BURLINGTON – Stacie Earl needed 100 petition signatures to become a candidate for the Kentucky House of Representatives. The Independent turned in 156. Her Republican opponent, Ed Massey, filed a suit arguing enough of the signatures were invalid to remove her name from the ballot. Boone County Circuit Court Judge James Schrand, in a hearing Friday, scrutinized the questionable signatures, with Earl’s candidacy hanging in the balance. “We knew it would be very close,” said Dennis Repenning, who represented Massey. And it was. Of the 156 signatures, 43 were nullified because they came from people living outside the proper jurisdiction: District 66. Another four were thrown out because they came from unregistered voters, said Philip Taliaferro, an attorney representing Massey. Five more couldn’t be verified, either because they were duplicate signatures that appeared twice on the petition or they were affiliated with false addresses, Taliaferro said.

That left 104 signatures. Two of the remaining signatures couldn’t be properly linked to voters. 102. About a dozen more, Massey’s team argued, shouldn’t count because when Earl collected them, her name wasn’t actually Earl, it was Storms, Taliaferro said. But Schrand ruled those who signed the petition for Earl, even though that wasn’t her legal name at the time, were familiar enough with the woman to know who they were supporting when they inked their John See CANDIDACY, Page 4A

County clerks in Northern Kentucky agree that researching your ballot and polling precinct location is key to preparing for voting on Election Day. Voting in Kentucky will take place 6 a.m. to 6 p.m. Tuesday, Nov. 6. Poll workers are instructed to allow voting to continue for any person in line before 6 p.m. Under Kentucky law, voters must bring a valid proof of ID (a driver’s license or signed credit card will do). A poll worker can also personally vouch for a voter as living in the precinct. Kentucky State Board of Elections Voter Information Center website offers voters a chance to see where they are registered to vote. The same website at http://bit.ly/votecenterky offers sample ballots listed by county with detailed precinct information. Even neighbors can have different ballot choices, said all three county clerks in Boone, Campbell and Kenton counties. Sometimes it’s not enough just to know what precinct you vote in, Campbell County Clerk Jim Luersen said. “Two precincts (Melbourne and Johns Hill) each literally have five different ballots,” Luersen said. “It depends on what street you live on as to what ballot you will receive.” Complicating matters is that boundaries of Campbell County’s seven school districts and 17 cities are not the same. “We have 55 different ballot faces,” Luersen said. “We have one of the more complicated elections in the state.” Kenton County has numerous local ballot difference with 20 cities on the ballot including Walton since part of that Boone County city is in Kenton County, said Clerk Gabrielle Summe. There are large areas in and around the cities of Independence, Crescent Springs and Villa Hills where voters may think they are in city limits. But they actually vote only in countywide offices. “There are little pockets of county properties throughout all of the cities,” Summe said. Even in Boone County, neighbors on some streets may see a campaign sign for Florence mayor down the street – but might not live in city limits themselves, Boone County Clerk Kenny Brown said. Turnout projections Each county clerk offered unique voter turnout predictions. ❚ In Boone County, about 25 to 27 percent of voters are expected to cast ballots, Brown said. ❚ Campbell County voter turnout could exceed 40 percent as it did four years ago, Luersen said. Voters have choices in contested races for judge-executive and county commission seats, commonwealth’s attorney, a judicial seat, statehouse and city races, he said. ❚ Kenton County: “I project about 30 percent turnout given the number of council races and things that are really buzzing in most of the cities,” Summe said.

The Glenview and Linkview precincts will vote at the Boone County Extension Enrichment Center, 1955 Burlington Pike, Burlington. ❚ Campbell County: Four polling precincts that were changed in the May

primary will remain changed for the general election. People who voted at Newport Baptist Convalescent Center will instead vote at the former A.D. Owens Elementary School, 1102 York St., Newport. Those who previously voted at Carthage Methodist Church in California will go instead to the California City Building, 4071 Union St. The Southgate VFW precinct has been moved to the Southgate Civic Center, 301 W. Walnut St. The Dayton Speers Court precinct was moved to Lincoln Elementary School at Fifth Street and Greendevil Lane. ❚ Kenton County: The Knights of Columbus polling precinct in Ludlow that moved in the May primary will stay at the Ludlow Senior Center at 808 Elm St.

A ferry running between Rabbit Hash, Kentucky, and Rising Sun, Indiana, has returned to service. The MS Lucky Lady, which shortens travel time between Boone County and Rising Sun, received upgrades for winter and new rigging. The dock location in Rising Sun is adjacent to Rising Star Casino, past the Resort’s Golf Course clubhouse. The ferry landing in Kentucky is off Route 18 between Rabbit Hash and Bellevue. The address is 8555 Lower River Road, Burlington. A one-way trip on the ferry boat will cost $5, or you can purchase a roundtrip ticket for $8. Earlier this month, travels on the ferry came to a halt. The stall in operations came less than a month after the ferry's official launch on Oct. 3. The ferry's original launch date for

NKU SOTA wins big at national singing competition Northern Kentucky University’s School of the Arts (SOTA) attended the Kentucky National Association of Teachers of Singing (NATS) Student Auditions at Bellarmine University in Louisville, in October. This transdisciplinary experience included two faculty from the Theatre Dance Program, Rita Larkin and Catherine Keen; two faculty from the Music Program, Kimberly Lazzeri and Joy Burdette; and three NKU pianists, Mika Komuro, Dasom Kwon, and Natasha Pence. In total, 18 students from NKU SOTA and NKU Music Preparatory competed in the student auditions. From the studio of Joy Burdette: Ella Lindsley, Willow Davis, Rachael Petranek, Mason Kelley, and Parker Culp; the studio of Catherine Keen: Ezra Crist, Blair Lamb, Sally Modzelewski, and Sarah Parlow; the studio of Rita Larkin: Allyson Davis, Faustina Gorham, Joshua Van Nort, Kristopher Freeman, Kali Marsh, and

Rebekah Lee; and the studio of Kimberly Lazzeri: Tyler Smith, Sarah DeMoor, and Kate Suekoff. Of these 18 students, an impressive 13 advanced to the Semifinals, with five placing in Finals, from each of the faculty studios. Parker Culp placed third in High School Music Theater Men; Ezra Crist placed third in Lower College Music Theater Men; Blair Lamb placed first in Lower College Music Theater Women; Allyson Davis placed second in Lower College Music Theater Women; Tyler Smith placed second in Senior Classical Men. Students had the opportunity to attend a performance by the Kentucky Opera Barbara and Halsey Stanford Studio Artists. Following the performance, the artists engaged in a Q & A session with the students. Each of the SOTA faculty served as adjudicators at the competition, with a few helping in the tally room as well.

DHL helps control Banklick Creek with trees A new tree planting effort along Banklick Creek in Kenton County is an effort to control floodwaters and stabilize the streambed. The creek flows for about 20 miles from Boone and Kenton counties into the Licking River. DHL Express employees and conservationists began what will be months of tree planting Sept. 26, southwest of Pioneer Park at 3975 Old Madison Pike. DHL employees will help plant about 6,500 trees along Banklick Creek, said a DHL spokesman. The trees will be planted at former residential properties bought up by Kenton County with $2.2 million in FEMA grants to eliminate recurring

flood damage. The Erlanger-based DHL has a package hub at Cincinnati/Northern Kentucky International Airport. DHL employs about 4,300 people there. The Kenton County Conservation District partnered with DHL to transplant about 60 trees in 3-, 5- and 7-gallon containers. The conservation district's goal is to plant 13,000 trees by November along Banklick Creek in south Covington, Fort Wright and Morning View. Chris Kaeff, Kenton County Conservation District supervisor, and Colin Beynon, DHL general manager at CVG, gave speeches at the tree planting.

Kimberly Lazzeri was officially elected President of the Kentucky NATS Chapter and will begin this role in 2019. In March 2019, NKU SOTA will be participating in the Regional NATS Student Auditions at Austin Peay State University.

It has been another interesting, busy week here on my little patch of heaven. We are still finding gourds, but not in the pumpkin patch. The volunteer gourds sprouted near the elderberry bushes next to the pumpkins. No kidding, those gourds are hanging like orange, white and green ornaments in the elderberries. It has been fun watching the little ones discover them and claim what gourds they find as their own. And I still haven’t had the heart to pull up the jalapeno and bell pepper plants. They’re still producing loads of peppers! Good news since I needed both to make the best black bean burritos recipe I’ve had in a long time. I want you to try this recipe. Let me know if it becomes a fave at your house, too.

I didn’t have cilantro and they still tasted yummy. Cilantro would add another element of flavor. I used a red bell. Maybe you’d like to use a yellow, orange or even green. Whatever you have. Go to taste on seasonings. Instructions Preheat oven to 350. Stir together garlic, butter and salt and pepper to taste. Brush this on cut sides of bread. Sandwich them together and place on baking sheet. Bake until heated through and outside is a bit crispy about 12-15 minutes.

Straight ticket vote… No thanks Jesse Brewer Guest Columnist Community Recorder

Kentucky is just one of eight states that still allows straight ticket voting. Texas just passed a law getting rid of it in 2020, which will make us one of seven states left. In less than a week the general elections will be here and that it’s a nonpresidential and non-governor election year, the turn-out is predicted to be low. Estimations of 10-14 percent of registered eligible voters are expected to show up at the polls. There are some very important races on the ballot that people need to know about and take interest in. In my home county, Boone County, we have several State Representative races (that are contested, meaning more than one person running for them) that are partisan. That means you can select either a Republican, Democrat, Libertarian or Independent. We also have a county clerk race and a congressional that are partisan. But in addition to the partisan races we also have a few non-partisan races that are very important, such as a district judge, the new family judge seat. And if you live in Florence, Union or Walton you have mayor and city council races. Non-partisan races mean the candidate on the ballot is not affiliated with

any political party, the candidate is just listed on the ballot. Now these people are registered as some sort of political affiliation, but it is not by their name on the ballot for you the voter to know, and if you are like a lot of other Kentucky voters, there is a high probability that you will vote straight ticket for either political party, and if you do that you do not cast a vote in any of these important non-partisan races. Why are all these other races important you may ask? Well if you live in one of the cities the council and mayor vote on ordinances that affect your taxes that you pay. Ever been divorced or have a loved one that went through a divorce? Well the family judge is the one that presides over custodial matters as well as other critical family related issues. The municipal judge presides over criminal matters, traffic tickets as well as well as lot of other important issues. The reason I’m laying all this out for you is to make you aware of what’s on the ballot. And if you decide to punch straight party ticket, for either party, then you do not cast a vote in these important non-partisan races. So, when you head to the polls on Tuesday Nov. 6, I ask that you stop, take a moment, and cast an individual vote in each race as in this low turnout of an election each vote truly does matter. FORT WRIGHT, Ky. – Test scores and grades on a report card measure how well students, or even school districts, are doing. In Kentucky, other metrics – depressing statistics on opioid-related deaths, parents in jail, children removed from drug-endangered homes – show the pressures that can keep kids from excelling in the classroom. Or from showing up at school at all. The U.S. Department of Justice has awarded a $666,176 grant to expand services for children who are victims of the opioid epidemic. Legal Aid of the Bluegrass based in Northern Kentucky secured the grant. By hiring a couple new lawyers and a social worker, it plans to work with schools in its 33-county service area to provided stability in the lives of children of the drug crisis. "Schools, in almost every community that we're in, are the place that people connect with," Joshua Crabtree, executive director of Legal Aid of the Bluegrass, told The Enquirer. He's convinced that reaching out to schools will get legal services where they're needed so that vulnerable kids can worry less about where they'll sleep and more about getting assignments done. Kentucky ranks first in the nation in the number of children that have at least one incarcerated parent. It ranks first in the number of children living in kinship care, which means living with a relative, often a grandparent, because parents might be in jail or in drug treatment. People ages 35 to 44, those most likely to be parents, were the largest demographic in overdose deaths, according to the 2017

"It's very normal to say that your parents are in jail," said Sarah Ackel, an educator in Kenton County Schools. "The conversation has changed in general, it's not a secret," said the fifthgrade teacher at Fort Wright Elementary School. "There are ... kids who are in my class who are homeless right now. I have children who have parents who are incarcerated and live with grandma, grandpa," she said. She knows some students were born addicted to heroin or encounter child abuse. "And I want to drive my instruction to meet them there." "That's the thing," said Jillian Beach of Legal Aid of the Bluegrass. "The teachers are kind of on the front line, whereas we can then step in to help combat some of these issues. There's got to be a force that's standing there recognizing them." Crabtree is confident lawyers can assist. Transient families may need help tracking down records from other school districts. Grandparents might not know when to enroll a child in school. With a spouse in treatment, a family can't afford to pay utility bills. Finding answers or obtaining benefits to resolve such situations, that's what legal aid lawyers do. "Let's get them in school. That's most likely the most stabilizing force" a child can be offered, Crabtree said.

Viewpoints Marsy’s Law: Undermining the Kentucky Constitution John Schickel Guest Columnist Community Recorder

On Election Day, Tuesday, Nov. 6, citizens will vote on whether to amend our Kentucky State Constitution. The proposed amendment is known as Marsy’s Law. The Marsy’s Law campaign originated in California after a woman was tragically killed by her former boyfriend. The ex-boyfriend was released from jail on bond and proceeded to confront her family in a supermarket. In a recent ruling, Franklin County Circuit Judge Thomas Wingate correctly concluded that votes for this amendment should not have legal effect. The ballot language proposed was too vague and did not adequately explain the many details of this proposed constitutional amendment. Someone who reads the brief ballot language would have little insight into its many components and would see no reason to vote against a vague request to enhance victims’ rights. It is my hope that the Supreme Court of Kentucky will agree with the Franklin County Circuit Court’s decision, and that votes on this measure will not be certified. What’s wrong with this constitutional amendment? Plenty. While the individuals sponsoring this legislation, no doubt have good intentions, they do not consider the history and design of our Commonwealth’s Constitution. The Bill of Rights in it was designed to protect citizens from the powers of government. The government has tremendous power. They can confiscate your property, put you in prison, and even execute you. Our founders learned the lessons of history well and correctly understood that individuals needed specific constitutional protections from government. Protections of actions between citizens were meant to be statutory and legislated into the criminal code. Kentucky has some of the best laws in the nation to keep crime victims informed. We should improve these statutes. However, amending the Constitution toward this end and others could create many far-reaching and unintended consequences undermining our form of government and justice system. The first duty of a prosecutor is to find the truth, and only proceed with a prosecution if there is adequate evidence for a conviction. Marsy’s Law might compromise a prosecutor’s ability to fulfill this obliga-

tion. Due process requires that a prosecutor must provide a certain standard of evidence beyond a reasonable doubt. This is a critical safeguard in our justice system, and Marsy’s Law could compromise this protection. Let me reiterate an earlier point: the intentions behind this bill are good. However, what this California law attempts to fix does not appear to be broken here in Kentucky. The Commonwealth already has the Kentucky Crime Victim Bill of Rights codified in KRS 421.500 to .575. Under Kentucky existing law, Marsy’s family would have been notified before the individual was released from jail. The mere presence of Marsy’s Law on the ballot in Kentucky is the result of a massive lobbying operation funded from outside the state. Over the last several years, more than $300,000 has been spent on this effort just in the Commonwealth of Kentucky. It is the most expensive lobbying effort that Kentucky has ever seen by outside interests attempting to change our Constitution. Marsy’s Law simply does not belong in our Commonwealth’s Constitution. Kentucky’s Constitution sets forth the powers and functions of the branches of government as well as certain general values and principles upon which the citizens agree, including basic rights afforded to those who stand accused by the state. These rights are a crucial protection against the government’s far-reaching power. Our Constitution is so well-balanced that it should rarely be subject to change. Kentucky has a Victims’ Bill of Rights well-enshrined in statute. If it must be changed, it can be done through the process of enacting legislation and without a constitutional amendment. Marsy’s Law will potentially undermine the administration of justice in the Commonwealth of Kentucky and, for that reason, should be put aside while the targeted issues are taken up by the General Assembly. The Cougars placed their top four runners in the top four spots and all five scorers in the top 16 to blow away the competition. The Cougars finished with a score of 26 to win the regional meet, easily distancing themselves from runners-up Covington Catholic (46). John Lloyd Crigler was a great athlete at Hebron High School graduating in 1954 before consolidation. Hebron is now the home for Conner High School. Crigler though was one of the finest athletes to ever play for any of the Boone County schools. In those days there were seven high schools in the county. Eventually that shrunk to one and now its back up to four with the addition of Conner, Ryle and Cooper High Schools. John played four years of basketball for Hebron and two years of track. He was a tremendous baseball player as well, but the school did not offer the sport. He ended up playing for many local amateur teams. In basketball he was selected to the All Northern Kentucky Teams in 1952-53 and 1953-54. The Coaches Association

During his junior year he ripped the nets for an average of 30 points per game and then 27.8 his senior year. In those years the Y.M.C.A. gave an award for the “Outstanding Set Shot,” which he won easily setting the record in 1954. His brilliant career earned him the right to play in numerous post season All-Star contest his senior year including the Kentucky Indiana series, the Kentucky Ohio series and All-Star game that year he was named “Star of Stars” for the game played in Pikeville, Kentucky. In track, John qualified for the State Track Meet in both the high jump and discus his junior and senior years. Crigler, following his stellar high school career, entered the University of

Kentucky and fulfilled his dream of playing for Adolph Rupp and the Wildcats. He played four years and was a starting forward his junior and senior seasons. One of this finest moments came when he connected on a 25-foot shot with just two seconds left to beat Alabama and send the Wildcats to the NCAA Championships. He was extremely instrumental in the Wildcats winning their Fifth National Championship scoring 14 points and pulling down 14 rebounds in the Championship game. The basketball gymnasium at Conner High School is named the John Lloyd Crigler Gym in his honor. Following John’s graduation from UK John went into the education field and for many years until retirement served as the golf coach and Athletic Director at Scott County High School in Georgetown, Kentucky. Nutrition facts label reboot, a tale of two labels Extending Knowledge Kathy R. Byrnes Community Recorder

The Nutrition Facts label that you may read when buying packaged foods or preparing a meal has undergone a makeover. It’s been updated by the U.S. Food and Drug Administration (FDA) to reflect updated scientific findings. These changes can help you make better-informed choices about the foods you and your family eat and help you maintain a healthy diet. Manufacturers with $10 million or more in annual food sales have until 2020 before the new label is required, and manufacturers with less than $10 million in annual food sales will have until 2021. Some manufacturers have already started using the new label. In fact, at least 10 percent of packages being sold already carry the new label. So, until the deadlines, you may see one of two different versions on packages: either the original label you’ve grown accustomed to using, or the new label. What’s the Difference Between the Two Labels? While both versions provide useful information, the new label reflects updated scientific information, including our greater understanding of the links between diet and chronic disease. It is also more realistic about how people eat today. Here are some of the changes: ❚ 1. The new label makes it easier if you or a member of your family is counting calories by putting the calories, the number of servings, and the serving size in larger, bolder type. We thought it was important to better highlight these numbers because nearly 40 percent of American adults are obese, and obesity is associated with heart disease, stroke, certain cancers, and diabetes.

What’s the Difference Between the Two Labels? PROVIDED

❚ 2. FDA is required to base serving sizes on what people eat and drink, so serving size requirements have been adjusted to reflect more recent consumption data. This way, the nutrition information provided for each serving is more realistic. For certain packages that contain more than one serving, you will see nutrition information per serving as well as per package. That means for a pint of ice cream, calories and nutrients are listed for one serving and the whole container. ❚ 3. Added sugars are now listed to help you know how much you are consuming. The 2015-2020 Dietary Guidelines for Americans recommends you consume less than 10 percent of calories per day from added sugars. That is because it is difficult to get the nutrients you need for good health while staying within calorie limits if you consume more than 10 percent of your total daily calories from added sugar. ❚ 4. Good nutrition means that you are getting the right amount of nutrients for your body to function correctly and to fight chronic diseases like obesity, heart disease, certain cancers, and type II diabetes. The FDA has updated the list

of nutrients required on the label to include Vitamin D and Potassium because Americans today do not always get the recommended amounts of these nutrients. Conversely, Vitamins A and C are no longer required, because deficiencies in these vitamins are rare today, but they can be listed by manufacturers voluntarily. ❚ 5. The old label lists calories from fats, but the new label does not. The FDA made this change because research shows the type of fat consumed is more important than total fats. For example, monounsaturated and polyunsaturated fats, such as those found in most vegetable oils and nuts, can reduce the risk of developing heart disease when eaten in place of saturated and trans-fat.

❚ 6. Daily values for nutrients like sodium, dietary fiber, and Vitamin D have been updated and are used to calculate the percent Daily Value (DV) that you see on the label. The percent DV helps you understand the nutrition information in the context of a daily diet. The footnote at the bottom of the label has changed to better explain the meaning of the percent DV. During this transition, no matter which label shows up on your food package, they both provide useful information to help you and your family make informed nutrition choices and maintain healthy eating patterns. Farm Dinner Theater offers unique health and safety educational perspective

Boone County Extension Service is choosing a unique platform via which to educate on farm health and safety: dinner theater. The Extension office will host Farm Dinner Theater on Friday, Nov. 16 from 6-8 p.m. at the Boone County Extension Enrichment Center, 1824 Patrick Drive, Burlington. Members of the local farming community will serve as actors for two short skits, one on roll-over safety, including tractors, lawn mowers and allterrain vehicles, and the other on exposure to pesticides, sun and tobacco. Cost is $5 per person and includes dinner with locally-grown ingredients. Farming consistently ranks as one of the most hazardous occupations in the United States, with little change in circumstances and outcomes of agricultural injury events over the last three decades. Studies provide evidence that younger farmers experience the greatest number of non-fatal injuries; however, older farmers incur more severe

and permanently disabling injuries and are at greater risk for fatal injuries than any other age group. Farm Dinner Theater is a local iteration of a federally-funded project by the Centers for Disease Control National Institute for Occupational Safety and Health via the University of Kentucky. The project utilizes a farm theater approach known as didactic readers’ theater and was built upon two decades of work by Dr. Deborah Reed, of the UK College of Nursing, and her research team in engagement with the farming community. Butch Foley FLORENCE - Burnham Robert Foley (Butch) of Florence, died at age 78 at St. Elizabeth Florence. Butch was born in Chicago, IL to Maryan and Robert Foley in 1939. He graduated from Anderson High School, where he met Joyce Kirby. They didn’t know it then, but many years later they would reconnect and become husband and wife. They enjoyed a wonderful 27 years together. After serving in the Army, Butch enrolled at the University of Cincinnati where he earned a Master’s Degree in Electrical Engineering. He went on to work at Wright Patterson Air Force Base in Dayton, Ohio as a Project Manager. Butch is remembered as being a brilliant man. He would work on anything that had a motor, and his family all agrees that he could fix anything. He was a part of the Classic British Motorcycle Club where he helped rehab vintage motorcycles. His favorite was a 1937 Ariel 350cc. Butch loved a good book, taking river cruises, skiing, wind surfing and golfing. He even had a hole-in-one. Butch is remembered by his friends as loved and respected. His good nature, wisdom and intelligence are the impressions left on their hearts. Butch is preceded in death by his parents and brother, James Foley. He is remembered with love by those who survive him; beloved wife Joyce; step-children, Lisa Beiring Armstrong (Jeff) and Robert King Beiring, Jr. (Rex); step-grandchildren, Kirby and Logan Armstrong, and Brooke and Lauren Beiring along with niece Jamie Foley. Memorial contributions in Butch’s name, can be made to the American Cancer Society 2808 Reading Rd. Cincinnati, OH 45206. Services will be held privately at the convenience of the family.
