WORDS FROM THE CEO Dear Member, On the 24th of July Clubs WA proudly celebrated the 60 anniversary of our industry association.

Established in 1957 as the peak body for Western Australian licensed clubs, we now have membership of more than 500 clubs across the state, from Kununurra to Esperance. For more than 60 years, we have been an integral and important voice within the industry, working with government, the private sector and independently to enhance and strengthen the role of clubs in the community. As both Clubs WA and individual clubs move into the future, we need to ensure that we continue to adapt to the ever-changing recreational and cultural needs of our society. Our industry has faced significant challenges over the past 60 years, including competition within the hospitality sector, increasing regulatory constraints, a tighter economy, and declining alcohol consumption all playing a part in where our industry currently sits.
ANNIVERSARY Supporting the Club Community for 60 years
The 2015 KPMG Club Census showed our industry now has 453,000 members across almost 1,000 clubs, and the sector generates more than 696 million dollars in social contribution for WA per annum. Not bad for a volunteer-driven group of clubbies! Formerly the ‘Registered Clubs Association’ up until the 1970’s, Clubs WA has come a long way since its incorporation in 1957. We did not have any fulltime staff until the 1990’s and have now progressed to a committed team of seven. Our staff, much like our clubs, put in many hours including voluntary time and I thank them for their dedicated work. Thank you also to our hard working State Councillors, both past and present, for your tireless efforts. It has been greatly appreciated. As we continue to overcome each of these challenges, we have a great opportunity to develop new offerings for our communities within a safe, family friendly environment. We work in a unique sector, where to survive clubs must constantly strive to find a manageable balance between running business operations whilst providing essential community services.

Once again I have been fortunate enough to visit more clubs around the state, the last visit being clubs in the Geraldton area. I really appreciate being able to sit down with clubs and discuss local issues as well as being able to clear up any queries regarding compliance. From my visits this year and our in-house workshops, there has been a common concern across clubs regarding both physical and metaphorical ‘safety’ aspects within a club environment. For this reason, this year’s Club Industry Forum will follow the theme of ‘Keeping Clubs Safe’. The focus will be on both Club Health including Occupational, Safety & Health, as well as building Safe Cultures within clubs by addressing concerns with mental health as well as bullying and harassment. Registrations for this annual Club Industry Forum & Supplier Expo are now open and a registration form and event information sheet has been enclosed in this publication. We will continue to announce and confirm event details in the coming weeks, so please keep an eye on our weekly E-News updates for further details.
I strongly encourage you to send representatives this year to update your team on the current responsibilities of club management and plan for the future of your club. Potential Consolidation of the Clubs Let’s see the Understanding. Generous. Likeable. You Award and the Hospitality Award On Friday 28 July 2017, Clubs Australia Industrial submitted an application to the Fair Work Commission to revoke the Registered and Licensed Clubs Award 2010 (the Clubs Award) and to vary the coverage of the Hospitality Industry (General) Award 2010 to include provisions for employers and employees covered under the Clubs Award. The consolidation of the Awards was prompted by pressures from United Voice (UV) for an agreement which includes a non-negotiable Memorandum of Understanding with UV for the clubs industry to ‘give positive encouragement to the participation of employees in the industry to join UV and furthermore, that it gives active encouragement to Clubs to enter into Enterprise Bargaining Agreements with UV’. We will keep member clubs informed with progress on the application.
New Work Health and Safety Bill to protect workers The McGowan Government has given the green light to develop a modernised Work Health and Safety Bill for Western Australia. Based on the national Work Health and Safety Act, the Bill will improve consistency with the rest of Australia and provide the primary legislation for workplace safety and health across all Western Australian industries. Consistent with the Government’s commitment to reduce red tape, the Bill will replace three Acts: Occupational Safety and Health Act 1984, Mines Safety and Inspection Act 1994; and Petroleum and Geothermal Energy Safety Levies Act 2011. The development of the Bill will involve consultation with stakeholders and the community, prior to expected introduction to State Parliament in mid-2019.

From car washes to quiz nights to cocktail classes and more, U.G.L.Y. Bartenders come up with unique and innovative ways to raise funds and ramp-up the funfactor in their venues. See page 14 for more details.
CSRFF Forward Planning Grants The Department of Sport & Recreation will allocate between $166,667–$2,000,000 to large scale projects where the total project cost exceeds $500,000 and may require an implementation period of between one and three years. Grants given in this category may be allocated in one or a combination of the years in the triennium. Examples of forward planning projects: • Multipurpose leisure/recreation centre • Swimming pool – new or major upgrade including heating to allow increased use • Construction of large synthetic fields • Playing field construction • Clubroom – new or major upgrade • Large ablution block/change rooms. Application process and timelines The Community Sporting and Recreation Facilities Fund (CSRFF) forward planning grants have one round each year. The round opened in June and will close on September 29, 2019. Successful applicants will be notified in February 2018. Clubs WA Welcomes New Acting Commissioner of Road Safety Acting Commissioner of Road Safety Iain Cameron is determined to achieve road safety results for the community through a focus on customers, organisational values, culture and working collaboratively. “It’s very energising, very exciting to be back involved in road safety in my home state of Western Australia,” said Mr Cameron. “I’m really looking forward to sharing my experience and putting the direct benefit into our community, by effectively implementing our world leading road safety strategy, Towards Zero 20082020.” Iain Cameron with Karen Giles Mr Cameron lead the Office of Road Safety from 2000-2015, and remained involved in road safety on a national scale, through a chairing role with Austroads and as an Independent Director on the Board of ANCAP.
On a global scale, Mr Cameron chaired the working group tasked with producing the 2016 OECDInternational Transport Forum Report Zero Road Deaths and Serious Injuries: Leading a Paradigm Shift in Road Safety and is on the board of UK registered charity, the Toward Zero Foundation. “I envision the Road Safety Commission as a leader amongst leaders as an agency, working collaboratively with other Government agencies and stakeholders to get the best out of our existing programs and encourage new projects to get better results for our community,” said Mr Cameron.

New Police Commissioner for WA The State Government has appointed Chris Dawson APM as Western Australia’s new Commissioner of Police. Mr Dawson was formerly WA Police Deputy Commissioner for 10 years and has more recently headed up the Australian Criminal Intelligence Commission for the past three and a half years. State Cabinet and Executive Council have approved the appointment for a term of five years. Mr Dawson has more than 30 years of law enforcement experience, having served in both country and metropolitan positions throughout Western Australia. As superintendent, Mr Dawson was the inaugural principal of the Joondalup Police Academy. As Deputy Commissioner of WA Police, Mr Dawson was responsible for the serious and organised crime and Counter Terrorism portfolios. In 2011, Mr Dawson headed up the biggest security operation in WA Police’s history - the Commonwealth Heads of Government Meeting. Mr Dawson commenced as Commissioner of Police on August 16, 2017, following the retirement of Karl O’Callaghan.
Have your say on the Local Government Act (1995) This Act is currently being reviewed under two stages: modernising local government; and positioning local government to deliver for the community. Clubs WA is preparing stakeholder feedback for submission to the the Department of Local Government, Sport and Cultural Industries on this review. We invite your comments on the Act, such as instances where you have felt there needed to be improvements to the Act to allow for greater communication with the club industry. Although this review will take a while, Clubs WA is keen to start compiling club feedback in preparation for submission to the review panel. Please address comments to karen@clubswa.com.au.

Clubs WA’s policy, direction and strategies are determined by a State Council of 12 elected members, six metro (according to the Planning and Development Act, Schedule 3) and six country, with half retiring every year.

IS YOUR CLUB INCOME TAX EXEMPT? BY DANIEL PAPAPHOTIS, B COM CPA, CLUBS WA REGISTERED COMPANY AUDITOR WHY A YEARLY SELF ASSESSMENT IS IMPORTANT FOR EVERY CLUB To help you determine if your club qualifies for the income tax exemption status, it is recommended that you perform the ATO self assessment checklist every year. Here are my steps for your club: 1. Work through the below flow chart from the ATO. Is your organisation a charity? For more information refer to Is your organisation a charity? (QC 16641).

You can self-assess whether your organisation is income tax exempt. Work through the Types of income tax exempt organisations to see if your organisation fits within any of the categories listed and meets the requirements for exemption. The worksheet will help you do this.

2. If your club then needs to self assess whether you are exempt from tax because you are not a charity or registered under the ACNC, then you must look at the types of income tax exempt organisations.
In other words, your club must fit under one of these broad groups: • Community service organisations • Cultural organisations • Educational organisations • Employment organisations • Health organisations • Resource development organisations • Scientific organisations • Sporting organisations
3. If your clubs fits in one of the above groups, then you must meet other requirements to be exempt from paying tax. If your club doesn’t fit in one of the groups above, then you will be liable for tax on non member income.
If your club falls into one of the broad categories, then you must also satisfy the following other requirements to be exempt from income tax. This includes passing at least one of the following: • A physical presence in Australia test - ie your club has a physical presence in Australia. • The Deductible gift recipient (DGR) test - requires your club to be a deductible gift recipient (DGR). • Prescribed by law test – applications can be sent to the government, where they will determine if the club is tax exempt. More information on this can be found at www.ato.gov. au/Non-profit/your-organisation/do-you-have-to-payincome-tax-/requirements-for-self-assessing-entities/ From here the next requirement is that the governing rules must be in place (in the constitution). This means that you must operate only in a manner consistent with the rules of core importance to your operation, including those related to your objects and those relating to your not-for-profit status. Finally, the final requirement is passing the income and assets condition. The organisation will meet this condition if it applies its income and assets solely for the purpose for which it is established. 4. If your club is satisfied you are exempt from tax, then you should complete the checklist form provided by the ATO.
This form doesn’t need to be sent off to the ATO but it should be signed off by the committee every year. ASSOCIATIONS INCORPORATION ACT 2015
FROM CLUBS WA MANAGEMENT
It has now been just over 12-months since the Associations Incorporation Act 2015 (referred to as the Associations Act) came into effect replacing the previous law for incorporated clubs and associations. Just a reminder of a few key activities your club should have already submitted or started to work on. UPDATE YOUR ADDRESS DETAILS Your club should have already notified the Department of Mines, Industry Regulation and Safety (DMIRS) (previously the Department of Commerce) of their address details. This information was due by 29 September 2016, but if you have yet to notify the DMIRS of this information please do so immediately through AssociationsOnline. COMMITTEE ELIGIBILITY It is important to check that all currently serving committee members are eligible to do so under the Associations Act. INFORMATION STATEMENTS DUE A reminder that your club must submit an information statement to Consumer Protection within six months after the end of their financial year. This statement is to confirm that your club is still active, that it’s eligible to be incorporated and that you have held your Annual General Meeting. You can lodge this statement through AssociationsOnline. Information you will need when lodging: • Your club’s current address (either street address or a PO Box); • The date of your most recent AGM; and • Your club’s total revenue for the last financial year. You will also need to confirm: • Whether you have at least six (6) voting members; • Your club’s main purpose (ie educational, sporting, recreation, religious); and

Whether your club is registered with the Australian Charities and Not-for-Profit Commission.
You do not need to submit copies of your financial reports, meeting minutes, or committee/member registers with the information statement. SHARE YOUR RULES WITH MEMBERS You must give each new member of your club a copy of the rules when they join. The rules can be in hardcopy or electronic format. Sharing links to where members can find the rules on your website or social media platforms is also acceptable. UPDATING YOUR CONSTITUTION It’s time to start considering what changes you will need to make to your Constitution, (if you haven’t done so already). As most clubs should now be aware, all associations under the Act must update their rules to comply with new requirements, by June 30, 2019. Please view the “Club Constitutions” page on the Clubs WA Member’s website for easy to follow processess and guides. We have also developed and made available Constitution templates for both licensed and nonlicensed clubs. Remember that ALL licensed clubs must first submit their draft updated constitution to Racing, Gaming and Liquor for PRIOR approval. AGMs & FINANCIAL REPORTING The requirements for financial reporting to members applicable to your club under the new law will depend on which reporting tier your club falls under. Each tier is calculated based on your club’s annual revenue. You can do a simple self-assessment to work out which tier your clubs belongs to and what information will need to be included in the financial report through the AssociationsOnline portal.
With the end of the financial year having just passed for the majority of incorporated clubs, management committees are reminded that its time to prepare for your Annual General Meeting (AGM). Associations have six months after the end of their financial year to hold their AGM, so groups operating on a 1 July to 30 June financial year will need to hold their meetings by no later than 31 December 2017. The new tiered reporting requirements are now in place, so please ensure your committee is aware of your club’s financial reporting responsibilities. Financial reporting is a major component of club governance and under the new Act there are increased penalties for committee members who fail to adhere to legislation. Clubs WA is aware of the costs involved in engaging professional financial services and as such we recommend that clubs with an audit requirement ensure they appoint an auditor that understands the club industry. It’s imperative to have your audit signed off to satisfy your constitution requirements prior to your scheduled AGM date. Clubs WA uses Francis A Jones as our auditor. Francis A Jones have also provided notes to assist your club with determining your income tax exemption status - please refer to page 11 for more information.

WASTE MANAGEMENT TIPS: FOR CLUB VENUES & EVENTS FROM CLUBS WA MANAGEMENT Reduce your ‘single-use’ items such as plastic cups, straws, plastic spoons, and paper napkins where you can. Serve tea, coffee and water in reusable mugs and cups at meetings and functions. You will still need to wash the mugs and cups after each use, but this process will reduce the amount of paper and plastic that goes to landfill. Provide more sustainable alternatives. Where you can’t cut out single-use items completely, such as at sporting carnivals or high-traffic events, try implementing ways that you can at least reduce your waste. You could have Club-Branded Reusable Coffee Mugs/Flasks made up that you can sell for a small amount at your coffee stands. This will reduce the amount of waste your event will contribute to landfill and decrease the amount of rubbish left on the grounds.
Whilst it might cost more to design and buy branded coffee mugs, unlike paper and plastic cups, you will actually be able to sell them for a small charge as well as getting the added bonus of free advertising if people keep using them after the event. There are also many stockists where you can buy ‘more sustainable’ ‘single-use’ items, such as takeaway coffee cups made from recycled materials or paper plates made out of biodegradable ingredients. Make the most of your leftover food. Making sure you strictly adhere to safe food handling and hygiene practices, there are ways to make the most of your leftover food in both a dollar and goodwill sense. • Plan a small event for the day following a big function and utilise your leftover produce. • Use leftover produce to make cheap meals to serve at the bar. • Partner with a local group such as Foodbank and donate your leftover food.

"BUT, I WAS JUST KIDDING!" How bad jokes can get your employees sacked and cost you a lot of money! By Viki Gnjatic, ClubsNSW Member Enquiries Team Leader Originally published in the April 2017 Club Life magazine
I think we all have that one person in our workplace who makes inappropriate jokes, is barely ever serious and often crosses the line leaving you thinking "Did he/she just say that?!" These characters are usually harmless and everyone knows what to expect. Often they are encouraged by their equally inappropriate colleagues. But sometimes these harmless "jokes" can get people sacked. If you require any guidance on acceptable joking standards in the workplace, take the next few cases as examples of what not to do (or say). In Michael Renton v Bendigo Health Care Group [2016], the applicant, who was a nurse, thought it would be hilarious to tag his colleagues in a sexually explicit Facebook video and comment that they were "slamming" each other, inappropriately decorate a colleague's desk as a "prank", and refer to a senior manager in crude, derogatory terms. So what happened to him? You guessed it, the nurse was dismissed for his conduct and he subsequently initiated proceedings in the Fair Work Commission (FWC) in the form of an unfair dismissal claim.
During the proceedings, the nurse conceded that his Facebook tag was sexually explicit but said he posted it to give his colleagues a laugh and was convinced they would not be offended. Interestingly, the FWC found that there was a valid reason for the dismissal but "on fine balance" the decision to terminate was "harsh in that it was disproportionate to the gravity of the misconduct". In determining the dismissal was harsh, the FWC considered the nurse's 18-year exemplary record, the one-off nature of the Facebook post, and that previous pranks in the workplace resulted in no disciplinary action. What this case shows is that while an employee's conduct may seem so outrageous that the only option is to instantly dismiss the employee, because the FWC considers other relevant factors such as employment history and personal circumstances, it is not always so simple to terminate employment. Another example of a prank gone wrong is in the case of Green v State of Queensland, Brooker and Keating [2017], which was initiated in the Queensland
Anti-Discrimination Commission and heard by the Queensland Civil and Administrative Tribunal (QCAT). A cleaner, who was tricked by his colleagues into believing he was cleaning up after a "sex romp" in a school staff room, developed psychological problems because of his "deep humiliation" and was awarded more than $150,000 in compensation. The cleaner's colleagues went to extreme lengths to set the scene and convince the cleaner it was real, including using mattresses, pillows and bedsheets from the sick bay. The colleagues eventually revealed that they orchestrated the prank and the cleaner initiated proceedings. The tribunal accepted that the impact of the prank, which amounted to sexual harassment and victimisation, was "very significant" and awarded damages. A word of caution to employers - the state was found vicariously liable for the acts of the two cleaners and was also ordered to pay compensation of $156,051. In another case recently heard in the NSW Industrial Relations Commission (NSW IRC), Torres v Commissioner of Police [2017], a senior special constable was dismissed for boasting about his sexual conquests, performing lewd acts and acting inappropriately towards his colleagues. The applicant's defence was that his acts were "innocent joking". Unsurprisingly, his behaviour was deemed to be sexual harassment and bullying, and his application for unfair dismissal was dismissed. That was never going to fly in the NSW IRC, or anywhere for that matter. Commissioner Murphy said there could be no doubt that the applicant openly discussed his sexual preferences in extremely vulgar language in front of his colleagues, including junior officers, both male and female. His conduct was deemed "well over the line" to be considered a joke. Staying on the theme of inappropriate conduct, in Mr Glenn Rogers v Allianz Insurance T/A Club Marine Insurance [2017], the FWC rejected claims an Allianz manager was unfairly sacked due to threatening comments made to a colleague if she did not stop talking during a taxi ride following a work social outing. Interestingly, his defence was that the comments were made at the club bar before the parties left in the taxi and that his colleague expressed "little objection" earlier that evening when someone accidentally made physical contact with her.
To make matters worse, he said he had "no regrets" and did not apologise. The FWC accepted that there was a valid reason for the manager's dismissal and dismissed his application. Just in case you have not been shocked enough by these decisions, I'll leave you with one more to ponder. Earlier this year, the QCAT ordered a hotel and its night caretaker to pay more than $300,000 in damages for the sexual assault of a female employee. The employee, a guest services agent, alleged that the caretaker sexually assaulted her in the bedroom of an employer-provided unit she shared with him at the hotel. She woke one morning at 5am to find him standing over her and acting inappropriately without her consent. The QCAT ruled that the assault constituted sexual harassment under state anti-discrimination laws and deemed the hotel and caretaker jointly liable, ordering $313,316 in damages. The hotel was held vicariously liable because the conduct occurred in the course of the caretaker's employment for the hotel - he was expected to be on-call between 10pm and 6am, hence his on-site accommodation. Now, in all seriousness, aside from teaching us a lesson or two about inappropriate jokes in the workplace, the last couple of cases demonstrate how employers can be held vicariously liable for the acts of their employees. It may seem ludicrous, but if such incidents occur during a person's employment, depending on the circumstances employers can also be liable. Having strong workplace policies and procedures should help prevent such conduct occurring. Regular training for all staff is also necessary to make sure employees understand what is acceptable behaviour in the workplace. You'd think that for grown adults what is and isn't acceptable would be common sense, but these cases have proven otherwise! Set amidst preparations for the Women’s AFL competition which began in February this year, Belinda Cipriano’s story ‘Finding footy’s feminine side’ is a fascinating portrait of the AFL’s National Female Development Manager – the remarkable Jan Cooper. Jan kicked off her career as a trainer at Swan Districts Football Club and worked with the WA Football Commission before accepting her current role. Over the past decade her campaigning for greater inclusivity in football has seen the number of women and girls involved in the sport leap from 16,000 to over 280,000 in 2015, and led to her induction into the WA Women’s Hall of Fame. Jan’s championing of women in football reflects the spirit of inclusivity and community-building at the heart of Clubs WA’s ‘My Club, My Community’ project. By taking a look at the grassroots beginnings of her wonderful career, Belinda’s article also highlighted how WA’s clubs community can act as a launching pad for future success. The two day event, which includes live entertainment and an evening meal, has grown considerably since the inaugural event way back in 2000. Sport and physical recreation organisations attract the most volunteers in Australia with about 14 per cent of the adult population (2.3 million people) donating their time each year. For clubs that cannot afford to employ a roster of fulltime paid staff, volunteers are the heart and soul of their operations. Creative tips to attract more volunteers to your club •

Be flexible and casual with your available volunteer positions. While you might be looking for a regular volunteer coach or official to watch over club games, for many casual volunteers the prospect of committing to a role which requires prior experience, further training or reference checks might seem just too difficult. To engage this type of volunteer who wants lots of flexibility, try offering a more generalist volunteer role where the level of responsibilities are not as high. Approach hobbyists - Try looking for Graphic Design or Journalism volunteers to help your club with social media and newsletters. Many university or school graduates would love the opportunity to help you with your marketing and public relations activities. You might be able to find some willing individuals who love taking photographs for a hobby – ask them if they would like to take photos of your games or your member nights. The volunteer would get such enjoyment out of this, and your club will get some great photos.

Promotion - Word-of-mouth is a powerful recruitment tool! Even if members attend regular games or events, they might not realise there are volunteer opportunities available.

Make volunteering quick, easy and flexible - Develop a simple form which allows individuals to fill in their details and submit their expressions of interest to volunteer at your club. This provides your club with access to a database of potential volunteers which you can group and sort into categories for when future opportunities arise.

Recognition - Include recognition as part of your volunteer recruitment and retainment plan. While volunteers understand that there is no real expectation of reward or formal compensation when they commit to helping out, it’s always nice to show your appreciation and recognise their valuable contributions. So whilst financial reimbursement for travel and out-of-pocket expenses are certainly ways to show appreciation for your volunteers, a sincerely written thank you note expressing appreciation for a volunteer’s effort and time, or a round of free food and drink down at the club bar may be all you need to keep your volunteers feeling happy and content.
There are so many great resources available to help you find your next volunteer. Gumtree Gumtree is Australia’s biggest local classifieds website, and allows users to purchase and sell second-hand goods, and advertise and find jobs (among many other things). Your club could post job and volunteer positions on the site for free. However, if you’re posting multiple adverts in the same category, Gumtree might ask you to pay a small fee. Volunteering WA The Volunteering WA website is a fantastic tool for volunteers and allows not-for-profit organisations to advertise volunteering positions. Universities Universities such as Curtin University often help their students link up with organisations who are offering volunteer, intern or junior paid positions. Volunteering for not-for-profit organisations is a great learning experience for students or recent graduates who want to gain more real-life experience before they start searching for fulltime work.
