Boone County’s top prosecutor works to restore confi dence Chris Mayhew

Cincinnati Enquirer USA TODAY NETWORK

Louis Kelly, the top elected prosecutor for Boone and Gallatin counties, ran on a pledge to clean up the offi ce. Kelly said he waited at fi rst to hear who was going to challenge 18-year incumbent Linda Tally Smith as a candidate. The 42-year-old who plays drums in a blues band as a hobby, said he would have supported someone else. He said he talked to friends, who encouraged him to seek the offi ce. "I saw what I felt was an ethical lapse of my predecessor and I felt somebody’s got to run, because I felt like the public had lost confi dence," Kelly said. Tally Smith had been resisting calls to resign for a year after her involvement in a scandal overturned one of Northern Kentucky's most high-profi le murders. Voters elected Kelly with a landslide victory in 2018 over incumbent Tally Smith Tally Smith. He received 68 percent of votes cast. Tally Smith fought off calls for her to resign during her last year in the offi ce. A clerk fi red by Tally Smith had handed over a thumb drive to the attorney general. Text messages on the thumb drive revealed an aff air developed between Tally Smith and detective Bruce McVay after David Dooley's 2014 murder trial. The murder case was on two episodes of Dateline and received national attention. McVay was the lead detective on the case. The thumb drive also contained messages between McVay and Smith which raised questions about if the defense had access to all evidence. Circuit Court Judge J.R. Schrand agreed evidence was withheld. He ordered a second trial. Dooley was convicted a second time in 2019 in the killing of Michelle Mockbee in 2012 at a warehouse where they both worked. He was sentenced to 43 years in prison. Becoming a Commonwealth's Attorney was never an aspiration before the

news about Tally Smith spread, Kelly said. "It was when all this kind of stuff blew up," he said. "And it wasn’t clear that someone was going to run and challenge her." Upon taking offi ce, Kelly said he decided defi ning success wasn't going to be about the number of convictions. "It needs to be just about doing the right thing," Kelly said. The offi ce has four full-time attorneys and a part-time attorney plus support staff . They handle about 1,200 circuit court cases fi led each year, he said. Some cases can take two or more years

to prosecute. Kelly said he has focused his offi ce on bringing a timely and just resolution to cases. "And timely, because I do believe in the presumption of innocence and I don’t want people sitting in jail or with an indictment over their head for multiple months and years if we can avoid it," he said. He created a rocket-docket program that has handled more than 200 of the cases in 2019. Defendants accused of lower-level off enses including fi rst-time drug possession or thefts of just over $500 from stores where merchandise

was recovered are off ered the rocket docket process, he said. They can still choose to have charges heard by the grand jury. The average possession case, where the prevailing belief is to recommend parole or treatment had been taking about 100 days between an arrest and a guilty plea, he said. People in those cases were sometimes waiting in jail three or four months for a court resolution. The average time between arrest and guilty plea on the rocket docket has been about 25 days in jail – about a fourth of the typical jail time, he said.

The Coast Guard says the reason a barge slammed into the Ludlow Bromley Yacht Club in October was because a person on barge fell asleep at the controls. On Oct. 2, a 1,200-foot tow and barge combination carrying rock, sand and gravel collided with the longstanding club ripping the restaurant and marina in half. Boats docked there were also

335 flu cases have been reported in Northern Kentucky as of Dec. 7.

A child in Northern Kentucky has died from fl u complications. The deaths of the unnamed child and an unnamed adult are the fi rst in the Cincinnati region for the 2019-20 fl u season. "Our condolences go out to those who have lost someone due to fl u illness," said Dr. Lynne Saddler, district director of the Northern Kentucky health department. “Sadly, this is a tragic reminder to all of us that fl u is a serious condition." No pediatric deaths had been reported yet in Ohio as of Friday, Dec. 13, according to health records there. Due to privacy laws, the health department could not release additional details about those who died. The district covers Boone, Campbell, Kenton and Grant counties. Flu cases have been picking up in Northern Kentucky, the health department noted, with 335 cases reported in Northern Kentucky as of Dec. 7. Nationally, Kentucky is among states with "widespread" fl u, according to the Centers for Disease Control and Prevention.

Ohio has less of a problem now, though there have been fl u cases reported in various regions, the CDC map shows. Southwest Ohio counties have tallied 22 cases in which someone has been hospitalized with fl u as of Friday, Dec. 13. "Now is the time to get your fl u shot," the Northern Kentucky Health Department release states. To fi nd out where to get your fl u shot, go cdc.gov/fl u, check with your local pharmacies or doctor. Health offi cials also off ered these ways to prevent spreading a fl u virus: ❚ Cover your nose and mouth with tissue when sneezing or coughing. Discard tissue in the trash and wash your hands. ❚ Avoid close contact with sick individuals. ❚ Stay home from school, work and errands if you have the fl u. ❚ Wash your hands frequently with soap and water. If necessary, use an alcohol-based hand sanitizer. ❚ Avoid touching your eyes, nose or mouth.

Someone new will soon join the Northern Kentucky caucus in Frankfort. Gov. Andy Beshear chose Campbell County representative Dennis Keene to be the next Commissioner of the Department of Local Government, according to a press release from the Covington-based political consulting company November Strategies. Keene's new job in Keene Frankfort means a special election will be needed to fi ll the House District 67 seat, which Keene, a Democrat, has held since 2005. The district covers the cities of Newport, Southgate, Bellevue and Dayton. The special election has not been scheduled. Whoever wins the election will govern for the rest of Keene's term, which ends in 2021. Then, if that indi-

vidual wants to keep the seat they will have to run for reelection with the rest of the Kentucky statehouse representatives in the 2020 general election. Keene and Kenton County representative Buddy Wheatley are the two Democrats out of the 13 representatives in Frankfort representing the counties of Boone, Kenton and Campbell. Voters in Campbell County recently leaned more Democratic. In the November gubernatorial election, Beshear won the county with about 52% of the vote. Sheriff: Beware of gift card email scam this holiday season Segann March

Cincinnati Enquirer USA TODAY NETWORK

The Kenton County Sheriff ’s Offi ce is urging residents to watch out for a potential email phishing scam where they are asked to purchase retail gift cards. Deputies were alerted Monday that a nearby county government agency’s employees received emails from an outof-offi ce supervisor asking them to purchase retail gift cards. According to a press release from the sheriff ’s offi ce, after the initial email exchange, employees were asked to scratch off the back of the cards to reveal their PIN codes. The scammer asked each person to send a picture of the PIN codes to a mobile number. Although the supervisor’s name was correct in the email, the generic address from “earthlink.net” was suspicious. The employees contacted the supervi-

sor directly to verify the scam attempt. “Purchasing retail credit cards and giving PIN codes is a fi rst clue it is a scam!” said Patrick Morgan, chief deputy at Kenton County Sheriff ’s Offi ce in the release. The Sheriff ’s Offi ce is warning residents in the area to not engage scam emails or callers. Deputies say to avoid giving out personal information, giving payment over the phone, or confi rming personal information. Morgan said most of the time, scammers are friendly, professional and convincing. “If a request from a supervisor, family member, neighbor or provider of service seems unusual — do not return the email or call the number provided. Contact the person or provider directly through your known contact numbers and verify the request,” according to the Sheriff ’s Offi ce.

Governors to meet to talk bridge tolls, next steps Jackie Borchardt Cincinnati Enquirer USA TODAY NETWORK

COLUMBUS, Ohio – Ohio Gov. Mike DeWine said he’s “optimistic” the Brent Spence Bridge project will get done but he and incoming Kentucky Gov. Andy Beshear still have a lot to work out. One of those issues: Tolls. Last year, DeWine told The Enquirer he didn’t see a way the bridge could be built without tolls. In a Dec. 13 interview, DeWine said it was premature to endorse tolling without fi rst talking with Beshear. Beshear, a Democrat, has not ruled out tolls but has said it’s something he needs to discuss with Kentuckians. That was a diff erent take than his gubernatorial opponent, Republican Gov. Matt Bevin, who said in a debate last month that tolls need to be part of the plan. In 2016, Bevin signed a bill that banned tolls from funding new bridges connecting Ohio and Kentucky. DeWine anticipates one state will be the fi scal agent for the project, which a 2017 study pegged at $2.6 billion. The project involves refurbishing the bridge and building a second bridge to the west. “We’ve got to pay for it some way and

we’re open to see how we can get it paid for,” DeWine said Dec. 13. DeWine said Ohio Transportation Director Jack Marchbanks has been talking with Kentucky Transportation Secretary Jim Gray. DeWine said Ohio

Holiday beef tenderloin and crispy roasted potatoes; and how to grate nutmeg Holiday beef tenderloin with Latin rub

Rita’s Kitchen Rita Heikenfeld

Just the mention of beef tenderloin in my recent column brought about requests for roasting. I can understand that, since choice tenderloin is expensive but so appropriate for holidays, and easy to roast. Plus it can be made ahead. If you’re serving this as a buff et, roasted asparagus showered with Parmesan right out of the oven is a nice veggie, since it tastes good at room temperature, too. Add some extra crispy roasted potatoes (baking soda is the secret – see my tip below) and you’ve got a feast.

Crispy roasted potatoes: baking soda is the secret Cut potatoes as you like, then boil with baking soda BEFORE roasting. Baking soda, being alkaline, breaks down potatoes’ surfaces, making them a little pasty looking on the outside. That translates into crisp outsides with creamier centers after roasting. It’s probably still in the dark brown shell. Give it a shake – if nutmeg rattles, crack shell off . Fresh nutmeg is stronger than dried so use about 3⁄ 4 as much as dried.

Instructions

Cut potatoes as you like, then boil with baking soda BEFORE roasting. Baking soda, being alkaline, breaks down potatoes’ surfaces, making them a little pasty looking on the outside. And remember, there’s carryover cooking which means when you remove the meat from the oven, the internal temperature continues to rise a few more degrees. Cover loosely with foil and let stand 10-20 minutes before carving. That way, the meat “relaxes," and juices collected in the center will redistribute throughout meat, making for a moist roast.

bed bug. Heavy infestations may have a “buggy” smell, but the odor is seldom apparent and should not be relied upon for detection. Examine the bed sheets and upper and lower seams of the mattress and box springs, especially along the headboard of the bed. Look behind the headboard if you can because it is a frequent hiding place for the bugs. If bedbugs are discovered, travelers can request another room, preferably in another area of the building. Keep suitcases off the fl oor on a luggage stand, tabletop or other hard surface. Wear pajamas that cover as much skin as possible since bedbugs don’t tend to burrow under clothing. Check under and around the cushions of chairs and sofas for possible signs of infestation.

If you experience itchy welts suggestive of bedbug bites during your stay, place all clothing in disposable plastic bags and put directly into the washer (using hot water) and dryer when you get home and throw away the plastic bags. Bedbugs are hard to spot inside a suitcase. However, you can inspect and vacuum luggage upon getting home. Treat or discard the suitcase if you suspect bedbugs. The good news is bedbugs are not generally thought to transmit any diseases. The not-so-good news is they can be challenging to control if you do end up with an infestation. It is best to be vigilant during your travels. SCHOOL NEWS Math Knight at Florence Elementary Florence Elementary students and their families recently participated in a family Math Knight and they are the home of the Florence Knights. Math Knight was sponsored by Mathnasium a math learning center. To start off the evening the families received pizza before becoming engaged in variety of math learning games. The games played could be easily incorporated with common household items. The games played were 10 Slam, Sticky Notes Number Line, Tangrams, Addimorphs, Sum Up/Sum Down, Playing the Odds and Number Detective, 4 Way Countdown and Magic Plus, Multiplication Heads Up/

Addition Heads Up, Spinning Wheel, and the back table provided your basic Connect 4 Game, a family favorite. At each game the students had their punch card punched to receive a goody bag and be entered into a drawing. The drawing entitled 1 student and 1 adult to one free month of services from Mathnasium. Many families took advantage of a free learning night and spending time together with their children. Community volunteers helped man the tables, several Boone County High School seniors, one Boone County Public Library partner, some Florence Elementary staff members, and a few Mathnasium members also provided the support needed for a successful evening.

Sports Cooper grad stars for Belmont James Weber

Cincinnati Enquirer USA TODAY NETWORK

Editor’s note: Information included refl ects this article’s original publication date – Dec. 13. Visit Cincinnati.com for possible updates. Casey Alexander recruited Adam Kunkel when Alexander was the head basketball coach at Lipscomb University in Nashville. Kunkel signed with Belmont, a nearby neighbor of Lipscomb’s. Alexander went down the street to Belmont in April, and now that he has, he enjoys having Kunkel on his roster. Kunkel, a 2018 Cooper High School graduate, is in his second year with the Bruins, who were 7-3 through Dec. 11. Belmont is a member of the Ohio Valley Conference, making the fi rst round of the NCAA Tournament last season. Belmont was 27-6 last season and has 14 straight winning seasons. The Bruins won a conference regular-season title in the OVC in six of their seven years in the league, all under Rick Byrd, who retired after 33 seasons there. Kunkel is having a breakout season in his sophomore year. He was averaging 18.6 points per game, plus 2.1 assists and 2.7 rebounds when this article was originally published. He had made 35 3pointers, shooting 45.5 percent from behind the arc at that time. He had twice been named Ohio Valley Conference Player of the Week. The 6-3 guard ranked among OVC leaders in fi ve statistical categories, including fi rst in 3-point fi eld goals per game (3.44) and second in points per game (18.8). He already had three games of 25 or more points, including a career-high 35 points at Boston College Nov. 16 and 28 points vs. Samford Nov. 11. “I recruited him at Lipscomb and I’m glad to coach him now,” Alexander said. “He comes from a really successful program at Cooper with Sully (head coach

Former Cooper player Adam Kunkel is having a breakout season in his sophomore year at Belmont. TONY TRIBBLE FOR THE ENQUIRER

Tim Sullivan). Winning games, tough kids, really good program, tough kids. The key has been he’s really displayed a lot of versatility on off ense. He’s shooting a good 3-point percentage, and he’s also scoring at the dribble, scoring off the rim. That’s the reason that he’s had the success he has.” Kunkel played 25 games last year and averaged two points per game. He was battling injuries at times last season and was also playing behind two high-scoring superstar guards, including Dylan Windler, who became a fi rst-round draft choice by the Cleveland Cavaliers.

He learned from those ahead of him. “The biggest adjustment is the speed of the game and how big everyone is out on the court,” Kunkel said. “High school is a little diff erent. It’s very fast. You have to know the plays and every aspect.” Kunkel is a good fi t for the Bruins, who are traditionally one of the top three-point shooting teams in the country. The Bruins average 11 makes per game this season and shoot 38.2 percent from the arc as a team. Belmont features 6-foot-11, 235pound Nick “Moose” Muszynski from

Pickerington, Ohio in the post, and surround him with four perimeter shooters. “Our fi ve-man is always the most important player in the off ense because it goes through him,, then on top of that the guys play well and the cream rises to the top,” Alexander said. “He has embraced the opportunity and he’s doing well his sophomore season.” Said Kunkel: “Staying confi dent. I couldn’t do it without my teammates. Having Moose down in the paint and having him kick it out has really helped me out.” Kunkel helped the Jaguars to the state championship game in 2017, losing to Bowling Green, and then lost to CJ Fredrick and Covington Catholic in the 2018 Ninth Region tournament. He is one of three members of that 2017 team starring in Division I college sports right now. Sean McNeil is averaging 6.8 points for 8-1 West Virginia. Dante Hendrix was the leading receiver this fall for Indiana State football. “I love seeing my family succeed,” he said. “Seeing Sean at WVU and seeing Dante Hendrix. I knew they would be great players and I’m really happy to watch them.” Belmont will play Alabama Dec. 21 on the road, with another local Sweet 16 star, Holmes graduate James Bolden. Bolden has started two games and is averaging nine points for the Crimson Tide. Kunkel and the Bruins beat rival Lipscomb twice this season. The nearby rivals, separated by two miles on the same road, play twice a year in non-conference after once being league rivals with Northern Kentucky University in the Atlantic Sun Conference. The rivalry reminds Kunkel of great Boone County battles. “Being a part of the rivalry is great,” he said. “They’re right down the road and there’s all this history behind it. It’s a great atmosphere. Nashville, you can’t beat it. Nashville is one of the best sports towns and I’m excited to be here.”

In both, she met automatic All-American standards and in the freestyle she set a personal best. Reil fi nished second in the 500 free and seventh in the breaststroke.

The Highlands boys team was third in the state for the second straight year behind diver Finn Murphy and returning standouts Mac Russell, Jack Banks, Jake Ryan and Will Griffi th. Russell had two top-fi ve solo medals at state and Banks had two solo medals.

Russell was regional champion in the 50 and 100 free. Banks had a regional title The group was key in three top-fi ve relays and regional championship foursomes.

Pandas and Colonels Covington Catholic and Notre Dame, traditional powers, will look to reclaim their dominance this year. Notre Dame was regional champion last year in girls. The top returners are all-region selections Riley Jordan and Allie Weidinger. night in new locations this holiday season as you travel to see family and friends. As we travel around there are some precautions to take to prevent getting bedbugs. While it is unpleasant to be bitten while staying at a hotel, it is even worse to bring the infestation home with you because eradication is very diffi cult. Bedbugs are hitchhikers and easily move from place to place on luggage, clothing, blankets and furniture. This mobility is a problem in hightraffi cked areas like in hotels and motels. Bedbugs are small and hard to detect. Plus they generally come out at night when the light is low and attack their victims in their sleep. Concerned travelers should check beds and soft-upholstered furniture for signs of bedbugs. Characteristically, these areas are marked by dark spotting and staining, which is the dried excrement of the bugs. Also present will be eggs and eggshells, the brownish molted skins of maturing nymphs and the bugs themselves. Another telltale, though less frequent sign, is rusty or reddish blood smears on bed sheets or mattresses from crushing an engorged See COMMUNITY, Page 10A

Emily Carroll, of New York City, is a 2016 medical-school graduate who just finished her residency. She is applying for fellowships and expects to get news (fingers crossed!) around the time this crossword is published. The genesis of the puzzle was 41-Across, with its unusual letter pattern. Part of that pattern led her to think of 110-Across, which became the puzzle’s ‘‘revealer’’ entry. This is Emily’s 10th crossword for The Times and her second Sunday. — W.S.

The property shall be sold subject to ad valorem taxes for the year 2020 and all subsequent years thereafter; easements, restrictions and stipulations of record; assessments for public improvements levied against the property, if any; existing zoning ordinances, statutes, laws, or regulations; and any facts which an inspection and accurate survey of the property may disclose.
