Dear Member, The recent Clubs WA Industry Awards showed just how incredibly important our clubs are to their local communities. On behalf of our State Council and staff, I would like to congratulate all our winners and finalists on this amazing achievement. We were very fortunate this year to have had three Government Ministers attend our Awards as our special guests. The Hon. Paul Papalia CSC MLA spoke about the Liquor Control Amendment Bill, which at the time of print is currently being debated in the Legislative Council. We remain hopeful that this legislation will pass and if so it will then allow our clubs to cater for genuine tourists. Minister Papalia stayed on to present our Club of the Year Awards to Gosnells Bowling Club (Small Category), Sorrento Bowling Club (Medium Category) and Swan Yacht Club (Large Category). The Hon. Michelle Roberts MLA announced the winner of the Road Safety Commission’s award for Clubs in the Community – Special Projects, this year won by the Princess Royal Sailing Club in Albany for their “Fishability” program. The Hon. Minister Mick Murray MLA presented the certificates and awards for our Volunteer Categories, with the winning entrants this year going to Jo Ryan from Thornlie Football & Sports Club and Eric Innes from Kellerberrin & Districts Club. We were also lucky enough to have a drop in from the Minister for Veteran’s Affairs, the Hon. Peter Tinley AM, MLA! The Shadow Minister for Racing and Gaming; Sport and Recreation, John McGrath MLA, also attended the night to celebrate our industry. Our club industry has a modest workforce of approximately 6,000 people, however we have the highest number of volunteers than any other sector in this state, which if paid would be at a value of over $88 million per annum. Our clubs, and their volunteers and staff, are the silent heroes of the WA community. They are the glue that holds the locals together, whether by creating safe places for sport and socialisation in the city, to providing all the facilities for the community to gather in the country. These efforts continue to shape the physical and mental health of all West Australians. So thank you all, for ensuring the future of our communities. Best wishes, Karen

Holly will be heading off to Scotland later this month to take on marketing and events over there. Ian Dang has now taken over the marketing and events position at Clubs WA and will be here to provide support to clubs just as Holly was. Ian comes from a strong corporate and not for profit background and will add valuable experience and skills as we move into our next chapter - read more about Ian on page 13.
A reminder that Clubs WA has developed comprehensive constitution templates which are available for download from the member’s section of the Clubs WA website. There are two templates available, one for licensed clubs and one for nonlicensed clubs.

In case of inspection by RGL over winter, make sure that your required signage and registers are up-to-date and that all staff and volunteers know where to locate such materials. Clubs WA is more than happy to come out to your venue and conduct an ‘audit’ to better prepare your club and staff for formal RGL inspections.

Clubs WA Welcomes Ian Dang
I’m Ian, I have recently joined the Clubs WA team as the Marketing and Business Development Coordinator. Born and raised in Perth, I completed my studies at Curtin University and for many years worked overseas in China, Laos, South Korea and Vietnam. My direct experience with sporting clubs has been with Mission Hills Golf Club in China. I was privileged to organise international projects, such as: The World Cup of Golf; Hollywood Celebrity Golf Tournaments; Tiger Wood’s Golf Clinic; reciprocal partnerships; and golf tours. I have over 10 years’ experience in the not-for-profit and charity sector, in Australia and overseas. I am also an active volunteer and a member of Rotary, Befriend and Global Hand Charity. I understand the challenges that most clubs and associations face on a daily basis and I plan to utilise my experience to improve upon the awesome foundation the Clubs WA team have created. My ultimate goal is to leverage the Clubs WA brand as an Industry Leader in Western Australia. I look forward to meeting you all in person to share our ideas and experiences to make all clubs successful and filled with memorable fellowship experiences. PROCESS FOR CHANGING YOUR CLUB CONSTITUTION Please note: *Steps 8 and 12 are only relevant for clubs with a liquor licence. Unlicensed clubs and associations & those with Special Facility or Tavern Licences can skip steps 8 and 12. 1. Download the Clubs WA template constitution from the member section of the website: https://www.clubswa.com. au/Members/Club-Constitutions/Licensed-Club-Constitution-Template 2. Ensure you have the most current constitution on file. If unsure you can check with Consumer Protection Division of The Department of Mines, Industry Regulation and Safety - as the only current copy is the one that they hold in their system. P: 1300 304 074. 3. Discuss what your club wants to change in your constitution and what needs to remain fixed in the constitution. 4. Draft the suggested changes at the sub-committee or management committee level. 5. Obtain approval at the management committee level. 6. Send your draft to Clubs WA for review. 7. Review Clubs WA feedback and amend as necessary. 8. *Send the final draft to Racing, Gaming and Liquor (RGL) for comment (you will need to follow this up). Please email this in the first instance to rgl@dlgsc.wa.gov.au and then follow up with a phone call 2 weeks later if you have not heard anything – at this time ask to speak to the person that has been assigned your draft. You need to allow at least one month for this process with RGL. Obtain a written response from RGL on your draft changes. 9. Ensure that the proposed changes are noted in a Special Notice of Motion to your members, with the timeframe as indicated in your current constitution. All members (including non-voting) must be advised as per your current constitution requirements. 10. Hold your General or Special General Meeting to have the Special Resolution accepted. This agenda item must be raised by the AGM convener (as per your constitution) as a Special Resolution. It should be moved and seconded by a committee member involved in the process and must be passed by a three-quarters majority of the Delegates present and voting. 11. Within one month of the passing of a special resolution to alter your constitution (the rules) you must lodge your constitution and notice of the special resolution with the Commissioner for Consumer Protection. The notice must set out the particulars of the alteration and include certification by a member of the committee that the resolution was duly passed as a special resolution and that the rules of the association as altered conform to the requirements of the Act. Associations Form “Notice of Special Resolution to Change Rules” **must be completed and the appropriate lodgement fee (either post or online) must accompany the notice. Current schedule of fees are: $37.50 (rules); $50.00 (rules, name or objects/surplus property); $62.50 (rules, name and objects/surplus property) – discounts may apply for online submission. www.commerce.wa.gov.au/publications/notice-special-resolution-change-rules ** If the person lodging the changes is NOT a committee member, they will be referred to as an agent and in addition to the form above must ALSO have a committee member complete the Certificate and statement of a management committee member (Complete Section A and Section B: Change of Rules) and either lodge this via post or PDF and upload online: www.commerce.wa.gov.au/sites/default/files/atoms/files/certstatemngmtcmtmber.pdf Lodging your revised constitution and forms can be done via post or online at: https://associations.commerce.wa.gov. au/associations/public/publicHomePage.jspx 12. *You will also need to inform Racing, Gaming and Liquor of your final changes with a copy of your changes and a cover letter with the changes made to the Director of the Licensing Division.

Associations Incorporation Act 2015 – Schedule 1 matters to be provided for in rules of an incorporated association Constitution inclusion checklist for both licensed and non-licensed clubs.
SCHEDULE 1 DIVISION 1 — MATTERS TO BE ADDRESSED IN YOUR CONSTITUTION: 1. The name of the incorporated association. 2. The objects or purposes of the incorporated association. 3. The qualifications (if any) for membership of the incorporated association and provision for when membership commences and when it ceases. 4. The register of members of the incorporated association. 5. The entrance fees, subscriptions and other amounts (if any) to be paid by members of the incorporated association. 6. The name, constitution, membership and powers of the management committee or other body having the management of the incorporated association (in this clause referred to as the committee) and provision for the following: (a) the election or appointment of members of the committee. (b) the terms of office of members of the committee. (c) the grounds on which, or reasons for which, the office of a member of the committee shall become vacant. (d) the filling of casual vacancies occurring on the committee. (e) the quorum and procedure at meetings of the committee. Bulk-Purchase Breathalyser Program for Clubs For clubs considering purchasing a wall-mounted breathalyser unit for your club, Clubs WA has arranged with Andatech a bulk-purchase discount, that would allow you to receive an almost 50% discount on your breathalyser unit. • Purchase the unit at the heavily discounted price of $1,650 (the model wholesales for $3,200). • Split profits from the PayPass machine 50/50 with the breathalyser company, Andatech - this is how Andatech can recoup some of the costs with giving clubs so a huge discount. • This scheme has been organised to all clubs to reduce the otherwise significant upfront costs. • Contract term can be individually negotiated for 3-5 years. • The scheme includes the year one calibration fee of $240. Alternatively, you can purchase drinking straws from your usual hospitality provider. Early termination of contract Minimum 6-month notice of cancellation of contract is required by Andatech. Otherwise a $424 earlytermination fee will apply. Service and Maintenance Annual calibration and servicing (calibration is $240 per year). The new calibration parts will be posted to the club each year and the club can easily switch over the new parts for reading. Insurance The Equipment is held at your risk during the term of this Agreement and it is your responsibility to maintain adequate insurance in respect of the Equipment in respect of theft, loss, damage for the term of this Agreement.

Regional WA wins big with Government sport upgrades Country Western Australia is the big winner in the latest round of the Community Sporting and Recreation Facilities Fund (CSRFF), with the Government awarding 80 per cent of grant allocations to organisations based in the regions. The latest CSRFF small grants round has allocated more than $582,000 to 20 grassroots sport and recreation organisations across WA, 16 of which are based in the country. Funded projects in this round include upgrades to female facilities at sport and recreation clubs, resurfacing of courts and playing spaces, and other important infrastructure and forward planning initiatives. CSRFF grants not only provide critical support to grassroots sport and recreation organisations, they generate work for small businesses in a range of industries, creating jobs and supporting local economies. Metropolitan projects receiving funding in this round include: • Melville Little Athletics Centre (City of Melville): $18,030 for relocation of the jumps track and pit; • City Beach Surfriders Club (Town of Cambridge): $16,500 for installation of a storage shed.
Regional projects receiving funding in this round include: • King River Horse & Pony Club (City of Albany): $9,350 for the design and construction of new jumps for the cross country course; • Broome Bowling Club (Shire of Broome): $32,100 to upgrade and replace lighting; • Broome Squash Club (Shire of Broome): $18,000 for the installation of a storeroom • Shire of Mingenew: $66,458 to rebuild the Mingenew netball courts; • Wonthella Bowling Club (City of Greater Geraldton): $66,519 for the installation of a synthetic green; • South Mandurah Football Club (City of Mandurah): $60,455 for the construction of new unisex change room facilities; • Dudley Park Bowling and Recreation Club (City of Mandurah): $42,342 to resurface bowling green; • Tom Price BMX Club (Shire of Ashburton): $37,525 to repair the track and bituminise berms; • Tom Price Diamond Club (Shire of Ashburton): $12,075 to install a home run fence; • Koombana Bay Sailing Club (City of Bunbury): $35,000 to upgrade men’s ablutions; and • Harvey Football Club (Shire of Harvey): $57,600 for a new ablution block for female competitors.

Committee Responsibilities It is the overall responsibility of the Club Management Committee to manage the club in accordance with the purposes or objects stated in the Constitution, including specific responsibilities: • • • •

Under the Associations Incorporation Act 2015, every committee member of the club: • is obliged to take all reasonable steps to ensure the association complies with its obligations under the Act. • must exercise their powers and discharge their duties with the degree of care and diligence that a reasonable person would exercise if that person: • were an officer of the association in the association’s circumstances; and • occupied the office held by, and had the same responsibilities within the association as, the officer. • must exercise their powers and discharge their duties: • in good faith in the best interests of the association; and • for a proper purpose. • must not improperly use their position to: • gain an advantage for the officer or another person; or • cause detriment to the association.

Community TAB Set to Boost Regions Community TAB is partnering with Netball WA to provide support for regional and Indigenous players across Western Australia. Community TAB’s Major Contributing Partnership sees a $40,000 contribution towards the Aboriginal Grassroots and All Stars Programs which will fund equipment, uniforms, coaches, umpires and off court education program. Community TAB proudly promotes the Corporate Social Responsibility of Racing and Wagering WA by giving back to the WA community and is entering this partnership with Netball WA to further its contribution in the WA sporting community, regional WA and Indigenous community. The Aboriginal All Stars program rewards the most talented young indigenous players across Western Australia with the opportunity to play and compete at an elite level, while the Grassroots Program operates out of 10 sites throughout the State, and runs from March to September each year, with players aged between
5-18. Each site varies in size, with an average engagement of 100 Aboriginal women involved in each site across the program as well as family and local community members also volunteering their time. With clubs and competitions in every major town throughout the state, engaging with more than 200,000 participants, over 8,500 of those identifying as Aboriginal and Torres Strait Islander, Netball WA has a diverse portfolio of programs and activities. Netball provides a positive environment and nurtures local role models to improve health and wellbeing and build sustainable capacity for regional towns and local communities. Iftar Celebrations Written by Jean Davis Office Assistant, Clubs WA
In collaboration with Gosnells Football Club, Chris Tallentire MLA Member for Thornlie hosted an Iftar dinner to join in the breaking fast celebrations with the Muslim Community. The evening celebrations started at 5:15pm with an introduction from Chris Tallentire who kindly thanked everyone for taking part in this special event. He then introduced Sheikh Mubarak who led a powerful Azaan Call to Prayer. All around members of the Muslim community proceeded to break their fast with some water and dates. Following the initial breaking of fast, table by table, people made their way to the delicious buffet of Middle Eastern food. During the feast, members of the Muslim and non-Muslim communities engaged in conversation, inclusive of all sorts of topics, from careers, to fasting hours, childhood and more. This was an amazing opportunity to connect with people from different backgrounds and beliefs and ask questions that you might not have an opportunity to ask in your day to day life. it was a real eye opening experience for members of all communities.
Once the event officially finished, many stayed to continue their conversations with their new-found friends. The President of the Gosnells Football club, Michael McCaughan said that the event was a positive step forward for the community. “This was a great inititave that brought so many different people together, to celebrate something that many people haven’t of before.” This collaboration was a well thought out idea that helped to bring so many different members of the community together to understand something that many people don’t have knowledge of. A big thank you to Chris Tallentire MLA for setting up this event and to Gosnells Football Club for being such great and accommodating hosts.
As desserts, tea and coffee were served, three individuals were called up to participate in a Q&A. The first participant was Father Phillip Perreau from Gosnells Catholic Church, the second participant was a Turkish gentleman who followed Islam and the third participant was an Australian lady who converted to Islam. A range of questions were asked to the three participants, ranging from their backgrounds, to the meaning of Iftar, how it is different to other religions and many more thought-provoking questions. The responses to the questions were outstanding and provided everyone with a more in-depth understanding of the Muslim religion and the people in its community.

Responsible Promotion of Liquor WRITTEN BY CLUBS WA MANAGEMENT As per the Liquor Control Act 1988
The Liquor Control Act 1988 places an obligation on licensees to sell and supply liquor in a responsible manner. Section 64(3) of the Act empowers the licensing authority to impose conditions on a licence to prohibit promotional activity in which drinks are offered free or at reduced prices; or to prohibit any practice that encourages the irresponsible consumption of alcohol. All licensees have an obligation and responsibility to ensure that any liquor promotion is consistent with the primary object of minimising alcohol related harm.
ACCEPTABLE PRACTICES • A maximum of two ‘traditional happy hours’ (i.e. of 60 minutes duration) during or immediately following normal day-time working hours, provided there is at least four hours separation between each happy hour and any happy hour has ceased by 7.00pm. • Promotions involving low alcohol beer where it is clear from the promotional material that it is a low alcohol beer promotion. • The in-house offer of a consistent price for a particular type or brand of liquor across the entire trading hours of the premises on a given day or night, providing the price is not so low that it will, in itself, encourage the excessive consumption of alcohol and intoxication. • Promotions of particular brands of liquor that provide incentives to purchase the brand by virtue of a consistent discounted price, offer a prize etc., that do not provide an incentive to consume the produce rapidly and to excess. • The provision of a complimentary drink to invited guests, provided the invitation is via a mail list or other direct correspondence maintained as part of a bona fide club/reward system (i.e. where persons have acknowledged their willingness to receive such invitations and a list of names has not been developed from, for example, a competition).
UNACCEPTABLE PRACTICES • The external advertising of a complimentary drink upon arrival, unless the drink is provided ancillary to another service such as accommodation or food. • Drinks that offer alcohol in non-standard measures and or by virtue of their emotive titles such as – ‘laybacks’, ‘shooters’, ‘slammers’, ‘test tubes’, ‘blasters’ – and their method of consumption encourages irresponsible drinking habits and are likely to result in rapid intoxication. • Drink cards that provide a multiple of free drinks, extreme discounts or discounts of limited duration on a given day or night and or have the capacity to be readily stockpiled by patrons or transferred to other patrons. In other words, the drink card must not, by design or potential misuse, create an incentive for patrons to consume liquor more rapidly, and/or in greater amounts than they otherwise might. • Promotional cards, vouchers or incentives providing free or discount drinks which are distributed away from the licensed premises. • Promotions of cheap alcohol, for a limited duration, in which cheap alcohol is the enticement for people to consume liquor on the premises and which may encourage the irresponsible consumption of liquor (unless indicated as an ‘Acceptable Practice’). • Any labelling or titling of promotions that may encourage patrons to consume liquor irresponsibly and excessively to an intoxicated state. • The refusal to serve half measures of spirits on request or provide reasonably priced nonalcoholic drinks. • Any promotion that encourages a patron to consume liquor excessively – ‘all you can drink’ offers, ‘free drinks for women’, ‘free drinks for women all night’, ‘two for one’ – and to consume liquor in an unreasonable time period.
