A Message from the Dean

DEAR ALUMNI AND FRIENDS: On the following pages you will read how Widener Law is making significant contributions to American legal education, to the legal profession, and to the communities in which we are located. Our full-time faculty are becoming more internationally known through their scholarship and leadership. Justices from the highly respected Delaware Supreme Court and judges from state and federal courts in several states continue to serve among our adjunct faculty. We are rigorously training Widener Law students to be well-rounded citizen lawyers who will step into leadership roles of their own. Ninety-one percent of the Class of 2006 were employed or in graduate school within nine months of graduation—our best figure in 10 years. While most of our 12,000 living alumni are concentrated in Delaware, Pennsylvania, Maryland, New Jersey, and New York, Widener graduates can be found across the country and in foreign locations. These great lawyers are being honored for their skills and are being elected to the bench and other significant government posts. Widener Law is a unique law center in America. We have campuses in two states as well as programs around the world, and we train individuals from post-high school to the judiciary. Your ongoing support enables us to be who we are and who we are becoming. Thank you. If my inaugural year as your Associate Provost and Dean is any indication of our future, even greater things are in store.

Linking Law and Public Health IN MAY Widener University School of Law and Thomas Jefferson University announced the launch of two new joint-degree programs in law and public health. Students can work toward either a juris doctor and master of public health (JD-MPH), or a master of jurisprudence in health law and master of public health (MJ-MPH). These two new dual degrees are designed to prepare students who are pursuing careers in fields such as public health administration, health insurance organization leadership, health consulting, and the pharmaceutical industry. They can be completed in three to seven years, depending on which program the student chooses and whether enrollment is part- or full-time. “This partnership brings together two leading institutions in a growing and important field,” Dean Linda L. Ammons said. “We are pleased to join Jefferson in this exciting endeavor.”

Class of 1978 Launching a New Scholarly Endeavor A NEW LAW JOURNAL, conceived by Widener students last year and funded with a generous grant from the law firm of Maron Marvel Bradley & Anderson, will focus on the intersection of law, economics, and race. The Widener Journal of Law, Economics, and Race, an idea generated and developed by students Robert Hawkins, Tamika Crawl-Bey, and Dana Griffin, will be disseminated in a completely electronic format beginning during the 2007-08 academic year. It will be a collaborative endeavor involving students on both the Wilmington and Harrisburg campuses. “The Journal will serve as a training ground where we emphasize for our students the importance of becoming ‘good citizens’ as they become leaders in business and government,” wrote Mr. Hawkins, Ms. Crawl-Bey, and Ms. Griffin in their grant proposal.

Recognizing Special Achievement WIDENER LAW Professor Juliet M. Moringiello received the Pennsylvania Bar Association’s Special Achievement Award in June for her efforts toward making Pennsylvania a more businessfriendly state. The award recognizes Professor Moringiello’s role in the Uniform Commercial Code enactment process. She chairs the Uniform Commercial Code Committee of PBA’s Business Law Section, playing a leading role in promoting the enactment in Pennsylvania of two revised Uniform Commercial Code articles: Article 1, setting forth the general provisions of the code, and Article 7, providing the rules governing the use of documents of title in commercial transactions. Professor Moringiello has been involved in the Uniform Commercial Code enactment process since the late 1990s, when Pennsylvania was considering the enactment of Article 9, governing secured transactions. She teaches and writes primarily in the areas of commercial law, bankruptcy, property, and electronic commerce.

Fighting for Benefits WITH STATE FUNDING from Delaware and Pennsylvania, Widener’s Veterans Law Clinic has collected, on a pro bono basis, more than $1 million for disabled veterans and their dependents since its launch in 1997. It is the only clinic of its kind in Pennsylvania and one of only two in the United States. The Clinic’s director, Widener Law Professor Thomas J. Reed, participated in a roundtable discussion in May in Washington, D.C., at the invitation of Rep. Bob Filner, D-Calif., chairman of the U.S. House of Representatives Committee on Veterans’ Affairs. The discussion was among the U.S. Department of Veterans Affairs, claims stakeholders, and members of the committee Filner chairs. Professor Reed spoke during a discussion of ideas to reduce the claims backlog and improve the current process for veterans.

ALAN E. GARFIELD, whose term as Widener’s H. Albert Young Fellow in Constitutional Law ended in June, discussed “The Constitution as a Symbol” when he delivered the Young Fellowship Lecture in April. In his remarks Professor Garfield, who teaches and writes in areas of constitutional law, the First Amendment, copyright, and contracts, explored how the Constitution is important not only for what it says, but also for what it symbolizes. He examined the role of religion in American society and addressed such controversial topics as the teaching of intelligent design and the display of Ten Commandments monuments. The H. Albert Young Fellowship in Constitutional Law was endowed in 1998 by the Young Foundation of Wilmington in honor of the late H. Albert Young, a highly respected attorney and former Delaware attorney general. The fellowship enables a Widener Law professor to conduct and publish research in the area of Delaware or U.S. constitutional law.

Rebuilding a Legal System NINE WIDENER LAW students from the Delaware campus, accompanied by two professors and a civic-minded Philadelphia public defender, spent a week of their winter break taking part in the Katrina-Gideon Interview Project, a national initiative through which law student volunteers traveled to New Orleans to assist the beleaguered Public Defender’s Office there as it tries to catch up on the backlog of cases caused by Hurricane Katrina. Professors Judy Ritter and Arlene Rivera Finkelstein supervised the students’ work, and the group was also accompanied by Everett Gillison, a public defender in Philadelphia’s homicide division. The students who participated all graduated in May. They are Brett Bendistis, Lisa M. Vetro, Danielle A. Graham, Jessica Sanchez, Julie A. Serfess, Nazim N. Karaca, Rachel A. Ramsay, Eric H. Lubin, and David Iannucci. Gifts from alumni and other friends of the Law School helped make this trip possible.

Saluting Students STANDOUT STUDENTS were honored in April at each campus’s Annual Student Awards Ceremony. Darlene Ghavimi-Alagha (Delaware) and Elizabeth F. Murdock (Harrisburg) received the Dean’s Award, for outstanding legal aptitude, exemplary service, significant leadership skills, and the potential to become an outstanding member of the legal community. The President’s Award, for demonstrated scholastic achievement and high potential for meaningful contribution to the law school, the community, and the profession, went to Janine Hochberg (Delaware) and Nicole E. Carter (Harrisburg). Dozens of other awards in scholarship and achievement were handed out, and more than 70 graduating students were honored for performing at least 50 hours of pro bono legal services during law school.

In Support of Excellence ONE OF THE SCHOOL OF LAW’S most generous benefactors saw its support rewarded with significant professional recognition for a faculty member and continued growth of a prestigious student competition. The Ruby R. Vale Foundation funds the Ruby R. Vale Professorship, whose holder, Lawrence A. Hamermesh, was appointed chairman of the Committee on Corporate Practice of the ABA’s section of business law. The committee has a membership of more than 320. Professor Hamermesh teaches and writes in the areas of corporate finance, mergers and acquisitions, securities regulation, business organizations, corporate takeovers, and professional responsibility, and has been quoted in such media outlets as The New York Times, The Wall Street Journal, and Financial Times. In addition, the Ruby R. Vale Interschool Corporate Moot Court Competition brought 24 teams representing 20 different law schools to the Ruby R. the final round of oral argument included justices of the Delaware Supreme Court and vice chancellors from the Delaware Court of Chancery. Florida State University College of Law bested Mercer University’s Walter F. George School of Law as overall winner; best oralist was awarded to a student from the College of William and Mary’s Marshall Wythe School of Law, and best brief went to Florida State. The Vale Competition will celebrate its 20th anniversary in 2008. Over the last two decades, approximately 1,000 student competitors have come to the Law School to participate; they have been joined by many faculty and student coaches as well as distinguished visiting scholars.

Honoring a Pioneer’s Legacy SHEILA SALVANT-VALENTINE, MD, a student in Widener’s Master of Jurisprudence in Health Law Program, was named an Albert Schweitzer Fellow by the Delaware Valley Schweitzer Fellows Program. Dr. Salvant-Valentine’s fellowship project involves community service aimed at the Haitian community. She will spend more than 200 hours over the course of a year, through Delmarva Rural Ministries, focusing on health care access for Haitian immigrants. Her work will primarily involve translation and education regarding cardiovascular disease and risk.

Recognizing A Mentor A NEW ANNUAL LECTURE SERIES honoring a beloved, longtime professor, mentor, and administrator debuted in April on the Harrisburg campus. The inaugural John Gedid Lecture, recognizing the director of the Law School’s Law and Government Institute, welcomed Melissa Waters, associate professor at Washington and Lee University School of Law, who discussed the war-crimes trial of former Iraq President Saddam Hussein. Waters trained Iraqi judges and attorneys in international human rights law and criminal defense law; some of those judges went on to preside over Hussein’s trial. Supporting the Gedid Lecture series are Aspen Publishing and the Harrisburg faculty. There is an ongoing effort to obtain gifts to endow the John Gedid Lecture.

Dedicating a Library, Honoring a Founder MORE THAN 40 ALUMNI gathered in May to celebrate the dedication of the Alfred Avins Special Collections Library at the Law School’s Delaware Campus. The event honored Dean Avins, the founder of Widener Law, and was the culmination of a fundraising campaign in his honor to benefit the Special Collections Library and a scholarship in Dean Avins’ name. Attendees traveled to downtown Wilmington to tour what is now the Sharon Temple Seventh-day Adventist Church. The Church was the home of the School of Law during its early years. Alfred Avins founded the Delaware Law School in 1971. His determination and resourcefulness were remembered with gratitude by all who contributed to the fund in his honor.

Supporting Public Interest Work IN MARCH members of the Lodge family, the Lodge Scholarship Committee, and donors gathered at the School of Law’s Delaware Campus to celebrate the awarding of the first Thomas S. Lodge Memorial Scholarship and to congratulate its first recipient, Harrisburg campus student Lisa Kelly. The scholarship honors the late Tom Lodge, an esteemed member of the Delaware Bar who served as a University trustee and as a School of Law overseer, and will be awarded annually to a student who has a demonstrated commitment to public interest legal work. It was made possible by gifts from the Lodge family, the Delaware bench and bar, faculty and staff, parents, and friends of Widener Law.

Seeking True Representation A VARIETY of diversity initiatives on both campuses in 2006-07 reflected a concerted effort by the School of Law to make the legal profession reflect the population it serves. The School hosted several lectures and symposia featuring legal scholars addressing diversity-related issues; especially noteworthy was the Dean’s Leadership Forum on Diversity on the Harrisburg Campus, focusing on diversity in higher education. It also assembled the new Dean’s Alumni Diversity Advisory Committee, launched several Diversity Pipeline Programs, and hosted the first Delaware State Bar Association Diversity Retreat. Our diversity efforts were recognized by the American Bar Association, whose Law Student Division honored the School of Law with its 2007 Henry Ramsey, Jr., Diversity Award. The award is presented annually in recognition of excellence and activities that have contributed toward the advancement of women, minorities, and persons with disabilities in the profession. The Widener chapter of the ABA Law Student Division accepted the award at the annual meeting of the American Bar Association in San Francisco in August. Honoring a Legend through Action JANUARY’S PROGRAM honoring the memory of Dr. Martin Luther King, Jr. became the forum for a kickoff of a new initiative on the Delaware campus: the Martin Luther King, Jr. Semester of Service. Professor Arlene Rivera Finkelstein, who took part in a panel discussion at the event, used her turn at the podium to announce the program, which enlisted students, faculty, and staff as 2007 MLK service fellows. The program called for 12 hours of service in 12 weeks. It was a collaboration of a faculty-student committee made up of Professor Robert L. Hayman Jr., Professor Micah J. Yarbrough, Professor Finkelstein, and student Jessica Sanchez. “We ask you to help us live the dream, as a law school,” Professor Finkelstein told the crowd.

Giving Scientists a Legal Voice WIDENER LAW PROFESSOR John C. Dernbach was one of four legal scholars to prepare arguments last year on behalf of 18 climate scientists in Massachusetts v. Environmental Protection Agency, a landmark U.S. Supreme Court case. Professor Dernbach and his colleagues represented a group asking the court to require the U.S. Environmental Protection Agency to revisit the question of whether greenhouse gases from cars and trucks should be regulated. It was the first U.S. Supreme Court case to deal with climate change. The group of scientists on whose behalf Professor Dernbach and the other attorneys filed an amicus brief included James Hansen, head of the NASA Institute for Space Studies, nine members of the National Academies of Science or Engineering, and two Nobel Laureates in chemistry who study the earth’s atmosphere. Professor Dernbach did the work on a pro bono basis. The brief argued that EPA had mischaracterized or misrepresented the relevant science in deciding not to regulate greenhouse gas emissions from motor vehicles. In April the Court held that EPA erred by not controlling greenhouse gas emissions. The majority opinion reflects the science described in the brief. John C. Dernbach did influential pro bono work on behalf of climate scientists.

Defending the Environment WIDENER STUDENTS in the Environmental and Natural Resources Law Clinic last September won a decision for their client in a Pennsylvania state appeal that sent a message to developers about taking state regulations seriously. The students, in collaboration with the Mid-Atlantic Environmental Law Center, housed alongside the clinic at Widener’s law campus in Delaware, represented, on a pro bono basis, Blue Mountain Preservation Association, a nonprofit civic group based in Monroe County, Pa. The Association had challenged a decision by the Pennsylvania Department of Environmental Protection to award a storm water discharge permit to a resort company that wanted to build a members-only recreation facility on the side of the county’s Blue Mountain. Students successfully helped argue that the company’s plans to discharge into the Aquashicola Creek, a high-quality, cold-water fishery in Monroe County, failed to comply with Pennsylvania’s antidegradation regulations regarding discharges to the creek.

Judging “Intelligent Design” WIDENER LAW’S Harrisburg campus welcomed U.S. District Judge John Jones for a talk on judicial independence in October. More than 200 people, predominately students, attended the hour-long discussion. Judge Jones explained how the highprofile “intelligent design” case of Kitzmiller v. Dover, over which he presided last year, ignited a passion in him for matters pertaining to judicial independence. He said that case, and the firestorm of attention it received from special interest groups, the media, and pundits, taught him the public needs to know more about how judges operate. Judge Jones suggested to the Widener students that judges and attorneys must do more to speak to the process of law and how the courts work, with an eye toward educating the public. C-SPAN aired Judge Jones’ presentation on its America & the Courts program and through its Web site, www.c-span.org.

Serving the Underserved WIDENER’S HARRISBURG Civil Law Clinic formally opened its new office space on Vartan Way with an open house in February. The clinic provides a vital service to people in need who require legal assistance but do not have the financial means to pay for an attorney. Students represent real clients and gain invaluable educational experience meeting with them, preparing documents for their cases, and arguing on the clients’ behalves in court. Clients get quality representation they could otherwise not afford. The clinic handled 160 cases last year. Similarly, the School of Law’s Delaware Civil Clinic, which took up 33 cases, provides free legal services to indigent clients in the First State with civil legal problems. It operates in conjunction with Delaware Volunteer Legal Services, the pro bono arm of the Delaware State Bar Association. The Delaware Campus’s Pennsylvania Civil Clinic, which deals with family law and bankruptcy, handled 22 cases. Widener students also staff the Legal Help Link, a toll-free phone line, and in 2006-07 responded to approximately 20,000 calls from people seeking legal representation.

Hearing From Leaders DEAN LINDA L. AMMONS inaugurated a forum series on each campus to give Widener Law students first-hand access to the insights of noted leaders. On the Delaware Campus, the Dean’s Leadership Forum focuses on the experiences of Widener Law alumni and provides an opportunity for students, in a conversational setting, to learn about what it takes to be a leader in legal and other communities. George K. Miller, Esq. ’81, a successful attorney, businessman, and community leader, spoke at the first forum, in November. In Harrisburg, Dean Ammons kicked off the first Dean’s Leadership Forum on Diversity, with a focus on diversity in higher education, in March. The daylong public conference featured 13 speakers, including Frank W. Hale, Jr., vice provost and professor emeritus from Ohio State University.
