As we go to press, we are working on the finishing touches for our annual gala dinner and WA Club Industry Awards, to be held at Crown Perth on Saturday 11th June. This year marks the 10th anniversary of this event and I am excited to be part of the celebrations which include a Great Gatsby inspired theme. I look forward to seeing the winner of the best dressed competition, which I believe will be heavily contested this year! Back by popular demand, will be the fabulous 9-peice band the Milford Street Shakers, with a special performance by ARIA Hall of Fame inductee Johnny Young. There will also be a Gatsby inspired performance by the WA Performance School. So if you haven’t already booked your ticket to our celebrations, please contact our office on 1300 640 616 to discuss the special packages available. This year we organised an Events Consultant to manage the Awards process, Sandra Azavedo. Sandra has contributed above and beyond to our organisation and on behalf of all the State Council and staff, thank you Sandra for all your efforts, it has been greatly appreciated. Sandra’s contract finishes up at the end of this month as she heads to Melbourne to establish her own company, and we wish her all the best with her new business.
With the end of the financial year for most clubs also on the horizon, I would like to remind you to consider conducting an audit of your club’s compliance as well as your financial audit. Clubs WA has an audit checklist readily available on the Members section of our website, as well as a host of other templates to assist you in managing your club. The new Associations Incorporation Act is still progressing, with changes expected to commence in July. For more information on how disputes should be settled within your club, please refer to our articles on page 10 and 13 of this Bulletin. SilverSport gives seniors a sporting chance Belmont residents aged 60 and older will be among the first in WA to take part in a new program by the Department of Sports and Recreation that provides up to $200 to help keep seniors active. The funding granted to individuals by the program can be used towards fees, uniforms and equipment for sport and recreation activities. SilverSport will start from July 1 and will be available to adults 60 and above who hold a Health Care Card or Pensioner Concession Card. Sil

We understand that it was not possible for all Clubbies to attend this workshop due to time and travel restraints. For this reason, the workshop was professionally filmed and is ready to share with those who could not attend. The video is now available to access for $33 including GST. Marmion Angling & Aquatic Club celebrates parking upgrade The City of Joondalup held an official opening of its recently redeveloped Marmion foreshore carpark. The development included 38 extra parking bays, a staircase leading to the beach, a beach shower, lighting upgrades and a 75m mural. The construction was funded by the City of Joondalup, Marmion Angling and Aquatic Club and the State Government.
New grass field for Gosnells Clubs WA’s first full size synthetic soccer fields are part of the City of Gosnells’ $47 million redevelopment of Mills Park in Beckenham. Resurfacing soccer fields with synthetic grass is seen as a way to meet surging demand for sports facilities across suburbs because more games can be played on the artificial surface without it wearing out.
Scarborough Surf Life Saving Club relocation Scarborough Beach foreshore is part of Premier Colin Barnett’s next project to promote state tourism, with an extra $18 million budget boost to complete the project. It will include construction of temporary facilities and the relocation of the Scarborough Surf Life Saving Club, reconfiguration of car parks and removal of a small section of man-made sand dunes. Planning is expected to be finalised by mid-2016.
New sporting complex for Wanneroo clubs The launch of the new clubrooms marked the completion of the Kingsway Regional Sporting Complex development, which also included building a hall, change rooms, kitchen facilities and equipment storage areas. Wanneroo Mayor Tracey Roberts said in a media release: “the upgrades and new facilities will allow more residents the opportunity to stay active and healthy in their local area.”
Cottesloe Golf Club’s Curtis Luck takes out WA championship Cottesloe Golf Club amateur golfer Curtis Luck (19) is now the 2016 Open Champion after winning the annual four day competition at WA Golf Club in Yokine on the 2nd of May. Luke is the third amateur in 25 years to win the WA Open and said it was his “best win” so far.
Surf life saving clubs welcome funding boost Surf lifesavers have welcomed a financial boost from the City of Wanneroo’s unspent funds and a committment to annual funding. The council decided last week to allocate $33,250 each to Yanchep and Quinns-Mindarie Surf Life Saving Clubs retrospectively for the 2015-16 season from unspent money allocated to the beach safety education and awareness program. The council also agreed to give the two clubs up to $40,000 a year through a funding model agreement that will start in the 2016-17 patrol season.
WA celebrates 120 years of organised soccer May 2016 marked the 120th anniversary of the official football matches played in this state. WA’s first competitive soccer matches were played on May 30, 1896 and involved Fremantle Wanderers against Crusaders at Weld Square in Perth, and the Perth Football Club against Civil Service.
Morley club opens refurbished premises The Morley Noranda Recreation Club marked its 40 year anniversary with a cermony in May, in the club’s newly refurbished facilities. The refurbishment included an upgraded commercial kitchen, meeting room, change rooms and reception area. The State Government contributed $800,000 towards the project.

Changes to the Associations Incorporation Act will take effect July 1 Although it remains likely that the regulations will not be available until the expected new Act is ratified in July, Clubs WA will still make available a new draft constitution template for you to review for your club, from mid June. The Department of Commerce will also unveil the ‘Associations Online’ system on the 1st July 2016. This is an integrated online solution to all your associations requirements, which will enable your club to lodge documents, change association details, purchase a copy of your constitution or certificate of association and more. In the coming months, Clubs WA will develop a workshop which will be dedicated to Associations Online so member clubs will have a full understanding of this online portal. We will also invite a keynote speaker from the Department of Commerce to the annual Club Industry Forum to highlight the system and to answer specific queries on the new Act. A reminder you will still have 3 years to transition to the new Act. However, please be aware that where your constitution differs from the Act or the regulations, the Act/regulations will override your constitution. In particular, clubs will need to be aware that the Department of Commerce model rules contain a very detailed Dispute and Mediation clause. In this, clubs will need to allow for the following process to ensure natural justice is provided: 1. Member complaints against other members/ committee complaints against members that result in a disciplinary hearing, allows the accused member the support of a representative.
2. The accused member is provided the opportunity to sight the complaints made against them and has the opportunity to respond to these complaints. 3. After a decision to suspend or expel the accused member has been made, that they are provided the opportunity to appeal the decision and/or seek mediation. 4. If after appeal and/or mediation the charge against this member is not dropped – they are advised they can take their concerns to the State Administrative Tribunal (SAT). SAT will make a decision which could refer the dispute to mediation or [if the correct process was not followed] give orders to either direct the club constitution be followed or enforce the rights and obligations of the club and members. Clubs WA will provide a Dispute and Mediation clause tailored to our clubs, which will be available on our draft template to be placed on our website by the end of this month. Also, a reminder to update your address details/register with Associations Online before 29 September https://associations.commerce.wa.gov.au/associations/ public/publicHomePage.jspx. Clubs WA will be hosting a ‘Secrets for Secretaries’ on Monday 22nd August, which will cover the new Associations Incorporation Act. Process for changing your club constitution 1. Download the Clubs WA template constitution from the member’s section of the Clubs WA website: http://www.clubswa.com.au/Members/Tools-forYour-Club/Club-Templates 2. Ensure you have the most current constitution on file (if unsure you can check with the Department of Commerce as the only current copy is the one that they hold in their system). Phone: 1300 304 074. 3. Discuss what your club wants to change in your constitution and what needs to remain fixed in the constitution. 4. Draft the suggested changes at the sub-committee or management committee level. 5. Obtain approval at the management committee level. 6. Send your draft to Clubs WA for review. 7. Review Clubs WA feedback and amend as necessary. 8. Send the final draft to Department of Racing, Gaming and Liquor (RGL) for comment (you will need to follow this up). Please email this in the first instance to rgl@rgl.wa.gov.au and then follow up with a phone call 2 weeks later if you have not heard anything – at this time ask to speak to the person that has been assigned your draft. You need to allow at least one month for this process with RGL. Obtain a written response from RGL on your draft changes. 9. Ensure that the proposed changes are noted in a Special Notice of Motion to your members, with the timeframe as indicated in your current constitution 10. All members (including non-voting) must be advised as per your current constitution requirements.
11. Hold your General or Special General Meeting to have the Special Resolution accepted. This agenda item must be raised by the AGM convener (as per your constitution) as a Special Resolution. It should be moved and seconded by a committee member involved in the process and must be passed by a three-quarters majority of the Delegates present and voting. 12. Within one month of the passing of a special resolution to alter your constitution (the rules) you must lodge notice of the special resolution with the Commissioner for Consumer Protection at the Department of Commerce. The notice must set out the particulars of the alteration and include certification by a member of the committee that the resolution was duly passed as a special resolution and that the rules of the association as altered conform to the requirements of the Act. 13. Associations Form 5, ‘Notice of Special Resolution Altering the Rules of an Incorporated Association’ must be completed and the appropriate lodgement fee must accompany the notice. Current schedule of fees are: • $23.10 (for change of rules only) • $46.20 (changes to the name OR objects) • $69.30 (changes to the name and objects) This can be done via post or online at: https:// associations.commerce.wa.gov.au/associations/public/ publicHomePage.jspx 14. You will also need to inform the Department of Racing, Gaming and Liquor of your final changes with a copy of your changes and a cover letter with the changes made to the Director of the Licensing Division. WAFL Count Me In:
Getting everyone involved
The Count Me In program was once again celebrated at the Western Australia Football League (WAFL) Round 5 games. Run by the State Government, the successful event is now in its third year, highlighting the importance of access and presence of sport and recreation in people’s lives. The event was developed in partnership with the Disability Services Commission, the WA Football Commission and the Department of Sport and Recreation. Disability Services Minister, Donna Faragher said the event reflected the State Government’s aspiration that “we all live in welcoming communities that facilitate citizenship, friendship, mutual support and a fair go for everyone.” The Count Me In program achieves this by focusing on: economic security and well-designed and accessible communities and homes; participation and contribution for people with disability in all aspects of life; and the provision of personalised supports and services which are innovative, flexible and person-centred.

Count Me In Football is just one aspect of the program that promotes inclusion and a fair go for people with disabilities. Some clubs and the WA Amateur Football League’s integrated football league host football coaching lessons for children with disability. In addition to this, people with a disability, their friends and family are invited to attend games for free. The integrated football program invites players over 16 years of age with an intellectual disability to join the team and play short games of football during half time at the Count Me In games. “It is important everyone in our community, including people with disability, have the opportunity to enjoy the benefits of getting involved in sport and recreation - it’s such a big part of our culture in Western Australia,” Minister Faragher said in a media release by the Department of Sport and Recreation. The Count Me In Round was promoted at the Round 5 league games involving East Fremantle vs Claremont at ATOM Stadium, East Perth vs West Perth at Medibank Stadium and Perth vs South Fremantle at Lathlain Park on Saturday the 16th of April. A game on the Sunday 17th of
April was also held that saw Swan Districts vs Subiaco at Steel Blue Oval. The round included demonstration games at half time by integrated football teams, Count Me In promotional activities and appearances at League games by special guests. 23 year old boundary umpire, Ryan Sinclair was just one of the participants who took part in the 2016 WAFL Count Me In Round. Born in Port Hedland Hospital without a lower left arm, Ryan has always been involved in sport and has never let his disability hold him back. Ryan has been a boundary umpire for 120 senior WAFL games and has played over 100 games with the South Perth Junior Football Club from the age of 10 to 17. During footy’s off season he plays cricket for the Curtin Victoria Park Redbacks.
The Count Me In round is a great way to remind people that everyone can enjoy the benefits of being a part of a sports club, whether on the field as a player, on the sidelines supporting the team, behind the scenes fundraising or taking part in the social side of club life. People with disabilities who had Companion Cards gained free entry to any of the WAFL home games during this round, along with their companions, or people with specially marked tickets. Time to work together on road safety The stark reality of road trauma is never more apparent than for those who farewell a loved one in the morning only to receive news of their sudden death in a crash. Each of those killed in crashes on our roads had plans for the year ahead and for the future. Each was loved by someone and will be mourned by someone, long into that future they’d planned. The dreadful circumstance of the Labour Day weekend in WA this year brought sharp and immediate focus to the issue of road safety, with 11 people killed in six crashes – five of them in regional WA. With the increased community and media focus on road safety comes the opportunity for all of us to work together to promote road safety awareness. The Road Safety Commission came into existence in July 2015 and works as an enabling agency for ideas that help to educate the community around road safety, with a view to reducing deaths and serious injuries on our roads. Through the administration of the Road Trauma Trust Account, the Commission funds a range of projects which fall within the scope of the State Government’s Towards Zero 2008-2020 road safety strategy, the four cornerstones of which aim to build and encourage safer roads and roadsides, safer vehicles, safer speeds and safer road use. Importantly, the Commission welcomes community engagement and the ability to expand upon ideas generated at grass-roots level. It funds a community grants program, which enables communities to generate ideas that will encourage dialogue around road safety, through participation in events which educate and inform. Nothing speaks community better than the idea of being part of a club and, with about 320,000 or so members around the State, Clubs WA has an important opportunity to educate and inform its members about road safety.
The chance of being involved in a fatal or serious injury crash in regional WA is statistically four times higher than in the metropolitan area. However, in 2016 the regional road toll for the first quarter spiked to a 12-toone likelihood, with three times as many people killed in regional WA as within the metropolitan boundaries. Clubs around WA are hubs for enjoyment and social engagement. Part of that interaction involves socialisation around the use of alcohol, be it a few drinks after a game or an organised event for family and friends. The responsibility for road safety rests with us all and it is for each club member in WA to ensure they look after each other. Don’t let a mate or family member drive drunk. Don’t let someone who’s had a long game on the field jump into their vehicle for a long drive home. They’re simple messages but, judging by the data received each year they’re messages that, for some, don’t cut through. Fatigue is one of the contributing factors to regional road deaths but fatigue can strike on short journeys too. It’s a hard one to measure, as it’s difficult to assess whether someone was tired, unless there’s a surviving passenger to attest. However, it’s usually the driver behind who sees a vehicle swerve, for no apparent reason, who can tell that fatigue was at play. Alcohol consumption was attributed to almost a quarter of the road deaths in WA in 2015, while speeding was believed responsible for 39% or 62 fatalities. As road users, we all share the responsibility for road safety. Whether we drive, cycle or walk, we’re all road users during our lives and it’s up to us to join forces, as one big club, to keep each other safe.
The first question usually asked by the community when a crash happens is what was the cause? Sadly, we know that speeding and alcohol consumption are major contributing factors to road deaths in Western Australia. In 2015, a staggering 60% of fatalities on WA roads were the result of crashes police suspected involved at least one driver behavioural factor, such as speeding, alcohol use, fatigue or inattention.

The Leukaemia Foundation Club Community Partner Clubs WA is very excited to be working with the Leukaemia Foundation this year to help promote their annual fundraising campaigns amongst Western Australia’s vibrant community club sector. The Leukaemia Foundation is the peak body for blood cancer in Australia, funding research and providing free services to support people with leukaemia, lymphoma, myeloma, and related blood disorders.
“Campaigns such as U.G.L.Y Bartender of the Year raise important funds, so that we can be there for families who are impacted by blood cancer when they need help the most. We look forward to having Clubs WA supporting U.G.L.Y Bartender of the Year this year,” said Andrew. Clubs WA Chief Executive Officer Karen Giles said clubbies love to be involved in community campaigns.
This year, more than 13,000 Australians are expected to be diagnosed with leukaemia, lymphoma, myeloma or a related blood disorder, equivalent to 35 people each day. The Leukaemia Foundation is able to assist these people by providing free support to people with blood cancer and their families, including: information, education, emotional care, transport to and from treatment and accommodation for regional Western Australians required to move to Perth for treatment. The Foundation also invests millions of dollars into blood cancer research each year.
“We know that Western Australian clubs are often at the forefront of fundraising challenges - they are the heart of their communities. Whether it’s in a time of need, or a local charity or group needs some help, community clubs are always there to offer their venues, volunteers and staff,” said Karen.
