A company that did site preparation work for renovations at Anderson High School is suing the Forest Hills Board of Education and the former general contractor for more than $2 million in unpaid invoices. J&D Rack Co. claims in a lawsuit filed in Hamilton County Common Pleas Court that Forest Hills is withholding money it owes Rack for change orders because the school board is over budget in its $103 million building project. Forest Hills’ failure to pay has forced Rack to lay off a third of its employees, Rack’s lawsuit says. The Green Township company is airing more than its financial complaints. “(Forest Hills) is mired in public scandals and, upon information and belief, substantially over budget in its $103 million district-wide construction project,” Rack says in its lawsuit. The district has had a run of creating headlines dating back to 2015: ❚ Former superintendent Dallas Jackson stepped down in 2015 after teachers alleged he bullied them into changing his son’s grades. ❚ The start of the Anderson High School school year was delayed in 2017 because of renovations of the building were behind schedule. In October of that year, the school had to close because it had no heat. Then, in November 2017 the school board fired the construction company. ❚ Three district employees departed earlier this year after records showed a multitude of email and text messages indicated a sexting scandal. ❚ The school board decided to revisit the possibility of changing Anderson

A committee recommended to the board the name remain the same in June. ❚ The board paid Doug Evans, CEO of Evans Landscaping, $2.15 million for property to create a new bus hub this year, despite the price being more than twice the market value and Evans being under federal indictment for fraud charges. Evans was found guilty on all charges earlier this week. “To compensate, (Forest Hills) is unjustifiably withholding payment for Rack’s work to coerce Rack to accept unreasonable adjustments to amounts properly owed to Rack.” In answer to the lawsuit, the Forest Hills Board of Education denies it is over budget in its building project.

As FC Cincinnati fans celebrate progress on the team’s stadium in Cincinnati’s West End, funding for the practice and training facility in Clermont County could be in jeopardy. Questions are being raised about why agreements surrounding the practice facility are being amended and rewritten – multiple times in the case of Milford. Milford City Manager Michael Doss is not responding to questions about the debt. The city’s law director did not return a call for comment. Clermont County leadership says it can’t speak for Milford. Original agreements, first approved in July, for FCC’s practice and training facility in Milford called for the city to sell securities to cover its share, $3.5 million, of the $5 million land cost. Milford’s debt was to be paid with money from a new 1 percent hotel tax approved by Clermont County Commissioners this summer. For reasons that are unclear, Milford has not issued the debt. In November, Milford City Council approved a new agreement with FC Training Facility LLC, Clermont Convention and Visitors Bureau, and the Clermont Port Authority. The new agreement, among other things, commits Milford to repay FCC $3.5 million. This month, the agreement was amended. There’s speculation that a lawsuit filed in September by Milford resident Rachel Richardson could be behind the series of agreements, amended agreements, and delay in the issuance of securities. The lawsuit accuses Milford officials of holding secret meetings and violating an agreed-upon injunction. facility. Richardson’s attorney, Matthew Miller-Novak, has said that violating open meetings laws could invalidate Milford City Council’s actions. Following Milford Council’s approval of the new agreement last month, county commissioners took action of their own. On Dec. 12, county commissioners amended an agreement regarding the collection and disbursement of the additional 1 percent hotel tax. Collection of the tax began in October with the first disbursement to occur this month. Since Milford has not issued debt, the commissioners amended the agreement. Proceeds from the new tax will be kept by the county until Milford issues securities. Also this month, state lawmakers ex-

tended Clermont County’s deadline for contracting with a professional sports team and implementing the hotel tax until next year. The additional 1 percent lodging tax was approved in 2017 as a line item in the state budget. It was effective through 2018. Republican Rep. Doug Green was behind the amendment. He did not return a call for comment. Earlier this month the 1 percent lodging tax resurfaced as an attachment to an appropriations bill approved by state legislators, said State Republican Rep. John Becker. In both situations, the item appeared “under cover of darkness,” Becker said. Union Township leadership is questioning whether the 1 percent additional hotel tax is even legal. During a meeting Trustee John McGraw asked if agreements are not approved and finalized, why is the hotel tax being collected? Trustee Matthew Beamer said he finds it interesting the 1 percent hotel tax was first introduced at the state level in the “darkness of night.

to the lawsuit that Forest Hills has grossly undervalued the value of Rack’s work due to a known error on the bid form, but adds in a counter-claim against Rack that the $2 million-plus Rack is seeking is unjustifiably high. It also asserts that the lien is hurting Performance’s attempt to collect money it says Forest Hills owes it. Performance Construction says in a cross-claim against Forest Hills that the school district owes Performance $647,708 in approved work and $172,465 in unbilled work it said it would pay – in addition to money that is the subject of Rack’s lawsuit. Rack also has sued David Zimmer and his business, The Zimmer Co. of Hebron, which provided Forest Hills with construction-management services, and the SSOE Group of Toledo, the school district’s architect for the project. According to Rack’s lawsuit, the three conspired with Forest Hills to delay or withhold payment to Rack in an attempt to coerce Rack into seeking less money for the change orders.

Garbage dump uncovered Rack says in its lawsuit that Forest Hills failed to conduct soil borings and permeability tests at a detention pond on the Anderson High School site at 7560 Forest Road before seeking bids, even though the school district knew or should have known it was formerly used as a garbage dump and full of massive chunks of old concrete. This resulted in change orders approved by agents of Forest Hills, Rack says. “(Forest Hills) instructed Performance that completion of these change orders was necessary so that the 20172018 school year opening would not be delayed, and asked Performance and Rack to expedite or ‘fast-track’ the work,” Rack says in its lawsuit.

“Rack has paid, and continues to pay, numerous of its own subcontractors and material suppliers for the site project despite not being paid itself,” the lawsuit states. Rack also says that it has laid off one-third of its workforce since Oct. 17, 2017, as a result of nonpayment from the district. In addition to being paid for the change orders, Rack wants compensatory and punitive damages from defendants in the lawsuit based on various and differing claims. Forest Hills, Performance Construction, Zimmer, The Zimmer Co. and SSOE Group all have denied wrongdoing in answers filed to Rack’s lawsuit. The school board also said some of the work performed by Rack was not at the direction of Forest Hills, its agents or Performance Construction.

Gun threats and sexting Rack says in its lawsuit that during a meeting at the Anderson High School site Aug. 9, 2017, someone identified as “DZ, as agent of (Forest Hills) and Zimmer,” yelled and cursed at John Rack and called him a liar in front of people. “Upon information and belief, DZ also threatened certain Performance employees that he would pull a gun on them. The threat was made on school grounds,” Rack says. Performance agreed in its filings that this happened. Forest Hills, Zimmer and The Zimmer Co. said it did not. Rack says Ray Johnson, then director of business operations for Forest Hills, assured the company that day it would be paid in full for the change orders. Johnson resigned in October 2017 after he and two other Forest Hills employees were involved in a sexting scandal. Judge Leslie Ghiz is presiding in the case, for which a conference is to be held Jan. 8.

Decadent chocolate-covered cherries will impress Rita’s Kitchen Rita Heikenfeld

It was a request from a reader I couldn’t refuse. “Help! I always make chocolate covered cherries for New Year’s and I lost your recipe. Do you still have it?” And the answer is…yes. The first time I tasted these was when friend, Perrin Rountree, an Anderson Township reader, brought them to work during the holidays. Easy to make, there’s just a bit of technique involved, which I’ve explained in detail. Maybe you need just one more confection for that holiday dessert tray.

Or is it a hostess gift you’re looking for? Get ready to impress the lucky recipient. And as we end the old year and segue into the new one, my prayer is that you finish the holidays with health and happiness, and start the New Year the same way.

Readers want to know Why is my layered peppermint bark separating? A couple of reasons for this, the main one being that you need to use highquality bar chocolate, not morsels, for both white and dark layers. White chocolate should contain cocoa butter, not palm kernel oil. Palm

kernel oil inhibits bonding of the dark chocolate and white layers. Don’t use “chocolate flavored” chocolate. Score the bark after the second layer has become almost firm in the refrigerator. This makes it easy to cut after it's completely set. Before cutting or breaking into pieces, let the layered bark set out just a few minutes. If it’s too cold, it may be too brittle to cut. Any tips on getting everything on the table at the right temperature? Hah, an age old dilemma! I learned

from Teri Gelter, daughter-in-law Courtney’s mom, to cook items that keep the heat in first, like pasta, potatoes, etc. Wrap them in a couple layers of foil (spray the inside of the foil if the food is in a pan so it doesn’t stick to the food), then wrap the whole thing in a couple bath towels. It should stay warm for an hour or so, freeing stove top and oven space. Baked potatoes can be wrapped in foil and then placed in a cooler lined with a bath towel. Candy shop quality chocolate-covered cherries Ingredients 1 jar l0 oz., maraschino cherries with stems Instructions Drain cherries very well on paper towels for several hours. They must be dry for fondant to adhere. Ingredients fondant Not a true fondant, but an easy one. You’ll have fondant left over. Ingredients 3 tablespoons butter, softened 3 tablespoons light corn syrup

smooth. If too soft to handle, chill for 15 minutes. (Mixture can also be made a week ahead, refrigerated and brought to room temperature). Shape 1⁄2 to l teaspoon mixture around each cherry, fitting fondant closely to cherry, enclosing base of the stem as well. Roll in your palms to smooth fondant. Place on baking sheet and chill until firm. This is necessary for chocolate to adhere.

Instructions

Melt chocolate. Let cool a bit – chocolate will be warm and liquid. Dip cherry into chocolate, sealing completely around the base of the stem again, or juice could leak out. Place on sprayed baking sheet. Chill until firm.

Mix butter and syrup, and then mix in powdered sugar. It will look a bit dry but will come together as you knead it

Store in covered container in refrigerator. Bring to room temperature before eating.

As the year ends, now is the time that many people look back and reflect on all that happened to get ready for the year ahead, and BBB is no different. Unfortunately, scammers stay the same from year to year and will continue to work to steal important information from people. To help consumers deter them, BBB has compiled scam information from 2018 to give everyone an idea of what to watch for in 2019. The three scams that were reported most often to BBB’s Scam Tracker this year were phishing scams, sweepstakes scams, and government grant scams. Phishing scams are typically committed using email messages or phone calls that appear to come from legitimate businesses or known email addresses. They often use crude social engineering tools designed to induce panic and trick the reader or caller into a vocal response or clicking on a link in the message. From there, the respondent is then convinced to divulge private information that the scammer then uses to commit identity theft. Sweepstakes and government grant scams are usually conducted by phone and include a claim that the recipient of the call has been awarded a prize or grant only if they pay an upfront fee. People that pressure you for payment should be treated with caution, and if

they ask for money through prepaid means - refuse. These payments are untraceable, and money lost typically can’t be recovered. While they weren’t necessarily scams, several news stories broke this year about data breaches of retailers that customers thought they could trust. The best advice? Make sure to keep an eye on your accounts and change your passwords periodically to keep your personal details secure. Instead of using a password, consider using a password keeper or a passphrase and double check you’re not giving any hints away on your social media postings. Cyber Experts are predicting that next year’s Internet of Things may be at higher risk of not being able to securely retain consumer’s personal information. Any of the new electronics that were intended to make our lives easier should probably be looked at and used with more caution. The days of simply updating a password are evolving to using a passphrase and constantly updating hardware or software will become the norm. It will become more of a necessity to keep our information personal and we’ll have to become diligent on who and with whom we share our email, phone and mailing address to protect against cyber thieves. Many of these large-scale breaches announced in the news are caused by phishing scams; they’re a simple and easy way to gather a lot of profitable information quickly. Customer and employee education should improve awareness of the latest attacks and scams, so

training is an especially important measure for business owners to take. Before we move on to the New Year, here’s one more fun fact to digest: 2019 will see 40 billion mobile phone calls. Half of those calls are expected to be from scammers. The best advice? Hang up or if you don’t recognize the number, don’t answer it and perhaps they’ll leave a voicemail. If they do leave one and you don’t recognize it, delete it. As you look back on your 2018 and think about resolutions for New Year’s, BBB recommends making it a goal to protect your personal information and step up your online security. Listen carefully to calls that request money of you and update the software on your mobile and electronic devices. Keep a close eye on bank statements, watch out for pop-up ads, emails, and text messages from unfamiliar sources and research any apps before downloading them. Leave the transfer tax alone Even the Holiday Season can’t stop more bad news for property owners. Not only are property taxes out of control, but now our County Commissioners are considering raising the property Transfer Tax by one third. Presently, the seller of a home pays $300 per $100,000 of property sold. If the Commissioner’s follow through with the increase, the seller of property would pay $400 per $100,000. The Cincinnati Area Board of Realtors have indicated their opposition, fearing the people will be discouraged from buying homes and moving into Hamilton County. As usual property owners are caught in the middle. On one hand, property owners (many of whom are seniors and on fixed incomes) can’t afford the high property taxes. On the other hand, they will have difficulty in selling their homes because of the additional burden of higher property transfer tax. No doubt, Saturday, Nov. 13, 1993, was a long day for many – students, parents, teachers, administrators, coaches and athletes – associated with St. Ursula Academy. Most likely, it’s easy for most – if not all – of them to remember exactly where they were that day, for it ranks as perhaps the most glorious and unforgettable in the East Walnut Hills school’s long, titleladen sports history. The day started for many with getting up early enough to make the two-hour trip north on Interstate 71 and I-270 to Hilliard High School, northwest of Columbus, for the 11 a.m. soccer state championship match against powerful Westerville North. After that match, played in a cold, driving rain that turned the field into a mudbath, many of the travelers – including Enquirer contributor Tim Pennington – headed south on I-270, then west on I-70 to I-675, pulling in to Wright State University’s Ervin J. Nutter Center for the Bulldogs’ 7 p.m. Division II volleyball state championship match against Thornville Sheridan. The hours and mileage proved worth the time and gasoline expense. The soccer team got two goals each from Katie Veith and Jill Baker to ease past four-time all-state striker and Ohio Player of the Year Lisa Suttmiller for a 4-1 win, earning their second state championship in three seasons with their second finals win over the Warriors. That night, Jenny Esselman led a balanced St. Ursula volleyball offense with six kills and setter Anna Wittrock finished with 12 assists as the Bulldogs dispatched Sheridan 15-5, 15-6 to capture their first-ever state championship in their third final four appearance. Senior Beth Junker admitted the soccer squad’s success pushed the volleyball team. “When they won it two years ago, we were kind of jealous, because we wanted one, too, and when they won it again, then we knew we wanted to go out and win this one,” Junker told the Enquirer.

Coach Bob Sheehan’s soccer team finished the season 21-1-2, yielding just two goals in its last four tournament games – 1-0 wins over Glen Este and Lakota, followed by a 3-1 win over Beavercreek in a state semifinal at Amelia High School. Suttmiller gave Westerville North a 1-0 lead six minutes into the title match against a St. Ursula team ranked No. 1 in the state and fourth nationally, but fullback Cathy Green led a defensive effort that kept the All-American under wraps the rest of the way. “She’s a great player, and I was intimidated a little bit by her, but I just wouldn’t let her turn the corner on me and get by me,” Green said. “If I could do that, then I knew I could hold her.” Veith scored the game-tying goal midway through the half on an assist from Baker and gave St. Ursula the lead with a goal off a crossing pass from Annette Gruber with 18 seconds left before halftime. Baker scored her first goal on a header off a Maria Peracchio lob pass midway through the second half and later gave the Bulldogs control with her second goal. Sheehan made sure his players knew to keep the ball in the middle of the field and away from the sloppy sidelines. “I think it affected them more than it did us,” Green said. One championship down, one to go. The caravan cruised into Fairborn for the volleyball match, which was remarkably one-sided. Playing in their first state championship match after not dropping a game in regional wins over Wilmington and Roger Bacon and needing three to get past Norwalk in the state semifinal, coach July Thoman Perry’s Bulldogs rushed out to a 12-3 lead and needed fewer than 15 minutes to put the Generals on their heels in the first game. They took a 6-1 lead to start the second game, but Sheridan came back to tie the score before St. Ursula regrouped to close out the match and finish 22-4. “I expect us to play perfectly, and we did,” Perry said. “We play the toughest schedule of any team in the state, and that includes any Division I team out there. UC Clermont women’s basketball tips off The UC Clermont College women’s basketball team is starting the 2018-19 season with a ton of talent, and high hopes. The team, which won the United States Collegiate Athletic Association Division II National Championship in 2014, finished around .500 last season. But Coach Rick Hosea, who has led the team for 12 years, believes an influx of new players could propel the squad to more success this year. The Cougars have three returning players and have added talented sophomore transfers Brooke Jenike (BethelTate) from Florida Southern College, Anna Voskuhl (St. Henry) from Midway University in Kentucky and Hanna Thie-

rauf (Milford) from Roosevelt in Chicago. Howdy folks, I was talking to some folks at the store last week and they had a little feller about four years or five years old. I asked him if he was excited about Christmas and Santa Claus. His mother said that is about all he talks about. That got me thinking about the Christmas when I was about five years old and my brother Frank was younger. My dad and mother went over to Goshen to a store a day before Christmas to get something. I remember looking out the car window to see if I could see Santa Claus. When we got home, mom said you

boys had better get to bed and asleep, so Santa Claus can bring your presents. We always hung a sock up, so we did that and went to bed. It seemed we had only got in bed when mom called us and said Santa had been there so come down from upstairs. Boy did we come down. I looked at my sock and there was something big in the toe. It was an orange, apple, English walnuts and some candy. Then we got a little toy and some clothes. I always wondered how Santa Claus knew my size. I asked mom, “What did Santa bring you and dad?” and she said he left them a shiny silver dollar. I didn’t know anything about a silver dollar, but mom seemed happy with that, so we were happy. Christmas in the 30s and 40s was a lot different than today.

I had a great blessing last Friday at the Catholic Church while helping at passing out of food to families. The deacon, Jerry, asked me if I would like to come there on Saturday to help put little red wagons together for needy families along with a Christmas meal. I said after we get done serving food at the Methodist Church, I always serve milk and coffee. He said that would be fine, so I went up to Jerry’s Church and we put some together. Then on Monday evening I had the pleasure of a group from the Methodist Church of children and parents coming and singing Christmas carols to me. That is a blessing. They did this last year and I sure enjoyed their singing. Ruth Ann and I along with a bunch of folks use to go and sing Christmas carols to folks at Christmas. I sure miss Ruth Ann, but we

will be together someday. Talk to Mike at the bait shop in Afton. He said there were a few deer harvested last weekend, but Saturday was a wash out with all the rain. He said a few folks went fishing and caught some crappie and channel catfish. The catfish have been biting good this year. Now if you read this after Christmas, Mr. Chester (cat) and I say a Merry Christmas and have a Happy New Year. I had to quit writing this to hold Chester on my lap. He is a blessing.
