioned the city’s administration. Some even called for Emanuel to step down. “Why do you have to shoot first and ask questions later?” Jones’ friend Jacqueline Walker asked Sunday during a news conference outside the home where the first shooting happened. LeGrier’s mother, Janet Cooksey, said: “The police are supposed to serve and protect us, yet they take lives. My son was a good child.” LeGrier was home on Christmas break from Northern Illinois University, where he was majoring in electrical engineering technology, when he was killed. He had been experiencing mental health issues according to his family. Jones, described by loved ones as a “beautiful” and “loving person,” was the mother of five children and an activist with Chicago’s Action Now Organization. She had taken off from work to concentrate on her illness from ovarian cancer and had just celebrated Christmas with family and friends. “Chicago police murdered one of our own early this morning,” Action Now said in a statement Saturday. More than a decade ago, the Chicago Police Dept created a crisis intervention team, which included officers who specialize in responding to calls involving mentally ill individuals. Mental health experts are concerned that training has failed and that officers are responding to calls with a different mindset. U.S. Rep. Bobby Rush said the shooting of LeGrier and Jones “adds salt to the wound” for Chicago’s citizens. “Why weren’t tasers used in this incident? Why were shots fired before other deescalating tactics were employed? Why does shooting someone to death seem to be the default tactics of the city’s police force?” Cong. Rush asked. The Rev. Jesse Jackson met with Jones’ family Sunday before calling for President Barack Obama to make a visit to his home city. “This is the epicenter of urban violence,” Jackson said. “We need help.” “Miss Jones is really a good neighbor,” Rev. Marshall Hatch said. “She was merely trying to let the police in. I don’t know how you lose your life for that.”

Be A Community Health Agent for Change In 2016 Eleana Elan Defender Contributing Writer Think about kicking off your new year as an agent for change. It is a huge responsibility, however, it can be quite rewarding. First, recognize those diseases that our community has a propensity for, such as heart disease, stroke, diabetes, hypertension and obesity, which are the top cardiovascular health issues that affect the Black community today. You can improve your state of health by raising awareness. Unfortunately in our communities, so many people are oblivious to the impact of these diseases unless they are affected by them directly. Being a change agent requires you to be patient and very persistent. A change agent should have the ability to build strong relationships with those they work with. A change agent should be comfortable asking tough questions. A change agent is someone that should have his or her own vision. A community change agent emerges from being a family leader first establishing habits and setting examples. Your passion for your and your family’s health will posture you to become a change agent. As you begin to share with your immediate community your commitment to the change for a healthy community, you will quickly emerge as an agent for change. Different communities are affected by different health conditions. Preparing your communities will depend on what issue you are trying to change. You don’t need a lot of money, but community resources are important for change to happen. For example, if you want to encourage your community to exercise more, safe parks and walkways are important. This of course means working with your community elected officials and community leaders, a health club or community recreation center, etc. If you are committed you can make it happen. You may begin with the senior population, which is eager to have activities that get them moving, so look into senior living facilities in your neighborhood and begin the discussion. Starting out with walk outings is a huge step forward. Also, there are monies available to help assist in the organization of this sort of move. Of course there will be obstacles, but persevere and share your own family’s progress. Gather others who may want to volunteer. Initially the lack of volunteers, lack of time, and community resources are barriers you might face in changing your community’s health. However, there are 10 easy things you can do to impact a healthy change in your community: www.chicagodefender.com

1. Plant a garden. 2. Organize a walking group with friends in your neighborhood. 3. Start a fitness group at your local park. 4. Provide healthy snacks for youth activities. 5. Challenge your co-workers to ride their bikes or walk to work. 6. Advocate for healthy vending machines at your office or community businesses. 7. Organize a ride-share to the nearest grocery store for fresh fruits and vegetables (for food desert residents). 8. Initiate CPR training in your community or share the CPR Anytime video with your friends. 9. Advocate to take fried foods off of the menu at church or community events or at least try to change the fried chicken to baked chicken. 10. Join an online community health service such as EmPowered to Serve to share and receive ideas and resources to proactively build a culture of health in your community through simple lifestyle changes. You don’t have to be a community leader to become a change agent; you just have to want to be one. Passion and commitment to your community are important and identifying what you want to change is tantamount! You can get friends involved in changing your community’s health by first asking them. You won’t know until you ask. Then lead by example – i.e.: participate in the walking group that you started or ride your bike to work if you ask them to do the same. Change agents don’t have to be the experts in everything, but they have to be actively involved in what they want to change. Children can absolutely be health change agents. In many cases, they are the inspiration for change, especially for areas like childhood obesity. They don’t need to experts, but if working with an older or more seasoned change agent, they can help impact change among their peers and even adults. The key to being a change agent is to want to change something. Setting goals will help put measurable outcomes in place. So set small measurable goals that will help you get to your big goal of say, weight loss, group training, or participating in a marathon. 1. Keep a food and exercise journal. 2. Enlist support from your friends and family. 3. Don’t let one setback keep you from working toward your goals. 4. Team up with a friend and hold each other accountable for eating and exercise. In other words, just do it!

I remembered standing at her elbow in the kitchen while she described a time when she was about 8-years-old, standing at her great-grandmother’s elbow. “Don’t worry. I don’t expect you to remember everything at once…My tips will come to you through the years.” Granny ended by saying that one day I would grow up to carry on the family cooking traditions when she was gone, adding in a soft voice, “But I’ll still be with you each time you remember us together in the kitchen and when you cook with my heavy black skillet.” That long ago New Years Eve, I observed as she chopped mountains of celery, onions and green bell peppers with freshly sharpened knives for the New Year’s Eve crab appetizers and the

family buffet with traditional New Year’s Day “good luck” black-eyed peas and cabbage dishes. Earlier in the day, I was there when Granny unwrapped the newly sharpened knives from the traveling craftsman who made knife-sharpening neighborhood house calls in the Gulf Coast city during the week between Christmas and New Year’s. This year, I gave the same instructions to my pre-teen niece while preparing these quick holiday New Year’s Eve appetizers made with chicken leftovers. Remembering Granny’s professional craftsman, I had taken my best knives to a family business specializing in knife sharpening. “A great cook once told me that beginning the year with sharp knives is worth the investment for cooks who want to turn out great dishes,” I told my niece.

New Year’s Eve Bites 3 /4 cup each: finely ground cracker crumbs, flour 1 tablespoon finely chopped fresh parsley About 1 1/2 to 2 cups finely chopped cooked chicken or turkey 2 celery ribs, finely chopped 1 small sweet onion, finely chopped 1 /2 green bell pepper, trimmed, finely chopped 1 egg beaten 2 teaspoons prepared coarse mustard, such as Dijon 2 teaspoons Creole or Soul seasoning Peanut oil O fat Greek Yogurt and Ground Chili Paste, such as Sambal Oelek, optional

Stir the cracker crumbs and flour together in a small bowl; add parsley flakes. Set aside. Combine the finely chopped turkey, celery, onion and green pepper in a large bowl, using your hands or a wooden spoon. Add 1/2 cup of the cracker/flour mixture and the egg, Creole seasoning and mustard, mixing with hands or with wooden spoon. Add any extra cracker/flour mixture to reach desired consistency. Form into bite-size patties, about 3/4-inch thick. Reserve any leftover crumb/flour mixture in a food storage bag for later use. Heat 1/2inch of oil in a large heavy skillet over medium heat. Add the chicken buttons without crowding. Cook, turning once, until lightly brown on both

sides, about 5 minutes. Transfer to paper-lined plate or pan. Serve with Greek yogurt and Sambal Oelek if desired. Makes about 18 to 24 appetizers, depending on size. Cracker Note: prepare cracker meal by pulsing in a food processor or use a rolling pin on crackers sealed in a food storage bag. It takes 25 to 30 cracker squares to make one cup.
