Dear Member, I have been fortunate in the last month to be able to separately address members of both Golf Management WA and Bowls WA. It has been a great opportunity for me to meet with club representatives and discuss local issues. Most of these issues are focused on liquor compliance, and it would appear that the Department of Racing, Gaming and Liquor is examining our use of temporary members for casual players who are not members of another club. Clubs WA will be working closely with the Department on this issue and will keep you informed of our progress. In the meantime, if you would like to discuss how your club complies in this area, please contact either Linda or myself for a more detailed discussion. Another cause for concern for some of our clubs is finance. Clubs WA encourages all our members to have processes in place to ensure your club’s financial obligations are being made. If you are in doubt, please check two things: firstly, when was your last payment to the ATO; and secondly, if you have paid staff, are correct entitlements in particular with their rates and superannuation being applied? If you cannot answer – or indeed do not like the answers to these two questions, please call us for next steps forward. The services such as those above that Clubs WA provides to our member clubs are subsidised by both our membership fees and our training income. A reminder that your
membership also entitles you to additional support including: templates for compliance and management plans; access to harm minimisation documentation; assistance with redrafting your constitution; assistance with alterations to your licence; ability to attend our many and varied workshops; and discounted training for your staff, volunteers and members with Responsible Service of Alcohol training and governance. Your support of our training arm, hospitalityalliancetraining.edu.au is encouraging as not only does it keep your membership fees to Clubs WA low, it provides your club with the best learning outcome to ensure that your club has a team of people who actually know their responsibilities for the sale and service of alcohol. Our next major event will focus on how we can help your club raise revenue and keep costs down and we are fortunate to have Clubs Australia CEO Anthony Ball coming along to discuss how this is done in other states (without relying on poker machines). We are keen to generate a discussion on what is working/not working in your club and solutions to issues such as computer systems; banking and fundraising. Drinks Standards for the hours covered by this permit variation 1. Liquor sold and supplied is restricted to one bottle of wine not exceeding 750ml or a maximum of four alcoholic drinks per person at any one time; 2. Liquor is not to be sold or supplied in non-standard measures - this includes jugs or pints of spirits and shooters or shooter style drinks; and 3. Pre-mixed alcoholic energy drinks are prohibited and the sale and supply of liquor mixed together with an energy drink is prohibited. Lodge of Applications Licensed clubs must lodge their applications as soon as possible. Late applications may not be considered. When applications are lodged, other than for Club Restricted licenses, the fee will be calculated based on the total number of people estimated to be present over the whole event. In addition, fees will be capped at $1100 for the event regardless of the number of persons present. General Conditions 1. During permitted hours under an ETP or a variation, the licensed club is authorised to sell liquor on the licensed premises for consumption on the licensed premises only ancillary to the provision of televised coverage of the Rugby World Cup 2015 matches. 2. There is to be no liquor discounting or advertising of cheap liquor. 3. Live entertainment by one or more artist present in person, or performing by way of recorded music is prohibited. 4. For special facility licenses required to provide food during permitted hours, this condition will not be varied. For other license types, light food and non-alcoholic beverages must be available. 5. The licensed club and/or an approved manager must contact the officer in charge of the closest police station to the licensed club within 24 hours prior. 6. During the permitted hours authorised under the permit/variation, patrons are prohibited from entering or re-entering the licensed premises twenty minutes after the kick-off of each match. 7. Where the permitted hours under an ETP or variation of license conditions has been approved to accommodate more than one match, patrons may enter or re-enter the licensed premises during the interval between the conclusion of one match and, up to twenty minutes after kick off of the match. 8. Patrons must vacate the licensed premises within thirty minutes of the conclusion of the televised game/s.

The Rugby World Cup will be held on 18 September to 1 November 2015, and live telecast of the matches will generally occur in Western Australia outside normal trading hours. Licensed clubs wishing to provide televised coverage of the matches are required to apply for an extended trading permit or variation of hours to trade during hours not covered under an existing license or permit. Applications should be lodged at least 14 days prior to the first match to allow sufficient opportunity for Police and Local Government Authorities to provide comments to the licensing authority. Licensed premises located in residential areas will be required to notify residents within 200 metres to enable them to respond to the proposed hours of trade. Where applications for extended trading hours are approved, those approvals will generally be subject to, but not limited to, the following conditions:-

Not even a factory fire that left the business in ashes and the rise of Asian manufacturing could stop WA-owned and family-run business Gascoigne Furniture. It is one of WA’s leading furniture manufacturers and retailers, bringing together a huge choice of exclusive designs. With founders Kim and Helen Gascoigne at the helm, it has been running for more than 30 years, with about 130, 000 West Australians sitting on a Gascoigne sofa every day. Former Australian Prime Minister John Howard even ordered a Gascoigne sofa – and liked it so much he ordered another.
And in 1999, a devastating fire accidently started by two workers razed its main manufacturing plant in Midland. “We took a massive loss on the chin, but we rebuilt from the fire. It was the toughest time for the business,” the 64-year-old said. “We went from a massive turnover. We were employing 130 people at the time, plus subcontractors and supplying 264 stores in Australia and New Zealand, plus exporting to 12 countries.” But the business survived by moving into retail as well as moving most of its manufacturing to

I think it’s why we have survived.” Mr Gascoigne said. “Everybody comes to us after they’ve bought from one of the big companies saying, ‘I’ll never buy from them again.’ If anything, people come and say our stuff lasts too long.” The business now employs 160 people and also includes a restoration and renovation division. Its total annual turnover is about $14.5 million. Mr Gascoigne said he loved his trade thanks to “the enjoyment you get from creating something beautiful.” “I get a lot of satisfaction out of it,” he said. “We like to create the most beautiful furniture possible. I also love to see young employees grow and turn into wonderful people. I’ve met some wonderful people through running this business.”

Clubs WA’s policy, direction and strategies are determined by a State Council of 12 elected members, six metro (according to the Planning and Development Act, Schedule 3) and six country, with half retiring every year. We are now seeking nominations for three (3) metro and three (3) country delegates to fill vacancies at the 2015 AGM - retiring members can renominate. Club News Community sport projects get a helping hand A local skateboard park will be expanded, a show jumping arena will be upgraded and practice cricket nets will be installed at a range of ovals, thanks to the latest round of the State Government’s Community Sporting and Recreation Facilities Fund (CSRFF). Sport and Recreation Minister Mia Davies announced 28 projects across Western Australia would share in $793,350 in the latest Small Grants round. “This scheme allows clubs and local governments to take on small but important projects which they might not otherwise have the money for,” Ms Davies said. “Funding in this round goes towards creating better amenities for local sport and recreation participants, encouraging them to be more active and join local clubs.” As part of the round, applications from the Shire of Murray, Shire of Gingin, City of Mandurah and Shire of Cranbrook totalling $43,456 are being funded for planning studies. “New and well-maintained sports facilities encourage greater participation which helps connect people, build resilience and strengthen communities,” the Minister said. “Clubs and local facilities provide the glue which holds many communities together - especially in regional areas.” There are two Small Grants rounds a year. Applications for the latest round close on August 31, 2015. The 2016-17 large CSRFF grant round is currently open and closes on September 30, 2015.*

Retiring soon? Some things to consider Retirement can be a time to explore some of the things you have been putting off for ages, such as traveling overseas, devoting more time to your hobbies, or spending valuable time with your grandkids. The lead up to retirement, however, may be stressful if you‘re unsure about your financial options. Having a combination of past savings and investments to draw an income from will give you some peace of mind. This may include selling shares and investment properties, relying on interest from saving accounts or term deposits, or downsizing your house and living off the proceeds. Or, it may simply mean having access to their super or the Age Pension, or a combination of both. Of course, an important consideration is knowing how much you may receive when you retire and how much savings you will be living on. To get a reasonable estimate, use the calculator at clubplussuper.com.au/super-modeller. This will give you a valuable gauge about setting a realistic time-frame about when you can stop work altogether.
When can you access your super?
Transitioning from working to retirement
As super provides a number of tax advantages, the government restricts early access to the payment of benefits. If your main source of income will be your super, the minimum age you can retire permanently and get access to it from 1 July 2015, is 56. Thereafter, depending on when you were born, there is a gradual increase to age 60. After age 60, you can simply change jobs and receive your super benefits. There are also special circumstances which allow partial payments from your super before retirement. These include situations where you may be experiencing severe financial hardship or are unable to continue working because of a serious health issue.
Another way of accessing part of your super without retiring is to start a Transition to Retirement (TTR) pension. This option is only available from age 55 onwards and allows you to either boost your super balance by ‘salary sacrificing’ or reduce your working hours and supplement your income by drawing money from your pension. Before you consider this strategy, it is recommended you seek financial advice as it does involve complex tax arrangements. Furthermore, you need to understand there may be consequences to accessing your super early, such as reducing the amount of money you can have during your retirement. You should also be aware that there are a number of rules for setting up a TTR pension. These include having a separate pension account from your normal super member account which you pay contributions into. You are also subject to annual minimum and maximum withdrawal limits and generally, you cannot exchange your TTR pension for a lump sum unless you have retired permanently. Qualifying for the Age Pension

A large proportion of retirees leaving work in the next few years will also rely on the Age Pension to supplement their retirement savings. As at 20 March 2015, the maximum fortnightly pension amount paid to a single person was $782.20 and $1,179.20 for a couple. This amount is paid only if you qualify for the full Age Pension. Eligibility for the Age Pension is determined by an income test (how much income you receive) and assets test (how much your assets are valued at). You need to pass both tests to qualify for a full or part Age Pension payment. From 1 July 2017, the Age Pension qualifying age will increase from 65 to 65½ years. The federal government has also recently introduced additional changes to the assets test that will come into effect from 1 January 2017. So if you’re planning to retire in the next couple of years, you should talk to your financial adviser to find out how these changes will directly impact your ability to qualify for the Age Pension. With an ageing Australian population, it’s no secret that the government will continue to tighten eligibility requirements in order to lessen the financial burden Age Pension entitlements place on the federal budget.

Consequences of unauthorised leasing of club premises The High Court recently considered a case involving an unauthorised lease of a club’s dining area. The key facts are: The New South Wales Polish Club entered into a lease agreement with another party to run a restaurant and function service from the Club. The lease breached the Club’s liquor licence obligations. When the relationship between the parties broke down and a dispute arose the Club wanted to avoid the lease and so argued that the lease was unenforceable because it was in breach of the NSW liquor legislation. The Club claimed there was, therefore, no lease of the restaurant area. The High Court was not persuaded by the Club’s arguments and found in favour of the restaurant tenant. The Court found that even though the agreement did breach the Club’s licence and the liquor legislation, it was still valid and enforceable as a lease to use and occupy premises. Despite the case relating to NSW law, the High Court decision has authority in Western Australia. Consequently this decision serves as a timely reminder for clubs of the obligations associated with leasing out some or all of club premises. The Liquor Control Act 1988 (WA) provides that every full club licence is subject to the condition that the club retains the right to occupy the licensed premises to the exclusion of all others. This condition continues to apply during any period that the licence is suspended. This means that clubs operating under a full club licence cannot enter into any agreement which gives rights to another party to use the kitchen, restaurant or any other part of the premises. This can potentially include, for example, allowing a chef to run his/her catering business from the club whilst providing catering services to members, which is a scenario sometimes contemplated by clubs. If such an unauthorised agreement or arrangement were to be entered into, sanctions under the liquor legislation could potentially be imposed and potentially in the worst case scenario it may result in the club losing its interest in the licence. These adverse consequences would prevail despite the possibility of a court upholding the agreement on the basis of the High Court ruling.

Raised in the Swan Valley, Larry studied winemaking at the famed Roseworthy College in Adelaide. After working at Hardys Tintara, he moved back to WA as Senior Winemaker for Houghtons in 1998. Within six months he was promoted again, this time to Regional Manager for parent company BRL Hardy’s entire West Australian operation. Now in his role as Director of Winemaking for Robert Oatley Vineyards, Larry is crafting wines that have varietal clarity, focus and which reflect their provenance - in a very modern fashion.
