INTRODUCTION The present guide is one of the results of the project called „The Network of Competent Authorities for Professional Qualifications in Romania (IMI PQ NET Romania)” implemented by the Ministry of National Education in partnership with the National Qualifications Authority and the Institute for Social Policies (IPS), co-financed by the European Social Fund through the Sectoral Operational Program Human Resources Development 2007– 2013(POSDRU). The General Objective of the project called „The Network of Competent Authorities for Professional Qualifications in Romania (IMI PQ NET Romania)” consists in creating and consolidating the IMI Network (Internal Market Information) for the professional qualifications in Romania (IMI PQ NET), with the purpose of sustaining the CE initiative regarding the development of the System for Informing the Internal Market, the development of a common initiative in this respect, at a national level, targeting the consolidation of the social partners’ capability (agencies and governmental organizations, professional associations) to promote durable development through the creation of proper instruments and communication channels and mutual consultancy with the purpose of gaining efficient communication with the similar organizations within the European Union and the European Economic Aria (SEA), through the IMI platform. To achieve the overall objective, MEN, as the beneficiary of the project, aims to accomplish the following objectives:  Creating and developing a national network to support the implementation of the Internal Market Information system (IMI), by binding the capacity of the social partners, by creating communicating channels and mutual consultation;

Developing and implementing common terms of recerence on the certification standards for the Romanian workers’ skills and the recognition of the professional qualifications of the EU citizens; Involving the Network members in sharing the information mediated by the IMI platform, by providing information/data to requests made by the organizations/associations from EU/EEA.

By making the guide for the certification and the recognition of the CTAP expert profession (expert that certifies, technically, the quality of the Forestry Earhworks) is subscribed to achieve the second objective mentioned and proposes the following:  Supporting the competent authorities from Romania in their efforts to normalize the certification and the recognition processes for the regulated professions, that they manage, by informing them about the practices from other EU member states (the present guide presents the practices from other nine state members)  Informing all the persons who have acquired qualifications in the analyzed activity , in Romania, and want to practice that profession in one of the nine EU countries presented in the guide. In order to complete this guide, a refined methodology was applied throughout the IMI PQ NET ROMANIA project, by consulting with competent authorities. The main information sources needed to complete this guide and other 29 similar professions were: - The research of the ANC experts for each country; - Information obtained from the competent authorities from Romania, during consultations and workshops; - IMI statistics and the database of the regulated professions, belonging to the European Commision 1;

Data collected during the study visits organized in the Netherlands, Italy, Spain, Denmark and Germany .

The structuring of the guide was based on the standard reference terms, as a rough guide for the procedures of validating and certificating the competences, and the recognition processes, defined during the project, in two rounds of workshop with the members of the IMI PQ NET Romania group, published with the 30 guides of certification and recognition. Thus, when structuring the guide, three major aspects were followed, in the analyzed countries compared to Romania, respectively the procedures for validation and certification of competencies, the recognition process for qualification and practicing the profession.

1. THE SETTLEMENT SITUATION IN ROMANIA AND IN OTHER MEMBER STATES OF THE EUROPEAN UNION The guide covers aspects of skills validation/certification, recognition and practice of the profession known in Romania as CTAP experct (expert that certifies, technically, the quality of the Forestry Earhworks) compared to identical, similar or related professions in nine EU states, namely Austria, Czech Republic, Denmark, Germany, Italy, UK, Holland, Portugal, Spain. The guide is intended to be a tool to assist the competent authorities from Romania (in this case, the Ministry of Environment and Climate Change), in their efforts to normalize the certification and recognition process of the regulated professions that they manage, by informing them about the practices from other EU member states. Also, this guide is designed and structured so that it is an efficient way of informing all the people that have obtained the qualification in Romania and want to practice permanently or temporarly, in one of the nine EU member states, presented in the guide. At the same time, the guide has some limitations. The first one is that it presents the situation from only nine EU member states, set for all the developed guides. A second important limitation is that some of the dates, in general the statistics, are available at the moment when the guide was developed and they need to be periodically updated. In the Annex 2 of Law 200 of May 25th, 2004 on the recognition of diplomas and professional qualifications for regulated professions in Romania, amended and supplemented, there are given a series of electric professions as ship's electrician foreman, ship's electrician, sea port foreman electrician, aspiring ship's electrician, onboard electrician, for which the competent authority is the Ministry of Transport. On the other hand, there are many professions for which the competent authority is the National Authority of Regulation in the Energy Area that, given the existing methodology, continuously

improved in recent years, can be considered regulated professions . According to the order no. of March 13th, 2013, these professions are: 

Authorized Electrical Engineering;  Project checker (in the electrical installations domain);  Technical Executer (in the electrical installations domain);  Quality technical expert and extrajudicial in the electrical installations domain. By analyzing the electrical professions, existing in the analyzed countries, it was found that there is a significant number of similar professions regulated. Table 1.1 presents the most important professions, similar to those in Romania, existing in the electric field, in the EU countries. An exception from these regulated profession is the High tension electrical cable technician / Tehnician cablu de înaltă tensiune which, though on the list, is not regulated in any country. Some of these jobs will be analyzed in detail in Chapters 2, 3 and 4, for the countries listed. This analysis took into account the fact that in Romania there are many regulated professions by the National Authority of Regulation, similar or equivalent to those presented in Table 1.1. Statistically speaking, in terms of the flow of migrants who left in other countries, others than those in which they obtained the qualification, we can determine which are the most “mobile” professions, taking as reference a relatively long time, 1997 – 2012, noting that the professions are classified by the number of decisions taken on recognition of the professional qualifications. Thus, starting from the existing data3, we can conclude the following: 1. In terms of geographical mobility. Taking into consideration the period of time 1997 - 2012, for all the decisions taken by the resident country, for all the EU member states and for all the professions, a hierarchy of top 5 countries can be established (considering the country in which the qualification was obtained) (Fig. 1.1) and the resident country (Fig. 1.2).

In figure 1.1, it can be seen that Romania occupies the 4th place, with 8% of all the countries in which the qualification was obtained, with UK on the first place, with 13%. 2. Based on the existing data, if we restrict the scope of analysys to qualifications obtained in the 9 analyzed countries + Romania, with recognition in the EU member states, we can make a ranking of the top 5 host countries, in which the professions are regulated in each country from the 9, where the qualifications were obtained:  For Austria (resident country), the top 5 host countries in which the professions are regulated are: Germany with 61%, on par with 10%, UK and Italy, and with 3%, Slovakia and the Netherlands;  For the Czech Republic: 28% UK, 18% Germany, 16% Austria, 13% Slovakia and with 5% Ireland;  For Denmark: 44% Sweden, 28% UK, 10% Germany, 4% the Netherlands, 3% Spain;  For Germany: 33% Austria, 17% UK, 9% the Netherlands, 7% Luxembourg, 5% Denmark;  Italy: 41% UK, on par with 12% Greece and Germany, 11% Spain and 5% Belgium;  The Netherlands: with 40% Belgium, 29% Germany, 17% UK, 3% Austria and 2% Sweden;

Although the number of the IMI recognizing decisions is not as high as in other professions (nurses, doctors etc.), in the forest area there is a significant number of decisions, that will be discussed in chapter 3, for each country and for each professions, trying to emphasize the degree of compatibility of migrants comning from Romania, with the recognition requirements of each country. 4. In the case of the electrical professions, the most important statistics, on generic categories of professions, can be obtained considering the top five countries where the migrants have obtained professional qualifications (Fig. 1.3, 1.5 and 1.7) and the top 5 countries in which the qualification has been recognized(fig. 1.4, 1.6 and 1.8). a. 2. THE SKILLS VALIDATION/CERTIFICATION PROCEDURES 2.1. Skills validation/certification of the profession as an electrician in ROMANIA In Romania , for the electricians who design, construct , verify and operate electric power system installations, the competent authority is National Authority of Regulation, who are authorized under Ord 11/2013 - "The Approval of the Regulation for licensing the electricians, projects checkers, the ones responsible for implementing the techniques and the Quality technical expert and extrajudicial in the electrical installations domain", published in the Official Gazette no. 152/21.03.2013 . For the four categories of professions, the order establishes the procedure for authorization, and also the switching to a higher or different degree / type, based on the examination procedures for organizing and conducting the authorization examination, the reauthorization procedure for the electricians who hold or have held badge issued by the competent authority, field of competencies , the rights and obligations of authorized persons and the suspenion conditions of or the withdrawal of authorization, namely sanctions, both for the Romaian and foreign individuals, requesting authorization to conduct business in Romania. The occupational categories in the electric field are similar to the ones in Italy (see 2.2). Moreover, there were no reported problems on recognition in this area between the two countries. Thus, in Romania the certified electricians to design / execute / verify the electrical installations connected to the National Power System (NPS) may have, where appropriate, authorization levels I, II, III and IV. For each of these degrees, there are defined two types of authorization: authorization type for electrical installation design and certification of type B, for executing electrical installations. For the Ist grade there are not provided 2 types of authorization, given the qualifications level required by art. 30 of the Regulation vocational school or training course; these qualifications confers to the

people the right to practice under the direction of licensed electricians of IIB, IIIB or IVB levels. The authorities award, depending depending on type and grade, the following aptnesses: -

Ist degree for the execution of parts of the electrical installation at a nominal voltage less than 1 kV; IIA degree, for the design of electrical installations at any technically feasible installed power and a rated voltage of less than 1 kV; IIB degree, for the execution of electrical installations at any technically feasible installed power and a rated voltage of less than 1 kV; IIIA degree, for the design of electrical installations at any technically feasible installed power and a rated voltage up to 20 kV; IIIB degree, for the execution of electrical installations at any technically feasible installed power and a rated voltage up to 20 kV; IVA degree, for the design of electrical installations at any technically feasible and installed power any standard rated voltage; IVB degree, for the execution of electrical installations at any technically feasible and installed power any standard rated voltage.

The approved regulation, by Order 11/2013, sets out in detail the authorization and the renewal procedure, the conduct of examinations, tests exam, for each professional category, separately. As an example, the authorization procedure for electricians performing design / execution / verification activities of electrical installations shown in Ord 11/2013, as follows.

1. The authorization of the electricians performing design / execution / verification of electrical installations is:

a. Based on Examination, getting the initial identity card for a certain type / degree, and the transition to a higher or different degree / type or

b. Without Examination, on the basis of a dossier prepared in accordance with Art. 15 and art. 16 of the Regulation. 2. The Specialized General Directorate of the Competent Authority may grant IVA degree authorization, without examination, based on a project, to flagship project engineers from the design institutes, in the field of energy, who hold or have held the Ist degree or a similar degree of the COR schedule, to teachers / lecturers in the Faculty of Energy and to researchers from institutes / research in the energy centers, at their request, if applicants meet the following conditions  

Professional qualification / specialization in the energy domain; A minimum experience of 20 years in the design / research installation of high voltage electrical area or teaching in the energy field.

The application for authorization shall be accompanied by the curriculum vitae and documents (copies of qualification and specialization diplomas, labor card copy, etc.), demonstrating that the conditions are required. 3. The required documents to be included in the dossier prepared for the submission to the Electrical Contractor exam, are: a. A permit application accompanied by the "Professional Information ", "Details of work done" and "information page" attached to the authorization application, made under annex 1, points A, B, C and D, from the Regulation; b. A copy after the identity card;

c. Copies of certificates or diplomas attesting the professional qualifications, d. Document attesting recognition of the professional qualification certificates or diplomas in Romania, issued in accordance with the legal provisions on the foreign individuals; e. Copy of the workbook, certifying the professional experience in the field in which the authorization is requested, where applicable, and / or, where appropriate, the report per employee in the register of the employees communicated to ITM; f. The extension of the Electrical Contractor, for the same degree/authorization type, can be requested under the session undr which the identification card expires, the issueing of the Electrical Contractor identification card to be processed in the session. Otherwise, the owner will be found on the list of individuals whose cards have expired, which is published and regularly updated on the website of the Competent Authority. The documents submitted for this application include: 

The application made according to the model specified in Annex 1 of the Regulation, the contents of which should result the professional work experience of the applicant, as defined in art. 31 of the Regulation; Proof of completion a theoretical training course, lasting minimum 20 hours; An appropriate medical opinion; Copy of the receipt proving that the licensing fee was paid, which is 50% of the appropriate authorization fare, adequate to the Electrical Contractor.

5. The identification card holder may be placed on a new exam, to a higher or different degree / type, in which case he will make a folder with the contents specified in art. 16. of The Regulation. The candidate who has been declared "Rejected" to any of the exams organized by the competent authority, he can sign in to a new examination, recording or transmitting through the postal service, for the submission, to the competent authority, a file containing the documents referred to in art. 16 of The Regulation. 6. The quality of the Electrical Contractor is final, as evidenced by the electrician’s identification card, only in terms of its validity. The identification card as an Electrical Contractor is granted under The Regulation and it is valid for a period of 5 years from the date of its release and shall be renewable under The Regulations. After the expiry of the identification card, a new badge can be regained only after promoting a new authorization examination, as mentioned in The Regulation. Similar conditions are detailed in Ord 11/2013, and for other categories of professions, namely, for the authorization of the project checkers, quality technical experts and extrajudicials in the electrical installations domain. Figure 2.1 shows the logical diagram of the electricians authorization, under the said Regulation.

2.2. Skills validation/certification of the profession as an electrician in ITALY For traditional and historical reasons, in Italy, a wide range of professions in engineering and other technical professions are administered by the Ministry of Justice, which has been along the time the promoter of many legal acts in various fields. Thus, in Italy, the engineering profession is a regulated one, but not all the graduates of high technical education get the title of an engineer. For example, university graduates from the electrical domain do not get the title of engineer. In Romania, the engineering profession is not regulated, but the formation is regulated. The person follows a study course of at least four years, followed by a bachelor's degree. An important difference towards Romania is the fact that, in Italy, the Autorita per L’Energia Elettrica e il Gas - AEEG (similar to the National Regulatory Authority in the Energy domain - NARE in Romania) has no powers of competent authority on training and / or qualification recognition, but only on the energy market regulation. The professions that in Romania are managed by NARE (the electricity and gas domains) are regulated in Italy by other ministries, primarily, the Ministry of Economic Development (tab. 2.1). The CEI 11-27 norm regulates the nomination of the persons responsible (il Responsabile dell’Impianto - RI, Preposto ai Lavori - PL). For example, every hair or cosmetics salon in Italy, there must be a technical manager. Technical Officer Qualification Hair Stylist is released in Italy by the region, based on training, courses or extra practice. Training can be of different durations, depending on how much time the person has been working in the field. It is taken into account the skills acquired in informal and non - formal framework and longer courses are organized for people who have no experience. At the end, an exam is sustained, after which the person is entitled. A document that will prove the skills gained will be issued by the regional authority, and with this document, the person can open a salon autonomously, can have employees, can work independently or work as an employee in a salon. In Italy, the CEI 11-27 Norm presents the method of naming of the person responsible with the electrical installation (il Responsabile dell’Impianto - RI) and of the person responsible with leading the work activity (il Preposto ai Lavori - PL), who have established specific roles and responsibilities, and also the conditions of formation of 'superiors' and 'supervisors' in this area, owners of plant and workers, including occupational safety rules. Training involves the following curriculum: - Legislative acts and regulations on electrical safety; - The CEI EN 50110-1 Norm - ”Making Electrical installation ” and CEI 11-27 Norm – “Electrical installation work”:  Professional profiles of electricians ;  Criteria for the award of the expert qualifications (PES - Persona ESperta), approved person (PAV - Persona Avertita), and establish the ability to work under pressure, case studies;  The way of determining the person responsible for carrying out electrical installation (il Responsabile dell’Impianto - RI) and the

person responsible for directing the work activity (il Preposto ai Lavori - PL) – defining of such tasks, roles and operational responsibilities;  General principles of safe performance of electrical work;  Planning electrical work: work plan, action plan, deliver work;  Working procedures for high tension electrical work, near high tensions installations and disconnected from the power plant;  High tension non-electrical work (electrical work related), near the high tension plants and decoupled from power plants; Temporary and mobile electrical work; Risk assessment power under Decree 81/2008; Final evaluation test.

Training is provided by certified trainers, able to provide theoretical and practical training. The teachers are experts with experience in design, maintenance and verification of electrical installations, electrical engineering graduates, graduates of special courses "Formare Formatori” and registered in the electrical registers. The CEI 11-27 Norm divides the specialists in the electrical instalation domain, and the training courses, in four categories, as follows: 1A, 2A, 1B şi 2B. Levels 1A and 2A are dedicated to the responsibles with the development of the installations and managing of works and have the programs mentioned above. For levels 1B and 2B, dedicated to operators, the curricula, in accordance with CEI 11-27, is as follows: Level 1 B – knowledge and operating skills (training and proper understanding of a work plan and a contingency plan, define, identify, delimit the working area and the area of intervention, the introduction of insulation and protection, location of equipment and devices, grounding and short circuit, check the voltage and safety ground binding, assessment of environmental conditions, knowledge of first aid) Level 2 B - knowledge of the techniques work under pressure:

Organizational experience: preparing the work, risk prevention, transmission or exchange of information between individuals in the team, assuming specific roles. Specific experience for the type of activity for which the person must be eligible: workplace analysis, equipment selection, definition, identification and delineation of the workplace, protecting parties under high voltage training, mastery of operational sequences for execution of work. Exercises and practical tests: replacing a device under high voltage protection, for household and similar panels, replacing the voltage of a protective device for industrial use etc.. The final evaluation of participants is based on theoretical and practical tests exam.

Regarding the regulated professions listed in the IMI database, out of the 155 professions existing in Italy, only one can be attributed to the electric field, summarized in Table 2.3. Skills validation/certification of the profession as an electrician in SPAIN In Spain the 2005/36/EC Directive was transposed by the "Royal Decree 1837/2008”, which presents in Annex VIII, the alphabetical list of all regulated professions and activities, grouped according to the training level available in Spain (Article 19 of the Royal Decree is equivalent to the Article 11 of 2005/36/EC).

Objective: The participants must acquire the knowledge and experience, necessary to perform all residential facilities required under the regulations. Thematic result Lift maintenance engineer /Lift contractor/Lift electrician: Installs the boxes and electrical circuits in ceiling, interior and exterior walls. Fitter electrician: emergency lighting, escalators, water pumps, photocells, fluorescent lighting calculations and project electrical installations, ventilation systems. The conduct and course duration. The full course is divided into two modules, one theoretical and one practical. The fitter electrician course has 7 units and the electrician plumber has 16 units Graduating. To promote the course, an exam for each module and a final exam is required. Registration requests. The administrative requirements consist of four copies of the identity card and study certificate. The skills validation / certification procedure for the profession Installer of low-voltage photovoltaic systems is established by the Royal Decree 842/2002, which approves the regulation of low voltage electrical engineering and technical instructions bt 01 bt 51 regarding the low voltage electricity. The activities are exclusively reserved for achievement, maintenance and repair of low voltage electrical installations. The ITC-BT-03 regulation on low voltage energy, classifies the installers into two categories: basic installers, with limited installation duties, and specialized installers, for extending the responsibility to design, maintain and explote. Low Voltage Installers must work in a company working with active low-voltage installations. The skills validation/certification procedures for the Installer of high-voltage photovoltaic systems profession is established by the Royal Decree 223/2008, approving the Regulation on technical conditions and safety guarantees in high voltage lines and technical instructions LAT ITC-01-09, Royal Decree 560/2010, amending certain Regulations on Industrial Safety, Law 17/2009 on free access to activities and Law 25/2009 amending certain laws, to harmonize with the Law 17/2009. Obtaining a qualification certificate for the profession, issued by the competent organization of the Autonomous Community is conditioned by one of the following training requirements: a) Bachelor's degree, which covers the areas covered by the Regulation on technical conditions and safety guarantees in high voltage power lines, b) professional diploma or qualification certificate included in the National Catalogue of Professional Qualifications, whose area of jurisdiction meets the requirements of The Regulation c) recognized training, gained through experience, in accordance with the provisions of the Royal Decree 1224/2009, paragraph - Technical Instructions. Modification and repair of non-control systems used to control power functions;  Fast connection and disconnection of electrical machinery and equipment;  Maintenance, calibration and repair of electrical machinery and equipment, that is connected to the fixed installation during operation. The legislation also establishes the work categories, that are mandatory performed by the Electrical Contractors. The authorization is valid for 5 years and includes elements of time, individual tasks, types of activities and the geographical area in which the holder may practice. The authorization is given in the conditions in which the applicant:  Attended a training course (usually two years) as an electrician or compatible with electrician practice, and graduated an exam that fulfils all the necessary training and practice until the expiration of the five years;  Worked at least one year in a specialized company;  Has legal age and is not under guardianship;  He is not bankrupt;  He has not received in the last 3 years a punishment for breaking the law or other regulations on electrical installations and electrical equipment;  He does not have his badge withdrawn;  He is the owner or the employee of a company that has business license. The competent authority may, in certain circumstances, grant exceptions to these conditions and may refuse to grant licenses for both Danish citizens and for other states, seeking qualification recognition, under certain conditions, such as criminal convictions, spent more debts than 50 000 DKK etc. The authorization may be withdrawn for a period of up to five years if the holder:  has been found guilty of gross or repeated negligence while at work;

breached the conditions under which the authorization is issued; provided false information that led to the authorization;  no longer meets the conditions established by law;  higher public debts than 100 000 DKK. All authorized persons are submitted in the competent authority register. The electrical achieving activities are exclusively reserved to licensed electricians. institute, an "individual case procedure" is triggered (Individual Case Procedure - ICP), in which the members will assess the applicant's career and training in relation to a set of standard criteria for the classification of engineer. Depending on the situation, the members may request for additional training courses for the applicant. If these steps are successfully terminated, the next step is an interview, in order to establish the professional development (Professional Development Review - Interview PDR). If this professional assessment was carried out by a similar organization or one approved by the Energy Institute, the applicant will no longer have to interview. Based on this interview a report will be submitted to the members of the institute, who will make a recommendation to the Board of the the Energy Institute. This council confirmes the result and gives Chartered Energy Engineer qualification. There are five skills categories and performance standars, detailed in the Energy Institute Member Guide8, as follows: A. Using a combination of engineering knowledge and skills, general and specialized, in order to optimize the application and technologies; B. Apply appropriate theoretical and practical methods for analyzing and solving engineering problems; C. Technical and commercial leadership; D. Interpersonal skills (professional communication, submitting proposals, holding discussions and use feedback to improve proposals); E. personal commitment for professional standards, awareness of obligations to the profession, to society and to the environment.

Akkreditierungsrat is to accredit the specific organizations that are evaluating the studying programs. Akkreditierungsrat has 17 members, reprezentând statele federale, instituţiile de învăţământ superior, students, employers, employees and, also, international representatives. Only under exceptional conditions, Akkreditierungsrat can evaluate the studying programs. The skills validation/certification methodology for Elektrotechniker (electrical engineering) is established by the Law of the technical professions regulation ("Gesetz zur Ordnung des Handwerks Handwerksordnung) from September 24, 1998, most recently amended on July 11, 2011.11. For the electricians with secondary education, the training is done by dual system (theoretical and apprenticeship in a company) and lasts three years. To start a business in this area, it is required passing the apprenticeship (Gesellenprüfung), plus 6 years of practice, or promoting the master’s degree ("Meisterprüfung"). The needed examination (Meisterprüfung) to run a business include its registeration (Eintragung în mor Handwerksrolle). The activities to achieve the electrical plumbing are exclusively reserved to the licensed electricians. Table 2.10 presents a comparative analysis of electric professions regulated in Germany and similar ones in Romania. The Order of Engineers is the only authority in Portugal who can grant the professional title of engineer, based on the qualification level, including the Engenheiro electrotecnico/Electromechanical and Engenheiro técnico de energia e sistemas de potência/ Energy engineer and Engenheiro electrotecnico/ Electromechanical. the technical officers in the electrical domain for which in Romania, the competent authority is NARE (position 4 and 5 from the table 2.10). The skills validation/certification methodology for the Engenheiro técnico de energia e sistemas de potência/ Energy engineer is established by the Law Decree no. 349/1999 (Estatuto da Associação Nacional dos Engenheiros Técnicos), Law no. 31/2009 and the Ordinance no. 1379/2009 on specific qualifications electrical skills. Only the persons who own a license (Cedula Profissional) can practice the profession. To obtain a license, the undergraduated degree is required (Bacharelato) in the electrical engineering domain and becoming a member of the Order of Engineers. The legislation mentionts that the activities benefit of a shared reservation (in respect of the implementation, supervision and coordination of the projects) to other categories of engineers or architects, except the civil engineers. The skills validation/certification methodology as an Técnico Responsável pela Execução (Exploração, Projecto) de Instalações Eléctricas de Serviço Particular/ Electrician / Senior electrician /Specialised electrician is established by the Decree no. 31/1983 and the implementation of Decree-Law no. 229/2006, which requires one of the following requirements: a. Licensed degree (Licenciatura sau Bacharelato) in electrical engineering, plus the membership of the Order of Engineers; b. Electricians who have minimum 2 years experience, considered as having appropriate qualifications; c. Electricians with no high education, but have 7 years of practice in executing in low voltage wiring, demonstrated through a procedure of recognition of experience; d. Authorized electricians who hold a professional ID card (Carteira Professional) issued by an authority before 30.4.1981 or electricians who can demonstrate equivalent experience, registered before 30/4/1981.

3. THE QUALIFICATION RECOGNITION PROCEDURES IN OTHER EU MEMBER STATES 3.1. General items Pentru recunoaşterea calificărilor profesionale conform Directivei 2005/36/CE există trei sisteme de recunoaştere, respectiv: For the recognition of the professional qualifications under the 2005/36/EC Directive, there are three recognition systems, namely:  The automatic recognition system, based on the preventive harmonization of the training and provides automatic recognition, applicable to certain professions such as nursing, dental, veterinary, midwife, architect, pharmacist etc.  The General System of Recognition, based on mutual trust between the member states, applicable to a large number of professions, that may be different in the member states. It applies in the case where the profession is regulated in the resident country and if the migrant has pursuited or is entitled to practice the resident country. In this system, the recognition is not automatic, but it is based on a comparison of training courses - provided in the two countries and the possibility, if differences exist, to impose compensatory measures. 

Recognition of proffesional experience Annex 4, in which the recognition is based on the experience gained in the resident country. The system applies to hand-made, commercial or industrial type professions, listed in Annex IV of the 2005/36/EC Directive, and provides automatic recognition if they meet the conditions laid down for each professional category.

For the analyzed profession in the present guide, the recognition is made through the General System of Recognition, on which there are the following possible decisions (Positive – General System of Recognition (without compensatory measures), Negative – General System of

Recognition, Positive/Negative after adaptation period (General System), Positive/Negative after skills test (General System, Positive/Negative after the examination). In the case of negative decisions, the applicant can appeal in court, through the SOLVIT system. For the recognition by the General System, the request is addressed to the Competent Authority from the resident country, mentioned in chapter 2, for each profession and for each country. This request must be sent with a series of documents and certifications listed in Annex VII of the 2005/36/EC Directive. Usually, the requested documents in the analyzed countries for the EU citizens that are seeking for recognition are: 1. Proof of citizenship, usually through a copy of identity card or passport; 2. Certificate of professional competence or qualifications, which provides access to the profession (where the profession is regulated in the resident country); 3. A certified copy of some specific documents that are requested for the profession concerned, indicating the exams needed to determine the possible existence of significant difference towards the resident country; 4. Other certificates, diplomas, etc.. relevant to the profession 5. A certified copy of the submission to the Profession Register of the country in which the title was obtained, if applicable; 6. A certificate stating that there are no criminal or professional obstacles in the pursuit of the profession, issued by the competent authority of the resident country; 8. Certificate that details any occupation in the resident country, as a completion of the qualification for which the recognition is sought (including the period of practical training conducted); 9. Contact details: name, address, telephone number and email. If someone sends documents on behalf of the applicant, such as a

company or a trustee, the sender's name, address, phone and e-mail are requested; 10. Specific conditions will be explicitly mentioned in this chapter, for each profession (the belonging to a professional association in the resident country, etc.). All the documents written in a foreign language must be accompanied by a translation in the language of the host country, certified in accordance with the original text, issued by the diplomatic or consular authorities of the host country that issued the diploma, or by an official translator from the host country. The procedural steps for the qualification recognition in the host country can be summarized as below: 1. Informing the migrant byy the contact point of the host country, referred to in the next subsections, for each analyzed country; 2. Submitting the requested documents at the Competent Authority, who can notify the applicant in maximum four weeks, for any additions; 3. Processing the file, in maximum 4 months; 4. Applying compensatory measures, if any:  Skill test, preceded, possibly, by a preparatory training offered by institutions authorized by the competent authority;  Training by an accommodation period;  Evaluating the language skills, by analyzing the evidence or by an interview, oral/written test, if needed; 5. Fees – available on the websites of the competent authorities, regularly updated; 6. Release of the certificate; 7. Appeal to SOLVIT or in court, in case of a negative decision. 3.5. The procedures for the qualification recognition in DENMARK As mentioned in chapter 2, in Denmark there are two regulated professions in the electrical domain and for these, as for all the other regulated professions, there are detailed information on the website of the Ministry of Science, Innovation and Higher Education14. Also, the Danish Agency for International Education (Styrelsen International Uddanelse Fost Cirius) can make a free evaluation, regarding the equivalance of the migrant’s study program from the resident country with the Danish ones, whch is not mandatory for the qualification recognition. Providing temporary services in the EU / EEA member states. Before the first applicant’s commitment in Denmark, he needs to inform the competent authority, by a written statement. The competent authority will check the professional qualifications before the applicant starts his profession. The renewal of the declaration will be needed if the applicant wants to practice, temporary or occasional, in Denmark, in the next year. The applicant needs to attach the following documents:  Contact information: name and surname, address, telephone and e-mail;  Signed and dated statement, indicating the occupation and the intention to provide a service in Denmark, temporary or occasional;  Proof of citizenship (such as a photocopy of the relevant pages of the passport);  Certification that he is legally established to practice in a member state and that he is not prohibited, even temporarily, on practicing, at the moment of filing the application (this can be provided by member states, these are listed in Appendix B of the Code of conduct), or other document proving the legally establishment;  Certified photocopies of professional qualification documents (proof of qualifications, an attestation of competence and / or professional background, licensing, etc.);  If neither the profession, nor the training is regulated in the member state of establishment: proof that he practiced the profession for at least two years during the last ten (eg, employment contracts and certificates from previous employers, attesting his work and its duration)  Proof of lack of criminal convictions (eg, a statement of criminal record);  Information on the name of the insurance company, if any, and the contract number or other means of collective protection with regards to professional liability;

Documentation of name change / marriage certificate (if applicable). Sending the documents. If the applicant is a citizen of a country belonging to the EU or EEA and the profession is listed by the Single Point of Contact, he can send the documents electronically at the point of contact, even if it is a temporary service provider (when it is required a declaration and the accompanied documents). If the applicant's occupation is not on the list of the Single Point of Contact, he must send the documents by mail to the competent authority, responsible for processing the request. The same applies if the applicant is a citizen of a country outside the EU / EEA. 

Certified photocopies. The applicant must submit certified photocopies of essential documents (professional qualification, certificate of the acquired rights, certificates of professional experience, etc.). This means that an authority has stamped and signed each page of the copy, as confirmation that these copies match with the original documents. This confirmation can be made by a Danish authority (eg local municipality, the job center, etc.), or by the institution / authority that issued the document, or embassy / consulate in Denmark of the country where the document is issued, or a Danish embassy or consulate. Individuals can not verify the copies. If the applicant can not submit a certified copy, the competent authority can control the content and authenticity of the diploma, certificate and / or personal data. Translations. The applicant must submit certified translations of the essential documents ( professional qualification , certificate of acquired rights, certificates of professional experience, etc. ). Standard documents such as ID cards, passports, etc., should not be sent as certified translations. Documents issued in English, Norwegian or Swedish should not be translated. Documents issued in other languages must be translated into Danish or English. Application form. There is no application form. The applicant should send a letter, mentioning the profession and to explain that he wants to work as a permanent employee, indefinitely. He must include the documents listed below at the "Documents required" section. Germany adopted, on April 1st, 2012, the “Recognition Act�18. Before this date there was no standard procedure for the professional qualification recognition acquired abroad, although almost three million persons with a professional qualification acquired abroad live and work in Germany. Today, many people from other countries work in Germany on occupations that are not consistent with their skill level. Because the German economy is dependent on skilled workers, the German government enacted the Law for improving the assessment and recognition of foreign qualifications, also known as the Law on recognition or the Recognition Act. This helps to equate the procedures for the professional qualifications and supports the skilled migrants and skilled foreign workers on the labour market in Germany. Germany has no central organization, that is responsible for all the foreign requests of the professional qualification recognition. The responsible authorities are available in every land. The Federal Institute for Vocational Education and Training has created a portal for recognition process in Germany, on the website of the Federal Ministry of Education and Research, to help individuals in seeking foreign recognition of their professional qualifications in finding an authority to investigate the case and provide prompt answers to their questions about the procedure of recognition. The portal is aimed not only for the immigrants who already live in Germany and have gained professional qualifications abroad, but also for the skilled workers from other countries, who are interested in working in Germany. The portal also helps the staff who advises individuals who are seeking for the recognition of qualifications acquired abroad. This portal 19 directs people who are seeking the recognition of a certificate or a diploma by an authority that is responsible for assessing 18 19

those skills and provide important information on the laws and regulations underlying the recognition of foreign qualifications procedures. In addition, the portal provides tips and information on career guidance. If one of the qualifications was obtained abroad, the diploma’s equivalent can be checked with the German titles, that will give the right to practice without a title granted, under the Law of determining professional qualifications – Berufsqualifikationsfeststellungsgesetz/ Professional qualification determination Act (BQFG)20. The access to this procedure may vary, depending on the special requirement of the regulated professions. In some cases, there are no procedures in place to assess qualifications from third countries. In the base of the BQFG law, a request can be submitted by any person who:  Has the professional qualifications obtained in a EU/EEA country;  Intents to practice paid employment in Germany. The procedure is not available for the unskilled or semiskilled persons, who don’t have the professional qualifications. Responsible authorities 

The Chambers of Commerce and Industry, who are primarily responsible for considering the equivalence training in the dual system and the central authority for industry and commerce: IHK FOSA (Approval of Foreign Skills). The responsibility in the regulated professions domain is based on the specialized laws and regulations of each Land.

The procedure compares foreign qualifications, with a similar German occupation; The competent authority shall consider whether there are fundamental differences between foreign qualifications and the German professional qualifications; Professional experience acquired in Germany or abroad can also be taken into account in addition to training; If it is not possible to provide adequate evidence of qualifications, an analysis can be performed to determine the qualifications of professional skills (eg, technical discussions and work sample); The procedure is the subject to a fee. The amount is based on the tax table of the authority and depends on the cost and effort involved in implementing the procedure. The responsible authority may provide accurate information regarding the tax.

Possible results 

If the examination is positive, the authority issues an equivalence certificate in unregulated professions. This has the same legal consequences as a German professional qualification. There is a certificate of the German examination. The procedure is a prerequisite for access to employment in regulated professions; When there are considerable differences between foreign qualifications and German skills, the following distinctions must be implemented: In the case of training occupations, the competent authority describes the existing professional qualifications and describes the differences between these and the German ones. This will help when applying for jobs and make it possible to obtain additional qualifications, if necessary; In the case of regulated professions, there may required an adaptation measure (test or adaptation period) in order to

achieve the equivalence. The compensatory measures vary according to the individual special laws. The responsible authority may provide information on how accurate. Translations will be prepared by the public appointed and sworn interpreters, translators in Germany or abroad. The competent authority may waive the need for translation. The length of the procedure  

The responsible authority begins evaluating the equivalence immediately after all the necessary documents are received. From December 1st, 2012, the procedure should not take more than three months. In difficult cases, the decision period may be extended once, for good reasons. The decision-making period starts with the receipt of all required documents.

For the recognition of these two qualifications, there is the additional requirement to be a member of the Orders of Engineers in Portugal. According to the operation rules of this Order, candidates for the membership on each category (effective member, trainee member, honorary member, student member and collective member) must submit an application to the regional secretariats of the Order. For the admission, the candidate's resume is reviewed and possibly he is the subject of a test. In 1993 the rules were changed so that the master’ s graduates and the owners of the doctorates titles may be exempted from the admission exam, based on comparasion with the program.. The admission as a member for each category is is preceded by the completion of an internship, as a "probationary member". In the second chapter of the Order’s Rules, there is presented in detail the admission for each of the six categories of membership. 3.11. The SOLVIT system The SOLVIT system is a problem-solving network, in which the EU member states work together to solve the problems resulting from improper application of the law by the public authorities. Among the areas in which the issue frequency is high and there are complaints to be dealt by SOLVIT, there is also the professional recognition of qualifications and diplomas, along with other areas such as access to education, residence permits, voting rights, social security, free movement of capital and payments etc. In each EU member state there is a SOLVIT center, that provides these services, free of charge. For the analyzed countries and for Romania, the data regarding the SOLVIT centres are presented in Table 3.1. SOLVIT centres22

The complaints can be submitted on-line, on the documents available on the SOLVIT websites from each country (Table 3.1). Any complaint through SOLVIT implies four stages to resolution:  the case is accepted, the legal base is being checked, if the documents that were included in the base by the origin center are not sufficient, additional documents are required;  obtaining the solution: the competent authority that is involved in the case is contacted and it cooperates in order to obtain a solution that is a fair, in accordance to European legislation;  solution proposal (implemented or not) – the solution must be real, practical and in accordance to European legislation;  Monitoring the implementation of the applicant's proposal to solve the case. SOLVIT potential is still insufficiently exploited as a problem solving key instrument at a national/European level, partially because of the insufficient staff from different SOLVIT centers and also because of the

insufficient information received by the European citizens regarding the competencies of these centers. 4. THE PURSUIT OF THE FORESTRY PROFESSIONS IN THE ANALYZED COUNTRIES 4.1. The pursuit of the electrical professions in Romania In Romania, the professional pursuit from the electrical domain is regulated under the Ord 11/2013 - "Regulation Approval for licensing electricians, project checkers, technical executer and quality technical expert and extrajudicial in the electrical installations domain” published in the Official Gazette no.152/21.03.2013. The most important provisions concerning the pursuit of the four categories of occupations, covered by this order, are as follows. Electrical Contractors have the right to pursuit activities according to their skills, mentioned in article 35:

A. As authorized individual, sole proprietorship or a family business member (only grades II, III and IV); B. As an employee of an economical operator, who pursuits activities on the basis of the certificates issued, by the competent authority; C. As an employee of a network operator; D. As an employee of an economical operator, as a producer or final electrical customer, industrial or similar. The extension of validity is completed as:  The extension of validy of the Electrical Contractor quality, for the same grade / type of authorization, can be requested during the moment of the expiration, and an Electrician identification card is issued;  The extension of validity can be submitted with the request for the extension of validity of the electrician identification card,

IIIA or IVA grade, during the session when the validity expires.  The quality extension of technical recognition validity cand be submitted with the request to extend the electrician identification card, IIIB or IVB grade, during the session when the validity expires.  The extension of the quality technical expert and extrajudicial in the electrical installations domain validity can be submitted with th request to extent the validity of the electrician indentification card, IIIA=B or IVA+B, during the session when the validity expires. If the request is not submitted during the expiration session, the holder will be found on the list of individuals whose cards have expired, which is published and regularly updated on the website of the competent authority. 4.2. The pursuit of similar profession in the analyzed EU countries In Italia the pursuit of the professions in the electrical area is compliant to some specific regional and autonomous provinces regulations. The professions from the Installazione impianti elettrici categories , in which we also find the Impiantista/ Electrician profession, which are responsible for the overall technical occupation that should be mandatory in any company, in which there is work with electrical appliances. The CEI 11-27 Norm regulates the appointment of persons (il Responsabile dell’Impianto - RI, Preposto ai Lavori - PL). For pursuing in Spain as a Ingeniero de Construcción y Electricidad/ Electromechanical engineer, there is the legal obligation to become a member of the College of Civil and Electrical Engineers / Colegio Oficial de Ingenieros de Construcción y Electricidad and to be registered in the Register of this college, valid for all those who practice

this profession is available for all those who practice it, in various types, either free or in private entities when using this title. In the UK for pursuing one of the analyzed professions, it is mandatory to become a member of a professional organization. So, for pursuing the Chartered Energy Engineer profession, the additional condition to become a member of the Energy Institute23 is mandatory, which is the competent authority in the recognition process, and to have at least five years of experience in the area. For the Electrical and computer (technology) engineer profession, it is mandatory to become a member of the Engineering and Technology Institution. In Portugal, in order to pursue the Engenheiro técnico de energia e sistemas de potência/ Energy engineer and Engenheiro electrotécnico/ Electromechanical, it is mandatory to become a member of the Order of Engineers in Portugal/Ordem dos Engenheiros24. According to the rules of operation from this Order, annually, the professional progress for each member can be assessed, at his request (art. 16), followed by the appropriate update of the degree or skill. Also, once in seven years the professional progress is reviewed and certified from the academic level E1 (Members with a degree in engineering EQF level 6), the E2 (Members with master's degree in engineering EQF level 7) and then E3 (Members with PhD in engineering - EQF level 8) (art. 17). On the other hand, each member can traverse three levels of professional qualifications for receiving membership, a Senior Member and the last step, Advisor Member. Membership is granted to E1 levele candidates, and the Senior Member one is given to the E2 and E3 levels, members who have at 23 24

least 5 years of experience and at least 3 recommendations from senior members or advisor members. To obtain the counselor membership, it is required a minimum of 5 years as a senior member or 15 years as a member or 20 years of professional experience in the field, plus three recommendations from other members councilors. All fees are established and maintained by the National Board of Directors. In the other countries, to pursue the analyzed professions in chapters 3 and 4, there are no special conditions. 5. CONCLUSIONS The present guide covers aspects of skills validation / certification, recognition and pursuit of the profession in Romaniain the electrical domain, compared with identical, similar, homologous or compatible professions from nein EU member states, namely Austria, Czech Republic, Denmark, Germany, Italy, UK, Netherlands, Portugal, Spain. These professions are discussed in detail in Chapters 2, 3 and 4, for the countries listed. This analysis took into account the fact that in Romania, the professions in the electrical domain are regulated by NARE and there have been identified the competent authorities for each country, for each of the analyzed profession. Even if in Italy, Autorita per L’Energia Elettrica e il Gas - AEEG (which is similar to NARE in Romania) does not have any responsability as a competent authority regarding training and / or qualification recoognition, but only to regulate the energy market, in the case of professions from this country, there has been identified a large number of similarity to those in Romania in terms of types and authorizations degrees.

Achieving the certification and qualification recognition guide in the electrical domain, primarily, seeks to be a useful tool to inform all persons who may be in the situation: 

To follow a training program in one of the analyzed countries, at the end of which is to pursue a similar profession in the electrical domain; Has a similar qualification to the one from Romania and wants to want to be recognized and to practice in the analyzed countries, temporarly or ocasionally; After recognition in one of the analyzed countries, they want to know the regulations and obligations regarding the pursuit of the profession, the professional conduct and ethics in the field, the membership in certain professional organizations etc.

Equally important, the guide aims to support the competent authorities of Romania in its efforts to standardize the certification and recognition of regulated professions that they manage, by informing them about the practices of other EU member states. The main limitations of the guide are that it only deals with the situation of 9 EU countries, set for all the developed guidelines and some information, generally the statistics, are available when developing guidelines and should be updated regularly. Although the IMI number of recognition decisions is not as high as in other professions (nurses, doctors, etc..), in the electric field there is still a significant number of decisions that are discussed in Chapter 3, for each country and for each profession, especially in regards to Austria where the profession Elektrotechnik / Electrical Engineer has 495 recognition decisions (and only 2 – negative! for Romania) and 276 temporary mobility decisions (none for Romania). In other countries, such as, for example Italy there is a greater number of positive decisions (15 decisions, out of which 11 were positive). In Chapter 4, there are highlighted the professions whose pursuit is the subject to certain membership organizations, colleges, orders etc.
